<section id="H8A0CFB47F3FE498594894CF071FF88C" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Legal Timber Protection Act</short-title></quote>.</text></section>
<section id="H786EB44A452547FCB1740071C5D52758"><enum>2.</enum><header>Prevention of illegal logging practices</header>
<subsection id="HA00CD6B371254922BABC87C170869B1D"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">The Lacey Act Amendments of 1981 are amended—</text>
<paragraph id="HB65E11447FA14FA88C98D983AF4109B2"><enum>(1)</enum><text>in section 2 (<external-xref legal-doc="usc" parsable-cite="usc/16/3371">16 U.S.C. 3371</external-xref>)—</text>
<subparagraph id="H9D946D6F2EA24A0580E2C55CB545D83B"><enum>(A)</enum><text>by striking subsection (f) and inserting the following:</text>

<subsection id="HDA5ED1BF08AF4439B724AE209611FB3C"><enum>(f)</enum><header>Plant</header>
<paragraph id="HB60CF122868D48F8B794EFB968F41F47"><enum>(1)</enum><header>In general</header><text>The term <term>plant</term> means any wild member of the plant kingdom, including roots, seeds, parts, and products thereof.</text></paragraph>
<paragraph id="H84B8D51ECC744BBE00008788474D3427"><enum>(2)</enum><header>Exclusions</header><text>The term <term>plant</term> excludes any common food crop or cultivar that is a species not listed—</text>
<subparagraph id="HEB1D99B3D63B4685864C3602B39F2B98"><enum>(A)</enum><text>in the Convention on International Trade in Endangered Species of Wild Fauna and Flora (27 UST 1087; TIAS 8249); or</text></subparagraph>
<subparagraph id="HC5CB974498AD48609047A3902341D95B"><enum>(B)</enum><text>as an endangered or threatened species under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph>
<subparagraph id="HE98420A9AEEE474DA4EDEAC67388F2DC"><enum>(B)</enum><text>in subsection (h), by inserting <quote>also</quote> after <quote>plants the term</quote>; and</text></subparagraph>
<subparagraph id="HCF2E6D3F32164673A3B4D3C90041B4B7"><enum>(C)</enum><text>by striking subsection (j) and inserting the following:</text>

<subsection id="HD4A665D9B7054556A4010056BEC7A3B8"><enum>(j)</enum><header>Take</header><text>The term <term>take</term> means—</text>
<paragraph id="HD04B90AE622147B4955FFD9278C7061"><enum>(1)</enum><text>to capture, kill, or collect; and</text></paragraph>
<paragraph id="HEB45DD43439147AD88F4A1E2E1F07E7D"><enum>(2)</enum><text>with respect to a plant, also to harvest, cut, log, or remove.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="HE224A77C9AF34A97B723629B95CDF0AD"><enum>(2)</enum><text>in section 3 (<external-xref legal-doc="usc" parsable-cite="usc/16/3372">16 U.S.C. 3372</external-xref>)—</text>
<subparagraph id="HF8C3BC214F9743758931B0E1C87743E2"><enum>(A)</enum><text>in subsection (a)—</text>
<clause id="HC5929E187E134A7EB9E1B4A9315F931C"><enum>(i)</enum><text>in paragraph (2), by striking subparagraph (B) and inserting the following:</text>
<quoted-block display-inline="no-display-inline" id="H251072EC53BC44F890FBA9CA143E9F7" style="OLC">
<subparagraph id="H3242087400F442B0AA8EBEF39500C686"><enum>(B)</enum><text>any plant—</text>
<clause id="H96BDA28C62F14D9F8479BCD1442D02F"><enum>(i)</enum><text>taken, transported, possessed, or sold in violation of any law or regulation of any State, or any foreign law, that protects plants or that regulates—</text>
<subclause id="H573A4EB52D444A57BCC4D66B008EC0A4"><enum>(I)</enum><text>the theft of plants;</text></subclause>
<subclause id="HD5E6AD82E6924816B223AF69C5F9C0C1"><enum>(II)</enum><text>the taking of plants from a park, forest reserve, or other officially protected area;</text></subclause>
<subclause id="HDA209562C8E64274867FC8C281601E8F"><enum>(III)</enum><text>the taking of plants from an officially designated area; or</text></subclause>
