Transportation security</header>
<section id="H4870528445164544B77468151DD1B231"><enum>101.</enum><header>Findings;
purpose</header>
<subsection id="H41C05355E7644E98A301A724626102DD"><enum>(a)</enum><header>Findings</header><text>Congress
finds that—</text>
<paragraph id="H7630A17D2EF249C1A100ADFDD06F34B8"><enum>(1)</enum><text>throughout the
world, public transportation systems have been a primary target of terrorist
attacks, causing countless deaths and injuries;</text>
</paragraph><paragraph id="HE685727F19704254BD16009273F11F20"><enum>(2)</enum><text>5,800 public
transportation agencies operate in the United States;</text>
</paragraph><paragraph id="HA5D72A12344142A7B6E643FAE3519199"><enum>(3)</enum><text>14,000,000 people
in the United States ride public transportation each work day;</text>
</paragraph><paragraph id="HD6EB8F3CD19545B4BB72EE00C53BE07"><enum>(4)</enum><text>safe and secure
public transportation systems are essential to the Nation’s economy and for
significant national and international public events;</text>
</paragraph><paragraph id="H3A08560A0F9549A8B67025A437829BCA"><enum>(5)</enum><text>the Federal
Transit Administration has invested $84,500,000,000 since 1992 for construction
and improvements to the Nation’s public transportation systems;</text>
</paragraph><paragraph id="H838103D562A84B12AB2E95D443D45217"><enum>(6)</enum><text>the Federal
Government appropriately invested $19,600,000,000 in fiscal years 2002 through
2006 to protect the Nation’s aviation system and its 2,000,000 daily
passengers;</text>
</paragraph><paragraph id="H4394742EAAE64FD5929F63D4E5668939"><enum>(7)</enum><text>the Federal
Government invested $380,000,000 in fiscal years 2003 through 2006 for grants
to protect public transportation systems in the United States;</text>
</paragraph><paragraph id="HB0FEC1A26AFB4161BB97199B895CA45C"><enum>(8)</enum><text>the Federal
Government has invested $9.00 in aviation security improvements per passenger,
but only $0.01 in public transportation security improvements per
passenger;</text>
</paragraph><paragraph id="H9792112309E8440E9539FC1CE8B58D0"><enum>(9)</enum><text>the Government
Accountability Office, the Mineta International Institute for Surface
Transportation Policy Studies, the American Public Transportation Association,
and other experts have reported an urgent need for significant investment in
transit security improvements;</text>
</paragraph><paragraph id="H586DF3E5F16A4C978958B203707BCEC"><enum>(10)</enum><text>Federal financial
assistance for transit security improvements should be separate from and
supplementary to funding for longstanding Federal programs for investment in
public transportation infrastructure;</text>
</paragraph><paragraph id="HBDEF6BB04CF64992A820CFF4A83C08AE"><enum>(11)</enum><text>the final report
of the National Commission on Terrorist Attacks Upon the United States (also
known as the <quote>9/11 Commission</quote>) found that the Federal Government
should—</text>
<subparagraph id="HFBD614AB95074429A400AC3C88C1AD36"><enum>(A)</enum><text>identify and
evaluate the transportation assets that need to be protected, set risk-based
priorities for defending them, and select the most practical and cost-effective
ways of doing so;</text>
</subparagraph><subparagraph id="HED59BBA5BB2043C800801B420218EA8E"><enum>(B)</enum><text>develop a plan, a
budget, and funding to implement the effort; and</text>
</subparagraph><subparagraph id="H4A6F674C9FE04D0FB283A6BF4B361317"><enum>(C)</enum><text>assign roles and
missions to the relevant authorities (Federal, State, regional, and local) and
to private stakeholders;</text>
</subparagraph></paragraph><paragraph id="H39DB06A6FBF34FBD8B1F74D178E46352"><enum>(12)</enum><text>the final report
of the 9/11 Commission also found that homeland security assistance should be
based strictly on an assessment of risks and vulnerabilities; and</text>
</paragraph><paragraph id="H54D6E11B5CCD4D53A6F7C889AAC3C36"><enum>(13)</enum><text>the Federal
Government has a duty to deter and mitigate, to the greatest extent
practicable, threats against the Nation’s public transportation systems.</text>
</paragraph></subsection><subsection id="H3DF16DB24DFB43D6B9BD42C3DFE826"><enum>(b)</enum><header>Purpose</header><text>The
purpose of this title is to provide grants to public transportation agencies
and over-the-road bus operators to improve security in a manner consistent with
the recommendations of the 9/11 Commission described in subsections (a)(11) and
(a)(12).</text>
</subsection></section><section id="HA2DB1C6E76B042F0A876DBE2D1CBA57C"><enum>102.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title, the following definitions
apply:</text>
<paragraph id="HEB553EEF820649E3BAE5F883FEADD5D"><enum>(1)</enum><header>Public
transportation</header><text>The term <term>public transportation</term> has
the meaning given the term in <external-xref legal-doc="usc" parsable-cite="usc/49/5302">section 5302(a)</external-xref> of title 49, United States
Code.</text>
</paragraph><paragraph id="HA40AA994070B4508B88E9F9042BC618C"><enum>(2)</enum><header>Public
transportation security assessment</header><text>The term <term>public
transportation security assessment</term> means a risk assessment (including a
criticality or vulnerability assessment) of a public transportation system
conducted pursuant to the annex executed under section 3028(b) of the Safe,
Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users
(<external-xref legal-doc="usc" parsable-cite="usc/49/5321">49 U.S.C. 5321</external-xref> note; 119 Stat. 1624).</text>
</paragraph><paragraph id="H0A7000A9C4254315AB307D02AEE587CD"><enum>(3)</enum><header>Secretary</header><text>The
term <quote>Secretary</quote> means the Secretary of Transportation, except as
otherwise specifically provided.</text>
</paragraph></section><section id="H37DB4A0BA4E14295BF5055F2B9B2532"><enum>103.</enum><header>Components of
security assessments and prioritized plans</header>
<subsection id="H67FC064EB7FF4BE0993FD90520E3D193"><enum>(a)</enum><header>Security
assessments</header><text display-inline="yes-display-inline">The Secretary
shall request that the Secretary of Homeland Security take necessary actions to
ensure that the public transportation security assessment of each public
transportation system identifies—</text>
<paragraph id="H0393B7B8E2704EDB9892F1F3100014C2"><enum>(1)</enum><text>the critical
