<section display-inline="no-display-inline" id="HE4A0D369C6804CB497D392C338A9D19E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Choices in Child Care Act</short-title></quote>.</text></section> 
<section id="HDF2FEEE35085411B90C79CA4B1D35434"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="HC4969097D4FF44538E6D04C4CE75C306"><enum>(1)</enum><text>Currently, child care assistance for children from low-income working families is severely underfunded, allowing only 1 in 7 eligible children to receive child care assistance for children from birth to age 13.</text></paragraph> 
<paragraph id="H1F385C8C2F5C4246A83B11DBFEB03B58"><enum>(2)</enum><text>Funding for the Child Care and Development Block Grant Act of 1990 has remained relatively flat for 5 years, making it more difficult for children from eligible families to receive child care assistance.</text></paragraph> 
<paragraph id="HCB3E56DC31A247DDB3AFAE4EEB4C25EE"><enum>(3)</enum><text>In the majority of United States families, parents, whether married or single, must work to provide economic security for their families and, not the least, for the infants newly welcomed into the families. Fifty-five percent of women with children less than 1 year of age are part of the workforce, while 73 percent of women with children 1 year of age or older are in the workforce.</text></paragraph> 
<paragraph id="H2C52D4D2AA9F4FB8BA2BE5D6B5D3A72F"><enum>(4)</enum><text>Research shows that the quality and nature of caretaking in the first months and years of life are critical to a young child's subsequent brain development, social development, and well-being. Healthy early development depends on nurturing and responsible relationships.</text></paragraph> 
<paragraph id="HCCAA40B965DF459EB9F7293551B9FA66"><enum>(5)</enum><text>Research also shows that there is an extreme shortage of quality, affordable child care for infants. Numerous studies document lack of infant care and, in particular, affordable care that meets basic health and safety standards, particularly in rural areas. The current number of infant slots of licensed child care providers can only meet 18 percent of the potential need. The shortage is even more acute in rural areas, especially those with a high percentage of low-wage residents.</text></paragraph> 
<paragraph id="H852E02CD6A864CA1ACF97705F5472410"><enum>(6)</enum><text>For the well-being of United States children, and for the economic security of the families on which the children depend, working parents should be able to provide child care for infants themselves without undermining family economic stability.</text></paragraph></section> 
<section id="H1B3A1282435C4C81864B95CF34F9956F"><enum>3.</enum><header>At-home infant care</header><text display-inline="no-display-inline">The Child Care and Development Block Grant Act of 1990 is amended by inserting after section 658G (<external-xref legal-doc="usc" parsable-cite="usc/42/9858e">42 U.S.C. 9858e</external-xref>) the following:</text> 
<quoted-block display-inline="no-display-inline" id="H9F867633848F40AF85A8B0C5D7D71B6B" style="OLC"> 
<section id="H3AB2452A49264E09839255F40721A586"><enum>658H.</enum><header>Demonstration projects to provide at-home infant care benefits</header> 
<subsection id="HE1F973F2DDAC49D6841255AB3D32C846"><enum>(a)</enum><header>Authority To award grants</header> 
<paragraph id="H9A846A51F5C04BD0A18E9CA2CCA4EB00"><enum>(1)</enum><header>In general</header><text>The Secretary shall award grants to not less than 5 and not more than 7 States to enable such States to carry out demonstration projects to provide at-home infant care benefits to eligible low-income families.</text></paragraph> 
<paragraph id="HDE4D438812684F99A353BF989D60C966"><enum>(2)</enum><header>Indian tribes</header><text>The Secretary may award grants to Indian tribes under this subsection. An Indian tribe that receives a grant under this subsection shall carry out a demonstration project to provide at-home infant care benefits to eligible low-income families. The Indian tribe shall carry out the demonstration project in the same manner, and to the same extent, as a State that receives a grant under this subsection, except that the Secretary may modify the requirements of this section as appropriate with respect to the Indian tribe.</text></paragraph> 