<subclause id="H4F139803B9CC47E780B1B8C5FB5554F8"><enum>(IV)</enum><text>the taking of plants without, or contrary to, required authorization;</text></subclause></clause>
<clause id="HE14CB65778904F40A55FA85BFB016D5B"><enum>(ii)</enum><text>taken, transported, or exported without the payment of appropriate royalties, taxes, or stumpage fees required for such plant by any law or regulation of any State or by any foreign law; or</text></clause>
<clause id="HE112730281D14A14A5192FB39B526954"><enum>(iii)</enum><text>exported or transshipped in violation of any limitation under any law or regulation of any State or under any foreign law; or</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause>
<clause id="HBE1F3DF153C744D7B4C4D656C1D7EBEC"><enum>(ii)</enum><text>in paragraph (3), by striking subparagraph (B) and inserting the following:</text>
<quoted-block display-inline="no-display-inline" id="HBFF35D5AFCCD4E38B334ED1BED4598CF" style="OLC">
<subparagraph id="H1648CF248548445EB4C594355ECC87E"><enum>(B)</enum><text>to possess any plant—</text>
<clause id="HCF275ACFFCF64F7E8BA9E56452DF7D6F"><enum>(i)</enum><text>taken, transported, possessed, or sold in violation of any law or regulation of any State, or any foreign law, that protects plants or that regulates—</text>
<subclause id="HC1C78D01CB9042FBAD5EDF003F19C619"><enum>(I)</enum><text>the theft of plants;</text></subclause>
<subclause id="H1AC41C9DA68148DDBA643866F09617C"><enum>(II)</enum><text>the taking of plants from a park, forest reserve, or other officially protected area;</text></subclause>
<subclause id="H709D056F0DBF4C29BA4B484E58AAEC8"><enum>(III)</enum><text>the taking of plants from an officially designated area; or</text></subclause>
<subclause id="H41591E6622A840EDA1D61F9573EAA72D"><enum>(IV)</enum><text>the taking of plants without, or contrary to, required authorization;</text></subclause></clause>
<clause id="HFC6F85CF2521478B91CA1E89286F2EB6"><enum>(ii)</enum><text>taken, transported, or exported without the payment of appropriate royalties, taxes, or stumpage fees required for such plant by any law or regulation of any State or by any foreign law; or</text></clause>
<clause id="H06570B91548E4394B60044669BB5DD5C"><enum>(iii)</enum><text>exported or transshipped in violation of any limitation under any law or regulation of any State or under any foreign law; or</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph>
<subparagraph id="H115504F61B584A3A8CEC68D5B47204B"><enum>(B)</enum><text>by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="H8E417DD6A2FB41EF812823F2C9B5D1C2" style="OLC">
<subsection id="H8A790578844742A9BE003521CD8DE62E"><enum>(f)</enum><header>Plant declarations</header>
<paragraph id="HAA6F44AE91364C8EB8A73DC40314C019"><enum>(1)</enum><header>In general</header><text>Effective 180 days from the date of enactment of this subsection and except as provided in paragraph (3), it shall be unlawful for any person to import any plant unless the person files upon importation where clearance is requested a declaration that contains—</text>
<subparagraph id="H39F7B4EC82F843A892CA11A2768E10E4"><enum>(A)</enum><text>the scientific name of any plant (including the genus and species of the plant) contained in the importation;</text></subparagraph>
<subparagraph id="HC77599498B504F1DB985113519DFE000"><enum>(B)</enum><text>a description of—</text>
<clause id="HD3FCD66FB1054112AED94E86CB908BA5"><enum>(i)</enum><text>the value of the importation; and</text></clause>
<clause id="H250CC12EE3FE4823854B145B31AB6EA5"><enum>(ii)</enum><text>the quantity, including the unit of measure, of the plant; and</text></clause></subparagraph>
