<section display-inline="no-display-inline" id="H158AA767AEF749619C095D3E991D7485" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>District of Columbia House Voting Rights Act of 2007</short-title></quote>.</text></section> 
<section id="H64305D3060BA4FD1BFF900AD8180C0F2" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds as follows:</text> 
<paragraph id="HA032113230154F10808FF00009355BB"><enum>(1)</enum><text>Over half a million people living in the District of Columbia, the capital of our democratic Nation, lack direct voting representation in the United States Senate and House of Representatives.</text> </paragraph>
<paragraph id="H4AC160A241F44308A436ABB9FC72791D"><enum>(2)</enum><text>District of Columbia residents have fought and died to defend our democracy in every war since the War of Independence.</text> </paragraph>
<paragraph id="HA8A0531DD6504A7781954F1977FBBC54"><enum>(3)</enum><text>District of Columbia residents pay billions of dollars in Federal taxes each year.</text> </paragraph>
<paragraph id="H4804DED4C5774269B17248E7D8082595"><enum>(4)</enum><text>Our Nation is founded on the principles of <quote>one person, one vote</quote> and <quote>government by the consent of the governed</quote>.</text> </paragraph></section>
<section display-inline="no-display-inline" id="H0E7B1E46C0904A6881C5A46C57A923CD" section-type="subsequent-section"><enum>3.</enum><header>Treatment of District of Columbia as Congressional district</header> 
<subsection id="H1E87CC20FA90473791E18B256589BF00"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, the District of Columbia shall be considered a Congressional district for purposes of representation in the House of Representatives.</text> </subsection>
<subsection id="HED7CC70FB2EC4913AA00BCC3F13242DE"><enum>(b)</enum><header>Conforming Amendments Relating to Apportionment of Members of House of Representatives</header> 
<paragraph id="H598B548474FC43F4B25E26AC1EEC241"><enum>(1)</enum><header>Inclusion of single District of Columbia member in reapportionment of members among States</header><text display-inline="yes-display-inline">Section 22 of the Act entitled <quote>An Act to provide for the fifteenth and subsequent decennial censuses and to provide for apportionment of Representatives in Congress</quote>, approved June 28, 1929 (<external-xref legal-doc="usc" parsable-cite="usc/2/2a">2 U.S.C. 2a</external-xref>), is amended by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="H8B17ADBCAF39405F89E5AC5D41A4AF74" style="traditional"> 
<subsection id="HEBD75FC3C48043AEA722CAE5AE4C286B"><enum>(d)</enum><text>This section shall apply with respect to the District of Columbia in the same manner as this section applies to a State, except that the District of Columbia may not receive more than one Member under any reapportionment of Members.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph>
<paragraph id="HF5EEF7BF9971420CA86DC189250006C3"><enum>(2)</enum><header>Clarification of determination of number of Presidential electors on basis of 23rd Amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/3/3">Section 3</external-xref> of title 3, United States Code, is amended by striking <quote>come into office;</quote> and inserting the following: <quote>come into office (subject to the twenty-third article of amendment to the Constitution of the United States in the case of the District of Columbia);</quote>.</text> </paragraph></subsection>
<subsection id="H77829F47E16540948EA617F06645BE0"><enum>(c)</enum><header>Conforming amendments regarding appointments to service academies</header> 
<paragraph id="HA99E349E00C84F61B1AF8246DBC4B906"><enum>(1)</enum><header>United States military academy</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/4342">Section 4342</external-xref> of title 10, United States Code, is amended—</text> 
<subparagraph id="HE6B8F5A8B10A42948324A9B86769D52"><enum>(A)</enum><text>in subsection (a), by striking paragraph (5); and</text> </subparagraph>
<subparagraph id="H192C619C74E84F0C00B29725AE646CA"><enum>(B)</enum><text>in subsection (f), by striking <quote>the District of Columbia,</quote>.</text> </subparagraph></paragraph>
<paragraph id="HAE4DC1CF6FA1436E8120ECE3A17E4D43"><enum>(2)</enum><header>United States naval academy</header><text>Such title is amended—</text> 
<subparagraph id="H1580F47A52EF4F85ADFD91CECD4618B2"><enum>(A)</enum><text>in section 6954(a), by striking paragraph (5); and</text> </subparagraph>
