<official-title>To improve Medicare beneficiary access by extending the 60 percent compliance threshold used to determine whether a hospital or unit of a hospital is an inpatient rehabilitation facility.</official-title>

<section id="H3259F4DB995346F08819C56DA4E00728" section-type="section-one"><enum>1.</enum><header>Extended phase-in of the inpatient rehabilitation facility classification criteria</header> 
<subsection id="H742ECAE3BB3C4A9EA307EBB240B6493"><enum>(a)</enum><header>In general</header><text>Section 5005 of the Deficit Reduction Act of 2005 is amended—</text> 
<paragraph id="H58FC021C1B994FBB975EB2E9BF63FA21"><enum>(1)</enum><text>in subsection (a), by striking <quote>apply the applicable percent specified in subsection (b)</quote> and inserting <quote>require a compliance rate that is no greater than the 60 percent compliance rate that became effective for cost reporting periods beginning on or after July 1, 2006</quote>; and</text></paragraph> 
<paragraph id="H365340C393AD4B648B8B62DDE47F9733"><enum>(2)</enum><text>by amending subsection (b) to read as follows:</text>

<subsection id="H0FCECF76CEFD4ECE8B76831C1940DFA9"><enum>(b)</enum><header>Continued use of comorbidities</header><text>For cost reporting periods beginning on or after July 1, 2008, the Secretary shall include patients with comorbidities as described in <external-xref legal-doc="regulation" parsable-cite="cfr/42/412.23">section 412.23(b)(2)(i)</external-xref> of title 42, Code of Federal Regulations (as in effect as of January 1, 2007), in the inpatient population that counts towards the percent specified in subsection (a).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H689CE427C1744D97AE3025D2C878AD5B"><enum>(b)</enum><header>Medical necessity criteria for beneficiaries served in rehabilitation hospitals and units</header><text>The Centers for Medicare &amp; Medicaid Services and Medicare fiscal intermediaries, Medicare administrative contractors, recovery audit contractors, and other government agents shall use and apply the criteria established in HCFA Ruling 85–2, as issued on July 31, 1985 (50 Fed. Reg. 31040), as the sole standard for determining the medical necessity of services provided by inpatient rehabilitation hospitals and units to Medicare beneficiaries under title XVIII of the Social Security Act.</text></subsection></section> 
<section id="HE4616DE2B1A8448E8072FE49FBAEDD47"><enum>2.</enum><header>Recommendations for classifying inpatient rehabilitation hospitals and units</header> 
<subsection id="H36171B4ED9B846B79E436F1B01219785"><enum>(a)</enum><header>Report to congress</header><text>Not later than 12 months after the date of the enactment of this Act, the Secretary of Health and Human Services, in consultation with physicians, administrators of inpatient rehabilitation and acute care hospitals, Medicare beneficiaries, and trade organizations representing inpatient rehabilitation hospitals and units, shall submit to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate a report that includes—</text> 
<paragraph id="H1F172A38AA514C0F9D9700DDE5B39222"><enum>(1)</enum><text>an examination of the impact of the 75 percent rule on the Medicare program and the specific impact of the rule on Medicare beneficiaries; and</text></paragraph> 
<paragraph id="H78759CE3EF2B436EBB65A78DCDDE485E"><enum>(2)</enum><text>alternatives to the 75 percent rule policy for determining exclusion criteria for inpatient rehabilitation hospital and unit designation under the Medicare program, including determining clinical appropriateness of inpatient rehabilitation hospital and unit admissions, and including alternative criteria based solely on a measure of a patient’s functional status which is independent of diagnosis.</text></paragraph><continuation-text continuation-text-level="subsection">For the purposes of this section, the term <term>75 percent rule</term> means the requirement of <external-xref legal-doc="regulation" parsable-cite="cfr/42/412.23">section 412.23(b)(2)</external-xref> of title 42, Code of Federal Regulations, that 75 percent of the patients of a rehabilitation hospital or converted rehabilitation unit are in 1 or more of 13 listed treatment categories.</continuation-text></subsection> 
