<official-title>To amend titles XVIII and XIX of the Social Security Act to expand the nursing home patients’ bill of rights to include the right to receive care from a credible caregiver by requiring background checks on direct access employees and the right to a safe environment during an emergency or natural disaster by requiring nursing long-term care facilities to establish disaster emergency and evacuation plans.</official-title>

<section id="HE73A19D584D6484CA4BAC8E7CACB6DEE" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Senior Safety and Dignity Act of 2007</short-title></quote>.</text></section> 
<section commented="no" display-inline="no-display-inline" id="HDB951302F412405FB038193234FE33FD"><enum>2.</enum><header>Securing right to receive care from a credible caregiver by requiring performance of background checks on direct access employees of long-term care facilities or providers</header> 
<subsection id="HCD2E5CFF17654848AB3C6E00C8005634"><enum>(a)</enum><header>Addition to nursing home patients’ bill of rights of right to receive care from a credible caregiver</header><text>Sections 1819(c)(1)(A) and 1919(c)(1)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(c)(1)(A)</external-xref>, 1396r(c)(1)(A)) are each amended—</text> 
<paragraph id="H0E4A0EBA8FC84CF1B42544D7B324D259"><enum>(1)</enum><text>by redesignating clause (xi) as clause (xiii); and</text></paragraph> 
<paragraph id="H6400E3E6C6094CFB86188B7B1E638BCE"><enum>(2)</enum><text>by inserting after clause (x) the following new clause:</text>

<clause id="HFACC96F42B8942D2A65E6E6145D6DECB"><enum>(xi)</enum><header>Receipt of care from credible caregiver</header><text display-inline="yes-display-inline">The right to receive care from a credible caregiver.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H00C9AB422C5C41739E54A9ED00F2814F"><enum>(b)</enum><header>Screening of skilled nursing facility and nursing facility employee applicants</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H6B33D422A7BA4780B969AA47FA1D7800"><enum>(1)</enum><header>Medicare program</header><text>Section 1819(b) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(b)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H3968E4BDCF2B486CB53BDF829988392"><enum>(9)</enum><header>Screening of skilled nursing facility workers</header> 
<subparagraph id="HA3C012A64906495591C1AD85A65CDFFF"><enum>(A)</enum><header>Background checks on applicants</header><text>Before hiring a skilled nursing facility worker, a skilled nursing facility shall conduct a background check on the employee in accordance with such procedures as the Secretary shall establish.</text></subparagraph> 
<subparagraph id="H3413A61548E84C57B07131940450D67D"><enum>(B)</enum><header>Prohibition on hiring of abusive workers</header> 
<clause id="H7F4DB5CFAA9E4EF5B1A1C69DD6220928"><enum>(I)</enum><header>In general</header><text>Subject to clause (ii), a skilled nursing facility may not knowingly employ any skilled nursing facility worker who has any disqualifying information (as defined in subparagraph (F)(ii)).</text></clause> 
<clause id="H4C3BC90128B041418C2015E1063EE5BD"><enum>(ii)</enum><header>Provisional employment</header><text>A skilled nursing facility may provide for a provisional period of employment for a skilled nursing facility worker pending completion of the background check required under subparagraph (A). Such facility shall maintain direct supervision of the covered individual during the worker’s provisional period of employment.</text></clause></subparagraph> 
<subparagraph id="H9B0038EB5AEF44DF9194C6AFCFEE9E69"><enum>(C)</enum><header>Procedures</header><text>The procedures established by the Secretary under subparagraph (A) shall—</text> 
<clause id="HDFDB0BE7D4FE4CC39829BFF94BD46EFF"><enum>(I)</enum><text>provide a process by which a skilled nursing facility worker may appeal or dispute the accuracy of the information obtained in a background check conducted under this paragraph;</text></clause> 
<clause id="HE1FF42EEEC7349649131AE1EEA689DF9"><enum>(ii)</enum><text>take into account the needs of skilled nursing facilities that serve a low volume of patients (as determined by the Secretary) with respect to providing supervision for provisional employees who are awaiting the results of a background check conducted under this paragraph; and</text></clause> 
<clause id="H883789F1BA8A480288F218650700B1B3"><enum>(iii)</enum><text>provide for the reimbursement of nursing facilities for 100 percent of the costs incurred by such facilities in complying with the requirements of this section.</text></clause></subparagraph> 
