<subparagraph id="HB4AC94A6948F431FBCFBE0E33713ED33"><enum>(B)</enum><text>will contribute to the restoration of an endangered ecosystem or rare and declining forest ecosystem, as defined by the Secretary.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H7B41ED0462E84AB78DC5B52B73FC895B"><enum>(c)</enum><header>Enrollment goals</header><text display-inline="yes-display-inline">Section 1231(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3831">16 U.S.C. 3831(d)</external-xref>) is amended—</text> 
<paragraph id="H0BAA7CECD80C4B7300774F07E8D6BB3D"><enum>(1)</enum><text>by striking <quote>The Secretary</quote> and inserting:</text>

<paragraph id="H0DD3ACE3B4BF44068EBEE767A9C7C41B"><enum>(2)</enum><header>Enrollment goals</header><text>For the period beginning on the date of the enactment of this paragraph and ending on December 31, 2013, the Secretary shall establish a goal—</text> 
<subparagraph id="HB040A9C852FC494384ABC035005749F9"><enum>(A)</enum><text display-inline="yes-display-inline">to enroll not less than 7,000,000 acres of eligible land, including land to be devoted to the restoration of rare and declining forests, through the continuous enrollment program and the conservation reserve enhancement program; and</text></subparagraph> 
<subparagraph id="HE380D06A4FF648E7812500004229F8B6"><enum>(B)</enum><text display-inline="yes-display-inline">to maintain enrollment of at least 7,800,000 acres in the Prairie Pothole Region National Conservation Priority Area.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HF37F66AFAB3943C7B4D57CCFBA28204"><enum>(d)</enum><header>Contracts To restore rare and declining forests</header><text display-inline="yes-display-inline">(d) Section 1231(e)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3831">16 U.S.C. 3831(e)(2)</external-xref>) is amended by adding at the end the following new subparagraph: </text> 
<quoted-block style="OLC" id="HA1EE58EE9AE940E186DEAF26A9E244D6" display-inline="no-display-inline"> 
<subparagraph id="HF3ADEA5F3739488888B5DBCB1E31A51B"><enum>(C)</enum><header>Rare and declining forests</header><text>In the case of land to be devoted to the restoration of rare and declining forest ecosystems, as determined by the Secretary, the Secretary may enter into contracts of more than 15 years.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD17B2629BCF147E59C65B1631CA22231"><enum>(e)</enum><header>Balance of natural resource purposes</header><text display-inline="yes-display-inline">Section 1231(j) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3831">16 U.S.C. 3831(j)</external-xref>) is amended—</text> 
<paragraph id="HAD25DE615359421DA66B63B9FFFD63E2"><enum>(1)</enum><text>by striking “In determining” and inserting the following:</text>

<subsection id="H1DF920173FB346B680EDA8E130A5EB3"><enum>(j)</enum><header>Conservation reserve enhancement program</header><text display-inline="yes-display-inline">Section 1234(f)(1) of such Act is (<external-xref legal-doc="usc" parsable-cite="usc/16/3834">16 U.S.C. 3834(f)</external-xref>) is amended by adding at the end the following new sentence: <quote>The Secretary may waive this payment limitation for persons participating in a conservation reserve enhancement program if the Secretary determines such a waiver is necessary to achieve the objectives of the conservation reserve enhancement program.</quote>.</text></subsection></section>

<clause id="HFE0F9BC0BB5D49359B82D85C83000570"><enum>(ii)</enum><text>enroll the land under a Tier II or Tier III conservation security contract at the time the Tier I contract expires if the producer demonstrates that the eligibility criteria for a Tier III conservation security contract are met.</text></clause></subparagraph> 
<subparagraph id="H217E8FB5CC0B41FD97226D7BD7907564"><enum>(C)</enum><header>Tier II renewals</header><text display-inline="yes-display-inline">In the case of land enrolled under a Tier II conservation security contract of a producer, the producer may—</text> 
<clause id="H7F4451B1BE2542E5AF7FCA7E02C3631D"><enum>(i)</enum><text>renew the contract if the producer agrees to a new conservation security plan that includes significant new conservation practices or activities, as determined by the Secretary; or</text></clause> 
<clause id="H50993CC7EB4E4AFE9C15F5DBE2413674"><enum>(ii)</enum><text display-inline="yes-display-inline">enroll the land under a Tier III conservation security contract at the time the Tier II contract expires if the producer demonstrates that the eligibility criteria for a Tier III conservation security contract are met.</text></clause></subparagraph> 
<subparagraph id="H5F1CB9B8487444A5A8C86FBB41630DA"><enum>(D)</enum><header>Tier III renewals</header><text display-inline="yes-display-inline">In the case of land enrolled under a Tier III conservation security contract of a producer, the producer may renew the contract, subject to a benchmark assessment by the Secretary to determine whether the producer fully complied with the requirements of the Tier III conservation security plan.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HD851B0E999A844E682BCEDE7FB7C80BE"><enum>(e)</enum><header>Elimination of maintenance payments</header><text display-inline="yes-display-inline">Section 1238C(b)(1)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3838c">16 U.S.C. 3838c(b)(1)(B)</external-xref>) is amended by adding at the end the following new sentence: <quote>Effective for payments made after October 1, 2006, payments under a conservation security contract may not include amounts for the maintenance of existing land management and vegetative practices or the maintenance of existing land-based structural practices.</quote>.</text></subsection>

<paragraph id="HA008125200EF4487A7D2464D71212200"><enum>(4)</enum><header>Minimum payment</header><text display-inline="yes-display-inline">Notwithstanding any other provision in this subsection, a producer participating in the conservation security program shall be entitled to an annual payment of not less than $1,500 under a conservation security contract.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="H86D99F28AE68414D8E75A098687D30D8"><enum>(2)</enum><header>Continuous enrollment for tier III contracts</header><text>The Secretary shall enroll lands that meet Tier III enrollment criteria on a continuous basis.</text></paragraph> 
<paragraph id="H838A362F7DC944B8BDBDC31BE5008C8C"><enum>(3)</enum><header>Periodic enrollment opportunities for tier I and II contracts</header><text display-inline="yes-display-inline">The Secretary shall ensure that producers whose land meets the eligibility criteria for enrollment under a Tier I or Tier II conservation security contract have the opportunity to enroll the land in the conservation security program once every three years.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HBEC0A1F9EFFF49549640004E053421A3"><enum>(h)</enum><header>Technical assistance</header><text>Subsection (f) of section 1238C of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3838c">16 U.S.C. 3838c</external-xref>) is amended to read as follows:</text>

<subsection id="H4A359A85139B4CD2B1BA8DF7BD987750"><enum>(a)</enum><header>Extension and funding</header><text>Section 1241(a) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3841">16 U.S.C. 3841(a)</external-xref>) is amended by striking paragraph (5) and inserting the following new paragraph:</text>

<paragraph id="H91BAAA9B9CB9467487A4F3254061D438"><enum>(4)</enum><header>Enrollment goal</header><text>For the period beginning on the date of the enactment of this paragraph and ending on December 31, 2013, the Secretary shall establish a goal to enroll not less than 2,000,000 acres of native grasslands in the program.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>

<paragraph id="H24236B0E449649F1009972733C1359AE"><enum>(1)</enum><header>Enrollment authorized</header><text display-inline="yes-display-inline">Subject to the eligibility requirements of subsection (c) and all other requirements of this subchapter, land enrolled in the conservation reserve program may be enrolled in the grassland reserve program if the Secretary determines that the land is of high ecological value and under significant threat of conversion to other uses. </text></paragraph> 
<paragraph id="HC6EABC30EC3F40D1AD9DB5AE9CD06CAC"><enum>(2)</enum><header>Maximum enrollment</header><text>The enrollment of conservation reserve program land under this subsection shall not exceed 50 percent of the total number of acres enrolled in the grassland reserve program in a given fiscal year.</text></paragraph> 
<paragraph id="HD2DEB675C54E4B6E00C8E8114FDDD8B7"><enum>(3)</enum><header>Prohibition on duplication of payments</header><text display-inline="yes-display-inline">Land enrolled in the grassland reserve program under this subsection shall no longer be eligible for payments under the conservation reserve program.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H619D230D472D46CFABAB2DF16FE8FEA"><enum>(d)</enum><header>Equity for pasture-based operations</header><text display-inline="yes-display-inline">Section 1238N of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3838N">16 U.S.C. 3838N</external-xref>) is further amended by inserting after subsection (d), as added by subsection (c), the following new subsection:</text>

<paragraph id="H75F92D1FABF04845BFE116668BD22EF8"><enum>(1)</enum><header>Agreements</header><text display-inline="yes-display-inline">The Secretary may enter into a special grasslands reserve enhancement agreement with a State under which the Secretary will make payments to the State or political subdivisions or agencies of the State to advance the purposes of the grassland reserve program in the State.</text></paragraph> 
<paragraph id="H3F36D704F9D34A2AA8DDEC8CCAB3BD46"><enum>(2)</enum><header>Payment limitations</header><text>Section 1305(d) of the Omnibus Budget Reconciliation Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/7/1308">7 U.S.C. 1308</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/100/203">Public Law 100–203</external-xref>) shall not apply to payments received by a State or political subdivision or agency thereof in connection with an agreement entered into under subsection (a).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>

<subsection id="H7D0AFDB595DC4691A212E94E3649EFED"><enum>(d)</enum><header>Bidding down</header><text display-inline="yes-display-inline">Subsection (c) of section 1240B of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-2">16 U.S.C. 3839aa–2</external-xref>) is amended to read as follows:</text>

<subsection id="H3E2FC381B9AC43D299D96EDF3DF72F00"><enum>(e)</enum><header>Evaluation of applications for cost-share payments and incentive payments</header><text>Section 1240C of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-3">16 U.S.C. 3839aa–3</external-xref>) is amended to read as follows:</text>

<subsection id="HD6312F9322CF4F809BF0ED94146C33FC"><enum>(a)</enum><header>Evaluation priorities and criteria</header><text display-inline="yes-display-inline">In evaluating applications for cost-share payments and incentive payments, the Secretary shall—</text> 
<paragraph id="HE819689FB3A344E4A79D3500C22208B9"><enum>(1)</enum><text display-inline="yes-display-inline">prioritize applications based on their overall level of cost-effectiveness to ensure that the conservation practices, systems, and approaches proposed are the most efficient means of achieving the anticipated environmental benefits of the project;</text></paragraph> 
<paragraph id="H595AB669914B4AC1BF388270DC58A993"><enum>(2)</enum><text display-inline="yes-display-inline">prioritize applications based on how effectively and comprehensively the project addresses the designated resource concern or resource concerns;</text></paragraph> 
<paragraph id="HF87CA2F4DD0841519EAC7EBABC0041B"><enum>(3)</enum><text>reward higher levels of environmental performance, such as advanced levels of management within land management practices;</text></paragraph> 
<paragraph id="H2D34325FE3B945DF81697498E0B7EF8B"><enum>(4)</enum><text>develop criteria for evaluating applications that will ensure that national, State, and local conservation priorities are effectively addressed; and</text></paragraph> 
<paragraph id="H1340763592A2432CA28EA3CAB17FD9F9"><enum>(5)</enum><text display-inline="yes-display-inline">prioritize applications that will improve environmental performance on existing operations.</text></paragraph></subsection> 
<subsection id="HBD6C1505CA2142B2BB3404FA03AD3C38"><enum>(b)</enum><header>Special rule for projects To improve wildlife habitat</header><text display-inline="yes-display-inline">In evaluating applications for cost-share payments and incentive payments primarily to improve wildlife habitat, in addition to meeting the requirements of subsection (a), the Secretary shall give priority to applications that—</text> 
<paragraph id="H746DEE963BDD49C49CC5478D7EAF1DE0"><enum>(1)</enum><text>protect and restore habitat for rare, threatened, endangered, and candidate species; or</text></paragraph> 
<paragraph id="H1936FA0565484C499D36995191C6DFCB"><enum>(2)</enum><text>further the goals and objectives of the State’s comprehensive wildlife conservation strategy.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H95F008DB6F9641ECA27746E9F3E83300"><enum>(f)</enum><header>Conservation innovation grants</header><text display-inline="yes-display-inline">Section 1240H of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-8">16 U.S.C. 3839aa–8</external-xref>) is amended—</text> 
<paragraph id="H36E726196A344811835CF2E93982FC7C"><enum>(1)</enum><text>in subsection (a), by striking <quote>may</quote> and inserting <quote>shall</quote>;</text></paragraph>

<subsection id="H6D32145918B647B80003EF21F414B4B0"><enum>(d)</enum><header>Technology transfer</header><text display-inline="yes-display-inline">To the maximum extent practicable, the Secretary shall ensure efficient, effective transfer of innovative technologies and approaches demonstrated through projects that receive funding under this section.</text></subsection> 
<subsection id="H364F614CC1114B97ABF886006EF84F99"><enum>(e)</enum><header>Funding</header><text display-inline="yes-display-inline">In addition to amounts made available under section 1241(a)(6) to carry out this chapter, the Secretary shall use funds of the Commodity Credit Corporation to carry out this section in the following amounts:</text> 
<paragraph id="HCE25560B292A464095AE3B8BDA7DE92B"><enum>(1)</enum><text>40,000,000 for fiscal year 2008.</text></paragraph> 
<paragraph id="H8464F7EA4C6A4529BAB90444CD2527F"><enum>(2)</enum><text>50,000,000 for fiscal year 2009.</text></paragraph> 
<paragraph id="HEF4D2D5250324F0DB6EF2543A11162C0"><enum>(3)</enum><text>60,000,000 for fiscal year 2010.</text></paragraph> 
<paragraph id="H724C3B6F00A14BAA8E901EB4D86DC86C"><enum>(4)</enum><text>75,000,000 for each of fiscal years 2011 through 2013.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>

<subsection id="H4472D1555F284236AF178FBC5544D5D0"><enum>(h)</enum><header>Additional provisions</header><text display-inline="yes-display-inline">Chapter 4 of subtitle D of title XII of such Act is amended by adding at the end the following new sections:</text>

