<enum>I</enum><header>Authorization Extensions and Viability Studies</header> <section id="H22E99C259B104EBEA8AC2C700097D934"><enum>1001.</enum><header>Extensions of authorized appropriations</header><text display-inline="no-display-inline">Division II of the Omnibus Parks and Public Lands Management Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/333">Public Law 104–333</external-xref>; 16 U.S.C. 461 note) is amended in each of sections 108(a), 209(a), 311(a), 409(a), 508(a), 608(a), 708(a), 810(a) (as redesignated by this Act), and 909(c), by striking <quote>$10,000,000</quote> and inserting <quote>$15,000,000</quote>.</text> </section><section id="HCF5A0A74E94B4595A88FF4762E100022"><enum>1002.</enum><header>Evaluation and report</header> <subsection id="H3FD9F64D707542749D00A56BC0FA9B62"><enum>(a)</enum><header>In general</header><text>For the nine National Heritage Areas authorized in Division II of the Omnibus Parks and Public Lands Management Act of 1996, not later than 3 years before the date on which authority for Federal funding terminates for each National Heritage Area, the Secretary shall—</text> <paragraph id="HD7F44EBD3CD2405289C304C3DB1F383D"><enum>(1)</enum><text>conduct an evaluation of the accomplishments of the National Heritage Area; and</text> </paragraph><paragraph id="H84B4478F78FD4255A3BD796B7F003803"><enum>(2)</enum><text>prepare a report in accordance with subsection (c).</text> </paragraph></subsection><subsection id="HFFE348AAF565472080118645DC0088B8"><enum>(b)</enum><header>Evaluation</header><text>An evaluation conducted under subsection (a)(1) shall—</text> <paragraph id="H90DD6F41772B4A97955BEDEF4125200"><enum>(1)</enum><text>assess the progress of the local management entity with respect to—</text> <subparagraph id="HEF1888F1EE924564BF00AD7937F4D67C"><enum>(A)</enum><text>accomplishing the purposes of the authorizing legislation for the National Heritage Area; and</text> </subparagraph><subparagraph id="H92E0132E992D484293082D31DC8923A2"><enum>(B)</enum><text>achieving the goals and objectives of the approved management plan for the National Heritage Area;</text> </subparagraph></paragraph><paragraph id="H99A00D4A24D047DDB3A2ECF2D1DB0219"><enum>(2)</enum><text>analyze the investments of Federal, State, Tribal, and local government and private entities in each National Heritage Area to determine the impact of the investments; and</text> </paragraph><paragraph id="HE598AF5AD66142AD96F367B9291DCB7B"><enum>(3)</enum><text>review the management structure, partnership relationships, and funding of the National Heritage Area for purposes of identifying the critical components for sustainability of the National Heritage Area.</text> </paragraph></subsection><subsection id="H3203BE849FF54E2D98364120B1D6074C"><enum>(c)</enum><header>Report</header><text>Based on the evaluation conducted under subsection (a)(1), the Secretary shall submit a report to the Committee on Natural Resources of the United States House of Representatives and the Committee on Energy and Natural Resources of the Senate. The report shall include recommendations for the future role of the National Park Service, if any, with respect to the National Heritage Area.</text> </subsection></section><enum>II</enum><header>Establishment of National Heritage Areas</header> <subtitle id="H49D4135AA80645AFACD6CD05458F9035"><enum>A</enum><header>Journey Through Hallowed Ground National Heritage Area</header> <section id="H3357D304E7F549E6AE160004F4E00FF"><enum>2001.</enum><header>Short title; and</text> </paragraph><paragraph id="HA1408E793EE54F1AAD5BC3A33BC800E8"><enum>(7)</enum><text>to provide appropriate linkages among units of the National Park System within and surrounding the National Heritage Area, to protect, enhance, and interpret resources outside of park boundaries.</text> </paragraph></subsection></section><section id="H36EDE86E386F43308586E191F200C231"><enum>2003.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle—</text> <paragraph id="HC5A7C61178CC4D00A4EC1F133F3E9CD9"><enum>(1)</enum><header>National heritage area</header><text>The term <term>National Heritage Area</term> means the Journey Through Hallowed Ground National Heritage Area established in this subtitle.</text> </paragraph><paragraph id="H0BE438562FE540D9A42900E78510D9BB"><enum>(2)</enum><header>Local coordinating entity</header><text>The term <term>local coordinating entity</term> means the Journey Through Hallowed Ground Partnership, a Virginia non-profit, which is hereby designated by Congress—</text> <subparagraph id="H79B3C7DFA7CF4494B5CFE4B549AAD4A3"><enum>(A)</enum><text>to develop, in partnership with others, the management plan for the National Heritage Area; and</text> </subparagraph><subparagraph id="H99568B58130D4F8E00BBAD5E23373998"><enum>(B)</enum><text>to act as a catalyst for the implementation of projects and programs among diverse partners in the National Heritage Area.</text> </subparagraph></paragraph><paragraph id="HC328E3D6176A40F194D39EA76037700"><enum>(3)</enum><header>Management plan</header><text>The term <term>management plan</term> means the plan prepared by the local coordinating entity for the National Heritage Area that specifies actions, policies, strategies, performance goals, and recommendations to meet the goals of the National Heritage Area, in accordance with this subtitle.</text> </paragraph><paragraph id="HAA61AF7F719D4ED1BF087C7043DBFA5C"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text> </paragraph></section><section id="HA40F8051CDB4465BB0FFD41606F8CF13"><enum>2004.</enum><header>Designation of the Journey Through Hallowed Ground National Heritage Area</header> <subsection id="HC1347DF9B2174E0082F40520040C218"><enum>(a)</enum><header>Establishment</header><text>There is hereby established the Journey Through Hallowed Ground National Heritage Area.</text> </subsection><subsection id="H66AD7E1E1B34497281DDDD7CD600E8B9"><enum>(b)</enum><header>Boundaries</header> <paragraph id="H2EE87E044B564B03929923075D83BC94"><enum>(1)</enum><header>In general</header><text>The Heritage Area shall consist of the 175-mile region generally following the Route 15 corridor and surrounding areas from Adams County, Pennsylvania, through Frederick County, Maryland, including the Heart of the Civil War Maryland State Heritage Area, looping through Brunswick, Maryland, to Harpers Ferry, West Virginia, back through Loudoun County, Virginia, to the Route 15 corridor and surrounding areas encompassing portions of Loudoun and Prince William Counties, Virginia, then Fauquier County, Virginia, portions of Spotsylvania and Madison Counties, Virginia, and Culpepper, Rappahannock, Orange, and Albemarle Counties, Virginia.</text> </paragraph><paragraph id="H69EC8CBA10144B2993A750573C4D7F93"><enum>(2)</enum><header>Map</header><text>The boundaries of the National Heritage Area shall include all of those lands and interests as generally depicted on the map titled <quote>Journey Through Hallowed Ground National Heritage Area</quote>, numbered P90/80,000, and dated October 2006. The map shall be on file and available to the public in the appropriate offices of the National Park Service and the local coordinating entity.</text> </paragraph></subsection></section><section id="H77DBA7A19EBD45F8A5B99740D950FE74"><enum>2005.</enum><header>Management plan</header> <subsection id="HB637396E4CDA4E4194FC33CEDB7C6EA"><enum>(a)</enum><header>Requirements</header><text>The management plan for the National Heritage Area shall—</text> <paragraph id="HD371D656FF1541FD8D7D73B7F3F0038"><enum>(1)</enum><text>describe comprehensive policies, goals, strategies, and recommendations for telling the story of the heritage of the area covered by the National Heritage Area and encouraging long-term resource protection, enhancement, interpretation, funding, management, and development of the National Heritage Area;</text> </paragraph><paragraph id="HA5E5F510D8AF4D4EA38773C988B496E6"><enum>(2)</enum><text>include a description of actions and commitments that Federal, State, Tribal, and local governments, private organizations, and citizens will take to protect, enhance, interpret, fund, manage, and develop the natural, historical, cultural, educational, scenic, and recreational resources of the National Heritage Area;</text> </paragraph><paragraph id="H827A7FFAFCD44723A95EC44270D9E467"><enum>(3)</enum><text>specify existing and potential sources of funding or economic development strategies to protect, enhance, interpret, fund, manage, and develop the National Heritage Area;</text> </paragraph><paragraph id="H6390D13EA82E45B09B04EC29A82DCCE"><enum>(4)</enum><text>include an inventory of the natural, historical, cultural, educational, scenic, and recreational resources of the National Heritage Area related to the national importance and themes of the National Heritage Area that should be protected, enhanced, interpreted, managed, funded, and developed;</text> </paragraph><paragraph id="H31F894D70B404600A7D61410FBC49127"><enum>(5)</enum><text>recommend policies and strategies for resource management, including the development of intergovernmental and interagency agreements to protect, enhance, interpret, fund, manage, and develop the natural, historical, cultural, educational, scenic, and recreational resources of the National Heritage Area;</text> </paragraph><paragraph id="H585EED31B0E4456E9985FB512E5933E0"><enum>(6)</enum><text>describe a program for implementation for the management plan, including—</text> <subparagraph id="HC772EF42542F4CE6A55E6F8E10595889"><enum>(A)</enum><text>performance goals;</text> </subparagraph><subparagraph id="H79CBE2BB64DB400CAE9EE50500CCFF91"><enum>(B)</enum><text>plans for resource protection, enhancement, interpretation, funding, management, and development; and</text> </subparagraph><subparagraph id="HEC14E3F6E9EF4F0D9B4CCD5097C671CC"><enum>(C)</enum><text>specific commitments for implementation that have been made by the local coordinating entity or any Federal, State, Tribal or local government agency, organization, business, or individual;</text> </subparagraph></paragraph><paragraph id="HD2FE4DF8354047E29C7BAA7639004100"><enum>(7)</enum><text>include an analysis of, and recommendations for, means by which Federal, State, Tribal, and local programs may best be coordinated (including the role of the National Park Service and other Federal agencies associated with the National Heritage Area) to further the purposes of this subtitle; and</text> </paragraph><paragraph id="H9842D076A73D4D23BE1DD39D822200B6"><enum>(8)</enum><text>include a business plan that—</text> <subparagraph id="H9013D47D2F5B413AB2781E9D84E69F07"><enum>(A)</enum><text>describes the role, operation, financing, and functions of the local coordinating entity and of each of the major activities contained in the management plan; and</text> </subparagraph><subparagraph id="H3BFDBE4E4D2542BCA453BBD15E8CC7A3"><enum>(B)</enum><text>provides adequate assurances that the local coordinating entity has the partnerships and financial and other resources necessary to implement the management plan for the National Heritage Area.</text> </subparagraph></paragraph></subsection><subsection id="HD8E274D83E354FEA9226D3A823C89A4"><enum>(b)</enum><header>Deadline</header> <paragraph id="H4F5C4E2417384323A343EDD3FB99E228"><enum>(1)</enum><header>In general</header><text>Not later than 3 years after the date on which funds are first made available to develop the management plan after designation as a National Heritage Area, the local coordinating entity shall submit the management plan to the Secretary for approval.</text> </paragraph><paragraph id="HFC7B72C9DC3B4F29A95470494D1EC7A2"><enum>(2)</enum><header>Termination of funding</header><text>If the management plan is not submitted to the Secretary in accordance with paragraph (1), the local coordinating entity shall not qualify for any additional financial assistance under this subtitle until such time as the management plan is submitted to and approved by the Secretary.</text> </paragraph></subsection><subsection id="H2F6F456C87D84C69A75FA76D26BEF552"><enum>(c)</enum><header>Approval of management plan</header> <paragraph id="HEF11AAFCA52C4E06889578650056C3C0"><enum>(1)</enum><header>Review</header><text>Not later than 180 days after receiving the plan, the Secretary shall review and approve or disapprove the management plan for a National Heritage Area on the basis of the criteria established under paragraph (3).</text> </paragraph><paragraph id="HE2CDC8B9621F481EA788547CBDC3629C"><enum>(2)</enum><header>Consultation</header><text>The Secretary shall consult with the Governor of each State in which the National Heritage Area is located before approving a management plan for the National Heritage Area.</text> </paragraph><paragraph id="H30D403323F974101B9C6BA80EAF58300"><enum>(3)</enum><header>Criteria for approval</header><text>In determining whether to approve a management plan for a National Heritage Area, the Secretary shall consider whether—</text> <subparagraph id="H0571E4F0D3194007A155369EF8BB0226"><enum>(A)</enum><text>the local coordinating entity represents the diverse interests of the National Heritage Area, including Federal, State, Tribal, and local governments, natural, and historic resource protection organizations, educational institutions, businesses, recreational organizations, community residents, and private property owners;</text> </subparagraph><subparagraph id="HA6D50E8F86C04DC6A25C0000797647CD"><enum>(B)</enum><text>the local coordinating entity—</text> <clause id="H13002FE103FF46B3837DEBDCED75D3D2"><enum>(i)</enum><text>has afforded adequate opportunity for public and Federal, State, Tribal, and local governmental involvement (including through workshops and hearings) in the preparation of the management plan; and</text> </clause><clause id="H3FF1ECDF1E74455F99520070BB77B9C6"><enum>(ii)</enum><text>provides for at least semiannual public meetings to ensure adequate implementation of the management plan;</text> </clause></subparagraph><subparagraph id="HD481C4596F814EE1B7F4042DF091C46"><enum>(C)</enum><text>the resource protection, enhancement, interpretation, funding, management, and development strategies described in the management plan, if implemented, would adequately protect, enhance, interpret, fund, manage, and develop the natural, historic, cultural, educational, scenic, and recreational resources of the National Heritage Area;</text> </subparagraph><subparagraph id="H984749C9AFAF4E62BF00217E37825787"><enum>(D)</enum><text>the management plan would not adversely affect any activities authorized on Federal land under public land laws or land use plans;</text> </subparagraph><subparagraph id="HA2DE91C522D740F6A85C5C7B69D351D8"><enum>(E)</enum><text>the local coordinating entity has demonstrated the financial capability, in partnership with others, to carry out the plan;</text> </subparagraph><subparagraph id="H77B087BB897E450AB38E55F59B54C4CA"><enum>(F)</enum><text>the Secretary has received adequate assurances from the appropriate State, Tribal, and local officials whose support is needed to ensure the effective implementation of the State, Tribal, and local elements of the management plan; and</text> </subparagraph><subparagraph id="H86FD72955BAC413FBA12A29FE8522077"><enum>(G)</enum><text>the management plan demonstrates partnerships among the local coordinating entity, Federal, State, Tribal, and local governments, regional planning organizations, nonprofit organizations, or private sector parties for implementation of the management plan.</text> </subparagraph></paragraph><paragraph id="HAF9BF1F4DAEF4215A98FECA3CAF18DB6"><enum>(4)</enum><header>Disapproval</header> <subparagraph id="HD5ED6FE497BE49C499B9AA5C6C614805"><enum>(A)</enum><header>In general</header><text>If the Secretary disapproves the management plan, the Secretary—</text> <clause id="HBE97CC6E412D46EF93C24BF2ED2D3DD9"><enum>(i)</enum><text>shall advise the local coordinating entity in writing of the reasons for the disapproval; and</text> </clause><clause id="H00DC23C7411747F6A392E97FBF5DF401"><enum>(ii)</enum><text>may make recommendations to the local coordinating entity for revisions to the management plan.</text> </clause></subparagraph><subparagraph id="H5F3D6F1DE1344B83833B6286C7CCB657"><enum>(B)</enum><header>Deadline</header><text>Not later than 180 days after receiving a revised management plan, the Secretary shall approve or disapprove the revised management plan.</text> </subparagraph></paragraph><paragraph id="HF058845F2AF643FCA61FD8223D938942"><enum>(5)</enum><header>Amendments</header> <subparagraph id="HECBBF04EE5174F2C8440C18B167FC400"><enum>(A)</enum><header>In general</header><text>An amendment to the management plan that substantially alters the purposes of the National Heritage Area shall be reviewed by the Secretary and approved or disapproved in the same manner as the original management plan.</text> </subparagraph><subparagraph id="H5553E8FEB5A94AED91F601EE9301AC02"><enum>(B)</enum><header>Implementation</header><text>The local coordinating entity shall not use Federal funds authorized by this subtitle to implement an amendment to the management plan until the Secretary approves the amendment.</text> </subparagraph></paragraph><paragraph id="HAB5A9E9FA93A40F8A0EDDA66EA34BE4"><enum>(6)</enum><header>Authorities</header><text display-inline="yes-display-inline">The Secretary may—</text> <subparagraph id="HD944B05825B44DBAB565AF20A3BAE2C"><enum>(A)</enum><text>provide technical assistance under the authority of this subtitle for the development and implementation of the management plan; and</text> </subparagraph><subparagraph id="H3E50929F85234F05A8AB4D819DD56427"><enum>(B)</enum><text>enter into cooperative agreements with interested parties to carry out this subtitle.</text> </subparagraph></paragraph></subsection></section><section id="H8BB58ADD280244EDAA5B6B9812ADF019"><enum>2006.</enum><header>Evaluation; report</header> <subsection id="H0BAD5136F773473BB20592F22BA3457F"><enum>(a)</enum><header>In general</header><text>Not later than 3 years before the date on which authority for Federal funding terminates for the National Heritage Area under this subtitle, the Secretary shall—</text> <paragraph id="HBB9DB5B0EEF1474E9EB588097E662660"><enum>(1)</enum><text>conduct an evaluation of the accomplishments of the National Heritage Area; and</text> </paragraph><paragraph id="H41A06F805B244974B0DE55B1109D72D2"><enum>(2)</enum><text>prepare a report in accordance with subsection (c).</text> </paragraph></subsection><subsection id="H3E77DD0F53DA402AA197FE5697EE8993"><enum>(b)</enum><header>Evaluation</header><text>An evaluation conducted under subsection (a)(1) shall—</text> <paragraph id="H30332DD1EFB140068D1BD43851C7492"><enum>(1)</enum><text>assess the progress of the local coordinating entity with respect to—</text> <subparagraph id="H910FA408F73C4EAB8C069895B8E82BBB"><enum>(A)</enum><text>accomplishing the purposes of the authorizing legislation for the National Heritage Area; and</text> </subparagraph><subparagraph id="H06AAB0F2E65449928F4E6884AAC3CFC"><enum>(B)</enum><text>achieving the goals and objectives of the approved management plan for the National Heritage Area;</text> </subparagraph></paragraph><paragraph id="H72734E6E46EE406CA1534F147E16B98C"><enum>(2)</enum><text>analyze the Federal, State, Tribal, local, and private investments in the National Heritage Area to determine the impact of the investments; and</text> </paragraph><paragraph id="H6ADECC9237CC419EBEF8F2E9758C2BBB"><enum>(3)</enum><text>review the management structure, partnership relationships, and funding of the National Heritage Area for purposes of identifying the critical components for sustainability of the National Heritage Area.</text> </paragraph></subsection><subsection id="H340E660E74DD4DDDAD30123F45EAB30"><enum>(c)</enum><header>Report</header><text>Based on the evaluation conducted under subsection (a)(1), the Secretary shall submit a report to the Committee on Natural Resources of the United States House of Representatives and the Committee on Energy and Natural Resources of the United States Senate. The report shall include recommendations for the future role of the National Park Service, if any, with respect to the National Heritage Area.</text> </subsection></section><section id="H42E4FCD10A5945CF836E3D2CBF29D10"><enum>2007.</enum><header>Local coordinating entity</header> <subsection id="H7449BBDA4D404828B49F3400785CCDEC"><enum>(a)</enum><header>Duties</header><text>To further the purposes of the National Heritage Area, the Journey Through Hallowed Ground Partnership, as the local coordinating entity, shall—</text> <paragraph id="H01D376F02EF643C6BA548449AFE57D5B"><enum>(1)</enum><text>prepare a management plan for the National Heritage Area, and submit the management plan to the Secretary, in accordance with this subtitle;</text> </paragraph><paragraph id="H45819C89DE334474A45380AA84440013"><enum>(2)</enum><text>submit an annual report to the Secretary for each fiscal year for which the local coordinating entity receives Federal funds under this subtitle, specifying—</text> <subparagraph id="H2839D8A6ABC54948B10990F620D09876"><enum>(A)</enum><text>the specific performance goals and accomplishments of the local coordinating entity;</text> </subparagraph><subparagraph id="H067FF0E11C834937B77402612EFC316F"><enum>(B)</enum><text>the expenses and income of the local coordinating entity;</text> </subparagraph><subparagraph id="H140BDD903AC442589BB105E41689ADD6"><enum>(C)</enum><text>the amounts and sources of matching funds;</text> </subparagraph><subparagraph id="HFA75E930C8734D508164C52D90AF1213"><enum>(D)</enum><text>the amounts leveraged with Federal funds and sources of the leveraging; and</text> </subparagraph><subparagraph id="HEE5290654A0140AF97720015337EF021"><enum>(E)</enum><text>grants made to any other entities during the fiscal year;</text> </subparagraph></paragraph><paragraph id="HBB7C2EA73DF447B99025AC9724956376"><enum>(3)</enum><text>make available for audit for each fiscal year for which the local coordinating entity receives Federal funds under this subtitle, all information pertaining to the expenditure of the funds and any matching funds; and</text> </paragraph><paragraph id="H5EE3992733454619A034A8545272A1B0"><enum>(4)</enum><text>encourage economic viability and sustainability that is consistent with the purposes of the National Heritage Area.