<official-title display="yes">To assist in the conservation of rare felids and rare canids by supporting and providing financial resources for the conservation programs of nations within the range of rare felid and rare canid populations and projects of persons with demonstrated expertise in the conservation of rare felid and rare canid populations.</official-title>

<section display-inline="no-display-inline" id="H73D7C2BA91BA482CB4BD1F2510DA00FB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Great Cats and Rare Canids Act of 2008</short-title></quote>.</text></section> 
<section id="H740B688B310640E5B7C0CD45E842D163"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are to provide financial resources and to foster international cooperation—</text> 
<paragraph id="HAC2530AD50D5422ABDA2A9E317F7ED1"><enum>(1)</enum><text>to restore and perpetuate healthy populations of rare felids and rare canids in the wild; and</text></paragraph> 
<paragraph id="H0759B359C4984655AC7D6ECA584729E4"><enum>(2)</enum><text>to assist in the conservation of rare felid and rare canid populations worldwide.</text></paragraph></section> 
<section id="H7369A2BC41D8447AA6E95699609BA0E4"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H27044FBE2B2E467F8B741CD820806C56"><enum>(1)</enum><header>CITES</header><text>The term <quote>CITES</quote> means the Convention on International Trade in Endangered Species of Wild Fauna and Flora, done at Washington March 3, 1973 (27 UST 1087; TIAS 8249), including its appendices.</text></paragraph> 
<paragraph id="HA00A300C90BF4F01B644FDF6C018F500"><enum>(2)</enum><header>Conservation</header><text>The term <quote>conservation</quote>—</text> 
<subparagraph id="H41E66BF4E84A4A13BCB6AE394DB71218"><enum>(A)</enum><text>means the methods and procedures necessary to bring a species of rare felid or rare canid to the point at which there are sufficient populations in the wild to ensure the long-term viability of the species; and</text></subparagraph> 
<subparagraph id="HD3B3E128126F4CE7BAC715593364786"><enum>(B)</enum><text>includes all activities associated with protection and management of a rare felid or rare canid population, including—</text> 
<clause id="HB6475865D22A43338DA6CE79DF476F8D"><enum>(i)</enum><text>maintenance, management, protection, and restoration of rare felid or rare canid habitat;</text></clause> 
<clause id="H8375A5CDC5AB4D16A695E800A53FC747"><enum>(ii)</enum><text>research and monitoring;</text></clause> 
<clause id="H1D22E5F20325437CBCA988AF929166E5"><enum>(iii)</enum><text>law enforcement;</text></clause> 
<clause id="HF9640A7363A9424A9DB745C9324D99B"><enum>(iv)</enum><text>community outreach and education;</text></clause> 
<clause id="H18956E60F4194C56A18768E34DDC25D8"><enum>(v)</enum><text>conflict resolution initiatives; and</text></clause> 
<clause id="HDAEEB8C6990B4B1BA4E9AE108B94ECF5"><enum>(vi)</enum><text>strengthening the capacity of local communities, governmental agencies, nongovernmental organizations and other institutions to implement conservation programs.</text></clause></subparagraph></paragraph> 
<paragraph id="HC6117117F923409BA28CC7B891896566"><enum>(3)</enum><header>Fund</header><text>The term <quote>Fund</quote> means the Great Cats and Rare Canids Conservation Fund established by section 5.</text></paragraph> 
<paragraph id="H1F5C3691C80846A3A25550CF8F7C22B1"><enum>(4)</enum><header>IUCN Red List</header><text>The term <quote>IUCN Red List</quote> means the Red List of Threatened Species Maintained by the World Conservation Union.</text></paragraph> 
<paragraph id="H13309F63DA0442C1A8390633FD0AAA9" display-inline="no-display-inline"><enum>(5)</enum><header>Rare canid</header><text>The term <quote>rare canid</quote>—</text> 
<subparagraph id="H7E14AD79AFAD43B083821C2274A24C6C"><enum>(A)</enum><text display-inline="yes-display-inline">except as provided in subparagraph (B), means any of the canid species dhole (Cuon alpinus), gray wolf (Canis lupus), Ethiopian wolf (Canis simensis), bush dog (Speothos venaticus), African wild dog (Lycaon pictus), maned wolf (Chrysocyon brachyurus), and Darwin's fox, (Pseudalopex fulvipes), including any subspecies or population of such a species; and</text></subparagraph> 
<subparagraph id="H9441F6A0D9814310B1D7574CD73C2F2B"><enum>(B)</enum><text>does not include any subspecies or population that is native to the area comprised of the United States and Canada or the European Union.</text></subparagraph></paragraph> 
