		<official-title>To amend the Internal Revenue Code of 1986 to provide a
		  credit for the purchase of plug-in hybrid vehicles.</official-title>

		<section display-inline="no-display-inline" id="H0B769D06D6BB4200001261E137641FF" section-type="section-one"><enum>1.</enum><header>Credit for plug-in hybrid
			 vehicles</header>
			<subsection id="H391548C24E734491A5DE8D9B8222CBFF"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subpart B of part IV
			 of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 (relating to
			 other credits) is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="HBB0FE06A43964F819B6030AB6F417B22" style="OLC">
					<section id="HBA635B545BB842C0B11503259D6B7F50"><enum>30D.</enum><header>Plug-in hybrid
				vehicles</header>
						<subsection id="H176BA9C0D9D94ED20027B81399FE967B"><enum>(a)</enum><header>Allowance of
				credit</header><text display-inline="yes-display-inline">There shall be allowed
				as a credit against the tax imposed by this chapter for the taxable year an
				amount equal to 10 percent of the cost of any qualified plug-in hybrid vehicle
				placed in service by the taxpayer during the taxable year.</text>
						</subsection><subsection id="H920F573137414D2A9F6869897717B54D"><enum>(b)</enum><header>Limitations</header>
							<paragraph id="H8B893B081C5E4FBE95DF4800BBB50010"><enum>(1)</enum><header>Limitation per
				vehicle</header><text>The amount of the credit allowed under subsection (a) for
				any vehicle shall not exceed the sum of—</text>
								<subparagraph id="H61A979B2A17446AB00786FFE135B2BDC"><enum>(A)</enum><text display-inline="yes-display-inline">$4,000 in the case of a plug-in electric
				drive vehicle with 4kWh traction battery, and</text>
								</subparagraph><subparagraph id="H0771CCA0908144B0A95C922E56E3106E"><enum>(B)</enum><text display-inline="yes-display-inline">$250 for each additional kWh of traction
				battery capacity of such vehicle as exceeds 4kWh but does not exceed
				50kWh.</text>
								</subparagraph></paragraph><paragraph id="HBED200220A8041A4A71161E22DCBB511"><enum>(2)</enum><header>Application with
				other credits</header>
								<subparagraph commented="no" id="HBB947C7ED5AB4FF3B2882DABB99DB8D1"><enum>(A)</enum><header>Business credit
				treated as part of general business credit</header><text display-inline="yes-display-inline">So much of the credit which would be
				allowed under subsection (a) for any taxable year (determined without regard to
				this paragraph) that is attributable to property of a character subject to an
				allowance for depreciation shall be treated as a credit listed in section 38(b)
				for such taxable year (and not allowed under subsection (a)).</text>
								</subparagraph><subparagraph id="H22730420A882495DBDDE117992D4B9E5"><enum>(B)</enum><header>Personal
				credits</header><text>The credit allowed by subsection (a) for any taxable year
				shall not exceed the excess (if any) of—</text>
									<clause id="H081D0474482E424682EEBAF1816A642"><enum>(i)</enum><text display-inline="yes-display-inline">the sum of the regular tax liability (as
				defined in section 26(b)) plus the tax imposed by section 55, over</text>
									</clause><clause id="H51D7299E5EA04716B181DDF70042A5A3"><enum>(ii)</enum><text>the sum of the
				credits allowable under subpart A and subpart B (other than this
				section).</text>
									</clause></subparagraph></paragraph></subsection><subsection id="H3B8FDBB8C7744D428F4CFA67B03E2FBC"><enum>(c)</enum><header>Qualified
				plug-In hybrid vehicle</header><text>For purposes of this section—</text>
							<paragraph id="H6047612BBAB042B9BD9DB9AB860087C"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The term
				<term>qualified plug-in hybrid vehicle</term> means a motor vehicle (as defined
				in section 30(c)(2))—</text>
								<subparagraph id="H00F05D703DFA46279B72073694C4579B"><enum>(A)</enum><text>the original use
				of which commences with the taxpayer,</text>
								</subparagraph><subparagraph id="H731348BC7F5D49B9A814712605750014"><enum>(B)</enum><text>which is acquired
				for use or lease by the taxpayer and not for resale,</text>
								</subparagraph><subparagraph id="HF29BC2ABF8B8489E9CD3A4AB2E5FF6CD"><enum>(C)</enum><text>which is made by a
				manufacturer,</text>
								</subparagraph><subparagraph id="H7E60BE32E48046A58F943C50D57962C9"><enum>(D)</enum><text display-inline="yes-display-inline">which has received a certificate of
				conformity under the Clean Air Act, and</text>
								</subparagraph><subparagraph id="HEAAE6155C282452BA58DEFFF1D6B1307"><enum>(E)</enum><text display-inline="yes-display-inline">which has not less than 2 onboard sources
				of stored energy, different in character from each other, from which to draw
				propulsion energy, where—</text>
									<clause id="H6AC1245E472E4A48AAE29C5444402500"><enum>(i)</enum><text>at
				least 1 of such sources is energized by plugging into an external source of
				electric power, and</text>
									</clause><clause id="H121DC5D4D41C41B2BE874432C549C2E"><enum>(ii)</enum><text display-inline="yes-display-inline">at least 1 of such sources is energized
				from an internal combustion engine, fuel cell, or other means, and such source
				is utilized to provide mechanical propulsion to the vehicle.</text>
