		<section display-inline="no-display-inline" id="H826FA8928BD8472BA4813D7398372D56" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Community Beaches Protection
			 Act</short-title></quote>.</text>
		</section><section id="H8131880C09F940F089F9F7DD47225D6F"><enum>2.</enum><header>Protection of
			 shores</header>
			<subsection id="H949E89B0ED0140CB8850297FC2E2DDCA"><enum>(a)</enum><header>Declaration of
			 policy</header><text>The first section of the Act entitled <quote>An Act
			 authorizing Federal participation in the cost of protecting the shores of
			 publicly owned property</quote>, approved August 13, 1946 (<external-xref legal-doc="usc" parsable-cite="usc/33/426e">33 U.S.C. 426e</external-xref>), is
			 amended to read as follows:</text>
				<quoted-block id="HE9ED4FBDFDEA47EAA490FAC9DCE364B6">
					<section id="H9F354DABB75B4712B976BB4B389585C0" section-type="subsequent-section"><enum>1.</enum><header>Shore
				protection</header>
						<subsection id="HB80525988D484BC9A61536EFEF4386D3"><enum>(a)</enum><header>Declaration of
				policy</header><text display-inline="yes-display-inline">With the purpose of
				preventing damage, restoring and maintaining the shores, beaches and other
				coastal resources of the United States, its territories and possessions, and
				promoting and encouraging the healthful recreation of the people, it is
				declared to be the policy of the United States, subject to the provisions of
				this Act, to promote shore protection projects and related research that
				encourage the protection, restoration, and enhancement of sandy beaches and
				other coastal infrastructure, including beach restoration and periodic beach
				nourishment, on a comprehensive and coordinated basis by the Federal
				Government, States, localities, and private interests. In carrying out this
				policy, preference shall be given to areas—</text>
							<paragraph id="H79DFE90DA0DD4E789E50FD5D056E13F"><enum>(1)</enum><text>in which there has
				been a previous investment of Federal funds;</text>
							</paragraph><paragraph id="H599BFCC26CD14C57828873BD24AA2BF8"><enum>(2)</enum><text>in which regional
				sediment management plans have been adopted;</text>
							</paragraph><paragraph id="H0A57BA936BD44E06878BA8009761DA37"><enum>(3)</enum><text>in which the need
				for prevention or mitigation of damage to shores, beaches, and other coastal
				infrastructure is attributable to Federal navigation projects or other Federal
				activities; or</text>
							</paragraph><paragraph id="HC9C7AE26C31947238795CE7CCBB03D05"><enum>(4)</enum><text>which promote
				human health and safety and the quality of life for individuals and
				families.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				<quoted-block id="H822A2EE5F2BE4AA2B7004D5EE4A1E78E">
					<subsection id="H59AAA7A406E1404AAE1FA8001F5E2594"><enum>(b)</enum><header>Implementation</header><text display-inline="yes-display-inline">The Secretary shall pay the Federal share
				of the cost of carrying out shore protection projects and related research that
				encourages the protection, restoration, and enhancement of shores, sandy
				beaches, and other coastal infrastructure (including projects for beach
				restoration, periodic beach nourishment, and restoration or protection of
				State, county, or other shores, public coastal beaches, parks, conservation
				areas, or other environmental resources).</text>
					</subsection><subsection id="H911FD6781516453797A4C91354EEC112"><enum>(c)</enum><header>Federal
				share</header>
						<paragraph id="H2B5E2E60EFDC4970AAB47EDD30721DC7"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraphs (2) through (4), the Federal share
				of the cost of a project described in subsection (b) shall be determined in
				accordance with section 103 of the Water Resources Development Act of 1986 (33
				U.S.C. 2213).</text>
						</paragraph><paragraph id="H2E7AE6697E004307BB1687F9BEE7BFB7"><enum>(2)</enum><header>Exception</header><text>In
				the case of a project for beach erosion control the primary purpose of which is
				recreation, the Federal share shall be equal to the Federal share for a beach
