		<official-title>To amend title XIX of the Social Security Act to
		  establish independent foster care adolescents as a mandatory category (and not
		  an optional category) of individuals for coverage under State Medicaid
		  programs.</official-title>

		<section id="HCF4087C75BBE458094E619DA97BFD618" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Medicaid
			 Foster Care Coverage Act of 2007</quote>.</text>
		</section><section id="HA38804FEAEDD461687C2A9C1E09E108"><enum>2.</enum><header>Independent foster
			 care adolescents established as mandatory category (and not optional category)
			 of individuals for Medicaid coverage</header>
			<subsection id="H4506EA1807284FCE8D8B1C441EEEB6AB"><enum>(a)</enum><header>Establishment as
			 mandatory category</header><text>Clause (i) of section 1902(a)(10)(A) of the
			 Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(A)</external-xref>) is amended—</text>
				<paragraph id="H890E90DE92EB4D4CBB53CB88BEDA19C6"><enum>(1)</enum><text>in subclause (VI),
			 by striking at the end <quote>or</quote>;</text>
				</paragraph><paragraph id="H3EFB4C718206412C00029573048DCF70"><enum>(2)</enum><text>in subclause
			 (VII), by adding at the end <quote>or</quote>; and</text>
				</paragraph><paragraph id="HC958E4644A6545E68F13BF2D8B3CC66B"><enum>(3)</enum><text>by adding at the
			 end the following new subclause:</text>

						<subclause id="H93C12BA759F14F8A898546C0D65CCC3B"><enum>(VIII)</enum><text>who are
				independent foster care adolescents (as defined in section
				1905(w)(1));</text>
						</subclause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H8FB0A16449124373919E59DB5168DAC0"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="H8CB8435984B84A4C885BC1C9FC65B488"><enum>(1)</enum><text>Clause (ii) of
			 such section is amended by striking subclause (XVII) and redesignating
			 subclauses (XVIII) and (XIX) as subclauses (XVII) and (XVIII),
			 respectively.</text>
				</paragraph><paragraph id="HDCA03D454F804388AFCD91C247767877"><enum>(2)</enum><text>Section 1905(w) of
			 the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(w)</external-xref>) is amended—</text>
					<subparagraph id="H994DAD4D9F914B1C85D1B9BFD200EE36"><enum>(A)</enum><text>in paragraph (1),
			 by inserting <quote>, subject to paragraph (3),</quote> after
			 <quote>means</quote>; and</text>
					</subparagraph><subparagraph id="HE2D2D1BE658C424BB9EC5F34CD1E2F3D"><enum>(B)</enum><text>in paragraph (3),
			 by striking <quote>section 1902(a)(10)(A)(ii)(XVII)</quote> and inserting
			 <quote>section 1902(a)(10)(A)(I)(VIII)</quote>.</text>
					</subparagraph></paragraph><paragraph id="H286AB9FC744A49718DD334339FDC2F90"><enum>(3)</enum><text>Section 1902 of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref>) is amended—</text>
					<subparagraph id="HF042B3BF9656464DBCC830EBE63D94C1"><enum>(A)</enum><text>in the matter
			 following subparagraph (G) of subsection (a)(10), by striking
			 <quote>subparagraph (A)(10)(ii)(XVIII)</quote> and inserting
			 <quote>subparagraph (A)(ii)(XVII)</quote>; and</text>
					</subparagraph><subparagraph id="H60E762AB9E0D46C59726F135247FB9CF"><enum>(B)</enum><text>in subsection
			 (cc)(2)(A)(I), by striking <quote>subsection (a)(10)(A)(ii)(XIX)</quote> and
			 inserting <quote>subsection (a)(10)(A)(ii)(XVIII)</quote>.</text>
					</subparagraph></paragraph><paragraph id="H0DDCA739A63C4ACC8C862CEF00D018"><enum>(4)</enum><text>Section 1903(f)(4)
			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(f)(4)</external-xref>) is amended—</text>
					<subparagraph id="H25A60E29694C432FA11B81DBECA632F8"><enum>(A)</enum><text>by striking
			 <quote>1902(a)(10)(A)(ii)(XVII),</quote> and inserting
			 <quote>1902(a)(10)(A)(I)(VIII),</quote> after
			 <quote>1902(a)(10)(A)(I)(VII),</quote>;</text>