<subparagraph id="H0F77E5294C7B42789000F790DEAF9018"><enum>(D)</enum><header>Immunity from liability</header><text>A skilled nursing facility that, in denying employment for an applicant, reasonably relies upon information about such applicant provided by the criminal background check shall not be liable in any action brought by such applicant based on the employment determination resulting from the information.</text></subparagraph> 
<subparagraph id="HD425C862A6D94E88B2D700F2B9F884D"><enum>(E)</enum><header>Civil penalty</header> 
<clause id="H8D8EBD9D748E4CD5ACAD43EFFD7500E2"><enum>(I)</enum><header>In general</header><text>A skilled nursing facility that violates the provisions of this paragraph shall be subject to a civil penalty in an amount not to exceed—</text> 
<subclause id="HA670238A755F412CA60343539F2687A"><enum>(I)</enum><text>for the first such violation, $2,000; and</text></subclause> 
<subclause id="HD699F8A6218A4FBF858515D6EC00A000"><enum>(II)</enum><text>for the second and each subsequent violation within any 5-year period, $5,000.</text></subclause></clause> 
<clause id="H708DC62EDA704048AAE5E3384CC19145"><enum>(ii)</enum><header>Knowing retention of worker</header><text>In addition to any civil penalty under clause (I), a skilled nursing facility that knowingly continues to employ a skilled nursing facility worker in violation of subparagraph (A) or (B) shall be subject to a civil penalty in an amount not to exceed $5,000 for the first such violation, and $10,000 for the second and each subsequent violation within any 5-year period.</text></clause></subparagraph> 
<subparagraph id="HFD73986FFE274211B102B38CB78C913B"><enum>(F)</enum><header>Definitions</header><text>In this paragraph:</text> 
<clause id="H64BA568A6F6D4794A3655E18BF2315D3"><enum>(I)</enum><header>Conviction for a relevant crime</header><text>The term <term>conviction for a relevant crime</term> means any Federal or State criminal conviction for—</text> 
<subclause id="HD4160C0E22EB446DAA8E884530E6E2B6"><enum>(I)</enum><text>any offense described in section 1128(a); and</text></subclause> 
<subclause id="HFE6D1DA145BD41CDB0B967BF51CC81"><enum>(II)</enum><text>such other types of offenses as the Secretary may specify in regulations.</text></subclause></clause> 
<clause id="HD87695C2777E413B9385854C2E0750C5"><enum>(ii)</enum><header>Disqualifying information</header><text>The term <term>disqualifying information</term> means information about a conviction for a relevant crime or a finding of patient or resident abuse.</text></clause> 
<clause id="HCF6D59AAD74442749DB9E8FFCD3CEA00"><enum>(iii)</enum><header>Skilled nursing facility worker</header><text>The term <term>skilled nursing facility worker</term> means any individual that has direct access to a patient of a skilled nursing facility under an employment or other contract, or both, with such facility. Such term includes individuals who are licensed or certified by the State to provide long-term care services, and nonlicensed individuals providing such services, as defined by the Secretary, including nurse assistants, nurse aides, home health aides, and personal care workers and attendants.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H3A6855C5D7FE43EB0067F761EFBFCB97"><enum>(2)</enum><header>Medicaid program</header><text>Section 1919(b) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(b)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H3E57A9048DF64B92AA7D521171058B26"><enum>(9)</enum><header>Screening of nursing facility workers</header> 
<subparagraph id="HD84D969C21D24EBAAB75964B486CCDA7"><enum>(A)</enum><header>Background checks on applicants</header><text>Before hiring a nursing facility worker, a nursing facility shall conduct a background check on the employee in accordance with such procedures as the Secretary shall establish.</text></subparagraph> 
<subparagraph id="HF9FCFD7810564D5993D7AD35C30E849"><enum>(B)</enum><header>Prohibition on hiring of abusive workers</header> 
<clause id="H1EFDEC3FBCEA467F9EFF8DC0B8AD4BD5"><enum>(I)</enum><header>In general</header><text>Subject to clause (ii), a nursing facility may not knowingly employ any nursing facility worker who has any disqualifying information (as defined in subparagraph (F)(ii)).</text></clause> 
<clause id="H7F60715F14D442DCAE88F9A7C51C1499"><enum>(ii)</enum><header>Provisional employment</header><text>A nursing facility may provide for a provisional period of employment for a nursing facility worker pending completion of the background check required under subparagraph (A). Such facility shall maintain direct supervision of the covered individual during the worker’s provisional period of employment.</text></clause></subparagraph> 