assets of the public transportation system;</text>
</paragraph><paragraph id="HFD8CE0B98E4C4BD9AC115882C274FD92"><enum>(2)</enum><text>threats to those
assets;</text>
</paragraph><paragraph id="H6E317E8AE6CE45C7BADBA738245004D0"><enum>(3)</enum><text>security
weaknesses in the public transportation system and its assets;</text>
</paragraph><paragraph id="H90795C0858BD4921BE7C2087555CB1BA"><enum>(4)</enum><text>redundant and
backup systems required to ensure the continued operation of critical elements
of the public transportation system in the event of an attack or other
incident; and</text>
</paragraph><paragraph id="HFB8075D2C9634EEF873B11C2F9B4D490"><enum>(5)</enum><text>the extent to
which public transportation employees, including bus and rail operators,
mechanics, customer service personnel, maintenance employees, transit police,
and security personnel, have received training in security awareness and public
transportation system emergency response procedures.</text>
</paragraph></subsection><subsection id="HA6325F5C6FE3425F8228BEBCBA7E5A3"><enum>(b)</enum><header>Prioritized
plans</header><text display-inline="yes-display-inline">A public transportation
agency that has received an assessment described in subsection (a) shall
develop, in consultation with the Secretary of Homeland Security, a prioritized
plan of needed capital and operational security improvements based on the
results of the assessment.</text>
</subsection></section><section id="HE13A8ACF05BE4C54ABA7A6F6C415A8A1"><enum>104.</enum><header>National public
transportation security needs assessment</header>
<subsection id="H532EC638BE704F57A1C0C55490914279"><enum>(a)</enum><header>In
general</header><text>The Secretary shall develop a national public
transportation security needs assessment (in this section referred to as the
<quote>national assessment</quote>) to determine the total costs of needed
capital and operational security improvements for the Nation’s public
transportation systems.</text>
</subsection><subsection id="HFB7469FFEE484A939462D5A2F8E7E56"><enum>(b)</enum><header>Use of
prioritized plans developed by public transportation agencies</header><text>The
Secretary shall develop the national assessment based on prioritized plans
developed by public transportation agencies under section 103(b).</text>
</subsection><subsection id="HCD9082FC865749388752CD696CAC02A6"><enum>(c)</enum><header>Recommended
funding levels</header><text display-inline="yes-display-inline">The national
assessment shall include recommended funding levels for each of fiscal years
2008 through 2010 for carrying out the capital security assistance program
authorized by section 105(a) and the operational security assistance program
authorized by section 105(b).</text>
</subsection><subsection id="HA21C1CB8C8EE48968B4374865764E08F"><enum>(d)</enum><header>Report</header><text>Not
later than 90 days after the date of enactment of this Act, the Secretary shall
transmit to the Committee on Transportation and Infrastructure of the House of
Representatives and the Committee on Banking, Housing, and Urban Affairs of the
Senate a report containing the national assessment.</text>
</subsection></section><section id="HEE4DE97FBD954F9FA62E96E436B5CAE8"><enum>105.</enum><header>Security
assistance grants</header>
<subsection id="H768C90EE41E047A3B408829BD2D5E2D4"><enum>(a)</enum><header>Capital security
assistance program</header>
<paragraph id="H8EFB2F34855E432AB9EF00AF00079B9E"><enum>(1)</enum><header>In
general</header><text>The Secretary shall make grants directly to eligible
public transportation agencies for capital security improvements described in
paragraph (2).</text>
</paragraph><paragraph id="H69F7C8619A2249699BA25844F8356067"><enum>(2)</enum><header>Allowable use of
funds</header><text>Grant funds received under paragraph (1) shall be used
for—</text>
<subparagraph id="H2CB45D8AF13D4D839CA04607A5DA1B9"><enum>(A)</enum><text>tunnel protection
systems;</text>
</subparagraph><subparagraph id="H6F2F3089CB8240248FCD3F8EA00F0EE"><enum>(B)</enum><text>perimeter
protection systems;</text>
</subparagraph><subparagraph id="H609DCBB96A194E9D90F3FE33A703766F"><enum>(C)</enum><text>redundant critical
operations control systems;</text>
</subparagraph><subparagraph id="H122F59EEB39D496A9E8BFA000280D9CE"><enum>(D)</enum><text>chemical,
biological, radiological, or explosive detection systems;</text>
</subparagraph><subparagraph id="H80834B03191F4FCAA86CA2A94F549C88"><enum>(E)</enum><text>surveillance
equipment;</text>
</subparagraph><subparagraph id="HEFD2AA295F0C4DFEA5E1B4F60879667"><enum>(F)</enum><text>inspection
technology;</text>
</subparagraph><subparagraph id="H87824E13975C4CC79C5B303BD185A207"><enum>(G)</enum><text display-inline="yes-display-inline">interoperable communications systems and
equipment, including mobile service equipment to provide access to 911
emergency services in an underground fixed guideway system;</text>
</subparagraph><subparagraph id="H2037D54DC56F441CACA11782287C1834"><enum>(H)</enum><text>emergency response
equipment;</text>
</subparagraph><subparagraph id="HC771106ADB494067BA4E2C4514C4099D"><enum>(I)</enum><text>fire suppression
and decontamination equipment;</text>
</subparagraph><subparagraph id="HBE6BAC522B24479F81B30025EA8FCA1D"><enum>(J)</enum><text>global positioning
or automated vehicle locator type system equipment;</text>
</subparagraph><subparagraph id="HA7DC8E6347AD463800DA37BA830000A1"><enum>(K)</enum><text>evacuation
improvements;</text>
</subparagraph><subparagraph display-inline="no-display-inline" id="H15C6BF1DCF4F45039B603215A5EB5F4C"><enum>(L)</enum><text>security training
for transit employees, including bus and rail operators, mechanics, customer
service employees, maintenance employees, transit police, and security
personnel;</text>
</subparagraph><subparagraph id="H083C47EF1D5C460192A9BEB146CE8F26"><enum>(M)</enum><text>live or simulated
drills; and</text>
</subparagraph><subparagraph id="HEF69DCA8A79A474889A3D147C6B92ED1"><enum>(N)</enum><text>other capital
security improvements.</text>
</subparagraph></paragraph><paragraph id="HEA27F0E7542F4174A602FD00FF0869C0"><enum>(3)</enum><header>Government’s
share</header><text>A grant for a capital security improvement project under
this subsection shall be for 80 percent of the net project cost of the project.
