		  the credit of servicemembers deployed to an overseas combat zone and to
		  facilitate awareness of a servicemember’s rights under such Act, and for other

		<section display-inline="no-display-inline" id="H24EA15FAD17F41F29D1F7B058502D135" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Servicemembers Credit Protection
			 Act</short-title></quote>.</text>
		</section><section id="H7E68F9BCFA804AC581E45CB554DACFEF"><enum>2.</enum><header>Notice of
			 deployment required</header>
			<subsection id="H649B97FF0F4D409C8400050968054DD7"><enum>(a)</enum><header>In
			 general</header><text>The Servicemembers Civil Relief Act (50 U.S.C. App. 501
			 et seq.) is amended by adding at the end the following new title:</text>
				<quoted-block display-inline="no-display-inline" id="H044D83ABEF1B4B64B33EF2C200477600" style="OLC">
					<title id="H602EE319C95747D29CF846DC197BD9BD"><enum>VIII</enum><header>Notice of
				deployment</header>
						<section id="HB17009A7810B4DA39F4505F8DD44AB98"><enum>801.</enum><header>Notice to
				consumer reporting agencies</header>
							<subsection id="HFFB3AA2FA6FC4D2EBAEB1775C500F115"><enum>(a)</enum><header>In
				general</header><text>In the case of the deployment of a servicemember away
				from the usual duty station of the servicemember to duty for which the
				servicemember is entitled to special pay under <external-xref legal-doc="usc" parsable-cite="usc/37/310">section 310(a)</external-xref> of title 37,
				United States Code, the Secretary shall—</text>
								<paragraph id="H12774CEABDE542AE8F4514191768C3BB"><enum>(1)</enum><text>notify each
				consumer reporting agency that compiles and maintains files on consumers on a
				nationwide basis of the deployment of the servicemember within 30 days after
				the deployment, together with such information as may be necessary to permit
				such consumer reporting agency to comply with section 605C of the Fair Credit
				Reporting Act with respect to the servicemember; and</text>
								</paragraph><paragraph id="H65FFD98D51B24F8A947F48BD026B9FB2"><enum>(2)</enum><text>notify each such
				consumer reporting agency when the notice under paragraph (1) ceases to apply
				with respect to such servicemember within 30 days after the end of the
				deployment.</text>
								</paragraph></subsection><subsection id="HE5E839EDCAD8458FB0BBBCA320625BB0"><enum>(b)</enum><header>Administrative
				action</header><text display-inline="yes-display-inline">The Secretary shall
				consult with each consumer reporting agency that compiles and maintains files
				on consumers on a nationwide basis and take such action as may be appropriate
				to ensure that the Secretary and such consumer reporting agency can comply with
				the requirements of this section and section 605C of the Fair Credit Reporting
				Act in a timely manner.</text>
							</subsection><subsection id="H82A108FFFE574EE9A39C1C07FA3C207C"><enum>(c)</enum><header>Definition</header><text>For
				purposes of this section, the term <quote>consumer reporting agency that
				compiles and maintains files on consumers on a nationwide basis</quote> has the
				meaning given to such term in section 603(p) of the Fair Credit Reporting
				Act.</text>
							</subsection></section><section id="H7C4B273457AD434F98A9135BCBD6EDC3"><enum>802.</enum><header>Increase in
				penalties for certain violations involving servicemembers deployed to an
				overseas combat zone</header>
							<subsection id="HAA9DF648447D4649A965ACFEB36967D"><enum>(a)</enum><header>In
				general</header><text>In the case of any person who is subject to a penalty
				under section 301(c)(1), 302(b)(1), 303(d)(1), 305(h)(1), 306(e)(1), or
				307(e)(1) in a case involving a servicemember whose consumer report, at the
				time of the violation giving rise to such person’s liability for the penalty,
				contains a combat zone duty alert, such section shall be applied by
				substituting <quote>not more than 3 years</quote> for <quote>not more than one
				year</quote>.</text>
							</subsection><subsection id="HD88DED21228A4E8A986213A1E00BC40"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of subsection (a), the terms
				<quote>combat zone duty alert</quote> and <quote>consumer report</quote> have
				the same meanings as in section 603 of the Fair Credit Reporting
				Act.</text>
							</subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HB15EBAA025EE4AEAB227FADCD906170"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 contents for the Servicemembers Civil Relief Act (50 U.S.C App. 501 et seq.) is
			 amended by inserting after the item relating to section 706 the following new
			 items:</text>

			 consumer files of servicemembers</header>
			<subsection id="HA6FAE93EF69C4529A3BCB11FA311B765"><enum>(a)</enum><header>In
			 general</header><text>The Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681">15 U.S.C. 1681 et seq.</external-xref>) is
			 amended by inserting after section 605B the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H38F981A2391449E4B53E8745FDE39F57" style="USC">
					<section id="H7979A5BC73D74FE4944526703052F315"><enum>605C.</enum><header>Combat zone
				duty alert</header>
						<subsection id="H4E22DD98A46E48EF803BC76C8674679"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Each consumer
				reporting agency described in section 603(p) that receives a notice under
				section 801(a)(1) of the Servicemembers Civil Relief Act from the Secretary of
