		<section id="HD903576A7A314912B0CAAA29E86CA068" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Restoring the Constitution Act of
			 2007</short-title></quote>.</text>
		</section><section id="H3B891981B9974250BBE6B59B8D35A1E4"><enum>2.</enum><header>Definition of
			 unlawful enemy combatant</header><text display-inline="no-display-inline">Paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/10/948a">section 948a</external-xref> of title 10,
			 United States Code, is amended to read as follows:</text>
			<quoted-block id="H05902C2C23204713B342896544042E49" style="OLC">
				<paragraph id="H4BC521501E2344AA9E8CB3F7BE830B"><enum>(1)</enum><header>Unlawful enemy
				combatant</header><text>The term <quote>unlawful enemy
				combatant</quote>—</text>
					<subparagraph id="H316E5FF91650453A84D7EAC61C007B1D"><enum>(A)</enum><text>means an
				individual who is not a lawful enemy combatant and—</text>
						<clause id="H349719CF91A24CD8BD19CEE5F6E0CB00"><enum>(i)</enum><text>who directly
				participates in hostilities in a zone of active combat against the United
				States; or</text>
						</clause><clause id="H794E6392B557417500E52EB149D318FC"><enum>(ii)</enum><text>who—</text>
							<subclause id="HD132B6BB8E994DEAAB6ED5DEF25A184"><enum>(I)</enum><text>planned,
				authorized, committed, or aided with specific intent the terrorist acts on the
				United States of September 11, 2001; or</text>
							</subclause><subclause id="H883761D7ABF14243B2ECAB0559C29079"><enum>(II)</enum><text>harbored with
				specific intent any individual described in clause (i); and</text>
							</subclause></clause></subparagraph><subparagraph id="H02B52BDA420C4070BC7F23371DEDAF33"><enum>(B)</enum><text>may be used solely
				for the purpose of designating an individual as triable by military commission
				under this
				chapter.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H1F03D101D386426C9B5800F4A64D7D48"><enum>3.</enum><header>Construction in
			 relation to Geneva Conventions</header><text display-inline="no-display-inline">Subsection (g) of <external-xref legal-doc="usc" parsable-cite="usc/10/948b">section 948b</external-xref> of title 10,
			 United States Code, is amended to read as follows:</text>
			<quoted-block id="H36E31CB7BDB14221B6411D2F8EEC241F" style="OLC">
				<subsection id="HC3505AF24EFF4594AFB5CFF200B97F13"><enum>(g)</enum><header>Construction in
				relation to Geneva Conventions</header><text>To the extent that any provision
				of this chapter is determined to be inconsistent with the obligations of the
				United States under the Geneva Conventions, the Geneva Conventions shall
				prevail, and such provision shall be deemed to have no further force or
				effect.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HF7012889762C42E7A7DA42866219D1DB"><enum>4.</enum><header>Determination of
			 unlawful enemy combatant status by combatant status review tribunal not
			 dispositive for purposes of jurisdiction of military commissions</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/10/948d">Section 948d</external-xref> of title 10, United States
			 Code, is amended—</text>
			<paragraph id="HFB219F977D3F437EB38D6210BE2EDB27"><enum>(1)</enum><text>by striking
			 subsection (c); and</text>
			</paragraph><paragraph id="H1D23EDC0538748F794279DBABE9023DA"><enum>(2)</enum><text>by redesignating
			 subsection (d) as subsection (c).</text>
			</paragraph></section><section id="H2049F6C1B0DC42F69DEAED64BE0900B3"><enum>5.</enum><header>Trial counsel and
			 defense counsel</header>
			<subsection id="HCFACFC3C1154450CB43CFDB614003195"><enum>(a)</enum><header>Repeal of
			 Authority for Civilian Trial Counsel</header><text>Subsection (b) of section
			 948k of title 10, United States Code, is amended to read as follows:</text>
				<quoted-block id="HE749271CB55C483ABA62DEA53F82249" style="OLC">
					<subsection id="H99CCF5C2410C4F569300D0E672BDA370"><enum>(b)</enum><header>Military Trial
				Counsel</header><text>Subject to subsection (e), trial counsel detailed for a
				military commission under this chapter must be a judge advocate (as that term