				erosion control project the primary purpose of which is storm damage protection
				or environmental restoration.</text>
						</paragraph><paragraph id="H63BABC1409FD4FA382E2D82CDC5E088C"><enum>(3)</enum><header>Remainder</header>
							<subparagraph id="HABC3FD23CA7641A4AA2E352EFAB2A6EC"><enum>(A)</enum><header>In
				general</header><text>Subject to subparagraph (B), the remainder of the cost of
				the construction of a project described in subsection (b) shall be paid by a
				State, municipality, other political subdivision, or nonprofit entity.</text>
							</subparagraph><subparagraph id="H4E814C35F7784C0083B59929BDB812E"><enum>(B)</enum><header>Exception</header><text>The
				Federal Government shall bear all of the costs incurred for the restoration and
				protection of Federal property.</text>
							</subparagraph></paragraph><paragraph id="H7B5469AB1DE0461382684C1EC8A8965F"><enum>(4)</enum><header>Greater Federal
				share</header><text>In the case of a project described in subsection (b) for
				the restoration and protection of a State, county, or other publicly-owned
				shore, coastal beach, park, conservation area, or other environmental resource,
				the Chief of Engineers may increase the Federal share to be greater than that
				provided in paragraph (1) if the area—</text>
							<subparagraph id="H9F370EC2741E46C9BA2989A32557B4A8"><enum>(A)</enum><text>includes—</text>
								<clause id="HD6800CB229354B8982C03522A0A2B633"><enum>(i)</enum><text>a
				zone that excludes permanent human habitation; or</text>
								</clause><clause id="H7AA6F36C69CC43A183520042162C45D9"><enum>(ii)</enum><text>a
				recreational beach or other area determined by the Chief of Engineers;</text>
								</clause></subparagraph><subparagraph id="H1CAA68B7397343DAA32D84FA0769C807"><enum>(B)</enum><text>satisfies adequate
				criteria for conservation and development of the natural resources of the
				environment; and</text>
							</subparagraph><subparagraph id="HCAC713F98D9945179B0426ABC66EAE62"><enum>(C)</enum><text>extends landward a
				sufficient distance to include, as approved by the Chief of Engineers—</text>
								<clause id="H596D4106CDB745D6853F8EAB789D4C78"><enum>(i)</enum><text>protective dunes,
				bluffs, or other natural features;</text>
								</clause><clause id="HB24A17A89B9D43A6A783149787A64314"><enum>(ii)</enum><text>such other
				appropriate measures adopted by the State or political subdivision of the State
				to protect uplands areas from damage, promote public recreation, or protect
				environmental resources; or</text>
								</clause><clause id="HBBAD63A350F04C3EB8B6E0BED0D44E66"><enum>(iii)</enum><text>appropriate
				facilities for public use.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="H93E0A13435B8493E99D8AC84F9E5922"><enum>(d)</enum><header>Periodic beach
				nourishment</header><text>In this Act, when the most suitable and economical
				remedial measures, as determined by the Chief of Engineers, would be provided
				by periodic beach nourishment, the term <term>construction</term> shall include
				the deposit of sand fill at suitable intervals of time to furnish sand supply
				to protect shores and beaches for a period of time specified by the Chief of
				Engineers and authorized by Congress.</text>
					</subsection><subsection id="H5C4881DB52E7494FAA0040F800AB069B"><enum>(e)</enum><header>Private shores
				and beaches</header>
						<paragraph id="H5F5EBD431C144776A6AD8605C93EBE82"><enum>(1)</enum><header>In
				general</header><text>A shore or beach, other than a public shore or beach,
				shall be eligible for Federal assistance under this Act if—</text>
							<subparagraph id="H3A3098AE1CFD4957BDA9BFCCF333384B"><enum>(A)</enum><text display-inline="yes-display-inline">there is a benefit to a public shore or
				beach, such as that arising from public use or from the protection of nearby
				public property; or</text>
							</subparagraph><subparagraph id="H051832206E694666804D3FF77F121449"><enum>(B)</enum><text>the benefits to
				the shore or beach are incidental to the project.</text>
							</subparagraph></paragraph><paragraph id="HA60E1DDF420E4E238F00AA2126406BBC"><enum>(2)</enum><header>Federal