<paragraph id="H327E8E32E3CA4A648944FFDC381B17D6"><enum>(3)</enum><header>Calculation</header><text>Any grant awarded to an Indian tribe under paragraph (2) shall not be counted in determining the number of grants awarded to States under paragraph (1).</text></paragraph></subsection> 
<subsection id="H24B9616BD4B24B4DAE25E94BF06C137B"><enum>(b)</enum><header>Demonstration projects</header> 
<paragraph id="H72B2E76D59014C84AC1BDF75545F45A7"><enum>(1)</enum><header>Application for participation and selection of States</header> 
<subparagraph id="H6626F254695A47718312A0CDB7CEBBC1"><enum>(A)</enum><header>In general</header><text>To be eligible to participate in the program carried out under this section and receive a grant under subsection (a) to carry out a demonstration project, a State shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require.</text></subparagraph> 
<subparagraph id="H5C98134827B0445191C693DC91EA5800"><enum>(B)</enum><header>Notice</header><text>Not later than 90 days after the date of enactment of Choices in Child Care Act, the Secretary shall publish in the Federal Register a notice of opportunity to participate in the program and receive such a grant, specifying the contents of an application described in subparagraph (A). The notice shall include a timeframe for States to submit such an application, and shall provide that all such applications shall be submitted not later than 270 days after such date of enactment.</text></subparagraph> 
<subparagraph id="H656EBFD3DA0641BA005CC2A069BAE480"><enum>(C)</enum><header>Selection</header> 
<clause id="HAB2F05E05FC546CA009F44BEDF477E81"><enum>(i)</enum><header>In general</header><text>The Secretary shall review the applications and select the participating States not later than 1 year after such date of enactment.</text></clause> 
<clause id="H7A1A758F05094219BB7DF848035C5179"><enum>(ii)</enum><header>Criteria</header><text>In selecting the participating States, the Secretary shall—</text> 
<subclause id="HDF4EAFE45A0B478F91788E8CA3F187F8"><enum>(I)</enum><text>seek to ensure geographic diversity; and</text></subclause> 
<subclause id="HA94B48AB261D44CF9DFF6D40D5AD1C72"><enum>(II)</enum><text>give priority to States—</text> 
<item id="HFB8CAA5B53E44105882C4C9927C781C4"><enum>(aa)</enum><text>whose applications demonstrate a strong commitment to improving the quality of infant care and the choices available to parents of infants;</text></item> 
<item id="H2A963E5836964DEF809B53E5E4647065"><enum>(bb)</enum><text>with experience relevant to the operation of at-home infant care programs; and</text></item> 
<item id="HBA208D810F4C48E0AFE26800459DE3BD"><enum>(cc)</enum><text>in which there are demonstrable shortages of infant care.</text></item></subclause></clause></subparagraph></paragraph> 
<paragraph id="H1980C33EEA0F42F98B2C1ED4DDEB4B61"><enum>(2)</enum><header>Required certifications</header><text>A State selected to be a participating State shall provide certifications to the Secretary, with respect to the demonstration project to be carried out by the State, that—</text> 
<subparagraph id="H365844E6BEF24420BF12695C8600B8DD"><enum>(A)</enum><text>during the period during which the State carries out the demonstration project, the State will not reduce expenditures for child care services below the level of such expenditures made by the State in the fiscal year preceding the fiscal year in which the State began to carry out the project;</text></subparagraph> 
<subparagraph id="H6BDCBFDA271E4E2284C4D3D1C02FDB8"><enum>(B)</enum><text>the State, in carrying out the demonstration project—</text> 
<clause id="HC53C7455601A4545B7DE6758871153F1"><enum>(i)</enum><text>will not give priority or preference to—</text> 
<subclause id="H9F450965C05C46E198C9F171F89B85A4"><enum>(I)</enum><text>eligible low-income families seeking to receive at-home infant care benefits through the demonstration project; over</text></subclause> 