</text> </paragraph></subsection><subsection id="H29B658F4DB6A4CDB9D7DB32668C92F4"><enum>(b)</enum><header>Authorities</header><text>For the purposes of preparing and implementing the approved management plan for the National Heritage Area, the local coordinating entity may use Federal funds made available under this subtitle to—</text> <paragraph id="H57268F844AC241C083975082DDEF49F4"><enum>(1)</enum><text>make grants to political jurisdictions, nonprofit organizations, and other parties within the National Heritage Area;</text> </paragraph><paragraph id="HB98A90D5A17D45BF9FC8FB02E919032B"><enum>(2)</enum><text>enter into cooperative agreements with or provide technical assistance to political jurisdictions, nonprofit organizations, Federal agencies, and other interested parties;</text> </paragraph><paragraph id="H9E087F39D3AB4355B48746C6799DE6DE"><enum>(3)</enum><text>hire and compensate staff, including individuals with expertise in—</text> <subparagraph id="H590593A648EA42DD9CC05530A5B13B6"><enum>(A)</enum><text>natural, historical, cultural, educational, scenic, and recreational resource conservation;</text> </subparagraph><subparagraph id="H8A03175E35384D6DB4431E448E30CAE7"><enum>(B)</enum><text>economic and community development; and</text> </subparagraph><subparagraph id="HA58917759A0C48E4B3617F51CCBFE169"><enum>(C)</enum><text>heritage planning;</text> </subparagraph></paragraph><paragraph id="HA729656C4B78423D8E5525F0E3BF2F9B"><enum>(4)</enum><text>obtain funds or services from any source, including other Federal programs;</text> </paragraph><paragraph id="H755A956ACF384CB09B62776239A5DF3"><enum>(5)</enum><text>contract for goods or services; and</text> </paragraph><paragraph id="H584D3CC5ECA945B4B8C81900BB246000"><enum>(6)</enum><text>support activities of partners and any other activities that further the purposes of the National Heritage Area and are consistent with the approved management plan.</text> </paragraph></subsection><subsection id="H6A59C3B6619641AB8F4F736386D73E81"><enum>(c)</enum><header>Prohibition on acquisition of real property</header><text>The local coordinating entity may not use Federal funds authorized under this subtitle to acquire any interest in real property.</text> </subsection></section><section id="H8AEFD5ECC0CC42AD9BEA4D028BF54FE9"><enum>2008.</enum><header>Relationship to other Federal agencies</header> <subsection id="HD5BE769628924108BD6B1643EE00A7D1"><enum>(a)</enum><header>In general</header><text>Nothing in this subtitle affects the authority of a Federal agency to provide technical or financial assistance under any other law.</text> </subsection><subsection id="HA41379A834604688B506F983BF77EB4C"><enum>(b)</enum><header>Consultation and coordination</header><text>The head of any Federal agency planning to conduct activities that may have an impact on a National Heritage Area is encouraged to consult and coordinate the activities with the Secretary and the local coordinating entity to the maximum extent practicable.</text> </subsection><subsection id="H1FA8791FD29B4BBD8D0209ED2BE86FE6"><enum>(c)</enum><header>Other Federal agencies</header><text>Nothing in this subtitle—</text> <paragraph id="H41D35D1963F14A9D88EF09C7DB567181"><enum>(1)</enum><text>modifies, alters, or amends any law or regulation authorizing a Federal agency to manage Federal land under the jurisdiction of the Federal agency;</text> </paragraph><paragraph id="HF31AF0A9C61248878FED845143AD6566"><enum>(2)</enum><text>limits the discretion of a Federal land manager to implement an approved land use plan within the boundaries of a National Heritage Area; or</text> </paragraph><paragraph id="H3C5EAB7C565C472B85A6C9F5B03D50A3"><enum>(3)</enum><text>modifies, alters, or amends any authorized use of Federal land under the jurisdiction of a Federal agency.</text> </paragraph></subsection></section><section id="HFC6567272DF04E1BBF6B79FDA14E771D"><enum>2009.</enum><header>Private property and regulatory protections</header><text display-inline="no-display-inline">Nothing in this subtitle—</text> <paragraph id="H907F910F0AA640EF89294166EE7894FF"><enum>(1)</enum><text>abridges the rights of any property owner (whether public or private), including the right to refrain from participating in any plan, project, program, or activity conducted within the National Heritage Area;</text> </paragraph><paragraph id="H2EC60F8C4E56426AA1B84D0D7553E6C"><enum>(2)</enum><text>requires any property owner to permit public access (including access by Federal, State, Tribal, or local agencies) to the property of the property owner, or to modify public access or use of property of the property owner under any other Federal, State, Tribal, or local law;</text> </paragraph><paragraph id="H92CEE36DDABE4D63A7A770E49F84DD24"><enum>(3)</enum><text>alters any duly adopted land use regulation, approved land use plan, or other regulatory authority (such as the authority to make safety improvements or increase the capacity of existing roads or to construct new roads) of any Federal, State, Tribal, or local agency, or conveys any land use or other regulatory authority to any local coordinating entity, including but not necessarily limited to development and management of energy or water or water-related infrastructure;</text> </paragraph><paragraph id="HAC7806EC6BC443ACAFEFF772D8C5196"><enum>(4)</enum><text>authorizes or implies the reservation or appropriation of water or water rights;</text> </paragraph><paragraph id="H87A07C1874E34A8ABE6BA1ACB643C8B7"><enum>(5)</enum><text>diminishes the authority of the State to manage fish and wildlife, including the regulation of fishing and hunting within the National Heritage Area; or</text> </paragraph><paragraph id="H0CDF35DAD89E4325A4745EDE66188EAA"><enum>(6)</enum><text>creates any liability, or affects any liability under any other law, of any private property owner with respect to any person injured on the private property.</text> </paragraph></section><section id="HDC19855837D9479E96AF6CAA39DBAD5C"><enum>2010.</enum><header>Authorization of appropriations</header> <subsection id="H2F268BEF5D3045349F52BD50B4FFB3E"><enum>(a)</enum><header>Authorization of Appropriations</header><text>Subject to subsection (b), there are authorized to be appropriated to carry out this subtitle not more than $1,000,000 for any fiscal year. Funds so appropriated shall remain available until expended.</text> </subsection><subsection id="H5E1224954E0A4C46976410FE1F6694D1"><enum>(b)</enum><header>Limitation on Total Amounts Appropriated</header><text>Not more than $15,000,000 may be appropriated to carry out this subtitle.</text> </subsection><subsection id="HA6AAF5178D834A4384FF7CA24F85BEAE"><enum>(c)</enum><header>Cost-Sharing Requirement</header><text display-inline="yes-display-inline">The Federal share of the total cost of any activity under this subtitle shall be not more than 50 percent; the non-Federal contribution may be in the form of in-kind contributions of goods or services fairly valued.</text> </subsection></section><section id="H82E93DD764084AD0B0D412786E322EE0"><enum>2011.</enum><header>Use of Federal funds from other sources</header><text display-inline="no-display-inline">Nothing in this subtitle shall preclude the local coordinating entity from using Federal funds available under other laws for the purposes for which those funds were authorized.</text> </section><section id="HE83E944A421A4EC983B8168FF8AA1BA9"><enum>2012.</enum><header>Sunset for grants and other assistance</header><text display-inline="no-display-inline">The authority of the Secretary to provide financial assistance under this subtitle terminates on the date that is 15 years after the date of enactment of this subtitle.</text> </section></subtitle><subtitle id="H9557D710300F4195A673B46B00E58062"><enum>B</enum><header>Niagara Falls National Heritage Area</header> <section id="H0840A50989A047399329BADADFA2D306"><enum>2021.</enum><header>Short title; and</text> </paragraph><paragraph id="H0EDAF9B18435464DBCD269D1BC03C700"><enum>(7)</enum><text>to provide appropriate linkages among units of the National Park System within and surrounding the National Heritage Area, to protect, enhance, and interpret resources outside of park boundaries.</text> </paragraph></subsection></section><section id="H2FD1D7F2D6134A3196D51195628C9997"><enum>2023.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle—</text> <paragraph id="HEE08FB0BAA2A457100F203DDCA1EB078"><enum>(1)</enum><header>National heritage area</header><text>The term <term>National Heritage Area</term> means the Niagara Falls National Heritage Area established in this subtitle.</text> </paragraph><paragraph id="H236672DF9AA54A16848F67778895A8EA"><enum>(2)</enum><header>Local coordinating entity</header><text>The term <term>local coordinating entity</term> means the local coordinating entity for the National Heritage Area designated pursuant to this subtitle.</text> </paragraph><paragraph id="HFE8828D917734E6581EDAE588C19EC20"><enum>(3)</enum><header>Management plan</header><text>The term <term>management plan</term> means the plan prepared by the local coordinating entity for the National Heritage Area that specifies actions, policies, strategies, performance goals, and recommendations to meet the goals of the National Heritage Area, in accordance with this subtitle.</text> </paragraph><paragraph id="HBCB6932677A54EDDA0B3EE6091C2C5D6"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text> </paragraph><paragraph id="H37494FF5090A484898CD9B001FB99185"><enum>(5)</enum><header>Commission</header><text>The term <term>Commission</term> means the Niagara Falls National Heritage Area Commission established under this subtitle.</text> </paragraph><paragraph id="H102E2DCEDE434C39B5C0A0D8572E1C53"><enum>(6)</enum><header>Governor</header><text>The term <term>Governor</term> means the Governor of the State of New York.</text> </paragraph></section><section id="HB11DE519621240F9A93F4C7F4500BA06"><enum>2024.</enum><header>Designation of the Niagara Falls National Heritage Area</header> <subsection id="H4D489697B4CC462993E380AFD29CAEA0"><enum>(a)</enum><header>Establishment</header><text>There is hereby established the Niagara Falls National Heritage Area.</text> </subsection><subsection id="H7D6EAAB8B4DE4942B5E66C48F81B8B2C"><enum>(b)</enum><header>Boundaries</header> <paragraph id="H24426F68C5BB4EC09899A824C62D73E1"><enum>(1)</enum><header>In general</header><text>The National Heritage Area shall consist of the area from the western boundary of the town of Wheatfield, New York, extending to the mouth of the Niagara River on Lake Ontario, including the city of Niagara Falls, New York, the villages of Youngstown and Lewiston, New York, land and water within the boundaries of the Heritage Area in Niagara County, New York, and any additional thematically related sites within Erie and Niagara Counties, New York, that are identified in the management plan developed under this subtitle.</text> </paragraph><paragraph id="H74398EAE9EAF4EC2B020FB45B65B6D2C"><enum>(2)</enum><header>Map</header><text>The boundaries of the National Heritage Area shall be as generally depicted on the map titled <quote>Niagara Falls National Heritage Area,</quote> and numbered P76/80,000 and dated July, 2006. The map shall be on file and available to the public in the appropriate offices of the National Park Service and the local coordinating entity.</text> </paragraph></subsection></section><section id="H4320C03ECAF84018969FA4B841D4FB1C"><enum>2025.</enum><header>Management plan</header> <subsection id="H65E1F10B5D124CEC81EFE9688100FED1"><enum>(a)</enum><header>Requirements</header><text>The management plan for the National Heritage Area shall—</text> <paragraph id="HC76DBB022CD64BEFA1D856929FAA1400"><enum>(1)</enum><text>describe comprehensive policies, goals, strategies, and recommendations for telling the story of the heritage of the area covered by the National Heritage Area and encouraging long-term resource protection, enhancement, interpretation, funding, management, and development of the National Heritage Area;</text> </paragraph><paragraph id="H5BE557CCE01247B99E83B1CB27637ED"><enum>(2)</enum><text>include a description of actions and commitments that Federal, State, Tribal, and local governments, private organizations, and citizens will take to protect, enhance, interpret, fund, manage, and develop the natural, historical, cultural, educational, scenic, and recreational resources of the National Heritage Area;</text> </paragraph><paragraph id="HE8920780AFDA4AD58E5DC70486CDB6E"><enum>(3)</enum><text>specify existing and potential sources of funding or economic development strategies to protect, enhance, interpret, fund, manage, and develop the National Heritage Area;</text> </paragraph><paragraph id="H3C4BD47990164B95948FF84BAB51CF31"><enum>(4)</enum><text>include an inventory of the natural, historical, cultural, educational, scenic, and recreational resources of the National Heritage Area related to the national importance and themes of the National Heritage Area that should be protected, enhanced, interpreted, managed, funded, and developed;</text> </paragraph><paragraph id="H6A078B7E6AAB4621BA2B0030FAFB4252"><enum>(5)</enum><text>recommend policies and strategies for resource management, including the development of intergovernmental and interagency agreements to protect, enhance, interpret, fund, manage, and develop the natural, historical, cultural, educational, scenic, and recreational resources of the National Heritage Area;</text> </paragraph><paragraph id="H9D1A633FC1584C3ABB008714438F851C"><enum>(6)</enum><text>describe a program for implementation for the management plan, including—</text> <subparagraph id="H7F35165B61374FE8BEC6D392D3D72DE"><enum>(A)</enum><text>performance goals;</text> </subparagraph><subparagraph id="HF67B3744AB2B4006B694806248E3E363"><enum>(B)</enum><text>plans for resource protection, enhancement, interpretation, funding, management, and development; and</text> </subparagraph><subparagraph id="H5B95C1FB34B54C0881AF83238EB2B01C"><enum>(C)</enum><text>specific commitments for implementation that have been made by the local coordinating entity or any Federal, State, Tribal, or local government agency, organization, business, or individual;</text> </subparagraph></paragraph><paragraph id="H1B58FC8AF2E74FB093CC79E5FD124007"><enum>(7)</enum><text>include an analysis of, and recommendations for, means by which Federal, State, Tribal, and local programs may best be coordinated (including the role of the National Park Service and other Federal agencies associated with the National Heritage Area) to further the purposes of this subtitle; and</text> </paragraph><paragraph id="HE350252B3DBE4A2D9C5EB84726002505"><enum>(8)</enum><text>include a business plan that—</text> <subparagraph id="HEFB5AF6ECFBB4FC200002110067DBAD7"><enum>(A)</enum><text>describes the role, operation, financing, and functions of the local coordinating entity and of each of the major activities contained in the management plan; and</text> </subparagraph><subparagraph id="HE648ACC7C646401F897C69A43012ECC4"><enum>(B)</enum><text>provides adequate assurances that the local coordinating entity has the partnerships and financial and other resources necessary to implement the management plan for the National Heritage Area.</text> </subparagraph></paragraph></subsection><subsection id="H48A0E0DFD0D14C989CBE333153E5CD2C"><enum>(b)</enum><header>Deadline</header> <paragraph id="H2C4A2D96EDBE47F58390464400D383B3"><enum>(1)</enum><header>In general</header><text>Not later than 3 years after the date on which funds are first made available to develop the management plan after designation as a National Heritage Area, the local coordinating entity shall submit the management plan to the Secretary for approval.</text> </paragraph><paragraph id="H377D4BA456BC4EDBAAEDFD3C1267025B"><enum>(2)</enum><header>Termination of funding</header><text>If the management plan is not submitted to the Secretary in accordance with paragraph (1), the local coordinating entity shall not qualify for any additional financial assistance under this subtitle until such time as the management plan is submitted to and approved by the Secretary.</text> </paragraph></subsection><subsection id="HF15A0D53267C403C86B6E61227920023"><enum>(c)</enum><header>Approval of management plan</header> <paragraph id="HFF4510F7930A44F39DCDFD383BF1ABA7"><enum>(1)</enum><header>Review</header><text>Not later than 180 days after receiving the plan, the Secretary shall review and approve or disapprove the management plan for a National Heritage Area on the basis of the criteria established under paragraph (3).</text> </paragraph><paragraph id="H5364A87E8DBD4B8BA4DF183DCD44E7D7"><enum>(2)</enum><header>Consultation</header><text>The Secretary shall consult with the Governor before approving a management plan for the National Heritage Area.</text> </paragraph><paragraph id="H2DB68823800D4D5DB6EC0076CD9F01BC"><enum>(3)</enum><header>Criteria for approval</header><text>In determining whether to approve a management plan for a National Heritage Area, the Secretary shall consider whether—</text> <subparagraph id="H6890342361FF4963938EF0D6E555E838"><enum>(A)</enum><text>the local coordinating entity represents the diverse interests of the National Heritage Area, including Federal, State, Tribal, and local governments, natural and historic resource protection organizations, educational institutions, businesses, recreational organizations, community residents, and private property owners;</text> </subparagraph><subparagraph id="H6119C2402196431CBD7951FBDDFFAC86"><enum>(B)</enum><text>the local coordinating entity—</text> <clause id="HD2B13549029B4F3392F038EFC5ACFA2E"><enum>(i)</enum><text>has afforded adequate opportunity for public and Federal, State, Tribal, and local governmental involvement (including through workshops and hearings) in the preparation of the management plan; and</text> </clause><clause id="H7CE772F68B6946D5B04E0138CD00C816"><enum>(ii)</enum><text>provides for at least semiannual public meetings to ensure adequate implementation of the management plan;</text> </clause></subparagraph><subparagraph id="HE7A43AB47F6140BEB8417B86D2611FB"><enum>(C)</enum><text>the resource protection, enhancement, interpretation, funding, management, and development strategies described in the management plan, if implemented, would adequately protect, enhance, interpret, fund, manage, and develop the natural, historic, cultural, educational, scenic, and recreational resources of the National Heritage Area;</text> </subparagraph><subparagraph id="H9C6662F4228D4D7A8257BF7CEEF8133B"><enum>(D)</enum><text>the management plan would not adversely affect any activities authorized on Federal land under public land laws or land use plans;</text> </subparagraph><subparagraph id="H5094E3147D424B20AB41966937A7A416"><enum>(E)</enum><text>the local coordinating entity has demonstrated the financial capability, in partnership with others, to carry out the plan;</text> </subparagraph><subparagraph id="H13FD83F394A94361B8B1B50298BC7CE"><enum>(F)</enum><text>the Secretary has received adequate assurances from the appropriate State, Tribal, and local officials whose support is needed to ensure the effective implementation of the State, Tribal, and local elements of the management plan; and</text> </subparagraph><subparagraph id="H938A1F4334EF43E2A8B122DF8D857700"><enum>(G)</enum><text>the management plan demonstrates partnerships among the local coordinating entity, Federal, State, Tribal, and local governments, regional planning organizations, nonprofit organizations, or private sector parties for implementation of the management plan.</text> </subparagraph></paragraph><paragraph id="H4D0AA81B9F634BDB9877696BE0C8A369"><enum>(4)</enum><header>Disapproval</header> <subparagraph id="H7FBBA02F817C4671B0E82D6900C5A86D"><enum>(A)</enum><header>In general</header><text>If the Secretary disapproves the management plan, the Secretary—</text> <clause id="H6E78A6E2F03744A9BAED72F316B9AFB7"><enum>(i)</enum><text>shall advise the local coordinating entity in writing of the reasons for the disapproval; and</text> </clause><clause id="H1A4F0C6FAD2C4EBC8CA0E07E82CD2812"><enum>(ii)</enum><text>may make recommendations to the local coordinating entity for revisions to the management plan.</text> </clause></subparagraph><subparagraph id="HC5338D769A7E490CAE00D84F16CA8100"><enum>(B)</enum><header>Deadline</header><text>Not later than 180 days after receiving a revised management plan, the Secretary shall approve or disapprove the revised management plan.</text> </subparagraph></paragraph><paragraph id="HB965522A36E64B6492E82DEB2D3DA8F6"><enum>(5)</enum><header>Amendments</header> <subparagraph id="H787F119C870646EFAF48D109D4D284D1"><enum>(A)</enum><header>In general</header><text>An amendment to the management plan that substantially alters the purposes of the National Heritage Area shall be reviewed by the Secretary and approved or disapproved in the same manner as the original management plan.</text> </subparagraph><subparagraph id="HD57B51D387BB4E5FBB81D3A004D8F7AF"><enum>(B)</enum><header>Implementation</header><text>The local coordinating entity shall not use Federal funds authorized by this subtitle to implement an amendment to the management plan until the Secretary approves the amendment.</text> </subparagraph></paragraph><paragraph id="HF5AF7BAF26624439943E666E336D5D50"><enum>(6)</enum><header>Authorities</header><text display-inline="yes-display-inline">The Secretary may—</text> <subparagraph id="H0A4C364EEF204C2895756644A8CDE942"><enum>(A)</enum><text>provide technical assistance under the authority of this subtitle for the development and implementation of the management plan; and</text> </subparagraph><subparagraph id="H14490368DDD44E718E5609CE8F9BA0"><enum>(B)</enum><text>enter into cooperative agreements with interested parties to carry out this subtitle.</text> </subparagraph></paragraph></subsection></section><section id="HC4B06F38B0294E9299D9D182BA563C5D"><enum>2026.</enum><header>Evaluation; report</header> <subsection id="H747D8D2D3CDA467CA43F765EA80388F5"><enum>(a)</enum><header>In general</header><text>Not later than 3 years before the date on which authority for Federal funding terminates for the National Heritage Area under this subtitle the Secretary shall—</text> <paragraph id="H25C8A7BD2DD14F0CB337D21058E2A0E0"><enum>(1)</enum><text>conduct an evaluation of the accomplishments of the National Heritage Area; and</text> </paragraph><paragraph id="H2C5B9F3988024CA7BA3C00347FCE3838"><enum>(2)</enum><text>prepare a report in accordance with subsection (c).