<official-title>To direct the Secretary of the Treasury to mint coins in commemoration of the battlefields of the Revolutionary War and the War of 1812, and for other purposes.</official-title>

<section id="H20D279DEE1084DD4B6176BDD56A30027" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Revolutionary War and War of 1812 Battlefields Commemorative Coin Act of 2007</short-title></quote>.</text> </section> 
<section id="H955E3094C97349CAA4DAC6507E93C500"><enum>2.</enum><header>Coin specifications</header> 
<subsection id="HC79415B92D51466792B339B63E237B00"><enum>(a)</enum><header>Denominations</header><text>In commemoration of the Revolutionary War and the War of 1812, the Secretary of the Treasury (hereafter in this Act referred to as the <quote>Secretary</quote>) shall mint and issue the following coins:</text> 
<paragraph id="HC4703D12C61B45F4B76599C3F2C600CB"><enum>(1)</enum><header>$5 gold coins</header><text>Not more than 300,000 $5 coins, which shall—</text> 
<subparagraph id="HF5E48F4F2454418D9D9C30076C9013D0"><enum>(A)</enum><text>weigh 8.359 grams;</text></subparagraph> 
<subparagraph id="H4E10BC3981414D828EF5EC493B38A86B"><enum>(B)</enum><text>have a diameter of 0.850 inches; and</text></subparagraph> 
<subparagraph id="H6D794B53F57B4B438BF8C6B763FA098E"><enum>(C)</enum><text>contain 90 percent gold and 10 percent alloy.</text></subparagraph></paragraph> 
<paragraph id="H45E4AA39699C40909DBC7F6E1294CD20"><enum>(2)</enum><header>$1 silver coins</header><text>Not more than 1,000,000 $1 coins, which shall—</text> 
<subparagraph id="H8043CF45BA4B425380045746D4BAC15"><enum>(A)</enum><text>weigh 26.73 grams;</text></subparagraph> 
<subparagraph id="HFD9D99403A74467983BF8171A5FAE12"><enum>(B)</enum><text>have a diameter of 1.500 inches; and</text></subparagraph> 
<subparagraph id="H3E0DF718AB55471B8EFDBB3E54C32E4"><enum>(C)</enum><text>contain 90 percent silver and 10 percent copper.</text></subparagraph></paragraph> 
<paragraph id="H45679355FF844B4780C73FC2B4C5B217"><enum>(3)</enum><header>Half dollar clad coins</header><text>Not more than 2,000,000 half dollar coins which shall be minted to the specifications for half dollar coins contained in <external-xref legal-doc="usc" parsable-cite="usc/31/5112">section 5112(b)</external-xref> of title 31, United States Code.</text></paragraph></subsection> 
<subsection id="HCC577181455F4BF0B2993BECC6755800"><enum>(b)</enum><header>Legal tender</header><text>The coins minted under this Act shall be legal tender, as provided in <external-xref legal-doc="usc" parsable-cite="usc/31/5103">section 5103</external-xref> of title 31, United States Code.</text></subsection> 
<subsection id="HA4CF90B2F3A1460ABD1FD0B2F7047E00"><enum>(c)</enum><header>Numismatic items</header><text>For purposes of sections <external-xref legal-doc="usc" parsable-cite="usc/31/5134">5134</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/31/5136">5136</external-xref> of title 31, United States Code, all coins minted under this Act shall be considered to be numismatic items.</text></subsection></section> 
<section id="HD7BE3AFC20DB4B798400246BE6D5501"><enum>3.</enum><header>Design of coins</header> 
<subsection id="HD19AD6BF41BD457985DDB1009771EE90"><enum>(a)</enum><header>Design requirements</header> 
<paragraph id="HA0CBE5980A5E4D91B135C2DEED932CE2"><enum>(1)</enum><header>In general</header><text>The design of the coins minted under this Act shall be emblematic of the Revolutionary War and the War of 1812.</text></paragraph> 
<paragraph id="HEB55A28C4FA949E9A87178D974C05E00"><enum>(2)</enum><header>Designation and inscriptions</header><text>On each coin minted under this Act there shall be—</text> 
<subparagraph id="H31947E6F568A40C7A9D78C9FFEABF8B5"><enum>(A)</enum><text>a designation of the value of the coin;</text></subparagraph> 
<subparagraph id="HAAC3178B561643C6A02817B084919C24"><enum>(B)</enum><text>an inscription of the year <quote>2009</quote>; and</text></subparagraph> 
<subparagraph id="H9D8848FB946542FFABF71CC73B63EC00"><enum>(C)</enum><text>inscriptions of the words <quote>Liberty</quote>, <quote>In God We Trust</quote>, <quote>United States of America</quote>, and <quote>E Pluribus Unum</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="HD89D50F32A5143CEBCF941A0B1CE431D"><enum>(b)</enum><header>Selection</header><text>The design for the coins minted under this Act shall be—</text> 
<paragraph id="H672572B22D5D4C148713829EDF4613CB"><enum>(1)</enum><text>selected by the Secretary after consultation with the Commission of Fine Arts, and the Revolutionary War and the War of 1812 Battlefields Foundation (hereafter in this Act referred to as the <quote>Foundation</quote>); and</text></paragraph> 