<subparagraph id="H5A835CCB27B84C56A069EB0007ABC289"><enum>(B)</enum><text>in section 6958(b), by striking <quote>the District of Columbia,</quote>.</text> </subparagraph></paragraph>
<paragraph id="HFA1315991CAD4C22AE39EBEF89E3EB6D"><enum>(3)</enum><header>United States air force academy</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/9342">Section 9342</external-xref> of title 10, United States Code, is amended—</text> 
<subparagraph id="H2761964026824BDA8EADBA96157DC8C6"><enum>(A)</enum><text>in subsection (a), by striking paragraph (5); and</text> </subparagraph>
<subparagraph id="H784026B97F964C898876A83CB681602D"><enum>(B)</enum><text>in subsection (f), by striking <quote>the District of Columbia,</quote>.</text> </subparagraph></paragraph>
<paragraph id="HBD71330CE69647A48613A20365CD251"><enum>(4)</enum><header>Effective date</header><text display-inline="yes-display-inline">This subsection and the amendments made by this subsection shall take effect on the date on which a Representative from the District of Columbia takes office for the One Hundred Tenth Congress.</text> </paragraph></subsection></section>
<section display-inline="no-display-inline" id="H91F94979CF0241D9B574EB00B0397A2" section-type="subsequent-section"><enum>4.</enum><header>Increase in Membership of House of Representatives</header> 
<subsection id="H9D6B2AB4FB9D44819B88C3C69FDFDF33"><enum>(a)</enum><header>Permanent Increase in Number of Members</header><text>Effective with respect to the One Hundred Tenth Congress and each succeeding Congress, the House of Representatives shall be composed of 437 Members, including any Members representing the District of Columbia pursuant to section 3(a).</text> </subsection>
<subsection id="H2611D0B77AF248A1B290210900C2ADFC"><enum>(b)</enum><header>Reapportionment of Members Resulting From Increase</header> 
<paragraph id="HA8B0038018CC471FADBFAEA2E029C230"><enum>(1)</enum><header>In general</header><text>Section 22(a) of the Act entitled <quote>An Act to provide for the fifteenth and subsequent decennial censuses and to provide for apportionment of Representatives in Congress</quote>, approved June 28, 1929 (<external-xref legal-doc="usc" parsable-cite="usc/2/2a">2 U.S.C. 2a(a)</external-xref>), is amended by striking <quote>the then existing number of Representatives</quote> and inserting <quote>the number of Representatives established with respect to the One Hundred Tenth Congress</quote>.</text> </paragraph>
<paragraph id="H9C5864294F204BDEA8A7A588EBC258FD"><enum>(2)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall apply with respect to the regular decennial census conducted for 2010 and each subsequent regular decennial census.</text> </paragraph></subsection>
<subsection id="H0015E9E9816B4F57B865011937FFC024"><enum>(c)</enum><header>Special Rules for Period Prior to 2012 Reapportionment</header> 
<paragraph id="H607D9334ED8E43F4AA3025CDAB991F84"><enum>(1)</enum><header>Transmittal of revised statement of apportionment by President</header><text>Not later than 30 days after the date of the enactment of this Act, the President shall transmit to Congress a revised version of the most recent statement of apportionment submitted under section 22(a) of the Act entitled <quote>An Act to provide for the fifteenth and subsequent decennial censuses and to provide for apportionment of Representatives in Congress</quote>, approved June 28, 1929 (<external-xref legal-doc="usc" parsable-cite="usc/2/2a">2 U.S.C. 2a(a)</external-xref>), to take into account this Act and the amendments made by this Act.</text> </paragraph>
<paragraph id="H927820BB5F52404F9E42A775C545B087"><enum>(2)</enum><header>Report by clerk</header><text>Not later than 15 calendar days after receiving the revised version of the statement of apportionment under paragraph (1), the Clerk of the House of Representatives, in accordance with section 22(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/2a">2 U.S.C. 2a(b)</external-xref>), shall send to the executive of each State a certificate of the number of Representatives to which such State is entitled under section 22 of such Act, and shall submit a report to the Speaker of the House of Representatives identifying the State (other than the District of Columbia) which is entitled to one additional Representative pursuant to this section.</text> </paragraph>
