		<legis-type>A BILL</legis-type>
		<official-title>To amend the Public Health Service Act to require the
		  Secretary of Homeland Security to improve and expedite the assessment and
		  determination of current and emerging chemical, biological, radiological and
		  nuclear material threats, to group such agents to facilitate the assessment and
		  acquisition of countermeasures that would address more than one of such agents
		  or adverse health consequences common to exposure to different agents, and for
		  other purposes.</official-title>

	<legis-body id="H6FEEB5A262B3406F91568BF2350057C" style="OLC">
		<section id="H50C2DC538C9646F0978F3D62266DEAF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Project
			 BioShield Material Threats Act of 2007</quote>.</text>
		</section><section id="H5656C10D1F5B4E57AA71D8674F4C2428"><enum>2.</enum><header>Material
			 threats</header>
			<subsection id="H9A773C1E61FB4635A637C12E94FEE853"><enum>(a)</enum><header>In
			 general</header><text>Section 319F–2(c)(2)(A) of the Public Health Service Act
			 (42 U.S.C. 247d–6b(c)(2)(A)) is amended—</text>
				<paragraph id="HEB1340B18D7848A29F0383175DCB5300"><enum>(1)</enum><text>by redesignating
			 clauses (i) and (ii) as subclauses (I) and (II), respectively;</text>
				</paragraph><paragraph id="HD9012EF39F014D9C829EB31A3124367"><enum>(2)</enum><text>by
			 moving each of such subclauses two ems to the right;</text>
				</paragraph><paragraph id="HB8796779B3004C3DAFD39B4C1B3DB33E"><enum>(3)</enum><text>by striking
			 <quote>(A) <header-in-text level="subparagraph" style="OLC">Material
			 threat.—</header-in-text>The Homeland Security Secretary</quote> and inserting
			 the following:</text>
					<quoted-block display-inline="no-display-inline" id="H3F0526430F6D4911ABECCF0BE96CA08" style="OLC">
						<subparagraph id="H8241EFA8705C407ABF52EA00A7E30807"><enum>(A)</enum><header>Material
				threat</header>
							<clause id="H3278A937E7A04C86A348569000D2F653"><enum>(i)</enum><header>In
				general</header><text>The Homeland Security
				Secretary</text>
							</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H4FBC1CC16AB0489797DA8CDAA0097CDF"><enum>(4)</enum><text>by adding at the
			 end the following clauses:</text>
					<quoted-block display-inline="no-display-inline" id="HA61117BF28034CD294ECE259E47C57CB" style="OLC">
						<clause id="HD073B7E060C44CCD91C1974983E6C8AB"><enum>(ii)</enum><header>Use of existing
				risk assessments</header><text display-inline="yes-display-inline">For the
				purpose of satisfying the requirements of clause (i) as expeditiously as
				possible, the Homeland Security Secretary shall, as practicable, utilize
				existing risk assessments that such Secretary considers credible.</text>
						</clause><clause id="HE5410C3B23D940388799F0A54D007553"><enum>(iii)</enum><header>Order of
				assessments</header>
							<subclause id="HED613E14529A4F4CA02C5E3EE9F066E2"><enum>(I)</enum><header>Groupings to
				facilitate assessment of countermeasures</header><text display-inline="yes-display-inline">In conducting threat assessments and
				determinations under clause (i) of chemical, biological, radiological, and
				nuclear agents, the Homeland Security Secretary shall, to the extent
				practicable and appropriate, consider the completion of such assessments and
				determinations for groups of agents toward the goal of facilitating the
				assessment of countermeasures under paragraph (3) by the Secretary of Health
				and Human Services.</text>
							</subclause><subclause id="HAB0EB5F20AB041CDAA35491780294300"><enum>(II)</enum><header>Categories of
				countermeasures</header><text>The grouping of agents under subclause (I) by the
				Homeland Security Secretary shall be designed to facilitate assessments under
				paragraph (3) by the Secretary of Health and Human Services regarding the
				following two categories of countermeasures:</text>
								<item id="HE1EBDDD489434C059E31993DAD7688BD"><enum>(aa)</enum><text>Countermeasures
				that may address more than one agent identified under clause (i)(II).</text>
								</item><item id="HA0129241B82E4E15B8827F1C5CBB815E"><enum>(bb)</enum><text display-inline="yes-display-inline">Countermeasures that may address adverse
				health consequences that are common to exposure to different agents.</text>
								</item></subclause><subclause id="HC70120B0949943899B23D5917478E752"><enum>(III)</enum><header>Rule of
				construction</header><text>A particular grouping of agents pursuant to
				subclause (II) is not required under such subclause to facilitate assessments
				of both categories of countermeasures described in such subclause. A grouping
				may concern one category and not the other.</text>
							</subclause></clause><clause id="H2130AB95BE1B4ABDA3EF7BFF3868CEA2"><enum>(iv)</enum><header>Time frame for
				completion of certain national-security determinations</header><text display-inline="yes-display-inline">With respect to chemical, biological,
				radiological, and nuclear agents known to the Homeland Security Secretary as of
				the day before the date of the enactment of this clause, and which such
				Secretary considers to be capable of significantly affecting national security,
				such Secretary shall complete the determinations under clause (i)(II) not later
				than December 31, 2007.</text>
						</clause><clause id="HE73607911D7D44F38DF5627EE4FA5B51"><enum>(v)</enum><header>Report to
				Congress</header><text display-inline="yes-display-inline">Not later than 30
				days after the date on which the Homeland Security Secretary completes a
				material threat assessment under clause (i) or a risk assessment for the
				purpose of satisfying such clause, the Secretary shall submit to Congress a
				report containing the results of such assessment.</text>
						</clause><clause id="H53A2020F45C24EC39C54B9C3B685D87B"><enum>(vi)</enum><header>Definition</header><text>For
				purposes of this subparagraph, the term <term>risk assessment</term> means a
				scientific, technically-based analysis of agents that incorporates threat,
				vulnerability, and consequence
				information.</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H8CF7F850F9BE4781944606697900FAF6"><enum>(b)</enum><header>Authorization of
			 appropriations</header><text>Section 521(d) of the Homeland Security Act of
			 2002 (6 U.S.C. 321–j(d)) is amended—</text>
				<paragraph id="HECF17D07989F42298E06FCDFFCE8EA45"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>2006,</quote> and inserting <quote>2009,</quote>; and</text>
				</paragraph><paragraph id="H55F39B9F2D1A4A50906446F4435165C8"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H80D649C21E2140ADAF29C30956FBFE75" style="OLC">
						<paragraph id="HA4F10BD7833F4E4285DF594D7D6472AE"><enum>(3)</enum><header>Additional
				authorization of appropriations regarding certain threat
				assessments</header><text display-inline="yes-display-inline">For the purpose
				of providing an additional amount to the Secretary to assist the Secretary in
				meeting the requirements of clause (iv) of section 319F–2(c)(2)(A)) of the
				Public Health Service Act (relating to time frames), there are authorized to be
				appropriated such sums as may be necessary for fiscal year 2008, in addition to
				the authorization of appropriations established in paragraph (1). The purposes
				for which such additional amount may be expended include conducting risk
				assessments regarding clause (i)(II) of such section when there are no existing
				risk assessments that the Secretary considers
				credible.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section></legis-body>