<subparagraph id="HFA37FD8A05504435B4905EFFF76D3D"><enum>(C)</enum><header>Procedures</header><text>The procedures established by the Secretary under subparagraph (A) shall—</text> 
<clause id="HC62F34CA51CE4328A6B2E9BB9591C57E"><enum>(I)</enum><text>provide a process by which a nursing facility worker may appeal or dispute the accuracy of the information obtained in a background check conducted under this paragraph;</text></clause>

<subparagraph id="H84480A03B11C4AD6B58B5BBC458DE1B"><enum>(D)</enum><header>Immunity from liability</header><text>A nursing facility that, in denying employment for an applicant, reasonably relies upon information about such applicant provided by the criminal background check shall not be liable in any action brought by such applicant based on the employment determination resulting from the information.</text></subparagraph> 
<subparagraph id="HB0176CE5359F4927A95778D8F4A87D92"><enum>(E)</enum><header>Civil penalty</header> 
<clause id="HC187DBC202EC40679E45F1A800288649"><enum>(I)</enum><header>In general</header><text>A nursing facility that violates the provisions of this paragraph shall be subject to a civil penalty in an amount not to exceed—</text> 
<subclause id="H848E8B05A0934A4998FE627546FCECCE"><enum>(I)</enum><text>for the first such violation, $2,000; and</text></subclause> 
<subclause id="H885735AB032D40C585928DFDCB43B320"><enum>(II)</enum><text>for the second and each subsequent violation within any 5-year period, $5,000.</text></subclause></clause> 
<clause id="HCF028941B99D431C0087AE58DA958F00"><enum>(ii)</enum><header>Knowing retention of worker</header><text>In addition to any civil penalty under clause (I), a nursing facility that knowingly continues to employ a nursing facility worker in violation of subparagraph (A) or (B) shall be subject to a civil penalty in an amount not to exceed $5,000 for the first such violation, and $10,000 for the second and each subsequent violation within any 5-year period.</text></clause></subparagraph> 
<subparagraph id="H479F255CB71348E6892BAB44B7F8DD2"><enum>(F)</enum><header>Definitions</header><text>In this paragraph:</text> 
<clause id="H770D7A7F6DD649088224187700B1F0E"><enum>(I)</enum><header>Conviction for a relevant crime</header><text>The term <term>conviction for a relevant crime</term> means any Federal or State criminal conviction for—</text> 
<subclause id="H1286B78D5AB6486CB0471C587E271466"><enum>(I)</enum><text>any offense described in section 1128(a); and</text></subclause> 
<subclause id="HE5CDC28DDAD442A3B0E5E6A04215F973"><enum>(II)</enum><text>such other types of offenses as the Secretary may specify in regulations.</text></subclause></clause> 
<clause id="H2951D7F80A0E4FD8803416E4113048A1"><enum>(ii)</enum><header>Disqualifying information</header><text>The term <term>disqualifying information</term> means information about a conviction for a relevant crime or a finding of patient or resident abuse.</text></clause> 
<clause id="H97DB57EA55014A1CABC6E6CFD9200A3"><enum>(iii)</enum><header>Nursing facility worker</header><text>The term <term>nursing facility worker</term> means any individual that has direct access to a patient of a nursing facility under an employment or other contract, or both, with such facility. Such term includes individuals who are licensed or certified by the State to provide long-term care services, and nonlicensed individuals providing such services, as defined by the Secretary, including nurse assistants, nurse aides, home health aides, and personal care workers and attendants.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HB55ACD78EF4943B195FF6E7FE8402300"><enum>(3)</enum><header>Effective date</header><text>The amendments made by this subsection and subsection (a) shall take effect on the date that is 1 year after the date on which the evaluation is completed under subsection (d)(1).</text></paragraph></subsection> 
<subsection id="HA11EEDCFAB7E4E20B027E5DD94B8693"><enum>(c)</enum><header>Application to other long-term care facilities or providers</header> 
<paragraph id="H742C6F7C9700440A9B3822FDD318A258"><enum>(1)</enum><header>Medicare</header><text>Part E of title XVIII of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x et seq.</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block act-name="Social" id="HA03AE0FF66E041ADB9DABEF469BE4BFD" style="traditional"> 
