<section id="HB3500358B1FE417B902C122729C1257F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote>Ari’s Law</quote>.</text></section> 
<section id="H6C405F9C9D0345A991182D9F253FB2DF"><enum>2.</enum><header>Establishment of railroad safety grant program</header> 
<subsection id="HD07D4CB64DCA4820B700505E6645D809"><enum>(a)</enum><header>Grants</header><text>The Secretary of Transportation (hereafter referred to as the <quote>Secretary</quote>) shall establish a grant program to improve railroad safety by providing funds to eligible entities to construct and maintain fencing and other protective structures along railroad tracks.</text></subsection> 
<subsection id="HB179ABDD927642D6AE6052839CD2D7FD"><enum>(b)</enum><header>Eligible entity</header><text>For the purposes of this Act, <quote>eligible entity</quote> means any of the following:</text> 
<paragraph id="H5AF28DB714694238AA9B3368DAD51E23"><enum>(1)</enum><text>A unit of local government who owns or controls land along a railroad right-of-way.</text></paragraph> 
<paragraph id="H490B1A4AB648422AB4B9EADF434900A9"><enum>(2)</enum><text>Any other person providing railroad transportation.</text></paragraph></subsection> 
<subsection id="HF99378C3671844C587F400D9A1C3AF21"><enum>(c)</enum><header>Grant conditions</header> 
<paragraph id="H1C77FB7FFF974686875BC2AEDF02AC98"><enum>(1)</enum><header>Certification required</header><text>In order to receive a grant under the program for a fiscal year, an eligible entity must certify to the Secretary, at such time and in such form as the Secretary may require, that—</text> 
<subparagraph id="HE78A24D778014BB1802D584CD8A27D55"><enum>(A)</enum><text>the eligible entity will monitor or inspect all of the fencing and other protective structures along railroad tracks within the entity’s jurisdiction not less frequently than once per week; and</text></subparagraph> 
<subparagraph id="H1DD4FCD2E5F14533955FB864459CB37E"><enum>(B)</enum><text display-inline="yes-display-inline">the eligible entity will repair any deficiency in the fencing and other protective structures within 2 weeks of finding or being notified of such deficiency.</text> </subparagraph></paragraph> 
<paragraph id="H7BA06557B29F4A6EB225CE17C1394B40"><enum>(2)</enum><header>Period of applicability</header><text>An eligible entity that receives a grant shall monitor and repair fencing and other protective structures, as described in subparagraphs (A) and (B) of paragraph (1), for the period beginning with the receipt of grant funds and ending 10 years after the date on which all grant funds received under the program by the entity have been expended.</text></paragraph> </subsection> 
<subsection id="H230F0B18C3524F2986A00081A329EA8"><enum>(d)</enum><header>Railroad defined</header><text>For the purposes of this Act, <quote>railroad</quote> means any form of nonhighway ground transportation that runs on rails or electromagnetic guideways.</text></subsection> 
<subsection id="H6089FCE6C5A84E5BB2CA59D216F92CD"><enum>(e)</enum><header>Authorization of Appropriations</header> 
<paragraph id="HE8767246740149508402995E2FC6E29F"><enum>(1)</enum><header>Grants</header><text>For grants under this section, there is authorized to be appropriated $20 million for fiscal year 2008 and each succeeding fiscal year.</text></paragraph> 
<paragraph id="HB375B382162F4C7EB10060C800B10018"><enum>(2)</enum><header>Continuing Availability of Amounts Appropriated</header><text>Amounts appropriated pursuant to the authorization under paragraph (1) shall remain available until expended.</text></paragraph> </subsection></section> 
<section id="H645583963CA048A18D4D2028B1C1B809"><enum>3.</enum><header>Studying and reporting on best practices for railroad safety</header> 
<subsection id="HD8001B0CB4464583ACE0CE3D2CC800DC"><enum>(a)</enum><header>Study of Best Practices</header><text display-inline="yes-display-inline">The Administrator of the Federal Railroad Administration shall study the best practices for railroad safety related to the construction, monitoring, and repair of fencing and other protective structures along railroad tracks.</text></subsection> 
<subsection id="H868D0DDD95124B9EA8CCB96B6EFDC85"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator shall submit a report of the findings from the study conducted in subsection (a) to Congress.</text> </subsection></section>