The recipient may provide additional local matching amounts.</text>
</paragraph></subsection><subsection id="H7D82ED34FA224DC88804B062FBF943EA"><enum>(b)</enum><header>Operational
security assistance program</header>
<paragraph id="HE6DB15DE28F14D28A6C356BBEE44B29F"><enum>(1)</enum><header>In
general</header><text>The Secretary shall make grants directly to eligible
public transportation agencies for operational security improvements described
in paragraph (2).</text>
</paragraph><paragraph id="HC4986FF0E68841C185BC7BA1DF7D894"><enum>(2)</enum><header>Allowable use of
funds</header><text>Grant funds received under paragraph (1) shall be used
for—</text>
<subparagraph id="H0C43B0A86FDC44E0A3DCA9C3C98E0200"><enum>(A)</enum><text>public awareness
campaigns for enhanced public transportation security;</text>
</subparagraph><subparagraph id="H23F05D50A14E42C5BFD59822FFF7B4C"><enum>(B)</enum><text>canine patrols for
chemical, biological, or explosives detection;</text>
</subparagraph><subparagraph id="H9B0B7079A9A84B80A155C1CA652E6434"><enum>(C)</enum><text>overtime
reimbursement for enhanced security personnel during significant national and
international public events, consistent with the priorities established under
subsection (e); and</text>
</subparagraph><subparagraph id="H13AA2FFDA92E46E5BAC533F3F11F12E6"><enum>(D)</enum><text>other appropriate
security improvements identified under subsection (e), including hiring
additional security personnel determined necessary under subsection (e), but
excluding routine, ongoing personnel costs.</text>
</subparagraph></paragraph><paragraph id="H5D174891BACB491EAF1D61D4B334668"><enum>(3)</enum><header>Government’s
share</header><text>A grant for an operating security improvement project under
this subsection may not exceed 50 percent of the net project cost of the
project.</text>
</paragraph></subsection><subsection id="H10707B01F0974775929BF61F30E403AD"><enum>(c)</enum><header>Eligibility</header><text display-inline="yes-display-inline">A public transportation agency shall be
eligible for a grant under this section if the agency has received or is
undergoing a public transportation security assessment.</text>
</subsection><subsection id="H13F1097019794EC0AA9423F546B89649"><enum>(d)</enum><header>Allocations</header>
<paragraph id="H59319CCB02DC4985B7D61260E95F21B1"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">The Secretary, in
consultation with the Secretary of Homeland Security, shall allocate grant
funds under this section based on the results of public transportation security
assessments described in section 103(a) and in a manner that prioritizes the
award of grant funds each fiscal year based on risk, consequences,
vulnerability, and threat.</text>
</paragraph><paragraph id="HBAD5DD77EF7540359B82045E8FD422B"><enum>(2)</enum><header>Response to
urgent threats</header><text>After providing written notice to the Committee on
Transportation and Infrastructure of the House of Representatives and the
Committee on Banking, Housing, and Urban Affairs of the Senate, the Secretary
may adjust grant allocations under this subsection if the Secretary determines
that the adjustment is necessary to respond to an urgent threat or other
significant factors.</text>
</paragraph></subsection><subsection id="HE88BE36684FF4ADDBB11F97399FDECC2"><enum>(e)</enum><header>Security
improvement priorities</header>
<paragraph id="HC430CB1C0274424F82B4BD40FCF954CF"><enum>(1)</enum><header>In
general</header><text>The Secretary, in consultation with the Secretary of
Homeland Security, shall establish security improvement priorities for each
public transportation agency receiving a public transportation security
assessment.</text>
</paragraph><paragraph id="H775DCAFF8CEF42329FDE799169F32039"><enum>(2)</enum><header>Consultation;
prioritized plan</header><text>The Secretary shall establish priorities under
paragraph (1)—</text>
<subparagraph id="H8E22189B16094E32AFEDA37CAB7760E0"><enum>(A)</enum><text>in consultation
with the management and employee representatives of the public transportation
agency; and</text>
</subparagraph><subparagraph id="H379A26DCDAD54BDDBA94C5C002FB122F"><enum>(B)</enum><text>in a manner that
is consistent with the system’s prioritized plan of needed capital and
operational security improvements described in section 103(b).</text>
</subparagraph></paragraph><paragraph id="HB22A6E2C8F9F4D269C35563591E3AD65"><enum>(3)</enum><header>Applicability</header><text>Priorities
established under paragraph (1) shall apply to funds provided to a public
transportation agency under this section.</text>
</paragraph></subsection><subsection id="H14B934D214084886A6001DA72AF9271"><enum>(f)</enum><header>Transit agency
responsibilities</header><text>Each public transportation agency that receives
a grant under this section shall—</text>
<paragraph id="HA6CF532BD5A047FB8E1F7DD3E87461F"><enum>(1)</enum><text>identify a security
coordinator to coordinate security improvements;</text>
</paragraph><paragraph id="H899B03D706B94D3AB095DE9667DE00AB"><enum>(2)</enum><text>develop a
comprehensive plan that demonstrates the agency’s capacity for operating and
maintaining the equipment purchased under this section; and</text>
</paragraph><paragraph id="H0AB3480642154B54863EDE29CBE08400"><enum>(3)</enum><text>report annually to
the Department of Transportation on the use of grant funds received under this
section.</text>
</paragraph></subsection><subsection id="H4851857095A4461BBBEEB996D8AE6BDB"><enum>(g)</enum><header>Grant
requirements</header><text>Except as otherwise specifically provided in this
title, a grant provided under this section shall be subject to the terms and
conditions applicable to grants made under <external-xref legal-doc="usc" parsable-cite="usc/49/5307">section 5307</external-xref> of title 49, United
States Code, and to such other terms and conditions as are determined by the
Secretary.</text>
</subsection></section><section id="H7B50AD855BB24C1FB51CCF73BD5727DE"><enum>106.</enum><header>Intelligence
sharing</header>
<subsection id="H0514C5BEDD8B402ABC49B396B666E67"><enum>(a)</enum><header>Intelligence
sharing</header><text>The Secretary shall request that the Secretary of
Homeland Security provide appropriate and timely notification of all credible
terrorist threats against public transportation assets in the United