<subclause id="H8DE6045375284E5A9E10ECC9A851797"><enum>(II)</enum><text>other eligible low-income families on a waiting list for child care assistance through another program in the State; but</text></subclause></clause> 
<clause id="H3A988A466E104D4CA8CAAE003392F5AD"><enum>(ii)</enum><text>will select a combination of families described in clause (i)(I) and families described in (i)(II) to receive at-home infant care benefits;</text></clause></subparagraph> 
<subparagraph id="H0CF8D9B49EAA49C687DB42BB9800E3E"><enum>(C)</enum><text>the State will—</text> 
<clause id="H8BB84A13941642D582888980D4B24E79"><enum>(i)</enum><text>provide parents applying to receive at-home infant care benefits with in- formation on the range of options for child care available to the parents;</text></clause> 
<clause id="HA674E49425E44A2F0013B84FF1D09330"><enum>(ii)</enum><text>ensure that approved applicants for at-home infant care benefits are permitted to choose between receipt of at-home infant care benefit subsidies, and receipt of certificates that may be used with an eligible child care provider for child care needed for employment; and</text></clause> 
<clause id="H2389724C1BB14A83BE4176FB3729C32F"><enum>(iii)</enum><text>provide that a family receiving at-home infant care benefit subsidies may exchange the subsidies for certificates described in clause (ii) at any time during the family’s participation in the demonstration project;</text></clause></subparagraph> 
<subparagraph id="H43620E021C1D4855B348A5D5B512D561"><enum>(D)</enum><text>the State will develop or update, and implement, a plan to improve the quality of infant care in the State, and provide parent education and support services to participants in the demonstration project; and</text></subparagraph> 
<subparagraph id="H6A9F97B8EC5B41A58883E300C01223A3"><enum>(E)</enum><text>the State will cooperate with information collection and evaluations conducted by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="H1D6D46C4454D47939ED6730494C9B8CD"><enum>(3)</enum><header>Family eligibility</header> 
<subparagraph id="H13CB1C4D8E554F5B85723C6E5BA78188"><enum>(A)</enum><header>In general</header><text>To be eligible to receive at-home infant care benefits through a demonstration project under this section, a family shall—</text> 
<clause id="H8139894F26BB42C2A5B82BDECDC525A0"><enum>(i)</enum><text>have a family income that does not exceed the limit specified in section 658P(4)(B);</text></clause> 
<clause id="H2204CAF210D64DC8ADB2678EEB266B5"><enum>(ii)</enum><text>include a child under the age of 12 months (or, at the election of the State carrying out the demonstration project, under the age of 24 months);</text></clause> 
<clause id="HB76DD2F0E67C40938217CEAFBF7EBDA8"><enum>(iii)</enum><text>include a parent who had a recent work history (as determined in accordance with the State's requirements for such a work history) prior to application for the at-home infant care benefits; and</text></clause> 
<clause id="H28573EE8C90D486293E6E9D164873409"><enum>(iv)</enum><text>meet such other eligibility requirements as the State may establish.</text></clause></subparagraph> 
<subparagraph id="H7A59E4570F3F45DCA0F2F17DFB617B27"><enum>(B)</enum><header>Two-Parent families</header><text>A State selected to carry out a demonstration project under this section shall permit 2-parent families to participate in the project but may not limit participation in the project to such families.</text></subparagraph></paragraph> 
<paragraph changed="not-changed" id="HB11CAEC2B8A540E5B289B9CAFE721DFF"><enum>(4)</enum><header>Amount of assistance</header><text>The amount of an at-home infant care benefit provided to an eligible low-income family under this section for a month shall not exceed the monthly amount obtained by applying 100 percent of the State’s maximum rate for a licensed family child care provider for full-time infant care.</text></paragraph> 
<paragraph id="H2E7F67D442E044578B853F2454C174AE"><enum>(5)</enum><header>TANF assistance</header><text>The receipt of an at-home infant care benefit under this section shall not be considered to be assistance for any purpose under the program of block grants to States for temporary assistance for needy families established under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>).</text></paragraph> 
