		<section display-inline="no-display-inline" id="HC38193FCEC664AF8B4ED5B68FC730883" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Marine Mammal Rescue Assistance
			 Amendments of 2007</short-title></quote>.</text>
		</section><section id="H7172E7ECE13C4EBAB16F11C62FC5093E"><enum>2.</enum><header>Stranding and
			 entanglement response</header>
			<subsection id="HE0E9DBC27CD9420A9C6B73F2531F92DB"><enum>(a)</enum><header>Collection and
			 updating of information</header><text>Section 402(b)(1)(A) of the Marine Mammal
			 Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1421a">16 U.S.C. 1421a(b)(1)(A)</external-xref>) is
			 amended by inserting <quote>or entangled</quote> after
			 <quote>stranded</quote>.</text>
			</subsection><subsection display-inline="no-display-inline" id="HA6DF96DB9CC34A2784F222B61DDAE7E3"><enum>(b)</enum><header>Entanglement
			 response agreements</header>
				<paragraph id="H7AAAA3AA6FEA43A0A9B35192AF64D83E"><enum>(1)</enum><header>In
			 general</header><text>Section 403 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1421b">16 U.S.C. 1421b</external-xref>) is
			 amended—</text>
					<subparagraph id="H243E0427CF5F4E4CB865005B00B3CB35"><enum>(A)</enum><text>by amending the
			 section heading to read as follows:</text>

			 by inserting <quote>or entanglement</quote> before the period.</text>
					</subparagraph></paragraph><paragraph id="H3FF52046E02B486A83D819CC4EE5784C"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The table of contents at the end of the first section
			 is amended by striking the item relating to section 403 and inserting the
			 following:</text>

			 406(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1421e">16 U.S.C. 1421e(a)</external-xref>) is amended by
			 inserting <quote>or entanglement</quote> after <quote>stranding</quote>.</text>
			</subsection><subsection display-inline="no-display-inline" id="H3A647ADF398D414383B3B4B15FAB8217"><enum>(d)</enum><header>Entanglement
			 defined</header>
				<paragraph id="H6AB820AF28FC452E88333C8800DE9FC1"><enum>(1)</enum><header>In
			 general</header><text>Section 410 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1421h">16 U.S.C. 1421h</external-xref>) is
			 amended—</text>
					<subparagraph id="H2115EDD3CFA941DC89FF8FA3913F95BA"><enum>(A)</enum><text>by redesignating
			 paragraphs (1) through (6) in order as paragraphs (2) through (7); and</text>
					</subparagraph><subparagraph id="HCCA3659D9B8F42FDAADE7795DF57B100"><enum>(B)</enum><text>by inserting
			 before paragraph (2) (as so redesignated) the following:</text>
						<quoted-block id="HD2BE6D58AB89442F93E685371CE51C00">
							<paragraph id="H79F7E6454D5E49689700DE7DB2878700"><enum>(1)</enum><text>The term
				<term>entanglement</term> means an event in the wild in which a living or dead
				marine mammal has gear, rope, line, net, or other material wrapped around or
				attached to it and is—</text>
								<subparagraph id="H5206E6BA70F64F349C46C03FA4DF57BA"><enum>(A)</enum><text>on a beach or
				shore of the United States; or</text>
								</subparagraph><subparagraph id="HB2F615068C3044F283E164CC35881356"><enum>(B)</enum><text>in waters under
				the jurisdiction of the United
				States.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HCAD761A48B704A8A98CB039BB27E8700"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 408(a)(2)(B)(i) of such Act (16 U.S.C.
			 1421f–1(a)(2)(B)(i)) is amended by striking <quote>section
			 410(6)</quote> and inserting <quote>section 410(7)</quote>.</text>
				</paragraph></subsection><subsection id="H34913BFEF7544A739D416D3CB74646CA"><enum>(e)</enum><header>John H. Prescott
			 Marine Mammal Rescue Assistance Grant Program</header>
				<paragraph id="H0227F47A47624FB39004B9CD6DB94D76"><enum>(1)</enum><header>Authorization of
			 appropriations for grant program</header><text>Section 408(h) of such Act
			 (16 U.S.C.
			 1421f–1(h)) is amended—</text>
					<subparagraph id="H9D15A27BE42F4BC4B571EE01EBFD8536"><enum>(A)</enum><text>by striking
			 <quote>$5,000,000 for each of fiscal years 2001 through 2003</quote> and
			 inserting <quote>$7,000,000 for each of fiscal years 2007 through 2010</quote>;
			 and</text>
					</subparagraph><subparagraph id="H2C0240B3265C4C2DB4D2D087FFAA15BD"><enum>(B)</enum><text>in paragraph (1)
			 by striking <quote>$4,000,000</quote> and inserting
			 <quote>$6,000,000</quote>.</text>
					</subparagraph></paragraph><paragraph id="HAFDC1B2D6DDD49508DE53C9CD1907221"><enum>(2)</enum><header>Administrative
			 costs and expenses</header><text>Section 408 of such Act (16 U.S.C.