				share</header><text>The Secretary shall adjust the Federal share of a project
				for a shore or beach, other than a public shore or beach, to reflect the
				benefits described in paragraph (1).</text>
						</paragraph></subsection><subsection id="HD46EE022FDB84C94920106072070CC15"><enum>(f)</enum><header>Authorization of
				projects</header>
						<paragraph id="H40B8CCC992AD4B229954C9264BF75FEB"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), no Federal share shall be
				provided for a project under this Act unless—</text>
							<subparagraph id="H78C4F6DBB90B44389C7D3D89F61975ED"><enum>(A)</enum><text>the plan for that
				project has been specifically adopted and authorized by Congress after
				investigation and study; or</text>
							</subparagraph><subparagraph id="H2D223D7302AF4EC7000044A53185202"><enum>(B)</enum><text>in the case of a
				small project under section 3 or 5, the plan for that project has been approved
				by the Chief of Engineers.</text>
							</subparagraph></paragraph><paragraph id="H3A60105036AE4F28A68983AC87BB9CA"><enum>(2)</enum><header>Studies</header>
							<subparagraph id="H824D180B19EC4B42A9344DF10079AEE2"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall—</text>
								<clause id="H598B3B27F15B458C8B77C5A368359601"><enum>(i)</enum><text>recommend to
				Congress studies concerning shore protection projects that meet the criteria
				established under this Act and other applicable law;</text>
								</clause><clause id="H1DD8EF3D0D5D4642898663D8FA3F4424"><enum>(ii)</enum><text>conduct such
				studies as Congress requests; and</text>
								</clause><clause id="H71C6FD48B37D4E1D989F1BB75BBA3132"><enum>(iii)</enum><text>annually report
				the status and results of all studies requested by Congress to the Committee on
				Environment and Public Works of the Senate and the Committee on Transportation
				and Infrastructure of the House of Representatives.</text>
								</clause></subparagraph><subparagraph id="H8C8F807585074E1796B387B763EC4500"><enum>(B)</enum><header>Recommendations
				for shore protection projects</header>
								<clause id="H6123F3EF3E764CBA9DDB880812132A3"><enum>(i)</enum><header>In
				general</header><text>The Secretary shall—</text>
									<subclause id="H0F7ED8B4B630497CA30400905C7144FE"><enum>(I)</enum><text display-inline="yes-display-inline">recommend to Congress the authorization or
				reauthorization of all shore and shore protection projects the plans for which
				have been approved by the Chief of Engineers; and</text>
									</subclause><subclause id="H0D3E36EE65324144AC2FEB7499723EE8"><enum>(II)</enum><text>report to
				Congress on the feasibility of other projects that have been studied under
				subparagraph (A) but have not been approved by the Chief of Engineers.</text>
									</subclause></clause><clause id="HA5438E973F8B431A898CDA540382AFAB"><enum>(ii)</enum><header>Considerations</header><text display-inline="yes-display-inline">In approving a project plan, the Chief of
				Engineers shall consider the economic and ecological benefits of the shore
				protection project.</text>
								</clause></subparagraph><subparagraph id="H5F9389583EE54935BDEB5618276396B2"><enum>(C)</enum><header>Coordination of
				projects</header><text display-inline="yes-display-inline">In conducting
				studies and making recommendations for a shore protection project under this
				paragraph, the Secretary shall—</text>
								<clause id="HE3DA077DC43341FD890473FA495F4933"><enum>(i)</enum><text display-inline="yes-display-inline">determine whether there is any other
				project being carried out by the Secretary or other Federal agency that may be
				complementary to the shore protection project; and</text>
								</clause><clause id="HC2196638B0C34401BE397BF80093F129"><enum>(ii)</enum><text>if there is such
				a complementary project, undertake efforts to coordinate the projects.</text>
								</clause></subparagraph></paragraph><paragraph id="HC6ED6E0034534331B47537410483EDC8"><enum>(3)</enum><header>Shore protection
				projects</header>
