		<legis-type>A BILL</legis-type>
		<official-title>To amend title 10, United States Code, to reduce the
		  eligibility age for receipt of non-regular military service retired pay for
		  members of the Ready Reserve in active federal status or on active duty for
		  significant periods.</official-title>

		<section display-inline="no-display-inline" id="H640E3454FBF74A6E8579C26DE555AD60" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National Guard and Reserve Retirement
			 Modernization Act</short-title></quote>.</text>
		</section><section id="H5613F99DD6EE4D8FBE8CB809F3E7382D" section-type="subsequent-section"><enum>2.</enum><header>Commencement of
			 receipt of Non-Regular service retired pay by members of the Ready Reserve on
			 active Federal status or active duty for significant periods</header>
			<subsection id="H868F1B4E9FDB4641A99603A2AD2D8091"><enum>(a)</enum><header>Reduced
			 Eligibility Age</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/12731">Section 12731</external-xref> of title 10, United States Code, is
			 amended—</text>
				<paragraph id="H3959D15C12DD45DF9EB4DDD25A360A2"><enum>(1)</enum><text>in
			 subsection (a), by striking paragraph (1) and inserting the following:</text>
					<quoted-block id="H6EE65DF6FACA4E84BA2C06B01895BFD4" style="OLC">
						<paragraph id="HC48F4EC48D614E3AABE7689BEAC59B02"><enum>(1)</enum><text>has attained the
				eligibility age applicable under subsection (f) to that
				person;</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HCAD8E3232FF2464A00F08379CF70DDB7"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
					<quoted-block id="H8CD0B13B5D3D44DCB9FCC496DAFFFD0" style="OLC">
						<subsection id="HF7C535D132F941FC91E1E2BE3FD56C1B"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HBDEDC97E717F4651827301CBD2E636B"><enum>(1)</enum><text>Subject to paragraph (2),
				the eligibility age for purposes of subsection (a)(1) is 60 years of
				age.</text>
							</paragraph><paragraph id="HC46177E1CF634CF4983E84C2900424F" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HD7026634CA564EE9A06E4880E12EC500"><enum>(A)</enum><text>In the case of a person
				who as a member of the Ready Reserve serves on active duty or performs active
				service described in subparagraph (B) after September 11, 2001, the eligibility
				age for purposes of subsection (a)(1) shall be reduced below 60 years of age by
				three months for each aggregate of 90 days on which such person so performs in
				any fiscal year after such date, subject to subparagraph (C). A day of duty may
				be included in only one aggregate of 90 days for purposes of this
				subparagraph.</text>
								</subparagraph><subparagraph id="HE6A1DE232B164AC9B514B038820000AD" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H061D115DE0FF4D9C8F99FA233D72004C"><enum>(i)</enum><text>Service on active duty
				described in this subparagraph is service on active duty pursuant to a call or
				order to active duty under a provision of law referred to in section
				101(a)(13)(B) or under section 12301(d) of this title. Such service does not
				include service on active duty pursuant to a call or order to active duty under
				section 12310 of this title.</text>
									</clause><clause id="H0143E45FD8E244BCB40714934874F2F9" indent="up1"><enum>(ii)</enum><text>Active service described in this
				subparagraph is also service under a call to active service authorized by the
				President or the Secretary of Defense under <external-xref legal-doc="usc" parsable-cite="usc/32/502">section 502(f)</external-xref> of title 32 for
				purposes of responding to a national emergency declared by the President or
				supported by Federal funds.</text>
									</clause></subparagraph><subparagraph id="H56FF73E930EC4C8E97E8B7A3E40404D7" indent="up1"><enum>(C)</enum><text>The eligibility age for purposes of
				subsection (a)(1) may not be reduced below 50 years of age for any person under
				subparagraph
				(A).</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H5BB043B1F3CB427896034F1C9BB15B89"><enum>(b)</enum><header>Continuation of
			 Age 60 as Minimum Age for Eligibility of Non-Regular Service Retirees for
			 Health Care</header><text>Section 1074(b) of such title is amended—</text>
				<paragraph id="H935B5CB6DAAB4BF28EC95F00B009FFAE"><enum>(1)</enum><text>by inserting
			 <quote>(1)</quote> after <quote>(b)</quote>; and</text>
				</paragraph><paragraph id="H16A5EA631C484FF1860015C91099178E"><enum>(2)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block id="H8482F598D7364CB0B3737D9F03B46F8F" style="OLC">
						<paragraph id="H64F9B03C036E47BAA8007D95DA1DD1A8" indent="up1"><enum>(2)</enum><text>Paragraph (1) does not apply to a
				member or former member entitled to retired pay for non-regular service under
				chapter 1223 of this title who is under 60 years of
				age.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HA647AD40675D49CBB278CADD25DBBB19"><enum>(c)</enum><header>Administration
			 of Related Provisions of Law or Policy</header><text>With respect to any
			 provision of law, or of any policy, regulation, or directive of the executive
			 branch that refers to a member or former member of the uniformed services as
			 being eligible for, or entitled to, retired pay under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/1223">chapter 1223</external-xref> of title 10,
			 United States Code, but for the fact that the member or former member is under
			 60 years of age, such provision shall be carried out with respect to that
			 member or former member by substituting for the reference to being 60 years of
			 age a reference to having attained the eligibility age applicable under
			 subsection (f) of <external-xref legal-doc="usc" parsable-cite="usc/10/12731">section 12731</external-xref> of title 10, United States Code (as added by
			 subsection (a)), to such member or former member for qualification for such
			 retired pay under subsection (a) of such section.</text>
			</subsection><subsection id="H6E9C108632CF4B1B835660C24F36A874"><enum>(d)</enum><header>Effective Date
			 and Applicability</header><text>The amendment made by subsection (a) shall take
			 effect as of September 11, 2001, and shall apply with respect to applications
			 for retired pay that are submitted under <external-xref legal-doc="usc" parsable-cite="usc/10/12731">section 12731(a)</external-xref> of title 10, United
			 States Code, on or after the date of the enactment of this Act.</text>
