<official-title>To amend the Public Health Service Act to provide waivers relating to grants for preventive health measures with respect to breast and cervical cancers.</official-title>

<section id="H8740D72125B445CF87B0058D618A443" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Breast and Cervical Cancer Early Detection Program Reauthorization Act of 2007</short-title></quote>.</text></section> 
<section id="HC1ADE7C8474D4AB2A188AD9545A991F2"><enum>2.</enum><header>National breast and cervical cancer early detection program</header><text display-inline="no-display-inline">Title XV of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300k">42 U.S.C. 300k et seq.</external-xref>) is amended—</text> 
<paragraph id="H1E53215D32A04AACBC7100B2857D6239"><enum>(1)</enum><text>in section 1501(d)—</text> 
<subparagraph id="H34DE8613EDD348B99CB93FD2471978AD"><enum>(A)</enum><text>in the heading, by striking <quote>2000</quote> and inserting <quote>2020</quote>; and</text></subparagraph> 
<subparagraph id="H26122DAEA4AC402BBEC3FE3B0000B6F1"><enum>(B)</enum><text>by striking <quote>by the year 2000</quote> and inserting <quote>by the year 2020</quote>;</text></subparagraph></paragraph> 
<paragraph id="H45985B9A32BC4D4EA822736F81C34902"><enum>(2)</enum><text>in section 1503, by adding at the end the following:</text> 
<quoted-block id="H4402984DA0B642ABAEE771228DD4371C" style="OLC"> 
<subsection id="HFFE6E1D0EB5343AA899B2D8C4421916D"><enum>(d)</enum><header>Waiver of Services Requirement on Division of Funds</header> 
<paragraph id="HC424D3B5E5294A38862996AF35076C69"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a demonstration project under which the Secretary, acting through the Director of the Centers for Disease Control and Prevention, may waive the requirements of paragraphs (1) and (4) of subsection (a) for not more than 5 States, if—</text> 
<subparagraph id="HD791CC565E524C22A474D0D23097BE22"><enum>(A)</enum> 
<clause id="HC205DD5897E842C89BCD0081DA6748D4" display-inline="yes-display-inline"><enum>(i)</enum><text>the State involved will use the waiver to leverage private funds to supplement each of the services or activities described in paragraphs (1) and (2) of section 1501(a); or</text></clause> 
<clause id="HA8E61B84E6E44132AD94EC27B730DCFD" indent="up1"><enum>(ii)</enum><text>the application of such requirement would result in a barrier to the enrollment of qualifying women;</text></clause></subparagraph> 
<subparagraph id="H6A13013D6319494CAA9D9370BF89CBEF"><enum>(B)</enum><text>the State involved provides assurances that the State will, on an annual basis, demonstrate to the Secretary the manner in which the State will use such waiver to maintain or expand the level of screening and follow-up services provided immediately prior to the waiver, and provide documentation of compliance with such maintenance or expansion requirement;</text></subparagraph> 
<subparagraph id="H26133F45ADC549DCA004077FBDE9FDE"><enum>(C)</enum><text>the State involved submits to the Secretary a plan for maintaining the level of activities carried out under the waiver after the expiration of the waiver;</text></subparagraph> 
<subparagraph id="H7C88504A3B8B4E9F81AD7B8BC732D3D7"><enum>(D)</enum><text>the Secretary finds that granting such a waiver to a State will not reduce the number of women in the State that receive each of the services or activities described in paragraphs (1) and (2) of section 1501(a), including making available screening procedures for both breast and cervical cancers; and</text></subparagraph> 
<subparagraph id="HE5FC6B10AAA24A40BBC78C41C59F173D"><enum>(E)</enum><text>the Secretary finds that granting such a waiver to a State will not adversely affect the quality of each of the services or activities described in paragraphs (1) and (2) of section 1501(a).</text></subparagraph></paragraph> 
<paragraph id="H6C0CBB1363034E8D99C4C25EFDAD3DE2"><enum>(2)</enum><header>Duration of waiver</header> 
<subparagraph id="H13B79BD66B65445BBAE616860004A76"><enum>(A)</enum><header>In general</header><text>In granting waivers under paragraph (1), the Secretary—</text> 