<section id="HA310B3C7F75D460FBDA9E50400B42D27"><enum>1240J.</enum><header>Promotion of forest stewardship practices</header> 
<subsection id="H8C7690A852024976886CD22EDB3DDFA5"><enum>(a)</enum><header>Cost-share payments and incentive payments</header><text display-inline="yes-display-inline">In carrying out the program under this chapter, the Secretary shall promote forest stewardship by providing cost-share payments and incentive payments to non-industrial private forest owners to carry out eligible conservation activities, to—</text> 
<paragraph id="H2B58E66B9AEF45D99E00AEE252FF5F58"><enum>(1)</enum><text>improve water quality;</text></paragraph> 
<paragraph id="H7070428011B54B3FB7048B0800B17D57"><enum>(2)</enum><text>improve habitat for at-risk species;</text></paragraph> 
<paragraph id="H67807D285D104D328F998C444559725F"><enum>(3)</enum><text>restore ecologically important forest types; or</text></paragraph> 
<paragraph id="H8DBDF995FF14483F8200A2AE466FAC24"><enum>(4)</enum><text>control invasive species.</text></paragraph></subsection> 
<subsection id="HB29A50FC9A554462AAF9E674D6E2DB5E"><enum>(b)</enum><header>Priority</header><text display-inline="yes-display-inline">The Secretary shall give priority to projects that involve multiple landowners implementing eligible conservation activities in a coordinated way to address the purposes described in subsection (a).</text></subsection> 
<subsection id="HD977DEE2305D4B56AD2F03B0ADCBD8AC"><enum>(c)</enum><header>Funding</header> 
<paragraph id="HCEDA61AC00D74297ACB7DA62796FE843"><enum>(1)</enum><header>Amounts</header><text>The Secretary shall use funds of the Commodity Credit Corporation to carry out this section in the following amounts:</text> 
<subparagraph id="H8C675A5491424FBAB4FE1BA74FC7FBD"><enum>(A)</enum><text display-inline="yes-display-inline">$25,000,000 for fiscal year 2008;</text></subparagraph> 
<subparagraph id="H7F6F619E0C8E4381BB931F828C16927F"><enum>(B)</enum><text>$45,000,000 for fiscal year 2009;</text></subparagraph> 
<subparagraph id="H8F9E6DB6CA0847AFAED755EBD4FECFEE"><enum>(C)</enum><text>$60,000,000 for fiscal year 2010;</text></subparagraph> 
<subparagraph id="H63304B47F2404428AD0035F0185BD617"><enum>(D)</enum><text>$75,000,000 million for each of fiscal years 2011 and 2012; and</text></subparagraph> 
<subparagraph id="HC5562613C1B94F8CA16927EFDDD70092"><enum>(E)</enum><text>$100 million for fiscal year 2013.</text></subparagraph></paragraph>

<section id="H0EE47510B3D848548024F6A166284263"><enum>1240K.</enum><header>Enhanced nutrient and manure management</header> 
<subsection id="HB3C553974D0E49CC85A1F33D8BB6AFFA"><enum>(a)</enum><header>Demonstration and implementation of nutrient and manure management conservation practices</header><text display-inline="yes-display-inline">In carrying out the program under this chapter, the Secretary shall provide cost-share, incentive payments, and technical assistance to agricultural producers to demonstrate and implement innovative and advanced conservation measures that hold substantial promise for producing cost-effective improvements to air and water quality by reducing the loss of nutrients to the environment. Such conservation measures may include:</text> 
<paragraph id="H5B7A50999B1D4C6C896BEA3BAC5DFEF6"><enum>(1)</enum><text display-inline="yes-display-inline">Manure processing and treatment technologies to permit more effective use and transport of manure nutrients, including energy production.</text></paragraph> 
<paragraph id="H61E6ED437D984228807F9EEEED840221"><enum>(2)</enum><text>Innovative land management practices for nutrient loss reduction, such as soil amendments, innovative cropping or grazing systems, precision nutrient application, on-farm analysis of nutrient needs, and performance-based incentive systems.</text></paragraph> 
<paragraph id="HD4AE3108E82B49E00007FC427FB534E8"><enum>(3)</enum><text>Feed management.</text></paragraph> 
<paragraph id="H0116F36CA80E4093931D497B62A04BFB"><enum>(4)</enum><text>Other projects that demonstrate and transfer the most cost-effective measures and technologies to reduce nitrogen and phosphorus losses.</text></paragraph></subsection> 
<subsection id="H95EF4F55F3774F92BD004972438EB68E"><enum>(b)</enum><header>Priorities</header><text display-inline="yes-display-inline">The Secretary shall give priority to projects that—</text> 
<paragraph id="HAA3A0DDFC22744D6A27166A26949D5D5"><enum>(1)</enum><text>involve multiple landowners implementing conservation measures described in subsection (a) in a coordinated way to address the purposes of this section; </text></paragraph> 
<paragraph id="H1E65690C0A474F3C829086FD02D99527"><enum>(2)</enum><text>have a high likelihood of advancing or demonstrating advanced manure or nutrient management measures; and </text></paragraph> 
<paragraph id="H348869C05CDF4D2E84D8BDA999FB508C"><enum>(3)</enum><text>are anticipated to produce significant benefits to air and water quality.</text></paragraph></subsection> 
<subsection id="H01F4C42EE5524662814751DB8EBD6251"><enum>(c)</enum><header>Locations of projects</header><text>To be eligible to receive assistance under this section, a project must be located in a watershed or subwatershed of a body of water impaired by nutrients in which either—</text> 
<paragraph id="H6F17FED6382349F28491003707A62F2D"><enum>(1)</enum><text>the amount of nutrients contained in manure produced in the watershed or subwatershed exceeds the amount that can be applied to cropland at agronomic rates; or</text></paragraph> 
<paragraph id="H56388907310247B9A7A6DC3B66EE8B19"><enum>(2)</enum><text>conventional nutrient management techniques are inadequate to meet water quality standards.</text></paragraph></subsection> 
<subsection id="H7578B977A1684C77A6D7AB007002582"><enum>(d)</enum><header>Regional technical advisory committees</header> 
<paragraph id="H9DB2A9D5CA264F8F8EA73D713D66A8D7"><enum>(1)</enum><header>Establishment</header><text>The Secretary shall establish regional technical advisory committees to assist the Secretary in selecting projects for funding under this section.</text></paragraph> 
<paragraph id="H257D227661344E5CA771858BB7D39300"><enum>(2)</enum><header>Participation</header><text>A regional technical advisory committee shall include scientists and other persons with expertise related to innovative and advanced nutrient management, to be appointed from agencies within the Department of Agriculture, other Federal and State agencies, producer associations, environmental organizations, and other interested groups.</text></paragraph> 
<paragraph id="HB212E5FD76884D16B0D4451D8B54FE11"><enum>(3)</enum><header>Relationship to state technical committees</header><text>Subtitle G, relating to State technical committees shall apply to a regional technical advisory committee, except that members of the committee shall be appointed on a regional basis consistent with paragraph (2).</text></paragraph></subsection> 
<subsection id="H458605509F234944B72C005D6F5716D6"><enum>(e)</enum><header>Equal treatment</header><text>In implementing this section, the Secretary shall ensure that farms of all sizes are treated equitably.</text></subsection> 
<subsection id="H4FC325017D4A4A119F7172D07F67D0E5"><enum>(f)</enum><header>Funding</header><text display-inline="yes-display-inline">In addition to amounts made available under section 1241(a)(6) to carry out this chapter, the Secretary shall use funds of the Commodity Credit Corporation to carry out this section in the following amounts:</text> 
<paragraph id="H8E7B7F65B72343F59FD93F45DC9F9883"><enum>(1)</enum><text>$160,000,000 for fiscal year 2008.</text></paragraph> 
<paragraph id="H7B736ED38D3948388DC0B15412B13477"><enum>(2)</enum><text>$175,000,000 for fiscal year 2009.</text></paragraph> 
<paragraph id="H3293B5904FA14808B8F3B8512DFEFF94"><enum>(3)</enum><text>$200,000,000 for each of fiscal years 2010, 2011, 2012, and 2013.</text></paragraph></subsection></section> 
<section id="H8BD118F934C74773B5517C8317AFB049"><enum>1240L.</enum><header>Performance incentives for States</header> 
<subsection id="H0DD4F4730C1041CF912F6032E9D7677B"><enum>(a)</enum><header>High level of performance bonus</header><text>For each of fiscal years 2008 through 2013, 10 percent of the funds made available under this chapter shall be reserved by the Secretary for bonus allocations to States that demonstrate a high level of performance in implementing the environmental quality incentives program.</text></subsection> 
<subsection id="HFAB09B2C7107445C996748B62BDC9DE5"><enum>(b)</enum><header>Special considerations</header><text>In evaluating State performance under subsection (a), the Secretary shall reward States that—</text> 
<paragraph id="HE6B18494E7704A56B1C8290061731EA9"><enum>(1)</enum><text>consistently meet the requirements of section 1240C in evaluating offers and payments;</text></paragraph> 
<paragraph id="H70A68A686E034A028EB0E3D21142D0FA"><enum>(2)</enum><text>dedicate a portion of their annual environmental quality incentives program allocation to multi-producer cooperative efforts to address specific resource concerns;</text></paragraph> 
<paragraph id="H8E82A2CBE2DB48F0A3AEFD408BA0F2D6"><enum>(3)</enum><text display-inline="yes-display-inline">collaborate with other Federal and State agencies, local governments, educational institutions, and for-profit and nonprofit organizations to monitor and evaluate the environmental outcomes associated with implementation of the environmental quality incentives program;</text></paragraph> 
<paragraph id="H4E8E1FB04FFA4E89AF839E1C38F46C3E"><enum>(4)</enum><text>demonstrate effective and efficient program delivery, including the provision of adequate technical assistance to all program participants through appropriate staffing and through cooperation with other Federal, State, Tribal, and local agencies, for-profit and nonprofit organizations, and individuals with demonstrated expertise in the planning and implementation of conservation practices, systems, and approaches;</text></paragraph> 
<paragraph id="H21A2A5FA2CE042459CD0212133B79062"><enum>(5)</enum><text>support and encourage innovative approaches to addressing resource concerns; and</text></paragraph> 
<paragraph id="HF4E65624022445EC9300742660EA006F"><enum>(6)</enum><text display-inline="yes-display-inline">demonstrate effective outreach and innovative approaches to reaching and serving beginning farmers and ranchers, limited-resource producers, and operators with lower rates of historical participation in Federal farm and conservation programs.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section display-inline="no-display-inline" id="H98B5FE3EB5F644348DAE1D39DE00B26D" section-type="subsequent-section"><enum>106.</enum><header>Reauthorization of and increased funding for wildlife habitat incentive program</header> 
<subsection id="H546533CB1E044AEEB3D4BDC1853F93D1"><enum>(a)</enum><header>Extension and funding</header><text display-inline="yes-display-inline">Section 1241(a)(7) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3841">16 U.S.C. 3841(a)(7)</external-xref>) is amended by striking subparagraphs (A) through (D) and inserting the following new subparagraphs:</text>

<subparagraph id="H52FA11F6C6BE4DB69B8D54FB167F82BE"><enum>(A)</enum><text display-inline="yes-display-inline">protect or restore habitat for a federally or State-listed rare, threatened, endangered, and candidate species; or</text></subparagraph> 
<subparagraph id="HA09E7DC7177B40EDB9C8CA00EB82D279"><enum>(B)</enum><text>further the goals and objectives of a State’s comprehensive wildlife conservation strategy.</text></subparagraph></paragraph> 
<paragraph id="H9AD76C9AEF0547D0B762CF067242E502"><enum>(2)</enum><header>Incentive payments for certain agreements and applications</header><text display-inline="yes-display-inline">In a case in which the Secretary enters into an agreement or contract described in paragraph (1), the Secretary may provide incentive payments to landowners under the agreement or contract, including the cost of management activities needed during the term of the agreement or contract.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HEB48B00DF3A549E68421B537A500EE7F"><enum>(d)</enum><header>Fish habitat</header><text>Section 1240N of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3839bb-1">16 U.S.C. 3839bb–1</external-xref>) is further amended by inserting after subsection (d), as added by subsection (c), the following new subsection:</text>

<subsection id="H03E2C9A3501B4AE2B1051277679754C4"><enum>(e)</enum><header>Development of fish habitat</header> 
<paragraph id="HEA51903AC4634337B5D4D26CE433229E"><enum>(1)</enum><header>Purposes of cost-share payments</header><text>Subsection (b)(1)(D) authorizes the Secretary to make cost-share payments to landowners to develop fish habitat. The development of fish habitat using such cost-share payments may include activities—</text> 
<subparagraph id="HBC5959B7B1434EC2A2C6666CC1D1CC"><enum>(A)</enum><text display-inline="yes-display-inline">to protect streamside areas, including through the installation of riparian fencing and improved stream crossings;</text></subparagraph> 
<subparagraph id="H81659DE3BFFD4E10AA4CD48F4FE0E0BA"><enum>(B)</enum><text>to repair in-stream habitat;</text></subparagraph> 
<subparagraph id="H0577F1E206C549E300428FF5E8DA47E5"><enum>(C)</enum><text>to improve water flows and water quality, including through channel restoration;</text></subparagraph> 
<subparagraph id="H87EFD4D3A0E747CCB7BAB9CCEECEC655"><enum>(D)</enum><text>to initiate watershed management and planning in areas in which streams are in a degraded condition due to past agricultural or forestry practices; and</text></subparagraph> 
<subparagraph id="H9CC3F6C645B04C01ABBC97335B6000AB"><enum>(E)</enum><text>to undertake other types of stream habitat improvement approved by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="HC3BABF84AC47417FBC6DF357D9004F99"><enum>(2)</enum><header>Priority projects</header><text display-inline="yes-display-inline">When considering applications describing projects to protect or restore fish habitat, the Secretary shall give priority to applicants who will use the cost-share payments to carry out a project—</text> 
<subparagraph id="H64569D0FB7FD4E37AAC005BAD4DCA4E6"><enum>(A)</enum><text>to remove a small dam or in-stream structure;</text></subparagraph> 
<subparagraph id="HB92DFF4912F94883BF5697A769648E5B"><enum>(B)</enum><text>to improve fish passage, including through culvert repair and maintenance;</text></subparagraph> 
<subparagraph id="HF994DB1D492648ED94ADB4004675B7B1"><enum>(C)</enum><text>to protect streamside areas;</text></subparagraph> 
<subparagraph id="HBF468C385CBF4AD0B5D57661B76DCA00"><enum>(D)</enum><text>to improve water flows, including through irrigation efficiency improvements; or</text></subparagraph> 
<subparagraph id="HC2F9D6B849BE45669E73DF97D6F4E3EA"><enum>(E)</enum><text>to improve in-stream flow quality or timing or temperature regimes.</text></subparagraph></paragraph> 
<paragraph id="H1D49FF541B5B4B04945D45E99E6879E0"><enum>(3)</enum><header>Priority for projects including upland improvements</header><text display-inline="yes-display-inline">In addition to the priority projects described in paragraph (2), to ensure that projects intended to protect or restore fish habitat also address the causes of stream habitat degradation, the Secretary shall give priority among applications describing such projects to applicants who demonstrate that upland improvements associated with the stream habitat improvement, including erosion and nutrient management have been, or will be, carried out.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>