<paragraph id="H931453432E9A4E67A123F3609F843342"><enum>(2)</enum><text>reviewed by the Citizens Coinage Advisory Committee.</text></paragraph></subsection></section> 
<section id="H2208473ED36C490F9C131B9B932092A1"><enum>4.</enum><header>Issuance of coins</header> 
<subsection id="HBD60B65AB877490E925FC592E500DD4F"><enum>(a)</enum><header>Quality of coins</header><text>Coins minted under this Act shall be issued in uncirculated and proof qualities.</text></subsection> 
<subsection id="H9C040B3E7E234852B4A1007682A4E88E"><enum>(b)</enum><header>Mint facility</header><text>Only 1 facility of the United States Mint may be used to strike any particular quality of the coins minted under this Act.</text></subsection> 
<subsection id="H184CD41BA66C4CD0007CB73B0088195E"><enum>(c)</enum><header>Period for issuance</header><text>The Secretary may issue coins minted under this Act only during the 1-year period beginning on January 1, 2009.</text></subsection></section> 
<section id="H03D8B55FF8FB47FE9B349650343BD9EE"><enum>5.</enum><header>Sale of coins</header> 
<subsection id="H8361AD734B6046C59E5F92E6F145D7C7"><enum>(a)</enum><header>Sale price</header><text>The coins issued under this Act shall be sold by the Secretary at a price equal to the sum of—</text> 
<paragraph id="H92F1C382A89E4EEF9185E052EA85BBB9"><enum>(1)</enum><text>the face value of the coins;</text></paragraph> 
<paragraph id="H5A1BCE3A8AF946C4BEC8410337B629AD"><enum>(2)</enum><text>the surcharge provided in section 6(a) with respect to such coins; and</text></paragraph> 
<paragraph id="HC364BEDA65B84E0F8E16B7E77F4BD706"><enum>(3)</enum><text>the cost of designing and issuing the coins (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping).</text></paragraph></subsection> 
<subsection id="H650839578FA1401099FE6B461D87EA50"><enum>(b)</enum><header>Bulk sales</header><text>The Secretary shall make bulk sales of the coins issued under this Act at a reasonable discount.</text></subsection> 
<subsection id="H7C489B56F1E24F030014CC9B9DF02DD7"><enum>(c)</enum><header>Prepaid orders</header> 
<paragraph id="H542349C0EC4A423A91B4910408A200DE"><enum>(1)</enum><header>In general</header><text>The Secretary shall accept prepaid orders for the coins minted under this Act before the issuance of such coins.</text></paragraph> 
<paragraph id="HAAC91450A6674E9A8F647D53F7BBBFCA"><enum>(2)</enum><header>Discount</header><text>Sale prices with respect to prepaid orders under paragraph (1) shall be at a reasonable discount.</text></paragraph></subsection> 
<subsection id="H18E7C220440449EBB32C5EB500C97907"><enum>(d)</enum><header>Marketing</header><text>The Secretary, in cooperation with the Foundation, shall develop and implement a marketing program to promote and sell the coins authorized under this Act both within the United States and internationally.</text></subsection></section> 
<section id="HB83CAEF676B74A2682D622D23800E2C"><enum>6.</enum><header>Surcharges</header> 
<subsection id="H8D1E54ACE6A24A25A55C819384B93B1D"><enum>(a)</enum><header>In general</header><text>All sales of coins minted under this Act shall include a surcharge as follows:</text> 
<paragraph id="HA9148FF3667E48818B3BA7B23E00CC4D"><enum>(1)</enum><text>A surcharge of $35 per coin for the $5 coin.</text></paragraph> 
<paragraph id="H92884F5F1C0E44D0B6B88C2C80008CEA"><enum>(2)</enum><text>A surcharge of $10 per coin for the $1 coin.</text></paragraph> 
<paragraph id="H26DD1C3B37D04AAEAE7EEA5CBD7CC398"><enum>(3)</enum><text>A surcharge of $3 per coin for the half dollar coin.</text></paragraph></subsection> 
<subsection id="H22AAF1BAEDCA4FAFB0C4FC4CD111FE43"><enum>(b)</enum><header>Distribution</header><text>Subject to <external-xref legal-doc="usc" parsable-cite="usc/31/5134">section 5134(f)</external-xref> of title 31, United States Code, all surcharges received by the Secretary from the sale of coins issued under this Act shall be promptly paid by the Secretary to the Foundation for purposes of the preservation of historically significant battlefields of the Revolutionary War and the War of 1812 and related historical sites.</text></subsection> 
<subsection id="H413E32F4CCB549AAA3D2EDACB8D53EEB"><enum>(c)</enum><header>Audits</header><text>The Foundation shall be subject to the audit requirements of <external-xref legal-doc="usc" parsable-cite="usc/31/5134">section 5134(f)(2)</external-xref> of title 31, United States Code, with regard to the amounts received by the Fund under subsection (b).</text></subsection></section>