<clause id="H92BD018FF4F94998BC00AB650571661"><enum>(i)</enum><text>shall grant such waivers for a period of 2 years; and</text></clause> 
<clause id="HDF8E6F10117F47D3B46997590100D699"><enum>(ii)</enum><text>upon request of a State, may extend a waiver for an additional 2-year period in accordance with subparagraph (B).</text></clause></subparagraph> 
<subparagraph id="H21300477B5574554AF9E0000F89283EF"><enum>(B)</enum><header>Additional period</header><text>The Secretary, upon the request of a State that has received a waiver under paragraph (1), shall, at the end of the 2-year waiver period described in subparagraph (A), review performance under the waiver and may extend the waiver for an additional 2-year period if the Secretary determines that—</text> 
<clause id="HE99573348E054974B452BD1DFE3DD521"><enum>(i)</enum> 
<subclause id="H07A57806FA6D48729579914F92776233" display-inline="yes-display-inline"><enum>(I)</enum><text>without an extension of the waiver, there will be a barrier to the enrollment of qualifying women; or</text></subclause> 
<subclause id="H68FCDC05082C4862AE27D9D22FEFDB52" indent="up1"><enum>(II)</enum><text>the State requesting such extended waiver will use the waiver to leverage private funds to supplement the services or activities described in paragraphs (1) and (2) of section 1501(a);</text></subclause></clause> 
<clause id="H6B0B927975C9447DBE47CB85265FBB12"><enum>(ii)</enum><text>the waiver has not, and will not, reduce the number of women in the State that receive the services or activities described in paragraphs (1) and (2) of section 1501(a);</text></clause> 
<clause id="HEAE519FC794E4924B066DCB27D1D4C4C"><enum>(iii)</enum><text>the waiver has not, and will not, result in lower quality in the State of the services or activities described in paragraphs (1) and (2) of section 1501(a); and</text></clause> 
<clause id="H0D256F277B03481DBDF5D7E6C054C75"><enum>(iv)</enum><text>the State has maintained the average annual level of State fiscal expenditures for the services and activities described in paragraphs (1) and (2) of section 1501(a) for the 2 years for which the waiver was granted at a level that is not less than the level of the State fiscal expenditures for such services and activities for the year preceding the first year for which the waiver is granted.</text></clause></subparagraph></paragraph> 
<paragraph id="HF8E7C310693B4307A85F302439B615CD"><enum>(3)</enum><header>Reporting requirements</header><text>The Secretary shall include as part of the evaluations and reports required under section 1508, the following:</text> 
<subparagraph id="H8998DBDF92EB4093A2DA351FE4306BBA"><enum>(A)</enum><text>A description of the total amount of dollars leveraged annually from private entities in States receiving a waiver under paragraph (1) and how these amounts were used.</text></subparagraph> 
<subparagraph id="H37D0E9B4F442446F868C2361B1F7AA02"><enum>(B)</enum><text>With respect to States receiving a waiver under paragraph (1), a description of the percentage of the grant that is expended on providing each of the services or activities described in—</text> 
<clause id="HCA3D712A0890401CBD48A422F637CF25"><enum>(i)</enum><text>paragraphs (1) and (2) of section 1501(a); and</text></clause> 
<clause id="H1CBF34374FA0480580C9F75D8717B001"><enum>(ii)</enum><text>paragraphs (3) through (6) of section 1501(a).</text></clause></subparagraph> 
<subparagraph id="H86A91C6CEEBA46609432B5903180EBB0"><enum>(C)</enum><text>A description of the number of States receiving waivers under paragraph (1) annually.</text></subparagraph> 
<subparagraph id="HC254CFF16DFF4DE5B79F6C006CE4C275"><enum>(D)</enum><text>With respect to States receiving a waiver under paragraph (1), a description of—</text> 
<clause id="HFD88BB5BA8544A2A8938F248E6A17B00"><enum>(i)</enum><text>the number of women receiving services under paragraphs (1), (2), and (3) of section 1501(a) in programs before and after the granting of such waiver; and</text></clause> 
