<official-title>To amend the Comprehensive Environmental Response Compensation and Liability Act of 1980 to provide that manure shall not be considered to be a hazardous substance, pollutant, or contaminant.</official-title>

<section id="HCA9F56DACD694B03B5E3B226687343B2" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Agricultural Protection and Prosperity Act of 2007</short-title></quote>.</text></section>
<section id="HEBB79E8EDE6D48208351EFC8DBC6CB2B"><enum>2.</enum><header>Animal waste</header>
<subsection id="HCB504E3FDC7C4B82AF311FB3234F63F2"><enum>(a)</enum><header>Amendment of Superfund</header><text display-inline="yes-display-inline">Title III of the <act-name parsable-cite="CERCL">Comprehensive Environmental Response, Compensation, and Liability Act of 1980</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/9651">42 U.S.C. 9651 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="HFAD1F39C64A14AE794E61CEC1155F64F"><enum>313.</enum><header>Exception for manure</header>
<subsection id="H24CDE8220EB940D28400BBA1CDBA8C80"><enum>(a)</enum><header>Definition of manure</header><text>In this section, the term <term>manure</term> means—</text>
<paragraph id="H47CF294D6D9F49C790F11EFCC255BD36"><enum>(1)</enum><text>digestive emissions, feces, urine, urea, and other excrement from livestock (as defined in section 10403 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8302">7 U.S.C. 8302</external-xref>));</text></paragraph>
<paragraph id="H7D26BD8094DA41CE85E3CEC0D400C0C8"><enum>(2)</enum><text>any associated bedding, compost, raw materials, or other materials commingled with such excrement from livestock (as so defined);</text></paragraph>
<paragraph id="HCDC28147C8CB4099803729D44009E4B"><enum>(3)</enum><text>any process water associated with any item referred to in paragraph (1) or (2); and</text></paragraph>
<paragraph id="H68D7BE3FB4384C1EA2AAB997F6BD223"><enum>(4)</enum><text>any byproduct, constituent, or substance contained in or originating from, or any emission relating to, an item described in paragraph (1), (2), or (3).</text></paragraph></subsection>
<subsection id="H2A6118C27FAA4F97BEA12223A57100EF"><enum>(b)</enum><header>Exemption</header><text>Upon the date of enactment of this section, manure shall not be included in the meaning of—</text>
<paragraph id="H05DC986E99D14869B12673EA93813E2C"><enum>(1)</enum><text>the term <term>hazardous substance</term>, as defined in section 101(14); or</text></paragraph>
<paragraph id="HD4EB021311784ECF8C79AA671796557E"><enum>(2)</enum><text>the term <term>pollutant or contaminant</term>, as defined in section 101(33).</text></paragraph></subsection>
<subsection id="HBEC3DD6EC99F437A89D585BD0ACF077"><enum>(c)</enum><header>Effect on Other Law</header><text>Nothing with respect to the enactment of this subsection shall—</text>
<paragraph id="H1AA30D6AC9D945448EEA3528883FEC2E"><enum>(1)</enum><text>impose any liability under the Emergency Planning and Community Right-To-Know Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/11001">42 U.S.C. 11001 et seq.</external-xref>) with respect to manure;</text></paragraph>
<paragraph id="HA63ECCAF869A4140982481F2BE900F8"><enum>(2)</enum><text>abrogate or otherwise affect any provision of the Air Quality Agreement entered into between the Administrator and operators of animal feeding operations (70 Fed. Reg. 4958 (January 31, 2005)); or</text></paragraph>
<paragraph id="HA8C0A76A12484E66911F378EC0E14393"><enum>(3)</enum><text>affect the applicability of any other environmental law as such a law relates to—</text>
<subparagraph id="H73FC6F2A13824C6BBCCD2CCDEDFC61E4"><enum>(A)</enum><text>the definition of manure; or</text></subparagraph>
<subparagraph id="H69D3A28C014A4D9581B4BF9D00D3E048"><enum>(B)</enum><text>the responsibilities or liabilities of any person regarding the treatment, storage, or disposal of manure.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H72213CAD6383432A882BD0DA064CCC2"><enum>(b)</enum><header>Amendment of SARA</header><text>Section 304(a)(4) of the Superfund Amendments and Reauthorization Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/11004">42 U.S.C. 11004(a)(4)</external-xref>) is amended—</text>
<paragraph id="H5A9E767392A2428C90B6FA79FCC2622D"><enum>(1)</enum><text>by striking <quote>This section</quote> and inserting the following:</text>

<subparagraph id="HB42BE76EA3154429B4507C633EA5C888"><enum>(A)</enum><header>In general</header><text>This section</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph id="HD147CCB4C62449DB9645D31142BC45C3"><enum>(2)</enum><text>by adding at the end the following:</text>

<subparagraph id="HD1F48624FC6144D185D01782E781678D"><enum>(B)</enum><header>Manure</header><text>The notification requirements under this subsection do not apply to releases associated with manure (as defined in section 313 of the <act-name parsable-cite="CERCL">Comprehensive Environmental Response, Compensation, and Liability Act of 1980</act-name>).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