<subsection id="H5FAC310C76BE4CBCB69B1312030011F1"><enum>(a)</enum><header>Establishment of grant program</header><text display-inline="yes-display-inline">Subtitle D of title XII of the Food Security Act of 1985 is amended by adding at the end the following new chapter:</text>

<subsection id="HF267CC1A5BCF4344A3E680D6B4C6E32C"><enum>(a)</enum><header>Grants and Agreements</header><text display-inline="yes-display-inline">The Secretary shall make grants and enter into agreements for not shorter than two-year or longer than five-year terms with eligible entities specified in subsection (c) to preferentially enroll producers in one or more of the programs specified in subsection (b) to carry out special projects and initiatives through which multiple producers and other interested persons cooperate to improve water quality or address other specific resources of concern related to agricultural production on a local, State, or regional scale.</text></subsection> 
<subsection id="H90E6ADE50549418191EADF00C7272048"><enum>(b)</enum><header>Covered programs</header><text>The conservation programs referred to in subsection (a) are the following:</text> 
<paragraph id="H645E436FAC0D46F8A9EED8EDD05785E7"><enum>(1)</enum><text display-inline="yes-display-inline">Conservation reserve program, but only the continuous signup portion of the program.</text></paragraph> 
<paragraph id="H7DD32BEE89D148AF98CF6D5793D1FF10"><enum>(2)</enum><text display-inline="yes-display-inline">Conservation reserve enhancement program. </text></paragraph> 
<paragraph id="HC9E8AAD79E3D406B8781EE85ADDCBBD"><enum>(3)</enum><text>Environmental quality incentives program.</text></paragraph> 
<paragraph id="H884918B5CB6C41E1AB0078A7C0594BFF"><enum>(4)</enum><text>Farmland protection program.</text></paragraph>

<paragraph id="H3604BA5C9DCB4FD883A8C77F86D8931"><enum>(4)</enum><text display-inline="yes-display-inline">Nongovernmental organizations and associations, including conservation organizations and producer associations and cooperatives.</text></paragraph></subsection> 
<subsection id="HD16034D5B4984897ACC9463996967188"><enum>(d)</enum><header>Applications</header> 
<paragraph id="HB4112A7D0E1B4BB98802007180BDDAA3"><enum>(1)</enum><header>Competitive process</header><text display-inline="yes-display-inline">The Secretary shall establish a competitive process for considering applications for agreements under this section consistent with the evaluation criteria listed in subsection (e).</text></paragraph> 
<paragraph id="H90CD1C99A09C4E7C93D11CEB32B320B7"><enum>(2)</enum><header>Program allocation</header><text>Applications shall include—</text> 
<subparagraph id="H81EA6D15BEC24F279B5D72E97116A808"><enum>(A)</enum><text>specification of the amount of funding or acres of one or more covered programs specified in subsection (b) proposed to be allocated to carry out the special project or initiative; and</text></subparagraph> 
<subparagraph id="HB66CE47CEED040188E4CD4B2590000E4"><enum>(B)</enum><text>a schedule for utilization of funding or acres over the life of the proposed project or initiative.</text></subparagraph></paragraph></subsection> 
<subsection id="H1E9318338CE84E0E9CB8DB62936FA2C1"><enum>(e)</enum><header>Evaluation criteria</header><text>In evaluating applications for agreements under this section the Secretary shall consider the extent to which—</text> 
<paragraph id="H5A11F6DD4C564222A80695537E38C918"><enum>(1)</enum><text>preferential enrollment in the covered programs specified in the application will effectively address the environmental objectives established for the special project or initiative; and</text></paragraph> 
<paragraph id="HE4A3EE9CBB614F3EB571862CFAC5351E"><enum>(2)</enum><text>the special project or initiative covered by the application—</text> 
<subparagraph id="H06AFDD8B7DEA4C5D98F042C051694906"><enum>(A)</enum><text>enjoys broad local and regional support from producers and other interested persons, including governmental and nongovernmental organizations with appropriate expertise on the issues the project or initiative seeks to address;</text></subparagraph> 
<subparagraph id="H88406E7AFD9940B7B32F1F2F4FC5E006"><enum>(B)</enum><text>includes clear environmental objectives and a high likelihood of success;</text></subparagraph> 
<subparagraph id="H914288EDF4FF45B9B9EB9D85C63EAF5"><enum>(C)</enum><text display-inline="yes-display-inline">includes a well defined project or initiative plan that identifies sensitive areas requiring treatment and prioritizes conservation systems, practices, and activities needed to achieve environmental objectives;</text></subparagraph> 
<subparagraph id="HD87F665AB2324B96BAC051A7C9318BE4"><enum>(D)</enum><text>promises adequate and coordinated participation to achieve the objectives of the project or initiative;</text></subparagraph> 
<subparagraph id="H017C13172AFC4DC98D487B0031835C29"><enum>(E)</enum><text display-inline="yes-display-inline">coordinates integration of local, State, and Federal efforts to make the best use of available resources and maximize cost-effective investments;</text></subparagraph> 
<subparagraph id="H48B34171484B4469987F03BBFF78F467"><enum>(F)</enum><text>leverages financial and technical resources from sources other than the programs authorized by this subtitle, including financial and technical resources provided by Federal and State agencies, local governments, nongovernmental organizations and associations, and other private sector entities;</text></subparagraph> 
<subparagraph id="H712D065DEFBA48279ED8F95F197F787B"><enum>(G)</enum><text>describes how all necessary technical assistance will be provided to each producer participating in the project or initiative, including cost estimates for technical assistance and whether such assistance will be provided by technical service providers;</text></subparagraph> 
<subparagraph id="HB5C37910A62C46FAB1F3FED0DFD81B59"><enum>(H)</enum><text display-inline="yes-display-inline">addresses a local, State, regional, or national environmental priority or priorities, with particular emphasis on any priority for which there is an existing State or federally approved plan in place for addressing that priority;</text></subparagraph> 
<subparagraph id="H3D98EF4500404A50955E00B487661076"><enum>(I)</enum><text display-inline="yes-display-inline">links environmental and conservation objectives with other objectives, such as spurring rural economic development through increased opportunities in the project area for recreation, value-added enterprises, or direct marketing of agricultural products, and assisting beginning, limited resource, tribal, and other producers maintain the viability of their operations;</text></subparagraph> 
<subparagraph id="H71B3B1E215FC415B9091C5145973821F"><enum>(J)</enum><text>includes a plan to evaluate progress and measure results; and</text></subparagraph> 
<subparagraph id="H3C2FF213EF0648CF964B00B2877C82E6"><enum>(K)</enum><text display-inline="yes-display-inline">clearly demonstrates that enrollment of producers in covered programs will be consistent with the purposes and policies of each individual program, as established in statute, rules and regulations, and program guidance promulgated by implementing agencies.</text></subparagraph></paragraph></subsection> 
<subsection id="H9FE73D394E714CD0AAAE51410F5EE47"><enum>(f)</enum><header>Priorities</header><text display-inline="yes-display-inline">To the maximum extent practicable, consistent with the requirements of subsection (d), the Secretary shall ensure that, each fiscal year, grants are awarded and agreements are entered into under this section to support projects and initiatives that collectively address the full range of resource concerns facing producers, ranchers, and small private forest landowners, including specifically projects and initiatives that are designed—</text> 
<paragraph id="H68B20EE2BB184505A0C8824CE3219159"><enum>(1)</enum><text>to achieve improvements in water quality in watersheds impacted by agriculture, particularly by increasing the participation of producers in implementing best management practices in a watershed or developing environmentally and economically viable alternative uses for manure and litter;</text></paragraph> 
<paragraph id="HAC60EB502D7441959F9D002603F52771"><enum>(2)</enum><text display-inline="yes-display-inline">to achieve improvements in air quality in a geographical area where agricultural operations impact air quality, especially an area that, as determined by the Administrator of the Environmental Protection Agency, is a nonattainment area with respect to any of the national ambient air quality standards promulgated by the Administrator under section 109 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409</external-xref>);</text></paragraph> 
<paragraph id="HA1342DC3872B41C59C31ABEF9FAB51B9"><enum>(3)</enum><text>to conserve water for environmental purposes such as enhanced in stream flows or aquifer recharge in regions, States, or local areas where water quantity is a concern;</text></paragraph> 
<paragraph id="H3478CD74845B4ECDA5DF90AB28A5E3DF"><enum>(4)</enum><text display-inline="yes-display-inline">to assist in the recovery of Federal or State-listed endangered species or species of special concern or to further the goals and objectives of a State’s comprehensive wildlife conservation plan through the cooperative efforts of multiple producers;</text></paragraph> 
<paragraph id="HDB833557D7424FB3A1D3577395868589"><enum>(5)</enum><text>to control invasive species on rangeland or other agricultural land through the cooperative efforts of multiple producers in a geographical area;</text></paragraph> 
<paragraph id="HD98A1473C8BF4C90AC086C464E1447B6"><enum>(6)</enum><text>to address a specific resource of concern or set of concerns on private, non-industrial forest land;</text></paragraph> 
<paragraph id="H3C1E464071D84C6E981090AB1D19F4AA"><enum>(7)</enum><text>to reduce losses of pesticides to the environment by engaging multiple producers in a geographic area in adoption of integrated pest management practices and approaches; and</text></paragraph> 
<paragraph id="HAF04B218497D451CBA1024D2580081A8"><enum>(8)</enum><text display-inline="yes-display-inline">to keep working farms and ranches facing development pressures in agricultural use.</text></paragraph></subsection> 
<subsection id="H52A844AC3690425F81D48519E977C895"><enum>(g)</enum><header>Cost share</header> 
<paragraph id="HD203E52E395E4E32B04786AEB766B439"><enum>(1)</enum><header>Maximum; exceptions</header><text display-inline="yes-display-inline">The Secretary shall not require more than 25 percent of the cost of a project or initiative supported under an agreement entered into under this section to come from non-Federal sources. However, the Secretary may award more points to projects or initiatives offering to cover a higher percentage of the cost of the project or initiative from non-Federal sources.</text></paragraph> 
<paragraph id="HCEB42E58E6D24B0A81570081F99473E"><enum>(2)</enum><header>In-kind contributions</header><text display-inline="yes-display-inline">If the Secretary establishes a cost-share requirement for a project or initiative, the Secretary shall allow the use of in-kind contributions to meet that requirement.</text></paragraph></subsection> 
<subsection id="H1FA190FD80F24C089557DDD91FABE3AB"><enum>(h)</enum><header>Funding</header> 
<paragraph id="H7C6058A2B2CC48D4B4EDFEA4E19AADC"><enum>(1)</enum><header>Set-aside</header><text display-inline="yes-display-inline">Of the funds provided each fiscal year to implement the programs specified in subsection (b), the Secretary shall use 20 percent to provide funds under agreements entered into under this section.</text></paragraph> 
<paragraph id="H3666D3BA3F1644DCB9066FF7ECC03536"><enum>(2)</enum><header>Allocation to states</header><text display-inline="yes-display-inline">The Secretary shall allocate to States 60 percent of the funds reserved under paragraph (1) to allow State Conservationists, with the advice of State technical committees, to select projects and initiatives for funding under this section at the State level.</text></paragraph> 
<paragraph id="H340576649B7F4B269C1E7086F2543B2F"><enum>(3)</enum><header>Water quality</header><text display-inline="yes-display-inline">To the maximum extent practicable and consistent with the other requirements of this section, the Secretary shall ensure that 50 percent of the funds awarded each year under this section are awarded to projects and initiatives that will improve water quality.</text></paragraph></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H15B7BE2CD5F74677B2A0823C2D40F9F2"><enum>(b)</enum><header>Conforming repeal</header><text>Section 1243 of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3843">16 U.S.C. 3843</external-xref>) is amended by striking subsection (f).</text></subsection></section> 
<section display-inline="no-display-inline" id="H6777C62B8EE54CA584E4AA0038541315" section-type="subsequent-section"><enum>108.</enum><header>Regional equity in funding of certain Department of Agriculture conservation programs</header><text display-inline="no-display-inline">Subsection (d) of section 1241 of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3841">16 U.S.C. 3841</external-xref>) is amended to read as follows:</text>

<paragraph id="H8FDFF84F45FE4E9E9B3C61CADD52BA64"><enum>(1)</enum><header>Minimum allocation</header><text display-inline="yes-display-inline">In allocating funds to States to implement the conservation programs under this subtitle D, other than the programs excluded by paragraph (2), the Secretary shall ensure that each State receives, at a minimum, $15,000,000 for each of the fiscal years 2007 through 2013. Funds provided as part of a cooperative conservation partnership initiative under chapter 6 to a project in a State or in a State adjacent to that State shall not be counted as part of the minimum base allocation to that State under this subsection.</text></paragraph>