<section id="HF12825A0B7B241FBA4BCD4485924E107"><enum>1898.</enum><header>Application of skilled nursing facility preventive abuse provisions to long-term care facilities and providers</header> 
<subsection commented="no" display-inline="yes-display-inline" id="H516A5DB881504E8C8FC4B066F74D81AB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The provisions of section 1819(b)(9) shall apply to a long-term care facility or provider (as defined in subsection (b)) in the same manner as such provisions apply to a skilled nursing facility.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H37E77F2B8E9343CA8413FFEBE003EB4"><enum>(b)</enum><header>Long-term care facility or provider</header><text>In this section, the term <term>long-term care facility or provider</term> means the following facilities or providers which receive payment for services under this title or title XIX:</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HAC9BA2FF262F48DB82E00296F15FB1C"><enum>(1)</enum><text>A home health agency.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HC3B5EFF7329E4DA29BAE8F7666C24F97"><enum>(2)</enum><text>A provider of hospice care.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H93337747AE464AA6BC983F50839D4C4C"><enum>(3)</enum><text>A long-term care hospital.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H3C61F6F5411F4CC9A21F859C451C296E"><enum>(4)</enum><text>A provider of personal care services.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HC9346705E52D4D078EF46493922DF217"><enum>(5)</enum><text>A residential care provider that arranges for, or directly provides, long-term care services.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H597AF7BF35AB4772ACB2BE0C3193FB2"><enum>(6)</enum><text>An intermediate care facility for the mentally retarded (as defined in section 1905(d)).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H6126C6FB6E0E4D6593F8FBD9A3461D25"><enum>(2)</enum><header>Medicaid</header><text>Section 1902(a) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref>) is amended—</text> 
<subparagraph id="H44828F10FB424FD4B910C3B76DE11CC"><enum>(A)</enum><text>in paragraph (69), by striking <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="HD612556EFD344B4B8F7D22BBB2556B1E"><enum>(B)</enum><text>in paragraph (70), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="HFE67DE80866B4973A61C42671CEE5031"><enum>(C)</enum><text>by inserting after paragraph (70) the following:</text> 
<quoted-block display-inline="no-display-inline" id="HF50B4B6F94264DB5A9E069856D3000A7" style="OLC"> 
<paragraph id="H9BD02587441E4CA3A1CDDD05FE00D638"><enum>(71)</enum><text>provide that the provisions of section 1919(b)(9) apply to a long-term care facility or provider (as defined in section 1898(b)) in the same manner as such provisions apply to a nursing facility.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H6FCC58533A404C3386CCFEC2566DA80"><enum>(3)</enum><header>Effective date</header><text>The amendments made by this subsection shall take effect on the date that is 1 year after the date on which the evaluation is completed under subsection (d)(1).</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H60769D41CE734753AEB500D16DE32E42"><enum>(d)</enum><header>National criminal background check program</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H31E02C6B6EF84E3191A8A5C4E44F89C0"><enum>(1)</enum><header>Completion of pilot program evaluation</header><text>Not later than the date that is 6 months after the completion of the pilot program for national and State background checks on direct patient access employees of long-term care facilities or providers established under section 307 of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>), the Secretary shall complete the evaluation required under subsection (e) of such section of such Act.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HAC9391B267F443888FF960FE00912313"><enum>(2)</enum><header>Establishment</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="H3E139A8CE81C4742A4A2C63083289822"><enum>(A)</enum><header>In general</header><text>Not later than the date that is 1 year after the completion of the evaluation of the program described in paragraph (1), the Secretary, in consultation with the Attorney General, shall establish a national criminal background check program in order to prevent abuse of nursing facility and skilled nursing facility residents and individuals receiving home health care services and other long-term care services under the medicare or medicaid programs, taking into account the findings and recommendations contained in the evaluation.