		  provide waivers relating to grants for preventive health measures with respect

	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H86ED3114803841B9AEF1D1BE32583638" style="OLC">
		<section display-inline="no-display-inline" id="HC538F0AABAF34C9DB300DD15AFFA57DD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National Breast and Cervical Cancer
			 Early Detection Program Reauthorization Act of
			 2007</short-title></quote>.</text>
		</section><section id="H65317906B9844417B9FD6E4100B26ECF"><enum>2.</enum><header>National breast
			 and cervical cancer early detection program</header><text display-inline="no-display-inline">Title XV of the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name>
			 (42 U.S.C. 300k et
			 seq.) is amended—</text>
			<paragraph id="H7BC38BE3C7C3448493D418B9893D8E64"><enum>(1)</enum><text>in section
			 1501(d)—</text>
				<subparagraph id="HEEAC737D6DFD4937B101D7A1E2B35F00"><enum>(A)</enum><text>in the heading, by
			 striking <quote><header-in-text level="subsection" style="OLC">2000</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">2020</header-in-text></quote>; and</text>
				</subparagraph><subparagraph id="H1FC9F7E4FE7A4EB78E54BBDB4907FF43"><enum>(B)</enum><text>by striking
			 <quote>by the year 2000</quote> and inserting <quote>by the year
			 2020</quote>;</text>
				</subparagraph></paragraph><paragraph id="H0055D2A415114DA4812C592580AD12C2"><enum>(2)</enum><text>in section 1503,
			 by adding at the end the following:</text>
				<quoted-block id="HB5B0B1F3F71943F09683B2702B74ADE4" style="OLC">
					<subsection id="HF35DFECD73C743C6AF29D801EAABF7EA"><enum>(d)</enum><header>Waiver of
				Services Requirement on Division of Funds</header>
						<paragraph id="H60334AA753484FB293A7B3B2DF75FF62"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall establish a demonstration project
				under which the Secretary may waive the requirements of paragraphs (1) and (4)
				of subsection (a) for not more than 5 States, if—</text>
							<subparagraph id="H896DD4BC35A94338A600E7C7EAD938E6"><enum>(A)</enum><text>the State involved
				will use the waiver to leverage non-Federal funds to supplement each of the
				services or activities described in paragraphs (1) and (2) of section
				1501(a);</text>
							</subparagraph><subparagraph id="H28149988F27E46698B8762D99DF17F2E"><enum>(B)</enum><text>the application of
				such requirement would result in a barrier to the enrollment of qualifying
				women;</text>
							</subparagraph><subparagraph id="HF719CF0607594A82AC7B00121C8E6E13"><enum>(C)</enum><text>the State
				involved—</text>
								<clause id="HF3CD4E229699418EBC7B2748A991C213"><enum>(i)</enum><text>demonstrates, to
				the satisfaction of the Secretary, the manner in which the State will use such
				waiver to expand the level of screening and follow-up services provided
				immediately prior to the date on which the waiver is granted; and</text>
								</clause><clause id="HC037731DFD9F4FBD9375E9025DAEBBA9"><enum>(ii)</enum><text>provides
				assurances, satisfactory to the Secretary, that the State will, on an annual
				basis, demonstrate, through such documentation as the Secretary may require,
				that the State has used such waiver as described in clause (i);</text>
								</clause></subparagraph><subparagraph id="H71619CC957B84C058CBB46700305207C"><enum>(D)</enum><text>the State involved
				submits to the Secretary—</text>
								<clause id="H93004BDEBEE2452C8045B4BF10E5ABFD"><enum>(i)</enum><text>assurances,
				satisfactory to the Secretary, that the State will maintain the average annual
				level of State fiscal year expenditures for the services and activities
				described in paragraphs (1) and (2) of section 1501(a) for the period for which
				the waiver is granted, and for the period for which any extension of such
				wavier is granted, at a level that is not less than—</text>
									<subclause id="H605BAD57740D4DD08484418600A3BB5E"><enum>(I)</enum><text>the level of the
				State fiscal year expenditures for such services and activities for the fiscal
				year preceding the first fiscal year for which the waiver is granted; or</text>
									</subclause><subclause id="H6FE7F064FA4A43DFB2332FCB8620B624"><enum>(II)</enum><text>at the option of
				the State and upon approval by the Secretary, the average level of the State
				expenditures for such services and activities for the 3-fiscal year period
				preceding the first fiscal year for which the waiver is granted; and</text>
									</subclause></clause><clause id="H43990F5A22344230A4A467F50045B000"><enum>(ii)</enum><text>a
				plan, satisfactory to the Secretary, for maintaining the level of activities
				carried out under the waiver after the expiration of the waiver and any
				extension of such waiver;</text>
								</clause></subparagraph><subparagraph id="HD217213337AE4441B674801D677376EF"><enum>(E)</enum><text>the Secretary
				finds that granting such a waiver to a State will increase the number of women
				in the State that receive each of the services or activities described in
