<official-title>To amend the Federal Water Pollution Control Act to provide additional protection to estuaries of national significance.</official-title>

<section id="HAF58501FAC2A4C23AAF5DBA197F2D00" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Estuary Protection Act</short-title></quote>.</text></section> 
<section id="H2E4CFEAB6D9548809968438246F848E7" section-type="subsequent-section" display-inline="no-display-inline"><enum>2.</enum><header>Estuary of national significance</header><text display-inline="no-display-inline">Section 101(a) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251(a)</external-xref>) is amended—</text> 
<paragraph id="H14D6DF46D81643EB93D99581DB92AA9B"><enum>(1)</enum><text>by redesignating paragraphs (6) and (7) as paragraphs (7) and (8) respectively; and</text></paragraph> 
<paragraph id="H3BE62D3A39B34BDEB3E045825FEA2657"><enum>(2)</enum><text>inserting the following after paragraph (5):</text>

<paragraph id="HE20AA7C2EBBD4E0B97E742B8B05DCD37"><enum>(6)</enum><text>it is the national policy that given the environmental risk that a floating storage regasification unit poses to an estuary, the construction or use of such a unit in an estuary of national significance be prohibited.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HDCA85C6F96234042BAA5BFC4AC29245B"><enum>3.</enum><header>National estuary program</header><text display-inline="no-display-inline">Section 320(g) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330(g)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H6F0AE64DA5C0495B89F576952C5F2949"><enum>(4)</enum><header>Eligibility</header><text>To be eligible to receive a grant under this subsection, an applicant for a grant shall certify to the Administrator that the applicant will not construct or use a floating storage regasification unit on an estuary of national significance. Such certification shall remain in effect subject to paragraph (5).</text></paragraph> 
<paragraph id="H1E641DC4A19B4E768374E332B4A59314"><enum>(5)</enum><header>Agency or court order</header><text display-inline="yes-display-inline">A grant recipient under this subsection may construct or use a floating storage regasification unit on an estuary of national significance only if the recipient is ordered to do so by a Federal agency or court that has authority to issue such orders.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