<paragraph id="HDCE26D6FBA7946029E8772CDD4C01E90" display-inline="no-display-inline"><enum>(6)</enum><header>Rare felid</header><text>The term <quote>rare felid</quote>—</text> 
<subparagraph id="H6A3016CFC6EA44CF96C6A2EF42632FF"><enum>(A)</enum><text display-inline="yes-display-inline">except as provided in subparagraph (B), means any of the felid species lion (Panthera leo), leopard (Panthera pardus), jaguar (Panthera onca), snow leopard (Uncia uncia), clouded leopard (Neofelis nebulosa), cheetah (Acinonyx jubatus), Iberian lynx (Lynx pardina), and Borneo bay cat (Catopuma badia), including any subspecies or population of such a species; and</text></subparagraph> 
<subparagraph id="H85B3C0D6050D4936A343001295007048"><enum>(B)</enum><text>does not include—</text> 
<clause id="HA7B5173698B140019CAFC2C98D2C90EB"><enum>(i)</enum><text>any species, subspecies, or population that is native to the United States; and</text></clause> 
<clause id="H7513961407654310B5943803FCCC0607"><enum>(ii)</enum><text>any tiger (Panthera tigris).</text></clause></subparagraph></paragraph> 
<paragraph id="H1CE2A82712EE4DA4899C082F4390B0E2"><enum>(7)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Interior.</text></paragraph></section> 
<section id="H20F368232F1D40628FB8F6E4E4EDBBA1"><enum>4.</enum><header>Financial assistance</header> 
<subsection id="HD89EBE9A66A34E46979C11F3AAC4545"><enum>(a)</enum><header>In General</header><text>Subject to the availability of funds and in consultation with other appropriate Federal officials, the Secretary shall use amounts in the Fund to provide financial assistance for projects for the conservation of rare felid and rare canids for which project proposals are approved by the Secretary in accordance with this section.</text></subsection> 
<subsection id="H195CDE8E79B54BE700F020608DD83763"><enum>(b)</enum><header>Project Proposals</header><text></text> 
<paragraph id="HB3BE3AEC06874E97B56489F794E8C412"><enum>(1)</enum><header>Eligible applicants</header><text>A proposal for a project for the conservation of rare felid and canids may be submitted to the Secretary by—</text> 
<subparagraph id="H1A904C21290E4FE5824726FF69ECFA27"><enum>(A)</enum><text>any wildlife management authority of a country that has within its boundaries any part of the range of a rare felid or rare canid species, respectively; and</text></subparagraph> 
<subparagraph id="HAC92D7AA591E44809B55D14D13676E6D"><enum>(B)</enum><text>any person or group with the demonstrated expertise required for the conservation in the wild of rare felids or rare canids, respectively.</text></subparagraph></paragraph> 
<paragraph id="HB427C32FE06945A68CC41D2D370080"><enum>(2)</enum><header>Project proposals</header><text>To be considered for financial assistance for a project under this Act, an applicant shall submit a project proposal that includes—</text> 
<subparagraph id="HDD457BCE4FD34A9E9FC75954B15D3B15"><enum>(A)</enum><text>a concise statement of the purposes of the project;</text></subparagraph> 
<subparagraph id="HF87CEE701FDF4617B6C03F88EEE821BF"><enum>(B)</enum><text>the name of the individual responsible for conducting the project;</text></subparagraph> 
<subparagraph id="H9C51032545BE47ED94CCD181B1E2E29"><enum>(C)</enum><text>a description of the qualifications of the individuals who will conduct the project;</text></subparagraph> 
<subparagraph id="H455D73E713A14767BABDA9389333587"><enum>(D)</enum><text>a concise description of—</text> 
<clause id="H6C078C16C4164C168BB52C4CE4450084"><enum>(i)</enum><text>methods for project implementation and outcome assessment;</text></clause> 
<clause id="H33D2A69D94B9482CB5C4D8A5FAF3C23"><enum>(ii)</enum><text>staffing for the project;</text></clause> 
<clause id="H612B883078314BFD9956F4DCDE00C21D"><enum>(iii)</enum><text>the logistics of the project; and</text></clause> 
<clause id="HD77F606CB51A4528A4DEEDF53C16366"><enum>(iv)</enum><text>community involvement in the project;</text></clause></subparagraph> 
<subparagraph id="H8090B1282C35456C8C00781192D2B0B7"><enum>(E)</enum><text>an estimate of funds and time required to complete the project;</text></subparagraph> 
<subparagraph id="H083A62E961F34C70994019859B06E790"><enum>(F)</enum><text>evidence of support for the project by appropriate governmental entities of the countries in which the project will be conducted, if the Secretary determines that such support is required for the success of the project;</text></subparagraph> 