				is defined in section 801 of this title (article 1 of the Uniform Code of
				Military Justice)) who is—</text>
						<paragraph id="HCB8B56770FB44A2CA94E48AAA319869B"><enum>(1)</enum><text>a graduate of an
				accredited law school or is a member of the bar of a Federal court or of the
				highest court of a State; and</text>
						</paragraph><paragraph id="H94E2874B40094EC984C63D38705FBA29"><enum>(2)</enum><text>certified as
				competent to perform duties as trial counsel before general courts-martial by
				the Judge Advocate General of the armed force of which he is a
				member.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5B44DC1D47D749FB9077A4AEE5B235B"><enum>(b)</enum><header>Authority for
			 Civilian Defense Counsel</header><text>Subsection (c) of such section is
			 amended to read as follows:</text>
				<quoted-block id="HD903124209D34F9A9152306B009B08B2" style="OLC">
					<subsection id="HB165ED6227EF41379B06E2A5E78B5B7"><enum>(c)</enum><header>Defense
				Counsel</header><text>Subject to subsection (e), trial counsel detailed for a
				military commission under this chapter must be—</text>
						<paragraph id="H18C7BFCE679149CF979498D5BD71499"><enum>(1)</enum><text>a judge advocate
				(as so defined) who is—</text>
							<subparagraph id="H7BE387E6366A4494AE36009B7792A11F"><enum>(A)</enum><text>a graduate of an
				accredited law school or is a member of the bar of a Federal court or of the
				highest court of a State; and</text>
							</subparagraph><subparagraph id="H777E095C195740BD8D3C70F6CEE1F4FD"><enum>(B)</enum><text>certified as
				competent to perform duties as trial counsel before general courts-martial by
				the Judge Advocate General of the armed force of which he is a member;
				or</text>
							</subparagraph></paragraph><paragraph id="HD65A4C3E170F4EF6A1445C9530EF0028"><enum>(2)</enum><text>a civilian who
				is—</text>
							<subparagraph id="H1A523C0062B24BEDA7BB4A0B43FC700"><enum>(A)</enum><text>a member of the bar
				of a Federal court or of the highest court of a State; and</text>
							</subparagraph><subparagraph id="HF0D20EE92F624A4FA4F87FEF140062D9"><enum>(B)</enum><text>otherwise
				qualified to practice before the military commission pursuant to regulations
				prescribed by the Secretary of
				Defense.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5D200051DDEF4884BA016EF05B00686D"><enum>(c)</enum><header>Conforming
			 Amendments</header><text>Such section is further amended—</text>
				<paragraph id="H86851E6C5B5F4221B7379B684E2DCFD7"><enum>(1)</enum><text>in subsection
			 (d)(1), by striking <quote>subsection (b)(1)</quote> and inserting
			 <quote>subsection (b)</quote>;</text>
				</paragraph><paragraph id="H415A978110B141329FA43624B6000060"><enum>(2)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="H50DE1BB57A7D4F999908F9AFC8941695"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>Trial counsel and military defense counsel</quote> and
			 inserting <quote>Military trial counsel and defense counsel</quote>;</text>
					</subparagraph><subparagraph id="H53DEF0714FDB4C8B8B36554D84B3EAC4"><enum>(B)</enum><text>in paragraph (3),
			 by striking <quote>Military defense</quote> and inserting
			 <quote>Defense</quote>; and</text>
					</subparagraph><subparagraph id="H92E392F0899A4255AA99E478AE827F8F"><enum>(C)</enum><text>in paragraph (4),
			 by striking <quote>trial counsel and military defense counsel</quote> and
			 inserting <quote>military trial counsel and defense counsel</quote>; and</text>
					</subparagraph></paragraph><paragraph id="H71D5B5420EF24B2F941131EAA439635D"><enum>(3)</enum><text>in subsection (e),
			 by striking <quote>trial counsel or military defense counsel</quote> and
			 inserting <quote>military trial counsel or military defense
			 counsel</quote>.</text>
				</paragraph></subsection></section><section id="H7D64C845132A447CA2120200F51DC920"><enum>6.</enum><header>Exclusion from
			 trial by military commission of statements obtained by coercion</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/10/948r">Section 948r</external-xref> of title 10, United States