States.</text>
</subsection><subsection id="H12BB765C6174427D99D018CEAA32523"><enum>(b)</enum><header>Information
sharing analysis center</header>
<paragraph id="H36C87EE4F6904FE58EBBBCBF696841CF"><enum>(1)</enum><header>Establishment</header><text>The
Secretary shall fund the reasonable costs of the Information Sharing and
Analysis Center for Public Transportation (referred to in this subsection as
the <quote>ISAC</quote>) established pursuant to Presidential Directive 63 to
protect critical infrastructure.</text>
</paragraph><paragraph id="H6516E16FC55B41B1ACEAB2EDCCCB799D"><enum>(2)</enum><header>Public
Transportation agency participation</header><text>The Secretary—</text>
<subparagraph id="HD2BBF8940C8442F885E504A0C1892500"><enum>(A)</enum><text>shall require
those public transportation agencies that the Secretary determines to be at
significant risk of terrorist attack to participate in the ISAC;</text>
</subparagraph><subparagraph id="HCDB2E7E35A1F485787E0A92C38C63E1B"><enum>(B)</enum><text>shall encourage
all other public transportation agencies to participate in the ISAC; and</text>
</subparagraph><subparagraph id="HCDFC9FBE8EC0496BBFBA00F64BDE2C8"><enum>(C)</enum><text>shall not charge
any public transportation agency a fee for participation in the ISAC.</text>
</subparagraph></paragraph></subsection></section><section id="H4A6FEC45F1E04392A2559F6088DBCEB4"><enum>107.</enum><header>Reporting
requirement</header>
<subsection id="HD1E6777C903344088E9C8DB798A24211"><enum>(a)</enum><header>In
general</header><text>Not later than September 30, 2008, the Secretary, in
consultation with the Secretary of Homeland Security, shall submit to the
Committee on Transportation and Infrastructure of the House of Representatives
and the Committee on Banking, Housing, and Urban Affairs of the Senate a report
that describes the implementation of sections 103 through 106. The Secretary
may submit the report in classified and unclassified forms.</text>
</subsection><subsection id="H228994C947F14A7D845E3B412EEE73B2"><enum>(b)</enum><header>Contents</header><text>The
report shall include—</text>
<paragraph id="H8DA8343F6BF74940A8DCEB47EDC37A0"><enum>(1)</enum><text>a
description of the state of public transportation security in the United
States; and</text>
</paragraph><paragraph id="HBD084AA5C0C948A9970500EB05B020CE"><enum>(2)</enum><text>a
description of actions taken by Federal, State, regional, and local governments
and private stakeholders to address threats to, and security weaknesses in, the
public transportation system and its assets.</text>
</paragraph></subsection></section><section id="H139882ED23644982A2F63987EF8190D7"><enum>108.</enum><header>Public
Transportation employee security training program</header>
<subsection id="H2F90E0AB3A234DD8B9B0E462AB483117"><enum>(a)</enum><header>In
general</header><text>Not later than 90 days after the date of enactment of
this Act, the Secretary, in consultation with the Secretary of Homeland
Security, appropriate law enforcement, security, and terrorism experts,
representatives of public transportation agencies, and representatives of
public transportation employees, shall develop and issue guidelines for a
public transportation employee security training program to prepare public
transportation employees for potential threat conditions.</text>
</subsection><subsection id="HA344D701897B4581AE8C977B14B300D7"><enum>(b)</enum><header>Public
Transportation agency programs</header>
<paragraph id="H74F0A5343A6C420091A7C7516D8272A1"><enum>(1)</enum><header>In
general</header><text>Not later than 90 days after the date on which Secretary
issues guidance under subsection (a) in final form, each public transportation
agency that has received or is undergoing a public transportation security
assessment shall develop an employee training program in accordance with such
guidance.</text>
</paragraph><paragraph id="HDF8D4B13E1DD4D4F90BBD2E3FC647CB9"><enum>(2)</enum><header>Review and
approval</header><text>Each public transportation agency referred to in
paragraph (1) shall submit its employee training program to the Secretary for
review and approval or amendment.</text>
</paragraph><paragraph id="H4663DAC848274CA1BCB009EF3B386C"><enum>(3)</enum><header>Implementation</header><text>Not
later than one year after the date on which the Secretary approves an employee
training program of a public transportation agency under paragraph (2), the
agency shall complete employee training in accordance with such program with
respect to the employees of the agency identified in the agency’s public
transportation security assessment. Other public transportation agency
employees may also be trained under the agency’s employee training
program.</text>
</paragraph></subsection><subsection id="H840C2BB8219041CB83578BFADE32AF28"><enum>(c)</enum><header>Reporting</header><text>As
part of the Secretary’s report to Congress under section 107, the Secretary
shall include an analysis of the extent to which public transportation agencies
are successfully carrying out the employee training programs described in this
section.</text>
</subsection></section><section id="H07733E80ACD64662A93D951770D3E54"><enum>109.</enum><header>Authorization of
appropriations</header>
<subsection id="HE958448B306F4EE385C76E291B11B1AC"><enum>(a)</enum><header>Capital security
assistance program</header><text>Subject to subsection (d), there is authorized
to be appropriated such sums as may be necessary to carry out section 105(a)
for each of fiscal years 2008 through 2010.</text>
</subsection><subsection id="HEDCD486D31AA4B3B83468F738FBAB8BD"><enum>(b)</enum><header>Operational
security assistance program</header><text>Subject to subsection (d), there is
authorized to be appropriated such sums as may be necessary to carry out
section 105(b) for each of fiscal years 2008 through 2010.</text>
</subsection><subsection id="HDF010B6AC3764B7291AF571B00BCB12B"><enum>(c)</enum><header>Information
Sharing and Analysis Center</header><text>There is authorized to be
appropriated to carry out section 106(b) $1,000,000 for each of fiscal years
2008 through 2010.</text>
</subsection><subsection id="H49C84487FC68419B8B896CA303A81415"><enum>(d)</enum><header>Effect of
recommended funding levels</header><text>Amounts appropriated for a fiscal year