<subparagraph id="HA0E5795892444AD1B379DF1941A47407"><enum>(G)</enum><text>information regarding the source and amount of matching funding available for the project; and</text></subparagraph> 
<subparagraph id="HDAFD99E8ABE74E059DC8B2E6FA8F332B"><enum>(H)</enum><text>any other information that the Secretary considers to be necessary for evaluating the eligibility of the project for funding under this Act.</text></subparagraph></paragraph></subsection> 
<subsection id="HA61E4C89CBB34442ABC0FD81E2C8B27C"><enum>(c)</enum><header>Project Review and Approval</header> 
<paragraph id="H67E43059CFED4410BF41338679F8ECB"><enum>(1)</enum><header>In general</header><text>The Secretary shall—</text> 
<subparagraph id="H76D5455A3FCA44C4A72E92CCA3EB226F"><enum>(A)</enum><text>not later than 30 days after receiving a project proposal, provide a copy of the proposal to the appropriate Federal officials; and</text></subparagraph> 
<subparagraph id="H770F88C24D274DD1AF90F3EE5124A551"><enum>(B)</enum><text>review each project proposal in a timely manner to determine if the proposal meets the criteria specified in subsection (d).</text></subparagraph></paragraph> 
<paragraph id="H042A80FDBC294D1993C915DA01A42869"><enum>(2)</enum><header>Consultation; approval or disapproval</header><text>Not later than 180 days after receiving a project proposal, and subject to the availability of funds, the Secretary, after consulting with other appropriate Federal officials, shall—</text> 
<subparagraph id="H05AB1EA4B47F4759909CB3EF1ED570FA"><enum>(A)</enum><text>ensure the proposal contains assurances that the project will be implemented in consultation with relevant wildlife management authorities and other appropriate government officials with jurisdiction over the resources addressed by the project;</text></subparagraph> 
<subparagraph id="H624590069AC34882961962F64D8F329F"><enum>(B)</enum><text>approve or disapprove the proposal; and</text></subparagraph> 
<subparagraph id="H536E6EB1D2C94AF0970002E91472B714"><enum>(C)</enum><text>provide written notification of the approval or disapproval to the person who submitted the proposal, other appropriate Federal officials, and each country within whose borders the project will take place.</text></subparagraph></paragraph></subsection> 
<subsection id="H19B153CA723D4713AA02264180FBF7CD"><enum>(d)</enum><header>Criteria for Approval</header><text>The Secretary may approve a project proposal under this section if the project will contribute to conservation of rare felids or rare canids in the wild by assisting efforts to—</text> 
<paragraph id="H51DB8C516D5D4320804797BB81A5AB3"><enum>(1)</enum><text>implement conservation programs;</text></paragraph> 
<paragraph id="HDB407F9363114FA7913620FF5F8B0058"><enum>(2)</enum><text>address the conflicts between humans and rare felids or rare canids, respectively, that arise from competition for the same habitat or resources;</text></paragraph> 
<paragraph id="HEABB624628ED4B5FBD910266834C5ED6"><enum>(3)</enum><text>enhance compliance with CITES, the Endangered Species Act of 1973, and other applicable laws that prohibit or regulate the taking or trade of rare felids and rare canids or regulate the use and management of rare felid and rare canid habitat;</text></paragraph> 
<paragraph id="H9A55609C8B854DEAABF508F4831ED842"><enum>(4)</enum><text>develop sound scientific information on, or methods for monitoring—</text> 
<subparagraph id="H183CAF2C9EBA40F788FB60C507172DCC"><enum>(A)</enum><text>the condition and health of rare felid or rare canid habitat;</text></subparagraph> 
<subparagraph id="HE306021275484CC2973DA8C8D6E0D938"><enum>(B)</enum><text>rare felid or rare canid population numbers and trends; and</text></subparagraph> 
<subparagraph id="HADCC7A4C5C0F428592EE39A506384BA3"><enum>(C)</enum><text>the ecological characteristics and requirements of populations of rare felids or rare canids for which there are little or no data;</text></subparagraph></paragraph> 
<paragraph id="HD187EB9D0BC84DAFA5626EA792D654C6"><enum>(5)</enum><text>promote cooperative projects among government entities, affected local communities, nongovernmental organizations, and other persons in the private sector; or</text></paragraph> 