</text> </paragraph></subsection><subsection id="H102728927C5F42CE0077828788904149"><enum>(b)</enum><header>Evaluation</header><text>An evaluation conducted under subsection (a)(1) shall—</text> <paragraph id="H1616946DF8564A2C8CFD83E6E7EF8300"><enum>(1)</enum><text>assess the progress of the local coordinating entity with respect to—</text> <subparagraph id="H01B4F6B35B3E409F9368E971E57100B1"><enum>(A)</enum><text>accomplishing the purposes of the authorizing legislation for the National Heritage Area; and</text> </subparagraph><subparagraph id="H05E295A8407345EA9D9E80ED43BE6867"><enum>(B)</enum><text>achieving the goals and objectives of the approved management plan for the National Heritage Area;</text> </subparagraph></paragraph><paragraph id="HE956A2737A234061A7FE216B69EADDC"><enum>(2)</enum><text>analyze the Federal, State, Tribal, and local, and private investments in the National Heritage Area to determine the impact of the investments; and</text> </paragraph><paragraph id="HAEA9D5990E644C35BD7128E52BB2CB03"><enum>(3)</enum><text>review the management structure, partnership relationships, and funding of the National Heritage Area for purposes of identifying the critical components for sustainability of the National Heritage Area.</text> </paragraph></subsection><subsection id="H930180338B2C4DAC8CEBF844EFCA409F"><enum>(c)</enum><header>Report</header><text>Based on the evaluation conducted under subsection (a)(1), the Secretary shall submit a report to the Committee on Natural Resources of the United States House of Representatives and the Committee on Energy and Natural Resources of the United States Senate. The report shall include recommendations for the future role of the National Park Service, if any, with respect to the National Heritage Area.</text> </subsection></section><section id="HA9C6F8D0A960480E8223DAE31443FDB1"><enum>2027.</enum><header>Local coordinating entity</header> <subsection id="HD41665378800499CBFF100ADCEBDD91"><enum>(a)</enum><header>Designation</header><text>The local coordinating entity for the Heritage Area shall be—</text> <paragraph id="H943E878D55E0413E816711B392F74F8B"><enum>(1)</enum><text>for the 5-year period beginning on the date of enactment of this subtitle, the Commission; and</text> </paragraph><paragraph id="H78A2F5C64EE74941ADA43F80726066D9"><enum>(2)</enum><text>on expiration of the 5-year period described in subparagraph (1), a private nonprofit or governmental organization designated by the Commission.</text> </paragraph></subsection><subsection id="H416124B9E11D40479EC32BD8897715DE"><enum>(b)</enum><header>Duties</header><text>To further the purposes of the National Heritage Area, the local coordinating entity, shall—</text> <paragraph id="HC70EE926DC3C43EBBC847D26AD295311"><enum>(1)</enum><text>prepare a management plan for the National Heritage Area, and submit the management plan to the Secretary, in accordance with this subtitle;</text> </paragraph><paragraph id="HE1625554870B457D92F9783E964796E5"><enum>(2)</enum><text>submit an annual report to the Secretary for each fiscal year for which the local coordinating entity receives Federal funds under this subtitle, specifying—</text> <subparagraph id="H3C8CD5522A6F4398ACC09D02DA6DF2BD"><enum>(A)</enum><text>the specific performance goals and accomplishments of the local coordinating entity;</text> </subparagraph><subparagraph id="HA3970F7C9184423D9C764F8582828D71"><enum>(B)</enum><text>the expenses and income of the local coordinating entity;</text> </subparagraph><subparagraph id="H93FAABFD22BB4D4D9555D4C764E047D5"><enum>(C)</enum><text>the amounts and sources of matching funds;</text> </subparagraph><subparagraph id="HB25A27CCFB784D66B2A3005EC88F02AC"><enum>(D)</enum><text>the amounts leveraged with Federal funds and sources of the leveraging; and</text> </subparagraph><subparagraph id="HDB9241C7CC864CF688CE2695489EBD83"><enum>(E)</enum><text>grants made to any other entities during the fiscal year;</text> </subparagraph></paragraph><paragraph id="HDD182E32DC8A4EB3B0C4D02153319947"><enum>(3)</enum><text>make available for audit for each fiscal year for which the local coordinating entity receives Federal funds under this subtitle, all information pertaining to the expenditure of the funds and any matching funds;</text> </paragraph><paragraph id="H35E85179B31849AFA72000DAE81F1E"><enum>(4)</enum><text>encourage economic viability and sustainability that is consistent with the purposes of the National Heritage Area; and</text> </paragraph><paragraph id="HAD7A8E783AFB437AA14D01B4896647E0"><enum>(5)</enum><text>coordinate projects, activities, and programs with the Erie Canalway National Heritage Corridor.</text> </paragraph></subsection><subsection id="HA9C2E230DDD945389EE15B2E9E6216AC"><enum>(c)</enum><header>Authorities</header><text>For the purposes of preparing and implementing the approved management plan for the National Heritage Area, the local coordinating entity may use Federal funds made available under this subtitle to—</text> <paragraph id="H285D6FB08FF34F9289BED389A3003971"><enum>(1)</enum><text>make grants to political jurisdictions, nonprofit organizations, and other parties within the National Heritage Area;</text> </paragraph><paragraph id="H8B389BD59DDD4393A27470A759B9AC96"><enum>(2)</enum><text>enter into cooperative agreements with or provide technical assistance to political jurisdictions, nonprofit organizations, Federal agencies, and other interested parties;</text> </paragraph><paragraph id="H7D5266D0204B4316BFED6131066277FE"><enum>(3)</enum><text>hire and compensate staff, including individuals with expertise in—</text> <subparagraph id="H366CF1C9F1134EBABAC6E9F5B7A83930"><enum>(A)</enum><text>natural, historical, cultural, educational, scenic, and recreational resource conservation;</text> </subparagraph><subparagraph id="H588AAE17EC35444E8D9884FCB148B46"><enum>(B)</enum><text>economic and community development; and</text> </subparagraph><subparagraph id="H838ED17F61E04B3E93C999EF2664FA15"><enum>(C)</enum><text>heritage planning;</text> </subparagraph></paragraph><paragraph id="H0346BACA29E047D5B66305273D76C008"><enum>(4)</enum><text>obtain funds or services from any source, including other Federal programs;</text> </paragraph><paragraph id="H3D3302C50E82494AA9DD67BB6C809BF"><enum>(5)</enum><text>contract for goods or services; and</text> </paragraph><paragraph id="HFAD9CF078E0C43A5B4ABD9C3C3475132"><enum>(6)</enum><text>support activities of partners and any other activities that further the purposes of the National Heritage Area and are consistent with the approved management plan.</text> </paragraph></subsection><subsection id="H1480A87499C54E328B7743A3FF003386"><enum>(d)</enum><header>Prohibition on acquisition of real property</header><text>The local coordinating entity may not use Federal funds authorized under this subtitle to acquire any interest in real property.</text> </subsection></section><section id="H91C43DF6A2E1421F9D57503CD093A3B3"><enum>2028.</enum><header>Niagara Falls Heritage Area Commission</header> <subsection id="H0E4F16C42BEA428A965C7671A9DC508E"><enum>(a)</enum><header>Establishment</header><text>There is established within the Department of the Interior the Niagara Falls National Heritage Area Commission.</text> </subsection><subsection id="HB122421757404C12936362A276F453FE"><enum>(b)</enum><header>Membership</header><text>The Commission shall be composed of 17 members, of whom—</text> <paragraph id="HB3C5D7F7C461470AA0F34236E96313D"><enum>(1)</enum><text>1 member shall be the Director of the National Park Service (or a designee);</text> </paragraph><paragraph id="HB4E6C5F1F1FD46C2AC40CA8414142CAD"><enum>(2)</enum><text>5 members shall be appointed by the Secretary, after consideration of the recommendation of the Governor, from among individuals with knowledge and experience of—</text> <subparagraph id="H3AD1D4E91D5D49BA891C58BF49D8D08"><enum>(A)</enum><text>the New York State Office of Parks, Recreation and Historic Preservation, the Niagara River Greenway Commission, the New York Power Authority, the USA Niagara Development Corporation, and the Niagara Tourism and Convention Corporation; or</text> </subparagraph><subparagraph id="H904CC17CA98C41E6B100D7E6CA82C0DA"><enum>(B)</enum><text>any successors of the agencies described in subparagraph (A);</text> </subparagraph></paragraph><paragraph id="HB83B4329875B4D5794DA6E1340D0A02F"><enum>(3)</enum><text>1 member shall be appointed by the Secretary, after consideration of the recommendation of the mayor of Niagara Falls, New York;</text> </paragraph><paragraph id="H25F14AF48A924AA7A6F072842BACE48B"><enum>(4)</enum><text>1 member shall be appointed by the Secretary, after consideration of the recommendation of the mayor of the village of Youngstown, New York;</text> </paragraph><paragraph id="HC5359BF3F9CB4DD8BDE7B512E34C6ED6"><enum>(5)</enum><text>1 member shall be appointed by the Secretary, after consideration of the recommendation of the mayor of the village of Lewiston, New York;</text> </paragraph><paragraph id="H6D808361EFBA41F89F3000593D19C69B"><enum>(6)</enum><text>1 member shall be appointed by the Secretary, after consideration of the recommendation of the Tuscarora Nation;</text> </paragraph><paragraph id="H4AD976CBE4714104006E89D4CDB494E3"><enum>(7)</enum><text>1 member shall be appointed by the Secretary, after consideration of the recommendation of the Seneca Nation of Indians; and</text> </paragraph><paragraph id="HC6993FA2E87D455C84CED434387D99B4"><enum>(8)</enum><text>6 members shall be individuals who have an interest in, support for, and expertise appropriate to tourism, regional planning, history and historic preservation, cultural or natural resource management, conservation, recreation, and education, or museum services, of whom—</text> <subparagraph id="H9EC1D9C0825640159DB7D13BFF5762D1"><enum>(A)</enum><text>4 members shall be appointed by the Secretary, after consideration of the recommendation of the 2 members of the Senate from the State; and</text> </subparagraph><subparagraph id="H6E942B1E5305475DBCBBDBF22EFCB5D1"><enum>(B)</enum><text>2 members shall be appointed by the Secretary, after consideration of the recommendation of the Member of the House of Representatives whose district encompasses the National Heritage Area.</text> </subparagraph></paragraph></subsection><subsection id="H3FC6348EFD9B487EAB95A9EF2000D369"><enum>(c)</enum><header>Terms; Vacancies</header> <paragraph id="HDF13B2588F904C4B9800D379F68E94A6"><enum>(1)</enum><header>Term</header><text>A member of the Commission shall be appointed for a term not to exceed 5 years.</text> </paragraph><paragraph id="HAEB293D7B494466582723E9991C4C47B"><enum>(2)</enum><header>Vacancies</header> <subparagraph id="H5C1018A67D1E4554BF1622393EB2E8FC"><enum>(A)</enum><header>Partial term</header><text>A member appointed to fill a vacancy on the Commission shall serve for the remainder of the term for which the predecessor of the member was appointed.</text> </subparagraph><subparagraph id="H2680598F2205428B8100AA5FF151E8D8"><enum>(B)</enum><header>In general</header><text>A vacancy on the Commission shall be filled in the same manner as the original appointment was made.</text> </subparagraph></paragraph></subsection><subsection id="HB9E0DBC822194655B038F9527E98CD4D"><enum>(d)</enum><header>Chairperson and Vice Chairperson</header> <paragraph id="H0067CB27DA4046CABBF68F62E45484FE"><enum>(1)</enum><header>Selection</header><text>The Commission shall select a Chairperson and Vice Chairperson from among the members of the Commission.</text> </paragraph><paragraph id="H3BAA8E1632AA48FB87C824ED6DF6131C"><enum>(2)</enum><header>Vice chairperson</header><text>The Vice Chairperson shall serve as the Chairperson in the absence of the Chairperson.</text> </paragraph></subsection><subsection id="H9A346FDBD5BD4A27BF997F5E00278658"><enum>(e)</enum><header>Quorum</header> <paragraph id="H2DB0901D6D7C4D83B1771720FA19ED84"><enum>(1)</enum><header>In general</header><text>A majority of the members of the Commission shall constitute a quorum.</text> </paragraph><paragraph id="HCEAE8272DA9848B491D731007779CEEB"><enum>(2)</enum><header>Transaction</header><text>For the transaction of any business or the exercise of any power of the Commission, the Commission shall have the power to act by a majority vote of the members present at any meeting at which a quorum is in attendance.</text> </paragraph></subsection><subsection id="HECBB29F4EC7E498FA7DCFA669534093E"><enum>(f)</enum><header>Meetings</header> <paragraph id="H44259414917243A192555084478DCDFB"><enum>(1)</enum><header>In general</header><text>The Commission shall meet at least quarterly at the call of—</text> <subparagraph id="H27DEF70906F3494EAA65E0AED3B3F057"><enum>(A)</enum><text>the Chairperson; or</text> </subparagraph><subparagraph id="H822CA8DDA7E64D2785B05505001EF333"><enum>(B)</enum><text>a majority of the members of the Commission.</text> </subparagraph></paragraph><paragraph id="H970C6415E7D8472CA38100DD62E7853D"><enum>(2)</enum><header>Notice</header><text>Notice of Commission meetings and agendas for the meetings shall be published in local newspapers that are distributed throughout the National Heritage Area.</text> </paragraph><paragraph id="H646E1E4DC5FD4F4CB8D3FFE0472DAC3C"><enum>(3)</enum><header>Applicable law</header><text>Meetings of the Commission shall be subject to section 552b of title 5, United States Code.</text> </paragraph></subsection><subsection id="H8FFDF650F4B14CB3BFBE31C919F704E"><enum>(g)</enum><header>Authorities of the Commission</header><text>In addition to the authorities otherwise granted in this subtitle, the Commission may—</text> <paragraph id="HB27453DF56B34754A7ACB0CB6FD3079F"><enum>(1)</enum><text>request and accept from the head of any Federal agency, on a reimbursable or non-reimbursable basis, any personnel of the Federal agency to the Commission to assist in carrying out the duties of the Commission;</text> </paragraph><paragraph id="H03F7FBCBD3234D6DBD88D86CF337E015"><enum>(2)</enum><text>request and accept from the head of any State agency or any agency of a political subdivision of the State, on a reimbursable or nonreimbursable basis, any personnel of the agency to the Commission to assist in carrying out the duties of the Commission;</text> </paragraph><paragraph id="HC2AA6FEABDF04B5F94DA7D46A2BB294"><enum>(3)</enum><text>seek, accept, and dispose of gifts, bequests, grants, or donations of money, personal property, or services; and</text> </paragraph><paragraph id="H5CAF3129CBBD4835824776B909A6DF5E"><enum>(4)</enum><text>use the United States mails in the same manner as other agencies of the Federal Government.</text> </paragraph></subsection><subsection id="HEC7434EEB4B74B819D08FB761BE1B31B"><enum>(h)</enum><header>Duties of the Commission</header><text>To further the purposes of the National Heritage Area, in addition to the duties otherwise listed in this subtitle, the Commission shall assist in the transition of the management of the National Heritage Area from the Commission to the local coordinating entity designated under this subtitle.</text> </subsection><subsection id="H9D12462D77BD4BD1BEBF37EA22C2D800"><enum>(i)</enum><header>Compensation of Members</header> <paragraph id="HB846ACFE013448768201C6CF3341DFD2"><enum>(1)</enum><header>In general</header><text>A member of the Commission shall serve without compensation.</text> </paragraph><paragraph id="H7666F7A10B88459BA6002807159DD596"><enum>(2)</enum><header>Travel expenses</header><text>A member of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for an employee of an agency under subchapter I of chapter 57 of title 5, United States Code, while away from the home or regular place of business of the member in the performance of the duties of the Commission.</text> </paragraph></subsection><subsection id="HDC0F4AC2F01848AABDA4F15D98B3B8BB"><enum>(j)</enum><header>Gifts</header><text>For purposes of section 170(c) of the Internal Revenue Code of 1986, any gift or charitable contribution to the Commission shall be considered to be a charitable contribution or gift to the United States.</text> </subsection><subsection id="H356CDA34E2CF4C86BDEB97725FE61054"><enum>(k)</enum><header>Use of Federal Funds</header><text>Except as provided for the leasing of administrative facilities under subsection (g)(1), the Commission may not use Federal funds made available to the Commission under this subtitle to acquire any real property or interest in real property.</text> </subsection></section><section id="HF63D2B9EC57F4F1B80D94911A3EA28D6"><enum>2029.</enum><header>Relationship to other Federal agencies</header> <subsection id="H1368063BB9A44371A8182E7FDB26B726"><enum>(a)</enum><header>In general</header><text>Nothing in this subtitle affects the authority of a Federal agency to provide technical or financial assistance under any other law.</text> </subsection><subsection id="H34A261F142BF47A8BAD0D4A207CD14E"><enum>(b)</enum><header>Consultation and coordination</header><text>The head of any Federal agency planning to conduct activities that may have an impact on a National Heritage Area is encouraged to consult and coordinate the activities with the Secretary and the local coordinating entity to the maximum extent practicable.</text> </subsection><subsection id="HBAB2AFBC21194BC8B9DC0087AA6A29F"><enum>(c)</enum><header>Other Federal agencies</header><text>Nothing in this subtitle—</text> <paragraph id="HE0EFEF4BB5824CDCA0A7B62B180183C6"><enum>(1)</enum><text>modifies, alters, or amends any law or regulation authorizing a Federal agency to manage Federal land under the jurisdiction of the Federal agency;</text> </paragraph><paragraph id="H5CB1D198A3CE4A8C8D2C976D878CDB49"><enum>(2)</enum><text>limits the discretion of a Federal land manager to implement an approved land use plan within the boundaries of a National Heritage Area; or</text> </paragraph><paragraph id="H3FA7008EB49D47E7BFDE86F6A364BEA"><enum>(3)</enum><text>modifies, alters, or amends any authorized use of Federal land under the jurisdiction of a Federal agency.</text> </paragraph></subsection></section><section id="H7A938B37D3DE4BBA84D0F01ED2968CDF"><enum>2030.</enum><header>Private property and regulatory protections</header><text display-inline="no-display-inline">Nothing in this subtitle—</text> <paragraph id="H35714EBDDDBF4DD7A7ABC3D5DBB3CBE6"><enum>(1)</enum><text>abridges the rights of any property owner (whether public or private), including the right to refrain from participating in any plan, project, program, or activity conducted within the National Heritage Area;</text> </paragraph><paragraph id="H1B4A2B6E29834C2484E8E114D612E509"><enum>(2)</enum><text>requires any property owner to permit public access (including access by Federal, State, Tribal, or local agencies) to the property of the property owner, or to modify public access or use of property of the property owner under any other Federal, State, Tribal, or local law;</text> </paragraph><paragraph id="H031451D066F14FDAA96F1F3752730966"><enum>(3)</enum><text display-inline="yes-display-inline">alters any duly adopted land use regulation, approved land use plan, or other regulatory authority of any Federal, State, Tribal, or local agency, or conveys any land use or other regulatory authority to any local coordinating entity, including but not necessarily limited to development and management of energy, water, or water-related infrastructure;</text> </paragraph><paragraph id="HBE795F2BEA1847EEA052A46305549BC3"><enum>(4)</enum><text>authorizes or implies the reservation or appropriation of water or water rights;</text> </paragraph><paragraph id="H160B420F37F64BCE8ED6D1CBED081DA1"><enum>(5)</enum><text>diminishes the authority of the State to manage fish and wildlife, including the regulation of fishing and hunting within the National Heritage Area; or</text> </paragraph><paragraph id="HA3E64F78B87B48EAA0DEC7D2489F3096"><enum>(6)</enum><text>creates any liability, or affects any liability under any other law, of any private property owner with respect to any person injured on the private property.</text> </paragraph></section><section id="HB5DB54DB4DAD42E88CFD294111D3E106"><enum>2031.</enum><header>Authorization of appropriations</header> <subsection id="HC96C0A680F584C76A8E5A0706C97BA42"><enum>(a)</enum><header>Authorization of Appropriations</header><text>Subject to subsection (b), there are authorized to be appropriated to carry out this subtitle not more than $1,000,000 for any fiscal year. Funds so appropriated shall remain available until expended.</text> </subsection><subsection id="H61A6902F4BA748DE887450ED87DB2B66"><enum>(b)</enum><header>Limitation on Total Amounts Appropriated</header><text>Not more than $15,000,000 may be appropriated to carry out this subtitle.</text> </subsection><subsection id="H1297CBF1967B45F998E5A687B7031D1"><enum>(c)</enum><header>Cost-Sharing Requirement</header><text display-inline="yes-display-inline">The Federal share of the total cost of any activity under this subtitle shall be not more than 50 percent; the non-Federal contribution may be in the form of in-kind contributions of goods or services fairly valued.</text> </subsection></section><section id="HE9CAFF792D7A4FCA98C9AAD8B25F0015"><enum>2032.</enum><header>Use of Federal funds from other sources</header><text display-inline="no-display-inline">Nothing in this subtitle shall preclude the local coordinating entity from using Federal funds available under other laws for the purposes for which those funds were authorized.</text> </section><section id="HDCAB07E7B131432D8B4FAB4C35634DFE"><enum>2033.</enum><header>Sunset for grants and other assistance</header><text display-inline="no-display-inline">The authority of the Secretary to provide financial assistance under this subtitle terminates on the date that is 15 years after the date of enactment of this subtitle.</text> </section></subtitle><subtitle id="H5A7C1FBB6C524A5780AD1E7CD3024455"><enum>C</enum><header>Muscle Shoals National Heritage Area</header> <section id="H18696B4B6A6D4497A5D754DFC8C9CEF6"><enum>2041.</enum><header>Short title; and</text> </paragraph><paragraph id="HC62EAC998C2D4566823EAB727BBAB4DE"><enum>(6)</enum><text>to provide appropriate linkages between units of the National Park System and communities, governments, and organizations within the National Heritage Area.</text> </paragraph></section><section id="H123893F6E3FA4689BFD87D3893352756"><enum>2043.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text> <paragraph id="H0871ECC47A384895BF095B89E93C0055"><enum>(1)</enum><header>National heritage area</header><text>The term <term>National Heritage Area</term> means the Muscle Shoals National Heritage Area established in this subtitle.