							<subparagraph id="H1C9BE48239D84A959C60517D21587879"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				construct any shore protection project authorized by Congress, or separable
				element of such a project, for which Congress has appropriated funds.</text>
							</subparagraph><subparagraph id="HF49E18B9C03A4B06B96C32EAA37BD85C"><enum>(B)</enum><header>Agreements</header>
								<clause id="H9FF99C9C498B4D8F8F085EE10827474D"><enum>(i)</enum><header>Requirement</header><text display-inline="yes-display-inline">After authorization by Congress, before the
				commencement of a construction of shore protection project or separable
				element, the Secretary shall offer to enter into a written agreement for the
				authorized period of Federal participation in the project with a non-Federal
				interest with respect to the project or separable element.</text>
								</clause><clause id="HE45EC6624F584512BECDBB819D148DD2"><enum>(ii)</enum><header>Terms</header><text>The
				agreement shall—</text>
									<subclause id="HC9F9C5A24B304481BF00B570B5248CFD"><enum>(I)</enum><text>specify the
				authorized period of Federal participation in the project; and</text>
									</subclause><subclause id="HB6769CEFEA9A4F3DB074B356008413DA"><enum>(II)</enum><text>ensure that the
				Federal Government and the non-Federal interest cooperate in carrying out the
				project or separable element.</text>
									</subclause></clause></subparagraph></paragraph></subsection><subsection id="HC96F19C6F4EB4B61B487BCE2F9AA7C"><enum>(g)</enum><header>Extension of the
				period of Federal participation</header><text display-inline="yes-display-inline">At the request of a non-Federal interest,
				the Secretary, acting through the Chief of Engineers and with the approval of
				Congress, shall extend the period of Federal participation in a shore
				protection project that is economically feasible, engineeringly sound, and
				environmentally acceptable for such additional period as the Secretary
				determines appropriate.</text>
					</subsection><subsection id="HAA9D22B0C532401A8D02E736278915B1"><enum>(h)</enum><header>Special
				considerations</header><text>In a case in which funds have been appropriated to
				the Corps of Engineers for a specific project but the funds cannot be expended
				because of the time limits of environmental permits or similar environmental
				considerations, the Secretary may carry over such funds for use in the next
				fiscal year if construction of the project, or a separable element of the
				project, will cause minimal environmental damage and will not violate an
				environmental
				permit.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H5B0B617C72E7471791C7F1F6CE96870"><enum>3.</enum><header>Non-Federal
			 contributions</header><text display-inline="no-display-inline">Section 103 of
			 the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2213">33 U.S.C. 2213</external-xref>) is amended by
			 adding at the end the following:</text>
			<quoted-block id="H43F1EB027C9346DB8EEB462110CBCBD5" style="OLC">
				<subsection id="HAD9F8B2F429F41D393A9B72BEF77FF5"><enum>(n)</enum><header>Non-federal
				contributions</header>
					<paragraph id="HA6B58E63D36E45CDA97F4D66CD95A700"><enum>(1)</enum><header>Prohibition on
				solicitation of excess contributions</header><text>The Secretary may not
				solicit contributions from non-Federal interests for costs of constructing
				authorized water resources development projects or measures in excess of the
				non-Federal share assigned to the appropriate project purposes listed in
				subsections (a), (b), and (c) or condition Federal participation in such
				projects or measures on the receipt of such contributions.</text>
					</paragraph><paragraph id="HB7C34B441516491E0006ABEA3904C20"><enum>(2)</enum><header>Limitation on
				statutory construction</header><text>Nothing in this subsection shall be
				construed to affect the Secretary’s authority under section 903(c) of this
				Act.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H10900AB3ED7A43B7A80358D85BC1E15F"><enum>4.</enum><header>National
			 shoreline erosion control development and demonstration program</header>
