		<section display-inline="no-display-inline" id="HBCA9D5F9C85E4C8483806E756E9E5647" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Emergency Coverage During an Incident
			 of National Significance Act of 2007</short-title></quote>.</text>
		</section><section id="HAAD4A393BBC9433C91C7F82F45D67939"><enum>2.</enum><header>Extension of
			 Federal employee health insurance to certain individuals affected by an
			 incident of national significance</header>
			<subsection id="H513CAE58BEBC44C7970092CDEFF5034"><enum>(a)</enum><header>In
			 general</header><text>Subpart G of part III of title 5, United States Code, is
			 amended by redesignating chapters 89A and 89B as chapters 89B and 89C,
			 respectively, and by inserting after chapter 89 the following:</text>

						<section id="H0CD4AF7F2DF340820017FF82E1BA6187"><enum>8921.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter—</text>
							<paragraph id="H0DADD5505CB74CEE90C9BBD1B3D00078"><enum>(1)</enum><text>the terms defined
				under section 8901 shall have the meanings given such terms under that
				section;</text>
							</paragraph><paragraph commented="no" id="HEDCFC6DEAE154ED9A406E767999BAB4F"><enum>(2)</enum><text>the term
				<quote>eligible individual</quote> means any individual who, at the time of an
				incident of national significance, resides or is employed in the area
				identified under section 8924 with respect to such incident;</text>
							</paragraph><paragraph commented="no" id="H680347236BF2437489D7B8D53724DED8"><enum>(3)</enum><text>the term
				<quote>incident of national significance</quote> means a domestic catastrophic
				incident which is designated as an incident of national significance by the
				President pursuant to the national response plan referred to in section 502(6)
				of the Homeland Security Act of 2002; and</text>
							</paragraph><paragraph id="HEC41AA51A1C94BD2AE5CC4E58E22C166"><enum>(4)</enum><text>the term
				<quote>Office</quote> means the Office of Personnel Management.</text>
							</paragraph></section><section id="H605CE43FFE414973ADB200839E52C897"><enum>8922.</enum><header>Health
				insurance for eligible individuals</header>
							<subsection id="HFE585F967ACE4574887BBD6579C0E462"><enum>(a)</enum><text>The Office of
				Personnel Management shall administer a health insurance program for eligible
				individuals in accordance with this chapter.</text>
							</subsection><subsection id="HA3ECCB40C56A4D6EAC93EF9333A3BD6"><enum>(b)</enum><text>Except as provided
				under this chapter, the Office shall prescribe regulations to apply the
				provisions of chapter 89 to the greatest extent practicable to eligible
				individuals covered under this chapter.</text>
							</subsection></section><section id="HC503CC58ECA84C3E8FF3991745C523C2"><enum>8923.</enum><header>Contract
				requirement</header>
							<subsection id="H4BB9D1BBC1E647479DCE99FAE225E35"><enum>(a)</enum><text>In each calendar
				year, the Office shall enter into a contract with 3 or more carriers to make
				available 5 or more health benefits plans (subject to the provisions of this
				chapter) to eligible individuals under this chapter.</text>
							</subsection><subsection id="HE53F4F343F024FC4AB8951080650C442"><enum>(b)</enum><text>In carrying out
				this section, the Office may require 5 or more carriers to enter into a
				contract described in subsection (a), as a condition of entering into a
				contract under section 8902.</text>
							</subsection></section><section id="H179B2FE9F5CE4C81B8A78E3ADB3F6D1"><enum>8924.</enum><header>Eligibility and
				identification of individuals</header>
							<subsection id="H13C0EDDFF19A4BE9AB7E9DDE202E116"><enum>(a)</enum><text>Except as provided
				in subsection (b), any eligible individual may enroll in a health benefits plan
				under this chapter.</text>
							</subsection><subsection display-inline="no-display-inline" id="H66D35B075BCC47CBA3BA9E929FB12FDE"><enum>(b)</enum><text>An individual may
				not enroll in a health benefits plan under this chapter, if the
				individual—</text>
								<paragraph id="HEC72AFDFF90240FE93CB03EE10789F82"><enum>(1)</enum><text>is 65 years of age
				or older;</text>
								</paragraph><paragraph id="H00F6B9D814F247D1869909F096F81F00"><enum>(2)</enum><text>is enrolled or
				eligible to enroll for coverage under a public health insurance program,
				including coverage under title XVIII of the Social Security Act, coverage under
				a State plan under title XIX of such Act, coverage under a State plan under
				title XX of such Act, or coverage under any other program determined by the
				Office;</text>
								</paragraph><paragraph id="H814CBBD426F84F259802716955C1F677"><enum>(3)</enum><text>is enrolled or
				eligible to enroll in a plan under chapter 89; or</text>
								</paragraph><paragraph id="H5B91F3F7BB6341ACB371AD478E8B74F"><enum>(4)</enum><text>is a member of the
				uniformed services as defined under <external-xref legal-doc="usc" parsable-cite="usc/10/101">section 101(a)(5)</external-xref> of title 10.</text>
								</paragraph></subsection><subsection id="H44E4373451BD4DFFB42CD38FBF172454"><enum>(c)</enum><text>With respect to
				each incident of national significance, the Secretary of Homeland Security
				shall, consistent with the President’s designation of such incident, identify
				the area affected by such incident and shall, in consultation with the Office,
				carry out a program to identify eligible individuals with respect to such
				incident.</text>
							</subsection><subsection id="H0309EE8B0401427DAFD539529164D100"><enum>(d)</enum><text>The period of an
				individual’s enrollment in a health benefits plan under this chapter shall not
				exceed 24 months with respect to any incident of national significance. Such
				period may be extended by the Office if the Secretary of Homeland Security
				determines that the area identified under subsection (c) remains affected by
				the incident.</text>
							</subsection></section><section id="H764C22EEF8424D578263061494E4EFC4"><enum>8925.</enum><header>Alternative
				conditions to Federal employee health benefits plans</header>
							<subsection id="HFA2BCC52A4FC4D73959B3B429C677F86"><enum>(a)</enum><text>Rates charged and
				premiums paid for a health benefits plan under this chapter may differ between
				or among geographic regions.</text>
							</subsection><subsection id="HF981B4E09F5A488D8BD5F26BA0E32871"><enum>(b)</enum><text>No Government
				contribution shall be made for any individual under this chapter.</text>
							</subsection><subsection id="H497B89FAFFBA445899F95F32161E6D11"><enum>(c)</enum><text>In the
				administration of this chapter, the Office shall ensure that individuals
				covered under this chapter shall be in a risk pool that is separate from the
				risk pool maintained for individuals covered under chapter
				89.</text>
							</subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H1D2BAF56E8F54B5C88B0127E852B304C"><enum>(b)</enum><header>Technical and
			 conforming amendments</header>
				<paragraph id="H4AD6B63F809943D4B31DC70073D9EDF8"><enum>(1)</enum><header>Contract
			 requirement under chapter 89</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8902">Section 8902</external-xref> of title 5, United
			 States Code, is amended by adding after subsection (o) the following:</text>
					<quoted-block id="H6773AB7B1B7746B497C3FD8F1268FC7" style="OLC">
						<subsection id="H510EA840A36A470296F26DFBC88636F8"><enum>(p)</enum><text>Each contract
				under this chapter may include, at the discretion of the Office, a provision
				that the carrier shall enter into a contract to provide 1 or more health
				benefits plans as described under chapter
				89A.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HF12A20505F984E90B4D93C72C5FF1948"><enum>(2)</enum><header>Table of
			 chapters</header><text>The table of chapters for part III of title 5, United
			 States Code, is amended—</text>
					<subparagraph id="H060E8390F094491DB1B728653E56FBDA"><enum>(A)</enum><text>by redesignating
			 the items relating to chapters 89A and 89B as items relating to chapters 89B
			 and 89C, respectively; and</text>
					</subparagraph><subparagraph id="HA0C46D8784B64AAC00712EFEED905681"><enum>(B)</enum><text>by inserting after
			 the item relating to chapter 89 the following:</text>