				paragraphs (1) and (2) of section 1501(a), including making available screening
				procedures for both breast and cervical cancers; and</text>
							</subparagraph><subparagraph id="HCB28F8C0F1C24592A3C309C100817DF0"><enum>(F)</enum><text>the Secretary
				finds that granting such a waiver to a State will not adversely affect the
				quality of each of the services or activities described in paragraphs (1) and
				(2) of section 1501(a).</text>
							</subparagraph></paragraph><paragraph id="HCD3DE842D81D422698C3789F98CB594F"><enum>(2)</enum><header>Duration of
				waiver</header>
							<subparagraph id="H7A450823190D4A7D95D5155233693628"><enum>(A)</enum><header>In
				general</header><text>In granting waivers under paragraph (1), the
				Secretary—</text>
								<clause id="HC8A9580E76D34DCEB64963EF647CD8"><enum>(i)</enum><text>shall grant such
				waivers for a period that is not less than 1 year but not more than 2 years;
				and</text>
								</clause><clause id="H6EF98034EA7643939BC172C4BF184795"><enum>(ii)</enum><text>upon request of a
				State, may extend a waiver for an additional period that is not less than 1
				year but not more than 2 years in accordance with subparagraph (B).</text>
								</clause></subparagraph><subparagraph id="HDE8DF516BE784A829F5BE1166F1C6657"><enum>(B)</enum><header>Additional
				period</header><text>The Secretary, upon the request of a State that has
				received a waiver under paragraph (1), shall, at the end of the waiver period
				described in subparagraph (A)(i), review performance under the waiver and may
				extend the waiver for an additional period if the Secretary determines
				that—</text>
								<clause id="HB6A29FE871D642B99141A5459618BD43"><enum>(i)</enum><text>without an
				extension of the waiver, there will be a barrier to the enrollment of
				qualifying women;</text>
								</clause><clause id="HA335234133A443E988C285F5BE4300C"><enum>(ii)</enum><text>the State
				requesting such extended waiver will use the waiver to leverage non-Federal
				funds to supplement the services or activities described in paragraphs (1) and
				(2) of section 1501(a);</text>
								</clause><clause id="HCB78ECE519FC4CA8823E2163E6E40058"><enum>(iii)</enum><text>the waiver has
				increased, and will continue to increase, the number of women in the State that
				receive the services or activities described in paragraphs (1) and (2) of
				section 1501(a);</text>
								</clause><clause id="HB29B57EA0B9E4658BFCA3D8735A48FDC"><enum>(iv)</enum><text>the waiver has
				not, and will not, result in lower quality in the State of the services or
				activities described in paragraphs (1) and (2) of section 1501(a); and</text>
								</clause><clause id="H00177B6B5ECF4AA0AA64517F6B79F606"><enum>(v)</enum><text>the State has
				maintained the average annual level of State fiscal expenditures for the
				services and activities described in paragraphs (1) and (2) of section 1501(a)
				for the period for which the waiver was granted at a level that is not less
				than—</text>
									<subclause id="HF1FE08EE5A124F0488B319557840BFA8"><enum>(I)</enum><text>the level of the
				State fiscal year expenditures for such services and activities for the fiscal
				year preceding the first fiscal year for which the waiver is granted; or</text>
									</subclause><subclause id="HF6BBDD60B0624238AED43F698E009803"><enum>(II)</enum><text>at the option of
				the State and upon approval by the Secretary, the average level of the State
				expenditures for such services and activities for the 3-fiscal year period
				preceding the first fiscal year for which the waiver is granted.</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="H87285E6F03174304A6522D191BDFA82C"><enum>(3)</enum><header>Reporting
				requirements</header><text>The Secretary shall include as part of the
				evaluations and reports required under section 1508, the following:</text>
							<subparagraph id="HC794CE682D46415B81629DEC951707C7"><enum>(A)</enum><text>A description of
				the total amount of dollars leveraged annually from Non-Federal entities in
				States receiving a waiver under paragraph (1) and how these amounts were
				used.</text>
							</subparagraph><subparagraph id="HF747D64686EF47F09E85CBCFB5067005"><enum>(B)</enum><text>With respect to
				States receiving a waiver under paragraph (1), a description of the percentage
				of the grant that is expended on providing each of the services or activities
				described in—</text>
								<clause id="H9B20EBAC18A9442192934EA8ADEDE0BE"><enum>(i)</enum><text>paragraphs (1) and
				(2) of section 1501(a); and</text>
								</clause><clause id="H771FF482B8924630B0C73DE360924830"><enum>(ii)</enum><text>paragraphs (3)
				through (6) of section 1501(a).</text>
								</clause></subparagraph><subparagraph id="HD718B87B67434F40AFD3FCA2ABBC2E96"><enum>(C)</enum><text>A description of
				the number of States receiving waivers under paragraph (1) annually.</text>
							</subparagraph><subparagraph id="H386D046DD4BA40DE8DFA22C54A7D2EC"><enum>(D)</enum><text>With respect to