									</clause></subparagraph></paragraph><paragraph id="HBCFEF15D804045F900867CCA55D8BCD"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">The term <term>qualified plug-in hybrid
				vehicle</term> shall not include any vehicle which is not a passenger
				automobile or light truck if such vehicle has a gross vehicle weight rating of
				less than 8,500 pounds.</text>
							</paragraph><paragraph id="H963BC6538136414799B14416C48D00A7"><enum>(3)</enum><header>Other
				terms</header><text display-inline="yes-display-inline">The terms “automobile”,
				“passenger automobile”, “light truck”, and “manufacturer” have the meanings
				given such terms in regulations prescribed by the Administrator of the
				Environmental Protection Agency for purposes of the administration of title II
				of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7521">42 U.S.C. 7521 et seq.</external-xref>).</text>
							</paragraph><paragraph id="H119FDBFDA90F4207B6BF8DB71ECF4D00"><enum>(4)</enum><header>KWh traction
				battery capacity</header><text display-inline="yes-display-inline">The term
				<term>kWh traction battery capacity</term> means the size of an electro
				chemical storage device, expressed in kWh, as measured from a 100 percent state
				of charge to 0 percent state of charge.</text>
							</paragraph></subsection><subsection id="HB4D530E358C0457097CED6DC86C95CB5"><enum>(d)</enum><header>Special
				rules</header>
							<paragraph id="H588B429CEB554865BAF29BE7890000B4"><enum>(1)</enum><header>Basis
				reduction</header><text>The basis of any property for which a credit is
				allowable under subsection (a) shall be reduced by the amount of such credit
				(determined without regard to subsection (b)(2)).</text>
							</paragraph><paragraph id="H2334A38C611049D0A3FB0039362BCE09"><enum>(2)</enum><header>Recapture</header><text>The
				Secretary shall, by regulations, provide for recapturing the benefit of any
				credit allowable under subsection (a) with respect to any property which ceases
				to be property eligible for such credit.</text>
							</paragraph><paragraph id="H1F115BBAF4C34530B92C112C38EFF887"><enum>(3)</enum><header>Property used
				outside United States, etc., not qualified</header><text>No credit shall be
				allowed under subsection (a) with respect to any property referred to in
				section 50(b) or with respect to the portion of the cost of any property taken
				into account under section 179.</text>
							</paragraph><paragraph id="H4CBB8E7778914B7EB48CB7EC89B8F76"><enum>(4)</enum><header>Denial of double
				benefit</header><text display-inline="yes-display-inline">No credit shall be
				allowed under this section with respect to a vehicle if a credit or deduction
				is allowed with respect to such vehicle under any other provision of this
				title.</text>
							</paragraph><paragraph id="H4128D34BA03440D98CA8FE7F692A5CA"><enum>(5)</enum><header>Election not to
				take credit</header><text>No credit shall be allowed under subsection (a) for
				any vehicle if the taxpayer elects to not have this section apply to such
				vehicle.</text>
							</paragraph><paragraph id="HA808A42F3E7B4CC7BCC2849FAF710F3"><enum>(6)</enum><header>Property used by
				tax-exempt entity; interaction with air quality and motor vehicle safety
				standards</header><text>Rules similar to the rules of paragraphs (6) and (10)
				of section 30B(h) shall apply for purposes of this section.</text>
							</paragraph></subsection><subsection id="HCD6706EB973B40E2A3124BBC21B4EC20"><enum>(e)</enum><header>Termination</header><text>This
				section shall not apply to any property placed in service after December 31,
				2014.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD33688C525ED4CA3B4DBA3D06C552E2"><enum>(b)</enum><header>Plug-in hybrid
			 vehicles not counted toward limitation on number of new qualified hybrid
			 vehicles eligible for <enum-in-header>30B
			 </enum-in-header>credit</header><text>Section (30)(B)(f)(5) of such Code
			 (defining qualified vehicle) is amended by adding at the end the following new
			 sentence: <quote>Such term shall not include a qualified plug-in hybrid vehicle
			 (as defined in section 30D(c)).</quote>.</text>
			</subsection><subsection commented="no" id="H8DAC7D2B0C7449209443258450B138C3"><enum>(c)</enum><header>Credit made part
			 of general business credit</header><text display-inline="yes-display-inline">Section 38(b) of such Code is amended by
			 striking ‘‘and’’ at the end of paragraph (30), by striking the period at the
			 end of paragraph (31) and inserting ‘‘, plus’’, and by adding at the end the
			 following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HCB8D55F3DAAB4733BCB586FF3FE161B" style="OLC">
					<paragraph commented="no" id="H2BE37BAF1DB24D81BB2E4E5D1D61C7C4"><enum>(32)</enum><text display-inline="yes-display-inline">the portion of the plug-in hybrid vehicle
				credit to which section 30D(b)(2)(A)
				applies.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H435AA6C48C8B46659BFCD00726DB25EF"><enum>(d)</enum><header>Conforming
			 amendment</header><text>Section 6501(m) of such Code is amended by inserting
			 <quote>30D(d)(5),</quote> after <quote>30C(e)(5),</quote>.</text>
			</subsection><subsection id="H09C6D4FF8C7548AF80262118F43B549"><enum>(e)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after December 31, 2007.</text>