</text> </paragraph><paragraph id="H57D7844D95C24BA49DD2F22E2160DAB2"><enum>(2)</enum><header>Local coordinating entity</header><text>The term <term>local coordinating entity</term> means the Muscle Shoals Regional Center, which is hereby designated by Congress—</text> <subparagraph id="H5C4B3E49A9D74B7EA9C4605E733F6DB0"><enum>(A)</enum><text>to develop, in partnership with others, the management plan for the National Heritage Area; and</text> </subparagraph><subparagraph id="H2510A02580ED49A68FAD7126028B24F"><enum>(B)</enum><text>to act as a catalyst for the implementation of projects and programs among diverse partners in the National Heritage Area.</text> </subparagraph></paragraph><paragraph id="HA0E946EA02D1496A834181AA2184519B"><enum>(3)</enum><header>Management plan</header><text>The term <term>management plan</term> means the plan prepared by the local coordinating entity for the National Heritage Area that specifies actions, policies, strategies, performance goals, and recommendations to meet the goals of the National Heritage Area, in accordance with this subtitle.</text> </paragraph><paragraph id="H36A2F4488811414283771D78005E11E1"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text> </paragraph></section><section id="HA7779894FF634695843400B6F913889B"><enum>2044.</enum><header>Designation of Muscle Shoals National Heritage Area</header> <subsection id="H0C88C857B38C4D2AA988C4BA7C1DB48C"><enum>(a)</enum><header>Establishment</header><text>There is hereby established the Muscle Shoals National Heritage Area in the State of Alabama.</text> </subsection><subsection id="H811E6C6FBE924A288E002D7D31988071"><enum>(b)</enum><header>Boundaries</header> <paragraph id="HBD5C20BFFDCD4DE600DAFCBAF96E2BAD"><enum>(1)</enum><header>In general</header><text>The National Heritage Area shall be comprised of the counties of Colbert, Franklin, Lauderdale, Lawrence, Limestone, and Morgan; including the Wilson Dam; the Handy Home; and the Helen Keller birthplace.</text> </paragraph><paragraph id="H4800E517159B45998100B6554800CB00"><enum>(2)</enum><header>Map</header><text>The boundary of the National Heritage Area shall be as generally depicted on the map titled <quote>Muscle Shoals National Heritage Area</quote>, numbered T08/80,000, and dated October 2007. The map shall be on file and available to the public in the appropriate offices of the National Park Service and the local coordinating entity.</text> </paragraph></subsection></section><section id="HCF2F4A9FFE63433A008101B5003C53D7"><enum>2045.</enum><header>Management plan</header> <subsection id="H1B3316E76B754BF38E9837E4E7BCB457"><enum>(a)</enum><header>Requirements</header><text>The management plan for the National Heritage Area shall—</text> <paragraph id="H408CCFF5E7FC465682910071143B1618"><enum>(1)</enum><text>describe comprehensive policies, goals, strategies, and recommendations for telling the story of the heritage of the area covered by the National Heritage Area and encouraging long-term resource protection, enhancement, interpretation, funding, management, and development of the National Heritage Area;</text> </paragraph><paragraph id="HBB16E2C5DF014F4A91B7BE04280A79F"><enum>(2)</enum><text>include a description of actions and commitments that Federal, State, Tribal, and local governments, private organizations, and citizens will take to protect, enhance, interpret, fund, manage, and develop the natural, historical, cultural, educational, scenic, and recreational resources of the National Heritage Area;</text> </paragraph><paragraph id="HBF93E64FC3DC499F99D076CDAAEF5E38"><enum>(3)</enum><text>specify existing and potential sources of funding or economic development strategies to protect, enhance, interpret, fund, manage, and develop the National Heritage Area;</text> </paragraph><paragraph id="H5A484E3520894881958F1D8D003CEB94"><enum>(4)</enum><text>include an inventory of the natural, historical, cultural, educational, scenic, and recreational resources of the National Heritage Area related to the national importance and themes of the National Heritage Area that should be protected, enhanced, interpreted, managed, funded, and developed;</text> </paragraph><paragraph id="H547D58DF064E4A95A226795B35D8566F"><enum>(5)</enum><text>recommend policies and strategies for resource management, including the development of intergovernmental and interagency agreements to protect, enhance, interpret, fund, manage, and develop the natural, historical, cultural, educational, scenic, and recreational resources of the National Heritage Area;</text> </paragraph><paragraph id="H25A0DF0181E144509700311148CBF4D"><enum>(6)</enum><text>describe a program for implementation for the management plan, including—</text> <subparagraph id="H70EB6D4B52B04059A3FB011BD4EC3FD2"><enum>(A)</enum><text>performance goals;</text> </subparagraph><subparagraph id="H00B2DCE34E2A41BD9D619EA1B627F767"><enum>(B)</enum><text>plans for resource protection, enhancement, interpretation, funding, management, and development; and</text> </subparagraph><subparagraph id="HB105C224338D469BBD31D720AAC3F8C2"><enum>(C)</enum><text>specific commitments for implementation that have been made by the local coordinating entity or any Federal, State, Tribal, or local government agency, organization, business, or individual;</text> </subparagraph></paragraph><paragraph id="HCC6C158CDDBF48938750E635B682E295"><enum>(7)</enum><text>include an analysis of, and recommendations for, means by which Federal, State, Tribal, and local programs may best be coordinated (including the role of the National Park Service and other Federal agencies associated with the National Heritage Area) to further the purposes of this subtitle; and</text> </paragraph><paragraph id="H8671E1A236BD4125BE99A21E414C49E"><enum>(8)</enum><text>include a business plan that—</text> <subparagraph id="HE6E4B8CEE2CA417CA5F02651E71BE895"><enum>(A)</enum><text>describes the role, operation, financing, and functions of the local coordinating entity and of each of the major activities contained in the management plan; and</text> </subparagraph><subparagraph id="HE925B320861B42E8A0623F7475FF7E00"><enum>(B)</enum><text>provides adequate assurances that the local coordinating entity has the partnerships and financial and other resources necessary to implement the management plan for the National Heritage Area.</text> </subparagraph></paragraph></subsection><subsection id="H600234E84C8147E6B0F6E14D75244B56"><enum>(b)</enum><header>Deadline</header> <paragraph id="H0FDBEBDF0CFD488E9E9F52794CBC9729"><enum>(1)</enum><header>In general</header><text>Not later than 3 years after the date on which funds are first made available to develop the management plan after designation as a National Heritage Area, the local coordinating entity shall submit the management plan to the Secretary for approval.</text> </paragraph><paragraph id="H8FF94485C2E342A4BFEDA71F5F397C53"><enum>(2)</enum><header>Termination of funding</header><text>If the management plan is not submitted to the Secretary in accordance with paragraph (1), the local coordinating entity shall not qualify for any additional financial assistance under this subtitle until such time as the management plan is submitted to and approved by the Secretary.</text> </paragraph></subsection><subsection id="H96CFCC9322144905A12C9710E9007C5E"><enum>(c)</enum><header>Approval of management plan</header> <paragraph id="H493C8E445E3A496F80CFCB96CFB603FD"><enum>(1)</enum><header>Review</header><text>Not later than 180 days after receiving the plan, the Secretary shall review and approve or disapprove the management plan for a National Heritage Area on the basis of the criteria established under paragraph (3).</text> </paragraph><paragraph id="H099B69B68B2E4463ABA3D8DD4CB1A350"><enum>(2)</enum><header>Consultation</header><text>The Secretary shall consult with the Governor of each State in which the National Heritage Area is located before approving a management plan for the National Heritage Area.</text> </paragraph><paragraph id="H7B52A28019AE4869A5265B82BBDB4B22"><enum>(3)</enum><header>Criteria for approval</header><text>In determining whether to approve a management plan for a National Heritage Area, the Secretary shall consider whether—</text> <subparagraph id="H0DB650081C94419588E64E5EC9DC4700"><enum>(A)</enum><text>the local coordinating entity represents the diverse interests of the National Heritage Area, including Federal, State, Tribal, and local governments, natural, and historic resource protection organizations, educational institutions, businesses, recreational organizations, community residents, and private property owners;</text> </subparagraph><subparagraph id="H17E353A8B5D447ECAF5161DE11CF9420"><enum>(B)</enum><text>the local coordinating entity—</text> <clause id="H3609030FBB924ECD82AEFCDBBF0064D4"><enum>(i)</enum><text>has afforded adequate opportunity for public and Federal, State, Tribal, and local governmental involvement (including through workshops and hearings) in the preparation of the management plan; and</text> </clause><clause id="H347A080C92304D54860656C3D9C6956D"><enum>(ii)</enum><text>provides for at least semiannual public meetings to ensure adequate implementation of the management plan;</text> </clause></subparagraph><subparagraph id="H3A3ECA9EC4704CC697BACEB3137B566"><enum>(C)</enum><text>the resource protection, enhancement, interpretation, funding, management, and development strategies described in the management plan, if implemented, would adequately protect, enhance, interpret, fund, manage, and develop the natural, historic, cultural, educational, scenic, and recreational resources of the National Heritage Area;</text> </subparagraph><subparagraph id="HC729E18C21AF41AF81A9D2C700C8587C"><enum>(D)</enum><text>the management plan would not adversely affect any activities authorized on Federal land under public land laws or land use plans;</text> </subparagraph><subparagraph id="H3AE93D49C550442D87E84EB736B50094"><enum>(E)</enum><text>the local coordinating entity has demonstrated the financial capability, in partnership with others, to carry out the plan;</text> </subparagraph><subparagraph id="H43773C8C1B8B41A4AA3F2250FA31C0C1"><enum>(F)</enum><text>the Secretary has received adequate assurances from the appropriate State, Tribal, and local officials whose support is needed to ensure the effective implementation of the State, Tribal, and local elements of the management plan; and</text> </subparagraph><subparagraph id="HBDB20F3267184DBD912B6FB00F836F1"><enum>(G)</enum><text>the management plan demonstrates partnerships among the local coordinating entity, Federal, State, Tribal, and local governments, regional planning organizations, nonprofit organizations, or private sector parties for implementation of the management plan.</text> </subparagraph></paragraph><paragraph id="HFA41CC92682044718E1D4C96E229E9D"><enum>(4)</enum><header>Disapproval</header> <subparagraph id="H1D8217347F06473D873124B42388007B"><enum>(A)</enum><header>In general</header><text>If the Secretary disapproves the management plan, the Secretary—</text> <clause id="H1FEDB2F1C78F4D49B2128ECAA4D44D38"><enum>(i)</enum><text>shall advise the local coordinating entity in writing of the reasons for the disapproval; and</text> </clause><clause id="HB3D6F606A98D45159BEC47D31CE0D300"><enum>(ii)</enum><text>may make recommendations to the local coordinating entity for revisions to the management plan.</text> </clause></subparagraph><subparagraph id="HA67DA99E11F94594A7AB72AC99491CBB"><enum>(B)</enum><header>Deadline</header><text>Not later than 180 days after receiving a revised management plan, the Secretary shall approve or disapprove the revised management plan.</text> </subparagraph></paragraph><paragraph id="H138D12DE275749FDA847B4BC795EB304"><enum>(5)</enum><header>Amendments</header> <subparagraph id="H127C166B629346DBA302477899F93D73"><enum>(A)</enum><header>In general</header><text>An amendment to the management plan that substantially alters the purposes of the National Heritage Area shall be reviewed by the Secretary and approved or disapproved in the same manner as the original management plan.</text> </subparagraph><subparagraph id="H7B81EC7C63004E998D5BD4C35E786600"><enum>(B)</enum><header>Implementation</header><text>The local coordinating entity shall not use Federal funds authorized by this subtitle to implement an amendment to the management plan until the Secretary approves the amendment.</text> </subparagraph></paragraph><paragraph id="H3CDA6106BB5542F2BAF3252091C49F1E"><enum>(6)</enum><header>Authorities</header><text display-inline="yes-display-inline">The Secretary may—</text> <subparagraph id="HB6C3F6309CAA4B1C93276F0475F720F3"><enum>(A)</enum><text>provide technical assistance under the authority of this subtitle for the development and implementation of the management plan; and</text> </subparagraph><subparagraph id="H11A93D1D6AF14FAFA5C160B11E7ECFF1"><enum>(B)</enum><text>enter into cooperative agreements with interested parties to carry out this subtitle.</text> </subparagraph></paragraph></subsection></section><section id="H356632D1C00D4F1182AC5BA3D5E10091"><enum>2046.</enum><header>Evaluation; report</header> <subsection id="HA6FED7F678A74795909D52341C34419E"><enum>(a)</enum><header>In general</header><text>Not later than 3 years before the date on which authority for Federal funding terminates for the National Heritage Area under this subtitle, the Secretary shall—</text> <paragraph id="HF874CD09675F4F668CF911BC9D495B9D"><enum>(1)</enum><text>conduct an evaluation of the accomplishments of the National Heritage Area; and</text> </paragraph><paragraph id="HB8D65DE30C7045F29D0026AE3717C6CD"><enum>(2)</enum><text>prepare a report in accordance with subsection (c).</text> </paragraph></subsection><subsection id="H77EC0DDBA4D94C78BD9994290705C130"><enum>(b)</enum><header>Evaluation</header><text>An evaluation conducted under subsection (a)(1) shall—</text> <paragraph id="HC5A89580EE8B477DA0088C70F02709D4"><enum>(1)</enum><text>assess the progress of the local coordinating entity with respect to—</text> <subparagraph id="H8093F5A61E664E5EA5B3A2CA708318A"><enum>(A)</enum><text>accomplishing the purposes of the authorizing legislation for the National Heritage Area; and</text> </subparagraph><subparagraph id="H3681C46A9D714D1CB870864743000337"><enum>(B)</enum><text>achieving the goals and objectives of the approved management plan for the National Heritage Area;</text> </subparagraph></paragraph><paragraph id="HC870013B02054719A6EB71E16275A856"><enum>(2)</enum><text>analyze the Federal, State, Tribal, and local, and private investments in the National Heritage Area to determine the impact of the investments; and</text> </paragraph><paragraph id="HD2E8B27A3FA24C41A53735FB4DDB5E83"><enum>(3)</enum><text>review the management structure, partnership relationships, and funding of the National Heritage Area for purposes of identifying the critical components for sustainability of the National Heritage Area.</text> </paragraph></subsection><subsection id="H3C07919FA96E464E9BA47844F12871F3"><enum>(c)</enum><header>Report</header><text>Based on the evaluation conducted under subsection (a)(1), the Secretary shall submit a report to the Committee on Natural Resources of the United States House of Representatives and the Committee on Energy and Natural Resources of the United States Senate. The report shall include recommendations for the future role of the National Park Service, if any, with respect to the National Heritage Area.</text> </subsection></section><section id="H99A3461E0AAF4AEB9BB3983CD03786A0"><enum>2047.</enum><header>Local coordinating entity</header> <subsection id="H6EB5E274449B411DB43E6CD8B0D8C08B"><enum>(a)</enum><header>Duties</header><text>To further the purposes of the National Heritage Area, the Muscle Shoals Regional Center, as the local coordinating entity, shall—</text> <paragraph id="H46EB960B23E1468FA65F5368899BE0C5"><enum>(1)</enum><text>prepare a management plan for the National Heritage Area, and submit the management plan to the Secretary, in accordance with this subtitle;</text> </paragraph><paragraph id="HFB2E703C192B4523940611E544F9C512"><enum>(2)</enum><text>submit an annual report to the Secretary for each fiscal year for which the local coordinating entity receives Federal funds under this subtitle, specifying—</text> <subparagraph id="H9E7F2690B9D94B0C00A00000A84B5054"><enum>(A)</enum><text>the specific performance goals and accomplishments of the local coordinating entity;</text> </subparagraph><subparagraph id="HD3C38032895942D29B895E7F4EB1BB41"><enum>(B)</enum><text>the expenses and income of the local coordinating entity;</text> </subparagraph><subparagraph id="H8876FDCDF6C94D9BBDDA6E633C2FAFA8"><enum>(C)</enum><text>the amounts and sources of matching funds;</text> </subparagraph><subparagraph id="H55888C3FDBC54BC3A9EF57DF35DED453"><enum>(D)</enum><text>the amounts leveraged with Federal funds and sources of the leveraging; and</text> </subparagraph><subparagraph id="H7A36FA2A996C41FAA95DFC097BCAC7F5"><enum>(E)</enum><text>grants made to any other entities during the fiscal year;</text> </subparagraph></paragraph><paragraph id="HF442E4C15100430F9C2501544DF3AB6"><enum>(3)</enum><text>make available for audit for each fiscal year for which the local coordinating entity receives Federal funds under this subtitle, all information pertaining to the expenditure of the funds and any matching funds; and</text> </paragraph><paragraph id="H676D55A1EF4D43F39F7497B92B054299"><enum>(4)</enum><text>encourage economic viability and sustainability that is consistent with the purposes of the National Heritage Area.</text> </paragraph></subsection><subsection id="H08D1613067534259B27D9E2BEC8FE4DB"><enum>(b)</enum><header>Authorities</header><text>For the purposes of preparing and implementing the approved management plan for the National Heritage Area, the local coordinating entity may use Federal funds made available under this subtitle to—</text> <paragraph id="HB1E4B4E2A1AF4324B23556C0CCDD62A6"><enum>(1)</enum><text>make grants to political jurisdictions, nonprofit organizations, and other parties within the National Heritage Area;</text> </paragraph><paragraph id="HBA223F539E3E4E24BA012ED914D25D32"><enum>(2)</enum><text>enter into cooperative agreements with or provide technical assistance to political jurisdictions, nonprofit organizations, Federal agencies, and other interested parties;</text> </paragraph><paragraph id="HBABD1C90A9BA4E4991802680A10521EA"><enum>(3)</enum><text>hire and compensate staff, including individuals with expertise in—</text> <subparagraph id="HEDDBB8E684D641E0A3891504391019E3"><enum>(A)</enum><text>natural, historical, cultural, educational, scenic, and recreational resource conservation;</text> </subparagraph><subparagraph id="HE96A68A0EF1A4115BCCAADB26F1D2A5"><enum>(B)</enum><text>economic and community development; and</text> </subparagraph><subparagraph id="H40A3DAD8339241928F4C74D866B0069"><enum>(C)</enum><text>heritage planning;</text> </subparagraph></paragraph><paragraph id="H6DD0BC94562E4F159366048E3B9334A0"><enum>(4)</enum><text>obtain funds or services from any source, including other Federal programs;</text> </paragraph><paragraph id="H780101B687304C6EBFF58C00E2FFFE35"><enum>(5)</enum><text>contract for goods or services; and</text> </paragraph><paragraph id="HADCF264FD878449AB52B5521D3B99F51"><enum>(6)</enum><text>support activities of partners and any other activities that further the purposes of the National Heritage Area and are consistent with the approved management plan.</text> </paragraph></subsection><subsection id="HF70E7997A7E44EA293E6A54177E200AD"><enum>(c)</enum><header>Prohibition on acquisition of real property</header><text>The local coordinating entity may not use Federal funds authorized under this subtitle to acquire any interest in real property.</text> </subsection></section><section id="H78D596D8992C4459833EBB55C8FE29AD"><enum>2048.</enum><header>Relationship to other Federal agencies</header> <subsection id="H4DFC21135B4C45FDAD8D819E1CAFA044"><enum>(a)</enum><header>In general</header><text>Nothing in this subtitle affects the authority of a Federal agency to provide technical or financial assistance under any other law.</text> </subsection><subsection id="H9F44E2B5561748528CF41FAA34966E58"><enum>(b)</enum><header>Consultation and coordination</header><text>The head of any Federal agency planning to conduct activities that may have an impact on a National Heritage Area is encouraged to consult and coordinate the activities with the Secretary and the local coordinating entity to the maximum extent practicable.</text> </subsection><subsection id="HB599D6E007F24326892C07E78EAAAFB6"><enum>(c)</enum><header>Other Federal agencies</header><text>Nothing in this subtitle—</text> <paragraph id="HB572BAB7FA9E48E18D62594EABA3CA70"><enum>(1)</enum><text>modifies, alters, or amends any law or regulation authorizing a Federal agency to manage Federal land under the jurisdiction of the Federal agency;</text> </paragraph><paragraph id="H9FFB1162D5C64345AAD6E8D48C94CBA4"><enum>(2)</enum><text>limits the discretion of a Federal land manager to implement an approved land use plan within the boundaries of a National Heritage Area; or</text> </paragraph><paragraph id="H3C6CCD5FA8B746AA90E73CAAE444408D"><enum>(3)</enum><text>modifies, alters, or amends any authorized use of Federal land under the jurisdiction of a Federal agency.</text> </paragraph></subsection></section><section id="HDB99D3A2BB0D43819EA6EB6E048C693D"><enum>2049.</enum><header>Private property and regulatory protections</header><text display-inline="no-display-inline">Nothing in this subtitle—</text> <paragraph id="H8906F187A6C24468BA2498B64A8ED79"><enum>(1)</enum><text>abridges the rights of any property owner (whether public or private), including the right to refrain from participating in any plan, project, program, or activity conducted within the National Heritage Area;</text> </paragraph><paragraph id="H4C9EB5146B3445B5AF84C562D99600D3"><enum>(2)</enum><text>requires any property owner to permit public access (including access by Federal, State, Tribal, or local agencies) to the property of the property owner, or to modify public access or use of property of the property owner under any other Federal, State, Tribal, or local law;</text> </paragraph><paragraph id="H809F5EFB9C744CC98BF6E000A2F215F"><enum>(3)</enum><text display-inline="yes-display-inline">alters any duly adopted land use regulation, approved land use plan, or other regulatory authority of any Federal, State, Tribal, or local agency, or conveys any land use or other regulatory authority to any local coordinating entity, including but not necessarily limited to development and management of energy, water, or water-related infrastructure;</text> </paragraph><paragraph id="H1F2E420453474C6A959CCE80DB134E65"><enum>(4)</enum><text>authorizes or implies the reservation or appropriation of water or water rights;</text> </paragraph><paragraph id="HA52F032CF64D4C3CB1467E381EE5A000"><enum>(5)</enum><text>diminishes the authority of the State to manage fish and wildlife, including the regulation of fishing and hunting within the National Heritage Area; or</text> </paragraph><paragraph id="H32D00B280CD84AC4BBFFD2ED02B5D95"><enum>(6)</enum><text>creates any liability, or affects any liability under any other law, of any private property owner with respect to any person injured on the private property.