				States receiving a waiver under paragraph (1), a description of—</text>
								<clause id="HCFF989A3F5354DB0962000AC3D2C9800"><enum>(i)</enum><text>the number of
				women receiving services under paragraphs (1), (2), and (3) of section 1501(a)
				in programs before and after the granting of such waiver; and</text>
								</clause><clause id="H81BA01B8C136491495D92BFEB12E11FF"><enum>(ii)</enum><text>the average
				annual level of State fiscal expenditures for the services and activities
				described in paragraphs (1) and (2) of section 1501(a) for the year preceding
				the first year for which the waiver was granted.</text>
								</clause></subparagraph></paragraph><paragraph id="H6CF6F775114744E4AEAB6CA5DBA5F131"><enum>(4)</enum><header>Limitation</header><text>Amounts
				to which a waiver applies under this subsection shall not be used to increase
				the number of salaried employees.</text>
						</paragraph><paragraph id="HC0088B17B7F14F9E826BFDAD1D772522"><enum>(5)</enum><header>Definitions</header><text>In
				this subsection:</text>
							<subparagraph id="HF0359A03C78442F8B09BDF5B8925687D"><enum>(A)</enum><header>Indian
				tribe</header><text>The term <term>Indian tribe</term> has the meaning given
				the term in section 4 of the <act-name parsable-cite="IHCIA">Indian Health Care
				Improvement Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/1603">25 U.S.C. 1603</external-xref>).</text>
							</subparagraph><subparagraph id="HEEAE09BEA5984BEC89D284AFFE86C336"><enum>(B)</enum><header>Tribal
				organization</header><text>The term <term>tribal organization</term> has the
				meaning given the term in section 4 of the <act-name parsable-cite="IHCIA">Indian Health Care Improvement Act</act-name>.</text>
							</subparagraph><subparagraph id="HAA1759CEA4CE4156BAEFE65D176EBDCB"><enum>(C)</enum><header>State</header><text>The
				term <term>State</term> means each of the several States of the United States,
				the District of Columbia, the Commonwealth of Puerto Rico, American Samoa, the
				Commonwealth of the Northern Mariana Islands, the Republic of the Marshall
				Islands, the Federated States of Micronesia, the Republic of Palau, an Indian
				tribe, and a tribal organization.</text>
							</subparagraph></paragraph><paragraph id="HB1B65DBE7CE146F8A09834392637BBB"><enum>(6)</enum><header>Sunset</header><text>The
				Secretary may not grant a waiver or extension under this subsection after
				September 30,
				2012.</text>
						</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H1FBD3B79081048C98B1C6064AD0773BF"><enum>(3)</enum><text>in section
			 1508—</text>
				<subparagraph id="HFDFFA9DB38CF46F88D92D632896D7B24"><enum>(A)</enum><text>in subsection (a),
			 by striking “evaluations of the extent to which” and all that follows through
			 the period and inserting: “evaluations of—</text>
					<quoted-block id="HB781B358A445424B008E921FBA208BA7" style="OLC">
						<paragraph id="H2BA3167994F74363B77D1EFA89B688DE"><enum>(1)</enum><text>the extent to
				which States carrying out such programs are in compliance with section
				1501(a)(2) and with section 1504(c); and</text>
						</paragraph><paragraph id="H0F3D6D09F09A40D28B90CF4699C773A5"><enum>(2)</enum><text>the extent to
				which each State receiving a grant under this title is in compliance with
				section 1502, including identification of—</text>
							<subparagraph id="H22497AC57A4C4BF68FEC3EB26E3EFC48"><enum>(A)</enum><text>the amount of the
				non-Federal contributions by the State for the preceding fiscal year,
				disaggregated according to the source of the contributions; and</text>
							</subparagraph><subparagraph id="HD27D6B1DFF6540AAAF5C76E943CC348B"><enum>(B)</enum><text>the proportion of
				such amount of non-Federal contributions relative to the amount of Federal
				funds provided through the grant to the State for the preceding fiscal
				year.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="H6739C5EC0BD2424182595CC694E2FFE"><enum>(B)</enum><text>in subsection (b),
			 by striking <quote>not later than 1 year after the date on which amounts are
			 first appropriated pursuant to section 1509(a), and annually thereafter</quote>
			 and inserting <quote>not later than 1 year after the date of the enactment of
			 the National Breast and Cervical Cancer Early Detection Program Reauthorization
			 of 2007, and annually thereafter</quote>; and</text>
				</subparagraph></paragraph><paragraph id="HB955BC78DD9944F7B73CC174886EFE8"><enum>(4)</enum><text>in
			 section 1510(a)—</text>
				<subparagraph id="HC6720C103E664814BF00D1C00D636B3"><enum>(A)</enum><text>by striking
			 <quote>and</quote> after <quote>$150,000,000 for fiscal year 1994,</quote>;
			 and</text>
				</subparagraph><subparagraph id="H21DC869273BD45398E8B39A26BBA4DE3"><enum>(B)</enum><text>by inserting
			 <quote>, $225,000,000 for fiscal year 2008, $245,000,000 for fiscal year 2009,
			 $250,000,000 for fiscal year 2010, $255,000,000 for fiscal year 2011, and
			 $275,000,000 for fiscal year 2012</quote> before the period at the end.</text>
				</subparagraph></paragraph></section></legis-body>