<section display-inline="no-display-inline" id="HDD7D2177599E4C00AAE26700FF1DB727" section-type="subsequent-section"><enum>111.</enum><header>Community Forests and Open Space Conservation Program</header> 
<subsection id="H547570CF027E457BA9853B394941B595"><enum>(a)</enum><header>Findings</header><text>Congress makes the following findings:</text> 
<paragraph id="HE708C6310835496F8D316DBAE44E9760"><enum>(1)</enum><text display-inline="yes-display-inline">The United States Forest Service projects that 44 million acres of privately owned forested land will be developed in the United States by 2030, including many of the most important remaining forested parcels within and adjacent to communities.</text></paragraph> 
<paragraph id="H72D1481BAAC046BABCFCB68600487D3B"><enum>(2)</enum><text>There is an urgent need to assist local governments in raising the funds necessary to purchase the most important of these parcels of privately owned forested land as they come up for sale.</text></paragraph> 
<paragraph id="H63730B2E727846629243E1D391474FC3"><enum>(3)</enum><text display-inline="yes-display-inline">The breakup of forested land into smaller parcels has resulted in an increasing number of owners of privately owned forested land, but many of these owners have little or no experience in forest stewardship.</text></paragraph> 
<paragraph id="H9B939C2E81DD434CBABA725B18F331FC"><enum>(4)</enum><text display-inline="yes-display-inline">In fast growing communities of all sizes across the United States, the remaining parcels of privately owned forested land play an essential role in protecting public water supplies, which has lead many local governments to purchase these lands for municipal or county ownership.</text></paragraph> 
<paragraph id="H458CD45A8D0D4F2AA3D2F070009099F9"><enum>(5)</enum><text display-inline="yes-display-inline">Rising rates of obesity and other public health problems related to inactivity have been shown to be ameliorated by improving public access to safe and pleasing areas for outdoor recreation, which has lead many local governments to purchase lands for recreational purposes under municipal or county ownership.</text></paragraph> 
<paragraph id="H827AAF46CDE5480AA915E0EEE1D9F52C"><enum>(6)</enum><text>Across the United States, many communities of diverse types and sizes are deriving significant financial benefit from owning and managing municipal or county forestlands as a source of local revenue that also contributes significantly to the health of the forest products economy at the local and national levels.</text></paragraph> 
<paragraph id="HCC2164A31AE8494F8D63D1812EB7E42"><enum>(7)</enum><text display-inline="yes-display-inline">The access to privately owned forested land for hunting, fishing, and trapping has declined, and the number of persons participating in these activities has likewise declined, as these lands are divided into smaller parcels and more owners of privately owned forested land post their land against public use, which has lead many local governments to purchase forestlands to guarantee access for hunting, fishing, and trapping.</text></paragraph> 
<paragraph id="H719B19BCB4154FCAA5D54F339DA4EA94"><enum>(8)</enum><text display-inline="yes-display-inline">There is a national interest and an urgent need to assist local governments in raising the funds necessary to purchase important privately owned forested land that will maintain the diverse public benefits of forestlands close to or within all manner of communities nationwide, from close-knit rural communities to fast growing suburban and exurban areas.</text></paragraph></subsection> 
<subsection id="H1EE74301D2214AF08256A2F796C02B9F"><enum>(b)</enum><header>Establishment of program</header><text display-inline="yes-display-inline">The Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2101">16 U.S.C. 2101 et seq.</external-xref>) is amended by adding at the end the following new section:</text>

<section id="H2B6C5C5BB8754650903922BF7E6E1704"><enum>21.</enum><header>Community Forests and Open Space Conservation Program</header> 
<subsection id="H1EB68A44A3B94F099F2F288EA422DCB5"><enum>(a)</enum><header>Establishment and purpose</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall establish within the Forest Service a program to be known as the <quote>Community Forests and Open Space Conservation Program</quote> (in this section referred to as the <quote>Program</quote>) for the purpose of assisting local governments in a State selected to participate in the Program to acquire forested land that—</text> 
<paragraph id="HC27EFEACF3F44CCFB6DC47CDC3C1F58D"><enum>(1)</enum><text>is economically, culturally, and environmentally important to the locality in which the land is located;</text></paragraph> 
<paragraph id="H4F0311224EB940F08B3889398EE9B873"><enum>(2)</enum><text>is threatened by conversion to non-forest uses; and</text></paragraph> 
<paragraph id="H3DA33386A883427CA08F4DC49DFE184C"><enum>(3)</enum><text>will conserve public access to and benefit from the land for a wide variety of public purposes, including model forest stewardship, sustainable timber production, forest-based educational and cultural activities, wildlife habitat protection, watershed protection, or outdoor recreation, including hunting and fishing.</text></paragraph></subsection> 
<subsection id="H9D3CCAAC993847FA9491656B6C8564D4"><enum>(b)</enum><header>Selection of participating states</header> 
<paragraph id="H920D5DA891D7411D95AA7A85BDA6500"><enum>(1)</enum><header>Selection</header><text>Not later than one year after the date of the enactment of this section, the Secretary shall select at least one State in each of the New England, Mid-Atlantic, Midwest, South, West, and Pacific Northwest regions of the United States to participate in the Program. The Secretary shall make the selections from among applications submitted by willing States. No State shall be compelled to participate in the Program.</text></paragraph> 
<paragraph id="H5DABBEC44B234A709D25C26C20A546E"><enum>(2)</enum><header>Implementation</header><text display-inline="yes-display-inline">Authority for implementation of the Program in a participating State shall lie with the State forester, equivalent State official, or other appropriate State natural resource management agency designated by the Governor of the State.</text></paragraph></subsection> 
<subsection id="H29132A6348B044E083345527D4723B84"><enum>(c)</enum><header>Eligibility and ranking criteria</header> 
<paragraph id="HFF230517C1BB4EF6BA34E8CAE951889C"><enum>(1)</enum><header>State assessment of need</header><text display-inline="yes-display-inline">Each participating State shall prepare an assessment of need that identifies the geographic areas within the State that will be the focus of land acquisition activities under the Program and priority objectives for conservation, based on conditions and public needs in the State. This requirement may be satisfied by inclusion of the assessment as part of an integrated State-wide forest planning process for application of Federal programs in the State.</text></paragraph> 
<paragraph id="H82607B90C7C144419E664021B25BC11B"><enum>(2)</enum><header>Establishment of criteria</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this section, the Secretary shall establish eligibility and ranking criteria for the selection of land acquisition proposals to receive funding under the Program. The Secretary shall establish the criteria in consultation with State Forest Stewardship Advisory Committees, State Urban and Community Forestry Advisory Committees, and similar organizations.</text></paragraph> 
<paragraph id="HB9F82910C9CA4FA19890B35CEBE39916"><enum>(3)</enum><header>Priorities</header><text display-inline="yes-display-inline">In establishing the eligibility and ranking criteria under paragraph (2), the Secretary shall give priority to the acquisition of lands that—</text> 
<subparagraph id="H957A77C8C44D438DBDE293CC26D65B3"><enum>(A)</enum><text>meet identified local open space and natural resource needs, as expressed in town plans, regional plans, or other relevant local planning documents;</text></subparagraph> 
<subparagraph id="HBF5EC82706954C49A415C1DCB5379D4E"><enum>(B)</enum><text>can be effectively managed to model good forest stewardship for private landowners and support forest-based educational programs, including vocational education in forestry;</text></subparagraph> 
<subparagraph id="H7BDBD98DC4E74438AD49F595B4208166"><enum>(C)</enum><text>provide significant protection of public water supplies or other waterways;</text></subparagraph> 
<subparagraph id="HB14F0B4178744CC8A1AE1F2FC9C629F6"><enum>(D)</enum><text>can offer long-term economic benefit to communities through forestry;</text></subparagraph> 
<subparagraph id="H662735EB5E3147A1BFCA254B710440C4"><enum>(E)</enum><text>contain important wildlife habitat; </text></subparagraph> 
<subparagraph id="H5359C87DD6A54C808DA3E1C4D01D96C"><enum>(F)</enum><text>provide convenient public access for outdoor recreation, including hunting and fishing; and</text></subparagraph> 
<subparagraph id="HB3C391041D6E471CBA89307E3733A465"><enum>(G)</enum><text>are most threatened with conversion to non-forest uses.</text></subparagraph></paragraph></subsection> 
<subsection id="HFA93F5A8AB704411BDA6860048138400"><enum>(d)</enum><header>Application and ranking of proposals</header> 
<paragraph id="H0F1BBFCB62EF4AA0A9A0EC71AA3741AE"><enum>(1)</enum><header>Preparation and contents</header><text display-inline="yes-display-inline">A local government in a participating State may prepare an application for assistance under the Program in the acquisition of forested land within the geographic program focus area in the State identified under subsection (c)(1). The application shall include certification by the appropriate unit or units of local government that the proposed land acquisition is consistent with any comprehensive plans for development adopted by the unit of local government and include such other information as the Secretary may prescribe.</text></paragraph> 
<paragraph id="H918A5D49A4B44D3BB79077B8ED7F8C33"><enum>(2)</enum><header>Submission</header><text display-inline="yes-display-inline">Participating States shall rank all applications according to priority and submit the applications to the Secretary at such times and in such form as the Secretary may prescribe.</text></paragraph> 
<paragraph id="HBA5B90C2861042D399C91802A0377567"><enum>(3)</enum><header>National list</header><text display-inline="yes-display-inline">The Secretary shall maintain a national list of all submitted applications, ranked according to the criteria established pursuant to subsection (c).</text></paragraph></subsection> 
<subsection id="H2FEDD656C82643D5B7B315A079749EFB"><enum>(e)</enum><header>Ownership of land</header> 
<paragraph id="H81068A5658064688BC9EFBD7CFB379F1"><enum>(1)</enum><header>Government ownership</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), all land acquired in whole or in part using funds provided under the Program shall be owned in fee simple by a local government, such as a municipality or county.</text></paragraph> 
<paragraph id="H17C4B4D45B974CF4902CE4C2774B29A6"><enum>(2)</enum><header>Nonprofit organization ownership</header><text display-inline="yes-display-inline">Upon the request of a participating State, designated nonprofit organizations operating within that State may also own land acquired using funds provided under the Program, subject to the condition that the land is open for public access consistent with the purposes and criteria of the Program.</text></paragraph> 
<paragraph id="H6F9C19F0BFF142C1865E97DC00448B96"><enum>(3)</enum><header>Effect of violation</header><text display-inline="yes-display-inline">If the owner of land acquired in whole or in part using funds provided under the Program sells the land, the owner shall reimburse the Secretary for the full amount of the funds provided under the Program, plus a penalty equal to 50 percent of the sale price or appraised value of the land at the time of the sale, whichever is greater. The local government or designated nonprofit organization that sold the land shall no longer be eligible for assistance under the Program.</text></paragraph></subsection> 
<subsection id="H125C4A04D29146AF9409D33C549BB070"><enum>(f)</enum><header>Duties of owners</header> 
<paragraph id="H3B3BD794C4B44D7EA9B7905548775186"><enum>(1)</enum><header>Use and prohibition on conversion</header><text display-inline="yes-display-inline">The owner of land acquired in whole or in part using funds provided under the Program shall manage the land in a manner that is consistent with the purposes for which the land was purchased under the Program and shall not convert the property to other non-forest uses. Public access for compatible recreational uses, as determined by the owner, shall be required.</text></paragraph> 
<paragraph id="H3299C1E84F4D4A81BE9BF18426672A8"><enum>(2)</enum><header>Management plan</header><text display-inline="yes-display-inline">Not later than two years after the closing date on the purchase of land using funds under the Program, the owner of the land shall complete a management plan for the land, which shall be subject to the approval of the responsible State agency. Management plans shall be created through a public process that allows for community participation and input.</text></paragraph></subsection> 
<subsection id="H96D219B0A36A4034B4EAC104B6EC57AF"><enum>(g)</enum><header>Cost Sharing requirements</header> 
<paragraph id="HB9EF74974253407700CDCF4B07EFB7C9"><enum>(1)</enum><header>Cost sharing</header><text display-inline="yes-display-inline">In accordance with such terms and conditions as the Secretary may prescribe, costs for the acquisition of land under the Program, and other costs associated with the Program, shall be shared among participating entities, including State, county, municipal, and other governmental units, landowners, corporations, or private organizations. Such costs may include costs associated with planning, administration, property acquisition, and property management. The Secretary may authorize in-kind contributions.</text></paragraph> 
<paragraph id="HC599674A2F514579AC746C0000138EC6"><enum>(2)</enum><header>Federal cost share</header><text display-inline="yes-display-inline">The Federal share of the cost to acquire land under the Program shall not exceed 50 percent of the total cost to acquire the land. Payments under this section shall be made in accordance with Federal appraisal and acquisition standards and procedures.</text></paragraph> 
<paragraph id="HDC4A4DFF9D374A86B109E6F739B8103"><enum>(3)</enum><header>Administration and technical assistance</header><text display-inline="yes-display-inline">In order to assist local governments in achieving model stewardship of land acquired under the Program, 10 percent of all funds appropriated for a fiscal year for the Program shall be allocated to the responsible State agencies in participating States to administer the Program and to provide technical assistance to local governments for forest stewardship, including development and implementation of management plans required by subsection (f)(2).</text></paragraph></subsection> 
<subsection id="H59CA78B443294B78BC4E037F9BF3BF81"><enum>(h)</enum><header>Private property protections</header> 
<paragraph id="HD8C14CF7F8544F4AA76BF55F7F83CE1F"><enum>(1)</enum><header>Access</header><text display-inline="yes-display-inline">Nothing in this section—</text> 
<subparagraph id="HF72EB678ECA84C05B20100BDB790E37C"><enum>(A)</enum><text>requires a private property owner to permit public access (including Federal, State, or local government access) to private property; or</text></subparagraph> 
<subparagraph id="H51F9DA36AA954494AB64C48BDA5B992"><enum>(B)</enum><text>modifies any provision of Federal, State, or local law with regard to public access to, or use of, private land.</text></subparagraph></paragraph> 
<paragraph id="H5A5CC25443DD43FDA974D6E337ED8201"><enum>(2)</enum><header>Liability</header><text display-inline="yes-display-inline">Nothing in this section creates any liability, or has any effect on liability under any other law, of a private property owner with respect to any persons injured on the private property.</text></paragraph> 
<paragraph id="H7E20A9EBCE1843B6B0E120497D24DCED"><enum>(3)</enum><header>Recognition of authority to control land use</header><text>Nothing in this section modifies any authority of Federal, State, or local governments to regulate land use.</text></paragraph> 
<paragraph id="HAE4119A4A9FD49CF84FA4072A4A9D4E"><enum>(4)</enum><header>Participation of private property owners</header><text display-inline="yes-display-inline">Nothing in this section requires a private property owner to participate in the Program.</text></paragraph></subsection> 
<subsection id="HE21AE9AAFB33415B8FF10099DD79D56E"><enum>(i)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretary to carry out the Program $50,000,000 for each of the fiscal years 2008 through 2013.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section display-inline="no-display-inline" id="H6733C7AC9F4445ECA3ADE66BC65CFE" section-type="subsequent-section"><enum>112.</enum><header>Farmland protection and farm viability programs</header><text display-inline="no-display-inline">Paragraph (4) of subsection (a) of section 1241 of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3841">16 U.S.C. 3841</external-xref>) is amended to read as follows:</text>