</text> </paragraph></section><section id="H70129405AD864E76B39C416DC2CE9944"><enum>2050.</enum><header>Authorization of appropriations</header> <subsection id="H0EDD0530DF7A4D00BBA7F6AE79A3B403"><enum>(a)</enum><header>Authorization of Appropriations</header><text>Subject to subsection (b), there are authorized to be appropriated to carry out this subtitle not more than $1,000,000 for any fiscal year. Funds so appropriated shall remain available until expended.</text> </subsection><subsection id="HB583D293831441C4B6C2B6A02451A83E"><enum>(b)</enum><header>Limitation on Total Amounts Appropriated</header><text>Not more than $15,000,000 may be appropriated to carry out this subtitle.</text> </subsection><subsection id="HAABF59D03A3345308B3414A84514506E"><enum>(c)</enum><header>Cost-Sharing Requirement</header><text display-inline="yes-display-inline">The Federal share of the total cost of any activity under this subtitle shall be not more than 50 percent; the non-Federal contribution may be in the form of in-kind contributions of goods or services fairly valued.</text> </subsection></section><section id="H8F6AAD9CB8464C0F8BDCA38B6541DDAF"><enum>2051.</enum><header>Use of Federal funds from other sources</header><text display-inline="no-display-inline">Nothing in this subtitle shall preclude the local coordinating entity from using Federal funds available under other laws for the purposes for which those funds were authorized.</text> </section><section id="H354C27231B98428D9934D585FA19FB4"><enum>2052.</enum><header>Sunset for grants and other assistance</header><text display-inline="no-display-inline">The authority of the Secretary to provide financial assistance under this subtitle terminates on the date that is 15 years after the date of enactment of this subtitle.</text> </section></subtitle><subtitle id="H13FB1836AB7E4C5AB16C98F572D5C69"><enum>D</enum><header>Freedom’s Way National Heritage Area</header> <section id="HFDC48C44D50B4141981F112388CC5FA7"><enum>2061.</enum><header>Short title; and</text> </paragraph><paragraph id="HF69C1913D9AF4B3D80C5BB264311BFCB"><enum>(5)</enum><text>to provide appropriate linkages between units of the National Park System and communities, governments, and organizations within the National Heritage Area.</text> </paragraph></subsection></section><section id="HB80EBC88F4D2456CA3FDC5A51D37A42"><enum>2063.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text> <paragraph id="HBC945D48084E47FBA5D0AF61A3D7989"><enum>(1)</enum><header>National heritage area</header><text>The term <term>National Heritage Area</term> means the Freedom’s Way National Heritage Area established in this subtitle.</text> </paragraph><paragraph id="H6032BAADAD4D498F83B58F909CD7C2DB"><enum>(2)</enum><header>Local coordinating entity</header><text>The term <term>local coordinating entity</term> means the Freedom’s Way Heritage Association, Inc., which is hereby designated by Congress—</text> <subparagraph id="H0C999BB31F7748429C64F4A21E2F5DC9"><enum>(A)</enum><text>to develop, in partnership with others, the management plan for the National Heritage Area; and</text> </subparagraph><subparagraph id="H15E5192C454F4748B9976D1180D6BE66"><enum>(B)</enum><text>to act as a catalyst for the implementation of projects and programs among diverse partners in the National Heritage Area.</text> </subparagraph></paragraph><paragraph id="H67661E79AFF34A68B00111CD0181E780"><enum>(3)</enum><header>Management plan</header><text>The term <term>management plan</term> means the plan prepared by the local coordinating entity for the National Heritage Area that specifies actions, policies, strategies, performance goals, and recommendations to meet the goals of the National Heritage Area, in accordance with this subtitle.</text> </paragraph><paragraph id="HF23A4E6BC40143CAA172F7D3C3F8EFA9"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text> </paragraph></section><section id="H578B25EA6A524466AD3652B1FE198480"><enum>2064.</enum><header>Designation of Freedom’s Way National Heritage Area</header> <subsection id="H0A6F5911398041A98DC964FE042C01F"><enum>(a)</enum><header>Establishment</header><text>There is hereby established the Freedom’s Way National Heritage Area.</text> </subsection><subsection id="H2E59055A15144746AA84BC71AC504495"><enum>(b)</enum><header>Boundaries</header> <paragraph id="H54F2ADD994AF4B0A992788E000AEE94E"><enum>(1)</enum><header>In general</header><text>The National Heritage Area shall include the following communities in the Commonwealth of Massachusetts: Winchendon, Ashburnham, Ashby, Gardner, Fitchburg, Westminster, Princeton, Sterling, Leominster, Townsend, Pepperell, Lunenburg, Shirley, Lancaster, Clinton, Bolton, Harvard, Ayer, Groton, Dunstable, Westford, Littleton, Boxborough, Stow, Hudson, Maynard, Sudbury, Concord, Carlisle, Acton, Bedford, Lincoln, Lexington, Woburn, Arlington, Medford, and Malden. Additionally it shall include the following communities in the State of New Hampshire: New Ipswich, Greenville, Mason, Brookline, Milford, Amherst, Hollis, and Nashua.</text> </paragraph><paragraph id="HDAC7752676BA43888B70779022C22D9C"><enum>(2)</enum><header>Map</header><text>The boundaries of the National Heritage area shall be as generally depicted on the map titled <quote>Freedom’s Way National Heritage Area</quote>, numbered T04/80,000, and dated July 2007. The map shall be on file and available to the public in the appropriate offices of the National Park Service and the local coordinating entity.</text> </paragraph></subsection></section><section id="H3FAA9D29E86E4544963EEF935024DB00"><enum>2065.</enum><header>Management plan</header> <subsection id="H2BDF72D4378B4BE39DC26D87ADC2172"><enum>(a)</enum><header>Requirements</header><text>The management plan for the National Heritage Area shall—</text> <paragraph id="H0170DB1B5E924ABB8673252F87D5B412"><enum>(1)</enum><text>describe comprehensive policies, goals, strategies, and recommendations for telling the story of the heritage of the area covered by the National Heritage Area and encouraging long-term resource protection, enhancement, interpretation, funding, management, and development of the National Heritage Area;</text> </paragraph><paragraph id="HF12B97F62A3D47CCB0ACA9407203327F"><enum>(2)</enum><text>include a description of actions and commitments that Federal, State, Tribal, and local governments, private organizations, and citizens will take to protect, enhance, interpret, fund, manage, and develop the natural, historical, cultural, educational, scenic, and recreational resources of the National Heritage Area;</text> </paragraph><paragraph id="H4B2EF3AE8D724ABB87C4A9F7604DD480"><enum>(3)</enum><text>specify existing and potential sources of funding or economic development strategies to protect, enhance, interpret, fund, manage, and develop the National Heritage Area;</text> </paragraph><paragraph id="HCF30B10825D941B282486300F2CA95E0"><enum>(4)</enum><text>include an inventory of the natural, historical, cultural, educational, scenic, and recreational resources of the National Heritage Area related to the national importance and themes of the National Heritage Area that should be protected, enhanced, interpreted, managed, funded, and developed;</text> </paragraph><paragraph id="HD669D82F0C754F2B8410B13293064413"><enum>(5)</enum><text>recommend policies and strategies for resource management, including the development of intergovernmental and interagency agreements to protect, enhance, interpret, fund, manage, and develop the natural, historical, cultural, educational, scenic, and recreational resources of the National Heritage Area;</text> </paragraph><paragraph id="H14710CB15BDE4E02932CF995A7FAA274"><enum>(6)</enum><text>describe a program for implementation for the management plan, including—</text> <subparagraph id="H1C2B459CC347497D99BAFA2935FBA41"><enum>(A)</enum><text>performance goals;</text> </subparagraph><subparagraph id="H2FC4CA353E7A40FA9295ABEE925B2F13"><enum>(B)</enum><text>plans for resource protection, enhancement, interpretation, funding, management, and development; and</text> </subparagraph><subparagraph id="H8CD271AB92BC44A8A07275ECFF9FC946"><enum>(C)</enum><text>specific commitments for implementation that have been made by the local coordinating entity or any Federal, State, Tribal, or local government agency, organization, business, or individual;</text> </subparagraph></paragraph><paragraph id="HBC8CEEBEAAC74E9CAE0026276052F2CA"><enum>(7)</enum><text>include an analysis of, and recommendations for, means by which Federal, State, Tribal, and local programs may best be coordinated (including the role of the National Park Service and other Federal agencies associated with the National Heritage Area) to further the purposes of this subtitle; and</text> </paragraph><paragraph id="HC0C58F25F0724EDCAB1CA168C98B5613"><enum>(8)</enum><text>include a business plan that—</text> <subparagraph id="H34CD19110DAF4575A2A510BCDF7645E2"><enum>(A)</enum><text>describes the role, operation, financing, and functions of the local coordinating entity and of each of the major activities contained in the management plan; and</text> </subparagraph><subparagraph id="H4BE91A296D2C45EDAB2FB0E24BFABA6E"><enum>(B)</enum><text>provides adequate assurances that the local coordinating entity has the partnerships and financial and other resources necessary to implement the management plan for the National Heritage Area.</text> </subparagraph></paragraph></subsection><subsection id="HFC3E7996ED3940669D44BE0E50781F8"><enum>(b)</enum><header>Deadline</header> <paragraph id="H86A2C531900E43A2A4F5F673587418EC"><enum>(1)</enum><header>In general</header><text>Not later than 3 years after the date on which funds are first made available to develop the management plan after designation as a National Heritage Area, the local coordinating entity shall submit the management plan to the Secretary for approval.</text> </paragraph><paragraph id="H5140BBBDA7644AFF868F7D92A1BAB0EE"><enum>(2)</enum><header>Termination of funding</header><text>If the management plan is not submitted to the Secretary in accordance with paragraph (1), the local coordinating entity shall not qualify for any additional financial assistance under this subtitle until such time as the management plan is submitted to and approved by the Secretary.</text> </paragraph></subsection><subsection id="H68CC5660C78E4C93A26F3172C5DA1544"><enum>(c)</enum><header>Approval of management plan</header> <paragraph id="H4FF553EB402741DDAB8363BB7B3820C"><enum>(1)</enum><header>Review</header><text>Not later than 180 days after receiving the plan, the Secretary shall review and approve or disapprove the management plan for the National Heritage Area on the basis of the criteria established under paragraph (3).</text> </paragraph><paragraph id="H04959DE427954558A2A9610E900B92D"><enum>(2)</enum><header>Consultation</header><text>The Secretary shall consult with the Governor of each State or Commonwealth in which the National Heritage Area is located before approving a management plan for the National Heritage Area.</text> </paragraph><paragraph id="H1BBCFC4DDD654D69A7FA1F1D001EA153"><enum>(3)</enum><header>Criteria for approval</header><text>In determining whether to approve a management plan for a National Heritage Area, the Secretary shall consider whether—</text> <subparagraph id="H0635401D36BF4C36B5FD3BB708442527"><enum>(A)</enum><text>the local coordinating entity represents the diverse interests of the National Heritage Area, including Federal, State, Tribal, and local governments, natural and historic resource protection organizations, educational institutions, businesses, recreational organizations, community residents, and private property owners;</text> </subparagraph><subparagraph id="H42DC60D557C84DEDBE804565D7CBFAE0"><enum>(B)</enum><text>the local coordinating entity—</text> <clause id="HD1710893B9F2447CA1761851362B27D"><enum>(i)</enum><text>has afforded adequate opportunity for public and Federal, State, Tribal, and local governmental involvement (including through workshops and hearings) in the preparation of the management plan; and</text> </clause><clause id="H0338FC890AC54A3390E5D4F0FF7770A8"><enum>(ii)</enum><text>provides for at least semiannual public meetings to ensure adequate implementation of the management plan;</text> </clause></subparagraph><subparagraph id="H8ED2CFCFC59D4DA585FF9200F0D4B182"><enum>(C)</enum><text>the resource protection, enhancement, interpretation, funding, management, and development strategies described in the management plan, if implemented, would adequately protect, enhance, interpret, fund, manage, and develop the natural, historic, cultural, educational, scenic, and recreational resources of the National Heritage Area;</text> </subparagraph><subparagraph id="H01EBA96B17784E45A147973600A49F00"><enum>(D)</enum><text>the management plan would not adversely affect any activities authorized on Federal land under public land laws or land use plans;</text> </subparagraph><subparagraph id="H756DF4CF3A454E5694CBB2B8C818C7C"><enum>(E)</enum><text>the local coordinating entity has demonstrated the financial capability, in partnership with others, to carry out the plan;</text> </subparagraph><subparagraph id="H38D31689D969461A966C9D25854CEED2"><enum>(F)</enum><text>the Secretary has received adequate assurances from the appropriate State, Tribal, and local officials whose support is needed to ensure the effective implementation of the State, Tribal, and local elements of the management plan; and</text> </subparagraph><subparagraph id="HDED9F59FF5194A7884A4715DB755E8"><enum>(G)</enum><text>the management plan demonstrates partnerships among the local coordinating entity, Federal, State, Tribal, and local governments, regional planning organizations, nonprofit organizations, or private sector parties for implementation of the management plan.</text> </subparagraph></paragraph><paragraph id="H3550257AD5AB4F86A609EE0904BF20A8"><enum>(4)</enum><header>Disapproval</header> <subparagraph id="HB7D3BD392ECA48FAAED8C0497F34E54E"><enum>(A)</enum><header>In general</header><text>If the Secretary disapproves the management plan, the Secretary—</text> <clause id="HB8273BEE82974226B7E435BF528531CC"><enum>(i)</enum><text>shall advise the local coordinating entity in writing of the reasons for the disapproval; and</text> </clause><clause id="H009D035053AE446388C5902E1E048925"><enum>(ii)</enum><text>may make recommendations to the local coordinating entity for revisions to the management plan.</text> </clause></subparagraph><subparagraph id="HC1A6C896620B41B68071B59E001716A"><enum>(B)</enum><header>Deadline</header><text>Not later than 180 days after receiving a revised management plan, the Secretary shall approve or disapprove the revised management plan.</text> </subparagraph></paragraph><paragraph id="H3C3FD058C5C34C4B97255D087E843132"><enum>(5)</enum><header>Amendments</header> <subparagraph id="H760B5D97707949B88505EB12792B1F3C"><enum>(A)</enum><header>In general</header><text>An amendment to the management plan that substantially alters the purposes of the National Heritage Area shall be reviewed by the Secretary and approved or disapproved in the same manner as the original management plan.</text> </subparagraph><subparagraph id="H678CFA8A526F43049573E3BC1415BE6F"><enum>(B)</enum><header>Implementation</header><text>The local coordinating entity shall not use Federal funds authorized by this subtitle to implement an amendment to the management plan until the Secretary approves the amendment.</text> </subparagraph></paragraph><paragraph id="HCB93145DCA9942DDADB261714B34E466"><enum>(6)</enum><header>Authorities</header><text display-inline="yes-display-inline">The Secretary may—</text> <subparagraph id="H811A7E3081FC4660B1DDE6CE9CF343D"><enum>(A)</enum><text>provide technical assistance under the authority of this subtitle for the development and implementation of the management plan; and</text> </subparagraph><subparagraph id="H78C43D0CD60744CFBFA53E3839FED071"><enum>(B)</enum><text>enter into cooperative agreements with interested parties to carry out this subtitle.</text> </subparagraph></paragraph></subsection></section><section id="H964C9B761E69402D828B63A0382798BE"><enum>2066.</enum><header>Evaluation; report</header> <subsection id="H0E3101032FC24E8895DD00D2E2089D60"><enum>(a)</enum><header>In general</header><text>Not later than 3 years before the date on which authority for Federal funding terminates for the National Heritage Area under this subtitle, the Secretary shall—</text> <paragraph id="H451E29DFE4E74E8600D1BF07FDED0C"><enum>(1)</enum><text>conduct an evaluation of the accomplishments of the National Heritage Area; and</text> </paragraph><paragraph id="H074D006492AF4C0A9C382D00BBA78D14"><enum>(2)</enum><text>prepare a report in accordance with subsection (c).</text> </paragraph></subsection><subsection id="H6A07CD697B8249DA85E43989A3DD00B5"><enum>(b)</enum><header>Evaluation</header><text>An evaluation conducted under subsection (a)(1) shall—</text> <paragraph id="H12E582999C804D119F0048CAACA69C05"><enum>(1)</enum><text>assess the progress of the local coordinating entity with respect to—</text> <subparagraph id="H9BF6C10DF87F42A4AD13D1E06BB6DCE7"><enum>(A)</enum><text>accomplishing the purposes of the authorizing legislation for the National Heritage Area; and</text> </subparagraph><subparagraph id="HD4B8A99E9D4A4979A92441CB41005C69"><enum>(B)</enum><text>achieving the goals and objectives of the approved management plan for the National Heritage Area;</text> </subparagraph></paragraph><paragraph id="H4BB834CF487D42F990D06E09FE5172EE"><enum>(2)</enum><text>analyze the Federal, State, Tribal, and local, and private investments in the National Heritage Area to determine the impact of the investments; and</text> </paragraph><paragraph id="HF25CD51BBDBB4E26BF00DD0387320466"><enum>(3)</enum><text>review the management structure, partnership relationships, and funding of the National Heritage Area for purposes of identifying the critical components for sustainability of the National Heritage Area.</text> </paragraph></subsection><subsection id="H781C2E665DBF427DBF7BACFB60B6AF1C"><enum>(c)</enum><header>Report</header><text>Based on the evaluation conducted under subsection (a)(1), the Secretary shall submit a report to the Committee on Natural Resources of the United States House of Representatives and the Committee on Energy and Natural Resources of the United States Senate. The report shall include recommendations for the future role of the National Park Service, if any, with respect to the National Heritage Area.</text> </subsection></section><section id="HD180E94493D04E5AB62C3DEB012557F0"><enum>2067.</enum><header>Local coordinating entity</header> <subsection id="H7B9EBC5097AA4C27A7FC30328F44B903"><enum>(a)</enum><header>Duties</header><text>To further the purposes of the National Heritage Area, the Freedom’s Way Heritage Association, Inc., as the local coordinating entity, shall—</text> <paragraph id="H56BF4E3B8FE646ECA04F44C2F71392C9"><enum>(1)</enum><text>prepare a management plan for the National Heritage Area, and submit the management plan to the Secretary, in accordance with this subtitle;</text> </paragraph><paragraph id="HBA6E1A284B0E4397A672C0099A215A"><enum>(2)</enum><text>submit an annual report to the Secretary for each fiscal year for which the local coordinating entity receives Federal funds under this subtitle, specifying—</text> <subparagraph id="H6909953DBF0F46AB00F444D19442FA45"><enum>(A)</enum><text>the specific performance goals and accomplishments of the local coordinating entity;</text> </subparagraph><subparagraph id="H4BF6B5E9455C4E1BB7045D642474A9EE"><enum>(B)</enum><text>the expenses and income of the local coordinating entity;</text> </subparagraph><subparagraph id="HDF1FC4B113FF4164B0E1C3E1ABD577A1"><enum>(C)</enum><text>the amounts and sources of matching funds;</text> </subparagraph><subparagraph id="H06E44847529B4C96AED8D920ADB49807"><enum>(D)</enum><text>the amounts leveraged with Federal funds and sources of the leveraging; and</text> </subparagraph><subparagraph id="H95B7783E423440039B2DC974EFF4006D"><enum>(E)</enum><text>grants made to any other entities during the fiscal year;</text> </subparagraph></paragraph><paragraph id="HC78FC0D9A9CC4B01999B9D85E53896F6"><enum>(3)</enum><text>make available for audit for each fiscal year for which the local coordinating entity receives Federal funds under this subtitle, all information pertaining to the expenditure of the funds and any matching funds; and</text> </paragraph><paragraph id="H030E7BE5EEF9409A9057AEF7D9B962C2"><enum>(4)</enum><text>encourage economic viability and sustainability that is consistent with the purposes of the National Heritage Area.</text> </paragraph></subsection><subsection id="HDB9610FD23D9478C8E4D011BE4C87CF9"><enum>(b)</enum><header>Authorities</header><text>For the purposes of preparing and implementing the approved management plan for the National Heritage Area, the local coordinating entity may use Federal funds made available under this subtitle to—</text> <paragraph id="H7357DACCEE31401A9001A4B2CD5F0054"><enum>(1)</enum><text>make grants to political jurisdictions, nonprofit organizations, and other parties within the National Heritage Area;</text> </paragraph><paragraph id="HE7529B4B39114ABF886E7EEA08B0968B"><enum>(2)</enum><text>enter into cooperative agreements with or provide technical assistance to political jurisdictions, nonprofit organizations, Federal agencies, and other interested parties;</text> </paragraph><paragraph id="H749BDC5296E94182B743FE8C688236FF"><enum>(3)</enum><text>hire and compensate staff, including individuals with expertise in—</text> <subparagraph id="HCD0EC644B8D04B899BD723C9C54CB385"><enum>(A)</enum><text>natural, historical, cultural, educational, scenic, and recreational resource conservation;</text> </subparagraph><subparagraph id="H533EAF025F7F44A7913D1031A037543C"><enum>(B)</enum><text>economic and community development; and</text> </subparagraph><subparagraph id="HB368C8D57D10479CA587BDB2F01168D"><enum>(C)</enum><text>heritage planning;</text> </subparagraph></paragraph><paragraph id="HE526FDAFE0944A11A1F2DA55278F83AF"><enum>(4)</enum><text>obtain funds or services from any source, including other Federal programs;</text> </paragraph><paragraph id="H07E6EEF4017D43AEA14D90D09570A2A3"><enum>(5)</enum><text>contract for goods or services; and</text> </paragraph><paragraph id="H456AF29F6E97436EADFDCA75A1DB004F"><enum>(6)</enum><text>support activities of partners and any other activities that further the purposes of the National Heritage Area and are consistent with the approved management plan.