to carry out a program authorized by section 105(a) or 105(b) may not exceed
the recommended funding level for that program established by the Secretary for
that fiscal year under section 104(c).</text>

availability</header><text>Sums appropriated pursuant to this section shall
remain available until expended.</text>
</subsection></section><enum>II</enum><header>Over-the-road bus
security assistance</header>
<section id="HE4AD518449BB4F218BEFF7EE08AE9ECF"><enum>201.</enum><header>Emergency
over-the-road bus security assistance</header>
<subsection id="HB9DC4BC4F07744F29BE12915BEE00017"><enum>(a)</enum><header>In
general</header><text>The Secretary of Transportation, acting through the
Administrator of the Federal Motor Carrier Safety Administration, shall
establish a program for making grants to private operators of over-the-road
buses for system-wide security improvements to their operations,
including—</text>
<paragraph id="H875BE9C084B44D2B84C4C156B9B573FB"><enum>(1)</enum><text>constructing and
modifying terminals, garages, facilities, or over-the-road buses to assure
their security;</text>
</paragraph><paragraph id="HBFCF335F35C54D9B92A189B925826BD"><enum>(2)</enum><text>protecting or
isolating the driver;</text>
</paragraph><paragraph id="HC6DC5D3926E647ADA9AFC4BD85EEB300"><enum>(3)</enum><text>acquiring,
upgrading, installing, or operating equipment, software, or accessorial
services for collection, storage, or exchange of passenger and driver
information through ticketing systems or otherwise, and information links with
government agencies;</text>
</paragraph><paragraph id="HC3C1B2E549A8442FA6BFF87CCAA1E982"><enum>(4)</enum><text>training employees
in recognizing and responding to security threats, evacuation procedures,
passenger screening procedures, and baggage inspection;</text>
</paragraph><paragraph id="H2FA2B193C3BF4FAF88BCF63D48F9003C"><enum>(5)</enum><text>hiring and
training security officers;</text>
</paragraph><paragraph id="HEBDCFC57675D42F8B354D21011C51423"><enum>(6)</enum><text>installing cameras
and video surveillance equipment on over-the-road buses and at terminals,
garages, and over-the-road bus facilities;</text>
</paragraph><paragraph id="H4F900EF632C948838F2111535F20A2A4"><enum>(7)</enum><text>creating a program
for employee identification or background investigation;</text>
</paragraph><paragraph id="H40BD3CB3B05E4F86B6CCC56E59D930B"><enum>(8)</enum><text>establishing an
emergency communications system linked to law enforcement and emergency
personnel; and</text>
</paragraph><paragraph id="HB0EA4B20B33E4635AD5C8C7D98AC9787"><enum>(9)</enum><text>implementing and
operating passenger screening programs at terminals and on over-the-road
buses.</text>
</paragraph></subsection><subsection id="H1A799C74F7B04193A4291F71F29102A"><enum>(b)</enum><header>Federal
share</header><text>The Federal share of the cost for which any grant is made
under this section shall be 80 percent.</text>
</subsection><subsection id="H37B7F330CFA04556BCF3F17D32B1BBCA"><enum>(c)</enum><header>Grant
requirements</header><text>A grant under this section shall be subject to all
the terms and conditions that a grant is subject to under section 3038(f) of
the Transportation Equity Act for the 21st Century (<external-xref legal-doc="usc" parsable-cite="usc/49/5310">49 U.S.C. 5310</external-xref> note; 112
Stat. 393).</text>
</subsection><subsection id="HB2B02EE24A9448EFA0F5077800A75111"><enum>(d)</enum><header>Report on
industry priorities</header>
<paragraph id="HA0911D0FFC1E43D2833B43D5E5C7313B"><enum>(1)</enum><header>Study</header><text>The
Administrator of the Federal Motor Carrier Safety Administration shall conduct
a study of—</text>
<subparagraph id="H691CF5492E174F3F9DFFD9A699E0EBD2"><enum>(A)</enum><text>the critical
assets and systems of the nationwide over-the-road bus industry;</text>
</subparagraph><subparagraph id="H75C4DEFEAD0A4224933F001C5F983100"><enum>(B)</enum><text>security threats
to the assets and systems;</text>
</subparagraph><subparagraph id="HA4E0796B17004122A5008CE9A7D1DFDB"><enum>(C)</enum><text>security
weaknesses in the assets and systems; and</text>
</subparagraph><subparagraph id="H3C86F227970148E8B52D540435F6F776"><enum>(D)</enum><text>redundant and
backup systems required to ensure the continued operation of critical elements
of the assets and systems in the event of an attack or other incident.</text>
</subparagraph></paragraph><paragraph id="HA9C6D586C4D9449986B6E305CD59F425"><enum>(2)</enum><header>Consultation</header><text>In
conducting the study, the Administrator shall consult with representatives of
private over-the-road bus operators and the employees of such operators.</text>
</paragraph><paragraph id="H2B4FF3C26101455BA60048485D351C02"><enum>(3)</enum><header>Report</header><text>Not
later than 90 days after the date of enactment of this Act, the Administrator
shall submit to the Secretary of Transportation and the Secretary of Homeland
Security a report, based on the results of the study, detailing the critical
assets, threats, and weaknesses in the over-the-road bus industry. The
Administrator shall update the report on an annual basis.</text>
</paragraph></subsection><subsection id="H85AEC256320E4A9EABA9C63EFFD8B663"><enum>(e)</enum><header>Allocation of
grants</header><text>The Secretary of Transportation, in consultation with the
Secretary of Homeland Security, shall establish priorities for the allocation
of grants under this section based on the report required by subsection (d)(3)
and shall make grants under this section in accordance with those
priorities.</text>
</subsection></section><section id="H1FAE91204540417DA5ED31C3C2613EA2"><enum>202.</enum><header>Plan
requirement</header>
<subsection id="HCB266A84794349CB9BFE0064F753864C"><enum>(a)</enum><header>In
general</header><text>The Secretary of Transportation may not make a grant
under section 201 to a private operator of over-the-road buses until the
operator has first submitted to the Secretary an application containing—</text>
<paragraph id="H373DE2B729924D43A021D3881F4BB161"><enum>(1)</enum><text>a
plan for making security improvements described in section 201 and the
Secretary has approved the plan; and</text>
</paragraph><paragraph id="HCE91FDC4D0D54738BBDCA00AEB9BEA6"><enum>(2)</enum><text>such additional
