		<section id="H3D9CF663DC464222B2F666B276E93FFC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Depository Institution Community
			 Development Investments Enhancement Act</short-title></quote>.</text>
		</section><section id="HEE345B90352944E7ACA346A234671049"><enum>2.</enum><header>Technical
			 corrections</header>
			<subsection id="H0412435CA9E54993B9D869D874411FE0"><enum>(a)</enum><header>National
			 banks</header><text display-inline="yes-display-inline">The first sentence of
			 the paragraph designated as the <quote>Eleventh</quote> of section 5136 of the
			 Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/12/24">12 U.S.C. 24</external-xref>) (as amended by section
			 305(a) of the Financial Services Regulatory Relief Act of 2006) is amended by
			 striking <quote>promotes the public welfare by benefiting primarily</quote> and
			 inserting <quote>is designed primarily to promote the public welfare, including
			 the welfare of</quote>.</text>
			</subsection><subsection id="H1E67AE884B204FE1BA06EA8422AEECD8"><enum>(b)</enum><header>State member
			 banks</header><text display-inline="yes-display-inline">The first sentence of
			 the 23rd undesignated paragraph of section 9 of the Federal Reserve Act
			 (12 U.S.C.
			 338a) (as amended by section 305(b) of the Financial Services
			 Regulatory Relief Act of 2006) is amended by striking <quote>promotes the
			 public welfare by benefiting primarily</quote> and inserting <quote>is designed
			 primarily to promote the public welfare, including the welfare
			 of</quote>.</text>
			</subsection></section><section display-inline="no-display-inline" id="H7F7BAF7D9917444DBE5BFA8435D83692" section-type="subsequent-section"><enum>3.</enum><header>Investments by Federal
			 savings associations authorized to promote the public welfare</header>
			<subsection id="H10D10D1A38AA4E9CA97BA9B72B3EEDDD"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 5(c)(3) of
			 the Home Owners' Loan Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1464">12 U.S.C. 1464(c)</external-xref>) is amended by
			 adding at the end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="H4A6969F66BA54A5F95A1C88C44F31210" style="OLC">
					<subparagraph id="H540C008D4D974483928F116119247907"><enum>(D)</enum><header>Direct
				investments to promote the public welfare</header>
						<clause id="H9C2E464D401B41A695831B2190B982A1"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">A Federal savings
				association may make investments, directly or indirectly, each of which is
				designed primarily to promote the public welfare, including the welfare of low-
				and moderate-income communities or families through the provision of housing,
				services, and jobs.</text>
						</clause><clause id="H1CA3EC3B5374436D947B28B446481311"><enum>(ii)</enum><header>Direct
				investments or acquisition of interest in other companies</header><text display-inline="yes-display-inline">Investments under clause (i) may be made
				directly or by purchasing interests in an entity primarily engaged in making
				such investments.</text>
						</clause><clause id="H48DE99B2D45749EABEC9641FBB9C1D0"><enum>(iii)</enum><header>Prohibition on
				unlimited liability</header><text>No investment may be made under this
				subparagraph which would subject a Federal savings association to unlimited
				liability to any person.</text>
						</clause><clause id="H90D55EECC9894D44A9753CE45D83B0F5"><enum>(iv)</enum><header>Single
				investment limitation to be established by director</header><text>Subject to
				clauses (v) and (vi), the Director shall establish, by order or regulation,
				limits on—</text>
							<subclause id="H9FF73BC51E064E7EB9BA7D1500D3EFEF"><enum>(I)</enum><text>the amount any
				savings association may invest in any 1 project; and</text>
							</subclause><subclause id="H511E38F12CAF40849FA4C6AEB2B4E2D7"><enum>(II)</enum><text>the aggregate
				amount of investment of any savings association under this subparagraph.</text>
							</subclause></clause><clause id="H47613EDAC5C0454E870286DE625B661D"><enum>(v)</enum><header>Flexible
				aggregate investment limitation</header><text>The aggregate amount of
				investments of any savings association under this subparagraph may not exceed
				an amount equal to the sum of 5 percent of the savings association's capital
				stock actually paid in and unimpaired and 5 percent of the savings
				association's unimpaired surplus, unless—</text>
							<subclause id="H638D1704BDE644BAA14BC4E6B771BFE5"><enum>(I)</enum><text>the Director
				determines that the savings association is adequately capitalized; and</text>
							</subclause><subclause id="H14C3AC73EFCB436FB862C0FA05B6F2AC"><enum>(II)</enum><text>the Director
				determines, by order, that the aggregate amount of investments in a higher
				amount than the limit under this clause will pose no significant risk to the
				affected deposit insurance fund.</text>
							</subclause></clause><clause id="HF31D1A763FF143FBA2386C44F756195"><enum>(vi)</enum><header>Maximum
				aggregate investment limitation</header><text>Notwithstanding clause (v), the
				aggregate amount of investments of any savings association under this
				subparagraph may not exceed an amount equal to the sum of 15 percent of the
				savings association's capital stock actually paid in and unimpaired and 15
				percent of the savings association's unimpaired surplus.</text>
						</clause><clause id="H29472B7FA8124EE8ABCE52CF04BD39"><enum>(vii)</enum><header>Investments not
				subject to other limitation on quality of investments</header><text>No
				obligation a Federal savings association acquires or retains under this
				subparagraph shall be taken into account for purposes of the limitation
				contained in section 28(d) of the Federal Deposit Insurance Act on the
				acquisition and retention of any corporate debt security not of investment
				grade.</text>
						</clause><clause id="HED1938036EE44851824060E5634FA57D"><enum>(viii)</enum><header>Applicability
				of standards to each investment</header><text display-inline="yes-display-inline">The standards and limitations of this
				subparagraph shall apply to each investment under this subparagraph made by a
				savings association directly and by its
				subsidiaries.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H13EB9486769B4201B1B6BD8BB0F66C23"><enum>(b)</enum><header>Technical and
			 Conforming Amendments</header><text display-inline="yes-display-inline">Section
			 5(c)(3)(A) of the Home Owners' Loan Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1464">12 U.S.C. 1464(c)(3)(A)</external-xref>) is amended
			 to read as follows:</text>
