<section section-type="section-one" id="H5B90CF80859B4EF888E0E7F4BC563A2" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Revolutionary War and War of 1812 Battlefield Protection Act</short-title></quote>.</text></section> 
<section id="HF9EC526A806D46398F138E5BA2DA437"><enum>2.</enum><header>Battlefield Acquisition Grant Program for battlefields of the Revolutionary War and War of 1812</header> 
<subsection id="H71C6A587033A4FEEAF6590D33DECE0B8"><enum>(a)</enum><header>Grant program</header><text>The American Battlefield Protection Act of 1996 (section 604 of division I of <external-xref legal-doc="public-law" parsable-cite="pl/104/333">Public Law 104–333</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/16/469k">16 U.S.C. 469k</external-xref>) is amended—</text> 
<paragraph id="HD4EB2E23561546B288A0F31CEF53E658"><enum>(1)</enum><text>by redesignating subsection (e) as subsection (f); and</text></paragraph> 
<paragraph id="HAEE98B0B2608456F8C4E76BE81B8BA22"><enum>(2)</enum><text>by inserting after subsection (d) the following new subsection:</text>

<subsection id="HDE9194A60085430EA98C581B074326B8"><enum>(e)</enum><header>Battlefield acquisition grant program for battlefields of the revolutionary war and war of 1812</header> 
<paragraph id="HF4A29E2EE69F41D392BCAB3EB5506C81"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text> 
<subparagraph id="HBC2C52510F5D4203878775A2EA993BB9"><enum>(A)</enum><header>Battlefield report</header><text>The term <term>battlefield report</term> means the document entitled <quote>Report to Congress on the Historic Preservation of Revolutionary War and War of 1812 Sites in the United States</quote>, prepared by the National Park Service, and dated September 2007.</text></subparagraph> 
<subparagraph id="H07BB6D17265A4A27A5408D84F045BC6B"><enum>(B)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a State or local government.</text></subparagraph> 
<subparagraph id="H115AC80846DF4B788C005D6959C3F9E3"><enum>(C)</enum><header>Eligible site</header><text>The term <term>eligible site</term> means a site that—</text> 
<clause id="HDDAFDF046E1045318090156F7BFA9B4F"><enum>(i)</enum><text>is not within the exterior boundaries of a unit of the National Park System; and</text></clause> 
<clause id="HDEBBAA4637DE48DF887F888B9F36FF88"><enum>(ii)</enum><text>is identified in the battlefield report.</text></clause></subparagraph> 
<subparagraph id="H5E36009FC5204EAFAFBFD7D946D5E9AB"><enum>(D)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the American Battlefield Protection Program.</text></subparagraph></paragraph> 
<paragraph id="H697685A921BA48B899CD0354ADA368CD"><enum>(2)</enum><header>Establishment</header><text>The Secretary shall establish a battlefield acquisition grant program for nationally significant battlefields and associated sites of the Revolutionary War and the War of 1812 under which the Secretary may make grants to eligible entities to pay the Federal share of the cost of acquiring fee-simple or lesser interests from willing sellers in eligible sites for the preservation and protection of those eligible sites.</text></paragraph> 
<paragraph id="H28AC07D323534CE78032E7279F0805D5"><enum>(3)</enum><header>Nonprofit partners</header><text>An eligible entity may acquire an interest in an eligible site using a grant under this subsection in partnership with a nonprofit organization.</text></paragraph> 
<paragraph id="H9C44A6BE8D5C407E82A88B95B2FFE399"><enum>(4)</enum><header>Non-federal share</header><text>The non-Federal share of the total cost of acquiring an interest in an eligible site under this subsection shall be not less than 50 percent.</text></paragraph> 
<paragraph id="HE623C74E68D2498787FF593449708B61"><enum>(5)</enum><header>Limitations on land use</header><text>An interest in an eligible site acquired under this subsection shall be subject to section 6(f)(3) of the <act-name parsable-cite="LWCFA">Land and Water Conservation Fund Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/4601-8">16 U.S.C. 4601–8(f)(3)</external-xref>).</text></paragraph> 
