<section section-type="section-one" id="H07C642DD15C547DF8338EDA85CF54A0" display-inline="no-display-inline"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Parental Notification and Intervention Act of 2007</short-title></quote>.</text></section>
<section id="H4252C752F81D4923AA53D181C1DEB8E5"><enum>2.</enum><header>Parental notification</header>
<subsection id="H323E317B5D834BC4AC040199FB87E47D"><enum>(a)</enum><text>It shall be unlawful for any person or organization to perform any abortion on an unemancipated minor under the age of 18, to permit the facilities of the entity to be used to perform any abortion on such a minor, or to assist in the performance of any abortion on such a minor, if the person or organization has failed to comply with the following requirements:</text>
<paragraph id="H8358C6EC417446A8A5F8BFA1DB911C8"><enum>(1)</enum><text>Unless there is clear and convincing evidence of physical abuse of the minor by the parent, written notification has been provided to the parents of the minor, informing the parents that an abortion has been requested for the minor.</text></paragraph>
<paragraph id="HB73B1597981C4483A2F12347AFE5508B"><enum>(2)</enum><text>There is compliance with a 96-hour waiting period after notice has been received by the parents.</text></paragraph>
<paragraph id="H17D7C5420FB444C6A595D5C2E7CC75EF"><enum>(3)</enum><text>There is compliance with the procedures contained in section 3 of this Act.</text></paragraph></subsection>
<subsection id="H54029964AA524BC896CEF800B6F19E7"><enum>(b)</enum><text>Whoever violates the provisions of subsection (a) of this section shall be fined not more than $1,000,000, or imprisoned not more than 10 years, or both.</text></subsection>
<subsection id="HF5FB271986DE44F08FBDA9C4BFA17386"><enum>(c)</enum><text>The provisions of this section shall not apply if, with respect to an unemancipated minor for whom an abortion is sought, a defense or affirmative defense exists which would be applicable to other provisions of title 18, United States Code. In any such case, a physician other than the physician with principal responsibility for making the decision to perform the abortion must make a determination that—</text>
<paragraph id="HA222279D560A44D38D2432245BD85535"><enum>(1)</enum><text>a medical emergency exists in which an abortion on the minor is necessary due to a grave, physical disorder or disease of the minor that would, with reasonable medical certainty, cause the death of the minor if an abortion is not performed;</text></paragraph>
<paragraph id="H1FA6EAE988FA467B9047B36D36C34010"><enum>(2)</enum><text>parental notification is not possible as a result of the medical emergency; and</text></paragraph>
<paragraph id="H896641A6D4504D7D959382A5E2E98D1F"><enum>(3)</enum><text>certifications regarding compliance with paragraphs (1) and (2) of this subsection have been entered in the medical records of the minor, together with the reasons upon which the determinations are based, including a statement of relevant clinical findings.</text></paragraph></subsection>
<subsection id="H2C5C84DE7B2846C38BB731A700FFC287"><enum>(d)</enum><text>For purposes of this section, any parental notification provided to comply with the provisions of subsection (a) shall be provided through the manner described in paragraph (1), or through the manner described in paragraph (2), as follows:</text>
<paragraph id="H7EF7498B0A574EC6A77700562BAB3314"><enum>(1)</enum><text> The notification shall be provided through certified mail in accordance with the following procedures:</text>
<subparagraph id="HEDCB4E9F8F3341A9A49C5776E3E3A5A8"><enum>(A)</enum><text>The notification shall be addressed to the parent of the unemancipated minor.</text></subparagraph>
<subparagraph id="H1773B1C1B05C49D38FB4AA4E9E82A4A8"><enum>(B)</enum><text>The address used shall be the dwelling or usual place of abode of the parent.</text></subparagraph>
<subparagraph id="H422C6A2E2CED4D5299D8D8FD5809C00"><enum>(C)</enum><text>Return receipt shall be requested.</text></subparagraph>
<subparagraph id="H6702D3A2CF414D519D11D81E51421CD1"><enum>(D)</enum><text>Delivery shall be restricted to the parent.</text></subparagraph></paragraph>
<paragraph id="H7E6F2399D5C949E49200ADF04C44347E"><enum>(2)</enum><text>The notification shall be delivered personally to the parent.</text></paragraph></subsection>
<subsection id="H122E9307E7E4498091D255B359647924"><enum>(e)</enum><text>For purposes of this section, the term <term>parent</term> includes, but is not limited to, any legal guardian of the child.</text></subsection></section>
<section id="H74055EBF8BAA40AEA9BE77339312678B"><enum>3.</enum><header>Parental intervention</header><text display-inline="no-display-inline">Any parent required to be notified pursuant to section 2 of this Act may bring an action in the district court of the United States where the parent resides or where the unemancipated minor is located. The court shall issue an injunction barring the performance of the abortion until the issue has been adjudicated and the judgment is final. The court shall issue relief permanently enjoining the abortion unless the court determines that granting such relief would be unlawful.</text></section>
<section id="HFAAED1C75FC440C79815717C5B3BC6C2"><enum>4.</enum><header>Effective date and severability</header>
<subsection id="H0117836288E847BC9ED1EE927B6C2B78"><enum>(a)</enum><text>The provisions of this Act shall be severable. If any provision of this Act, or any application thereof, is found unconstitutional, that finding shall not affect any provision or application of the Act not so adjudicated.</text></subsection>
<subsection id="HE3B4FE8BE7F94C9C9E77EE9EB33F8DFD"><enum>(b)</enum><text>The provisions of this Act shall take effect immediately upon enactment.</text></subsection></section>
