		<section id="HC056F04D7C8C4556B13050389B55AAFC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote>Veterans’ Benefits Protection Act</quote>.</text>
		</section><section id="H0E2E5DB0DD304ABF8C8E5F306F7FE4E" section-type="subsequent-section"><enum>2.</enum><header>Repeal of authority
			 for agent or attorney representation in veterans benefits cases before the
			 Department of Veterans Affairs</header>
			<subsection id="HDD841C31C82E4B5E8EDDB3D2BAC834B4"><enum>(a)</enum><header>Repeal</header><text>Title
			 38, United States Code, is amended—</text>
				<paragraph id="H7754A1EF071D411FA8BDD7D553E95F00"><enum>(1)</enum><text>in section
			 5904—</text>
					<subparagraph id="HC78C197CA0774F57833DAAEDB5D0B00"><enum>(A)</enum><text>in subsection
			 (a)—</text>
						<clause id="H8910CE4E0FCA4FC8B3B5C1E801F24756"><enum>(i)</enum><text>by
			 striking <quote>(1) Except as provided in paragraph (4), the Secretary</quote>
			 and inserting <quote>The Secretary</quote>;</text>
						</clause><clause id="H9915B845FB0B442C858B8EED21562268"><enum>(ii)</enum><text>by
			 striking paragraphs (2) through (6); and</text>
						</clause><clause id="HA6F141DB969E42B100C65BCCA789D8B5"><enum>(iii)</enum><text>by
			 inserting after the period at the end the following new sentence: <quote>The
			 Secretary may require that individuals, before being recognized under this
			 section, show that they are of good moral character and in good repute, are
			 qualified to render claimants valuable service, and otherwise are competent to
			 assist claimants in presenting claims.</quote>; and</text>
						</clause></subparagraph><subparagraph id="H88BC1DC7105A48D5B1D7B70095328789"><enum>(B)</enum><text>in subsection
			 (b)—</text>
						<clause id="H6E72AFAE6C044689AF3FF2001175A4B2"><enum>(i)</enum><text>by
			 striking paragraphs (6) through (9);</text>
						</clause><clause id="H894AB608EB2E40E6AA59DCB200A8A5DC"><enum>(ii)</enum><text>in
			 paragraph (4), by inserting <quote>or</quote> after the semicolon; and</text>
						</clause><clause id="HDF5922AE6A5A43D899B2D8EC9DCD1020"><enum>(iii)</enum><text>in
			 paragraph (5), by striking the semicolon and inserting a period;</text>
						</clause></subparagraph></paragraph><paragraph id="H17E4AFD3293A488A9CD038302C4166D1"><enum>(2)</enum><text>in section
			 5902(b)—</text>
					<subparagraph id="HDAC528DFA6394956A322EB7E123811F4"><enum>(A)</enum><text>by striking
			 <quote>(1)</quote>;</text>
					</subparagraph><subparagraph id="HF0334F19798045A2926E3C54B900E108"><enum>(B)</enum><text>by striking
			 paragraph (2); and</text>
					</subparagraph><subparagraph id="H4B4621D1A3B0489487EA844F070000CB"><enum>(C)</enum><text>by redesignating
			 subparagraphs (A) and (B) as paragraphs (1) and (2), respectively; and</text>
					</subparagraph></paragraph><paragraph id="H7D7CFB13D8A04D1687299291FFD715D8"><enum>(3)</enum><text>in section
			 5903—</text>
					<subparagraph id="H6AE5EEB23DD54F639F85405FE28495B"><enum>(A)</enum><text>by striking
			 subsection (b); and</text>
					</subparagraph><subparagraph id="HBCE896237D444F3B975FE4E29B1F56B2"><enum>(B)</enum><text>by striking
			 <quote>(a) <header-in-text level="subsection" style="USC">In
			 general—</header-in-text></quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H18EF41D2A94246AB002BA90055E7F053"><enum>(b)</enum><header>Repeal of
			 modification of date for commencement of services</header>
				<paragraph id="HC6490FBEE9D546759BC89FDE1B7CA030"><enum>(1)</enum><header>In
			 general</header><text>Effective as provided in paragraph (2), subsection (c) of
			 section 5904 of such title is amended—</text>
