<official-title>To amend part D of title XVIII of the Social Security Act to remove the Medicare prescription drug benefit late enrollment penalty.</official-title>

<section id="HE427FFB59CB9417081B32ED617E956D6" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Universal Health Act of 2007: Repeal of the Late Enrollment Penalty in Medicare Part D</short-title></quote>. </text></section> 
<section id="HF2692AB9CA7045C88F841414EF735676"><enum>2.</enum><header>Removing the Medicare prescription drug benefit late enrollment penalty</header> 
<subsection id="H8A5360FA3C1C423F81AF549893BE0062"><enum>(a)</enum><header>In general</header><text>Section 1860D–13 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-113">42 U.S.C. 1395w–113</external-xref>) is amended—</text> 
<paragraph id="H14F19830F3094B89ABF1F0C409449107"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text level="section" style="OLC">; late enrollment penalty</header-in-text></quote>;</text></paragraph> 
<paragraph id="HFC803EF92C8346AAAA80EE84D7FFCC0"><enum>(2)</enum><text>in subsection (a)(1), by striking subparagraph (D);</text></paragraph> 
<paragraph id="HB41146D4BAFA4AA786DE78353DD8D92"><enum>(3)</enum><text>by striking subsection (b); and</text></paragraph> 
<paragraph id="HCC8F73CA494A467382E99529465CE6D2"><enum>(4)</enum><text>in subsection (c)—</text> 
<subparagraph id="H560C6A5442E442509EF24C00C7BECF41"><enum>(A)</enum><text>in paragraph (1), by striking <quote>(and any late enrollment penalty)</quote>;</text></subparagraph> 
<subparagraph id="HBE5B5769D189439495A51054EFAF7455"><enum>(B)</enum><text>by striking paragraph (2); and </text></subparagraph> 
<subparagraph id="HA979558724A948139154F1B11D529F7D"><enum>(C)</enum><text>in paragraph (3), by striking <quote>paragraph (2) shall not apply and</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H8CEE50076A864B088F81157CEF800A5"><enum>(b)</enum><header>Conforming amendments</header> 
<paragraph id="H74C0A47302C24732A7C54E16A9D0F144"><enum>(1)</enum><text>Section 1860D–1 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-101">42 U.S.C. 1395w–101</external-xref>) is amended—</text> 
<subparagraph id="H027D6D116D604185A4F8E6EB0C5082B"><enum>(A)</enum><text>in subsection (b)—</text> 
<clause id="HE904E90B9E0F40CEBE1F14E64BF444D0"><enum>(i)</enum><text>in paragraph (3), by striking subparagraph (A); and </text></clause> 
<clause id="H09F3D06880524A7C8908F64BE8221DF9"><enum>(ii)</enum><text>by striking paragraph (6); and</text></clause></subparagraph> 
<subparagraph id="HAFAC87BF852A46FCB77CEF2DF855061C"><enum>(B)</enum><text>in subsection (c), by striking paragraph (4).</text></subparagraph></paragraph> 
<paragraph id="H95F67B7C013345BE9E86AF8828A807C7"><enum>(2)</enum><text>Section 1860D–11(g)(6) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-111">42 U.S.C. 1395w–111(g)(6)</external-xref>) is amended by striking <quote>Except for as provided in section 1860D–13(b) (relating to late enrollment penalty) and subject</quote> and inserting <quote>Subject</quote>.</text></paragraph> 
<paragraph id="H23457B5BBB43435784BDD9D6EE4A259"><enum>(3)</enum><text>Section 1860D–14 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-114">42 U.S.C. 1395w–114</external-xref>) is amended—</text> 
<subparagraph id="HD81B73E27E60439CAD5F74E7B74E433"><enum>(A)</enum><text>by amending subsection (a)(1)(A) to read as follows:</text> 
<quoted-block style="OLC" id="H016FC056A2234A78BA12AFAECA0000FC" display-inline="no-display-inline"> 
<subparagraph id="H35ED853EAA0A444AA76CCE0750A4FCFE" indent="up1"><enum>(A)</enum><header>Full premium subsidy</header><text>An income-related premium subsidy equal to 100 percent of the amount described in subsection (b)(1), but not to exceed the premium amount specified in subsection (b)(2)(B).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H2FE7C24FBFD145ABBC85E17C70B67B8C"><enum>(B)</enum><text>in subsection (b)(2)(B), by striking <quote>The premium amounts described in this subparagraph do not include any amounts attributable to late enrollment penalties under section 1860D–13(b).</quote>.</text></subparagraph></paragraph> 
<paragraph id="H59AC393E79304CF095F88EA990063EF4"><enum>(4)</enum><text>Section 1860D–16(b)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-116">42 U.S.C. 1395w–116(b)(3)</external-xref>) is amended by striking <quote>(and the portion of late enrollment penalties)</quote>.</text></paragraph> 
<paragraph id="H89FE894023DB4AE882F115B0B573DBBE"><enum>(5)</enum><text>Section 1860D–41(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-141">42 U.S.C. 1395w–141(a)</external-xref>) is amended by striking paragraph (3).</text></paragraph> 
<paragraph id="H8F3684CC5C3742D682E493B975407F99"><enum>(6)</enum><text>Section 1882(v)(2)(B)(ii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ss">42 U.S.C. 1395ss(v)(2)(B)(ii)</external-xref>) is amended to read as follows:</text>

<clause id="H1A5AD9DBD76C42F591D717BBD1001533" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">If the individual does not enroll in a plan under part D during such period, the individual may continue enrollment in the individual's current plan without change, but the individual will not be guaranteed the option of enrollment in another medicare supplemental policy pursuant to paragraph (3).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H2E5CF29478C24847BC359BD6CB7C2852"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall be effective as of the date of the enactment of this Act and shall apply to monthly beneficiary premiums for months beginning after such date.</text></section>
