			 Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for
			 Users (119 Stat. 1156) are amended by striking <quote>paragraph (1)</quote>
			 each place it appears and inserting <quote>paragraph (2)</quote>.</text>

			 Federal lands highways</header><text>Section 1119 of the Safe, Accountable,
			 Flexible, Efficient Transportation Equity Act: A Legacy for Users (119 Stat.
			 1190) is amended by striking subsection (m) and inserting the following:</text>

				$20,000,000 for each fiscal year may be used for the maintenance of forest
				highways;</text>

				$1,000,000 for each fiscal year may be used for signage identifying public
				hunting and fishing access; and</text>

				$10,000,000 for each fiscal year shall be used by the Secretary of Agriculture
				to pay the costs of facilitating the passage of aquatic species beneath forest
				roads (as defined in <external-xref legal-doc="usc" parsable-cite="usc/23/101">section 101(a)</external-xref> of title 23, United
				States Code), including the costs of constructing, maintaining, replacing, and
				removing culverts and bridges, as
				appropriate.</text>

			 Legacy for Users (119 Stat. 1205) is amended in the State column by inserting
			 <quote>LA,</quote> after <quote>TX,</quote>.</text>

			 through 609, respectively</quote> and inserting <quote>through 190 as sections

			 systems management and operations defined</header><text>Section 101(a) of
			 title 23, United States Code, is amended by adding at the end the

				general</header><text>The term <term>transportation systems management and
				operations</term> means an integrated program to optimize the performance of
				existing infrastructure through the implementation of multimodal and
				intermodal, cross-jurisdictional systems, services, and projects designed to
				preserve capacity and improve security, safety, and reliability of the
				transportation system.</text>
							</subparagraph><subparagraph commented="no" id="H9994749509664601A7131CBF8FBDBDDC"><enum>(B)</enum><header>Inclusions</header><text>The
				term <term>transportation systems management and operations</term>
				includes—</text>
								<clause commented="no" id="HD00EDC80AB9B413E8392F0721E00D6"><enum>(i)</enum><text>regional operations
				collaboration and coordination activities between transportation and public
				safety agencies; and</text>
								</clause><clause commented="no" id="H5428BBEF46764F149410DC15166FDDE"><enum>(ii)</enum><text>improvements to
				the transportation system, such as traffic detection and surveillance, arterial
				management, freeway management, demand management, work zone management,
				emergency management, electronic toll collection, automated enforcement,
				traffic incident management, roadway weather management, traveler information
				services, commercial vehicle operations, traffic control, freight management,
				and coordination of highway, rail, transit, bicycle, and pedestrian
				operations.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" id="HD40B2128EB6A40199100F825BFE99565"><enum>(h)</enum><header>Correction of
			 reference in apportionment of highway safety improvement program
			 funds</header><text>Effective October 1, 2006,
			 section
			 104(b)(5)(A)(iii) of title 23, United States Code, is amended
			 by striking <quote>the Federal-aid system</quote> each place it appears and
			 inserting <quote>Federal-aid highways</quote>.</text>
				</subsection><subsection id="H83326A469E584CFE907FD5BDBF9D4507"><enum>(i)</enum><header>Correction of
			 amendment To advance construction</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/115">Section 115</external-xref> of title 23, United

			 Act: A Legacy for Users (119 Stat. 1155) is amended by striking subparagraphs

				available for obligation in the same manner as if the funds were apportioned

				States Code; except that the funds shall not be transferable and shall remain

			 proportional to the amount of obligation authority or funding that is so

			 projects numbered 1 through 3676 pursuant to section 1102(c)(4)(A) of that Act

			 discretionary use of surface transportation program funds</header><text display-inline="yes-display-inline">Of the funds apportioned to each State
			 under section
			 104(b)(3) of title 23, United States Code, a State may expend
			 for each of fiscal years 2007 through 2009 not more than $1,000,000 for the
			 following activities:</text>
					<paragraph commented="no" id="H42DBC3A14EBB443EAB7FC636775D1700"><enum>(1)</enum><text display-inline="yes-display-inline">Participation in the Joint Operation Center
			 for Fuel Compliance established under
			 section
			 143(b)(4)(H) of title 23, United States Code, within the
			 Department of the Treasury, including the funding of additional positions for
			 motor fuel tax enforcement officers and other staff dedicated on a full-time
			 basis to participation in the activities of the Center.</text>
					</paragraph><paragraph commented="no" id="H42A1FB2271E046120058E637E60EF26"><enum>(2)</enum><text display-inline="yes-display-inline">Development, operation, and maintenance of
			 electronic filing systems to coordinate data exchange with the Internal Revenue
			 Service by States that impose a tax on the removal of taxable fuel from any
			 refinery and on the removal of taxable fuel from any terminal.</text>
					</paragraph><paragraph commented="no" id="H51C1C363D62D430DACF925FC4EAAACE6"><enum>(3)</enum><text>Development,
			 operation, and maintenance of electronic single point of filing in conjunction
			 with the Internal Revenue Service by States that impose a tax on the removal of
			 taxable fuel from any refinery and on the removal of taxable fuel from any
			 terminal.</text>
					</paragraph><paragraph commented="no" id="HC0B868EAEEBB4A23A246BD9557077D00"><enum>(4)</enum><text display-inline="yes-display-inline">Development, operation, and maintenance of
			 a certification system by a State of any fuel sold to a State or local
			 government (as defined in
			 section
			 4221(d)(4) of the Internal Revenue Code of 1986) for the
			 exclusive use of the State or local government or sold to a qualified volunteer
			 fire department (as defined in section 150(e)(2) of such Code) for its
			 exclusive use.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H72F09F724A784F50A4C117F7E184800"><enum>(5)</enum><text display-inline="yes-display-inline">Development, operation, and maintenance of
			 a certification system by a State of any fuel sold to a nonprofit educational
			 organization (as defined in section 4221(d)(5) of such Code) that includes
			 verification of the good standing of the organization in the State in which the
			 organization is providing educational services.</text>
					</paragraph></subsection><subsection display-inline="no-display-inline" id="HE06443716D224ECEA805BE142C3E335E"><enum>(d)</enum><header>Project Federal
			 share</header><text display-inline="yes-display-inline">Section 1964 of the
			 Safe, Accountable, Flexible, Efficient Transportation Equity: A Legacy for
			 Users (119 Stat. 1519) is amended by adding at the end the following:</text>

