		<official-title>To amend the Immigration and Nationality Act to deny
		  citizenship at birth to children born in the United States of parents who are
		  not citizens or permanent resident aliens.</official-title>

		<section display-inline="no-display-inline" id="HD2FC0074699D4FBC9CB877BDBE625100" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Citizenship Reform Act of
			 2007</short-title></quote>.</text>
		</section><section id="HF8DA993DA71149BEA69F99B0EC3D203E"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">It is the purpose of this Act to deny
			 automatic citizenship at birth to children born in the United States to parents
			 who are not citizens or permanent resident aliens.</text>
		</section><section id="H91C08F4569664359963F49E19075C399"><enum>3.</enum><header>Denying
			 citizenship at birth for children of non-citizen, non-permanent resident
			 aliens</header>
			<subsection id="HBBA29F7C3A194548A1EEF5D82D72904"><enum>(a)</enum><header>In
			 General</header><text>Section 101 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>)
			 is amended by inserting after subsection (c) the following new
			 subsection:</text>
				<quoted-block act-name="Immigration and Nationality Act" id="HB85FA265B590471CB6E8BD85EA04DAA" style="OLC">
					<subsection id="H5B32370B160C49D89DCC5383BFEE019C"><enum>(d)</enum><text>For purposes of
				section 301(a), a person born in the United States shall be considered as
				<quote>subject to the jurisdiction of the United States</quote> if—</text>
						<paragraph id="HFAFC813A9F8E4810B6C6A44C80CA3205"><enum>(1)</enum><text>the child was born
				in wedlock in the United States to a parent who is—</text>
							<subparagraph id="HC20CBE3BCC024CC0A1B807BF46806BE0"><enum>(A)</enum><text>a citizen or
				national of the United States; or</text>
							</subparagraph><subparagraph id="H19368CC707604ABB971D442BE2FCF676"><enum>(B)</enum><text>an alien lawfully
				admitted for permanent residence in the United States who maintains his or her
				residence (as defined in subsection (a)(33)) in the United States; or</text>
							</subparagraph></paragraph><paragraph id="H400232FEFC124867AAB3AAAFB9E9F76E"><enum>(2)</enum><text>the child was born
				out of wedlock in the United States—</text>
							<subparagraph id="H3508DD843C4D4713BAB8C26F8DBE004D"><enum>(A)</enum><text>to a mother who
				is—</text>
								<clause id="H5905553525514C66B1A6D153FD71013"><enum>(i)</enum><text>a
				citizen or national of the United States; or</text>
								</clause><clause id="H6A4AA488559C441A990053469E1FA377"><enum>(ii)</enum><text display-inline="yes-display-inline">an alien lawfully admitted for permanent
				residence in the United States who maintains her residence (as defined in
				subsection (a)(33)) in the United States; or</text>
								</clause></subparagraph><subparagraph id="HA94EC71FD45241A19E22C9F10053E300"><enum>(B)</enum><text display-inline="yes-display-inline">to a father who is a citizen or national of
				the United States, or an alien lawfully admitted for permanent residence in the
				United States who maintains his residence (as defined in subsection (a)(33)) in
				the United States, but only if—</text>
								<clause id="H4C01983B2C9A479481DB76E418A4CD"><enum>(i)</enum><text display-inline="yes-display-inline">a blood relationship between the father and
				the child is established by clear and convincing evidence;</text>
								</clause><clause id="HD6A52091034D423FB67C1E1E25BAFF8F"><enum>(ii)</enum><text display-inline="yes-display-inline">the father had the nationality of the
				United States or was a permanent resident of the United States at the time of
				the child's birth;</text>
								</clause><clause id="HBE1858097D674DB5A5000010D800D259"><enum>(iii)</enum><text display-inline="yes-display-inline">the father (unless deceased) has agreed in
				writing to provide financial support for the child until the child reaches18
				years of age; and</text>
								</clause><clause id="H76D325EBCA684EC1B150BCB7B54F6158"><enum>(iv)</enum><text display-inline="yes-display-inline">while the child is under 18 years of
				age—</text>
									<subclause id="HF1DEC963CFBD4439009C82C9E8DF24C"><enum>(I)</enum><text display-inline="yes-display-inline">the father acknowledges paternity of the
				child in writing under oath; or</text>
									</subclause><subclause id="H2E201D15B10A4DFDA8EB927FD8C6CB28"><enum>(II)</enum><text display-inline="yes-display-inline">the paternity of the child is established
				by adjudication of a competent court.</text>
									</subclause></clause></subparagraph></paragraph><continuation-text continuation-text-level="subsection">For
				purposes of this subsection, a child is considered to be <quote>born in
				wedlock</quote> only if both parents are married to each other and parents are
				not considered to be married if such marriage is only a common law
				marriage.</continuation-text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5467E4CBFD7B440090727264DC6DAAC8"><enum>(b)</enum><header>Conforming
			 Amendment</header><text>Section 301 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1401">8 U.S.C. 1401</external-xref>) is amended by
			 inserting <quote>(as defined in section 101(d))</quote> after <quote>subject to
			 the jurisdiction thereof</quote>.</text>
			</subsection><subsection id="H70152A76FD55406A9292725719E16B5"><enum>(c)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall apply to aliens
			 born on or after the date of the enactment of this Act.</text>