</text> </paragraph></subsection><subsection id="HDC67B870E54F43CFBDFE001EE16EF2DE"><enum>(c)</enum><header>Prohibition on acquisition of real property</header><text>The local coordinating entity may not use Federal funds authorized under this subtitle to acquire any interest in real property.</text> </subsection></section><section id="HFE14B34A47E647388B52D1FFFD60928C"><enum>2068.</enum><header>Relationship to other Federal agencies</header> <subsection id="H079FC45A7D5C441DB58C8D03590200A5"><enum>(a)</enum><header>In general</header><text>Nothing in this subtitle affects the authority of a Federal agency to provide technical or financial assistance under any other law.</text> </subsection><subsection id="H9FC13714666D4E77BA91B7E9CF8D0D"><enum>(b)</enum><header>Consultation and coordination</header><text>The head of any Federal agency planning to conduct activities that may have an impact on a National Heritage Area is encouraged to consult and coordinate the activities with the Secretary and the local coordinating entity to the maximum extent practicable.</text> </subsection><subsection id="H171126B4CB244A4F9556EFE5D7E72400"><enum>(c)</enum><header>Other Federal agencies</header><text>Nothing in this subtitle—</text> <paragraph id="H1F89543389CA4543ADDCB5954E6F8B8C"><enum>(1)</enum><text>modifies, alters, or amends any law or regulation authorizing a Federal agency to manage Federal land under the jurisdiction of the Federal agency;</text> </paragraph><paragraph id="H6C0BE5FE022C415790954983AFADFD"><enum>(2)</enum><text>limits the discretion of a Federal land manager to implement an approved land use plan within the boundaries of a National Heritage Area; or</text> </paragraph><paragraph id="H9C2A7E366ED1400D91C0175510D78EF"><enum>(3)</enum><text>modifies, alters, or amends any authorized use of Federal land under the jurisdiction of a Federal agency.</text> </paragraph></subsection></section><section id="H5D9CD2E19D0649C2A8DF28314396681B"><enum>2069.</enum><header>Private property and regulatory protections</header><text display-inline="no-display-inline">Nothing in this subtitle—</text> <paragraph id="H921BBE4B88DA4BF9AC2919568EA1D84D"><enum>(1)</enum><text>abridges the rights of any property owner (whether public or private), including the right to refrain from participating in any plan, project, program, or activity conducted within the National Heritage Area;</text> </paragraph><paragraph id="HBE3635FE8EF04A61BA25A733CDAA722B"><enum>(2)</enum><text>requires any property owner to permit public access (including access by Federal, State, Tribal, or local agencies) to the property of the property owner, or to modify public access or use of property of the property owner under any other Federal, State, Tribal, or local law;</text> </paragraph><paragraph id="H91859292281648DF98C8B4770626497D"><enum>(3)</enum><text display-inline="yes-display-inline">alters any duly adopted land use regulation, approved land use plan, or other regulatory authority of any Federal, State, Tribal, or local agency, or conveys any land use or other regulatory authority to any local coordinating entity, including but not necessarily limited to development and management of energy, water, or water-related infrastructure;</text> </paragraph><paragraph id="H8BD36E838BFF488594760048D58768A8"><enum>(4)</enum><text>authorizes or implies the reservation or appropriation of water or water rights;</text> </paragraph><paragraph id="H738E458F41DC43DCA571C451BDADBC4"><enum>(5)</enum><text>diminishes the authority of the State to manage fish and wildlife, including the regulation of fishing and hunting within the National Heritage Area; or</text> </paragraph><paragraph id="H7BBB28BECEDF4820A3E4D76F3B7460DC"><enum>(6)</enum><text>creates any liability, or affects any liability under any other law, of any private property owner with respect to any person injured on the private property.</text> </paragraph></section><section id="H1E5D81C5262D4A92834D4F6E9E096541"><enum>2070.</enum><header>Authorization of appropriations</header> <subsection id="HAD9743F3BE04444CBB989EDAFEB8AF63"><enum>(a)</enum><header>Authorization of Appropriations</header><text>Subject to subsection (b), there are authorized to be appropriated to carry out this subtitle not more than $1,000,000 for any fiscal year. Funds so appropriated shall remain available until expended.</text> </subsection><subsection id="HC8E91C56D16542C7A14631C61CE395C5"><enum>(b)</enum><header>Limitation on Total Amounts Appropriated</header><text>Not more than $15,000,000 may be appropriated to carry out this subtitle.</text> </subsection><subsection id="HDC4E627F820D49869955DDA3599301CE"><enum>(c)</enum><header>Cost-Sharing Requirement</header><text display-inline="yes-display-inline">The Federal share of the total cost of any activity under this subtitle shall be not more than 50 percent; the non-Federal contribution may be in the form of in-kind contributions of goods or services fairly valued.</text> </subsection></section><section id="H431941AB9DBD42E1A368BA9FE0DB6271"><enum>2071.</enum><header>Use of Federal funds from other sources</header><text display-inline="no-display-inline">Nothing in this subtitle shall preclude the local coordinating entity from using Federal funds available under Acts other than this subtitle for the purposes for which those funds were authorized.</text> </section><section id="H7E11A1864CB0497A842B29A13FA0EE00"><enum>2072.</enum><header>Sunset for grants and other assistance</header><text display-inline="no-display-inline">The authority of the Secretary to provide financial assistance under this subtitle terminates on the date that is 15 years after the date of enactment of this subtitle.</text> </section></subtitle><subtitle id="HC545C12F06504DFE00B3C139BD400F8"><enum>E</enum><header>Abraham Lincoln National Heritage Area</header> <section id="H1F7F807EE14248FAAB9E2FD69DA14DEA"><enum>2081.</enum><header>Short title; and</text> </paragraph><paragraph id="H6A22173F72C74B119F5DA8662BBB178E"><enum>(6)</enum><text>to provide appropriate linkages between units of the National Park System and communities, governments, and organizations within the Heritage Area.</text> </paragraph></subsection></section><section id="HFA19C33F3364458BB1730022C0F7ADBA"><enum>2083.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text> <paragraph id="H8EF4587A91D944ED8BA000B37D003073"><enum>(1)</enum><header>National heritage area</header><text>The term <term>National Heritage Area</term> means the Abraham Lincoln National Heritage Area established in this subtitle.</text> </paragraph><paragraph id="HF59A56B621694E47BC19E451A343DD8E"><enum>(2)</enum><header>Local coordinating entity</header><text>The term <term>local coordinating entity</term> means the Looking for Lincoln Heritage Coalition, which is hereby designated by Congress—</text> <subparagraph id="HDB8364C4BAA94F94AA1C4CF8CF8B676E"><enum>(A)</enum><text>to develop, in partnership with others, the management plan for the National Heritage Area; and</text> </subparagraph><subparagraph id="H2C6AB2E8C3D4432D848FBDBEB6A68DA0"><enum>(B)</enum><text>to act as a catalyst for the implementation of projects and programs among diverse partners in the National Heritage Area.</text> </subparagraph></paragraph><paragraph id="H90DD65538B244E81B37E3375D6A9E3ED"><enum>(3)</enum><header>Management plan</header><text>The term <term>management plan</term> means the plan prepared by the local coordinating entity for the National Heritage Area that specifies actions, policies, strategies, performance goals, and recommendations to meet the goals of the National Heritage Area, in accordance with this subtitle.</text> </paragraph><paragraph id="H650EC1993D1143D2007EF74897071480"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text> </paragraph></section><section id="HE7B74232527D42B6AEEC6776DAE03208"><enum>2084.</enum><header>Designation of Abraham Lincoln National Heritage Area</header> <subsection id="H1D73E15D85FF40A1A7F292677B9616D4"><enum>(a)</enum><header>Establishment</header><text>There is hereby established the Abraham Lincoln National Heritage Area.</text> </subsection><subsection id="HE7204F8FA7184EB097E9434FCA21F005"><enum>(b)</enum><header>Boundaries</header> <paragraph id="HFCD3A00DB4804212852CBE6000016C4"><enum>(1)</enum><header>In general</header><text>The National Heritage Area shall consist of sites as designated by the management plan within a core area located in Central Illinois, consisting of Adams, Brown, Calhoun, Cass, Champaign, Christian, Clark, Coles, Cumberland, Dewitt, Douglas, Edgar, Fayette, Fulton, Greene, Hancock, Henderson, Jersey, Knox, LaSalle, Logan, Macon, Macoupin, Madison, Mason, McDonough, McLean, Menard, Montgomery, Morgan, Moultrie, Peoria, Piatt, Pike, Sangamon, Schuyler, Scott, Shelby, Tazwell, Vermillion, Warren and Woodford counties.</text> </paragraph><paragraph id="H78389F73925C42F1862EBA33E8336ECE"><enum>(2)</enum><header>Map</header><text>The boundaries of the National Heritage Area shall be as generally depicted on the map titled <quote>Proposed Abraham Lincoln National Heritage Area</quote>, and numbered 338/80,000, and dated July 2007. The map shall be on file and available to the public in the appropriate offices of the National Park Service and the local coordinating entity.</text> </paragraph></subsection></section><section id="HE409BEF8C2084A41A47E621401DEDCCD"><enum>2085.</enum><header>Management plan</header> <subsection id="H4115094E33684B3A8FEAEC3845B9871F"><enum>(a)</enum><header>Requirements</header><text>The management plan for the National Heritage Area shall—</text> <paragraph id="H2A7276C3AD4E4015B6244896A7808F24"><enum>(1)</enum><text>describe comprehensive policies, goals, strategies, and recommendations for telling the story of the heritage of the area covered by the National Heritage Area and encouraging long-term resource protection, enhancement, interpretation, funding, management, and development of the National Heritage Area;</text> </paragraph><paragraph id="H2CD4F089288840A9AA031132965FED1C"><enum>(2)</enum><text>include a description of actions and commitments that Federal, State, Tribal, and local governments, private organizations, and citizens will take to protect, enhance, interpret, fund, manage, and develop the natural, historical, cultural, educational, scenic, and recreational resources of the National Heritage Area;</text> </paragraph><paragraph id="H5D01D20EF1BF422CAADEF10062404842"><enum>(3)</enum><text>specify existing and potential sources of funding or economic development strategies to protect, enhance, interpret, fund, manage, and develop the National Heritage Area;</text> </paragraph><paragraph id="H8F7C798B67874D4D8322AEEDB670800"><enum>(4)</enum><text>include an inventory of the natural, historical, cultural, educational, scenic, and recreational resources of the National Heritage Area related to the national importance and themes of the National Heritage Area that should be protected, enhanced, interpreted, managed, funded, and developed;</text> </paragraph><paragraph id="H5AB4D7EB61ED4CFC8581012DAAC38091"><enum>(5)</enum><text>recommend policies and strategies for resource management, including the development of intergovernmental and interagency agreements to protect, enhance, interpret, fund, manage, and develop the natural, historical, cultural, educational, scenic, and recreational resources of the National Heritage Area;</text> </paragraph><paragraph id="HE107AB67A1B94502BA9C35F05FBB1DF8"><enum>(6)</enum><text>describe a program for implementation for the management plan, including—</text> <subparagraph id="H062B0AA28CDC471BA48198B7266046F4"><enum>(A)</enum><text>performance goals;</text> </subparagraph><subparagraph id="H7730B724D5BB4F8B926BE02FA9D1D79"><enum>(B)</enum><text>plans for resource protection, enhancement, interpretation, funding, management, and development; and</text> </subparagraph><subparagraph id="H709560F9306743FCB6B73E31009BC9D1"><enum>(C)</enum><text>specific commitments for implementation that have been made by the local coordinating entity or any Federal, State, Tribal, or local government agency, organization, business, or individual;</text> </subparagraph></paragraph><paragraph id="H15E997B504D740EE9FF5CDEF4866D09D"><enum>(7)</enum><text>include an analysis of, and recommendations for, means by which Federal, State, Tribal, and local programs may best be coordinated (including the role of the National Park Service and other Federal agencies associated with the National Heritage Area) to further the purposes of this subtitle; and</text> </paragraph><paragraph id="H51E5DE49730F422E96359D96E7A35167"><enum>(8)</enum><text>include a business plan that—</text> <subparagraph id="HB4730E89A2D54DA286D844447E5DDEE3"><enum>(A)</enum><text>describes the role, operation, financing, and functions of the local coordinating entity and of each of the major activities contained in the management plan; and</text> </subparagraph><subparagraph id="HB70DB44B7716429ABD3939CE2DDDA804"><enum>(B)</enum><text>provides adequate assurances that the local coordinating entity has the partnerships and financial and other resources necessary to implement the management plan for the National Heritage Area.</text> </subparagraph></paragraph></subsection><subsection id="H378B985628E346908019BA66024250D6"><enum>(b)</enum><header>Deadline</header> <paragraph id="HEDEEECF2565D495D855C13215233E941"><enum>(1)</enum><header>In general</header><text>Not later than 3 years after the date on which funds are first made available to develop the management plan after designation as a National Heritage Area, the local coordinating entity shall submit the management plan to the Secretary for approval.</text> </paragraph><paragraph id="H2BA8259BFDAB474DBC4BA4C597D125A4"><enum>(2)</enum><header>Termination of funding</header><text>If the management plan is not submitted to the Secretary in accordance with paragraph (1), the local coordinating entity shall not qualify for any additional financial assistance under this subtitle until such time as the management plan is submitted to and approved by the Secretary.</text> </paragraph></subsection><subsection id="HECB124C9C04947F5BBED9D3725850045"><enum>(c)</enum><header>Approval of management plan</header> <paragraph id="HD63CF2981BAD4F0C8D19A2BC716300B1"><enum>(1)</enum><header>Review</header><text>Not later than 180 days after receiving the plan, the Secretary shall review and approve or disapprove the management plan for a National Heritage Area on the basis of the criteria established under paragraph (3).</text> </paragraph><paragraph id="H6590815BDF53428BBBAD663D3047B6B3"><enum>(2)</enum><header>Consultation</header><text>The Secretary shall consult with the Governor of each State in which the National Heritage Area is located before approving a management plan for the National Heritage Area.</text> </paragraph><paragraph id="H82B14E8DFC604E87A2138421D851E8C1"><enum>(3)</enum><header>Criteria for approval</header><text>In determining whether to approve a management plan for a National Heritage Area, the Secretary shall consider whether—</text> <subparagraph id="H8C3AC35A86924747881517DA4C00F430"><enum>(A)</enum><text>the local coordinating entity represents the diverse interests of the National Heritage Area, including Federal, State, Tribal, and local governments, natural, and historic resource protection organizations, educational institutions, businesses, recreational organizations, community residents, and private property owners;</text> </subparagraph><subparagraph id="H47AB97BF40EE4D44998659204ED1B2FC"><enum>(B)</enum><text>the local coordinating entity—</text> <clause id="H13069110D19F42698F002B00F93BB795"><enum>(i)</enum><text>has afforded adequate opportunity for public and Federal, State, Tribal, and local governmental involvement (including through workshops and hearings) in the preparation of the management plan; and</text> </clause><clause id="HA2ACF66F859E4BB58C232F9600BBC186"><enum>(ii)</enum><text>provides for at least semiannual public meetings to ensure adequate implementation of the management plan;</text> </clause></subparagraph><subparagraph id="H5FEED4B42F65473CA9A274ABF38B0591"><enum>(C)</enum><text>the resource protection, enhancement, interpretation, funding, management, and development strategies described in the management plan, if implemented, would adequately protect, enhance, interpret, fund, manage, and develop the natural, historic, cultural, educational, scenic, and recreational resources of the National Heritage Area;</text> </subparagraph><subparagraph id="H471BAADA8EDD4B448154B3EA7350AC76"><enum>(D)</enum><text>the management plan would not adversely affect any activities authorized on Federal land under public land laws or land use plans;</text> </subparagraph><subparagraph id="HA00EFE602E8F46D9A8B010FF660007A4"><enum>(E)</enum><text>the local coordinating entity has demonstrated the financial capability, in partnership with others, to carry out the plan;</text> </subparagraph><subparagraph id="H29297873BD344C9098E333A8377FB072"><enum>(F)</enum><text>the Secretary has received adequate assurances from the appropriate State, Tribal, and local officials whose support is needed to ensure the effective implementation of the State, Tribal, and local elements of the management plan; and</text> </subparagraph><subparagraph id="H0D4FAD6BEA1B4A7800000142CCED0096"><enum>(G)</enum><text>the management plan demonstrates partnerships among the local coordinating entity, Federal, State, Tribal, and local governments, regional planning organizations, nonprofit organizations, or private sector parties for implementation of the management plan.</text> </subparagraph></paragraph><paragraph id="H3ADCF28769FA4B8486C260187C484681"><enum>(4)</enum><header>Disapproval</header> <subparagraph id="H971680F50DA748B293F42DC7A321F43"><enum>(A)</enum><header>In general</header><text>If the Secretary disapproves the management plan, the Secretary—</text> <clause id="HF4690AA5079143708DF9A020A781D4AF"><enum>(i)</enum><text>shall advise the local coordinating entity in writing of the reasons for the disapproval; and</text> </clause><clause id="H2BAD201A493041CF9C79DABA5C9500CD"><enum>(ii)</enum><text>may make recommendations to the local coordinating entity for revisions to the management plan.</text> </clause></subparagraph><subparagraph id="HD007A05C7EE743B1A925D362F61EE2E5"><enum>(B)</enum><header>Deadline</header><text>Not later than 180 days after receiving a revised management plan, the Secretary shall approve or disapprove the revised management plan.</text> </subparagraph></paragraph><paragraph id="H77B960599A904599926CCB978324045D"><enum>(5)</enum><header>Amendments</header> <subparagraph id="H617C4AC14F964482B326B604F300E259"><enum>(A)</enum><header>In general</header><text>An amendment to the management plan that substantially alters the purposes of the National Heritage Area shall be reviewed by the Secretary and approved or disapproved in the same manner as the original management plan.</text> </subparagraph><subparagraph id="H74484B511B5549C8A692F699B81854B3"><enum>(B)</enum><header>Implementation</header><text>The local coordinating entity shall not use Federal funds authorized by this subtitle to implement an amendment to the management plan until the Secretary approves the amendment.</text> </subparagraph></paragraph><paragraph id="H108A4F71F61D42B888936CAE265C93B8"><enum>(6)</enum><header>Authorities</header><text display-inline="yes-display-inline">The Secretary may—</text> <subparagraph id="H8DCABDFDB02546D8AB7ECC335FC53101"><enum>(A)</enum><text>provide technical assistance under the authority of this subtitle for the development and implementation of the management plan; and</text> </subparagraph><subparagraph id="HDE71AB5EF5C246E5B5AF46713416909E"><enum>(B)</enum><text>enter into cooperative agreements with interested parties to carry out this subtitle.</text> </subparagraph></paragraph></subsection></section><section id="H44EBC9FA723849BBB46927D6E38F43CE"><enum>2086.</enum><header>Evaluation; report</header> <subsection id="H6A0D0DD5A3CA4A7FB7D3B1CC7459DB77"><enum>(a)</enum><header>In general</header><text>Not later than 3 years before the date on which authority for Federal funding terminates for the National Heritage Area under this subtitle, the Secretary shall—</text> <paragraph id="H3BB9C126A1084AC1AE5D397795E8C6AD"><enum>(1)</enum><text>conduct an evaluation of the accomplishments of the National Heritage Area; and</text> </paragraph><paragraph id="HCDE5D7F939444D9889D7933C437F7800"><enum>(2)</enum><text>prepare a report in accordance with subsection (c).</text> </paragraph></subsection><subsection id="H314F25C9E11849DA94EF9690802DCCA0"><enum>(b)</enum><header>Evaluation</header><text>An evaluation conducted under subsection (a)(1) shall—</text> <paragraph id="H8A52C19336814579BBF1DD717D41CADB"><enum>(1)</enum><text>assess the progress of the local coordinating entity with respect to—</text> <subparagraph id="H8D5A66371978440EA200228266D85BC"><enum>(A)</enum><text>accomplishing the purposes of the authorizing legislation for the National Heritage Area; and</text> </subparagraph><subparagraph id="H40082079A5A54A6AAEDF3C1800582DD7"><enum>(B)</enum><text>achieving the goals and objectives of the approved management plan for the National Heritage Area;</text> </subparagraph></paragraph><paragraph id="HF9243A7601F542DF8922384E00ECCEC3"><enum>(2)</enum><text>analyze the Federal, State, Tribal, and local, and private investments in the National Heritage Area to determine the impact of the investments; and</text> </paragraph><paragraph id="HCD0425E28DC94719AB39F4DC4C14AE6F"><enum>(3)</enum><text>review the management structure, partnership relationships, and funding of the National Heritage Area for purposes of identifying the critical components for sustainability of the National Heritage Area.