					</subparagraph></paragraph></subsection><subsection id="H3B8C7315B6AE4B1B9FE1AFD96D4C9971"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on the
			 date of enactment of this Act and shall apply to contracts that take effect
			 with respect to the calendar year following such date of enactment.</text>
			</subsection></section><section id="H4F87A4FB55F44E41B344D16BAF946C88"><enum>3.</enum><header>Credit for
			 emergency health insurance costs of certain individuals affected by an incident
			 of national significance</header>
			<subsection id="H801DF543217D46A39623D9B578ED317E"><enum>(a)</enum><header>In
			 general</header><text>Subpart C of part IV of subchapter A of chapter 1 of the
			 Internal Revenue Code of 1986 (relating to refundable credits) is amended by
			 redesignating section 36 as section 37 and inserting after section 35 the
			 following new section:</text>

					<section id="HF43C6B8D9EC84B80B6A7BA5655F860F2"><enum>36.</enum><header>Emergency health
				insurance costs of certain individuals affected by an incident of national
				significance</header>
						<subsection id="H256864B8CAC548CE8B7D4286C7F66C00"><enum>(a)</enum><header>In
				general</header><text>In the case of an individual, there shall be allowed as a
				credit against the tax imposed by this subtitle for the taxable year an amount
				equal to the applicable percentage of the amount paid during such taxable year
				by the taxpayer for coverage of the taxpayer and family members under the
				health insurance plan established under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/89A">chapter 89A</external-xref> of title 5, United States
				Code.</text>
						</subsection><subsection id="H3A624CA34F554700921D9D1B00677FA0"><enum>(b)</enum><header>Applicable
				percentage</header>
							<paragraph id="H89C2099475F6433D9B533F8996B3E3FF"><enum>(1)</enum><header>In
				general</header><text>For purposes of subsection (a), the applicable percentage
				shall be determined in accordance with the following table:</text>

