		<official-title display="yes">To authorize the Secretary of the Interior
		  to lease certain lands in Virgin Islands National Park, and for other
		  purposes.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" id="HAD29897269804881837037AE30BB68AA" style="OLC">
		<section id="H103A81BC2B674C61A15D48F38003B07" section-type="section-one"><enum>1.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions
			 apply:</text>
			<paragraph id="H7ADD8B28B073424EB0B4285B9B00DCA7"><enum>(1)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of the Interior.</text>
			</paragraph><paragraph id="H65CBBFBE15784FF588EDF62ECDB0E96E"><enum>(2)</enum><header>RUE</header><text>The
			 term <term>RUE</term> means the retained use estate entered into by the Jackson
			 Hole Preserve and the United States on September 30, 1983.</text>
			</paragraph><paragraph id="H8CB2929B79CA4B48A46B9D2F009EC67D"><enum>(3)</enum><header>Park</header><text>The
			 term <term>park</term> means Virgin Islands National Park.</text>
			</paragraph><paragraph id="H84C4EEEAD8834D4E8149B77B03DD001B"><enum>(4)</enum><header>CBI</header><text>The
			 term <term>CBI</term> means CBI Acquisitions, LLC.</text>
			</paragraph><paragraph id="H9E52BDD4320B48E8002880FB596CB853"><enum>(5)</enum><header>Resort</header><text>The
			 term <term>Resort</term> means Caneel Bay Resort on the island of St. John in
			 Virgin Islands National Park.</text>
			</paragraph></section><section id="H8A8597FFC0CB4489A7217BD9E2148CED"><enum>2.</enum><header>Lease
			 agreement</header>
			<subsection id="HFF679C4B1EB94158A6EAC1D7320B642"><enum>(a)</enum><header>Authorization</header><text>The
			 Secretary may enter into a lease agreement with CBI governing the use of
			 property for the continued management and operation of the Resort.</text>
			</subsection><subsection id="H96EE6067F4CC49EBAA9CE8AACB529699"><enum>(b)</enum><header>Additional
			 Lands</header><text>Any lease entered into pursuant to this Act shall include
			 the property covered by the RUE and any associated property owned by CBI
			 donated to the National Park Service.</text>
			</subsection><subsection id="HEBF0F23028F847C68BD976EE62D814B5"><enum>(c)</enum><header>Terms</header><text>The
			 lease agreement authorized under subsection (a) shall—</text>
				<paragraph id="HDB1BB5C9E7384BABAFE91BB700728FBE"><enum>(1)</enum><text>require that
			 operations and maintenance of the Resort are conducted in a manner consistent
			 with the preservation and conservation of the resources and values of the Park
			 as well as the best interests of the Resort;</text>
				</paragraph><paragraph id="H25890B245FF9483BB243607D107EFAB4"><enum>(2)</enum><text>be for the minimum
			 number of years practicable to enable the lessee to secure financing for any
			 necessary improvements to the Resort, taking into account the financial
			 obligations of CBI, but in any event shall not exceed 40 years;</text>
				</paragraph><paragraph id="HA19163A36ED74A5A936B48E1D42D79A"><enum>(3)</enum><text>prohibit any
			 transfer, assignment or sale of the lease or otherwise convey or pledge any
			 interest in the lease without prior written notification to and approval by the
			 Secretary;</text>
				</paragraph><paragraph id="HCA51F3BC138E48C984D9B30495A626B1"><enum>(4)</enum><text>prohibit any
			 increase in the number of guest accommodations available at the Resort;</text>
				</paragraph><paragraph id="HEE5BB905F6EC4DE988085F47483CD153"><enum>(5)</enum><text>prohibit any
			 increase in the overall size of the Resort;</text>
				</paragraph><paragraph id="H80AE8444D55E4187A88B4DF2FDE6312C"><enum>(6)</enum><text>prohibit the sale
			 of partial ownership shares or timeshares in the Resort;</text>
				</paragraph><paragraph id="HD690844F08254F69B9C9B860F7E3095F"><enum>(7)</enum><text>be designed to
			 facilitate transfer of all property covered by the lease to Federal
			 administration upon expiration of the lease; and</text>
				</paragraph><paragraph id="HDF04CE884B574CEBB853BE2CE1C840C9"><enum>(8)</enum><text>include any other
			 provisions determined by the Secretary to be necessary to protect the Park and
			 the public interest.</text>
				</paragraph></subsection><subsection id="HA89EF3DB759142B19F97FC9C6E84FBED"><enum>(d)</enum><header>Appraisals</header><text>The
			 Secretary shall require appraisals to determine the fair market value of all
			 property covered by the RUE and any property, including the value, if any, of
			 the surrendered term of the RUE, owned by CBI to be donated, or otherwise
			 conveyed, to the National Park Service. Such appraisals shall be conducted
			 pursuant to the Uniform Appraisal Standards for Federal Land
			 Acquisition.</text>
			</subsection><subsection id="H7488E8A2A53D44B9845D926300E1AEAE"><enum>(e)</enum><header>Compensation</header>
				<paragraph id="H701BF7A7AB41411CBBD6006DFEBFBD0"><enum>(1)</enum><header>In
			 general</header><text>The lease authorized by this Act shall—</text>
					<subparagraph id="HCCDF2E42BADC4722BA193813E1883364"><enum>(A)</enum><text>require payment to
			 the United States of the property’s fair market value rent, taking into account
			 the value of any associated property transferred by CBI as well as the value,
			 if any, of the surrendered term of the RUE;</text>
					</subparagraph><subparagraph id="H1EE9A702C7AB4DFCB1DD8BDB3180C79E"><enum>(B)</enum><text>include a
			 provision—</text>
						<clause id="H2E18DC281DE34F2C00EDCE9B31DEC400"><enum>(i)</enum><text>allowing
			 recalculation of the amount of the payment required under this subsection, at
			 the request of the Secretary or CBI, in the event of extraordinary
			 unanticipated changes in conditions anticipated at the time the lease was
			 finalized; and</text>
						</clause><clause id="H9873FA99212A4677870054BBF22EE210"><enum>(ii)</enum><text>providing for
			 binding arbitration in the event the Secretary and CBI are unable to agree upon
			 an adjustment to the payment in these circumstances.</text>
						</clause></subparagraph></paragraph><paragraph id="H484ACEBFDF36416D83F029D7FD39EDB"><enum>(2)</enum><header>Distribution</header><text>Eighty
			 percent of the payment to the United States required by this subsection shall
			 be available to the Secretary, without further appropriation, for expenditure
			 within the Park. The remaining twenty percent shall be deposited in the
			 Treasury.</text>
				</paragraph><paragraph id="H8DE0ACF53CF64AF99560E5203FF1700"><enum>(3)</enum><header>Applicability of
			 certain law</header><text>Section 321 of the Act of June 30, 1932 (40 U.S.C.
			 1302), relating to the leasing of buildings and property of the United States,
			 shall not apply to the lease entered into by the Secretary pursuant to this
			 Act.</text>
				</paragraph></subsection></section><section id="HA5FAEC980125401F86A17E7271510590"><enum>3.</enum><header>Retained use
			 estate</header><text display-inline="no-display-inline">As a condition of the
			 lease, CBI shall relinquish to the Secretary all rights under the RUE and
			 transfer, without compensation, ownership of improvements covered by the RUE to
			 the United States.</text>
