		<official-title>To amend title XXI of the Social Security Act to make
		  available additional amounts to address the funding shortfalls in the State
		  Children’s Health Insurance Program for fiscal year 2007.</official-title>

		<section display-inline="no-display-inline" id="H0A6964D1F98A43B3A356BFEB63125203" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Guaranteed Access for SCHIP’s Target Population Act of
			 2007</short-title></quote>.</text>
		</section><section id="H7F7D644BF86E4C74A7180059302D36D5"><enum>2.</enum><header>Additional
			 allotments to address SCHIP funding shortfalls for fiscal year 2007</header>
			<subsection id="H7BDF013D126B4A18B053F4F8059707CE"><enum>(a)</enum><header>In
			 general</header><text>Section 2104(h) of the Social Security Act (42 U.S.C.
			 1397dd(h)), as added by section 201(a) of the National Institutes of Health
			 Reform Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/482">Public Law 109–482</external-xref>), is amended—</text>
				<paragraph id="H857E484755524350ACCF00FC3455BB5"><enum>(1)</enum><text>in
			 the heading for paragraph (2), by striking <quote><header-in-text level="paragraph" style="OLC">remainder of reduction</header-in-text></quote>
			 and inserting <quote><header-in-text level="paragraph" style="OLC">part</header-in-text></quote>;</text>
				</paragraph><paragraph id="HA1B8263414064A048BBBD4E93C1DE121"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (4) through (7)
			 as paragraphs (5) through (8), respectively; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H99A1788BBB9F400DADC0640015709B2E"><enum>(3)</enum><text>by inserting after
			 paragraph (3), the following:</text>

						<paragraph id="HBB91891C5E804CBEA74B4E32C356279F"><enum>(4)</enum><header>Additional
				allotments to address fiscal year 2007 funding shortfalls</header>
							<subparagraph id="H89923D71776148D191D443B802B33C42"><enum>(A)</enum><header>Allotment
				authority</header><text display-inline="yes-display-inline">From the amount
				made available under subparagraph (F) for additional allotments under this
				paragraph, subject to subparagraphs (C) and (D), the Secretary shall allot to
				each remaining shortfall State described in subparagraph (B) such amount as the
				Secretary determines will eliminate the estimated shortfall described in such
				subparagraph for the State for fiscal year 2007.</text>
							</subparagraph><subparagraph id="H8152F08F8DB740A087FBECE956E0BFFA"><enum>(B)</enum><header>Remaining
				shortfall State described</header><text>For purposes of subparagraph (A), a
				remaining shortfall State is a State with a State child health plan approved
				under this title for which the Secretary estimates, on the basis of the most
				recent data available to the Secretary as of the date of the enactment of this
				paragraph, that the projected Federal expenditures under such plan for the
				State for fiscal year 2007 will exceed the sum of—</text>
								<clause id="HFC5DD854367842E583AB52FFCDE9C212"><enum>(i)</enum><text>the amount of the
				State's allotments for each of fiscal years 2005 and 2006 that will not be
				expended by the end of fiscal year 2006;</text>
								</clause><clause id="HB64C2A9FE7194483A2DCCED1BB3D3E28"><enum>(ii)</enum><text>the amount of the
				State's allotment for fiscal year 2007; and</text>
								</clause><clause id="HB2E15CB412294DE3B42D09C5F9BC6E99"><enum>(iii)</enum><text>the amounts, if
				any, that are to be redistributed to the State during fiscal year 2007 in
				accordance with paragraphs (1) and (2).</text>
								</clause></subparagraph><subparagraph id="H5B1383F53F8B479296F0719D5E31C454"><enum>(C)</enum><header>Expenditure
				rules</header><text></text>
								<clause id="H188354ADD24C4FB09E5D00D35E744B99"><enum>(i)</enum><header>Coverage only
				for populations eligible on October 1, 2006</header><text>Subparagraph (A) of
				paragraph (5) shall apply to the expenditure of amounts allotted to remaining
				shortfall States under this paragraph in the same manner as such subparagraph
				applies to the expenditure of amounts redistributed under paragraphs (1) and
				(2) of this subsection.</text>
								</clause><clause id="H7AB2DAC3506D4B25BF7663A0C0DFB03C"><enum>(ii)</enum><header>Coverage only
				for children or pregnant women with income that does not exceed 200 percent of
				poverty</header><text>A remaining shortfall State shall use amounts allotted
				under this paragraph only for expenditures for providing child health
				assistance or other health benefits coverage to an individual who is a child or
				pregnant woman who is eligible for such assistance or coverage under the State
				child health plan and whose family income does not exceed 200 percent of the
				poverty line for a family of the size involved. For purposes of the preceding
				sentence, a child’s or pregnant woman’s family income shall be determined
				solely on the basis of adjusted gross income and without regard to any income
				or resource methodologies applied under the State child health plan for
				purposes of determining eligibility under such plan.</text>
								</clause></subparagraph><subparagraph id="H6C892BA0D77048BBB2A1268E2F1BBD5E"><enum>(D)</enum><header>Proration
				rule</header><text>If the amount available under subparagraph (F) is less than
				the total amount of the estimated shortfalls determined by the Secretary under
				subparagraph (A), the amount of the estimated shortfall for each remaining
				shortfall State determined under such subparagraph shall be reduced
				proportionally.</text>
							</subparagraph><subparagraph id="HFA6C4008D0E74B719F54473BFBF30A9"><enum>(E)</enum><header>Rule of
				construction</header><text>Nothing in this subparagraph shall be construed as
				prohibiting a State from using non-Federal funds to provide child health
				assistance or other health benefits coverage for individuals who are not
				described in subparagraph (C)(ii) and paragraph (5)(A) and are otherwise
				eligible for such assistance or coverage under the State child health
				plan.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H47AD7DCD2CD848AFB5284E4264141123"><enum>(F)</enum><header display-inline="yes-display-inline">Appropriation; allotment
				authority</header><text display-inline="yes-display-inline">For the purpose of
				providing additional allotments to remaining shortfall States under this
				paragraph there is appropriated, out of any funds in the Treasury not otherwise
				appropriated, $750,000,000 for fiscal year
				2007.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H571604358A604A3E821BDD79F06CB21"><enum>(b)</enum><header>Additional
			 conforming amendments</header><text>Section 2104(h) of such Act (42 U.S.C.