			 Code, is amended by striking subsections (c) and (d) and inserting the
			 following new subsection (c):</text>
			<quoted-block id="H04D15406C59C4A1D80DCFCB83C229E" style="OLC">
				<subsection id="H714526F008084D98B7541C94CA00343E"><enum>(c)</enum><header>Exclusion of
				Statements Obtained by Coercion</header><text>A statement obtained by use of
				coercion shall not be admissible in a military commission under this chapter,
				except against a person accused of coercion as evidence that the statement was
				made.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HF9A267C1D9EA44838090648026F0BDE6"><enum>7.</enum><header>Modification of
			 authorities on rules for military commissions</header>
			<subsection id="HD623714A3F624C3F994528C2122BA31"><enum>(a)</enum><header>Rules
			 Generally</header><text>Subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/10/949a">section 949a</external-xref> of title 10, United
			 States Code, is amended to read as follows:</text>
				<quoted-block id="HFB83D78BAF0840ED822F9EF09FD0DBEE" style="OLC">
					<subsection id="H2723D10AB2AE4B11BB72E3A5A22101B0"><enum>(a)</enum><header>Procedures and
				Rules of Evidence</header><text>(1) Pretrial, trial, and post-trial procedures,
				including elements and modes of proof, for cases triable by military commission
				under this chapter may be prescribed by the Secretary of Defense. Such
				procedures may not be contrary to or inconsistent with this chapter. Except as
				otherwise provided in this chapter or chapter 47 of this title, the procedures
				and rules of evidence applicable in trials by general courts-martial shall
				apply in trials by military commission under this chapter.</text>
						<paragraph id="HA8FD04C2F0F345A09224044911003938" indent="up1"><enum>(2)</enum><text>The Secretary of Defense may, in
				consultation with the Attorney General, make such exceptions in the
				applicability in trials by military commission under this chapter from the
				procedures and rules of evidence otherwise applicable in general courts-martial
				as may be required by the unique circumstances of the conduct of military or
				intelligence operations during hostilities. Such exceptions may not be contrary
				to or inconsistent with this
				chapter.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HCE3F2D3B66A048C1A7C4600E54B0035"><enum>(b)</enum><header>Exclusion of
			 Evidence Seized Inside the United States Without
			 Warrant</header><text>Subsection (b)(2)(B) of such section is amended by
			 inserting <quote>seized outside the United States</quote> after
			 <quote>Evidence</quote>.</text>
			</subsection><subsection id="H8EEE29CD72504EA5B892A0E500A9007C"><enum>(c)</enum><header>Discretion of
			 Military Judge To Exclude Hearsay Evidence Determined To Be Unreliable or
			 Lacking in Probative Value</header><text>Subsection (b)(2)(E)(ii) of such
			 section is amended by striking <quote>if the party opposing the admission of
			 the evidence demonstrates that the evidence is unreliable or lacking in
			 probative value</quote> and inserting <quote>if the military judge determines,
			 upon motion by counsel, that the evidence is unreliable or lacking in probative
			 value</quote>.</text>
			</subsection></section><section id="H7495981F32764FB8A3A3080021D0A6ED"><enum>8.</enum><header>Self-representation
			 of accused before military commissions</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/10/949c">Section 949c</external-xref> of title 10, United States
			 Code, is amended by adding at the end the following new subsection:</text>
			<quoted-block id="H2768914BDCF948E9840146F8D86931FA" style="OLC">
				<subsection id="H402A6A8094244D8CB61D448D8CC553BD"><enum>(c)</enum><header>Self-Representation
				by Accused</header><text>(1) Notwithstanding any provision of subsection (b),
				the accused may represent himself in his defense before a military commission
				under this chapter.</text>
					<paragraph id="H3043AF1F230D464B003416D6E357DBFC" indent="up1"><enum>(2)</enum><text>The accused’s representation of