<paragraph id="HD2316D113F1C4E809C70DD9310EEC263"><enum>(6)</enum><header>Benefit not treated as income</header><text>Notwithstanding any other provision of law, the value of an at-home infant care benefit shall not be treated as income for purposes of any Federal or federally-assisted program that bases eligibility, or the amount of benefits or services provided, on need.</text></paragraph></subsection> 
<subsection id="H032F4DCFF4D743159DEF040117D834A8"><enum>(c)</enum><header>Evaluation and report to Congress</header> 
<paragraph id="HA7D4880A1A9F4BA1BADEDC00397143E9"><enum>(1)</enum><header>In general</header><text>The Secretary shall conduct an evaluation of the demonstration projects carried out under this section and submit a report to Congress containing the results of such evaluation not later than 4 years after the date of enactment of Choices in Child Care Act.</text></paragraph> 
<paragraph id="H9AE7F51102CF48ABBE3880458BEDDDB"><enum>(2)</enum><header>Requirements</header><text>In conducting the evaluation, the Secretary shall examine the following:</text> 
<subparagraph id="H63B6C260BD784555883475F14366B3AB"><enum>(A)</enum><text>Implementation experiences of the States carrying out the demonstration projects in developing and operating projects providing at-home infant care benefits, including design issues and issues in coordinating at-home infant care benefits provided under this section with benefits provided or funded under another provision of this Act in the State.</text></subparagraph> 
<subparagraph id="H029C7466B3DB4B02B464A12245843006"><enum>(B)</enum><text>The characteristics of families seeking to participate and participating in the demonstration projects providing at-home infant care benefits funded under this section.</text></subparagraph> 
<subparagraph id="HDF719C4CF1D14F5C9D9C0181BB7C81C0"><enum>(C)</enum><text>The length of participation by families in such demonstration projects and the reasons for the families ceasing to participate in the demonstration projects.</text></subparagraph> 
<subparagraph id="H9214CA49E4E9475CB39C7FD9C1051EFF"><enum>(D)</enum><text>The prior and subsequent employment of the participating families and the effect of the demonstration project participation on subsequent employment of the families.</text></subparagraph> 
<subparagraph id="H62866F488CE04013B1E6085C12AE0052"><enum>(E)</enum><text>The costs and benefits of the demonstration projects.</text></subparagraph> 
<subparagraph id="HFA73B689B06844F6A436830947D2D00"><enum>(F)</enum><text>The effectiveness of State efforts (including tribal efforts) to improve the quality of infant care during the periods in which the demonstration projects are carried out.</text></subparagraph></paragraph> 
<paragraph id="HF72BA041561A40769F51A273F53B2F09"><enum>(3)</enum><header>Reservation of funds</header><text>From the amount appropriated under section 658B(b) for a fiscal year, the Secretary shall reserve $1,000,000 for purposes of conducting the evaluation required under this subsection.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section commented="no" id="H5E149B7781684206AAC3FEB5BD3F16D2"><enum>4.</enum><header>Authorization of appropriations and conforming amendments</header> 
<subsection commented="no" id="HC2A339576C0B41B5BEBA59F438484420"><enum>(a)</enum><header>Authorization of appropriations</header><text>Section 658B of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858">42 U.S.C. 9858</external-xref>) is amended—</text> 
<paragraph commented="no" id="H482D8C372B584B21974948EEFE233C00"><enum>(1)</enum><text>by inserting:</text> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H2625E1DC2E3643F2B510ABD06C00253D"><enum><quote>(a)<header-in-text level="subsection" style="OLC"> In General.—</header-in-text></quote></enum><text>before <quote>There is</quote>;</text></subparagraph></paragraph>

<subparagraph commented="no" id="H0F04C186FCD34380A337AE76FDD1CFE"><enum>(A)</enum><text>in paragraph (1), by striking <quote>under this subchapter</quote> and inserting <quote>under section 658B(a)</quote>; and</text></subparagraph>