<subparagraph id="HFCB80A043B9946058500C6D2747DA08"><enum>(C)</enum><text>the name of the country from which the plant was taken.</text></subparagraph></paragraph>
<paragraph id="H0BFC88101DBF4C4E96B4F21D766F6DE"><enum>(2)</enum><header>Declaration relating to plant products</header><text>Until the date on which the Secretary promulgates a regulation under paragraph (6), a declaration relating to a plant product shall—</text>
<subparagraph id="HF2B85B5EDB7942DF8DE3E6957F681B9"><enum>(A)</enum><text>in the case in which the species of plant used to produce the plant product that is the subject of the importation varies, and the species used to produce the plant product is unknown, contain the name of each species of plant that may have been used to produce the plant product; and</text></subparagraph>
<subparagraph id="HB364EB5C554547F1B4EAE859F386347"><enum>(B)</enum><text>in the case in which the species of plant used to produce the plant product that is the subject of the importation is commonly taken from more than 1 country, and the country from which the plant was taken and used to produce the plant product is unknown, contain the name of each country from which the plant may have been taken.</text></subparagraph></paragraph>
<paragraph id="H9AEDB308D9CE4BCD8B8480E11EE97DD1"><enum>(3)</enum><header>Exclusions</header><text display-inline="yes-display-inline">Paragraphs (1) and (2) shall not apply to plants used exclusively as packaging material to support, protect, or carry another item, unless the packaging material itself is the item being imported.</text></paragraph>
<paragraph id="H165B0CA2D80A46969F96AFF0CEBA763E"><enum>(4)</enum><header>Review</header><text>Not later than 2 years after the date of enactment of this subsection, the Secretary shall review the implementation of each requirement described in paragraphs (1) and (2) and the effect of the exclusions in paragraph (3).</text></paragraph>
<paragraph id="H383D389347044BA9BE1369004C81711E"><enum>(5)</enum><header>Report</header>
<subparagraph id="HEC0C728A79EA4AC59DD6CF1A13744F3"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date on which the Secretary completes the review under paragraph (4), the Secretary shall submit to the appropriate committees of Congress a report containing—</text>
<clause id="H25742A39AD0E47D08FCF8B491E2CFFB6"><enum>(i)</enum><text>an evaluation of—</text>
<subclause id="H37DBCC84E35C49F98BC365C6890604B5"><enum>(I)</enum><text>the effectiveness of each type of information required under paragraphs (1) and (2) in assisting enforcement of section 3; and</text></subclause>
<subclause id="H0AC6BEEABC5443C1813109433DA953A8"><enum>(II)</enum><text>the potential to harmonize each requirement described in paragraphs (1) and (2) with other applicable import regulations in existence as of the date of the report;</text></subclause></clause>
<clause id="H475BE30EDE0447AE91BB4B86506D67F1"><enum>(ii)</enum><text>recommendations for such legislation as the Secretary determines to be appropriate to assist in the identification of plants that are imported into the United States in violation of section 3; and</text></clause>
<clause id="H294E4454DF8040E084225587A3B9A2AD"><enum>(iii)</enum><text>an analysis of the effect of the provisions of subsection (a) and (f) on—</text>
<subclause id="HB22DCDFE693745509539D232BEA3944"><enum>(I)</enum><text>the cost of legal plant imports; and</text></subclause>
<subclause id="HD0EC7C16B1A34307ACF49CFBC9A6B3E"><enum>(II)</enum><text>the extent and methodology of illegal logging practices and trafficking.</text></subclause></clause></subparagraph>