				himself in his defense shall be governed by such rules as the Secretary of
				Defense shall prescribe. Such rules, and any rights, privileges, or limitations
				under such rules, shall be consistent with rules applicable to
				self-representation by an accused in a criminal trial under the laws of the
				United States and international law.</text>
					</paragraph><paragraph id="HF6B9F63CD2234C4F94588053D5F315B7" indent="up1"><enum>(3)</enum><text>If the accused represents himself
				under this subsection, the accused—</text>
						<subparagraph id="H8B7608260F3F49B3A52E763FA2285CDA"><enum>(A)</enum><text>shall be assisted in his defense by
				military defense counsel detailed in accordance with subsection (b)(2);
				or</text>
						</subparagraph><subparagraph id="H918E2A42146942F39624E325377860EF"><enum>(B)</enum><text>may be assisted in his defense by
				civilian defense counsel meeting the requirements of subsection (b)(3),
				together with military defense counsel so detailed.</text>
						</subparagraph></paragraph><paragraph id="H3FA7E49F1A974DD28D7179A50094CBC2" indent="up1"><enum>(4)</enum><text>Any civilian counsel assisting in the
				defense of an accused under this subsection shall comply with the provisions of
				subsection (b)(4).</text>
					</paragraph><paragraph id="H21049AAED58E42999F40E786ABFFAC86" indent="up1"><enum>(5)</enum><text>Subsection (b)(7) shall not apply
				with respect to any defense counsel assisting in the defense of an accused
				under this subsection, except to the extent the accused is unable to carry out
				his
				defense.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HEF320216B83D40B70092E466A22B6B1C"><enum>9.</enum><header>Enhancement of
			 authorities on discovery of witnesses and other evidence</header><text display-inline="no-display-inline">Subsection (d)(1) of such section is amended
			 by adding at the end the following:</text>
			<quoted-block display-inline="yes-display-inline" id="H8CBAB37C33824303BAC5BDAED263D5DD" style="OLC">
				<text>If the
			 military judge determines that the substitute is not sufficient to protect the
			 right of the defendant to a fair trial, the military judge
			 may—</text><subparagraph id="H37A54F701C184854BBF95C1550793D00"><enum>(A)</enum><text>dismiss the
				charges in their entirety;</text>
				</subparagraph><subparagraph id="HCDC593CD4A56485B92A94CCCCBCA2FBA"><enum>(B)</enum><text>dismiss the
				charges or specifications or both to which the information relates; or</text>
				</subparagraph><subparagraph id="H334EB1C646604043994F5BB867CEFDA"><enum>(C)</enum><text>take such other
				actions as may be required in the interest of
				justice.</text>
				</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H6C2077732FCA43DC8B95A3A4076AA10"><enum>10.</enum><header>Review of
			 military commission decisions by United States court of appeals for the armed
			 forces rather than court of military commission review</header>
			<subsection id="HE0CC51D7B7234D6092532928AC7EAC92"><enum>(a)</enum><header>Review</header>
				<paragraph id="H893DB54BC6CB44EA9592B34E44EB2395"><enum>(1)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/950f">Section 950f</external-xref> of title 10, United States Code, is amended
			 to read as follows:</text>
					<quoted-block id="H982E460720764C388E7DF5DD06EC3C59" style="OLC">
						<section id="HF9D7D504E6BA44179D1CCCB2C199580"><enum>950f.</enum><header>Review by court
				of appeals for the armed forces</header><text display-inline="no-display-inline">The United States Court of Appeals for the
				Armed Forces, in accordance with procedures prescribed in regulations by the
				Secretary of Defense, shall review the record in each case that is referred to
				the Court by the convening authority under section 950c of this title with
				respect to any matter of law, including whether any rational fact finder could
				have concluded that there was sufficient evidence to establish guilt, raised by
				the
				accused.</text>