information as the Secretary may require to ensure accountability for the
obligation and expenditure of amounts made available to the operator under the
grant.</text>
</paragraph></subsection><subsection id="H9BA6B8A0B5D84861A3C4C45D50333FEE"><enum>(b)</enum><header>Coordination</header><text>To
the extent that an application for a grant submitted under this section
proposes security improvements within a specific terminal owned and operated by
an entity other than the applicant, the applicant shall demonstrate to the
satisfaction of the Secretary that the applicant has coordinated the security
improvements for the terminal with that entity.</text>
</subsection><subsection id="HDA3509DBB95942F0B46CAACE4916696E"><enum>(c)</enum><header>Consultation
with DHS</header><text>In approving plans under subsection (a)(1), the
Secretary may consult with the Secretary of Homeland Security.</text>
</subsection></section><section id="H96BE3288D37D4E55A14EAC067DA3CE63"><enum>203.</enum><header>Over-the-road
bus defined</header><text display-inline="no-display-inline">In this title, the
term <quote>over-the-road bus</quote> means a bus characterized by an elevated
passenger deck located over a baggage compartment.</text>
</section><section id="H740C10DB992D430699A3A105B73E52A1"><enum>204.</enum><header>Bus security
assessment</header>
<subsection id="HB922C6A805644F5F80617E6648C2D825"><enum>(a)</enum><header>In
general</header><text>Not later than 90 days after the date of enactment of
this Act, the Secretary of Transportation shall transmit to the Committee on
Transportation and Infrastructure of the House of Representatives and the
Committee on Commerce, Science, and Transportation of the Senate a preliminary
report in accordance with the requirements of this section.</text>
</subsection><subsection id="H1347E99A7B0947498DEA9000CC3D936"><enum>(b)</enum><header>Contents of
preliminary report</header><text>The preliminary report shall include—</text>
<paragraph id="H5843BDF5C38C4A2DB5437B65DCAE6B73"><enum>(1)</enum><text>an assessment of
the over-the-road bus security grant program;</text>
</paragraph><paragraph id="H163E54E646B04E498708A7001B47B1A3"><enum>(2)</enum><text>an assessment of
actions already taken to address identified security issues by both public and
private entities and recommendations on whether additional safety and security
enforcement actions are needed;</text>
</paragraph><paragraph id="HA1C4EE1F2AB94C9CB990825532F3D2FC"><enum>(3)</enum><text>an assessment of
whether additional legislation is needed to provide for the security of
Americans traveling on over-the-road buses;</text>
</paragraph><paragraph id="H92147073B0154192B3FE7BBC8F92CAC2"><enum>(4)</enum><text>an assessment of
the economic impact that security upgrades of buses and bus facilities may have
on the over-the-road bus transportation industry and its employees;</text>
</paragraph><paragraph id="H32A571FF8E954A9BA591CF28C5764B5"><enum>(5)</enum><text>an
assessment of ongoing research and the need for additional research on
over-the-road bus security, including engine shut-off mechanisms, chemical and
biological weapon detection technology, and the feasibility of
compartmentalization of the driver;</text>
</paragraph><paragraph id="HABBA8F3AC7E247D2AFA0FCCC26179CD7"><enum>(6)</enum><text>an assessment of
industry best practices to enhance security; and</text>
</paragraph><paragraph id="H146AE6C9CB7041B8B2EA16918DDFE881"><enum>(7)</enum><text display-inline="yes-display-inline">an assessment of the total costs of needed
improvements to substantially improve the security of the Nation’s
over-the-road bus industry and a recommended funding level for carrying out
this title based on that assessment for each of fiscal years 2008 through
2010.</text>
</paragraph></subsection><subsection id="HDFBA65C412D34409850034F6F7D687C9"><enum>(c)</enum><header>Consultation
with industry, labor, and other groups</header><text>In carrying out this
section, the Secretary shall consult with over-the-road bus management and
labor representatives, public safety and law enforcement officials, and the
National Academy of Sciences.</text>
</subsection></section><section id="HB6A2B6A0CEEA4600A875D33BB15B28B2"><enum>205.</enum><header>Funding</header>
<subsection id="H72CAF8E4192A44739933B8C1F43CB85"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">Subject to subsection
(b), there is authorized to be appropriated to the Secretary of Transportation
such sums as may be necessary to carry out this title for each of fiscal years
2008 through 2010.</text>
</subsection><subsection id="H47ED09A8C1794CF3B35BCB5166AC78A5"><enum>(b)</enum><header>Effect of
recommended funding levels</header><text>Amounts appropriated for a fiscal year
to carry out this title may not exceed the recommended funding level
established by the Secretary for that fiscal year under section 204(b)(7)
.</text>
</subsection><subsection id="H5043C8E10D9B427985712790C21DB3A1"><enum>(c)</enum><header>Period of
availability</header><text>Amounts appropriated pursuant to this section shall
remain available until expended.</text>
</subsection></section><enum>III</enum><header>Rail
Security</header>
<section id="H793871726E5740F48425224398303FF3"><enum>301.</enum><header>Railroad
transportation security plan</header>
<subsection id="H4822CAAABF86475197982F8994C4403B"><enum>(a)</enum><header>Requirement</header>
<paragraph id="H583401C7A6C94D0080993384A08E2CE"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">The Secretary of
Transportation, in consultation with the Under Secretary of Homeland Security
for Border and Transportation Security, shall develop a plan for the security
of the Nation’s railroads. The plan shall include—</text>
<subparagraph id="H9094BFC2581948C0B4A213D0D808D63D"><enum>(A)</enum><text>identification and
evaluation of critical railroad assets and infrastructures;</text>
</subparagraph><subparagraph id="H06038705188449E9B7CBA0E537F1851F"><enum>(B)</enum><text>identification of
threats to those assets and infrastructures;</text>
</subparagraph><subparagraph id="HC02B2783E3FE4F7D9471CF3BF9B6EBFC"><enum>(C)</enum><text>identification of
vulnerabilities that are specific to the transportation of hazardous materials
via railroad;</text>
</subparagraph><subparagraph id="H020D57E0364B4091AF42FEBBB6F7E254"><enum>(D)</enum><text>identification of
