Criminal consequences for deportable alien’s failure to depart or failure to appear

Section 243(a) of the Immigration and Nationality Act (8 U.S.C. 1253(a)) is amended— (1)in the subsection heading, by inserting for failure to appear and before for failure to depart; (2)in paragraph (1)— (A)in subparagraph (C), by striking or at the end; (B)in subparagraph (D), by adding or at the end; and (C)by inserting after subparagraph (D) the following: (E)was ordered removed in absentia under section 240(b)(5)(A) (unless such order was rescinded under subparagraph (C) of such section), ; and (3)by striking the matter following subparagraph (E) (as added by paragraph (2)) and inserting the following: shall be imprisoned for a term of years not less than 1 and not more than 4 (or 10 years if the alien is a member of any of the classes described in paragraph (1)(E), (2), (3), or (4) of section 237(a)) and fined in accordance with title 18, United States Code..