</text> </paragraph></subsection><subsection id="H8085A37157EE4A5A83D56B94BE9037FB"><enum>(c)</enum><header>Report</header><text>Based on the evaluation conducted under subsection (a)(1), the Secretary shall submit a report to the Committee on Natural Resources of the United States House of Representatives and the Committee on Energy and Natural Resources of the United States Senate. The report shall include recommendations for the future role of the National Park Service, if any, with respect to the National Heritage Area.</text> </subsection></section><section id="HA053FBA734B947F5862C4988F203CC12"><enum>2087.</enum><header>Local coordinating entity</header> <subsection id="HF00457F2527B4C6185EE9B13646B48DD"><enum>(a)</enum><header>Duties</header><text>To further the purposes of the National Heritage Area, the Looking for Lincoln Heritage Coalition, as the local coordinating entity, shall—</text> <paragraph id="HE1BC970D6012400ABAA67C94E3A02000"><enum>(1)</enum><text>prepare a management plan for the National Heritage Area, and submit the management plan to the Secretary, in accordance with this subtitle;</text> </paragraph><paragraph id="H30A4FE330BE94A1391D9346FFC61D5F7"><enum>(2)</enum><text>submit an annual report to the secretary for each fiscal year for which the local coordinating entity receives Federal funds under this subtitle, specifying—</text> <subparagraph id="H4FF4D8351721480A9DE7DD9E55900FE"><enum>(A)</enum><text>the specific performance goals and accomplishments of the local coordinating entity;</text> </subparagraph><subparagraph id="HF0E5EDE2CC734B0EB8D417ACFE1181F"><enum>(B)</enum><text>the expenses and income of the local coordinating entity;</text> </subparagraph><subparagraph id="H566496B0C0014A9AADBDE8180EC7C34"><enum>(C)</enum><text>the amounts and sources of matching funds;</text> </subparagraph><subparagraph id="HDEF11F837DFC4DD5A75B2EC55B531070"><enum>(D)</enum><text>the amounts leveraged with Federal funds and sources of the leveraging; and</text> </subparagraph><subparagraph id="H22FFCA18AEC24B94853258CCFE5BA133"><enum>(E)</enum><text>grants made to any other entities during the fiscal year;</text> </subparagraph></paragraph><paragraph id="HA9C09D6C54F64397ADDE419C904500C6"><enum>(3)</enum><text>make available for audit for each fiscal year for which the local coordinating entity receives Federal funds under this subtitle, all information pertaining to the expenditure of the funds and any matching funds; and</text> </paragraph><paragraph id="H20AF045DA19F4D95A059E5D894EB00D2"><enum>(4)</enum><text>encourage economic viability and sustainability that is consistent with the purposes of the National Heritage Area.</text> </paragraph></subsection><subsection id="HE5DA502240B74A3B9330E86434BBC0DF"><enum>(b)</enum><header>Authorities</header><text>For the purposes of preparing and implementing the approved management plan for the National Heritage Area, the local coordinating entity may use Federal funds made available under this subtitle to—</text> <paragraph id="H6629F87E254C475E9FD93CDA63E61E7"><enum>(1)</enum><text>make grants to political jurisdictions, nonprofit organizations, and other parties within the National Heritage Area;</text> </paragraph><paragraph id="HCB32F8D251774059993481970085BFB6"><enum>(2)</enum><text>enter into cooperative agreements with or provide technical assistance to political jurisdictions, nonprofit organizations, Federal agencies, and other interested parties;</text> </paragraph><paragraph id="H5E41A8423B234F03B3A03215873F4400"><enum>(3)</enum><text>hire and compensate staff, including individuals with expertise in—</text> <subparagraph id="H11E7668A4C85475F937DED773CA5219B"><enum>(A)</enum><text>natural, historical, cultural, educational, scenic, and recreational resource conservation;</text> </subparagraph><subparagraph id="H3DF1158000204B6CA126A8309D681F1E"><enum>(B)</enum><text>economic and community development; and</text> </subparagraph><subparagraph id="HF0E1BDA3463141EBAC37D4EBD2F699A0"><enum>(C)</enum><text>heritage planning;</text> </subparagraph></paragraph><paragraph id="HD845A4ABC3B94163B072A059C150AF01"><enum>(4)</enum><text>obtain funds or services from any source, including other Federal programs;</text> </paragraph><paragraph id="HF50BB500803746E80034DF5F9136C493"><enum>(5)</enum><text>contract for goods or services; and</text> </paragraph><paragraph id="H9F5CF40F623B4F1C9BFA3442CFFB0A7"><enum>(6)</enum><text>support activities of partners and any other activities that further the purposes of the National Heritage Area and are consistent with the approved management plan.</text> </paragraph></subsection><subsection id="H5EAB6B098A7D4FEEBC65B6961729F8DC"><enum>(c)</enum><header>Prohibition on acquisition of real property</header><text>The local coordinating entity may not use Federal funds authorized under this subtitle to acquire any interest in real property.</text> </subsection></section><section id="HADE08F32823444BC8F68226780000063"><enum>2088.</enum><header>Relationship to other Federal agencies</header> <subsection id="H868F5604952F4BEAB4D3C8F601349B00"><enum>(a)</enum><header>In general</header><text>Nothing in this subtitle affects the authority of a Federal agency to provide technical or financial assistance under any other law.</text> </subsection><subsection id="H9C000EDCB2BD4B36B4E90148AAFD3724"><enum>(b)</enum><header>Consultation and coordination</header><text>The head of any Federal agency planning to conduct activities that may have an impact on a National Heritage Area is encouraged to consult and coordinate the activities with the Secretary and the local coordinating entity to the maximum extent practicable.</text> </subsection><subsection id="H63D27802C1544E6EAC0882D3EFB3D16D"><enum>(c)</enum><header>Other Federal agencies</header><text>Nothing in this subtitle—</text> <paragraph id="H1ECBF142FDEB47A6A01382A2FB2698E3"><enum>(1)</enum><text>modifies, alters, or amends any law or regulation authorizing a Federal agency to manage Federal land under the jurisdiction of the Federal agency;</text> </paragraph><paragraph id="H8D1B02D2F8D94D4297F443C42BDED02"><enum>(2)</enum><text>limits the discretion of a Federal land manager to implement an approved land use plan within the boundaries of a National Heritage Area; or</text> </paragraph><paragraph id="H022816AC0B424BDD87B2A8A8B9189724"><enum>(3)</enum><text>modifies, alters, or amends any authorized use of Federal land under the jurisdiction of a Federal agency.</text> </paragraph></subsection></section><section id="HB97A3E6EC086429992AB92133F57E152"><enum>2089.</enum><header>Private property and regulatory protections</header><text display-inline="no-display-inline">Nothing in this subtitle—</text> <paragraph id="H4C5D4254A29C41AD8E9525BACCCC5552"><enum>(1)</enum><text>abridges the rights of any property owner (whether public or private), including the right to refrain from participating in any plan, project, program, or activity conducted within the National Heritage Area;</text> </paragraph><paragraph id="H79455DB3F93A40DA9CE1F7086C0128BD"><enum>(2)</enum><text>requires any property owner to permit public access (including access by Federal, State, Tribal, or local agencies) to the property of the property owner, or to modify public access or use of property of the property owner under any other Federal, State, Tribal, or local law;</text> </paragraph><paragraph id="H2E30D4818B3C4C7A801820912800C2D3"><enum>(3)</enum><text display-inline="yes-display-inline">alters any duly adopted land use regulation, approved land use plan, or other regulatory authority of any Federal, State, Tribal, or local agency, or conveys any land use or other regulatory authority to any local coordinating entity, including but not necessarily limited to development and management of energy, water, or water-related infrastructure;</text> </paragraph><paragraph id="H8D3382A4C58C4BE2974300D255673BD5"><enum>(4)</enum><text>authorizes or implies the reservation or appropriation of water or water rights;</text> </paragraph><paragraph id="HB6902EF1A26E4C41A2C15446F380F922"><enum>(5)</enum><text>diminishes the authority of the State to manage fish and wildlife, including the regulation of fishing and hunting within the National Heritage Area; or</text> </paragraph><paragraph id="H4348CF0E05CE4EDC8626A77279DDAA6"><enum>(6)</enum><text>creates any liability, or affects any liability under any other law, of any private property owner with respect to any person injured on the private property.</text> </paragraph></section><section id="H0305F50F60B64330A5606D638CACE911"><enum>2090.</enum><header>Authorization of appropriations</header> <subsection id="HFCF694F450044E8B88F691536F23C4D4"><enum>(a)</enum><header>Authorization of Appropriations</header><text>Subject to subsection (b), there are authorized to be appropriated to carry out this subtitle not more than $1,000,000 for any fiscal year. Funds so appropriated shall remain available until expended.</text> </subsection><subsection id="H7AFAB4788C104E94B78E429400D92B60"><enum>(b)</enum><header>Limitation on Total Amounts Appropriated</header><text>Not more than $15,000,000 may be appropriated to carry out this subtitle.</text> </subsection><subsection id="HCA043C524F0E4B70986EC898FCB8151D"><enum>(c)</enum><header>Cost-Sharing Requirement</header><text display-inline="yes-display-inline">The Federal share of the total cost of any activity under this subtitle shall be not more than 50 percent; the non-Federal contribution may be in the form of in-kind contributions of goods or services fairly valued.</text> </subsection></section><section id="H1542427977674C3F8F7158A1D6D30513"><enum>2091.</enum><header>Use of Federal funds from other sources</header><text display-inline="no-display-inline">Nothing in this subtitle shall preclude the local coordinating entity from using Federal funds available under other laws for the purposes for which those funds were authorized.</text> </section><section id="H72508051275047D7B82CA4A52D85D2AC"><enum>2092.</enum><header>Sunset for grants and other assistance</header><text display-inline="no-display-inline">The authority of the Secretary to provide financial assistance under this subtitle terminates on the date that is 15 years after the date of the enactment of this subtitle.</text> </section></subtitle><subtitle id="HD72ACE4618FA4E8081B34F1C81633883"><enum>F</enum><header>Santa Cruz Valley National Heritage Area</header> <section id="H8E53430FEAD34815A1428822FC873E30"><enum>2111.</enum><header>Short title; and</text> </paragraph><paragraph id="HF1467B3F9E7C4F1000C8F855D28EDEEF"><enum>(5)</enum><text>to provide appropriate linkages between units of the National Park System and communities, governments, and organizations within the National Heritage Area.</text> </paragraph></section><section id="HBB250FBC7788434080E4E3960AF09E1"><enum>2113.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text> <paragraph id="H1141A852E56845BEBFEFDCE2167DB64"><enum>(1)</enum><header>National heritage area</header><text>The term <term>National Heritage Area</term> means the Santa Cruz Valley National Heritage Area established in this subtitle.</text> </paragraph><paragraph id="HCF118FAED2C5467F83DCFC9EE9FD065"><enum>(2)</enum><header>Local coordinating entity</header><text>The term <term>local coordinating entity</term> means the Santa Cruz Valley Heritage Alliance, Inc., which is hereby designated by Congress—</text> <subparagraph id="H34F4B1A5C2244025A4677E5C76CF996C"><enum>(A)</enum><text>to develop, in partnership with others, the management plan for the National Heritage Area; and</text> </subparagraph><subparagraph id="H03E6224727054D3E91399518CD2912EE"><enum>(B)</enum><text>to act as a catalyst for the implementation of projects and programs among diverse partners in the National Heritage Area.</text> </subparagraph></paragraph><paragraph id="H76926C3FCD61452887D57F183C2FA96D"><enum>(3)</enum><header>Management plan</header><text>The term <term>management plan</term> means the plan prepared by the local coordinating entity for the National Heritage Area that specifies actions, policies, strategies, performance goals, and recommendations to meet the goals of the National Heritage Area, in accordance with this subtitle.</text> </paragraph><paragraph id="H7FDE36B52D094B3E9E61E571007DF446"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text> </paragraph></section><section id="HE5FF6E41E4BB44DE00AAB2D066B2B791"><enum>2114.</enum><header>Designation of Santa Cruz Valley National Heritage Area</header> <subsection id="H0CC67A37597F411997F270BE823EA8C5"><enum>(a)</enum><header>Establishment</header><text>There is hereby established the Santa Cruz Valley National Heritage Area.</text> </subsection><subsection id="H7F97E69DC82845CDB78F7EFEDB04E000"><enum>(b)</enum><header>Boundaries</header> <paragraph id="H0576DCBC3105408DA9D176CA16B4D5B"><enum>(1)</enum><header>In general</header><text>The National Heritage Area shall consist of portions of the counties of Santa Cruz and Pima.</text> </paragraph><paragraph id="H657AC0BEC4C148B3B69ED644CC41B49"><enum>(2)</enum><header>Map</header><text>The boundaries of the National Heritage Area shall be as generally depicted on the map titled <quote>Santa Cruz Valley National Heritage Area</quote>, and numbered _______, and dated _______. The map be on file and available to the public in the appropriate offices of the National Park Service and the local coordinating entity.</text> </paragraph></subsection></section><section id="H1F3D39095D8A46B1AFEC5FAB70F85DF"><enum>2115.</enum><header>Management plan</header> <subsection id="HD1669A8273914A31BCACC6DF921D974B"><enum>(a)</enum><header>Requirements</header><text>The management plan for the National Heritage Area shall—</text> <paragraph id="H910ED8C34F2B40A1B4BEA3B0D45297B6"><enum>(1)</enum><text>describe comprehensive policies, goals, strategies, and recommendations for telling the story of the heritage of the area covered by the National Heritage Area and encouraging long-term resource protection, enhancement, interpretation, funding, management, and development of the National Heritage Area;</text> </paragraph><paragraph id="HFEBDF79352C14CD6B07287EFFBB20013"><enum>(2)</enum><text>include a description of actions and commitments that Federal, State, Tribal, and local governments, private organizations, and citizens will take to protect, enhance, interpret, fund, manage, and develop the natural, historical, cultural, educational, scenic, and recreational resources of the National Heritage Area;</text> </paragraph><paragraph id="HCBF1D52950CF48AF81BDA1E238B41631"><enum>(3)</enum><text>specify existing and potential sources of funding or economic development strategies to protect, enhance, interpret, fund, manage, and develop the National Heritage Area;</text> </paragraph><paragraph id="HC3653C588D064E0181A9C3127B59475F"><enum>(4)</enum><text>include an inventory of the natural, historical, cultural, educational, scenic, and recreational resources of the National Heritage Area related to the national importance and themes of the National Heritage Area that should be protected, enhanced, interpreted, managed, funded, and developed;</text> </paragraph><paragraph id="H2DD4238583304CF0B4A0111C75ACD781"><enum>(5)</enum><text>recommend policies and strategies for resource management, including the development of intergovernmental and interagency agreements to protect, enhance, interpret, fund, manage, and develop the natural, historical, cultural, educational, scenic, and recreational resources of the National Heritage Area;</text> </paragraph><paragraph id="HBF5D1E104528497D97266FB88D38B884"><enum>(6)</enum><text>describe a program for implementation for the management plan, including—</text> <subparagraph id="H22161F1D0C0C4421863132FF1297F073"><enum>(A)</enum><text>performance goals;</text> </subparagraph><subparagraph id="H9A1F03D26FD5481BAEBBA8BBAEB5F4E3"><enum>(B)</enum><text>plans for resource protection, enhancement, interpretation, funding, management, and development; and</text> </subparagraph><subparagraph id="H8DFF48AE735C404D843B2FE11D9BF642"><enum>(C)</enum><text>specific commitments for implementation that have been made by the local coordinating entity or any Federal, State, Tribal, or local government agency, organization, business, or individual;</text> </subparagraph></paragraph><paragraph id="H137B3348FA134524894B7EDD9DC373F"><enum>(7)</enum><text>include an analysis of, and recommendations for, means by which Federal, State, Tribal, and local programs may best be coordinated (including the role of the National Park Service and other Federal agencies associated with the National Heritage Area) to further the purposes of this subtitle; and</text> </paragraph><paragraph id="H52F84AF0C3CD4C46B1AF94167E71F1D"><enum>(8)</enum><text>include a business plan that—</text> <subparagraph id="HA3049CCDFEB6464C82BBD018E56B51C"><enum>(A)</enum><text>describes the role, operation, financing, and functions of the local coordinating entity and of each of the major activities contained in the management plan; and</text> </subparagraph><subparagraph id="H5B74FB59AC8A4850830405FAD4342C92"><enum>(B)</enum><text>provides adequate assurances that the local coordinating entity has the partnerships and financial and other resources necessary to implement the management plan for the National Heritage Area.</text> </subparagraph></paragraph></subsection><subsection id="H9BD759D1EA634271B796EB00CCCE6CE9"><enum>(b)</enum><header>Deadline</header> <paragraph id="H1DCFA786F6C94A4FA7E2DDAEFD8B93F3"><enum>(1)</enum><header>In general</header><text>Not later than 3 years after the date on which funds are first made available to develop the management plan after designation as a National Heritage Area, the local coordinating entity shall submit the management plan to the Secretary for approval.</text> </paragraph><paragraph id="HB23F11B370814E030025B4C7A4329CB5"><enum>(2)</enum><header>Termination of funding</header><text>If the management plan is not submitted to the Secretary in accordance with paragraph (1), the local coordinating entity shall not qualify for any additional financial assistance under this subtitle until such time as the management plan is submitted to and approved by the Secretary.</text> </paragraph></subsection><subsection id="HD7631D0D54DA47B5B7A3C4685C4F50CE"><enum>(c)</enum><header>Approval of management plan</header> <paragraph id="HBB50A71CF0DF478E8617A7BBD2330569"><enum>(1)</enum><header>Review</header><text>Not later than 180 days after receiving the plan, the Secretary shall review and approve or disapprove the management plan for a National Heritage Area on the basis of the criteria established under paragraph (3).</text> </paragraph><paragraph id="H6906D82691E544E2BCB6A0CF59DDA9D5"><enum>(2)</enum><header>Consultation</header><text>The Secretary shall consult with the Governor of each State in which the National Heritage Area is located before approving a management plan for the National Heritage Area.</text> </paragraph><paragraph id="H628CE80CBC394ED90072C8DF8E2D00E4"><enum>(3)</enum><header>Criteria for approval</header><text>In determining whether to approve a management plan for a National Heritage Area, the Secretary shall consider whether—</text> <subparagraph id="H7A2A2653C6C04A9D005F392510DA0000"><enum>(A)</enum><text>the local coordinating entity represents the diverse interests of the National Heritage Area, including Federal, State, Tribal, and local governments, natural and historic resource protection organizations, educational institutions, businesses, recreational organizations, community residents, and private property owners;</text> </subparagraph><subparagraph id="H9FD761EF116D483D81D064F1F24D1B45"><enum>(B)</enum><text>the local coordinating entity—</text> <clause id="H93FB98CC0FE6482E8F7CE5B0F1E999AB"><enum>(i)</enum><text>has afforded adequate opportunity for public and Federal, State, Tribal, and local governmental involvement (including through workshops and hearings) in the preparation of the management plan; and</text> </clause><clause id="HC0A8D34E38A346E7A659DFD2DE891345"><enum>(ii)</enum><text>provides for at least semiannual public meetings to ensure adequate implementation of the management plan;</text> </clause></subparagraph><subparagraph id="HC47D9C0E50CE419CAA03C0A2CFEB102E"><enum>(C)</enum><text>the resource protection, enhancement, interpretation, funding, management, and development strategies described in the management plan, if implemented, would adequately protect, enhance, interpret, fund, manage, and develop the natural, historic, cultural, educational, scenic, and recreational resources of the National Heritage Area;</text> </subparagraph><subparagraph id="H0D12E652F3044199A676EF205000013D"><enum>(D)</enum><text>the management plan would not adversely affect any activities authorized on Federal land under public land laws or land use plans;</text> </subparagraph><subparagraph id="H7C9A00E006884BF79B8D5EBB2EC2E0AE"><enum>(E)</enum><text>the local coordinating entity has demonstrated the financial capability, in partnership with others, to carry out the plan;</text> </subparagraph><subparagraph id="HC91F19FF0D1C4D11A0AB15919B2CF86"><enum>(F)</enum><text>the Secretary has received adequate assurances from the appropriate State, Tribal, and local officials whose support is needed to ensure the effective implementation of the State, Tribal, and local elements of the management plan; and</text> </subparagraph><subparagraph id="H007EAA4BA6C54B6AAEEFA700008E5BC8"><enum>(G)</enum><text>the management plan demonstrates partnerships among the local coordinating entity, Federal, State, Tribal, and local governments, regional planning organizations, nonprofit organizations, or private sector parties for implementation of the management plan.</text> </subparagraph></paragraph><paragraph id="HCE63CEB0E2AB405DBCFA40E58CB24B83"><enum>(4)</enum><header>Disapproval</header> <subparagraph id="HCCD9005CCD6C468590D977604FD88726"><enum>(A)</enum><header>In general</header><text>If the Secretary disapproves the management plan, the Secretary—</text> <clause id="H91E0B98A6AD04267877F73924F548BC9"><enum>(i)</enum><text>shall advise the local coordinating entity in writing of the reasons for the disapproval; and</text> </clause><clause id="HDBF504C6B41142039BE6A2BFB809DFD2"><enum>(ii)</enum><text>may make recommendations to the local coordinating entity for revisions to the management plan.</text> </clause></subparagraph><subparagraph id="HFA645316B7444A8D91E4D530B331E3FB"><enum>(B)</enum><header>Deadline</header><text>Not later than 180 days after receiving a revised management plan, the Secretary shall approve or disapprove the revised management plan.