		<official-title>To require the prompt issuance by the Secretary of
		  Agriculture of regulations to restore integrity to the payment limitation
		  requirements applicable to commodity payments and benefits, to reduce waste,
		  fraud, and abuse related to the receipt of commodity payments and benefits, and
		  for other purposes.</official-title>

		<section display-inline="no-display-inline" id="H07F9FA977B574969BBE7053E49ECF01E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Farm Programs Payment Limitation
			 Integrity Act</short-title></quote>.</text>
		</section><section id="HE89160C28E8E4505979E4C248983C9D0"><enum>2.</enum><header>Issuance of
			 regulations to establish measurable standards to prevent use of separate
			 entities to exceed payment limitations applicable to commodity payments and to
			 limit payments to active farmers</header>
			<subsection id="HE57F894B4FDD4BD3ABC0BBB200A49F62"><enum>(a)</enum><header>Standards
			 regarding active personal management and evasion schemes and
			 devices</header><text display-inline="yes-display-inline">The Secretary of
			 Agriculture (in this section referred to as the <quote>Secretary</quote>) shall
			 promulgate regulations to establish measurable standards of—</text>
				<paragraph id="H91E7F505C8214F58A588C756DB967338"><enum>(1)</enum><text>what constitutes a
			 significant contribution of active personal management with respect to a farm
			 operation for purposes of applying the payment limitations specified in section
			 1001 of the Food Security of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/7/1308">7 U.S.C. 1308</external-xref>); and</text>
				</paragraph><paragraph id="H3DF59D5190EC4CE6BBB79DF32105F6C1"><enum>(2)</enum><text>what constitutes a
			 scheme or device to effectively evade such payment limits or to evade section
			 1001A or 1001C of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1308-1">7 U.S.C. 1308–1</external-xref>, 1308–3).</text>
				</paragraph></subsection><subsection id="H80F6B0393A714803990066CE65553700"><enum>(b)</enum><header>Enforcement of
			 multiple entity limitations</header><text display-inline="yes-display-inline">The Secretary shall promulgate regulations
			 to ensure that total payments and gains described in section 1001 of the Food
			 Security of 1985 made to or through joint operations or multiple entities under
			 the primary control of a person, in combination with the payments and gains
			 received directly by the person, do not exceed twice the applicable dollar
			 amounts specified in subsections (b), (c), and (d) of such section.</text>
			</subsection><subsection id="H5062A121674C41759463514F532C0530"><enum>(c)</enum><header>Attribution of
			 payments and gains derived from certain farming operations</header><text display-inline="yes-display-inline">In the case of a person that in the
			 aggregate owns, conducts farming operations, or provides custom farming
			 services on land with respect to which the aggregate commodity payments exceed
			 the applicable dollar amounts specified in subsections (b), (c), and (d) of
			 section 1001 of the Food Security of 1985, the Secretary shall promulgate
			 regulations to ensure that all payments and gains made on crops produced on the
			 land are attributed as follows:</text>
				<paragraph id="HDC0A946044DF4D23B6B4A53F565407DD"><enum>(1)</enum><text>To a person that
			 rents land as lessee or lessor through a crop share lease and receives a share
			 of the payments that is less than the usual and customary share of the crop
			 received by the lessee or lessor, as determined by the Secretary.</text>
				</paragraph><paragraph id="H68CE759DE44A4EF49038573FBD9EF36F"><enum>(2)</enum><text>To a person that
			 provides custom farming services through arrangements under which—</text>
					<subparagraph id="H67B9CDFF41374534BD07B79ED9DAF39F"><enum>(A)</enum><text>all or part of the
			 compensation for the services is at risk;</text>
					</subparagraph><subparagraph id="HF9C0625CDEF84837B3E6FEC3F3CFD827"><enum>(B)</enum><text>farm management
			 services are provided by—</text>
						<clause id="H7CA1E2DE86B540F2B95028D927E8C388"><enum>(i)</enum><text>the
			 same person;</text>
						</clause><clause id="HA821FD1E5B884E56825858FF413E9EB3"><enum>(ii)</enum><text>an
			 immediate family member; or</text>
						</clause><clause id="H3A178AC6C3C948EEB69F00CEF33652D1"><enum>(iii)</enum><text>an
			 entity or individual that has a business relationship that is not an arm’s
			 length relationship, as determined by the Secretary; or</text>
						</clause></subparagraph><subparagraph id="HA686E56EABD84433AA9D04BD3735BA60"><enum>(C)</enum><text>more than 2/3 of
			 the farming operations are conducted as custom farming services provided
			 by—</text>
						<clause id="H998101EF60C4498DBE787993C85563E9"><enum>(i)</enum><text>the
			 same person;</text>
						</clause><clause id="HAC4F13D7377A461290EBEDB1244056F"><enum>(ii)</enum><text>an