<paragraph display-inline="no-display-inline" id="H1ABD25C87B2C46F1BAA8EC586FBFF174"><enum>(3)</enum><header>Requirements for election of additional member</header><text display-inline="yes-display-inline">During the One Hundred Tenth Congress, the One Hundred Eleventh Congress, and the One Hundred Twelfth Congress—</text> 
<subparagraph id="H67EA643A9D2841D397B1305258B204D2"><enum>(A)</enum><text>notwithstanding the Act entitled <quote>An Act for the relief of Doctor Ricardo Vallejo Samala and to provide for congressional redistricting</quote>, approved December 14, 1967 (<external-xref legal-doc="usc" parsable-cite="usc/2/2c">2 U.S.C. 2c</external-xref>), the additional Representative to which the State identified by the Clerk of the House of Representatives in the report submitted under paragraph (2) is entitled shall be elected from the State at large; and</text> </subparagraph>
<subparagraph id="HF6D29E3659DD45EBBB8266D160977CD9"><enum>(B)</enum><text>the other Representatives to which such State is entitled shall be elected on the basis of the Congressional districts in effect in the State for the One Hundred Ninth Congress.</text> </subparagraph></paragraph></subsection>
<subsection display-inline="no-display-inline" id="H73570D43933443F30024397B9BBE8F73"><enum>(d)</enum><header>Seating of New Members</header><text display-inline="yes-display-inline">The first Representative from the District of Columbia and the first additional Representative to which the State identified by the Clerk of the House of Representatives in the report submitted under subsection (c) is entitled shall each be sworn in and seated as Members of the House of Representatives on the same date.</text> </subsection></section>
<section display-inline="no-display-inline" id="HE0B7C542F4794563B042339190FA5EBB" section-type="subsequent-section"><enum>5.</enum><header>Repeal of office of District of Columbia delegate</header> 
<subsection id="H0A650EB5C8304E348B8FB2CA41D4471E"><enum>(a)</enum><header>Repeal of Office</header> 
<paragraph id="H26E06527EC834BE8B7E48E2D0811D6A6"><enum>(1)</enum><header>In general</header><text>Sections 202 and 204 of the District of Columbia Delegate Act (<external-xref legal-doc="public-law" parsable-cite="pl/91/405">Public Law 91–405</external-xref>; sections 1–401 and 1–402, D.C. Official Code) are repealed, and the provisions of law amended or repealed by such sections are restored or revived as if such sections had not been enacted.</text> </paragraph>
<paragraph display-inline="no-display-inline" id="H7BEF2EE1C32C436D9ED50057B6392300"><enum>(2)</enum><header>Effective date</header><text>The amendments made by this subsection shall take effect on the date on which a Representative from the District of Columbia takes office for the One Hundred Tenth Congress.</text> </paragraph></subsection>
<subsection id="H829A046D56C04519B2B422107DE08097"><enum>(b)</enum><header>Conforming amendments to District of Columbia Elections Code of 1955</header><text>The District of Columbia Elections Code of 1955 is amended as follows:</text> 
<paragraph id="H349E3672F16F460CA2293999D7AE18D9"><enum>(1)</enum><text>In section 1 (sec. 1–1001.01, D.C. Official Code), by striking <quote>the Delegate to the House of Representatives,</quote> and inserting <quote>the Representative in the Congress,</quote>.</text> </paragraph>
<paragraph id="H91E0DB2A491A4CF580B4FFDFA8C3410"><enum>(2)</enum><text>In section 2 (sec. 1–1001.02, D.C. Official Code)—</text> 
<subparagraph id="HF8926FE2FC7347858E417B5441C958FC"><enum>(A)</enum><text>by striking paragraph (6); and</text> </subparagraph>
<subparagraph id="H4C6E80667B414ED3AFA51B4D49028E63"><enum>(B)</enum><text>in paragraph (13), by striking <quote>the Delegate to Congress for the District of Columbia,</quote> and inserting <quote>the Representative in the Congress,</quote>.</text> </subparagraph></paragraph>
<paragraph id="HAC5846CCE9DB466B88EEC522AED4F229"><enum>(3)</enum><text>In section 8 (sec. 1–1001.08, D.C. Official Code)—</text>

<paragraph id="HD504D5AE1468431592BB81174B1B0173"><enum>(1)</enum><text>By striking <quote>offices of Senator and Representative</quote> each place it appears in subsection (d) and inserting <quote>office of Senator</quote>.</text> </paragraph>
<paragraph id="HA81A83576DC246F3BB85D38D0068D2D"><enum>(2)</enum><text>In subsection (d)(2)—</text>