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H555D73C12C404DC1B0C41EA51D264338"><enum>(B)</enum><header>Use in conducting required background checks</header><text>The national criminal background check program shall be made available to a long-term care facility or provider for the purpose of conducting criminal background checks, including the criminal background checks required under sections 1819(b)(9) and 1919(b)(9) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(b)</external-xref>, 1396r(b)) (as added by subsection (a)).</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H8BB4FF2528894679AF9817EA1F87CD2D"><enum>(C)</enum><header>Conduct of background checks by the Federal Bureau of Investigation</header><text>The Secretary, in consultation with the Attorney General, shall establish procedures for the background checks to be conducted by the Federal Bureau of Investigation, in cooperation with appropriate State and Federal agencies.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HA76643A505774FEE8766B2536B9D9EE5"><enum>(D)</enum><header>Consultation</header><text>In establishing the national criminal background check program, the Secretary shall consult with appropriate interested parties, including—</text> 
<clause commented="no" display-inline="no-display-inline" id="HF03F310A94864FF5B7D9DBCE643CAA9F"><enum>(I)</enum><text>representatives of long-term care facilities or providers;</text></clause>

<clause commented="no" display-inline="no-display-inline" id="HEBFE04A5FA1545EDAD2475ECFF73236F"><enum>(iii)</enum><text>consumers of long-term care services;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H5CC86DFCE84E479ABFCA4F52B2F3C35"><enum>(iv)</enum><text>consumer advocates; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H5248A3B980AA418A946212F0F431ED9D"><enum>(v)</enum><text>appropriate Federal and State officials.</text></clause></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HD9099E9A25BD4078B80700081DD213AB"><enum>(3)</enum><header>Definitions</header><text>In this subsection:</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HC7CB34819D96413EA2E726B061C25CD0"><enum>(A)</enum><header>Long-term care facility or provider</header><text>The term <term>long-term care facility or provider</term> means the following facilities or providers which receive payment for services under title XVIII or XIX of the Social Security Act:</text> 
<clause commented="no" display-inline="no-display-inline" id="H48C68ED33AAB43138BF432FF4BDD60A3"><enum>(I)</enum><text>A nursing facility (as defined in subparagraph (B)).</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H3C21F4CFCBCD46E0923E259666D1B300"><enum>(ii)</enum><text>A skilled nursing facility (as defined in subparagraph ©)).</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HE8754ADA4F164363B36545BD1219E63E"><enum>(iii)</enum><text>A home health agency.</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H36FE323836E1426689CF1FC87F7748AD"><enum>(iv)</enum><text>A provider of hospice care (as defined in section 1861(dd)(1) of the Social Security Act) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(dd)(1)</external-xref>).</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H4067B1898BE14B0880BAF625FFD303F3"><enum>(v)</enum><text>A long-term care hospital (as described in section 1886(d)(1)(B)(iv) of such Act) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)(1)(B)(iv)</external-xref>).</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H6D7AF77B2DA64F179709BAC8A9A90D7"><enum>(vi)</enum><text>A provider of personal care services.</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HCFFB56541BFA41CC86D457F347B880F0"><enum>(vii)</enum><text>A residential care provider that arranges for, or directly provides, long-term care services.</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HE72960402ADC4DE69137F100BF83DEB"><enum>(viii)</enum><text>An intermediate care facility for the mentally retarded (as defined in section 1905(d) of such Act) (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(d)</external-xref>).</text></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H548C0A1EF15D4548A110F51C00557BFE"><enum>(B)</enum><header>Nursing facility</header><text>The term <term>nursing facility</term> has the meaning given such term in section 1919(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(a)</external-xref>).</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H8887B61D79F64B11AF005201022E9B9C"><enum>(C)</enum><header>Skilled nursing facility</header><text>The term <term>skilled nursing facility</term> has the meaning given such term in 1819(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(a)</external-xref>).</text></subparagraph></paragraph></subsection></section> 