					<subparagraph id="H597D84F438D849B382F604EFD86D5185"><enum>(A)</enum><text>by striking
			 paragraph (3) and redesignating paragraph (4) as paragraph (3);</text>
					</subparagraph><subparagraph id="H4E781CA2525B4EDFB6C18BC097C6E98E"><enum>(B)</enum><text>in paragraph
			 (1)—</text>
						<clause id="H97833CCA133A44828E4004634E4E69C8"><enum>(i)</enum><text>by
			 striking <quote>a notice of disagreement is filed with respect to</quote> and
			 inserting <quote>the Board of Veterans’ Appeals first makes a final decision
			 in</quote>;</text>
						</clause><clause id="HEB6B6CCC52B949BD9165E86F00F23CA7"><enum>(ii)</enum><text>by
			 inserting after <quote>in the case.</quote> the following new sentence:
			 <quote>Such a fee may be charged, allowed, or paid in the case of services
			 provided after such date only if an agent or attorney is retained with respect
			 to such case before the end of the one-year period beginning on that
			 date.</quote>;</text>
						</clause><clause id="HA3FAC894B19045A9881B14EB4DE6FBC0"><enum>(iii)</enum><text>in
			 the last sentence, by striking <quote>fees charged, allowed, or paid
			 for</quote>; and</text>
						</clause><clause id="H72A897D405D744AA80C90529EF3EA592"><enum>(iv)</enum><text>by
			 striking <quote>paragraph (4)</quote> and inserting <quote>paragraph
			 (3)</quote>; and</text>
						</clause></subparagraph><subparagraph id="HF9D563ED0715440998DFB68B7CF6AA9D"><enum>(C)</enum><text>in paragraph
			 (2)—</text>
						<clause id="H0178282511404901AF8BCC09FAD06DCC"><enum>(i)</enum><text>by
			 striking <quote>after a notice of disagreement is filed with respect to the
			 case</quote> and inserting <quote>after the Board first makes a final decision
			 in the case</quote>;</text>
						</clause><clause id="H44EA29112FD44E8A93D2000069ABE9AE"><enum>(ii)</enum><text>by
			 striking <quote>with the Secretary pursuant to regulations prescribed by the
			 Secretary</quote> and inserting <quote>with the Board at such time as may be
			 specified by the Board</quote>; and</text>
						</clause><clause id="H44A96582D8C9414CB25BAB076CB227C1"><enum>(iii)</enum><text>by
			 adding at the end the following new sentences: <quote>The Board, upon its own
			 motion or the request of either party, may review such a fee agreement and may
			 order a reduction in the fee called for in the agreement if the Board finds
			 that the fee is excessive or unreasonable. A finding or order of the Board
			 under the preceding sentence may be reviewed by the United States Court of
			 Appeals for Veterans Claims under section 7263(d) of this title.</quote></text>
						</clause></subparagraph></paragraph></subsection><subsection id="H69B5C55BE33D45DEBDD796566B083EC2"><enum>(c)</enum><header>Repeal of repeal
			 of penalty</header><text>Section 5905 is amended by inserting after
			 <quote>Whoever</quote> the following: <quote>(1) directly or indirectly
			 solicits, contracts for, charges, or receives, or attempts to solicit, contract
			 for, charge, or receive, any fee or compensation except as provided in sections
			 5904 or 1984 of this title, or (2)</quote>.</text>
			</subsection><subsection id="H3CA48954DC2A4D9F86DD3F616B3942F2"><enum>(d)</enum><header>Conforming
			 repeals</header><text display-inline="yes-display-inline">Section 101 of the
			 Veterans Benefits, Health Care, and Information Technology Act of 2006 (Public
			 Law 109–461) is amended—</text>
				<paragraph id="H595044E0BEFF469890202976C124E97D"><enum>(1)</enum><text>in subsection (c),
			 by striking paragraph (2); and</text>
				</paragraph><paragraph id="H328FFB27C34B49AB95DFCDD37F1EC0B2"><enum>(2)</enum><text>by striking
			 subsections (h) and (i).</text>