redundant and backup systems required to ensure the continued operation of
critical elements of the railroad system in the event of an attack or other
incident, including disruption of commercial electric power or communications
networks;</text>
</subparagraph><subparagraph id="H86349616BC5D41F28BD35988B8EEED84"><enum>(E)</enum><text>identification of
security weaknesses in passenger and cargo security, transportation
infrastructure, protection systems, procedural policies, communications
systems, employee training, emergency response planning, and any other area
identified by the plan;</text>
</subparagraph><subparagraph id="HF3E9374B96B141839E171311AB09C689"><enum>(F)</enum><text>a plan for the
Federal Government to provide increased security support at high or severe
threat levels of alert, developed in consultation with the freight and
intercity passenger railroads and State and local governments;</text>
</subparagraph><subparagraph id="H1121B6165D5244539DE3E183F75B466D"><enum>(G)</enum><text>procedures for
establishing and maintaining permanent and comprehensive consultative relations
among the parties described in subsection (b); and</text>
</subparagraph><subparagraph id="H539A439AC5FA46648D4431AA5159B5FF"><enum>(H)</enum><text>a contingency
plan, developed in conjunction with freight and intercity and commuter
passenger railroads, to ensure the continued movement of freight and passengers
in the event of an attack affecting the railroad system, which shall
contemplate—</text>
<clause id="H87255A8AAC4E46D0B265CAB900DC9117"><enum>(i)</enum><text>the
possibility of rerouting traffic due to the loss of critical infrastructure,
such as a bridge, tunnel, yard, or station; and</text>
</clause><clause id="HC841F2481FB24C0BBBA800DF9005ECE"><enum>(ii)</enum><text>methods of
continuing railroad service in the Northeast Corridor in the event of a
commercial power loss, or catastrophe affecting a critical bridge, tunnel,
yard, or station.</text>
</clause></subparagraph></paragraph><paragraph id="H6991022C945E47358ECD58D397B6E212"><enum>(2)</enum><header>Existing private
and public sector efforts</header><text>The plan shall take into account
actions taken or planned by both public and private entities to address
identified security issues and assess the effective integration of such
actions.</text>
</paragraph><paragraph id="H110C396059324C26A05100F6CBBB005D"><enum>(3)</enum><header>Recommendations</header><text>The
Secretary of Transportation shall develop and implement prioritized
recommendations for improving railroad security, including recommendations
for—</text>
<subparagraph id="H7EF6CEC13A364EE5AD7E21A41ED7CBFF"><enum>(A)</enum><text>improving the
security of rail tunnels, rail bridges, rail switching and car storage areas,
other rail infrastructure and facilities, information systems, and other areas
identified by the Secretary as posing significant railroad-related risks to
public safety and the movement of interstate commerce, taking into account the
impact that any proposed security measure might have on the provision of
railroad service;</text>
</subparagraph><subparagraph id="HC0BA512BEC9E4B72999CE9DF95472974"><enum>(B)</enum><text>deploying
equipment to detect explosives and hazardous chemical, biological, and
radioactive substances, and any appropriate countermeasures;</text>
</subparagraph><subparagraph id="H7C55710CFFE2431B986404653C8546B6"><enum>(C)</enum><text>installing
redundant and backup systems to ensure the continued operation of critical
elements of the railroad system in the event of an attack or other incident,
including disruption of commercial electric power or communications
networks;</text>
</subparagraph><subparagraph id="H685D681B3CF44444B159BEAADF0005"><enum>(D)</enum><text>conducting public
outreach campaigns on passenger railroads;</text>
</subparagraph><subparagraph id="H3EC19057380B4CA3A9BB9EDA4C40ECFE"><enum>(E)</enum><text>deploying
surveillance equipment; and</text>
</subparagraph><subparagraph id="H2654A5E2E6D4484097A3C5D3B05B4374"><enum>(F)</enum><text>identifying the
immediate and long-term costs of measures that may be required to address those
risks.</text>
</subparagraph></paragraph></subsection><subsection id="H126032A27C0F4C61A4AD80B1827FA6A8"><enum>(b)</enum><header>Consultation</header><text>In
developing the plan under subsection (a), the Secretary of Transportation shall
consult with rail management, rail labor, owners or lessors of rail cars used
to transport hazardous materials, first responders, shippers of hazardous
materials, State Departments of Transportation, public safety officials
(including those within agencies and offices of the Department of Homeland
Security), and other relevant parties.</text>
</subsection><subsection id="H4D2E5A21E4C94B3F9DFE4CDE3DA14DC3"><enum>(c)</enum><header>Report</header>
<paragraph id="H10B7B27B9AEF4D0B9F57E4CDC7FF4319"><enum>(1)</enum><header>Contents</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
enactment of this Act, the Secretary of Transportation shall transmit to the
Committee on Commerce, Science, and Transportation of the Senate and the
Committee on Transportation and Infrastructure of the House of Representatives
a report containing the plan and prioritized recommendations required by
subsection (a), along with recommended funding levels for each of fiscal years
2008 through 2010 for carrying out the implementation plan and such
recommendations.</text>
</paragraph><paragraph id="H1451A607B001443ABB07E706E474F65B"><enum>(2)</enum><header>Format</header><text>The
Secretary may submit the report in both classified and redacted formats if the
Secretary determines that such action is appropriate or necessary.</text>
</paragraph></subsection><subsection id="HD677419DD02941388FE68724179B8036"><enum>(d)</enum><header>Authorization of
appropriations</header><text display-inline="yes-display-inline">There are
authorized to be appropriated to the Secretary of Transportation such sums as
may be necessary for fiscal years 2008 through 2010 for the purpose of carrying
out this section. Amounts appropriated for a fiscal year to carry out this
section may not exceed the recommended funding level for such fiscal year
established by the Secretary under subsection (c)(1). Amounts appropriated
pursuant to this subsection shall remain available until expended.</text>