<section id="H3448EC04E5D0416185E53F9BBC300719" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds as follows:</text> 
<paragraph id="H5182E1803CF84D85975D95AF110058AC"><enum>(1)</enum><text>Over half a million people living in the District of Columbia, the capital of our democratic Nation, lack direct voting representation in the United States Senate and House of Representatives.</text></paragraph> 
<paragraph id="HB03F2400480E438294E76114339BFE4"><enum>(2)</enum><text>District of Columbia residents have fought and died to defend our democracy in every war since the War of Independence.</text></paragraph> 
<paragraph id="H2690E1101817423F9457EE4D93591F19"><enum>(3)</enum><text>District of Columbia residents pay billions of dollars in Federal taxes each year.</text></paragraph> 
<paragraph id="H8D9711D0CFE64C5EBC7F49B5F5DE9A6"><enum>(4)</enum><text>Our Nation is founded on the principles of <quote>one person, one vote</quote> and <quote>government by the consent of the governed</quote>.</text></paragraph></section> 
<section display-inline="no-display-inline" id="H370EA7C3C5354B479EDFDA9BBF9F1171" section-type="subsequent-section"><enum>3.</enum><header>Treatment of District of Columbia as Congressional district</header> 
<subsection id="H2B446BD4CF8B4F2A9924AAAE729FA1A8" display-inline="no-display-inline"><enum>(a)</enum><header>Representation in House of Representatives</header> 
<paragraph id="HF8AF207788204B5796D101D05EA94582"><enum>(1)</enum><header>In general</header><text>Whereas the District of Columbia is drawn from the State of Maryland, notwithstanding any other provision of law, the District of Columbia shall be considered a Congressional district for purposes of representation in the House of Representatives.</text></paragraph> 
<paragraph id="HD771C325CAF3469EB9E21C7423414DF8"><enum>(2)</enum><header>No representation provided in Senate</header><text>The District of Columbia shall not be considered a State for purposes of representation in the Senate.</text></paragraph></subsection> 
<subsection id="H6026AB23CA8E4039A0668E007184392E"><enum>(b)</enum><header>Conforming Amendments Relating to Apportionment of Members of House of Representatives</header> 
<paragraph id="H3C3DCBAADA60460E818C8B00C2D2E07D"><enum>(1)</enum><header>Inclusion of single District of Columbia member in reapportionment of members among States</header><text display-inline="yes-display-inline">Section 22 of the Act entitled <quote>An Act to provide for the fifteenth and subsequent decennial censuses and to provide for apportionment of Representatives in Congress</quote>, approved June 28, 1929 (<external-xref legal-doc="usc" parsable-cite="usc/2/2a">2 U.S.C. 2a</external-xref>), is amended by adding at the end the following new subsection:</text>

<section display-inline="no-display-inline" id="HCA2CDFCFDEC34B429FD263151768A1A6" section-type="subsequent-section"><enum>4.</enum><header>Increase in Membership of House of Representatives</header> 
<subsection id="H9DB91C6F881045C7BE6D83B6B5DDD527"><enum>(a)</enum><header>Permanent Increase in Number of Members</header><text>Effective with respect to the One Hundred Tenth Congress and each succeeding Congress, the House of Representatives shall be composed of 437 Members, including any Members representing the District of Columbia pursuant to section 3(a).</text></subsection> 
<subsection id="H2E1F8A93BE0D470E9685E7A42B455392"><enum>(b)</enum><header>Reapportionment of Members Resulting From Increase</header> 
<paragraph id="HAE4D11B75CA842F5B001884FB669E9E1"><enum>(1)</enum><header>In general</header><text>Section 22(a) of the Act entitled <quote>An Act to provide for the fifteenth and subsequent decennial censuses and to provide for apportionment of Representatives in Congress</quote>, approved June 28, 1929 (<external-xref legal-doc="usc" parsable-cite="usc/2/2a">2 U.S.C. 2a(a)</external-xref>), is amended by striking <quote>the then existing number of Representatives</quote> and inserting <quote>the number of Representatives established with respect to the One Hundred Tenth Congress</quote>.</text></paragraph> 
<paragraph id="HFEE93BEA9DD7494CABCEB4B83137F773"><enum>(2)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall apply with respect to the regular decennial census conducted for 2010 and each subsequent regular decennial census.</text></paragraph></subsection> 