						</section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H45C3A23EFFCF4B1A003F6321DA055B02"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of subchapter VI
			 of chapter 47A of such title is amended by striking the item relating to
			 section 950f and inserting the following new item:</text>

			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/47A">Chapter 47A</external-xref> of title 10, United States Code, is further
			 amended as follows:</text>
					<subparagraph id="HA32DFC8464124B8BB06C7E842300E186"><enum>(A)</enum><text>In section
			 950c(a), by striking <quote>the Court of Military Commission Review</quote> and
			 inserting <quote>the United States Court of Appeals for the Armed
			 Forces</quote>.</text>
					</subparagraph><subparagraph id="H1E323DC63D8846D6BC7E4F9300CA2924"><enum>(B)</enum><text>In section 950d,
			 by striking <quote>the Court of Military Commission Review</quote> each place
			 it appears and inserting <quote>the United States Court of Appeals for the

			 military justice</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/867a">Section 867a(a)</external-xref> of title 10, United States Code
			 (article 67a(a) of the Uniform Code of Military Justice), is amended by
			 striking <quote>Decisions</quote> and inserting <quote>Except as provided in
			 sections 950d and 950g of this title, decisions</quote>.</text>
				</paragraph></subsection></section><section id="H28350BA661E34E27A000102E9B380009"><enum>11.</enum><header>Scope of review
			 of detention-related decisions</header>
			<subsection id="H09F4666BBF3048638B6BC2C27341BEFF"><enum>(a)</enum><header>Scope of Review
			 of United States Court of Appeals for the District of Columbia
			 Circuit</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/950g">Section 950g</external-xref> of title 10, United States Code, is
			 amended—</text>
				<paragraph id="HAD1995658DCC41BF85BBA701F8495016"><enum>(1)</enum><text>by striking
			 subsection (c); and</text>
				</paragraph><paragraph id="H1167910E6E884C03AA9EAF2364742E9E"><enum>(2)</enum><text>by redesignating
			 subsection (d) as subsection (c).</text>
				</paragraph></subsection><subsection id="H98E1B179F22C492700C93FD680A2E558"><enum>(b)</enum><header>Scope of
			 Authority for Review of Military Commission Procedures and
			 Actions</header><text>Subsection (b) of section 950j of such title is amended
			 to read as follows:</text>
				<quoted-block id="HB9920464D1A54C6ABEB081B700094F3F" style="OLC">
					<subsection id="H4A4AD09D158C4D72982F2000DB4BD831"><enum>(b)</enum><header>Limited Review
				of Military Commission Procedures and Actions</header><text>Except as otherwise
				provided in this chapter, <external-xref legal-doc="usc" parsable-cite="usc/28/2241">section 2241</external-xref> of title 28, and any other habeas corpus
				provision, no court, justice, or judge shall have jurisdiction to hear or
				consider any claim or cause of action whatsoever, including any action pending
				on or filed after October 17, 2006, relating to the prosecution, trial, or
				judgment of a military commission under this chapter, including challenges to
				the lawfulness of procedures of military commissions under this
				chapter.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H7FF73106AA024CECBAEAEFCA7D27C502"><enum>(c)</enum><header>Termination of

			 Commissions Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/366">Public Law 109–366</external-xref>) is amended by striking section
			 5.</text>
		</section><section id="H6B87CA8444DD45C1AF719B004470B9A3"><enum>13.</enum><header>Implementation
			 of treaty obligations</header>
			<subsection id="HEEB59F3EA6974AE2838B57BF3427DD63"><enum>(a)</enum><header>In
			 General</header><text>Section 6(a) of the Military Commissions Act of 2006
			 (<external-xref legal-doc="public-law" parsable-cite="pl/109/366">Public Law 109–366</external-xref>; 120 Stat. 2632; <external-xref legal-doc="usc" parsable-cite="usc/18/2441">18 U.S.C. 2441</external-xref> note) is amended—</text>
				<paragraph id="H4C86C92C184A4F72BA0073B044002397"><enum>(1)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph id="H0F2E744A78B3401FB1B093245DACB672"><enum>(A)</enum><text>in the first