					</subparagraph><subparagraph id="HF752DD77D7EB44B180D22008F3D6630"><enum>(B)</enum><text display-inline="yes-display-inline">by striking
			 <quote>1902(a)(10)(A)(ii)(XVIII)</quote> and inserting
			 <quote>1902(a)(10)(A)(ii)(XVII)</quote>; and</text>
					</subparagraph><subparagraph id="HAF7CDB81A9A94856A0F4213F1CC24C08"><enum>(C)</enum><text display-inline="yes-display-inline">by striking
			 <quote>1902(a)(10)(A)(ii)(XIX)</quote> and inserting
			 <quote>1902(a)(10)(A)(ii)(XVIII)</quote>.</text>
					</subparagraph></paragraph><paragraph id="HCA17B100B1214B40A7EECF6D808FD5E9"><enum>(5)</enum><text>Section 1905 of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d</external-xref>) is amended—</text>
					<subparagraph id="H113DA35FBDD649F28C4E1328C0A58EEA"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)(2)(B), by striking
			 <quote>1902(a)(10)(A)(ii)(XIX)</quote> and inserting
			 <quote>1902(a)(10)(A)(ii)(XVIII)</quote>; and</text>
					</subparagraph><subparagraph id="H3CBF6F33A8944D8900BDD804ADD14EEA"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (b), by striking
			 <quote>1902(a)(10)(A)(ii)(XVIII)</quote> and inserting
			 <quote>1902(a)(10)(A)(ii)(XVII)</quote>.</text>
					</subparagraph></paragraph><paragraph id="H915DC1BEF9B749BCBF1E9BF37864B9CD"><enum>(6)</enum><text display-inline="yes-display-inline">Section 1916(I) of such Act (42 U.S.C.
			 1396o(I)) is amended in paragraphs (1) and (3), by striking
			 <quote>1902(a)(10)(A)(ii)(XIX)</quote> and inserting
			 <quote>1902(a)(10)(A)(ii)(XVIII)</quote> each place it appears.</text>
				</paragraph><paragraph id="HD26D1DF66AC44E2D92990100CB258EB7"><enum>(7)</enum><text>Section
			 1916A(b)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396o-1">42 U.S.C. 1396o–1(b)(3)</external-xref>) is amended in subparagraphs
			 (A)(v) and (B)(vii), by striking <quote>1902(a)(10)(A)(ii)(XVIII)</quote> and
			 inserting <quote>1902(a)(10)(A)(ii)(XVII)</quote> each place it appears.</text>
				</paragraph><paragraph id="H9D8D67AAE395456C9D475E18CEB1E86"><enum>(8)</enum><text>Section 1937(a)(2)(B)(x) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-7">42 U.S.C. 1396u–7(a)(2)(B)(x)</external-xref>) is amended
			 by striking <quote>1902(a)(10)(A)(ii)(XVIII)</quote> and inserting
			 <quote>1902(a)(10)(A)(ii)(XVII)</quote>.</text>
				</paragraph></subsection><subsection id="H9C017F5017C642CC8F012B003B30DBF0"><enum>(c)</enum><header>Effective
			 date</header>
				<paragraph id="HE88760D078ED4A31BE6F4D6800FE80C8"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the amendments made
			 by subsections (a) and (b) shall apply to calendar quarters beginning on or
			 after October 1, 2007, without regard to whether or not final regulations to
			 carry out such amendments have been promulgated by such date.</text>
				</paragraph><paragraph id="H295EFD84DADB41C5A51CB0EB00E6103F"><enum>(2)</enum><header>Exception if
			 State legislation required</header><text>In the case of a State plan for
			 medical assistance under title XIX of the Social Security Act which the
			 Secretary of Health and Human Services determines requires State legislation
			 (other than legislation appropriating funds) in order for the plan to meet the
			 additional requirement imposed by the amendments made by subsection (a), the
			 State plan shall not be regarded as failing to comply with the requirements of
			 such title solely on the basis of its failure to meet this additional
			 requirement before the first day of the first calendar quarter beginning after
			 the close of the first regular session of the State legislature that begins
			 after the date of the enactment of this Act. For purposes of the previous
			 sentence, in the case of a State that has a 2-year legislative session, each
			 year of such session shall be deemed to be a separate regular session of the
			 State legislature.</text>
