		<legis-type>A BILL</legis-type>
		<official-title>To provide institutions of higher education with a right
		  of action against entities that improperly regulate intercollegiate sports
		  activities.</official-title>

	<legis-body id="H3159444575F649E08E6352E32639F989" style="OLC">
		<section display-inline="no-display-inline" id="H30CA3AC78E444EED9866E5C512B3D80" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Protection of University Governance Act of
			 2007</short-title></quote>.</text>
		</section><section id="H3466CA3AE6B747A5905E3DDE49F457B4"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
			<paragraph id="H4A7CA3E2814D448884F0534B190663DA"><enum>(1)</enum><text display-inline="yes-display-inline">Voluntary collegiate self-regulation of
			 intercollegiate sports activities is a traditional and desirable
			 undertaking.</text>
			</paragraph><paragraph id="HAE27ABA21008457BB3F8E17FAE7115E1"><enum>(2)</enum><text>The regulation of
			 intercollegiate sports activities significantly affects interstate
			 commerce.</text>
			</paragraph><paragraph id="H62270329BB2F403E8E14381DAEF91E12"><enum>(3)</enum><text display-inline="yes-display-inline">Any attempt by an entity that regulates
			 intercollegiate sports activities to impose its view of correct social policy
			 on institutions of higher education participating in such activities is
			 inimical to the traditions of higher education in America and is inconsistent
			 with university governance and academic freedom. Attempts to regulate
			 institutions in this manner detract from the diversity of America and the
			 independence of thought and spirit that are the essence of higher education in
			 this Nation.</text>
			</paragraph></section><section id="H7CBCEBE3471A4445A55F909334F8FF9C"><enum>3.</enum><header>Improper actions
			 by entities that regulate intercollegiate sports activities</header>
			<subsection id="H9BB07C307AC3498D8E3C4CA6BBB7553C"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">An entity that
			 regulates intercollegiate sports activities shall not impose any penalty or
			 sanction on, or deny any benefit to, an institution of higher education by
			 reason of the team name, symbol, emblem, or mascot of any intercollegiate
			 sports activity of such institution.</text>
			</subsection><subsection id="HDABA14E615D54FDEA79989ED1E705F98"><enum>(b)</enum><header>Liability</header><text>An
			 entity that regulates intercollegiate sports activities shall be liable to an
			 institution of higher education that is aggrieved by such entity as a result of
			 any violation of
			 <internal-xref idref="H9BB07C307AC3498D8E3C4CA6BBB7553C" legis-path="3.(a)">subsection (a)</internal-xref>. In any action brought under
			 this subsection, the entity that regulates intercollegiate sports activities
			 may be subject to injunction and shall be liable to the aggrieved institution
			 of higher education for any damages caused thereby, including reasonable
			 attorneys’ fees and costs.</text>
			</subsection><subsection id="HB48FA7AE1FE9415B8016AB2468B77BD"><enum>(c)</enum><header>Jurisdiction</header><text display-inline="yes-display-inline">Any action brought under
			 <internal-xref idref="HDABA14E615D54FDEA79989ED1E705F98" legis-path="3.(b)">subsection (b)</internal-xref> may be filed in an
			 appropriate district court of the United States.</text>
			</subsection></section><section id="H58F5CF6363A045AE89050781B4CC649E"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H474F3FD5BCD84E0E98194FFF43E79455"><enum>(1)</enum><header>Entity that
			 regulates intercollegiate sports activities</header><text display-inline="yes-display-inline">The term <term>entity that regulates
			 intercollegiate sports activities</term> means any entity that regulates
			 intercollegiate sports activities and that is not a Federal, State, Tribal,
			 territorial, or local government entity.</text>
			</paragraph><paragraph id="H834A65B3D7CF45DD8D00DBF61EEA5100"><enum>(2)</enum><header>Institution of
			 higher education</header><text display-inline="yes-display-inline">The term
			 <term>institution of higher education</term> means an institution defined in
			 section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>), except that
			 such term does not include an institution described in subsection (a)(1)(C) of
			 that section.</text>
			</paragraph></section><section id="HE1A70DD3117C4F7FAABA919C7C00B2"><enum>5.</enum><header>Severability and
			 effective date</header>
			<subsection id="H263D0988C6604186A67141DB53AA001B"><enum>(a)</enum><header>Severability</header><text display-inline="yes-display-inline">The provisions of this Act are severable.
			 If any provision of this Act, or any application thereof, is found
			 unconstitutional, that finding shall not affect any provision or application of
			 the Act not so adjudicated.</text>
			</subsection><subsection id="HD1AF0824497E4F95AF46A73463F8DC51"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">This Act shall apply to
			 any violation of
			 <internal-xref idref="H9BB07C307AC3498D8E3C4CA6BBB7553C" legis-path="3.(a)">section 3(a)</internal-xref> by an entity that regulates
			 intercollegiate sports activities which occurs on or after August 4,
			 2005.</text>