			 sentence, by inserting after <quote>international character</quote> the
			 following: <quote>and preserve the capacity of the United States to prosecute
			 nationals of enemy powers for engaging in acts against members of the United
			 States Armed Forces and United States citizens that have been prosecuted by the
			 United States as war crimes in the past</quote>; and</text>
					</subparagraph><subparagraph id="H01F1C45E971E4F49904B9D3342B9EEC"><enum>(B)</enum><text>by striking the
			 second sentence; and</text>
					</subparagraph></paragraph><paragraph id="HA7D4C9AA72E0423C8C00F2003086A901"><enum>(2)</enum><text>in paragraph
			 (3)—</text>
					<subparagraph id="HE3F82B4A51FD43BA9E8CDD59BF9E1886"><enum>(A)</enum><text>in subparagraph
			 (A)—</text>
						<clause id="H4AD85BE532304839BCD5BC2BA2680457"><enum>(i)</enum><text>by
			 striking <quote>the President has the authority for the United States to
			 interpret the meaning and application of the Geneva Conventions and to
			 promulgate</quote> and inserting <quote>the President has the authority,
			 subject to congressional oversight and judicial review, to promulgate</quote>;
			 and</text>
						</clause><clause id="HCD85A49B4B3E48CDBA87A0E7E76D7E35"><enum>(ii)</enum><text>by
			 striking <quote>higher standards and</quote>;</text>
						</clause></subparagraph><subparagraph id="H2767351CFB0248DABB372EE5444B1C62"><enum>(B)</enum><text>in subparagraph
			 (B), by striking <quote>interpretations</quote> and inserting
			 <quote>rules</quote>; and</text>
					</subparagraph><subparagraph id="HF109B5DCE333498381492806E8C81BF"><enum>(C)</enum><text>by amending
			 subparagraph (D) to read as follows:</text>
						<quoted-block id="H8267C3E629554503B4BB638200E41CCC" style="OLC">
							<subparagraph id="HB2700C7EDC8F43E90039E3CDF0E28150"><enum>(D)</enum><text>The President
				shall notify other parties to the Geneva Conventions that the United States
				expects members of the United States Armed Forces and other United States
				citizens detained in a conflict not of an international character to be treated
				in a manner consistent with the standards described in subparagraph (A) and
				embodied in <external-xref legal-doc="usc" parsable-cite="usc/18/2441">section 2441</external-xref> of title 18, United States Code, as amended by
				subsection
				(b).</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H553943AB17B041E4BD242B4528A2103F"><enum>(b)</enum><header>Modification of
			 War Crimes Offenses</header>
				<paragraph id="H35918F2202564C9E97163061B9E2CB50"><enum>(1)</enum><header>Inclusion of
			 denial of trial rights among offenses</header><text>Paragraph (1) of section
			 2441(d) of title 18, United States Code, is amended by adding at the end the
			 following new subparagraph:</text>
					<quoted-block id="H2CD47814F49A4B4B90D1D8FD7263ACA5" style="OLC">
						<subparagraph id="HD8B5CE2929024B1DA2B625062816AADF"><enum>(J)</enum><header>Denial of trial
				rights</header><text>The act of a person who intentionally denies one or more
				persons the right to be tried before a regularly constituted court affording
				all the judicial guarantees which are recognized as indispensable by civilized
				peoples as prescribed by common Article
				3.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H07EDAA77026A4570A3F6DBF8A24E71C2"><enum>(2)</enum><header>Inclusion of
			 imposition of cruel, inhuman, or degrading treatment or punishment among
			 offenses</header><text>Such section is further amended—</text>
					<subparagraph id="H3B58A49013D2423B853B1C74E3BEA719"><enum>(A)</enum><text>in paragraph (1),
			 by adding at the end the following new subparagraph:</text>
						<quoted-block id="H2203FEAB70A244E9868B01F5BB277952" style="OLC">
							<subparagraph id="H0B5051FB9C4141D4827D7D586362B99C"><enum>(K)</enum><header>Cruel, inhuman,
				or degrading treatment or punishment</header><text>The act of a person who
				subjects, or conspires or attempts to subject, an individual in the custody or
