		<official-title>To amend the Communications Act of 1934 to require
		  recipients of universal service support for schools and libraries to protect
		  minors from commercial social networking websites and chat
		  rooms.</official-title>

		<section display-inline="no-display-inline" id="HC74CA223F64D4B8E81133BFF7EA30750" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Deleting Online Predators Act of
			 2007</short-title></quote>.</text>
		</section><section id="H52D59DC1189C47F988C456772E43A242"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds that—</text>
			<paragraph id="H9476B675A329492989B978329DDA67D"><enum>(1)</enum><text display-inline="yes-display-inline">sexual predators approach minors on the
			 Internet using chat rooms and social networking websites, and, according to the
			 United States Attorney General, one in five children has been approached
			 sexually on the Internet;</text>
			</paragraph><paragraph id="HFF95B5177F8E4C9AAE64BA66E3BC9E44"><enum>(2)</enum><text>sexual predators
			 can use these chat rooms and websites to locate, learn about, befriend, and
			 eventually prey on children by engaging them in sexually explicit
			 conversations, asking for photographs, and attempting to lure children into a
			 face to face meeting; and</text>
			</paragraph><paragraph id="HD699CD30EC6C4016A54B10292EFC4C3F"><enum>(3)</enum><text display-inline="yes-display-inline">with the explosive growth of trendy chat
			 rooms and social networking websites, it is becoming more and more difficult to
			 monitor and protect minors from those with devious intentions, particularly
			 when children are away from parental supervision.</text>
			</paragraph></section><section id="H5CEB5F35E0CD4615B8306D2C30D85800"><enum>3.</enum><header>Certifications to
			 include protections against commercial social networking websites and chat
			 rooms</header>
			<subsection id="H5A5AD50ED98942B7ADFBF783D66F62A5"><enum>(a)</enum><header>Certification by
			 schools</header><text>Section 254(h)(5)(B) of the Communications Act of 1934
			 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254(h)(5)(B)</external-xref>) is amended by striking clause (i) and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HEDFD56C730134BA79711F9917357E72" style="OLC">
					<clause id="HAA27B282386E4F0990F4188997A46E93"><enum>(i)</enum><text>is
				enforcing a policy of Internet safety for minors that includes monitoring the
				online activities of minors and the operation of a technology protection
				measure with respect to any of its computers with Internet access that—</text>
						<subclause id="H7EC2784E980B4AE6ADA63A6E64B6D8"><enum>(I)</enum><text>protects against
				access through such computers to visual depictions that are—</text>
							<item id="H11C5686E222D44799CF216B044D3ABE9"><enum>(aa)</enum><text>obscene;</text>
							</item><item id="H55477CA5CD03411E9FF26D9FC214FA53"><enum>(bb)</enum><text>child
				pornography; or</text>
							</item><item id="H2685F1946BC14E1DB6ABBD3C7F747400"><enum>(cc)</enum><text>harmful to
				minors; and</text>
							</item></subclause><subclause id="HB229CC38CE164E228E07F10059696153"><enum>(II)</enum><text display-inline="yes-display-inline">protects against access to a commercial
				social networking website or chat room unless used for an educational purpose
				with adult supervision;
				and</text>
						</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H598147C9263141F6A9286550602D0085"><enum>(b)</enum><header>Certification by
			 libraries</header><text>Section 254(h)(6)(B) of such Act (47 U.S.C.