<subsection id="HE0FD4C1350FE4D0DA13B03F004FF0B1"><enum>(a)</enum><header>Methods of enrollment</header><text display-inline="yes-display-inline">Section 502(f)(1)of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6572">16 U.S.C. 6572(f)(1)</external-xref>) is amended by striking subparagraph (C) and inserting the following new subparagraph:</text>

<subsection id="H806AA2EA39F147E993E3F2EC5C202896"><enum>(a)</enum><header>Funding source</header><text>For each of fiscal years 2008 through 2013, the Secretary shall use the funds, facilities, and authorities of the Commodity Credit Corporation to carry out the healthy forests reserve program, including the provision of technical assistance under the program.</text></subsection> 
<subsection id="HBE697F2710D94019BDF1B8B4FAEEA9D"><enum>(b)</enum><header>Section 11 cap</header><text display-inline="yes-display-inline">The use of Commodity Credit Corporation funds under subsection (a) to provide technical assistance under the healthy forests reserve program shall not be considered an allotment or fund transfer from the Commodity Credit Corporation for purposes of the limitation on expenditures for technical assistance imposed by section 11 of the Commodity Credit Corporation Charter Act (<external-xref legal-doc="usc" parsable-cite="usc/15/714i">15 U.S.C. 714i</external-xref>).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section display-inline="no-display-inline" id="HF3C1428834A64B04AE3D4680DE26FAC0" section-type="subsequent-section"><enum>114.</enum><header>Integrated pest management initiative</header> 
<subsection id="HC124A001C04C433BBF00D9A2F7384636"><enum>(a)</enum><header>Initiative required</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall implement an integrated pest management initiative in priority areas identified by the Secretary pursuant to subsection (b) for the purpose of assisting agricultural producers operating in a priority area to comply with pest management regulations and alleviate the need for additional regulations regarding pest management activities.</text></subsection> 
<subsection id="HC22CB7C8D5F84F86B0DA5CEF7B567C48"><enum>(b)</enum><header>Identification of priority areas</header> 
<paragraph id="H2C134783AF314CA79B763356B23C9CD0"><enum>(1)</enum><header>Identification</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall identify priority areas where the adoption by agricultural producers of integrated pest management practices and approaches offers the greatest potential benefit to producers seeking to comply with pest management regulations and alleviate the need for additional regulations regarding pest management activities. At a minimum, priority areas shall include agricultural lands dominated by the production of specialty crops and agricultural lands where agricultural pest management activities are regulated for the purpose of mitigating specific impacts to human health or the environment, such as an area in which pollutants exceed authorized total maximum daily load or an air quality non-attainment area.</text></paragraph> 
<paragraph id="HAC778015E42A41D8B96831A89DAA813"><enum>(2)</enum><header>Consultation</header><text display-inline="yes-display-inline">The Secretary shall identify priority areas in consultation with the Environmental Protection Agency, the United States Geological Service, the United States Fish and Wildlife Service, agricultural producers, appropriated State agencies, and other interested persons.</text></paragraph></subsection> 
<subsection id="HBC1CBCEE795B4660935D5D299E6C6B60"><enum>(c)</enum><header>Activities in priority areas</header> 
<paragraph id="H31A6DA6704C841679113E09CC6FEAA7"><enum>(1)</enum><header>Expedited approval of management practices</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall develop the best-available integrated pest management practices for the primary agricultural commodities and significant pests in each priority area identified under subsection (b) and expedite approval of these practices for implementation by agricultural producers.</text></paragraph> 
<paragraph id="H9F251A31A0CC42CCA5E215A26B413E6D"><enum>(2)</enum><header>Improved evaluation of management plans</header><text display-inline="yes-display-inline">The Secretary shall develop and make available criteria to enable staff of the Natural Resources Conservation Service and agricultural producers operating in priority areas identified under subsection (b) to effectively compare pest management plans, considering relative risks and potential benefits to multiple resources of concern, including air, surface water, ground water, bees and other pollinators, wildlife, and worker safety.</text></paragraph> 
<paragraph id="H8AC9FC0565244FEEABE3A0DC47CEE305"><enum>(3)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">The Secretary may enter in cooperative agreements, memorandums of understanding, and contracts for services with technical service providers, other agencies, and non-Federal organizations, as necessary, to assist in providing technical assistance regarding integrated pest management planning and implementation to producers operating in priority areas identified under subsection (b).</text></paragraph> 
<paragraph id="H3846DB11A60E4F5D9F52FBF0BEAD74DA"><enum>(4)</enum><header>Marketing</header><text display-inline="yes-display-inline">The Secretary may market the availability of integrated pest management tools and training to agricultural producers in the priority areas identified under subsection (b).</text></paragraph> 
<paragraph id="H0296419F21F34B6AA3B5EFD995BA6F52"><enum>(5)</enum><header>Program integration</header><text display-inline="yes-display-inline">The Secretary shall set goals for integrating the integrated pest management initiative with the environmental quality incentives program established under chapter 4 of subtitle D of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa">16 U.S.C. 3839aa et seq.</external-xref>) and other conservation programs in each priority area identified under subsection (b), including indicators of the extent to which these programs fund integrated pest management practices and the extent to which supported integrated pest management practices reduce pesticide use and risk.</text></paragraph></subsection> 
<subsection id="HB7E14EB7531B499190DF85C3DCD3739"><enum>(d)</enum><header>Annual report</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall submit to Congress an annual report on the integrated pest management initiative, including progress in meeting the program integration goals set under subsection (c)(5).</text></subsection> 
<subsection id="H7ECA936F30E84964951CE7E2EC30AA4E"><enum>(e)</enum><header>Funding</header><text display-inline="yes-display-inline">The Secretary of Agriculture may use funds provided for the conservation security program and environmental quality incentives program under subtitle D of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3830">16 U.S.C. 3830 et seq.</external-xref>) to implement the integrated pest management initiative.</text></subsection></section> 
<section id="H35654A4054A94DE09D538B56F100EB87" section-type="subsequent-section"><enum>115.</enum><header>Conservation access initiative to encourage greater participation by socially disadvantaged farmers and ranchers in conservation programs</header> 
<subsection id="H77BF243F55814835AB5D6D37106FBA22"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HB1817DAD8F3541E3B98D823073A598CB"><enum>(1)</enum><header>Socially disadvantaged group</header><text display-inline="yes-display-inline">The term <term>socially disadvantaged group</term> means a group of persons whose members have been subjected to racial or ethnic prejudice because of their identity as members of a group without regard to their individual qualities.</text></paragraph> 
<paragraph id="H1FD455ACD0F743B38F3E5B35EAD9B452"><enum>(2)</enum><header>Socially disadvantaged farmer or rancher</header><text>The term <term>socially disadvantaged farmer or rancher</term> means a farmer or rancher who is a member of a socially disadvantaged group.</text></paragraph> 
<paragraph id="HE70976473D7C42E4BFABDB0045D6614F"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means any of the following:</text> 
<subparagraph id="HC96E911C46B7451790E4EAF57EF43AC"><enum>(A)</enum><text>Any community-based organization, network, or coalition of community-based organizations that—</text> 
<clause id="HDA4BBDB6A19449B7A94DD7C96F3B9996"><enum>(i)</enum><text>has demonstrated experience in providing agricultural education or other agriculturally related services to socially disadvantaged farmers or ranchers;</text></clause> 
<clause id="HD1C4A2B91C3E434600EADADE9B557AA"><enum>(ii)</enum><text>has provided to the Secretary of Agriculture documentary evidence of work with socially disadvantaged farmers or ranchers for not less than a five-year period preceding the submission of an application for assistance under this section; and</text></clause> 
<clause id="H134ADAD76CEC4E48BE7091D8C4170443"><enum>(iii)</enum><text display-inline="yes-display-inline">does not engage in activities prohibited under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986.</text></clause></subparagraph> 
<subparagraph id="H169D538BDE0D4BB7B00022BFA2D4D6DD"><enum>(B)</enum><text display-inline="yes-display-inline">An Indian tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>)) or a national tribal organization that has demonstrated experience in providing agriculture education or other agriculturally related services to socially disadvantaged farmers or ranchers in a region.</text></subparagraph> 
<subparagraph id="HC453F011B3CA4B9B891FE2F8F83BDC1C"><enum>(C)</enum><text display-inline="yes-display-inline">An 1890 institution or 1994 institution (as defined in section 2 of the Agricultural Research, Extension, and Education Reform Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/7/7601">7 U.S.C. 7601</external-xref>)), including West Virginia State College.</text></subparagraph> 
<subparagraph id="H9E9732E282EB4411BAA09D71AC8B22FD"><enum>(D)</enum><text display-inline="yes-display-inline">An Indian tribal community college or an Alaska Native cooperative college.</text></subparagraph> 
<subparagraph id="H6BDCB9D9ACA440569C41B4D369848300"><enum>(E)</enum><text display-inline="yes-display-inline">An Hispanic-serving institution (as defined in section 1404 of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3103">7 U.S.C. 3103</external-xref>)).</text></subparagraph> 
<subparagraph id="H6F3AEE31351D47F8A99F46EBDB1E4BE0"><enum>(F)</enum><text display-inline="yes-display-inline">Any other institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)) that has demonstrated experience in providing agriculture education or other agriculturally related services to socially disadvantaged farmers or ranchers in a region.</text></subparagraph></paragraph></subsection> 
<subsection id="H0F5E16CAC8E247AD8E5EB48518045D09"><enum>(b)</enum><header>Initiative</header><text display-inline="yes-display-inline">With respect to all programs authorized or amended by this title, the Secretary of Agriculture shall establish a conservation initiative for socially disadvantaged farmers or ranchers. With respect to such programs that serve an Indian tribe, the Secretary shall be required to pay the costs of office space to carry out conservation functions authorized under this section.</text></subsection> 
<subsection id="H95E523A6E26F4A4FB2CEB100497E2916"><enum>(c)</enum><header>Special rule for cost-share payments</header><text display-inline="yes-display-inline">Notwithstanding the actual cost sharing requirements imposed by a program authorized or amended by this title, the Secretary of Agriculture may pay up to 100 percent of the costs incurred by a socially disadvantaged farmer or rancher to participate in the program.</text></subsection> 
<subsection id="H220F001CFF5B411BA6B78E66B747813C"><enum>(d)</enum><header>Outreach and assistance</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall carry out an outreach and technical assistance program to encourage and assist socially disadvantaged farmers or ranchers to participate equitably in the full range of agricultural programs authorized or amended by this title.</text></subsection> 
<subsection id="H033E9FC284C440D6A4CF52D4289B96B0"><enum>(e)</enum><header>Grants and contracts</header><text display-inline="yes-display-inline">The Secretary of Agriculture may make grants to, and enter into contracts and other agreements with, an eligible entity to provide information and technical assistance to socially disadvantaged farmers or ranchers so that they can participate equitably in the full range of agricultural programs authorized or amended by this title.</text></subsection> 
<subsection id="H162B714CC1A44F849782697FD0B0DAF9"><enum>(f)</enum><header>Relationship to other law</header><text display-inline="yes-display-inline">The authority to carry out this section shall be in addition to any other authority provided in this or any other Act.</text></subsection> 
<subsection id="HA2452AE4E52E47989E868268A921FA22"><enum>(g)</enum><header>Funding</header><text display-inline="yes-display-inline">The Secretary of Agriculture may reserve up to 10 percent of the funds provided for a fiscal year for financial assistance under the conservation programs under subtitle D of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3830">16 U.S.C. 3830 et seq.</external-xref>) to carry out this section.</text></subsection></section> 
<section id="HE069DB734A20450CBB51A50115E2539C" section-type="subsequent-section" display-inline="no-display-inline"><enum>116.</enum><header>Conservation loan guarantee program</header><text display-inline="no-display-inline">Subtitle A of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1921">7 U.S.C. 1921–1936a</external-xref>) is amended by inserting after section 304 the following:</text>