				under the physical control of the United States Government, regardless of
				nationality or physical location, to cruel, inhuman, or degrading treatment or
				punishment.</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H3D04D88F739B49CE9DC4DC1294E07643"><enum>(B)</enum><text>in paragraph
			 (2)—</text>
						<clause id="H4D5BDD0C52384334BAB8002EC5720742"><enum>(i)</enum><text>in
			 subparagraph (D), by striking <quote>and</quote> at the end;</text>
						</clause><clause id="H72A5907D9B74458494FCB3B395D214CF"><enum>(ii)</enum><text>in
			 subparagraph (E), by striking the period at the end and inserting <quote>;
			 and</quote>; and</text>
						</clause><clause id="HE6F9C0BFEE2345C29398EA7246DBD830"><enum>(iii)</enum><text>by
			 adding at the end the following new subparagraph:</text>
							<quoted-block id="HDEEE6ACB03D34E899BC8C75114F97D1F" style="OLC">
								<subparagraph id="HA7D388BD915544279D7748CF951D7734"><enum>(F)</enum><text>the term
				<quote>cruel, inhuman, or degrading treatment or punishment</quote> shall be
				applied for purposes of paragraph (1)(K) in accordance with the meaning given
				that term in section 6(c)(2) of the Military Commissions Act of 2006 (42 U.S.C.
				2000dd–0).</text>
								</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph><paragraph id="HDEC0314A82214520A700952E7ED610A3"><enum>(3)</enum><header>Inclusion of
			 certain other violations of common article 3 among
			 offenses</header><text>Paragraph (1) of such section is further amended by
			 adding at the end the following new subparagraph:</text>
					<quoted-block id="HF22B4C16AFF1454EB300F2ED5BE5B04" style="OLC">
						<subparagraph id="H8C58E1D59E9344FDB164886B46DC2D38"><enum>(L)</enum><header>Certain other
				violations of common article 3</header><text>The act of a person not subject to
				<external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/47">chapter 47</external-xref> of title 10 (the Uniform Code of Military Justice) who commits, or
				conspires or attempts to commit, an act not otherwise enumerated under this
				paragraph that constitutes a violation of common Article 3 and is an act which,
				if committed by a person subject to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/47">chapter 47</external-xref> of title 10, would be punishable
				under that chapter by the penalty of death or confinement for one year or
				more.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HA5F82EC5ADDA41F78700510378182EE4"><enum>(4)</enum><header>Additional
			 definitional matters</header><text>Paragraph (2) of such section is further
			 amended—</text>
					<subparagraph id="HE12FB3685C564A39BDADAD4B15534F8E"><enum>(A)</enum><text>in subparagraph
			 (D)—</text>
						<clause id="H727924E20EAF4122832093B23B2B84D4"><enum>(i)</enum><text>by
			 striking clause (ii) and inserting the following new clause (ii):</text>
							<quoted-block id="HA5211DA0FB3D4E1BAC05AFC1A8B5EA82" style="OLC">
								<clause id="H51C4A465D7C24D96AF2C6F4EC2D21633"><enum>(ii)</enum><text>serious physical
				pain;</text>

						</clause><clause id="H2A70661CF3884338A700BE892CDE67F0"><enum>(ii)</enum><text>in
			 clause (iii), by striking <quote>(other than cuts, abrasions, or
			 bruises)</quote>; and</text>
						</clause></subparagraph><subparagraph id="HC60171E46923468B9E40E619F2DB2F46"><enum>(B)</enum><text>in subparagraph
			 (E)(ii), by striking <quote>and non-transitory</quote>.</text>
					</subparagraph></paragraph></subsection></section><section id="H707094FB654640D7BC167D590047E8EF"><enum>14.</enum><header>Restoration of
			 habeas corpus for individuals detained by the United States</header>
			<subsection id="H67070A61F1E544CEBE62FFAF7C405FBC"><enum>(a)</enum><header>Restoration</header><text>Subsection
			 (e) of <external-xref legal-doc="usc" parsable-cite="usc/28/2241">section 2241</external-xref> of title 28, United States Code, is repealed.</text>
			</subsection><subsection id="H5238A2795FCD405887EB5364BB74C683"><enum>(b)</enum><header>Title
