		<official-title>To reserve a small percentage of the amounts made
		  available to the Secretary of Agriculture for the farmland protection program
		  to fund challenge grants to encourage the purchase of conservation easements
		  and other interests in land to be held by a State agency, county, or other
		  eligible entity, and for other purposes.</official-title>

		<section display-inline="no-display-inline" id="HD718C301867747FD8505E5D7291B9F20" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Open Space and Farmland Preservation
			 Act</short-title></quote>.</text>
		</section><section id="H5559D859C6C2408CB1F847DFB15308D6"><enum>2.</enum><header>Additional
			 title-holding option under farmland protection program</header>
			<subsection id="H97B8C79E78444317BF76415C7678386E"><enum>(a)</enum><header>Additional
			 title-holding option; reservation of funds</header><text display-inline="yes-display-inline">Section 1238I of the Farm Security Act of
			 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3838i">16 U.S.C. 3838i</external-xref>) is amended by adding at the end the following new
			 subsection:</text>

					<subsection id="HE75787CEEA1F41D798F933B0DD963E01"><enum>(d)</enum><header>Option for title
				To be held by eligible entity</header>
						<paragraph id="H5B24DE362CA7409CB2CF78D3891E765E"><enum>(1)</enum><header>Reservation of
				funds; purpose</header><text>Of the funds made available under section
				1241(a)(4) for a fiscal year to carry out this section, the Secretary shall
				reserve not less than 15 percent to make grants to support cooperative efforts
				by an eligible State agency, a county, and one or more other eligible entities
				to purchase conservation easements and other interests in eligible land under
				subsection (a), the title to which will be held by an eligible entity rather
				than the United States.</text>
						</paragraph><paragraph id="H523736FCA37B46958CAF78C54569DDE8"><enum>(2)</enum><header>Cost
				sharing</header><text>Notwithstanding subsection (c)(1), the share of the cost
				of purchasing a conservation easement or other interest in eligible land borne
				by the United States under this subsection shall not exceed 25 percent. The
				State agency involved in the purchase shall contribute 25 percent of the
				purchase price, the county involved in the purchase shall contribute 25 percent
				of the purchase price, and the other eligible entities involved in the purchase
				shall contribute 25 percent of the purchase price.</text>
						</paragraph><paragraph id="HEC37564C69D04B9A86782067742CBF54"><enum>(3)</enum><header>Prohibition on
				use of grant funds</header><text>Federal funds made available under this
				subsection may not be used by grant recipients for administrative
				purposes.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H342A513C96DF41A2A0E1D4FBFAAF713D"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall take effect on
			 October 1, 2007.</text>