<section id="H7F6F0EACDB734F0EAF6737AF3DC465F7"><enum>304A.</enum><header>Conservation loan guarantee program</header> 
<subsection id="H1FDB0835E2CA43149333351F984FA3F1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may provide a loan guarantee, an interest subsidy, or both, to enable an eligible borrower to obtain a qualified conservation loan.</text></subsection> 
<subsection id="H941EEB40381D4CAEB4F224A45593B7CE"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H8BA62678BFE847FBB6107093E581BAED"><enum>(1)</enum><header>Eligible borrower</header><text display-inline="yes-display-inline">The term <term>eligible borrower</term> means a farmer, rancher, farm cooperative, private domestic corporation, partnership, joint operation, trust, or limited liability company, that is engaged primarily and directly in agricultural production in the United States.</text></paragraph> 
<paragraph id="H1B22BCDD92B5449D93E248A2DB21193" display-inline="no-display-inline"><enum>(2)</enum><header>Qualified conservation loan</header><text>The term <term>qualified conservation loan</term> means a loan that meets the following requirements:</text> 
<subparagraph id="HE5FEC74A96454E8AAACC75B398633832"><enum>(A)</enum><header>Purpose</header><text display-inline="yes-display-inline">The loan proceeds are required to be used to cover the costs to the borrower of carrying out a qualified conservation project.</text></subparagraph> 
<subparagraph id="H1DA5560CE16C4621A3F67B73EFDEF94D"><enum>(B)</enum><header>Principal amount</header><text>The principal amount of the loan is not more than $1,000,000.</text></subparagraph> 
<subparagraph id="HA446BB0F23344A8DB933C6B22656CFAA"><enum>(C)</enum><header>Repayment period</header><text display-inline="yes-display-inline">The loan repayment period shall not exceed 10 years.</text></subparagraph> 
<subparagraph id="H3100901C61A74F94848BB1A2177E7BC5"><enum>(D)</enum><header>No repayment required in first year</header><text>The lender is prohibited from requiring any part of the loan to be repaid in the 1-year period that begins with the date of the closing of the loan.</text></subparagraph> 
<subparagraph id="HEBFACEFC31A2451BBC19C42BC60EE9C"><enum>(E)</enum><header>No loan forgiveness</header><text>The lender is prohibited from forgiving any part of the loan.</text></subparagraph> 
<subparagraph id="HCD3B167BA95641869282895F03557690"><enum>(F)</enum><header>Limited processing fee</header><text>The total of all processing fees charged with respect to the loan does not exceed such amount as shall be prescribed by the Secretary. </text></subparagraph></paragraph> 
<paragraph id="HDAEFFB6DB6F84B4CB9ECDA37DD4BD6D9"><enum>(3)</enum><header>Qualified conservation project</header><text display-inline="yes-display-inline">The term <term>eligible conservation project</term> means, with respect to an eligible borrower, conservation measures included in a conservation plan for a farming or ranching operation of the borrower, including—</text> 
<subparagraph id="HE6D839ED0CE6483892C8EBF1B78C3B05"><enum>(A)</enum><text display-inline="yes-display-inline">the installation of conservation structures, including terraces, sod waterways, permanently vegetated stream borders and filter strips, windbreaks (tree or grass), shelter belts, and living snow fences, if all plantings consist of vegetation appropriate to the locale;</text></subparagraph> 
<subparagraph id="H10012EB632614248A907C8FE3D370000"><enum>(B)</enum><text display-inline="yes-display-inline">the establishment of forest cover for sustained yield timber management, erosion control, or shelter belt purposes, if the forest cover is appropriate to the locale;</text></subparagraph> 
<subparagraph id="H05256E88EAD34736A0C57C70241F00D2"><enum>(C)</enum><text display-inline="yes-display-inline">the installation of water conservation measures;</text></subparagraph> 
<subparagraph id="HCA020931ED8A4E8C888FF86211C1FAF4"><enum>(D)</enum><text display-inline="yes-display-inline">the installation of waste management systems;</text></subparagraph> 
<subparagraph id="H5CA27DA897A04501BCD6BDA3FB74374B"><enum>(E)</enum><text display-inline="yes-display-inline">the establishment or improvement of permanent pasture;</text></subparagraph> 
<subparagraph id="H45011101A3E34C15A437E0569500FD7C"><enum>(F)</enum><text display-inline="yes-display-inline">the payment of costs of complying with section 1212 of the Food Security Act of 1985;</text></subparagraph> 
<subparagraph id="HC919130A271148D59E3C4F876C23E8E1"><enum>(G)</enum><text display-inline="yes-display-inline">other purposes consistent with the conservation plan;</text></subparagraph> 
<subparagraph id="H8D42533E413449919CEDAAA95798831C"><enum>(H)</enum><text display-inline="yes-display-inline">any conservation project or practice, as described by technical guides and handbooks issues by the Natural Resources Conservation Service; or</text></subparagraph> 
<subparagraph id="HFC2A489EC5E549B88E45EBEAF724B17C"><enum>(I)</enum><text display-inline="yes-display-inline">emerging conservation practices, techniques, or technologies, as approved by the Secretary.</text></subparagraph></paragraph></subsection> 
<subsection id="HD0B019DB152245C6AEFB11B258EB1D7C"><enum>(c)</enum><header>Limitations applicable to loan guarantees</header> 
<paragraph id="H1E55C969AD994DB99B181448C4EE73AA"><enum>(1)</enum><header>Limitation on amount of guarantee</header><text>The portion of a loan that the Secretary may guarantee under this section shall be not less than 80 percent and not more than 90 percent of the principal amount of the loan.</text></paragraph> 
<paragraph id="H7FCF93D54C664685B852B0ED9E34F243"><enum>(2)</enum><header>Limitation on total amount outstanding</header><text>The aggregate principal amount of outstanding loans guaranteed by the Secretary under this section shall not exceed $1,000,000,000.</text></paragraph></subsection> 
<subsection id="HE50D63562AC54B4BB2945FA9CB12264"><enum>(d)</enum><header>Limitation on amount of interest subsidy</header><text display-inline="yes-display-inline">The interest subsidy which the Secretary may provide under this section with respect to a loan shall result in a reduction of the interest rate agreed upon by the borrower and the lender (but to not less than zero) by—</text> 
<paragraph id="HA80D1AE0488F48BFB9FDF00503EE66C"><enum>(1)</enum><text>500 basis points, if the principal amount of the loan is less than $100,000;</text></paragraph> 
<paragraph id="H91205D2C5D4E433692076C709F39C53F"><enum>(2)</enum><text>400 basis points, if the principal amount of the loan is not less than $100,000 and is less than $500,000; and</text></paragraph> 
<paragraph id="HAAC2BD0481B943B0BB5760A7526FE8B5"><enum>(3)</enum><text display-inline="yes-display-inline">300 basis points, in any other case.</text></paragraph></subsection> 
<subsection id="HC45B539CDD19469080E5AD1EA769F821"><enum>(e)</enum><header>Administrative provisions</header> 
<paragraph id="HD99F229C4A3D43D2A34E3EE1FF428DC1"><enum>(1)</enum><header>Authority to collect processing fee</header><text display-inline="yes-display-inline">The Secretary may assess a fee to cover the cost of processing an application under this section equal to not more than 1 percent of the principal amount of the loan sought by the applicant, as described in the application.</text></paragraph> 
<paragraph id="HC5473E468DFF4F6DAC6EC73EF0D2EBF2"><enum>(2)</enum><header>Provision of financial information</header><text display-inline="yes-display-inline">An applicant for a loan guarantee or interest subsidy under this section shall provide the Secretary with such financial information as may be required by the Secretary, in the manner generally required by commercial agricultural lenders in the geographical area where the farming or ranching operation of the applicant is located. </text></paragraph> 
<paragraph id="H8DD9F9CC9969459A8033ACDE448F9F66"><enum>(3)</enum><header>Appraisal</header><text display-inline="yes-display-inline">The Secretary may require that an appraisal made in connection with an application for a loan guarantee or interest subsidy under this section be conducted by a specialized appraiser that uses standards similar to the standards used for similar purposes in the private sector, as determined by the Secretary.</text></paragraph> 
<paragraph id="H01A6F1D8AAC54FEFBD8EA7BE255886EA"><enum>(4)</enum><header>Approval of application</header><text>The Secretary shall not approve an application submitted pursuant to this section, unless the Natural Resources Conservation Service has determined that—</text> 
<subparagraph id="H2B060E1AE4E44375B4693B4F9674FE63"><enum>(A)</enum><text display-inline="yes-display-inline">the loan sought by the applicant, as described in the application, would be a qualified conservation loan; and</text></subparagraph> 
<subparagraph id="H0FB7EF2BAE034D8B94D75364AA55E00"><enum>(B)</enum><text>the project for which the loan is sought is likely to result in a net benefit to the environment.</text></subparagraph></paragraph> 
<paragraph id="HB1C35C0D00FA491EA53967FA2CC6F4A5"><enum>(5)</enum><header>Deadline for decision on application</header><text display-inline="yes-display-inline">Within 45 business days after the receipt of an application for assistance under this section, the Secretary shall transmit to the applicant the decision of the Secretary to approve or disapprove the application, to the extent practicable.</text></paragraph> 
<paragraph id="H8DED4944E7B2408F8C5C569F746B7218"><enum>(6)</enum><header>Equitable distribution of loan guarantees and interest subsidies</header><text display-inline="yes-display-inline"> The Secretary shall ensure that loan guarantees and interest subsidies under this section are equitably distributed among agricultural producers according to the scale of the operations of the producers.</text></paragraph></subsection> 
<subsection id="H2905491AF1254E1E8D26743E242B3355"><enum>(f)</enum><header>Relationship with other conservation programs</header><text display-inline="yes-display-inline">Neither the application for, nor the receipt of, a loan guarantee or an interest subsidy under this section shall affect the eligibility of the recipient for assistance under title XII of the Food Security Act of 1985 or the Watershed Protection and Flood Prevention Act.</text></subsection> 
<subsection id="HA1A991A9F0DA4A908CBFBD89862F3489"><enum>(g)</enum><header>Appropriations</header><text display-inline="yes-display-inline">For each of fiscal years 2008 through 2013, the Secretary shall use such funds of the Commodity Credit Corporation as are necessary to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H2CC86A4DC9DA4C94A573FEAEFD4000AF"><enum>117.</enum><header>Pilot program for comprehensive conservation planning</header> 
<subsection id="HFFF8AE7A97664007B9E04E63AC4877EA"><enum>(a)</enum><header>Pilot program required</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall establish a pilot program to evaluate the feasibility of assisting producers, before they apply for assistance under any conservation program under subtitle D of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3830">16 U.S.C. 3830 et seq.</external-xref>), by making a comprehensive assessment of the resource concerns, needs, and alternative solutions for the producer’s entire operation, as determined by the Secretary, following the procedures in the conservation planning manual of the Natural Resources Conservation Service. </text></subsection> 
<subsection id="H5485A6B688904BC39D15F46973EF4E19"><enum>(b)</enum><header>Locations</header><text display-inline="yes-display-inline">The pilot program shall be undertaken in the following locations:</text> 
<paragraph id="H8635164AC9E948B2A308D642EB7088C2"><enum>(1)</enum><text>The Chesapeake Bay watershed.</text></paragraph> 
<paragraph id="H9DDCE9E0FD3443FE958CE28184AF261C"><enum>(2)</enum><text>The Great Lakes Basin.</text></paragraph> 
<paragraph id="HC4CD35331E794441A3E2C9D1CCEAFF8F"><enum>(3)</enum><text>The Connecticut River watershed.</text></paragraph> 
<paragraph id="H5E2E31F7E11C4CD9B9E9FD991D633EFA"><enum>(4)</enum><text display-inline="yes-display-inline">The Highlands Region, as defined in section 3 of the Highlands Conservation Act (<external-xref legal-doc="public-law" parsable-cite="pl/108/421">Public Law 108–421</external-xref>; 118 Stat. 2375).</text></paragraph> 
<paragraph id="H265AFFE63EB543E394CC9EFD3B5B7153"><enum>(5)</enum><text>The Upper Mississippi River Basin.</text></paragraph></subsection> 
<subsection id="HF8722708377E41D4834D7664FB905785"><enum>(c)</enum><header>Provision of assistance</header><text display-inline="yes-display-inline">The assistance to producers shall be provided by the Secretary directly or through third-party providers certified by the Secretary, and shall be provided without charge to the producer. The results of the comprehensive conservation planning shall be provided to the producer to enable informed choices on the type of financial assistance available through conservation programs administered by the Secretary that would most effectively address the resource needs of the farmer’s operation consistent with the environmental goals for the area in which the operation is located.</text></subsection> 
<subsection id="HCF6B2355C5E3471785003618016F9CD2"><enum>(d)</enum><header>Funding</header><text display-inline="yes-display-inline">The Secretary shall use funds of the Commodity Credit Corporation to carry out the pilot program in the amount of $40,000,000 for each of fiscal years 2008 through 2013. The funds shall be equally divided, to the maximum extent practicable, between each of the four pilot program locations.</text></subsection> 
<subsection id="HAEAD56636A134F8CA30051BC106D5195"><enum>(e)</enum><header>Assessment and Report</header><text display-inline="yes-display-inline">The Secretary shall conduct an assessment of the effectiveness of the pilot program and publish a report, to be available to the public, of the results of the assessment. An assessment and report shall be undertaken in the second year and the fifth year of the pilot program.</text></subsection></section> 
<section id="HC81B621A63E646B889ACD5AC00B3198" section-type="subsequent-section" display-inline="no-display-inline"><enum>118.</enum><header>Technical assistance under Department of Agriculture conservation programs</header> 
<subsection id="HAF43183D374C42950029E6D0B8178CDF"><enum>(a)</enum><header>Use of third-party providers</header><text display-inline="yes-display-inline">Section 1242 of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3842">16 U.S.C. 3842</external-xref>) is amended—</text> 
<paragraph id="H5ADD6437BFAC429FA781324BB41CF264"><enum>(1)</enum><text>in subsection (a), by striking paragraph (2) and inserting the following new paragraph:</text>

<subsection id="HC892B854FFEB41B9AB8DE497D3793CC"><enum>(b)</enum><header>Cooperative Conservation Educational Assistance Program</header><text>Such section is further amended by adding at the end the following new subsection:</text>

<subsection id="H79B9DD6E8187467896C0303E826B3DFD"><enum>(c)</enum><header>Cooperative Conservation Educational Assistance Program</header><text display-inline="yes-display-inline">The Secretary shall establish a cooperative conservation educational assistance program through which a student at an institution of higher education, in a field of study such as agronomy, conservation biology, engineering, and other subject relevant to the provision of technical assistance under this section, may receive educational assistance in exchange for a commitment of service to the Natural Resources Conservation Service or other agency within the Department of Agriculture involved in providing such assistance. Establishment of the program shall be carried out by rulemaking, and the final rule shall be issued not later than 180 days after the date of the enactment of this subsection.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></title>

<paragraph id="H99FA7E80433D44F7B4A5DFD6451F447F"><enum>(2)</enum><header>Form of recipient share</header><text display-inline="yes-display-inline">The recipient share of the cost of a project may be made in the form of cash or the provision of services, material, or other in-kind contributions. The amount of the recipient share made in the form of the provision of services, material, or other in-kind contributions shall not exceed 25 percent of the amount of the share determined under paragraph (1).</text></paragraph> 
<paragraph id="HBCAA0B25D62549CC8DA2A530833D9520"><enum>(3)</enum><header>Interest rate</header><text display-inline="yes-display-inline">A loan made under subsection (c) shall bear interest at the rate equivalent to the rate of interest charged on Treasury securities of comparable maturity on the date the loan is approved. The interest rate shall remain in effect for the term of the loan.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H325561B2B8394989B92E30B388640654"><enum>(d)</enum><header>Energy reserve program</header><text>Such section is further amended—</text>

<paragraph id="HDCCF6E0ACBA845328FF4D5F17163C3D8"><enum>(2)</enum><header>Eligible lands</header><text>The Secretary may include any land, regardless of a cropping history, so long as the feed stock is produced and harvested consistent with the needs of the environment, as provided in paragraph (3).</text></paragraph> 
<paragraph id="HF512CB42A160476AA8CA3247E50238E0"><enum>(3)</enum><header>Duties of owners and operators</header><text>Under a contract entered into under this subsection, an owner or operator of land shall implement a feed stock conservation plan to ensure that lands enrolled are managed consistent with the needs of the environment, including the needs of wildlife. Paragraphs (5) and (6) of section 1232(a) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3832">16 U.S.C. 3832(a)</external-xref>) shall apply to the contracts</text></paragraph> 
<paragraph id="HE481C716100C404AB1E84DE0A3C292E4"><enum>(4)</enum><header>Payments</header><text>The Secretary shall provide annual rental payments to owners and operators of lands of amounts not greater than $25,000 for any fiscal year, and shall establish the amounts of payments through—</text> 
<subparagraph id="H0EACC6A410FC4FE4830768F4296E240"><enum>(A)</enum><text>the submission of bids for such contracts by owners and operators in such manner as the Secretary may prescribe; or</text></subparagraph> 
<subparagraph id="H89C7A871B55B4F5791D98CAF161CF7B4"><enum>(B)</enum><text>such other means as the Secretary determines are appropriate.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HCB3CF4CDB7864A6D9E84DB2E9B03B13"><enum>(e)</enum><header>Funding</header><text display-inline="yes-display-inline">Subsection (i) of such section, as amended by subsection (d)(1), is amended to read as follows:</text>