<subsection id="HCEB975A02D914710B74FF94B8C859BF2"><enum>(b)</enum><header>Considerations</header><text>In developing the report described in subsection (a), the Secretary shall include the following:</text> 
<paragraph id="H9CBB02BC68F8431EA6B841B85E0DCC8"><enum>(1)</enum><text>The effect of the 75 percent rule on access to inpatient hospital rehabilitation care by Medicare beneficiaries and the effectiveness of care available to such beneficiaries in other health care settings.</text></paragraph> 
<paragraph id="H95B5C63598E5490296002241769666D2"><enum>(2)</enum><text>A comparative analysis of the overall Medicare system costs, including Medicare expenditures to acute care hospitals, home health agencies, skilled nursing facilities, and long-term care hospitals, resulting from implementation of the 75 percent rule.</text></paragraph> 
<paragraph id="HA5A59DF9C7B544589BA2AB47A06B6478"><enum>(3)</enum><text display-inline="yes-display-inline">A analysis that compares the quality, cost, and patient outcomes of inpatient rehabilitation services among different post-acute care settings, including whether the Medicare program and Medicare beneficiaries may incur higher costs of care for the entire episode of illness because of factors such as—</text> 
<subparagraph id="H14B97DBA12304F72B507E6D046348388"><enum>(A)</enum><text>readmissions to acute care hospitals that could have been avoided absent the 75 percent rule; or</text></subparagraph> 
<subparagraph id="H06E07A88F4994FC6B74920C1EDE60034"><enum>(B)</enum><text>extended lengths of stay in post-acute settings other than a rehabilitation hospital or unit because beneficiaries were denied access to care in such a hospital or unit due to the 75 percent rule.</text></subparagraph></paragraph></subsection></section> 
<section id="H88EDC6C6D7544636883C94CC5284C900"><enum>3.</enum><header>Technical correction for inpatient rehabilitation hospitals and units nomenclature</header> 
<subsection id="H01BBEE87B7F744C0BE95AEAFF4142F28"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1886(j) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(j)</external-xref>) is amended—</text> 
<paragraph id="H9D31EE76BD884A58B0D025E176C18F97"><enum>(1)</enum><text>in paragraph (1)(A), by striking <quote>(in this subsection referred to as a <quote>rehabilitation facility</quote>), other than a facility</quote> and inserting <quote>other than a hospital or unit</quote>;</text></paragraph> 
<paragraph id="H1B12D0E79E51465580C82670FCBA04D"><enum>(2)</enum><text>by striking <quote>rehabilitation facility</quote> and <quote>facility</quote> and inserting <quote>inpatient rehabilitation hospital or a rehabilitation unit</quote> and <quote>hospital or unit</quote>, respectively, each place it appears; </text></paragraph> 
<paragraph id="HC3AA993BD4594143A67F9E8C67770040"><enum>(3)</enum><text>by striking <quote>rehabilitation facilities</quote> and inserting <quote>inpatient rehabilitation hospitals or rehabilitation units</quote> each place it appears; and</text></paragraph> 
<paragraph id="H41A024B4B7EB43659F16009256EE7B8C"><enum>(4)</enum><text>in paragraph (6), by striking <quote>rehabilitation facilities’ costs</quote> and inserting <quote>costs of inpatient rehabilitation hospitals or rehabilitation units</quote>.</text></paragraph></subsection> 
<subsection id="H71AA08C305C74E3E84FC1DC59D7BD683"><enum>(b)</enum><header>Use of the term <term>IRH/U</term></header><text>The Secretary of Health and Human Services shall, under regulation and Medicare program guidance, use the term <term>inpatient rehabilitation hospital/unit</term> or <term>IRH/U</term> to refer to entities receiving payment for inpatient rehabilitation services under section 1886(j) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(j)</external-xref>).</text></subsection></section> 
<section id="H9BE32A0FBAEA44158307E6123369518B"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">Sections 1 and 3 of this Act shall take effect on July 1, 2007, and section 2 shall take effect on the date of the enactment of this Act.</text></section>
