<official-title>To amend title XVIII of the Social Security Act to eliminate discriminatory copayment rates for outpatient psychiatric services under the Medicare Program.</official-title>

<section section-type="section-one" id="H1FD4CA8AFEB142C888F8352E124982D0" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Seniors Access to Mental Health Act of 2007</short-title></quote>.</text></section> 
<section id="H6B55EE51DF2D4DDB957DBA6992943191"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H1D67040F1D2E410DB35C261805280049"><enum>(1)</enum><text>The Medicare program currently discriminates against mental health services for seniors by charging more in copayments for such services than for any other outpatient health care services. This policy creates a barrier for seniors who would benefit from effective mental health treatments and increases costs to the Medicare program.</text></paragraph> 
<paragraph id="HF5C30812117C4C28B08BD7E37BBBEBBF"><enum>(2)</enum><text>Despite the availability of proven treatments, the Substance Abuse and Mental Health Administration has shown that 63 percent of seniors who need mental health treatments do not receive it.</text></paragraph> 
<paragraph id="HA64676B4882442F0BB068EA93C217831"><enum>(3)</enum><text>The Surgeon General attributes this large unmet need to patient barriers (such as the reluctance of patients to discuss psychological problems), provider barriers (such as difficulty with respect to diagnosing and treating mental illness), and health care system barriers (such as payment and coverage policies).</text></paragraph> 
<paragraph id="H846338E379474900A1A04B00DE779B2C"><enum>(4)</enum><text>Adjusting Medicare copayment rates for outpatient psychiatric care to correspond with Medicare copayment rates for all other health care services will integrate the diagnosis and treatment of chronic diseases and mental illnesses, such as depression, for more effective care and lower health care costs.</text></paragraph></section> 
<section id="H86CA534FD5FA4094B38682D8588CCCF0"><enum>3.</enum><header>Elimination of discriminatory copayment rates for Medicare outpatient psychiatric services</header><text display-inline="no-display-inline">Section 1833(c) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395<italic>l</italic>(c)) is amended to read as follows:</text>

<subsection id="HAEA837C28B894410BB5BF76DDB46F4D4"><enum>(c)</enum> 
<paragraph id="HCA7732D982DC43B7A404073C888782A" display-inline="yes-display-inline"><enum>(1)</enum><text>Notwithstanding any other provision of this part, with respect to expenses incurred in a calendar year in connection with the treatment of mental, psychoneurotic, and personality disorders of an individual who is not an inpatient of a hospital at the time such expenses are incurred, there shall be considered as incurred expenses for purposes of subsections (a) and (b)—</text> 
<subparagraph id="H8B5128D37CF94E6D88197DD0B5C33B1F" indent="up1"><enum>(A)</enum><text>for expenses incurred in any year before 2008, only 62<fraction>1/2</fraction> percent of such expenses;</text></subparagraph> 
<subparagraph id="HECBECF6E7EE14F8200DD6EE663F1774E" indent="up1"><enum>(B)</enum><text>for expenses incurred in 2008, only 68<fraction>3/4</fraction> percent of such expenses;</text></subparagraph> 
<subparagraph id="H98EFFA1E56C54BD586BFFC177F7C53B1" indent="up1"><enum>(C)</enum><text>for expenses incurred in 2009, only 75 percent of such expenses;</text></subparagraph> 
<subparagraph id="HA7DA488DE00B480990FAAE0913122D62" indent="up1"><enum>(D)</enum><text>for expenses incurred in 2010, only 81<fraction>1/4</fraction> percent of such expenses;</text></subparagraph> 
<subparagraph id="H91556502FE394316BA5E71871CD8D8C4" indent="up1"><enum>(E)</enum><text>for expenses incurred in 2011, only 87<fraction>1/2</fraction> percent of such expenses;</text></subparagraph> 
<subparagraph id="H0B36058A80BD4A81B3A7C46D69B2A5C8" indent="up1"><enum>(F)</enum><text>for expenses incurred in 2012, only 93<fraction>3/4</fraction> percent of such expenses; and</text></subparagraph> 
<subparagraph id="HF33E0387E717438AB9A500A1007FD843" indent="up1"><enum>(G)</enum><text>for expenses incurred in 2013, or any subsequent year, 100 percent of such expenses.</text></subparagraph></paragraph> 
<paragraph indent="up1" id="H064D529AA0B94A248EDDE52E7BC7C794"><enum>(2)</enum><text display-inline="yes-display-inline">For purposes of subparagraphs (A) through (F) of paragraph (1), the term <term>treatment</term> does not include brief office visits (as defined by the Secretary) for the sole purpose of monitoring or changing drug prescriptions used in the treatment of such disorders or partial hospitalization services that are not directly provided by a physician.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