<subsection id="H7781893BAB8F4049A83951A2C6C2382E"><enum>(e)</enum><header>Funding</header><text display-inline="yes-display-inline">The Secretary shall use $25,000,000 of funds of the Commodity Credit Corporation to carry out this section in each of the fiscal years 2008 through 2013, of which $5,000,000 shall be used to support the use of electronic benefit transfers at farmers’ markets.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>

<paragraph id="H1455F17242EE46778DEE53FC0C40005"><enum>(1)</enum><text>Locally procured agricultural products, as compared to products transported from distant sources—</text> 
<subparagraph id="H87EFF6560F404BD498A8B5ABB4000432"><enum>(A)</enum><text>are often harvested closer to full ripeness and can have higher nutritional quality;</text></subparagraph> 
<subparagraph id="H56E975E56AEA437B9C68B2765621D483"><enum>(B)</enum><text>can have improved ripeness, taste, or selection, which can increase rates of consumption of agricultural products; and</text></subparagraph> 
<subparagraph id="HE980D4CA5E8643F3B8C634962EFC5500"><enum>(C)</enum><text>are more efficient to store, distribute, and package.</text></subparagraph></paragraph> 
<paragraph id="HE335D1A3BE4846FFA6108514E9E6852D"><enum>(2)</enum><text>Use of local produce—</text> 
<subparagraph id="H06D9FABD40204618B6AFEB2500ECAAF"><enum>(A)</enum><text>reduces dependence upon foreign oil by reducing fuel consumption rates associated with the production or transportation of agricultural products;</text></subparagraph> 
<subparagraph id="H16C53099C5944064A9ECF7DF1CCC55B1"><enum>(B)</enum><text>can help to improve the ability of those using the procurement system to provide education on nutrition, farming, sustainability, energy efficiency, and the importance of local purchases to the local economy;</text></subparagraph> 
<subparagraph id="H2A0623C9792F4607B7808B46C77D6D88"><enum>(C)</enum><text>helps to maintain a robust logistics network for agricultural product procurement; and</text></subparagraph> 
<subparagraph id="H5B474D0EA97E4F6E9468BBFE6CC6FF7F"><enum>(D)</enum><text>promotes farm, business, and economic development by accessing local markets.</text></subparagraph></paragraph> 
<paragraph id="HCED28176431946EFA719879189B9C4E2"><enum>(3)</enum><text>Section 9(j) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(j)</external-xref>) directs the Secretary of Agriculture to encourage institutions participating in the school lunch program established under that Act and the school breakfast program established by section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>) to purchase, in addition to other food purchases, locally produced foods, to the maximum extent practicable and appropriate.</text></paragraph></subsection> 
<subsection id="H980EA79334C34C2EAAFF8D577D96BC85"><enum>(b)</enum><header>Department of Defense Geographic procurement preference</header><text>Notwithstanding any other provision of law, the Department of Defense may use a geographic preference to purchase locally produced agricultural products for—</text> 
<paragraph id="H9DD8E65425F54A2F8B850000CE1E888F"><enum>(1)</enum><text>the Defense Supply Center Philadelphia;</text></paragraph> 
<paragraph id="HCFADD7F59E6F4A108F7F383FA69533BF"><enum>(2)</enum><text>the Department of Defense Farm to School Program;</text></paragraph> 
<paragraph id="HAD7B79DD952F4BE8006B009361B5F0CD"><enum>(3)</enum><text>the Department of Defense Fresh Fruit and Vegetable Program;</text></paragraph> 
<paragraph id="HD4B3A8205E7C41888C002D3711293C61"><enum>(4)</enum><text>the service academies;</text></paragraph> 
<paragraph id="H0DCD3E7F3DCB4F0D98F64B7B9E3585FA"><enum>(5)</enum><text>Department of Defense domestic dependant schools;</text></paragraph> 
<paragraph id="HCFFE727D285C40D9986F1931200412BA"><enum>(6)</enum><text>other Department of Defense schools under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/108">chapter 108</external-xref> of title 10, United States Code;</text></paragraph> 
<paragraph id="H931AF6A4F0024F2BB5D498079795EB57"><enum>(7)</enum><text>commissary and exchange stores; and</text></paragraph> 
<paragraph id="H17284A98512A4D5EBEBC2CD512E394AF"><enum>(8)</enum><text>morale, welfare, and recreation facilities operated by the Department of Defense</text></paragraph></subsection> 
<subsection id="H1B1B2BF9EF47436D91E09C17ECEB114B"><enum>(c)</enum><header>Department of Agriculture and related entities geographic procurement preference</header><text>Notwithstanding any other provision of law, the Department of Agriculture, schools, local educational agencies, and other entities may use a geographic preference to purchase locally produced agricultural products for—</text> 
<paragraph id="HEB3700A5C2964856818E68D14CAA12"><enum>(1)</enum><text>the school breakfast program established by section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>);</text></paragraph> 
<paragraph id="H17DB2FD5D4414E1EBAAB8B09E8E0A44"><enum>(2)</enum><text>the school lunch program established under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>);</text></paragraph> 
<paragraph id="H19D02BB8B00744EE8D5DD8DE78DE167"><enum>(3)</enum><text>the summer food service program for children established under section 13 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1761">42 U.S.C. 1761</external-xref>); and</text></paragraph> 
<paragraph id="H4FB086AC987E4046929B005507699D49"><enum>(4)</enum><text>the child and adult care food program established under section 17 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766</external-xref>).</text></paragraph></subsection> 
<subsection id="HC06D5493789B45769300AAC723106E31"><enum>(d)</enum><header>Addition of geographic preference</header><text display-inline="yes-display-inline">In the case of the purchase of agricultural products for a program or entity described in subsection (b) or (c), the local food service director or other entity making the purchase may include the geographic preference provided by such subsections in bid specifications and may select a bid involving locally produced agricultural products, even if that bid is not the lowest bid.</text></subsection> 
<subsection id="HF9A42A00D7774BBEA05600BE7328DE47"><enum>(e)</enum><header>Reporting</header><text>A school, local educational agency, or other entity participating in one or more of the programs described in subsection (c) shall report to the Secretary of Agriculture if the school, local educational agency, or other entity pays more than 10 percent more than the lowest bid to purchase locally produced agricultural products in accordance with this section.</text></subsection> 
<subsection id="H24187C9C102840FE97B961F372E42F7D"><enum>(f)</enum><header>Review</header><text display-inline="yes-display-inline">The Secretary of Defense and the Secretary of Agriculture shall periodically review the use of the geographic preference provided by this section to prevent fraud or abuse.</text></subsection></section> 
<section id="HE2DE75FE01904C979C2DD9ABC3914300" display-inline="no-display-inline" section-type="subsequent-section"><enum>308.</enum><header>Fruit and vegetable nutrition promotion program</header> 
<subsection id="H9616E69DD7DC4A7A9C852B0085CFE94F"><enum>(a)</enum><header>In general</header><text>The Secretary of Agriculture, acting through the Administrator of the Agricultural Marketing Service, shall establish and carry out a program to provide assistance to eligible trade organizations described in subsection (c) to increase the consumption of fruits and vegetables in the United States to meet Federal health guidelines.</text></subsection> 
<subsection id="H10882C630653491D845C7B2D9F7F8078"><enum>(b)</enum><header>Requirements for participation</header><text>To be eligible for assistance under this section, an organization shall—</text> 
<paragraph id="HEAD2D49FE8ED42C3B7006642B55FAC41"><enum>(1)</enum><text>be an eligible trade organization;</text></paragraph> 
<paragraph id="H3A53D3A1945741B6A6A03D00904675CB"><enum>(2)</enum><text>prepare and submit a plan to increase the consumption of fruits and vegetables in the United States to the Administrator of the Agricultural Marketing Service that meets any guidelines governing such plans established by the Administrator; and</text></paragraph> 
<paragraph id="HB753AD349FF04F5D905289C11DDE0689"><enum>(3)</enum><text>meet any other requirements established by the Administrator.</text></paragraph></subsection> 
<subsection id="H8E22DDD4FF6B413EB19584AA0714273D"><enum>(c)</enum><header>Eligible trade organizations</header><text>An eligible trade organization under this section shall be—</text> 
<paragraph id="HB2387730150C4013A652C557F7927F74"><enum>(1)</enum><text display-inline="yes-display-inline">a nonprofit fruit and vegetable trade organizations in the United States;</text></paragraph> 
<paragraph id="HD63447D3EC9C4D6FA9FAF77C42DD6850"><enum>(2)</enum><text>a nonprofit State or regional fruit and vegetable organization;</text></paragraph> 
<paragraph id="H9C1213B0218840088E63F2DF404E3604"><enum>(3)</enum><text>a fruit and vegetable agricultural cooperative in the United States;</text></paragraph> 
<paragraph id="HA39FC84AA6584721B2CD3512288E02E1"><enum>(4)</enum><text>a commodity board or commission in the United States; or</text></paragraph> 
<paragraph id="H4290339B175C475B9DA51CEF2CE0E612"><enum>(5)</enum><text>a small business engaged in the fruit and vegetable industry in the United States.</text></paragraph></subsection> 
<subsection id="H10926E566DAA4CEA93A0F4C12F19EA35"><enum>(d)</enum><header>Matching funds</header><text>Assistance provided under this section shall not exceed—</text> 
<paragraph id="H894B83E7AC9B424E830416351C9CC259"><enum>(1)</enum><text>in the case of an organization described in paragraphs (1) through (4) of subsection (c), 90 percent of the cost of the plan to increase the consumption of fruits and vegetables in the United States submitted under subsection (b)(2); and</text></paragraph> 
<paragraph id="H3802D33686B44719B28D52A3184953AF"><enum>(2)</enum><text>in the case of an organization described in subsection (c)(5), 50 percent of the cost of the plan to increase the consumption of fruits and vegetables in the United States submitted under subsection (b)(2).</text></paragraph></subsection> 
<subsection id="H8EB4016774BF4D728605A5FDFBBBA07B"><enum>(e)</enum><header>Funding</header><text>Of the funds available to the Commodity Credit Corporation, the Administrator of the Agricultural Marketing Service shall use $100,000,000 in each of fiscal years 2008 through 2011 to carry out this section.</text></subsection></section> 
<section id="H36414B8C63414E87AEA519ABE2006F12" display-inline="no-display-inline" section-type="subsequent-section"><enum>309.</enum><header>Use of <quote>Dietary Guidelines for Americans</quote> in special nutrition programs and school lunch programs</header><text display-inline="no-display-inline">Section 9(a) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(a)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H4B8D7ECEFF514488BC094B65D9D94F58"> 
<paragraph id="H8225474408FE40CBA32F7E203907E2CA"><enum>(5)</enum><header>Allocations to be based on dietary guidelines</header><text>For the school year beginning in July 2007 and each school year thereafter, the Secretary shall ensure that allocations of food and food ingredients offered in school nutrition programs under this Act and the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771 et seq.</external-xref>) are based on the most recent Dietary Guidelines for Americans.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H6C0E2F6E50574E4DA2785C04B23DF2E"><enum>310.</enum><header>Section 32 specialty crop purchases</header> 
<subsection id="H5EF1105FD5F341D7889377BED0C4A0CC"><enum>(a)</enum><header>Minimum level of purchases</header><text display-inline="yes-display-inline">Section 32 of the Act of August 24, 1935 (<external-xref legal-doc="usc" parsable-cite="usc/7/612c">7 U.S.C. 612c</external-xref>) is amended in the sixth sentence by inserting after <quote>and their products</quote> the following: <quote>, and, for each of fiscal years 2008 through 2012, the Secretary of Agriculture shall devote not less than $400,000,000 of sums appropriated under this section to purchases of non-basic agricultural commodities, such as fruits, vegetables, and other specialty food crops</quote>.</text></subsection> 
<subsection id="H3D481E83F89D42E59393AC7B20E3C6D3"><enum>(b)</enum><header>Expansion of DOD fresh program</header><text>Such section is further amended by inserting after the sixth sentence, as amended by subsection (a), the following new sentence: <quote>Of the funds specified in the preceding sentence, the Secretary of Agriculture shall expend not less than $150,000,000 for each of fiscal years 2008 through 2012 for the purchase of fresh fruits and vegetables for distribution to schools and service institutions in accordance with section 6(a) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1755">42 U.S.C. 1755(a)</external-xref>).</quote>. </text></subsection></section> 
<section id="H33010C933DE94818951724F35635EFFB" section-type="subsequent-section" display-inline="no-display-inline"><enum>311.</enum><header>Amendments to the food stamp program</header> 
<subsection id="H2E34DEFC31624079BEE98E477BF5009B"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline"> Section 3 of the Food Stamp Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012</external-xref>) is amended by adding at the end the following</text> 
<quoted-block style="traditional" id="H795C5CE443B543A2A6EDB5D0A6D2C921" display-inline="no-display-inline"> 
<subsection id="H183CC38197E644F2BBB3BD57EC445CB"><enum>(v)</enum><text display-inline="yes-display-inline"><quote>Food stamp nutrition education</quote> means direct education, group activities, community health promotion, and comprehensive public health approaches (including but not limited to, social marketing, mass media, public-private partnerships, policy, systems and environmental changes, and evaluation) that promote healthy eating and make healthy food and physical activity choices more desired, affordable, and accessible. To serve all those potentially eligible for food stamps, nutrition education programs should be designed to reach large numbers of low-income individuals. Programs shall support behavior change consistent with the Dietary Guidelines for Americans, including a diet rich in fruits and vegetables and whole grains.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H5A1006EE5AA74122A000528FF01F7BE"><enum>(b)</enum><header>Administration</header><text display-inline="yes-display-inline">Section 11(e)(1)(A) of the Food Stamp Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020(e)(1)(A)</external-xref> is amended by inserting <quote>, and provide food stamp nutrition education</quote> after <quote>program</quote>.</text></subsection></section> 
<section id="HE838C6CA6E4B4AB7A6D7C5EAC28015C2"><enum>312.</enum><header>Food stamp fruit and vegetable electronic benefit transfer pilot project</header> 
<subsection id="H1F645EB57C9640AB90B792A622DDE575"><enum>(a)</enum><header>Finding</header><text display-inline="yes-display-inline">The Congress finds that increased consumption of fruits and vegetables by participants in the food stamp program will significantly improve the overall dietary habits of such participants.</text></subsection> 
<subsection id="H1669B58A09224295A5B24B54A36D9DE8"><enum>(b)</enum><header>Pilot Project</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall establish and carry out a pilot project that will provide to each participant in the food stamp program who receives benefits in the form of an electronic benefit transfer, financial incentives for each dollar of such benefits expended by such recipient to facilitate the purchase of fresh fruits and vegetables.</text></subsection> 
<subsection id="HD794E4BD6E084FF5A5CCED964DDC1FAC"><enum>(c)</enum><header>Authorization of Appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated $10,000,000 for each of 5 fiscal years to carry out this section.</text></subsection></section></title> 
<title id="H84F9B5C74B924F64AB91FEBA370152C6"><enum>IV</enum><header>Promotion of New Markets and Farm Viability</header> 
<section id="HC48E0675B1FC4C2EBEDFCEA7E2000020"><enum>401.</enum><header>Farm viability program</header> 
<subsection id="HD5FDE610EC7A41049969A85DB08C295"><enum>(a)</enum><header>Program required</header><text>Subsection (a) of section 1238J of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3838j">16 U.S.C. 3838j</external-xref>) is amended by striking <quote>The Secretary may</quote> and inserting <quote>Using amounts made available under subsection (b), the Secretary shall</quote>.</text></subsection>