			 obligation limitation</header><text>Funds made available under this section
			 shall be subject to any limitation on obligations for Federal-aid highways and
			 highway safety construction programs under section 1102 the Safe, Accountable,
			 Flexible, Efficient Transportation Equity Act: A Legacy for Users
			 (23 U.S.C.
			 104 note; 119 Stat. 1157) or any other Act.</text>
				</subsection><subsection id="H950383DE1C9A41BA811BE48D7CEDC3B"><enum>(e)</enum><header>Equity bonus
			 formula</header><text>Notwithstanding any other provision of law, in allocating
			 funds for the equity bonus program under
			 section
			 105 of title 23, United States Code, for each of fiscal years
			 2007 through 2009, the Secretary of Transportation shall make the required
			 calculations under that section as if this section had not been enacted.</text>
				</subsection><subsection id="HDB9371005C13412D87B88E67B012C75"><enum>(f)</enum><header>Funding for
			 research activities</header><text>Of the amount made available by section
			 5101(a)(1) of the Safe, Accountable, Flexible, Efficient Transportation Equity
			 Act: A Legacy for Users (119 Stat. 1779)—</text>
					<paragraph id="HA0F15690FE0B41119304732BE2510611"><enum>(1)</enum><text>at least
			 $1,000,000 shall be made available for each of fiscal years 2007 through 2009
			 to carry out section
			 502(h) of title 23, United States Code; and</text>
					</paragraph><paragraph id="H68A4D97AA99D454586B76122EFCC4FD4"><enum>(2)</enum><text>at least
			 $4,900,000 shall be made available for each of fiscal years 2007 through 2009
			 to carry out section 502(i) of that title.</text>
					</paragraph></subsection><subsection id="H729C43A1EA3842A5A71F7646CDF7A0D"><enum>(g)</enum><header>Technical
			 amendments</header>

			</section><section display-inline="no-display-inline" id="H492F31E42DDF489CBA5818006213C018"><enum>119.</enum><header>Efficient use
			 of existing highway capacity</header>
				<subsection id="HCF07CD83CBE2437FA96EEA5697007B75"><enum>(a)</enum><header>Study</header><text>The
			 Secretary of Transportation shall conduct a study on the impacts of converting
			 left and right highway safety shoulders to travel lanes.</text>
				</subsection><subsection id="H820AC95049574DEF91B5500313CFA6FD"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">In conducting the study, the Secretary
			 shall—</text>
					<paragraph id="HCFB30F0660C74A788DD5F5298C438E6B"><enum>(1)</enum><text>analyze instances
			 in which safety shoulders are used for general purpose vehicle traffic, high
			 occupancy vehicles, and public transportation vehicles;</text>
					</paragraph><paragraph id="HFFC8C0328648444C00BE157579DB4D49"><enum>(2)</enum><text>analyze instances
			 in which safety shoulders are not part of the roadway design;</text>
					</paragraph><paragraph id="H3286779A673D44FA901C96DD62D460F4"><enum>(3)</enum><text>evaluate whether
			 or not conversion of safety shoulders or the lack of a safety shoulder in the
			 original roadway design has a significant impact on the number of accidents or
			 has any other impact on highway safety; and</text>
					</paragraph><paragraph id="HD5187B504B1C4046AFC1B811B7EDA2B"><enum>(4)</enum><text>compile relevant
			 statistics.</text>
					</paragraph></subsection><subsection id="HD27FEC2C56344298A2729B962C324E63"><enum>(c)</enum><header>Report</header><text>Not
			 later than one year after the date of enactment of this Act, the Secretary
			 shall transmit to Congress a report on the results of the study.</text>

			 date</header>

			 to each State shall not be less than three-quarters of 1
			 percent</quote>.</text>

			 for Users (119 Stat. 1521) is amended—</text>