<subparagraph id="HB65E9259D7C74CAA8146FEB651D0F44F"><enum>(B)</enum><header>Public participation</header><text>In conducting the review under paragraph (3), the Secretary shall provide public notice and an opportunity for comment.</text></subparagraph></paragraph>
<paragraph id="H55F014AC5833414DAAC8B9567FAB8900"><enum>(6)</enum><header>Promulgation of regulations</header><text>Not later than 180 days after the date on which the Secretary completes the review under paragraph (4), the Secretary may promulgate regulations—</text>
<subparagraph id="H899A6E1FB06D4D09A34E57D08DFC7490"><enum>(A)</enum><text>to limit the applicability of any requirement described in paragraph (2) to specific plant products;</text></subparagraph>
<subparagraph id="H75C93EBFB7A24E9E8E4976B33499EC93"><enum>(B)</enum><text>to make any other necessary modification to any requirement described in paragraph (2), as determined by the Secretary based on the review under paragraph (4); and</text></subparagraph>
<subparagraph id="H1776EAF4F1EF4A6C8000B1D8C8A9D4E0"><enum>(C)</enum><text>to limit the scope of exclusion in paragraph (3) if warranted as a result of the review under paragraph (4).</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H4CAC1D0B64F84C8A8622CFEA48FAF2D"><enum>(3)</enum><text>in section 7(a)(1) (<external-xref legal-doc="usc" parsable-cite="usc/16/3376">16 U.S.C. 3376(a)(1)</external-xref>), by striking <quote>section 4</quote> and inserting <quote>section 3(f), section 4,</quote>;</text></paragraph>
<paragraph id="H4DC04932AD794AE7A94B966FC24C118D"><enum>(4)</enum><text display-inline="yes-display-inline">in section 4 (<external-xref legal-doc="usc" parsable-cite="usc/16/3373">16 U.S.C. 3373</external-xref>)—</text>
<subparagraph id="H0EA5E95FB5FC458FBAE49618462D4DCC"><enum>(A)</enum><text>by striking <quote>subsections (b) and (d)</quote> each place it appears and inserting <quote>subsections (b), (d), and (f)</quote>;</text></subparagraph>
<subparagraph id="H9C09BF0077604608A632755BCF63473F"><enum>(B)</enum><text>by inserting <quote>or section 3(f)</quote> after <quote>section 3(d)</quote> each place it appears; and</text></subparagraph>
<subparagraph id="H5B046CBB102145D382D83F7956160115"><enum>(C)</enum><text>in subsection (a)(2), by inserting <quote>or who violates subsection 3(f) other than as provided in paragraph (1)</quote> after <quote>subsection 3(b)</quote>; and</text></subparagraph></paragraph>
<paragraph id="H4DFCDC6E5A004417957DD2EDDC9B835B"><enum>(5)</enum><text>by adding at the end of section 5 (<external-xref legal-doc="usc" parsable-cite="usc/16/3374">16 U.S.C. 3374</external-xref>) the following:</text>

<subsection id="H06D326ED370444FEAA35BB1FA7954E54"><enum>(d)</enum><header>Civil forfeitures</header><text display-inline="yes-display-inline">Civil forfeitures under this section shall be governed by the provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/46">chapter 46</external-xref> of title 18, United States Code.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H31EA44D0F3D741E69C99B5140573C83F"><enum>(b)</enum><header>Technical correction</header><text display-inline="yes-display-inline"></text>
<paragraph id="H2179DF485B69499C95086D8B35187569"><enum>(1)</enum><header>Correction</header><text>Section 102(c) of <external-xref legal-doc="public-law" parsable-cite="pl/100/653">Public Law 100–653</external-xref> is amended—</text>
<subparagraph id="HD60A1205310E484BBA709698AE58BCA5"><enum>(A)</enum><text>by inserting <quote>of the Lacey Act Amendments of 1981</quote> after <quote>Section 4</quote>; and </text></subparagraph>
<subparagraph id="HD9A2AE0E167943C49802526E500000C9"><enum>(B)</enum><text>by striking <quote>(other than section 3(b))</quote> and inserting <quote>(other than subsection 3(b))</quote>.</text></subparagraph></paragraph>