<paragraph id="H130B02AC31E34989BD7D64A9B0973E47"><enum>(6)</enum><header>Reports</header> 
<subparagraph id="H93A464EEED154819BDA30074211137B8"><enum>(A)</enum><header>In general</header><text>Not later than 5 years after the date of the enactment of this subsection, the Secretary shall submit to Congress a report on the activities carried out under this subsection.</text></subparagraph> 
<subparagraph id="H1156AD2442274AE09CAA60E424D3498"><enum>(B)</enum><header>Update on battlefield report</header><text>Not later than 3 years after the date of the enactment of this subsection, the Secretary shall submit to Congress a report that updates the battlefield report to reflect—</text> 
<clause id="H725E9DE2FBD8489B81204201C72D84D5"><enum>(i)</enum><text>preservation activities carried out at the 677 battlefields and associated sites identified in the battlefield report during the period between publication of the battlefield report and the update;</text></clause> 
<clause id="HAFE54166FF42476CA03EFB41F2C7C6AE"><enum>(ii)</enum><text>changes in the condition of the battlefields and associated sites during that period; and</text></clause> 
<clause id="H589A677D3EC348979EA4BAFD3CCC7B08"><enum>(iii)</enum><text>any other relevant developments relating to the battlefields and associated sites during that period.</text></clause></subparagraph></paragraph> 
<paragraph id="H818201D9BF1F4F4B9C00066E6932AD56"><enum>(7)</enum><header>Authorizations of appropriations</header> 
<subparagraph id="H35C93419AAB047C58D7599CE141DC83D"><enum>(A)</enum><header>In general</header><text>There are authorized to be appropriated to the Secretary from the Land and Water Conservation Fund to provide grants under this subsection $10,000,000 for each of fiscal years 2009 through 2013.</text></subparagraph> 
<subparagraph id="H65B15497428143CFB3A1ADE805DD4158"><enum>(B)</enum><header>Update of battlefield report</header><text>There are authorized to be appropriated to the Secretary to carry out paragraph (6)(B), $500,000.</text></subparagraph></paragraph></subsection> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H4DE0D40591054CF1B5B69E801BCAFCDA"><enum>(b)</enum><header>Conforming amendments</header> 
<paragraph id="H662BB6297B8E4FE5B915E09477B3256"><enum>(1)</enum><header>References to other battlefield acquisition program</header><text>Subsection (d) of the American Battlefield Protection Act of 1996, as added by section 3 of Civil War Battlefield Preservation Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/359">Public Law 107–359</external-xref>; 116 Stat. 3016), is amended—</text> 
<subparagraph id="HEEA368E523A84F769C62D93124BF218"><enum>(A)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">Battlefield Acquisition Grant Program</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Battlefield Acquisition Grant Program for Battlefields of the Civil War</header-in-text></quote>; and</text></subparagraph> 
<subparagraph id="HB6FF6B19660B47599C43F28CF7903CD"><enum>(B)</enum><text>in paragraph (2), by striking <quote>grant program</quote> and inserting <quote>grant program for battlefields of the Civil War</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H0A20196EEB304597A5B38C53CFD5E12"><enum>(2)</enum><header>Termination of authority</header><text display-inline="yes-display-inline">Subsection (f) of the American Battlefield Protection Act of 1996, as redesignated by subsection (a)(1), is amended—</text> 
<subparagraph id="H1C59566C9FB04B07BF75735671BF4050"><enum>(A)</enum><text display-inline="yes-display-inline">in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">Repeal</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Expiration</header-in-text></quote>; and</text></subparagraph> 
<subparagraph id="HEB57C59209D943ABA4F357CF59EFFEFF"><enum>(B)</enum><text>in paragraph (1), by striking <quote>is repealed</quote> and inserting <quote>expires</quote>.</text></subparagraph></paragraph></subsection></section>