			 254(h)(6)(B)) is amended by striking clause (i) and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HFAC67B130EC84D7F93FA5B00F9AAD663" style="OLC">
					<clause id="H23258F4EE88D450C86BD5740F87FAC7F"><enum>(i)</enum><text>is
				enforcing a policy of Internet safety that includes the operation of a
				technology protection measure with respect to any of its computers with
				Internet access that—</text>
						<subclause id="H6A181A3FBBA046718E00BE20F82C820"><enum>(I)</enum><text>protects against
				access through such computers to visual depictions that are—</text>
							<item id="HDD962D78ED8F4D5F93E360F000C9225"><enum>(aa)</enum><text>obscene;</text>
							</item><item id="HC23552A1305446CCB812C05DE2892C8"><enum>(bb)</enum><text>child pornography;
				or</text>
							</item><item id="H74FDEADC99EA4E6F8494B6001171F0DD"><enum>(cc)</enum><text>harmful to
				minors; and</text>
							</item></subclause><subclause id="H06AACF1FF05F49E29E4139260510C800"><enum>(II)</enum><text display-inline="yes-display-inline">protects against access by minors without
				parental authorization to a commercial social networking website or chat room,
				and informs parents that sexual predators can use these websites and chat rooms
				to prey on children;
				and</text>
						</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HFA8ECD27AD8F46FDB0AE129148D66E76"><enum>(c)</enum><header>Definitions</header><text>Section
			 254(h)(7) is amended by adding at the end the following new
			 subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="H533B465B74A14E96A500AA66CEA37483" style="OLC">
					<subparagraph id="H6A23F25F444F41299FDD876FC309D3D0"><enum>(J)</enum><header>Commercial
				social networking websites; chat rooms</header><text display-inline="yes-display-inline">Within 120 days after the date of enactment
				of the <short-title>Deleting Online Predators Act of
				2007</short-title>, the Commission shall by rule define the terms <term>social
				networking website</term> and <term>chat room</term> for purposes of this
				subsection. In determining the definition of a social networking website, the
				Commission shall take into consideration the extent to which a website—</text>
						<clause id="HB1214CC282B1479800A5BB393BDF749"><enum>(i)</enum><text>is
				offered by a commercial entity;</text>
						</clause><clause id="H5F589375B57F4258BF8CFEC8C7D4D98"><enum>(ii)</enum><text>permits registered
				users to create an on-line profile that includes detailed personal
				information;</text>
						</clause><clause id="H0CCBA4E6E63C41D49DF5A11328D6009C"><enum>(iii)</enum><text>permits
				registered users to create an on-line journal and share such a journal with
				other users;</text>
						</clause><clause id="HD8C7FA782D6C4BCB868F64FB51C2F000"><enum>(iv)</enum><text>elicits
				highly-personalized information from users; and</text>
						</clause><clause id="H57A9E12368244098995183DC541BF8BB"><enum>(v)</enum><text>enables
				communication among
				users.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD65E74D4C04944A884AE07E986C1A705"><enum>(d)</enum><header>Disabling During
			 Adult or Educational Use</header><text>Section 254(h)(5)(D) of such Act is
			 amended—</text>
				<paragraph id="HAA150185C3D8438B92D768AFE6F83BB"><enum>(1)</enum><text>by
			 inserting <quote><header-in-text level="subparagraph" style="OLC">or
			 educational</header-in-text></quote> after <quote><header-in-text level="subparagraph" style="OLC">during adult</header-in-text></quote> in the
			 heading; and</text>
				</paragraph><paragraph id="HBC15B69BBD3E4B8A9253C506003DF21C"><enum>(2)</enum><text>by inserting
			 before the period at the end the following: <quote>or during use by an adult or
			 by minors with adult supervision to enable access for educational purposes
			 pursuant to subparagraph (B)(i)(II)</quote>.</text>
				</paragraph></subsection></section><section id="H92F3F7F0EB534BD894DCE55959E4EF02"><enum>4.</enum><header>FTC consumer
			 alert on Internet dangers to children</header>
			<subsection id="H71108FC5D2CD49ACABFBF79A3744BFF"><enum>(a)</enum><header>Information
			 regarding child predators and the Internet</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the Federal Trade Commission shall—</text>
				<paragraph id="HEAE3C8E8D7DA4B3B97484C9112CC15C0"><enum>(1)</enum><text>issue a consumer
			 alert regarding the potential dangers to children of Internet child predators,
			 including the potential danger of commercial social networking websites and
			 chat rooms through which personal information about child users of such
			 websites may be accessed by child predators; and</text>
				</paragraph><paragraph id="H96E5FEF36C6549F398D3C7D64E6963CE"><enum>(2)</enum><text display-inline="yes-display-inline">establish a website to serve as a resource
			 for information for parents, teachers and school administrators, and others
			 regarding the potential dangers posed by the use of the Internet by children,
			 including information about commercial social networking websites and chat
			 rooms through which personal information about child users of such websites may
			 be accessed by child predators.</text>
				</paragraph></subsection><subsection id="H7D768959A2014E288CAEBF9F6F385200"><enum>(b)</enum><header>Commercial
			 social networking websites</header><text display-inline="yes-display-inline">For purposes of the requirements under
			 subsection (a), the terms <term>commercial social networking website</term> and
			 <term>chat room</term> have the meanings given such terms pursuant to section
			 254(h)(7)(J) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254(h)(7)(J)</external-xref>), as
			 amended by this Act.</text>
