<legis-type>AN ACT</legis-type> 
<official-title display="yes">To direct the Secretary of Transportation to issue regulations to reduce the incidence of child injury and death occurring inside or outside of light motor vehicles, and for other purposes.</official-title>

<section id="H34C12FE7952D43B7A8CB72806F4C2D62" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cameron Gulbransen Kids Transportation Safety Act of 2007</short-title></quote> or the <quote><short-title>K.T. Safety Act of 2007</short-title></quote>.</text></section> 
<section id="H435DB28B235745BA8CA82C2B258700FD"><enum>2.</enum><header>Rulemaking regarding child safety</header> 
<subsection id="H810E492A05FB4533B4C68B05FEC167F2"><enum>(a)</enum><header>Power window safety</header> 
<paragraph id="H54FD947D1F5E4DFA89DC26366B95E7EF"><enum>(1)</enum><header>Consideration of rule</header><text>Not later than 18 months after the date of the enactment of this Act, the Secretary of Transportation (referred to in this Act as the <quote>Secretary</quote>) shall initiate a rulemaking to consider prescribing or amending Federal motor vehicle safety standards to require power windows and panels on motor vehicles to automatically reverse direction when such power windows and panels detect an obstruction to prevent children and others from being trapped, injured, or killed.</text></paragraph> 
<paragraph id="H2F568FB402F9405EB90011AE3D09CDD8"><enum>(2)</enum><header>Deadline for decision</header><text display-inline="yes-display-inline">If the Secretary determines such safety standards are reasonable, practicable, and appropriate, the Secretary shall prescribe, under <external-xref legal-doc="usc" parsable-cite="usc/49/30111">section 30111</external-xref> of title 49, United States Code, the safety standards described in paragraph (1) not later than 30 months after the date of enactment of this Act. If the Secretary determines that no additional safety standards are reasonable, practicable, and appropriate, the Secretary shall—</text> 
<subparagraph id="H70E40D0BE4344D7E914CFCB5E8862608"><enum>(A)</enum><text>not later than 30 months after the date of enactment of this Act, transmit a report to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate describing the reasons such standards were not prescribed; and</text></subparagraph> 
<subparagraph id="H7AA3F294D5874EF1B64B248FED5CBD10"><enum>(B)</enum><text display-inline="yes-display-inline">publish and otherwise make available to the public through the Internet and other means (such as the <quote>Buying a Safer Car</quote> brochure) information regarding which vehicles are or are not equipped with power windows and panels that automatically reverse direction when an obstruction is detected.</text></subparagraph></paragraph></subsection> 
<subsection id="HF62BCCD7D9DE4A9B99C6B9AAC08C006B"><enum>(b)</enum><header>Rearward visibility</header><text display-inline="yes-display-inline">Not later than 12 months after the date of the enactment of this Act, the Secretary shall initiate a rulemaking to revise Federal Motor Vehicle Safety Standard 111 (FMVSS 111) to expand the required field of view to enable the driver of a motor vehicle to detect areas behind the motor vehicle to reduce death and injury resulting from backing incidents, particularly incidents involving small children and disabled persons. The Secretary may prescribe different requirements for different types of motor vehicles to expand the required field of view to enable the driver of a motor vehicle to detect areas behind the motor vehicle to reduce death and injury resulting from backing incidents, particularly incidents involving small children and disabled persons. Such standard may be met by the provision of additional mirrors, sensors, cameras, or other technology to expand the driver’s field of view. The Secretary shall prescribe final standards pursuant to this subsection not later than 36 months after the date of enactment of this Act.</text></subsection> 
<subsection id="H44A753C9F77D4565ADA68F49A44FD3A2"><enum>(c)</enum><header>Phase-In period</header><text></text> 
<paragraph id="H9415D5F69D0E4DA3B834F9B71FBC2F58"><enum>(1)</enum><header>Phase-in period required</header><text display-inline="yes-display-inline">The safety standards prescribed pursuant to subsections (a) and (b) shall establish a phase-in period for compliance, as determined by the Secretary, and require full compliance with the safety standards not later than 48 months after the date on which the final rule is issued.</text> </paragraph> 