</text> </subparagraph></paragraph><paragraph id="H410D0AFAF1DD4EA89925CB3C79415785"><enum>(5)</enum><header>Amendments</header> <subparagraph id="H73A15F4A03984D2B91A9CCB5C7D357C"><enum>(A)</enum><header>In general</header><text>An amendment to the management plan that substantially alters the purposes of the National Heritage Area shall be reviewed by the Secretary and approved or disapproved in the same manner as the original management plan.</text> </subparagraph><subparagraph id="HA25D1AD5D8F7430F85E1002F26BAC599"><enum>(B)</enum><header>Implementation</header><text>The local coordinating entity shall not use Federal funds authorized by this subtitle to implement an amendment to the management plan until the Secretary approves the amendment.</text> </subparagraph></paragraph><paragraph id="H9CB037C9C51440EA9720BAC244D314C9"><enum>(6)</enum><header>Authorities</header><text>The Secretary may—</text> <subparagraph id="HD1CCBDE5E6BF44E4B17FE8C073002535"><enum>(A)</enum><text>provide technical assistance under the authority of this subtitle for the development and implementation of the management plan; and</text> </subparagraph><subparagraph id="HA10B07B895B44FD581000505369C9E88"><enum>(B)</enum><text>enter into cooperative agreements with interested parties to carry out this subtitle.</text> </subparagraph></paragraph></subsection></section><section id="H61FB896D3A524FDC9351AF8D4B005C08"><enum>2116.</enum><header>Evaluation; report</header> <subsection id="H61BE7937B636490781A5F7D68EB2470"><enum>(a)</enum><header>In general</header><text>Not later than 3 years before the date on which authority for Federal funding terminates for the National Heritage Area under this subtitle, the Secretary shall—</text> <paragraph id="H6E0F977137D841C0A538647422AEDBEA"><enum>(1)</enum><text>conduct an evaluation of the accomplishments of the National Heritage Area; and</text> </paragraph><paragraph id="HABF4DA2CD0C14176B3D8FAE2001845AD"><enum>(2)</enum><text>prepare a report in accordance with subsection (c).</text> </paragraph></subsection><subsection id="H5A78DBE8E33D4C91AB7E5437706D1025"><enum>(b)</enum><header>Evaluation</header><text>An evaluation conducted under subsection (a)(1) shall—</text> <paragraph id="H194A6172A45F4B3B94EEC80F4C71706"><enum>(1)</enum><text>assess the progress of the local coordinating entity with respect to—</text> <subparagraph id="H68F96189E50942E4AB02BCD2F1E13041"><enum>(A)</enum><text>accomplishing the purposes of the authorizing legislation for the National Heritage Area; and</text> </subparagraph><subparagraph id="HCB11C9B8374B4C5886255240E688B762"><enum>(B)</enum><text>achieving the goals and objectives of the approved management plan for the National Heritage Area;</text> </subparagraph></paragraph><paragraph id="H27F7C579032B485FAA8232C2F9D3298F"><enum>(2)</enum><text>analyze the Federal, State, Tribal, and local, and private investments in the National Heritage Area to determine the impact of the investments; and</text> </paragraph><paragraph id="HB448594674464FC0BDB003D1002436E8"><enum>(3)</enum><text>review the management structure, partnership relationships, and funding of the National Heritage Area for purposes of identifying the critical components for sustainability of the National Heritage Area.</text> </paragraph></subsection><subsection id="H6151DC32CEF54F1E8957985030564B66"><enum>(c)</enum><header>Report</header><text>Based on the evaluation conducted under subsection (a)(1), the Secretary shall submit a report to the Committee on Natural Resources of the United States House of Representatives and the Committee on Energy and Natural Resources of the United States Senate. The report shall include recommendations for the future role of the National Park Service, if any, with respect to the National Heritage Area.</text> </subsection></section><section id="H3E8EB6042B544DFB9FF27C446CAF8944"><enum>2117.</enum><header>Local coordinating entity</header> <subsection id="H3DE8CEE028574079A4A2ADD3FD2B0189"><enum>(a)</enum><header>Duties</header><text>To further the purposes of the National Heritage Area, the Santa Cruz Valley Heritage Alliance, Inc., as the local coordinating entity, shall—</text> <paragraph id="H90021CB40D444BE1B524D94568DCB00"><enum>(1)</enum><text>prepare a management plan for the National Heritage Area, and submit the management plan to the Secretary, in accordance with this subtitle;</text> </paragraph><paragraph id="HDE37912D2ED84594A47CC7E2ABDC7D60"><enum>(2)</enum><text>submit an annual report to the Secretary for each fiscal year for which the local coordinating entity receives Federal funds under this subtitle, specifying—</text> <subparagraph id="HECBD2FF60FF54906000054000345E486"><enum>(A)</enum><text>the specific performance goals and accomplishments of the local coordinating entity;</text> </subparagraph><subparagraph id="H2C1F6CC7184E4FC8B1002152AF975F2D"><enum>(B)</enum><text>the expenses and income of the local coordinating entity;</text> </subparagraph><subparagraph id="HCE9ACBEFC3D6448C8758B41475EF2699"><enum>(C)</enum><text>the amounts and sources of matching funds;</text> </subparagraph><subparagraph id="H8422D4337E4F49DE8C073679F4AEDD36"><enum>(D)</enum><text>the amounts leveraged with Federal funds and sources of the leveraging; and</text> </subparagraph><subparagraph id="H702EB8220B1A4409AFE85202BE117251"><enum>(E)</enum><text>grants made to any other entities during the fiscal year;</text> </subparagraph></paragraph><paragraph id="H8079917C039D4C3E96CDB8BBB2FEF028"><enum>(3)</enum><text>make available for audit for each fiscal year for which the local coordinating entity receives Federal funds under this subtitle, all information pertaining to the expenditure of the funds and any matching funds; and</text> </paragraph><paragraph id="HDFBAC7207BAF4DBEA638816DE0619F72"><enum>(4)</enum><text>encourage economic viability and sustainability that is consistent with the purposes of the National Heritage Area.</text> </paragraph></subsection><subsection id="H517A5C4D275D4E87BB8C21C6CE0066F6"><enum>(b)</enum><header>Authorities</header><text>For the purposes of preparing and implementing the approved management plan for the National Heritage Area, the local coordinating entity may use Federal funds made available under this subtitle to—</text> <paragraph id="H5B06C89CEDC24D85B0DB00AE53AA9D98"><enum>(1)</enum><text>make grants to political jurisdictions, nonprofit organizations, and other parties within the National Heritage Area;</text> </paragraph><paragraph id="H4CA74A34D1CC411594EE030023642D50"><enum>(2)</enum><text>enter into cooperative agreements with or provide technical assistance to political jurisdictions, nonprofit organizations, Federal agencies, and other interested parties;</text> </paragraph><paragraph id="HA0054F7D7A6345E89459A3EC2C76D0FE"><enum>(3)</enum><text>hire and compensate staff, including individuals with expertise in—</text> <subparagraph id="H6441C972630F41EDAF0021344EBEC400"><enum>(A)</enum><text>natural, historical, cultural, educational, scenic, and recreational resource conservation;</text> </subparagraph><subparagraph id="H80D67F1271774B678797A7A30674A063"><enum>(B)</enum><text>economic and community development; and</text> </subparagraph><subparagraph id="H2E9E6DE419584A158264AECA0006729E"><enum>(C)</enum><text>heritage planning;</text> </subparagraph></paragraph><paragraph id="H9581F05277B4446182D1F2FF65ABC267"><enum>(4)</enum><text>obtain funds or services from any source, including other Federal programs;</text> </paragraph><paragraph id="H7AC72C9BE5A54D5E91E4972359290F"><enum>(5)</enum><text>contract for goods or services; and</text> </paragraph><paragraph id="HA0C53CCD1AE744E59854A4827D80489F"><enum>(6)</enum><text>support activities of partners and any other activities that further the purposes of the National Heritage Area and are consistent with the approved management plan.</text> </paragraph></subsection><subsection id="HDCD800E2F0904633AA33EBF6B00CA3D"><enum>(c)</enum><header>Prohibition on acquisition of real property</header><text>The local coordinating entity may not use Federal funds authorized under this subtitle to acquire any interest in real property.</text> </subsection></section><section id="H3DF1F026A68A46BC8D82D6648BA1E24"><enum>2118.</enum><header>Relationship to other Federal agencies</header> <subsection id="HC71B15AC41664F6DA344F0112CB6E705"><enum>(a)</enum><header>In general</header><text>Nothing in this subtitle affects the authority of a Federal agency to provide technical or financial assistance under any other law.</text> </subsection><subsection id="H2B915C5C03EF4C67951FB6DF7D186DD"><enum>(b)</enum><header>Consultation and coordination</header><text>The head of any Federal agency planning to conduct activities that may have an impact on a National Heritage Area is encouraged to consult and coordinate the activities with the Secretary and the local coordinating entity to the maximum extent practicable.</text> </subsection><subsection id="HE4093273F5FF4894AC53D52806166215"><enum>(c)</enum><header>Other Federal agencies</header><text>Nothing in this subtitle—</text> <paragraph id="HB191C2F7027542B6BF1F93D740179684"><enum>(1)</enum><text>modifies, alters, or amends any law or regulation authorizing a Federal agency to manage Federal land under the jurisdiction of the Federal agency;</text> </paragraph><paragraph id="HB680BE896998423EAE5EAD8B740243D9"><enum>(2)</enum><text>limits the discretion of a Federal land manager to implement an approved land use plan within the boundaries of a National Heritage Area; or</text> </paragraph><paragraph id="H18CEFABEED2E4998ABE34431C618C96C"><enum>(3)</enum><text>modifies, alters, or amends any authorized use of Federal land under the jurisdiction of a Federal agency.</text> </paragraph></subsection></section><section id="HDAC44CDBFA004636B3F47102DC40C57E"><enum>2119.</enum><header>Private property and regulatory protections</header><text display-inline="no-display-inline">Nothing in this subtitle—</text> <paragraph id="H1FD264A4140A4941BE99EDCF82FA41EF"><enum>(1)</enum><text>abridges the rights of any property owner (whether public or private), including the right to refrain from participating in any plan, project, program, or activity conducted within the National Heritage Area;</text> </paragraph><paragraph id="H9439CE55A6B5422CBE9900394DCC0052"><enum>(2)</enum><text>requires any property owner to permit public access (including access by Federal, State, Tribal, or local agencies) to the property of the property owner, or to modify public access or use of property of the property owner under any other Federal, State, Tribal, or local law;</text> </paragraph><paragraph id="HCDCBCFAF217A41F0B5E2A32837556241"><enum>(3)</enum><text display-inline="yes-display-inline">alters any duly adopted land use regulation, approved land use plan, or other regulatory authority of any Federal, State, Tribal, or local agency, or conveys any land use or other regulatory authority to any local coordinating entity, including but not necessarily limited to development and management of energy, water, or water-related infrastructure;</text> </paragraph><paragraph id="H91CC3BA108404397BA2EE9D41C7FC287"><enum>(4)</enum><text>authorizes or implies the reservation or appropriation of water or water rights;</text> </paragraph><paragraph id="H59ADF0DB6C864113AF8E6376E9BA6B58"><enum>(5)</enum><text>diminishes the authority of the State to manage fish and wildlife, including the regulation of fishing and hunting within the National Heritage Area; or</text> </paragraph><paragraph id="H0B4B3615773B408DBA5D36E184005761"><enum>(6)</enum><text>creates any liability, or affects any liability under any other law, of any private property owner with respect to any person injured on the private property.</text> </paragraph></section><section id="HD83F53BE991A4189A88DD7BBA162B5A5"><enum>2120.</enum><header>Authorization of appropriations</header> <subsection id="H81E8835E701A43B99918D56E4CCD68EA"><enum>(a)</enum><header>Authorization of Appropriations</header><text>Subject to subsection (b), there are authorized to be appropriated to carry out this subtitle not more than $1,000,000 for any fiscal year. Funds so appropriated shall remain available until expended.</text> </subsection><subsection id="H0B18C078C02B42349FE6D3E791605FE"><enum>(b)</enum><header>Limitation on Total Amounts Appropriated</header><text>Not more than $15,000,000 may be appropriated to carry out this subtitle.</text> </subsection><subsection id="HE60BCABCDD124B59913F09ADB7B30009"><enum>(c)</enum><header>Cost-Sharing Requirement</header><text display-inline="yes-display-inline">The Federal share of the total cost of any activity under this subtitle shall be not more than 50 percent; the non-Federal contribution may be in the form of in-kind contributions of goods or services fairly valued.</text> </subsection></section><section id="HE9229B30C9994B128CFAFEAEE8C47DC"><enum>2121.</enum><header>Use of Federal funds from other sources</header><text display-inline="no-display-inline">Nothing in this subtitle shall preclude the local coordinating entity from using Federal funds available under other laws for the purposes for which those funds were authorized.</text> </section><section id="H123197EFB274499680F05FDB01A56613"><enum>2122.</enum><header>Sunset for grants and other assistance</header><text display-inline="no-display-inline">The authority of the Secretary to provide financial assistance under this subtitle terminates on the date that is 15 years after the date of enactment of this subtitle.</text> </section></subtitle><enum>III</enum><header>Study</header> <section id="HA6CC9BD7B9D6471A8008A3C03500D6A4"><enum>3001.</enum><header>Study and report of proposed Northern Neck National Heritage Area</header> <subsection id="H4A91E133664E4453AE731DAC5130097"><enum>(a)</enum><text>The Secretary of the Interior (hereafter referred to as <quote>the Secretary</quote>), in consultation with appropriate State historic preservation officers, State historical societies, and other appropriate organizations, shall conduct a study of the suitability and feasibility of designating the area described in subsection (d) as the Northern Neck National Heritage Area in the Commonwealth of Virginia.</text> </subsection><subsection id="HEB213305FF1747028B71BCFC0031F300"><enum>(b)</enum><header>Criteria</header><text>In conducting the study, the Secretary shall apply the following criteria to determine the suitability and feasibility of designating the area described in subsection (d) as a National Heritage Area:</text> <paragraph id="H4759D3CC25D64F41B3AA93B1DD4B5773"><enum>(1)</enum><text>The area—</text> <subparagraph id="H3FEFCB66CA6B4524893C53E8844B39C9"><enum>(A)</enum><text>has an assemblage of natural, historic, cultural, educational, scenic, or recreational resources that together are nationally important to the heritage of the United States;</text> </subparagraph><subparagraph id="H104D474C2D3F40FFA978D5FE3A35948"><enum>(B)</enum><text>represents distinctive aspects of the heritage of the United States worthy of recognition, conservation, interpretation, and continuing use;</text> </subparagraph><subparagraph id="H5EE9C748411146FD99AB089FB663A920"><enum>(C)</enum><text>is best managed as such an assemblage through partnerships among public and private entities at the local or regional level;</text> </subparagraph><subparagraph id="H15BF946CADB043F891B229B25247D2B4"><enum>(D)</enum><text>reflects traditions, customs, beliefs, and folklife that are a valuable part of the heritage of the United States;</text> </subparagraph><subparagraph id="H650E9DE4C2184A71AD12C4A07E99D4FD"><enum>(E)</enum><text>provides outstanding opportunities to conserve natural, historical, cultural, or scenic features;</text> </subparagraph><subparagraph id="HA66B36F703D445E8B565D46148ABCCFC"><enum>(F)</enum><text>provides outstanding recreational or educational opportunities; and</text> </subparagraph><subparagraph id="H8945A5602D5D47C7A3004BFCE864D0F"><enum>(G)</enum><text>has resources and traditional uses that have national importance.</text> </subparagraph></paragraph><paragraph id="H59273FE6BDBF4D18A08094D2A2CAB06"><enum>(2)</enum><text>Residents, business interests, nonprofit organizations, and governments (including relevant Federal land management agencies) within the proposed area are involved in the planning and have demonstrated significant support through letters and other means for National Heritage Area designation and management.</text> </paragraph><paragraph id="H6811E15E893546AB87CE8816B61234FD"><enum>(3)</enum><text>The local coordinating entity responsible for preparing and implementing the management plan is identified.</text> </paragraph><paragraph id="H2394CF28EBB94D72B92BB831D852C59"><enum>(4)</enum><text>The proposed local coordinating entity and units of government supporting the designation have documented their commitment to work in partnership to protect, enhance, interpret, fund, manage, and develop resources within the National Heritage Area.</text> </paragraph><paragraph id="HA7432388C1C641F0A17B72D00DA3573"><enum>(5)</enum><text>The proposed local coordinating entity has developed a conceptual financial plan that outlines the roles of all participants (including the Federal Government) in the management of the National Heritage Area.</text> </paragraph><paragraph id="HB3DBA22C12D14D56B0AD22C50C943F"><enum>(6)</enum><text>The proposal is consistent with continued economic activity within the area.</text> </paragraph><paragraph id="H803D08C9BAE74CD1B728C7C7D08E82C7"><enum>(7)</enum><text>A conceptual boundary map has been developed and is supported by the public and participating Federal agencies.</text> </paragraph></subsection><subsection id="HFF62D93968D34D808766B18F47751691"><enum>(c)</enum><header>Consultation</header><text>In conducting the study, the Secretary shall consult with the managers of any Federal land within the proposed National Heritage Area and secure the concurrence of the managers with the findings of the study before making a determination for designation.</text> </subsection><subsection id="HA66B996CAD8F4B6BAA1039D8BBDDD493"><enum>(d)</enum><header>Boundaries of the Study Area</header><text>The study area referred to in subsection (a) shall be comprised of the following:</text> <paragraph id="HE85B19CA6B874FBF83B73E58B9A9C0EB"><enum>(1)</enum><text>The part of Virginia between the Potomac and the Rappahannock Rivers in eastern coastal Virginia.</text> </paragraph><paragraph id="H7232C32C8759415EBA8C9370F4711CBB"><enum>(2)</enum><text>Westmoreland, Northumberland, Richmond, King George, and Lancaster Counties, Virginia.</text> </paragraph><paragraph id="H174689F889C749A6B33515C3DD5E3596"><enum>(3)</enum><text>Other areas that have heritage aspects that are similar to those aspects that are in the areas described in paragraphs (1) and (2) and which are adjacent to or in the vicinity of those areas.</text> </paragraph></subsection><subsection id="H8A8F6E58BF284757B63BE7E0716539FC"><enum>(e)</enum><header>Report</header><text>The Secretary shall</text> <paragraph id="HDD84D8E89A35432E9860E652DB925D63"><enum>(1)</enum><text>review, comment on, and determine if the study meets the criteria specified in subsection (b) for designation as a National Heritage Area;</text> </paragraph><paragraph id="HD6196EF63DE44CCCA7D6515B8FFD5620"><enum>(2)</enum><text>consult with the Governor of the Commonwealth of Virginia; and</text> </paragraph><paragraph id="HD4437B60DC2B49268DB3C35B91906600"><enum>(3)</enum><text>not later than 3 fiscal years after the date on which funds are first made available for this section, submit to the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate a report on the findings, conclusions and recommendations of the study, including—</text> <subparagraph id="H783F0C79F1CC449EA24900D7C165BCDB"><enum>(A)</enum><text>any comments received from the Governor of the Commonwealth of Virginia; and</text> </subparagraph><subparagraph id="H088A08EF5FDF49B9BE63BEA9D94BDE00"><enum>(B)</enum><text>a finding as to whether the proposed National Heritage Area meets the criteria for designation.</text> </subparagraph></paragraph></subsection><subsection id="H4224B5945A424002B957C0EA41E9A2FA"><enum>(f)</enum><header>Disapproval</header><text>If the Secretary determines that the proposed National Heritage Area does not meet the criteria for designation, the Secretary shall include within the study submitted under subsection (e)(3) a description of the reasons for the determination.</text> </subsection></section><enum>IV</enum><header>Technical Corrections and Additions</header> <section id="H7186659B154A4BBB82954B178B44A767"><enum>4001.</enum><header>National Coal Heritage Area technical corrections</header><text display-inline="no-display-inline">Title I of Division II of the Omnibus Parks and Public Lands Management Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/333">Public Law 104–333</external-xref> as amended by Public Law 106–176 and Public Law 109–338) is amended—</text> <paragraph id="H137E22C9D54B4083B48DB6DB5909E12"><enum>(1)</enum><text display-inline="yes-display-inline">by striking section 103(b) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H7729D4B62BEC438DBF6E6EB47CFFAC18" style="OLC"> <subsection id="HAD063838CE0F45AC9DC7D4EEF2258FC"><enum>(b)</enum><header>Boundaries</header><text>The National Coal Heritage Area shall be comprised of Lincoln County, West Virginia, and Paint Creek and Cabin Creek within Kanawah County, West Virginia, and the counties that are the subject of the study by the National Park Service, dated 1993, entitled <quote>A Coal Mining Heritage Study: Southern West Virginia</quote> conducted pursuant to title VI of Public Law 100–699.</text> </subsection><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph><paragraph id="H9C49E1F0BD9B4B44981C93A710D0C513"><enum>(2)</enum><text>by striking section 105 and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="HA6B2B5AF02524449882FA8BD6CFB6638" style="OLC"> <section id="HB002BB9F195942E8A8C1F952F5E1A5C1"><enum>105.</enum><header>Eligible resources</header> <subsection id="H6E235F0E30CF40129C7893C313E0F399"><enum>(a)</enum><header>In general</header><text>The resources eligible for the assistance under section 104 shall include—</text> <paragraph id="HD0D11D4A9AC641399E78EB1B9B4B5BA2"><enum>(1)</enum><text>resources in Lincoln County, West Virginia, and Paint Creek and Cabin Creek in Kanawah County, West Virginia, as determined to be appropriate by the National Coal Heritage Area Authority;