<paragraph id="H299C3ACF046844E2890049EC75B81C61"><enum>(6)</enum><text>funds will not be appropriated for the purchase or lease of lands to be used as suitable habitat for felids or canids.</text></paragraph></subsection> 
<subsection id="HB519E34921C34162931393BFBB03FA00"><enum>(e)</enum><header>Project Sustainability</header><text>In approving project proposals under this section, the Secretary shall give preference to conservation projects that are designed to ensure effective, long-term conservation of rare felids and rare canids and their habitats.</text></subsection> 
<subsection id="H5D91A7CA1DC64239AD74462807BB2C34"><enum>(f)</enum><header>Matching Funds</header><text>In determining whether to approve project proposals under this section, the Secretary shall give preference to projects for which there exists some measure of matching funds.</text></subsection> 
<subsection id="H4D60D7F9499F465EB73011BB4661DB1B"><enum>(g)</enum><header>Project Reporting</header> 
<paragraph id="H7449049624CC4862A6EF653E56E03C72"><enum>(1)</enum><header>In general</header><text>Each person that receives assistance under this section for a project shall submit to the Secretary periodic reports (at such intervals as the Secretary considers necessary) that include all information that the Secretary, after consultation with other appropriate government officials, determines is necessary to evaluate the progress and success of the project for the purposes of ensuring positive results, assessing problems, and fostering improvements.</text></paragraph> 
<paragraph id="H5D80087537714625B04368082B725ED2"><enum>(2)</enum><header>Availability to the public</header><text>Reports under paragraph (1), and any other documents relating to projects for which financial assistance is provided under this Act, shall be made available to the public.</text></paragraph></subsection> 
<subsection id="H9748C733EFC843B885E4F144D0A53811"><enum>(h)</enum><header>Limitations on Use for Captive Breeding or Display</header><text>Amounts provided as a grant under this Act—</text> 
<paragraph id="H356B9136CE8740099DD71539D9B672E6"><enum>(1)</enum><text>may not be used for captive breeding or display of rare felids and rare canids other than captive breeding for release into the wild; and</text></paragraph> 
<paragraph id="H32F1C181592B443FAA302B1CB700E0BB"><enum>(2)</enum><text>may be used for captive breeding of a species for release into the wild only if no other conservation method for the species is biologically feasible.</text></paragraph></subsection> 
<subsection id="H7A3F28A0418B46D18265FE7EF6F99389"><enum>(i)</enum><header>Advisory Group</header><text></text> 
<paragraph id="H6A2F6979274F4106A0C6C6C5247B4BE4"><enum>(1)</enum><header>In general</header><text>To assist in carrying out this Act, the Secretary may convene an advisory group consisting of individuals representing public and private organizations actively involved in the conservation of felids and canids.</text></paragraph> 
<paragraph id="H9B54F242B8634DBABB7C0089B120F545"><enum>(2)</enum><header>Public participation</header> 
<subparagraph id="HA3020F039DAE435C913B45879282A9C6"><enum>(A)</enum><header>Meetings</header><text>The advisory group shall—</text> 
<clause id="HA5BA18945B4D431F00FC009B6F89D63E"><enum>(i)</enum><text>ensure that each meeting of the advisory group is open to the public; and</text></clause> 
<clause id="H1DE6F06A11FA45AD98DA95A965905784"><enum>(ii)</enum><text>provide, at each meeting, an opportunity for interested persons to present oral or written statements concerning items on the agenda.</text></clause></subparagraph> 
<subparagraph id="HCA2F752F741F476DBF39E2419ED7CD11"><enum>(B)</enum><header>Notice</header><text>The Secretary shall provide to the public timely notice of each meeting of the advisory group, including the meeting agenda.</text></subparagraph> 
<subparagraph id="HE5040655E6DF4A1EA00000E8FABF0E0"><enum>(C)</enum><header>Minutes</header><text>Minutes of each meeting of the advisory group shall be kept by the Secretary and shall be made available to the public.</text></subparagraph></paragraph> 
<paragraph id="H61282BAF3C2D4C4C871D91C55E5C1331"><enum>(3)</enum><header>Exemption from Federal Advisory Committee Act</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the advisory group.</text></paragraph></subsection></section> 
<section id="H9619F4C57FF643DEB81496DFB6B6B600"><enum>5.</enum><header>Great Cats and Rare Canids Conservation Fund</header> 