<paragraph id="HA6C4BBC6AC4B4C35BEE8F98000521855"><enum>(2)</enum><header>Phase-in priorities</header><text>In establishing the phase-in period of the rearward visibility safety standards required under subsection (b), the Secretary shall consider whether to require the phase-in according to different types of motor vehicles based on data demonstrating the frequency by which various types of motor vehicles have been involved in backing incidents resulting in injury or death. If the Secretary determines that any type of motor vehicle should be given priority, the Secretary shall issue regulations that specify—</text> 
<subparagraph id="H4643F859E5FA46198B729E01E85F461C"><enum>(A)</enum><text>which type or types of motor vehicles shall be phased-in first; and</text></subparagraph> 
<subparagraph id="H747C46BD01114F90A4A0001602A44DDA"><enum>(B)</enum><text>the percentages by which such motor vehicles shall be phased-in.</text></subparagraph> </paragraph></subsection> 
<subsection id="HF48FFD558278419C80BF73D289836DDB"><enum>(d)</enum><header>Preventing motor vehicles from rolling away</header> 
<paragraph id="H2790E899E8214869BC009B788F33127B"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">Each motor vehicle with an automatic transmission that includes a <quote>park</quote> position manufactured for sale after September 1, 2010, shall be equipped with a system that requires the service brake to be depressed before the transmission can be shifted out of <quote>park</quote>. This system shall function in any starting system key position in which the transmission can be shifted out of <quote>park</quote>.</text></paragraph> 
<paragraph id="H920A96086D8B4A228BBC67DA5F2DA1AB"><enum>(2)</enum><header>Treatment as motor vehicle safety standard</header><text display-inline="yes-display-inline">A violation of paragraph (1) shall be treated as a violation of a motor vehicle safety standard prescribed under <external-xref legal-doc="usc" parsable-cite="usc/49/30111">section 30111</external-xref> of title 49, United States Code, and shall be subject to enforcement by the Secretary under chapter 301 of such title.</text></paragraph> 
<paragraph id="H51831A64EB38428E00B3F00FB901EE0"><enum>(3)</enum><header>Publication of noncompliant vehicles</header> 
<subparagraph id="H160BBD3068CB4F9F9F34B2603073319E"><enum>(A)</enum><header>Information submission</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, for the current model year and annually thereafter through 2010, each motor vehicle manufacturer shall transmit to the Secretary the make and model of motor vehicles with automatic transmissions that include a <quote>park</quote> position that do not comply with the requirements of paragraph (1).</text></subparagraph> 
<subparagraph id="H6718FDEDD5644C4EB800BFDCF62BE8EE"><enum>(B)</enum><header>Publication</header><text display-inline="yes-display-inline">Not later than 30 days after receiving the information submitted under subparagraph (A), the Secretary shall publish and otherwise make available to the public through the Internet and other means the make and model of the applicable motor vehicles that do not comply with the requirements of paragraph (1). Any motor vehicle not included in the publication under this subparagraph shall be presumed to comply with such requirements.</text></subparagraph></paragraph></subsection> 
<subsection id="H7732EC1EBDC043BF8F44BBB0555681E4" commented="no"><enum>(e)</enum><header>Definition of motor vehicle</header><text>As used in this Act and for purposes of the motor vehicle safety standards described in subsections (a) and (b), the term <term>motor vehicle</term> has the meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/49/30102">section 30102(a)(6)</external-xref> of title 49, United States Code, except that such term shall not include—</text> 
<paragraph id="H86C8A0F2705A4C46AA9883D0DA00DCB6"><enum>(1)</enum><text>a motorcycle or trailer (as such terms are defined in <external-xref legal-doc="regulation" parsable-cite="cfr/49/571.3">section 571.3</external-xref> of title 49, Code of Federal Regulations); or</text></paragraph> 