<subsection id="H80B1C8B9E03649E5BF85EF528116EB75"><enum>(c)</enum><header>Special Rules For Period Prior to 2012 Reapportionment</header> 
<paragraph id="HA721E6317A744F3FAC9F00915E0034EE"><enum>(1)</enum><header>Transmittal of revised statement of apportionment by President</header><text>Not later than 30 days after the date of the enactment of this Act, the President shall transmit to Congress a revised version of the most recent statement of apportionment submitted under section 22(a) of the Act entitled <quote>An Act to provide for the fifteenth and subsequent decennial censuses and to provide for apportionment of Representatives in Congress</quote>, approved June 28, 1929 (<external-xref legal-doc="usc" parsable-cite="usc/2/2a">2 U.S.C. 2a(a)</external-xref>), to take into account this Act and the amendments made by this Act.</text></paragraph> 
<paragraph id="HCC5302512A804A3DB5CCA8D49409209E"><enum>(2)</enum><header>Report by clerk</header><text>Not later than 15 calendar days after receiving the revised version of the statement of apportionment under paragraph (1), the Clerk of the House of Representatives, in accordance with section 22(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/2a">2 U.S.C. 2a(b)</external-xref>), shall send to the executive of each State a certificate of the number of Representatives to which such State is entitled under section 22 of such Act, and shall submit a report to the Speaker of the House of Representatives identifying the State (other than the District of Columbia) which is entitled to one additional Representative pursuant to this section.</text></paragraph> 
<paragraph display-inline="no-display-inline" id="H89B0E0069C524145AD2486D7C527F6C"><enum>(3)</enum><header>Requirements for election of additional member</header><text display-inline="yes-display-inline">During the One Hundred Tenth Congress, the One Hundred Eleventh Congress, and the One Hundred Twelfth Congress—</text> 
<subparagraph id="HF995955014D949958D1BC7A12E1804CB"><enum>(A)</enum><text>notwithstanding the Act entitled <quote>An Act for the relief of Doctor Ricardo Vallejo Samala and to provide for congressional redistricting</quote>, approved December 14, 1967 (<external-xref legal-doc="usc" parsable-cite="usc/2/2c">2 U.S.C. 2c</external-xref>), the additional Representative to which the State identified by the Clerk of the House of Representatives in the report submitted under paragraph (2) is entitled shall be elected from the State at large; and</text></subparagraph> 
<subparagraph id="HFD6556DB2D4B498BA7D42FE5CC9E6FC"><enum>(B)</enum><text>the other Representatives to which such State is entitled shall be elected on the basis of the Congressional districts in effect in the State for the One Hundred Ninth Congress.</text></subparagraph></paragraph></subsection> 
<subsection id="H1FE245EEBC5F467A806BE58EF35336E9" display-inline="no-display-inline"><enum>(d)</enum><header>Seating of New Members</header><text display-inline="yes-display-inline">The first Representative from the District of Columbia and the first additional Representative to which the State identified by the Clerk of the House of Representatives in the report submitted under subsection (c) is entitled shall each be sworn in and seated as Members of the House of Representatives on the same date.</text></subsection></section> 
<section display-inline="no-display-inline" id="H1DB1F648B8064DD1B2434CF95278E8ED" section-type="subsequent-section"><enum>5.</enum><header>Repeal of office of District of Columbia delegate</header> 
<subsection id="H257323DD86F040FA8B3095725DE0099B"><enum>(a)</enum><header>Repeal of Office</header> 
<paragraph id="H9BFB4F0982694E85948E68ED2E0419F6"><enum>(1)</enum><header>In general</header><text>Sections 202 and 204 of the District of Columbia Delegate Act (<external-xref legal-doc="public-law" parsable-cite="pl/91/405">Public Law 91–405</external-xref>; sections 1–401 and 1–402, D.C. Official Code) are repealed, and the provisions of law amended or repealed by such sections are restored or revived as if such sections had not been enacted.</text></paragraph> 
<paragraph id="H27F4848641644059BF7921844767B4D5" display-inline="no-display-inline"><enum>(2)</enum><header>Effective date</header><text>The amendments made by this subsection shall take effect on the date on which a Representative from the District of Columbia takes office for the One Hundred Tenth Congress.</text></paragraph></subsection>