<clause id="HA6CD2DAB4FDC4E1C003F82D48CDD32E9"><enum>(ii)</enum><text>the average annual level of State fiscal expenditures for the services and activities described in paragraphs (1) and (2) of section 1501(a) for the year preceding the first year for which the waiver was granted.</text></clause></subparagraph></paragraph> 
<paragraph id="HF9534A3086424543BD474900CE5350A8"><enum>(4)</enum><header>Limitation</header><text>Amounts to which a waiver applies under this subsection shall not be used to increase the number of salaried employees.</text></paragraph> 
<paragraph id="HC799AB8DBD4A47648F06F273D514D377"><enum>(5)</enum><header>Definitions</header><text>In this subsection:</text> 
<subparagraph id="H6B1D8E81A1A74974A44CBF98EAA1F00"><enum>(A)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> has the meaning given the term in section 4 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1603">25 U.S.C. 1603</external-xref>).</text></subparagraph> 
<subparagraph id="H423A818E3A7149C8BCA82FE4F9133B93"><enum>(B)</enum><header>Tribal organization</header><text>The term <term>tribal organization</term> has the meaning given the term in section 4 of the Indian Health Care Improvement Act.</text></subparagraph> 
<subparagraph id="H729D2949359D4D9885CAC1768EBD5D26"><enum>(C)</enum><header>State</header><text>The term <term>State</term> means each of the several States of the United States, the District of Columbia, the Commonwealth of Puerto Rico, American Samoa, the Commonwealth of the Northern Mariana Islands, the Republic of the Marshall Islands, the Federated States of Micronesia, the Republic of Palau, an Indian tribe, and a tribal organization.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H31C60BE422B241A39D451006290441C9"><enum>(3)</enum><text>in section 1508—</text> 
<subparagraph id="H4F23F3C7C1A5430DA700DD00C0F14313"><enum>(A)</enum><text>in subsection (a), by striking <quote>evaluations of the extent to which</quote> and all that follows through the period and inserting: </text> 
<quoted-block style="OLC" id="H6EC451D5FE8C469EB97B3F1626767262" display-inline="yes-display-inline"><text display-inline="yes-display-inline">evaluations of—</text> 
<paragraph id="H462F03C3B8D24819A9B1B8177049F50"><enum>(1)</enum><text>the extent to which States carrying out such programs are in compliance with section 1501(a)(2) and with section 1504(c); and</text></paragraph> 
<paragraph id="H5AB95B917589477DA0D83308EEE4F353"><enum>(2)</enum><text>the extent to which each State receiving a grant under this title is in compliance with section 1502, including identification of—</text> 
<subparagraph id="H3DCD365FBA6A4509B94675EABDA394F1"><enum>(A)</enum><text>the amount of the non-Federal contributions by the State for the preceding fiscal year, disaggregated according to the source of the contributions; and</text></subparagraph> 
<subparagraph id="H42965C6183D7471FBFC3B580B00A6A9"><enum>(B)</enum><text>the proportion of such amount of non-Federal contributions relative to the amount of Federal funds provided through the grant to the State for the preceding fiscal year.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HD8FBB283F68C4280A114BDCAC8BC2DD"><enum>(B)</enum><text>in subsection (b), by striking <quote>not later than 1 year after the date on which amounts are first appropriated pursuant to section 1509(a), and annually thereafter</quote> and inserting <quote>not later than 1 year after the date of the enactment of the National Breast and Cervical Cancer Early Detection Program Reauthorization of 2007, and annually thereafter</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H13448493857F4F1CAD72A3C2A7D339A1"><enum>(4)</enum><text>in section 1510(a)—</text> 
<subparagraph id="H6DCC27247C8041869DA87FE27C4C22E"><enum>(A)</enum><text>by striking <quote>and</quote> after <quote>$150,000,000 for fiscal year 1994,</quote>; and</text></subparagraph> 
<subparagraph id="HC1BAB0D9E4244DA6A0F3EDD99DC2D02E"><enum>(B)</enum><text>by inserting <quote>, $225,000,000 for fiscal year 2008, $245,000,000 for fiscal year 2009, $250,000,000 for fiscal year 2010, $255,000,000 for fiscal year 2011, and $275,000,000 for fiscal year 2012</quote> before the period at the end.</text></subparagraph></paragraph></section>