			 10</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/950j">Section 950j</external-xref> of title 10, United States Code, is amended by
			 striking subsection (b) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H040B56FAA7234D6F8E7D4DCF785F368" style="OLC">
					<subsection id="H961E601B65B44CFD975569AD26606900"><enum>(b)</enum><header>Limited review
				of military commission procedures and actions</header><text>Except as otherwise
				provided in this chapter or in <external-xref legal-doc="usc" parsable-cite="usc/28/2241">section 2241</external-xref> of title 28 or any other habeas
				corpus provision, and notwithstanding any other provision of law, no court,
				justice, or judge shall have jurisdiction to hear or consider any claim or
				cause of action whatsoever, including any action pending on or filed after the
				date of the enactment of the Military Commissions Act of 2006, relating to the
				prosecution, trial, or judgment of a military commission under this chapter,
				including challenges to the lawfulness of procedures of military commissions
				under this
				chapter.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H61FEDBB27CB54379B35BDBC8295D222C"><enum>15.</enum><header>Expedited
			 judicial review of military commissions act of 2006</header><text display-inline="no-display-inline">Notwithstanding any other provision of law,
			 the following rules shall apply to any civil action, including an action for
			 declaratory judgment, that challenges any provision of the Military Commissions
			 Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/366">Public Law 109–366</external-xref>), or any amendment made by that Act, on the
			 ground that such provision or amendment violates the Constitution or the laws
			 of the United States:</text>
			<paragraph id="H07A575AD97F54B1A85DFEDCB1BA840D9"><enum>(1)</enum><text>The action shall
			 be filed in the United States District Court for the District of Columbia and
			 shall be heard in that Court by a court of three judges convened pursuant to
			 <external-xref legal-doc="usc" parsable-cite="usc/28/2284">section 2284</external-xref> of title 28, United States Code.</text>
			</paragraph><paragraph id="HCADD09C1F20F4647922E2C97802B37F2"><enum>(2)</enum><text>An interlocutory
			 or final judgment, decree, or order of the United States District Court for the
			 District of Columbia in an action under paragraph (1) shall be reviewable as a
			 matter of right by direct appeal to the Supreme Court of the United States. Any
			 such appeal shall be taken by a notice of appeal filed within 10 days after the
			 date on which such judgment, decree, or order is entered. The jurisdictional
			 statement with respect to any such appeal shall be filed within 30 days after
			 the date on which such judgment, decree, or order is entered.</text>
			</paragraph><paragraph id="H16DCB952D5174269B2B6A3AD51C7CF1"><enum>(3)</enum><text>It
			 shall be the duty of the United States District Court for the District of
			 Columbia and the Supreme Court of the United States to advance on the docket
			 and to expedite to the greatest possible extent the disposition of any action
			 or appeal, respectively, brought under this section.</text>
			</paragraph></section><section id="HEC97BA9C99CC4ABF9FB7796E2E56098C"><enum>16.</enum><header>Effective
			 date</header>
			<subsection id="H0792DADA8F81444B85AC3D8F4C31290"><enum>(a)</enum><header>In
			 General</header><text>Except as provided in subsection (b), the amendments made
			 by this Act shall take effect on October 17, 2006, the date of the enactment of
			 the Military Commissions Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/366">Public Law 109–366</external-xref>), immediately after
			 the enactment of that Act and shall apply to all cases, without exception, that
			 are pending on or after such date.</text>
			</subsection><subsection id="HBBDDC89CD02343058E1078BF3E891173"><enum>(b)</enum><header>Revisions to War
			 Crimes Offenses</header><text>The amendments made by section 13(b) shall take
			 effect on the date of the enactment of this Act.</text>
