<official-title display="yes">To amend title 18, United States Code, to strengthen prohibitions against animal fighting, and for other purposes.</official-title>

<section id="H38D524EB242647DEB8FB6E9643BE14AD" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Animal Fighting Prohibition Enforcement Act of 2007</short-title></quote>.</text></section> 
<section id="HEE9696F8993C4B4EA38C00A32C59354B"><enum>2.</enum><header>Enforcement of animal fighting prohibitions</header> 
<subsection id="H3ADC3EB8F97944C1B2B00012E8641E8C"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/3">Chapter 3</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="USC" id="H7FFF2D0A06E348F2B0DF15009B947F91" display-inline="no-display-inline"> 
<section id="H674B01F4AAC14215BC54A4656C3B1E4"><enum>49.</enum><header>Enforcement of animal fighting prohibitions</header><text display-inline="no-display-inline">Whoever violates subsection (a), (b), (c), or (e) of section 26 of the Animal Welfare Act shall be fined under this title, imprisoned for not more than 3 years, or both, for each violation.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H44D19E5BBD664D32BD822D6368FA6047"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for such chapter is amended by inserting after the item relating to section 48 the following:</text>

<section id="HA6983634C42E4E5DB89C3E82A690CC5E"><enum>3.</enum><header>Amendments to the animal welfare act</header><text display-inline="no-display-inline">Section 26 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2156">7 U.S.C. 2156</external-xref>) is amended—</text> 
<paragraph id="H41521B906AC4492FAA78C7D57076E7A5"><enum>(1)</enum><text>in subsection (c), by striking <quote>interstate instrumentality</quote> and inserting <quote>instrumentality of interstate commerce for commercial speech</quote>;</text></paragraph> 
<paragraph id="H26F9A8A5A89C4D2C9BA9038E2D884645"><enum>(2)</enum><text>in subsection (d), by striking <quote>such subsections</quote> and inserting <quote>such subsection</quote>; </text></paragraph> 
<paragraph id="HEB5D131E0EB844DF8C2D411D15BE5E14"><enum>(3)</enum><text>by striking subsection (e) and inserting the following:</text>

<subsection id="HE48EFD12B1214D73B8A1BF8156D65EDA"><enum>(e)</enum><text>It shall be unlawful for any person to knowingly sell, buy, transport, or deliver in interstate or foreign commerce a knife, a gaff, or any other sharp instrument attached, or designed or intended to be attached, to the leg of a bird for use in an animal fighting venture.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H97402FC7B5744F559901D177515B391"><enum>(4)</enum><text>in subsection (g)—</text> 
<subparagraph id="HA791FFC572ED4C788BED06B8F6CB4822"><enum>(A)</enum><text>in paragraph (1), by striking <quote>or animals, such as waterfowl, bird, raccoon, or fox hunting</quote>; and</text></subparagraph> 
<subparagraph id="HCCDED43407554D9DAF900100082F4F8B"><enum>(B)</enum><text>by striking paragraph (3) and inserting the following:</text> 
<quoted-block style="OLC" id="HA0FA6E6DF9B741519602038FD700B8D" display-inline="no-display-inline"> 
<paragraph id="H90EBDB6F5FF0468C8EE6D9CB07F8891C"><enum>(3)</enum><text>the term <quote>instrumentality of interstate commerce</quote> means any written, wire, radio, television or other form of communication in, or using a facility of, interstate commerce;</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H96321080DC12476EB430B2057C6BD13"><enum>(5)</enum><text>by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="H08FD5DAFAA9A470CBBC9B9A400DEC9DA" display-inline="no-display-inline"> 
<subsection id="H01B4569365AC409F9FF75FF000F36CC8"><enum>(i)</enum><text display-inline="yes-display-inline">The criminal penalties for violations of subsection (a), (b), (c), or (e) are provided in <external-xref legal-doc="usc" parsable-cite="usc/18/49">section 49</external-xref> of title 18, United States Code.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
