		<official-title display="yes">To amend
		  <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/22">chapter 22</external-xref> of title 44,
		  United States Code, popularly known as the Presidential Records Act, to
		  establish procedures for the consideration of claims of constitutionally based
		  privilege against disclosure of Presidential records.</official-title>

		<section id="H97ECF86942694BCB9035F3EA06DEB2BE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Presidential Records Act Amendments of
			 2007</short-title></quote>.</text>
		</section><section id="H783146FE0927476CBCCBE9E09263D4A4"><enum>2.</enum><header>Procedures for
			 consideration of claims of constitutionally based privilege against
			 disclosure</header>
			<subsection id="H904F1043804F45BDA7CD71A786F75CC"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/22">Chapter 22</external-xref> of title 44,
			 United States Code, is amended by adding at the end the following:</text>
				<quoted-block id="H70B9C5C1D5314AA18DEB58B05EAC434B" style="USC">
					<section id="H8C7EBE4EF41646FB96955018B1B16DD"><enum>2208.</enum><header>Claims of
				constitutionally based privilege against disclosure</header>
						<subsection id="H2BFC51B6B0CC4EBBA400737B2367D36"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HAA3EF9D9251B4A8DB93EFBFF8E8F19BE"><enum>(1)</enum><text>When the Archivist
				determines under this chapter to make available to the public any Presidential
				record that has not previously been made available to the public, the Archivist
				shall—</text>
								<subparagraph id="H69CB282DB96646B0A74F9698C7FF19A1" indent="up1"><enum>(A)</enum><text>promptly provide notice of such
				determination to—</text>
									<clause id="H9714B5E6F59B4F10BAEDB7C026B1A1D"><enum>(i)</enum><text>the former President during whose
				term of office the record was created; and</text>
									</clause><clause id="HE2D8FA011D4143BA9F69E0F5F7A4EB00"><enum>(ii)</enum><text>the incumbent President;
				and</text>
									</clause></subparagraph><subparagraph id="HB32F502EFE644F07906BA52654E4C5F7" indent="up1"><enum>(B)</enum><text>make the notice available to the
				public.</text>
								</subparagraph></paragraph><paragraph id="HAF5EE94171B84F469CE7A525F8728F45" indent="up1"><enum>(2)</enum><text>The notice under paragraph
				(1)—</text>
								<subparagraph id="H39323118102745F483255FA2EF6C689B"><enum>(A)</enum><text>shall be in writing; and</text>
								</subparagraph><subparagraph id="H21A39C82E9C7435F906E0081CC2F796B"><enum>(B)</enum><text>shall include such information as may
				be prescribed in regulations issued by the Archivist.</text>
								</subparagraph></paragraph><paragraph id="H6632CDE6BFC44C3396FBD07CAB456EF" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HFC92AEB6B20049A4B0C42447AFD57C4D"><enum>(A)</enum><text>Upon the expiration of
				the 20-day period (excepting Saturdays, Sundays, and legal public holidays)
				beginning on the date the Archivist provides notice under paragraph (1)(A), the
				Archivist shall make available to the public the record covered by the notice,
				except any record (or reasonably segregable part of a record) with respect to
				which the Archivist receives from a former President or the incumbent President
				notification of a claim of constitutionally based privilege against disclosure
				under subsection (b).</text>
								</subparagraph><subparagraph id="HE9785CB8D0BA4208B002C4831971D559" indent="up1"><enum>(B)</enum><text>A former President or the incumbent
				President may extend the period under subparagraph (A) once for not more than
				20 additional days (excepting Saturdays, Sundays, and legal public holidays) by
				filing with the Archivist a statement that such an extension is necessary to
				allow an adequate review of the record.</text>
								</subparagraph><subparagraph id="H15CEC26CF7184E418443CB30CD849D34" indent="up1"><enum>(C)</enum><text>Notwithstanding subparagraphs (A) and
				(B), if the period under subparagraph (A), or any extension of that period
				under subparagraph (B), would otherwise expire after January 19 and before July
				20 of the year in which the incumbent President first takes office, then such
				period or extension, respectively, shall expire on July 20 of that year.</text>
								</subparagraph></paragraph></subsection><subsection id="H2769EDC256074AF8A21F3799598D51B1"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HCB39849EDA824CD2BF001736D7FA51CC"><enum>(1)</enum><text>For purposes of this
				section, any claim of constitutionally based privilege against disclosure must
				be asserted personally by a former President or the incumbent President, as
				applicable.</text>