				Defense with respect to a consumer who is a servicemember (as defined in
				section 101(1) of such Act) shall—</text>
							<paragraph id="H1BE47526D8AB461EB9003055A3C59155"><enum>(1)</enum><text display-inline="yes-display-inline">include a combat zone duty alert in the
				file of that consumer, and also provide that alert along with any credit score
				generated in using that file, until notified by the Secretary of Defense that
				such consumer no longer qualifies for such alert; and</text>
							</paragraph><paragraph id="H7D2EE0DB56A84D72A68C1B339B26AE62"><enum>(2)</enum><text>during the period
				such alert is in effect, exclude the consumer from any list of consumers
				prepared by the consumer reporting agency and provided to any third party to
				offer credit or insurance to the consumer as part of a transaction that was not
				initiated by the consumer.</text>
							</paragraph></subsection><subsection id="HB6E6F888278445BEB4B418DEE8E016B9"><enum>(b)</enum><header>Information on
				consumer’s rights required To be included</header><text display-inline="yes-display-inline">The combat zone duty alert included in any
				consumer’s file pursuant to subsection (a) shall include a summary of the
				rights of the consumer under the Servicemembers Civil Relief Act and the duties
				of creditors and other persons under such Act to the consumer.</text>
						</subsection><subsection id="HCCC69518939A478CB25457ABD82A905"><enum>(c)</enum><header>Notice to
				furnishers of adverse information</header><text display-inline="yes-display-inline">If any person, including another consumer
				reporting agency, furnishes adverse information to a consumer reporting agency
				described in section 603(p) with respect to a consumer whose file includes a
				combat zone duty alert under subsection (a)(1), the consumer reporting agency
				shall notify such person of the existence of the combat zone duty alert in the
				file of such consumer together with the summary of rights and duties described
				in subsection (b).</text>
						</subsection><subsection id="HE8781486F2C241B8AC24BDD0FB3B5852"><enum>(d)</enum><header>Duty of reseller
				To reconvey alert</header><text display-inline="yes-display-inline">A reseller
				shall include in its report any combat zone duty alert placed in the file of a
				consumer pursuant to this section by another consumer reporting agency.</text>
						</subsection><subsection id="H6126A2E354A743D3983D653519865BFC"><enum>(e)</enum><header>Procedures</header><text display-inline="yes-display-inline">Each consumer reporting agency described in
				section 603(p) shall establish policies and procedures to comply with this
				section and shall cooperate with the Secretary of Defense in establishing such
				procedures to ensure effective compliance with the requirements of this
				section.</text>
						</subsection><subsection id="HA97EFC7F0B1240AAB085ACA6AAAAA5BF"><enum>(f)</enum><header>Notice from
				secretary</header><text>This section shall cease to apply to with respect to
				any consumer as of the date the consumer reporting agency described in section
				603(p) receives a notice from the Secretary of Defense under section 801(a)(2)
				relating to such
				consumer.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H0F51D698165E4A128553245C1B7BCBEE"><enum>(b)</enum><header>Definitions</header>
				<paragraph id="HC079F989DC0A482B9D5B9605E2D74CC2"><enum>(1)</enum><header>In
			 general</header><text>Subsection (q) of section 603 of the Fair Credit
			 Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681a">15 U.S.C. 1681a(q)</external-xref>) is amended by adding at the end the
			 following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HFFB0876834274E23879BBFDCB9BCD338" style="OLC">
						<paragraph id="HC2F287DE85D645B9860041758DF2228D"><enum>(6)</enum><header>Combat zone duty
				alert</header><text display-inline="yes-display-inline">The term <quote>combat
				zone duty alert</quote> means a statement in the file of a consumer
				that—</text>
							<subparagraph id="HB04344FC55574FC9AEA91456000082AF"><enum>(A)</enum><text display-inline="yes-display-inline">notifies all prospective users of a
				consumer report relating to the consumer that the consumer is serving as a
				servicemember in a combat zone and includes any information required under
				section 605C; and</text>
							</subparagraph><subparagraph id="H13ABF32744234AB6A61B3514C0CEFE12"><enum>(B)</enum><text>is presented in a
				manner that facilitates a clear and conspicuous view of the statement described
				in subparagraph (A) by any person requesting such consumer
				report.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H587150108A954809BF3FE16B867B152D"><enum>(2)</enum><header>Technical and
			 conforming amendment</header><text display-inline="yes-display-inline">The
			 heading for subsection (q) of section 603 of the Fair Credit Reporting Act (15
			 U.S.C. 1681a(q)) is amended by inserting <quote><header-in-text level="subsection" style="OLC">and military</header-in-text></quote> after
			 <quote><header-in-text level="subsection" style="OLC">to
			 fraud</header-in-text></quote>.</text>
				</paragraph></subsection><subsection id="H56390F11D6284FD2AA424E50679E7068"><enum>(c)</enum><header>Clerical
			 amendment</header><text>The table of sections for title VI of the Consumer
			 Credit Protection Act is amended by inserting after the item relating to
			 section 605B the following new item:</text>