<section id="H003C7A08237D4613A1DB5FAEE629925C"><enum>3.</enum><header>Securing the right to a safe environment in long-term care facilities during an emergency or natural disaster by requiring these facilities to establish disaster emergency and evacuation plans</header> 
<subsection id="H81E790A31DDB4ACD8DCA873B58D495EB"><enum>(a)</enum><header>Addition to nursing home patients’ bill of rights of right to a safe environment during an emergency or natural disaster</header><text display-inline="yes-display-inline">Sections 1819(c)(1)(A) and 1919(c)(1)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(c)(1)(A)</external-xref>, 1396r(c)(1)(A)), as amended by section 2(a), are each amended by inserting after clause (xi) the following new clause:</text>

<clause id="H84E2AF1E24534D11B113C48E93EB5E4B"><enum>(xii)</enum><header>Safe environment during emergency or natural disaster</header><text display-inline="yes-display-inline">The right to a safe environment during an emergency or natural disaster.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF0298BBA8F614D30813DCFC1C0115F52"><enum>(b)</enum><header>Application under Medicare</header><text>Section 1819(d)(4) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(d)(4)</external-xref>) is amended—</text> 
<paragraph id="H339A300708464D0383ED7C9353BC80B1"><enum>(1)</enum><text>by redesignating subparagraph (B) as subparagraph (C); and</text></paragraph> 
<paragraph id="H7BC69A5E940347689E059600512C4869"><enum>(2)</enum><text>by inserting after subparagraph (A) the following new subparagraph:</text>

<subparagraph id="H207DC62E17C3437FB6217ED96709651F"><enum>(B)</enum><header>Disaster emergency and evacuation plans</header><text>A skilled nursing facility must—</text> 
<clause id="H194563E186C84109B36CD0082121383"><enum>(I)</enum><text>have a clear and pre-established disaster plan to ensure the safety of all its patients during an emergency or natural disaster and possible evacuation; and</text></clause> 
<clause id="HF15AC34541A0492995759577DFDC9CEA"><enum>(ii)</enum><text display-inline="yes-display-inline">inform residents and next-of-kin regarding such plan and the location of possible evacuation in case of an emergency or disaster.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection display-inline="no-display-inline" id="HB920B83DA7F24EC4972910BC44B85EA3"><enum>(c)</enum><header>Medicaid</header><text>Section 1919(d)(4) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r">42 U.S.C. 1396r(d)(4)</external-xref>) is amended—</text> 
<paragraph id="H75D87880078B48A7B5F30312C805B7A3"><enum>(1)</enum><text>by redesignating subparagraph (B) as subparagraph (C); and</text></paragraph> 
<paragraph id="H582C990F63D34B1E002E19DCE9CE3702"><enum>(2)</enum><text>by inserting after subparagraph (A) the following new subparagraph:</text>

<subparagraph id="HF743592A7B774233B62223E3CE4A2C7"><enum>(B)</enum><header>Disaster emergency and evacuation plans</header><text>A nursing facility must—</text> 
<clause id="H15B758EE4AAF4B9F95863ED60935CDC"><enum>(I)</enum><text>have a clear and pre-established disaster plan to ensure the safety of all its patients during an emergency or natural disaster and possible evacuation; and</text></clause> 
<clause id="H2D45D11444AA4F5C8E008B00E25CB53D"><enum>(ii)</enum><text>inform residents and next-of-kin regarding such plan and the location of possible evacuation in case of an emergency or disaster.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HE702672D64214D65A631581E5C20A03D"><enum>(d)</enum><header>Application to other long-term care facilities</header> 
<paragraph id="HDABBEE5FD6F6482CA21446CF4495FEF2"><enum>(1)</enum><header>Medicare</header><text>Section 1898(a) of such Act, as added by section 2(c)(1), is amended by inserting <quote>and section 1819(d)(4)(B)</quote> after <quote>section 1819(b)(9)</quote>.</text></paragraph> 
<paragraph id="H0DCD5C1EDACE4C419BCAD7A27BE83423"><enum>(2)</enum><header>Medicaid</header><text>Section 1902(a)(71) of such Act, as inserted by section 2(c)(2)(C), is amended by inserting <quote>and section 1919(d)(4)(B)</quote> after <quote>section 1919(b)(9)</quote>. </text></paragraph></subsection> 
<subsection id="HDB38A220A90D4168BCACCBD32217141D"><enum>(e)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply as of the date that is one year after the date of the enactment of this Act.</text></subsection></section>