							</paragraph><paragraph id="HCDF63C68DCDF42A8B3A16E593273DFC4" indent="up1"><enum>(2)</enum><text>A former President or the incumbent
				President shall notify the Archivist, the Committee on Oversight and Government
				Reform of the House of Representatives, and the Committee on Homeland Security
				and Governmental Affairs of the Senate of a privilege claim under paragraph (1)
				on the same day that the claim is asserted under paragraph (1).</text>
							</paragraph></subsection><subsection id="H3BCB73E8475B43CAB79EEB964562EAA3"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H724AFB8C1B96492784568DFAE520B000"><enum>(1)</enum><text>The Archivist shall not
				make publicly available a Presidential record that is subject to a privilege
				claim asserted by a former President until the expiration of the 20-day period
				(excluding Saturdays, Sundays, and legal public holidays) beginning on the date
				the Archivist is notified of the claim.</text>
							</paragraph><paragraph id="HE3E7C49D93C34E0AB28FCD2EF9935E77" indent="up1"><enum>(2)</enum><text>Upon the expiration of such period
				the Archivist shall make the record publicly available unless otherwise
				directed by a court order in an action initiated by the former President under
				section 2204(e).</text>
							</paragraph></subsection><subsection id="H602FA4973BAB43FDA67BC54E5976C4D2"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HD04560E49A234078AC8C83FEEBC0A01F"><enum>(1)</enum><text>The Archivist shall not
				make publicly available a Presidential record that is subject to a privilege
				claim asserted by the incumbent President unless—</text>
								<subparagraph id="H9BAE8FAA20294EEEB09165A6290952A7" indent="up1"><enum>(A)</enum><text>the incumbent President withdraws the
				privilege claim; or</text>
								</subparagraph><subparagraph id="HBD0F80123F254D77A48EF5415C5E3B46" indent="up1"><enum>(B)</enum><text>the Archivist is otherwise directed by
				a final court order that is not subject to appeal.</text>
								</subparagraph></paragraph><paragraph id="H59E1D151B7CF4A61BCFF9CC9524D9700" indent="up1"><enum>(2)</enum><text>This subsection shall not apply with
				respect to any Presidential record required to be made available under section
				2205(2)(A) or (C).</text>
							</paragraph></subsection><subsection id="HAA154845343146AAA74FEE00C91DB8A7"><enum>(e)</enum><text>The Archivist
				shall adjust any otherwise applicable time period under this section as
				necessary to comply with the return date of any congressional subpoena,
				judicial subpoena, or judicial
				process.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H7FF6FECC2EC04C9CAB579F637218F447"><enum>(b)</enum><header>Restrictions</header><text>Section
			 2204 of title 44, United States Code (relating to restrictions on access to
			 presidential records) is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H82DC33FDE01B47BA83586802036FB0BF" style="OLC">
					<subsection id="H3B5DABA3C2774FB4ADFBCEFB5D9C5372"><enum>(f)</enum><text>The Archivist
				shall not make available any original presidential records to any individual
				claiming access to any presidential record as a designated representative under
				section 2205(3) if that individual has been convicted of a crime relating to
				the review, retention, removal, or destruction of records of the
				Archives.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H243A76738DEF4E678710849F006508B"><enum>(c)</enum><header>Conforming
			 amendments</header><paragraph commented="no" display-inline="yes-display-inline" id="HEF687DAF053440598500BB91881D9103"><enum>(1)</enum><text>Section 2204(d) of title
			 44, United States Code, is amended by inserting <quote>, except section
			 2208,</quote> after <quote>chapter</quote>.</text>
				</paragraph><paragraph id="H0B0F70416EB74CA180AFF2537486DF0" indent="up1"><enum>(2)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/44/2207">Section 2207</external-xref> of title 44, United
			 States Code, is amended in the second sentence by inserting <quote>, except
			 section 2208,</quote> after <quote>chapter</quote>.</text>
				</paragraph></subsection><subsection id="H74D71853CBA9445AA78BFB3F05210570"><enum>(d)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/22">chapter 22</external-xref> of title 44,
			 United States Code, is amended by adding at the end the following:</text>

			</subsection></section><section id="HEB6F25DE7B004A52A344690680FC4B81"><enum>3.</enum><header>Executive order
			 of November 1, 2001</header><text display-inline="no-display-inline">Executive
			 Order No. 13233, dated November 1, 2001 (66 Fed. Reg. 56025), shall have no
			 force or effect.</text>