</subsection></section><section id="HCDB04EF2EFD9424B96E868B5D503D2FC"><enum>302.</enum><header>Silence Means
Security</header>
<subsection id="H1FB0A3AC451B4394BBDE647D5CC00B7"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">For the purposes of this section—</text>
<paragraph id="H87E2EA78A7CD49BCA43EE06D2BEE8DC2"><enum>(1)</enum><text>the term
<quote>cargo information</quote> means information regarding—</text>
<subparagraph id="H030A4DB0F9494C89AFBC4C8292E954BA"><enum>(A)</enum><text>the contents of a
rail car or container containing hazardous material, except for information
contained on a placard placed on a rail car;</text>
</subparagraph><subparagraph id="HF351DA9CF0534AAC81B59C42BA319F1F"><enum>(B)</enum><text>the routes of such
hazardous material, including ports of embarkation and disembarkation and
locations of acceptance and delivery by shippers; or</text>
</subparagraph><subparagraph id="H6D00665E69C74665B60020B0D6CB6BD5"><enum>(C)</enum><text>security threats
or incidents occurring en route;</text>
</subparagraph></paragraph><paragraph id="H83D65B589D5D49F3BE31D5C77D6BEFEE"><enum>(2)</enum><text>the term
<quote>covered individual</quote> means an employee of—</text>
<subparagraph id="HCE5F7BEECCEF46F9A5F2A347883CBE97"><enum>(A)</enum><text>a rail
carrier;</text>
</subparagraph><subparagraph id="HA1C32C55F6E440C5BF349DCBD157E7CE"><enum>(B)</enum><text>a rail shipper;
or</text>
</subparagraph><subparagraph id="H468F0B8E4B9D43BB001C83E351DBE91D"><enum>(C)</enum><text>a railroad
contractor or railroad labor organization; and</text>
</subparagraph></paragraph><paragraph id="HC14DA2350824451C819CA0C764764495"><enum>(3)</enum><text>the term
<quote>security vulnerability</quote> means the existence of a condition,
practice, or procedure which may constitute a threat to national or homeland
security.</text>
</paragraph></subsection><subsection id="H50C76C04A9E9405C93BB30C39256818C"><enum>(b)</enum><header>Prohibition</header><text>Except
as provided in subsection (c), no covered individual shall reveal a security
vulnerability, cargo information, security plan, or security training program
to any other person.</text>
</subsection><subsection id="H562D0DDF4C0A46148300F9F59E3C00F2"><enum>(c)</enum><header>Reporting of a
security vulnerability or cargo information</header><text display-inline="yes-display-inline">A covered individual may lawfully reveal or
report a security vulnerability, cargo information, security plan, or security
training program to—</text>
<paragraph id="H4A6AC05F37EA475F82B5C797CF9FC34"><enum>(1)</enum><text>an
employee of a railroad, or an agent acting on behalf of a railroad;</text>
</paragraph><paragraph id="H2D52AAE5514C4800BA56E6F8FAC5FAC5"><enum>(2)</enum><text>a
railroad police officer or any other Federal, State, or local law enforcement
or public safety official;</text>
</paragraph><paragraph id="H570ABE09BA964450965E4423473C3E36"><enum>(3)</enum><text>a
representative of the covered individual’s labor organization;</text>
</paragraph><paragraph id="H4666B0C62AB74194888227399360B07F"><enum>(4)</enum><text>a
representative of a railroad industry organization, including the Association
of American Railroads, the American Public Transportation Association, the
American Short Line and Regional Railroad Association, and the Railway Supply
Institute;</text>
</paragraph><paragraph id="H9EDCDA23E7E947C6A7E41924A6098BA6"><enum>(5)</enum><text>a
representative of the Department of Transportation or Department of Homeland
Security, or any agency thereof; or</text>
</paragraph><paragraph id="H3E1866546F1D4D63B7F679BA00F13B95"><enum>(6)</enum><text>a
rail shipper, consignee, rail equipment owner, lessor or lessee, or person
handling or processing cargo information on behalf of a railroad, shipper, or
consignee.</text>
</paragraph></subsection><subsection id="H05B6E859D94340B0A9ACEDC21350C7E6"><enum>(d)</enum><header>Civil
Penalties</header><text>Any person who violates this section shall be subject
to a civil penalty assessed by the Secretary of Transportation in an amount not
to exceed $5,000 per violation.</text>
</subsection></section><section id="HE66DF1DD7BB748A6A5616D34207466AF"><enum>303.</enum><header>Miscellaneous
technical and conforming provisions</header>
<subsection id="HE6D230BA7CAF4111B748C00042CAAC96"><enum>(a)</enum><header>Rail police
officers</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/28101">Section 28101</external-xref> of title 49, United States Code, is
amended by striking <quote>the rail carrier</quote> each place it appears and
inserting <quote>any rail carrier</quote>.</text>
</subsection><subsection id="H0433E01808F740778736EE5403B490BA"><enum>(b)</enum><header>Review of rail
regulations</header><text>Not later than 1 year after the date of enactment of
this Act, the Secretary of Transportation, in consultation with the Under
Secretary of Homeland Security for Border and Transportation Security, shall
review existing rail regulations of the Department of Transportation for the
purpose of identifying areas in which those regulations need to be revised to
improve railroad security.</text>
</subsection><subsection id="HA99B267DEDA0474EA63DBA4228F01DB0"><enum>(c)</enum><header>Railroad
security</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/20101">Section 20101</external-xref> of title 49, United States Code, is
amended by striking <quote>safety</quote> and inserting <quote>safety,
including security,</quote>.</text>
</subsection><subsection id="H85CA59B482C04BDBB649999321C8B935"><enum>(d)</enum><header>Rail safety
regulations</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/20103">Section 20103(a)</external-xref> of title 49, United States Code, is
amended by striking <quote>safety</quote> the first place it appears, and
inserting <quote>safety, including security,</quote>.</text>
</subsection><subsection id="H35FA0406F8204A37A14B66ACC400BF63"><enum>(e)</enum><header>Certain
personnel limitations not To apply</header><text>Any statutory limitation on
the number of employees in the Transportation Security Administration of the
Department of Transportation, before or after its transfer to the Department of
Homeland Security, does not apply to the extent that any such employees are
responsible for implementing the provisions of this title.</text>