							</paragraph><paragraph id="HBE0F6210AF10418293C964CC26380617"><enum>(2)</enum><header>Family
				income</header><text>For purposes of this subsection, the term <quote>family
				income</quote> means the aggregate adjusted gross income of the taxpayer and
				the taxpayer’s spouse and dependents.</text>
							</paragraph><paragraph id="H1D32A2C213ED4B8EB68B2D3D56D11655"><enum>(3)</enum><header>Poverty
				line</header><text>For purposes of this subsection, the term <quote>poverty
				line</quote> means the poverty line as defined in section 673(2) of the
				Community Services Block Grant Act, for a family of the size involved.</text>
							</paragraph></subsection><subsection id="H2DF23CB1CF7B43D9909BD15373FAFF81"><enum>(c)</enum><header>Special
				rules</header>
							<paragraph id="H67C4ECBCAF6041620034EC8337FB7599"><enum>(1)</enum><header>Coordination
				with advance payments of credit</header><text>With respect to any taxable year,
				the amount which would (but for this paragraph) be allowed as a credit to the
				taxpayer under subsection (a) shall be reduced (but not below zero) by the
				aggregate amount paid on behalf of such taxpayer under section 7529 for such
				taxable year.</text>
							</paragraph><paragraph id="H894E2E311D374B399E58D86FC1E30833"><enum>(2)</enum><header>Coordination
				with other deductions</header><text>Amounts taken into account under subsection
				(a) shall not be taken into account in determining any deduction allowed under
				section 162(l) or 213.</text>
							</paragraph><paragraph id="H144C1F025C2644B5A4BABB6D9D1C6B77"><enum>(3)</enum><header>Treatment of
				payments</header><text display-inline="yes-display-inline">For purposes of this
				section, payments made by the Secretary on behalf of any individual under
				section 7529 (relating to advance payment of credit for emergency health
				insurance costs of certain individuals affected by an incident of national
				significance) shall be treated as having been made by the taxpayer.</text>
							</paragraph><paragraph id="HCD584D959A304B1EA52D3B181D8B434D"><enum>(4)</enum><header>Regulations</header><text>The
				Secretary may prescribe such regulations and other guidance as may be necessary
				or appropriate to carry out this section and section
				7529.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H737F6A46327D43D99DBADDAB5F28591B"><enum>(b)</enum><header>Advance payment
			 of credit</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/77">Chapter 77</external-xref> of the Internal Revenue Code of 1986
			 (relating to miscellaneous provisions) is amended by adding at the end the
			 following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H1997AC09AFD3400D98E1F919D300A2A2" style="OLC">
					<section id="H96CE6946EC9B4FC68293F7754CD4BFB"><enum>7529.</enum><header>Advance payment
				of credit for emergency health insurance costs of certain individuals affected
				by an incident of national significance</header><text display-inline="no-display-inline">Not later than <inline-comment display="yes">August 1, 2008</inline-comment>, the Secretary shall establish a
				program for making payments on behalf of individuals described in section 36(a)
				to the health insurance plan established under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/89A">chapter 89A</external-xref> of title 5, United
				States
				Code.</text>
					</section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HBD30BA4A8445421DA0EFEAFE7B1CA9E7"><enum>(c)</enum><header>Conforming
			 amendments</header>
				<paragraph id="H47510B74DF684DD197979B5437624CE7"><enum>(1)</enum><text>Paragraph (2) of
			 <external-xref legal-doc="usc" parsable-cite="usc/31/1324">section 1324(b)</external-xref> of title 31, United States Code, is amended by inserting
			 <quote>, 36,</quote> after <quote>section 35</quote>.</text>
				</paragraph><paragraph id="HEDB70DA9183A40D8BF278154EC9B9690"><enum>(2)</enum><text>The table of
			 sections for subpart C of part IV of chapter 1 of the Internal Revenue Code of
			 1986 is amended by striking the item relating to section 36 and inserting the
			 following new items:</text>

			 sections for chapter 77 of such Code is amended by adding at the end the
			 following new item:</text>

				</paragraph></subsection><subsection id="HB0B397ED6DC24046B01D271BE677D886"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years ending after the date of the enactment of this Act.</text>
			</subsection></section><section id="HFAD38DB7D4444D78B374E45DE6EB44EC"><enum>4.</enum><header>Plan for
			 extension of Federal employee health benefits program to certain individuals
			 affected by an incident of national significance</header><text display-inline="no-display-inline">Not later than 3 months after the date of
			 enactment of this Act and after consultation with appropriate experts, the
			 Secretary of Homeland Security, and other Federal officers, the Director of the
			 Office of Personnel Management shall submit a comprehensive plan to Congress
			 that—</text>
			<paragraph id="H0FF73E66630C498EAF6F48C7370020F4"><enum>(1)</enum><text>provides for the
			 orderly implementation of the amendments made by this Act; and</text>
			</paragraph><paragraph id="HCB76F8F5CC924D5EAE542400CC8FF955"><enum>(2)</enum><text>includes a
			 schedule of actions to be taken to provide for that implementation.</text>