<section display-inline="no-display-inline" id="HA408187304E945B98CD65D3820003F3" section-type="subsequent-section"><enum>402.</enum><header>National organic certification and transition cost share program</header><text display-inline="no-display-inline">Section 10606 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/6523">7 U.S.C. 6523</external-xref>) is amended to read as follows:</text>

<section id="HEF490109AE244CE4919FE7F248ED5B43"><enum>10606.</enum><header>National organic certification and transition cost share program</header> 
<subsection id="H6DE8B104DD54482D00BD2454FC268D75"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Of the funds of the Commodity Credit Corporation, the Secretary of Agriculture (acting through the Natural Resources Conservation Service) shall use $80,000,000 for each of fiscal years 2008 through 2013 to establish a national organic certification and transition cost-share program to assist producers and handlers of agricultural products in obtaining certification under the national organic production program established under the Organic Foods Production Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6501">7 U.S.C. 6501 et seq.</external-xref>) and to assist producers and handlers in making the transition to organic production under the such program.</text></subsection> 
<subsection id="HD14A584DC3BA447899EEA84933315F1C"><enum>(b)</enum><header>Certification costs</header> 
<paragraph id="HF942EBF0003848898294DD172574339B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall pay under this section a portion of the costs incurred by a producer or handler in obtaining certification under the national organic production program, as certified to and approved by the Secretary.</text></paragraph> 
<paragraph id="HF8DF947D181144E1B2E099C5903051B6"><enum>(2)</enum><header>Maximum amount</header><text display-inline="yes-display-inline">The amount of a payment made to a producer or handler for certification under this section shall be $750 per year.</text></paragraph> 
<paragraph id="H8BF907B554E048F0B7B26931857C4F9F"><enum>(3)</enum><header>Funding</header><text display-inline="yes-display-inline">Of the funds made available under subsection (a), the Secretary (acting through the Agricultural Marketing Service) shall use $25,000,000 for each of the fiscal years 2008 through 2013 to share up to 75 percent of the cost of certification.</text></paragraph></subsection> 
<subsection id="HDED3B57DEE9047DD93A4C95F92054F68"><enum>(c)</enum><header>Accreditation and enforcement costs</header><text display-inline="yes-display-inline">Of the funds made available under subsection (a), the Secretary (acting through the Agricultural Marketing Service) shall use $5,000,000 for each of the fiscal years 2008 through 2013 to fund the accreditation and enforcement programs operated by the National Organic Program to implement the accreditation and enforcement provisions of the Organic Foods Production Act of 1990.</text></subsection> 
<subsection id="HF1CF2C0DE1DB40909773C649CC8CEA45"><enum>(d)</enum><header>Reimbursements for Infrastructure Necessary To Implement Organic Practice Standards</header> 
<paragraph id="H2B8CE93FAB134ADBACD81703C96EF9B7"><enum>(1)</enum><header>Establishment</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary shall establish a program to reimburse producers and handlers for the costs of transition to organic production.</text></paragraph> 
<paragraph id="H27538E887433458B91728EB1BBD8BDAF"><enum>(2)</enum><header>Program</header><text display-inline="yes-display-inline">Under the program established under paragraph (1), the Secretary (acting through the Natural Resources Conservation Service) shall use $50,000,000 for each of the fiscal years 2008 through 2013 to assist producers and handlers developing and implementing infrastructure and practices necessary to transition land and animals to meet the requirements of the Organic Food Production Act of 1990.</text></paragraph> 
<paragraph id="H5E4CC74C80AC4B0681A165C683CE300"><enum>(3)</enum><header>Plan submission</header><text display-inline="yes-display-inline">The Secretary may only reimburse a producer or handler under this section if the producer or handler submits to the Secretary an organic transition plan that contains the expected costs for infrastructure and practices, the environmental and economic benefits derived from the infrastructure or implementing organic practice standards, and a demonstration of the existence of a market or the reasonable expectation of a future market for the products to be produced or handled.</text></paragraph> 
<paragraph id="H34B71E6A7FCB41B0B970AFFACC00B561"><enum>(4)</enum><header>Appropriate infrastructure and practice standards</header><text>The Secretary shall only reimburse producers and handlers under this subsection for the costs of the following:</text> 
<subparagraph id="HA02C09DBD3294DF8BF261D88586EE304"><enum>(A)</enum><text display-inline="yes-display-inline">Organic practices and activities during transition to certified organic production consistent with an approved plan to transition to certified organic production.</text></subparagraph> 
<subparagraph id="H1611E95B496F481B80EA994819230F3"><enum>(B)</enum><text>Farm infrastructure necessary to implement organic practice standards, including livestock watering facilities and fencing, so long as such infrastructure is consistent with an approved plan to transition to certified organic production.</text></subparagraph> 
<subparagraph id="H7AE246D99C5A4252B2AF645D17D0AD80"><enum>(C)</enum><text>Organic livestock welfare measures, so long as such infrastructure or practices and activities are necessary to implement an organic practice standard and are consistent with an approved plan to transition to certified organic production.</text></subparagraph> 
<subparagraph id="H5514CC736A0246B39ED7A9C858416D9C"><enum>(D)</enum><text>Advanced organic practices consistent with approved certified organic production.</text></subparagraph> 
<subparagraph id="H5F07F7D2FA694CFD97926007CCE5A116"><enum>(E)</enum><text>Technical assistance, including the costs of developing an approved transition plan under this section.</text></subparagraph> 
<subparagraph id="H7F64355F5F00444698611031BE9231B3"><enum>(F)</enum><text>Other measures the Secretary, after consultation with the National Organic Standards Board, determines are appropriate.</text></subparagraph></paragraph> 
<paragraph id="H65C417A8D05E47F4BDC7486BEA9E6BE"><enum>(5)</enum><header>Organic transition technical advice</header><text display-inline="yes-display-inline">The Secretary shall consult with the National Organic Standards Board regarding the elements of an approved organic transition plan and to identify and recommend ways that the Secretary may generally use the resources provided for programs under subtitle D of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3830">16 U.S.C. 3830 et seq.</external-xref>) to facilitate transition to organic production, including the resources provided by the Environmental Quality Incentives Program and the Conservation Security Program.</text></paragraph> 
<paragraph id="HF2A7340CD3FA49B1893DC9AEBC08EB6F"><enum>(6)</enum><header>Maximum amount for transition reimbursement</header><text display-inline="yes-display-inline">Except as provided in (A) and (B), the maximum amount of reimbursement paid to a producer or handler for transition to organic production under this section shall be $10,000 per fiscal year.</text> 
<subparagraph id="HA727DE82E3C646BB8CBB3B021683F1A"><enum>(A)</enum><header>Specialty crops</header><text>In the case of an individual or entity who annually produces three or more types of specialty crops, the individual or entity may not receive, directly or indirectly, cost-share or incentive payments under this section that, in the aggregate, exceed $20,000 per year, for a period not to exceed four years.</text></subparagraph> 
<subparagraph id="H5E6C11483DCC4F2700349300825516B8"><enum>(B)</enum><header>Dairy</header><text>In the case of an individual or entity whose principal farming enterprise is dairy, the individual or entity may not receive, directly or indirectly, cost-share or incentive payments under this section that, in the aggregate, exceed $20,000 per year, for a period not to exceed four years.</text></subparagraph></paragraph> 
<paragraph id="HB36EFE4C34574E67A3F24354C4609067"><enum>(7)</enum><header>Eligible fiscal years</header><text>A producer or handler may only receive payments—</text> 
<subparagraph id="HAE7973091D6F470482EE4CF1E7C5A776"><enum>(A)</enum><text>in four fiscal years; and</text></subparagraph> 
<subparagraph id="HBC8836AB64E547E99FFC14B8A000862F"><enum>(B)</enum><text>after the first payment, in the fiscal year in which such payment was made and the three subsequent fiscal years.</text></subparagraph></paragraph> 
<paragraph commented="no" id="H591E776F77C341968E188144E738009E"><enum>(8)</enum><header>Transition Reimbursements</header><text display-inline="yes-display-inline">A certified organic producer or handler under the national organic production program shall be eligible for reimbursements to make the transition to organic production for new lands and livestock.</text></paragraph> 
<paragraph id="H921FE98BCE0F4210A799F84129D9919"><enum>(9)</enum><header>Suspension authority</header><text>To ensure orderly and continued growth in organic farming—</text> 
<subparagraph id="H0C3C1D590C4D40BD95BD2CED0008AA62"><enum>(A)</enum><text>prior to each fiscal year and no later than October 1st of each year, the Secretary shall publish organic commodity specific assessments analyzing the domestic production and consumption, import and export organic market demand and growth potential for each organic commodity and the anticipated number and total amount of new reimbursements for the following year affecting each commodity; and</text></subparagraph> 
<subparagraph id="H246F56998034469FBD00C1FF5DFCCAFE"><enum>(B)</enum><text>the Secretary shall not enroll new producers under this subsection if, for any particular agricultural commodity, any new producers would produce an increased amount of that agricultural commodity that the Secretary finds is reasonably anticipated to affect the continuing economic viability of farmers currently certified under the national organic production program or would create unreasonable geographic disparities in the distribution of reimbursements provided under this section.</text></subparagraph></paragraph> 
<paragraph id="HE7494708A0A84FC6AE5245A5CC5D3FFF"><enum>(10)</enum><header>Appeals</header><text display-inline="yes-display-inline">An applicant seeking transition assistance under this section has the right to appeal an adverse decision by Secretary with regard to an application for assistance, as provided in section 275 of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6995">7 U.S.C. 6995</external-xref>).</text></paragraph></subsection> 
<subsection id="H65F1383C30D84C3AA0710254F5A7EB07"><enum>(e)</enum><header>Technical and educational assistance</header><text display-inline="yes-display-inline">Of the funds made available under subsection (a) for a fiscal year, the Secretary shall use not less than $15,000,000 to provide technical and educational assistance to producers and handlers to carry out this section, including entering into cooperative agreements with qualified entities to implement the transition to organic production.</text></subsection> 
<subsection id="H41A445512AAD4CF70058D8106CB5596"><enum>(f)</enum><header>Reporting</header><text display-inline="yes-display-inline">Not later than March 1 of each year, the Secretary shall submit to Congress and the National Organic Standards Board a report detailing State-by-State expenditures on certification, including the number of producers and handlers served by the program, and State-by-State expenditures on transition assistance, including the number of producers and handlers served by the program, the practices implemented, an assessment of the impacts of the program on organic production, and recommended reforms, if any.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H5E376882DB57417284B5E41F179333A6"><enum>402a.</enum><header>National organic technical committee</header> 
<subsection id="H11E1B60C98F349D9BDD7981B91C21D52"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a National Organic Technical Committee to oversee development and implementation of the Organic Certification and Transition Program and to improve the organic agriculture interface with all other conservation programs and activities administered by the NRCS, including developoment of criteria for the approval of qualified organic technical advisors.</text></subsection> 
<subsection id="H3656A9BC14D3408FBDA1BF82FBB9C965"><enum>(b)</enum><header>Membership</header><text>The membership of the National Organic Technical Committee shall be comprised of—</text> 
<paragraph id="HFF9A2AD240DA4E9882BD3EDB35207F80"><enum>(1)</enum><text>three organic farmers;</text></paragraph> 
<paragraph id="HFEA0D9F47F334C9EA59B9FDE24665597"><enum>(2)</enum><text>two organic certifying agents;</text></paragraph> 
<paragraph id="H76F8D99B00A34BDE85327750735424E8"><enum>(3)</enum><text>two organic inspectors;</text></paragraph> 
<paragraph id="H43DA436B5A2041A193C027DB715B6DE"><enum>(4)</enum><text>one representative of an environmental organization knowledgeable about organic agriculture; and</text></paragraph> 
<paragraph id="H94009B6AC70E4D24A8A7268FD71200F8"><enum>(5)</enum><text>one scientist with expertise in conservation planning.</text></paragraph></subsection></section> 
<section id="H5E2CA40444E644FEA1C8BB833E8D93B9"><enum>403.</enum><header>Organic agriculture research and extension initiative</header><text display-inline="no-display-inline">Section 1672B(e) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/5925b">7 U.S.C. 5925b(e)</external-xref>) is amended to read as follows:</text>

<section id="H3815A08DBBFE45DABDE5939F774442B1"><enum>404.</enum><header>Funding for education grants programs for Hispanic-serving institutions</header><text display-inline="no-display-inline">Subsection (c) of section 1455 of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3241">7 U.S.C. 3241</external-xref>) is amended to read as follows:</text>
