		<official-title>To amend the Servicemembers Civil Relief Act to provide
		  relief with respect to rent and mortgage payments for members of the reserve
		  components who are called to active duty and to amend the Internal Revenue Code
		  of 1986 to allow a refundable credit to lessors for payments foregone by reason
		  of such relief.</official-title>

		<section display-inline="no-display-inline" id="H6724BF274E1C473AA5532C00FC977D71" section-type="section-one"><enum>1.</enum><header>Relief with respect to rent
			 and mortgage payments for reserve components members ordered to active
			 duty</header>
			<subsection id="HC216A02380F943D18C5B851B522EC400"><enum>(a)</enum><header>Rent and
			 mortgage relief</header><text>Title III of the Servicemembers Civil Relief Act
			 (50 U.S.C. App. 531 et seq.) is amended by adding at the end the following new
			 section:</text>

					<section id="H9A7D4D73208A439991D603642FF22CA7"><enum>309.</enum><header>Rent and
				mortgage relief</header>
						<subsection id="H19851B8786014BCAA326310429774F45"><enum>(a)</enum><header>Rent</header><text>A
				member of a reserve component who is ordered to report for military service for
				a period of more than 90 days and who on the date of such order is a lessee of
				real property that is occupied by the member or dependents of the member as the
				primary residence of the member or dependents shall not be required to pay rent
				under that lease for any period of such military service during which the
				member is assigned to duty at a location sufficiently distant from such
				property that the member is unable to reside at such property.</text>
						</subsection><subsection id="H532EA542F6724D5A8287581B81CDD606"><enum>(b)</enum><header>Mortgages</header>
							<paragraph id="H9E905B45D00A46DA86F03800D8BC1BEC"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">A member of a reserve
				component who is ordered to report for military service for a period of more
				than 90 days and who on the date of such order resides at real property that is
				occupied by the member or dependents of the member as the primary residence of
				the member or dependents, is owned by the member, and is secured by a mortgage
				shall be not be required during the period of such military service to make any
				payment of principal or interest on the mortgage. Any payment not paid by
				reason of the preceding sentence shall be deferred and shall be appended, on a
				month-for-month basis, to the end of the term of the mortgage, in the same
				amount as originally due.</text>
							</paragraph><paragraph id="H122F7AEAFD024A849E261C5DE7AAAAF"><enum>(2)</enum><header>Mortgage</header><text display-inline="yes-display-inline">In this subsection, the term
				<term>mortgage</term> includes a trust deed or other security in the nature of
				a
				mortgage.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HBEF81243B93B4AE4BA1E11F2059F416F"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of contents in section 1(b) of such Act is
			 amended by inserting after the item relating to section 308 the following new
			 item:</text>

					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF5BCC7D00AFF454DA8DB6E81457B5F9E"><enum>(c)</enum><header>Effective
			 date</header><text>Section 309 of the Servicemembers Civil Relief Act, as added
			 by subsection (a), shall apply with respect to obligations to make lease
			 payments or mortgage payments that become due on or after the date of the
			 enactment of this Act.</text>
			</subsection></section><section id="HF69D5CFCBDB84FCB93E3FB51E683635D"><enum>2.</enum><header>Refundable tax
			 credit for lessors with respect to rent relief for reserve components members
			 ordered to active duty</header>
			<subsection id="HCE8FB72B7CE64E56B282E7DD79B74A0"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subpart C of part IV
			 of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 (relating to
			 refundable credits) is amended by redesignating section 36 as section 37 and by
			 inserting after section 35 the following new section:</text>

					<section id="HFE18F83E1A794287B287D44B47CC067"><enum>36.</enum><header>Credit for
				lessors with respect to rent relief for reserve components members ordered to
				active duty</header>
						<subsection id="H52388AB3635B46088BED031C9E45F1FD"><enum>(a)</enum><header>General
				rule</header><text display-inline="yes-display-inline">In the case of a lessor,
				there shall be allowed as a credit against the tax imposed by this chapter for
				the taxable year an amount equal to the reserve component rent relief
				credit.</text>
						</subsection><subsection id="H1BDB93F747CF437C854209A05BD463B4"><enum>(b)</enum><header>Limitation based
				on previous rent</header><text>For purposes of this section—</text>
							<paragraph id="H39DB4F28F14245919E00235153E23896"><enum>(1)</enum><header>In
				general</header><text>In the case of a property which was rented for the entire
				preceding taxable year, the amount taken into account under this section as
				rent not received with respect to such property shall not exceed the amount for
				which such property was rented for the preceding taxable year.</text>
							</paragraph><paragraph id="H3380868D42FA4489923D9334D300DFD3"><enum>(2)</enum><header>Property rented
				for less than full year</header><text display-inline="yes-display-inline">In
				the case of a property which was rented for less than the entire preceding
				taxable year, the amount taken into account under this section as rent not
				received with respect to such property shall not exceed the amount for which
				such property was rented for the preceding taxable year, annualized under such
				methods as the Secretary may prescribe by regulation.</text>
							</paragraph><paragraph id="H8537D77BFA6C4410AD3249E370C92E01"><enum>(3)</enum><header>Property not
				rented during preceding year</header><text>This subsection shall not apply in
				the case of a property which was not rented during the preceding taxable
				year.</text>
							</paragraph></subsection><subsection id="H8B6FD80FF0E342BB80F63F376704002F"><enum>(c)</enum><header>Reserve
				component rent relief credit</header><text display-inline="yes-display-inline">For purposes of subsection (a), the reserve
				component rent relief credit for a taxable year is the aggregate amount of rent
				not received on leases held by the taxpayer by reason of section 309(a) of the
				Servicemembers Civil Relief Act.</text>
						</subsection><subsection id="H6F2F3F7BCC524F26A92FEFC6C146973E"><enum>(d)</enum><header>Denial of double
				benefit</header><text>No deduction shall be allowed under this chapter with
				respect to amounts taken into account in determining the credit allowed under
				this section.</text>
						</subsection><subsection id="H0BF1AF5314124428B4DF409BD48FDC75"><enum>(e)</enum><header>Regulations</header><text>The
				Secretary shall issue such regulations as may be necessary or appropriate to
				carry out this
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H682A602549E94D7DA100A1459C49C600"><enum>(b)</enum><header>Technical
			 amendment</header><text>Paragraph (2) of <external-xref legal-doc="usc" parsable-cite="usc/31/1324">section 1324(b)</external-xref> of title 31, United
			 States Code, is amended by inserting <quote>or from section 36 of such
			 Code</quote> before the period at the end.</text>
			</subsection><subsection id="H15F9F6016C9840768788CDC1F9B2C00"><enum>(c)</enum><header>Clerical
			 amendment</header><text>The table of sections for subpart C of part IV of
			 subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by
			 redesignating the item relating to section 36 as an item relating to section 37
			 and by inserting after the item relating to section 35 the following new
			 item:</text>

			</subsection><subsection id="H83626FFB0B394211BC1050B5A9DFED56"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after the date of the enactment of this Act.</text>