			<subsection id="HF01AE7FEB9254143BA46100674C1A3B8"><enum>(a)</enum><header>Permanent
			 extension of program</header><text>Section 5(a) of the Act entitled <quote>An
			 Act authorizing Federal participation in the cost of protecting the shores of
			 publicly owned property</quote>, approved August 13, 1946 (<external-xref legal-doc="usc" parsable-cite="usc/33/426h">33 U.S.C. 426h(a)</external-xref>),
			 is amended by striking all after <quote>program</quote>.</text>
			</subsection><subsection id="H4F7E1376F7EB44918CD56D4F301699"><enum>(b)</enum><header>Extension of
			 planning, design, and construction phase</header><text>Section 5(b)(1)(A) of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/426h">33 U.S.C. 426h(b)(1)(A)</external-xref>) is amended by striking all after
			 <quote>methods</quote>.</text>
			</subsection><subsection id="H0EE5F7D3E4B3465A8E9500005CB0EFD6"><enum>(c)</enum><header>Technology
			 transfers to educational institutions</header><text>Section 5(b)(1)(D) of such
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/33/426h">33 U.S.C. 426h(b)(1)(D)</external-xref>) is amended by inserting <quote>and educational
			 institutions</quote> after <quote>entities</quote>.</text>
			</subsection><subsection id="H95E5B615C93A44109714C040C5DCA92"><enum>(d)</enum><header>Cost-sharing;
			 removal of projects</header><text>Section 5(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/426h">33 U.S.C. 426h(b)</external-xref>)
			 is further amended—</text>
				<paragraph id="HC76AEB25CB644612A83271ED204734C5"><enum>(1)</enum><text>by redesignating
			 paragraphs (3) and (4) as paragraphs (5) and (6), respectively; and</text>
				</paragraph><paragraph id="H074C6656B55A48AAB95F5000EAF8091D"><enum>(2)</enum><text>by inserting after
			 paragraph (2) the following:</text>
					<quoted-block id="H24473BBE1D8B4DB7A27BF46BDE208D00" style="OLC">
						<paragraph id="HEF590383DBE948E4972C40996DAD66C"><enum>(3)</enum><header>Cost
				sharing</header><text>The Secretary may enter into a cost-sharing agreement
				with a non-Federal interest to carry out a project, or a phase of a project,
				under the erosion control program in cooperation with the non-Federal
				interest.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H1C1B7EA47CAD44DFBE9146E6D9825E41"><enum>(e)</enum><header>Modification of
			 existing shoreline protection projects</header><text>Section 5 of such Act (33
			 U.S.C. 426h) is further amended—</text>
				<paragraph id="H8319223776FE430300F54358F854EA61"><enum>(1)</enum><text>by redesignating
			 subsection (e) as subsection (f); and</text>
				</paragraph><paragraph id="H620637D8C5AD4FD9B400AFE2FD500B5"><enum>(2)</enum><text>by
			 inserting after subsection (d) the following:</text>
					<quoted-block id="HB3A81C3FF33C42F0ACA345B176DD008E" style="OLC">
						<subsection id="H70DCFD31D30249409385CDD7CAD49000"><enum>(e)</enum><header>Modification of
				existing shoreline protection projects</header><text display-inline="yes-display-inline">–Following initial construction and
				adequate evaluation of a demonstration project’s performance and lifecycle
				cost, the Secretary at the request of a non-Federal interest is authorized to
				amend the agreement for an existing federally authorized shore protection
				project to incorporate the demonstration project as a feature of the authorized
				shore protection project with the future cost of the project to be determined
				by the cost-sharing ratio of the authorized shore protection project. Such
				amendment shall only be made if the Chief of Engineers determines that it meets
				the engineering, economic, and design standards of the authorized shore
				protection
				project.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HB32E32CA1077417BB4F6C39D17CAD06"><enum>(f)</enum><header>Authorization of
			 Appropriations</header><text>Section 5(f)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/426h">33 U.S.C. 426h(e)(2)</external-xref>)
			 (as redesignated by subsection (e)(1) of this section) is amended by striking
			 <quote>$25,000,000</quote> and inserting <quote>$31,000,000</quote>.</text>
			</subsection></section></legis-body>