			 immediate family member; or</text>
						</clause><clause id="HE6A7C5AFD7EA403289D2999DE305C3C9"><enum>(iii)</enum><text>an
			 entity or individual that has a business relationship that is not an arm’s
			 length relationship, as determined by the Secretary.</text>
						</clause></subparagraph></paragraph><paragraph id="HBA44222E9BDA447D99934F017EDDC27E"><enum>(3)</enum><text>To a person under
			 such other arrangements as the Secretary determines are established to transfer
			 payments from persons that would otherwise exceed the applicable dollar amounts
			 specified in subsections (b), (c), and (d) of such section.</text>
				</paragraph><paragraph id="H147DC8FC1A7B4CE1B0B2901941F363D2"><enum>(4)</enum><text>To the direct
			 recipient of the commodity payments as well as to the person to whom the
			 payments are attributed under paragraph (1), (2), or (3).</text>
				</paragraph></subsection><subsection id="HE51A47AF4BA244BC842303B506E4B000"><enum>(d)</enum><header>Primary
			 control</header><text>In the regulations required by this section, the
			 Secretary shall define <quote>primary control</quote> to include a joint
			 operation or multiple entity in which a person owns an interest that is equal
			 to or greater than the interest of any other one or more persons that
			 materially participate on a regular, substantial, and continuous basis in the
			 management of the operation or entity.</text>
			</subsection><subsection id="H8A2699AE6F4E4689AB0076954DB4FB59"><enum>(e)</enum><header>Material
			 participation</header><text display-inline="yes-display-inline">In the
			 regulations required by this section, the Secretary shall ensure that the
			 standards for active personal management require no less involvement than the
			 standard for materially participating on a regular, substantial, and continuous
			 basis in the management of the operation or entity as defined by Treasury
			 regulation section 1.469–5T(a)(1), as in effect on the date of the enactment of
			 this Act.</text>
			</subsection><subsection id="HD5A716CCA63348C3B94E96B6D553DBB"><enum>(f)</enum><header>Time for
			 issuance; procedure</header><text>The regulations required by this section
			 shall be issued in final form not later than 270 days after the date of the
			 enactment of this Act. To ensure compliance with this deadline, the Secretary
			 shall issue the regulations without regard to—</text>
				<paragraph id="HDA619EB145CA4ED1978D2429413F024C"><enum>(1)</enum><text>the notice and
			 comment provisions of <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code;</text>
				</paragraph><paragraph id="HEAEB743AE64644DDAD527D12C1BBA7E"><enum>(2)</enum><text>the Statement of
			 Policy of the Secretary of Agriculture effective July 24, 1971 (36 Fed. Reg.
			 13804), relating to notices of proposed rulemaking and public participation in
			 rulemaking; and</text>
				</paragraph><paragraph id="HB5C92990539D430FB0EFB12FFE8375B"><enum>(3)</enum><text>chapter 35 of title
			 44, United States Code (commonly known as the Paperwork Reduction Act).</text>
				</paragraph></subsection><subsection id="HC4438A523FFF489185BFC45D83EC85F9"><enum>(g)</enum><header>Congressional
			 review of agency rulemaking</header><text>In carrying out this section, the
			 Secretary shall use the authority provided under <external-xref legal-doc="usc" parsable-cite="usc/5/808">section 808</external-xref> of title 5, United
			 States Code.</text>
			</subsection></section><section id="H0D2D1E2CA2B146D3B3B75E3CF6DB81DB"><enum>3.</enum><header>Prevention of
			 schemes or devices to evade payment limitations</header><text display-inline="no-display-inline">Section 1001B of the Food Security Act of
			 1985 (<external-xref legal-doc="usc" parsable-cite="usc/7/1308-2">7 U.S.C. 1308–2</external-xref>) is amended—</text>
			<paragraph id="H98E99E39E60245DC8E4E6896AB72C01E"><enum>(1)</enum><text>by striking
			 <quote>If</quote> and inserting <quote>(a)
			 <header-in-text level="subsection" style="OLC">Basic penalty for evasion of
			 payment limitations</header-in-text>.—Subject to subsection (b), if</quote>;
			 and</text>
			</paragraph><paragraph id="HAC0A7C7774B14756B1007F74BFD2836F"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
				<quoted-block id="HC51EF04969484012A6EDAFAC17B80131" style="OLC">
					<subsection id="H77E101E3DCCD475892C808FD070872F2"><enum>(b)</enum><header>Effect of
				fraud</header><text>If the Secretary determines that a person has committed
				fraud in connection with the adoption of a scheme or device to evade, or that
				has the purpose of evading, section 1001, 1001A, or 1001C, the person shall be
				ineligible to receive farm program payments (as described in subsections (b),
				(c), and (d) of section 1001 as being subject to limitation) applicable to the
				crop year for which the scheme or device was adopted and the succeeding five
				crop
				years.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