<paragraph id="H53FD0BF0DAD148B2B93143C82374CD53"><enum>(2)</enum><text>any motor vehicle that is rated at more than 10,000 pounds gross vehicular weight.</text></paragraph></subsection> 
<subsection id="H3B110FA7F16243F0B7B51608B70065F5"><enum>(f)</enum><header>Database on injuries and deaths in nontraffic, noncrash events</header> 
<paragraph id="H94843BDF2AAA4C9FA2E47F959DA037A3"><enum>(1)</enum><header>In general</header><text>Not later than 12 months after the date of the enactment of this Act, the Secretary shall establish and maintain a database of injuries and deaths in nontraffic, noncrash events involving motor vehicles.</text></paragraph> 
<paragraph id="H19700F3E6C6B43A48E02C94C4F6570FD"><enum>(2)</enum><header>Contents</header><text>The database established pursuant to paragraph (1) shall include information regarding—</text> 
<subparagraph id="H9E95313826CA41BD8E71FEF8BB69DDE"><enum>(A)</enum><text>the number, types, and causes of injuries and deaths resulting from the events described in paragraph (1);</text></subparagraph> 
<subparagraph id="H6E1BF7C0A4D8450D9048BB7D7C417B2F"><enum>(B)</enum><text>the make, model, and model year of motor vehicles involved in such events, when practicable; and</text></subparagraph> 
<subparagraph id="H8B00E25F941C4271BA16DE98801DBF92"><enum>(C)</enum><text>other variables that the Secretary determines will enhance the value of the database.</text></subparagraph></paragraph> 
<paragraph id="H6A631305558C474A9408E51DD2A9053C"><enum>(3)</enum><header>Availability</header><text display-inline="yes-display-inline">The Secretary shall make the information contained in the database established pursuant to paragraph (1) available to the public through the Internet and other means.</text></paragraph></subsection> </section> 
<section id="HF71ADCBB148C4D288180EFC83E9941B5"><enum>3.</enum><header>Child safety information program</header> 
<subsection id="H5DEF18A42EDA404B97B4A6B7B0012EF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 9 months after the date of the enactment of this Act, the Secretary shall provide information about hazards to children in nontraffic, noncrash incident situations by—</text> 
<paragraph id="H8201D9B83E81452781658C8489E26098"><enum>(1)</enum><text display-inline="yes-display-inline">supplementing an existing consumer information program relating to child safety; or</text></paragraph> 
<paragraph id="HE64A3C8F9ACD46FEBE4DD619A8487D5B"><enum>(2)</enum><text display-inline="yes-display-inline">creating a new consumer information program relating to child safety.</text></paragraph></subsection> 
<subsection id="H66815027CA1948048E2EDE62C35E9101"><enum>(b)</enum><header>Program requirements</header><text display-inline="yes-display-inline">In carrying out the program under subsection (a), the Secretary shall—</text> 
<paragraph id="HD59F751684E14F878431FF1C0075C1B1"><enum>(1)</enum><text>utilize information collected pursuant to section 2(f) regarding nontraffic, noncrash injuries, and other relevant data the Secretary considers appropriate, to establish priorities for the program;</text></paragraph> 
<paragraph id="HA914A5CEAE004ABEB152FBD246FBF4AB"><enum>(2)</enum><text>address ways in which parents and caregivers can reduce risks to small children arising from back over incidents, hyperthermia in closed motor vehicles, accidental actuation of power windows, and any other risks the Secretary determines should be addressed; and</text></paragraph> 
<paragraph id="H2801F7C08B4845A5A02B2CFD25C5794E"><enum>(3)</enum><text>make information related to the program available to the public through the Internet and other means.</text></paragraph></subsection></section> 
<section id="H76E598C3562F47A6B509003C17BBD90"><enum>4.</enum><header>Deadlines</header><text display-inline="no-display-inline">If the Secretary determines that the deadlines applicable under this Act cannot be met, the Secretary shall—</text> 
<paragraph id="H9F4D1C62B27B44CAAAEABEE096255992"><enum>(1)</enum><text>establish new deadlines; and</text></paragraph> 
<paragraph id="HFD03882F6E034D8D8056707444E9151F"><enum>(2)</enum><text display-inline="yes-display-inline">notify the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate of the new deadlines and describing the reasons the deadlines specified under this Act could not be met.</text></paragraph></section>