			 1397dd(h)) (as so added), is further amended—</text>
				<paragraph id="HA92E93E2C59C43DD0037C48270FD00D1"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(B), by striking
			 <quote>paragraph (4)(B)</quote> and inserting <quote>paragraph
			 (5)(B)</quote>;</text>
				</paragraph><paragraph id="H510C5394BB2F48A2AFC57892E1007DE8"><enum>(2)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph id="H2026452C98DA49FA91E3E714A03FACDC"><enum>(A)</enum><text>in subparagraph
			 (A), by striking <quote>paragraph (5)(B)</quote> and inserting
			 <quote>subparagraph (6)(B)</quote>; and</text>
					</subparagraph><subparagraph id="H10BE069729E64B7AB876A3507FB400C3"><enum>(B)</enum><text>in subparagraph
			 (B), by striking <quote>paragraph (4)(B)</quote> and inserting <quote>paragraph
			 (5)(B)</quote>;</text>
					</subparagraph></paragraph><paragraph id="HA2AE775A58024617B06E00EA3DBF1C46"><enum>(3)</enum><text>in paragraph
			 (6)(A) (as redesignated by subsection (a)(2)), by striking <quote>and
			 (3)</quote> and inserting <quote>(3), and (4)</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9DA0401B6C2D492D94BF45AA1054E63D"><enum>(4)</enum><text display-inline="yes-display-inline">in paragraph (7) (as so
			 redesignated)—</text>
					<subparagraph id="H60047D9FA77E4DA2881F6688740084D4"><enum>(A)</enum><text>in the first
			 sentence—</text>
						<clause id="H9323D7BC1A2A42E1002DDA39088CE45C"><enum>(i)</enum><text>by
			 inserting <quote>or allotted</quote> after <quote>redistributed</quote>;
			 and</text>
						</clause><clause id="HF260731685C744EC9CD400B95E59F6D9"><enum>(ii)</enum><text>by
			 inserting <quote>or allotments</quote> after <quote>redistributions</quote>;
			 and</text>
						</clause></subparagraph><subparagraph id="HCB8A3E9A8022472485002B27596699CF"><enum>(B)</enum><text>in the second
			 sentence, by striking <quote>and (3) in accordance with paragraph (5)</quote>
			 and inserting <quote>(3), and (4) in accordance with paragraph
			 (6)</quote>.</text>
					</subparagraph></paragraph></subsection></section><section id="HE9E0166360BD45F1AA6F94000437CFB8"><enum>3.</enum><header>Elimination of
			 State option to increase cap amount on individuals’ equity asset test for
			 eligibility for long-term care assistance under Medicaid</header>
			<subsection id="H645B683408DF42F1A29DB130E0F8A55F"><enum>(a)</enum><header>In
			 general</header><text>Section 1917(f)(1) of the Social Security Act (42 U.S.C.
			 1396p(f)(1)) is amended by striking subparagraph (B).</text>
			</subsection><subsection id="HBF18EDF772504D5790B23C18F700E200"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Such section is further amended—</text>
				<paragraph id="H65286400D2644E4A8FCCBE2286DA37D4"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>subparagraphs (B) and (C)</quote> and inserting
			 <quote>subparagraph (B)</quote>;</text>
				</paragraph><paragraph id="H8DA77D0334F54717952FA38EA313ABD9"><enum>(2)</enum><text>by redesignating
			 subparagraph (C) as subparagraph (B); and</text>
				</paragraph><paragraph id="H7C4B1EBA0D7744F3AFEEA04CED7596AF"><enum>(3)</enum><text>in subparagraph
			 (B), as so redesignated, by striking <quote>dollar amounts</quote> and
			 inserting <quote>dollar amount</quote>.</text>
				</paragraph></subsection><subsection id="HB36B4ACB32A44E949D3B1B5E3D73F225"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to
			 individuals who are determined eligible for medical assistance with respect to
			 nursing facility services or other long-term care services based on an
			 application filed on or after the date of the enactment of this section.</text>