<subsection id="HBC27D2FBA46245C70070EF87E9E5C24C"><enum>(a)</enum><header>Establishment</header><text>There is established, in the Multinational Species Conservation Fund established in title I of the Department of the Interior and Related Agencies Appropriations Act, 1999 under the heading <quote>MULTINATIONAL SPECIES CONSERVATION FUND</quote>, a separate account to be known as the <quote>Great Cats and Rare Canids Conservation Fund</quote>, consisting of—</text> 
<paragraph id="H4A5C5B73C866413D83ECBEFF07616907"><enum>(1)</enum><text>amounts transferred to the Secretary of the Treasury for deposit into such account under subsection (c); and</text></paragraph> 
<paragraph id="HA5EDB9BE14EF4F919332D3F3E5E84892"><enum>(2)</enum><text>amounts appropriated to such account under section 7.</text></paragraph></subsection> 
<subsection id="H65BCAEDD5E1B4347905D648BE5DB93B5"><enum>(b)</enum><header>Expenditures From Fund</header><text></text> 
<paragraph id="HC29F4623DCA84DF3ACA019105056D106"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), upon request by the Secretary, the Secretary of the Treasury shall transfer from the Fund to the Secretary, without further appropriation, such amounts as the Secretary determines are necessary to provide assistance under section 4.</text></paragraph> 
<paragraph id="H71362E5132FE4D9DB4B06516379F2234"><enum>(2)</enum><header>Administrative expenses</header><text>Of the amounts in the Fund available for each fiscal year, the Secretary may expend not more than three percent, or up to $100,000, whichever is greater, to pay the administrative expenses necessary to carry out this Act.</text></paragraph></subsection> 
<subsection id="HFD22710ADA414DF593093B8BAF49BF64"><enum>(c)</enum><header>Acceptance and Use of Donations</header><text>The Secretary may accept and use donations to provide assistance under section 4, and may make public on the Internet website and in publications of the Department of the Interior that the Secretary is authorized to accept and use such donations. Amounts received by the Secretary in the form of such donations shall be transferred to the Secretary of the Treasury for deposit into the Fund.</text></subsection></section> 
<section id="H8F1692F2AC314E2C94167079A67734C1"><enum>6.</enum><header>Study of conservation status of felid and canid species</header> 
<subsection id="HD2D3393BE07048F8B3209466F7624CDE"><enum>(a)</enum><header>In general</header><text>The Secretary shall initiate within three months after the date of the enactment of this Act a study of felid and canid species listed under the IUCN Red List that are not rare canids and rare felids (as those terms are defined in section 3), respectively, to determine—</text> 
<paragraph id="H496EF598F9654A55B703D5646787C7F1"><enum>(1)</enum><text>the conservation status of such species in the wild, including identification of any such species that are critically endangered or endangered; and</text></paragraph> 
<paragraph id="H5F947A645B204934802711ABE714A931"><enum>(2)</enum><text>any such species that should be made eligible for assistance under this Act.</text></paragraph></subsection> 
<subsection id="HDFFFC1B89A2C4E9A84F339CADD1DC25F"><enum>(b)</enum><header>Report</header><text>Not later than two years after date of the enactment of this Act the Secretary shall report to the Congress the determinations made in the study, including recommendations of additional felid species and canid species that should be made eligible for assistance under this Act.</text></subsection></section>
<section id="H052E808B6DA9432E832B577D9B26A46F"><enum>7.</enum><header>Authorization or appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated—</text> 
<paragraph id="H252BA2D37C82420FA52F47E5982B6944"><enum>(1)</enum><text>to the Fund, $5,000,000 for each of fiscal years 2009 through 2013 to carry out this Act, other than section 6; and</text></paragraph> 
<paragraph id="H478B9D17F4F54765BE5F64CFE2D3E35E"><enum>(2)</enum><text>such sums as are necessary to carry out section 6.</text></paragraph></section>
<section id="H8CCE21D726754F138BFF0957EADB976" display-inline="no-display-inline" section-type="subsequent-section"><enum>8.</enum><header>Ineligible countries</header><text display-inline="no-display-inline">Amounts provided as a grant under this Act may not be spent on projects in Iran, Syria, Cuba, Sudan, and North Korea.</text></section>