			 1421f–1) is amended—</text>
					<subparagraph id="HDEE6E7A95E754FB0A1AC4B5FA1A000BC"><enum>(A)</enum><text>by adding at the
			 end of subsection (a)(1) the following: <quote>All funds available to implement
			 this section shall be distributed to eligible stranding network participants
			 for the purposes set forth in this paragraph and paragraph (2), except as
			 provided in subsection (f).</quote>; and</text>
					</subparagraph><subparagraph id="H8057C75C67F145AC9E678100475C7DC1"><enum>(B)</enum><text>by amending
			 subsection (f) to read as follows:</text>
						<quoted-block id="HE48765C7CEA945C49DE2BD2EA1002828">
							<subsection id="HD3BD898D32FB4FA7B856DACF00AC41B"><enum>(f)</enum><header>Administrative
				costs and expenses</header><text>Of the amounts available each fiscal year to
				carry out this section, the Secretary may expend not more than 6 percent or
				$80,000, whichever is greater, to pay the administrative costs and
				administrative expenses to implement the grant program under subsection (a).
				Any such funds retained by the Secretary for a fiscal year for such costs and
				expenses that are not used for such costs and expenses before the end of the
				fiscal year shall be provided as grants under subsection
				(a).</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H29C8DC325B304428BB7F1086BF142D98"><enum>(3)</enum><header>Emergency
			 assistance</header><text>Section 408 of such Act (16 U.S.C.
			 1421f–1) is amended—</text>
					<subparagraph id="HD43E25A7F19F44A197AAAE6F04FC1F24"><enum>(A)</enum><text>in subsection (a)
			 by redesignating paragraph (2) as paragraph (3), and by inserting after
			 paragraph (1) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H49B0CE7684894A179556C100443DC442" style="OLC">
							<paragraph id="H44CF128E6DD34AABACFEA3ADD2F8FEEE" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Subject to the availability of
				appropriations, the Secretary may also enter into cooperative agreements,
				contracts, or such other agreements or arrangements as the Secretary considers
				appropriate to address stranding events requiring emergency
				assistance.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HB772C61837DC4DC5BD6B00EBF114E18B"><enum>(B)</enum><text>in subsection (d)
			 by inserting <quote>(1)</quote> before the text, and by adding at the end the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="HE075F55CFC434BA1BD4BD5645511C93D" style="OLC">
							<paragraph id="HFC33533E7F3B48F987083D08652375AB" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Funding for emergency stranding projects
				shall not be subject to the funding limit established in paragraph
				(1).</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H322F27638ABD4E35BA7F1D558FA84476"><enum>(C)</enum><text>in subsection
			 (e)—</text>
						<clause id="H787221B2B21B4BE7A7EDEA7836D9238E"><enum>(i)</enum><text>in
			 paragraph (1) by striking <quote>The non-Federal</quote> and inserting
			 <quote>Except as provided in paragraph (2), the non-Federal</quote>;</text>
						</clause><clause id="H057A0192B5174D3382DA51C1351ED3FF"><enum>(ii)</enum><text>by
			 redesignating paragraph (2) as paragraph (3); and</text>
						</clause><clause id="H2F10564AA4974D5BB1E636F0A1E767D6"><enum>(iii)</enum><text>by
			 inserting after paragraph (1) the following:</text>
							<quoted-block display-inline="no-display-inline" id="HA1D00305C376490597C4B2F147C96627" style="OLC">
								<paragraph id="H6B520BBC17BE488898E336E733C7E547"><enum>(2)</enum><header>Emergency
				assistance</header><text>No non-Federal contribution shall be required for
				funding for a response to an emergency stranding
				event.</text>
								</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="H5338136CA3A84702943085B1480425F4"><enum>(D)</enum><text>in subsection (g)
			 by redesignating paragraph (2) as paragraph (3) and inserting after paragraph
			 (1) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H219DC632E50C4536862E9690D4430018" style="OLC">
							<paragraph id="H6DA4E1ED8CC6486AA4008FD8C2C18359"><enum>(2)</enum><header>Emergency
				assistance</header><text>The term <term>emergency assistance</term> means
				assistance provided for a stranding event that—</text>
								<subparagraph id="HE9D5D12A27DF482BAD495EC276853031"><enum>(A)</enum><text>is not an unusual
				mortality event as defined in section 409(6);</text>
								</subparagraph><subparagraph id="H89B9976B02FD492EA95E7E920000B640"><enum>(B)</enum><text>leads to an
				immediate increase in required costs for stranding response, recovery, or
				rehabilitation in excess of regularly scheduled costs;</text>
								</subparagraph><subparagraph id="H1E96F7576A6247C1AB3DD336F82E808"><enum>(C)</enum><text>may be cyclical or
				endemic; and</text>
								</subparagraph><subparagraph id="HD4682A87C3E24913809047E2727D0590"><enum>(D)</enum><text>may involve
				out-of-habitat
				animals.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HB31B6470DA0E4529AAF8609565CBC4E4"><enum>(4)</enum><header>Contributions</header><text>Section
			 408 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1421f-1">16 U.S.C. 1421f–1</external-xref>) is amended by
			 adding at the end the following:</text>
					<quoted-block id="HE222DE982AF543428B92BF23F8C7102F">
						<subsection id="H925A1D1AE98F4ABF8EE5C9395CB8275C"><enum>(i)</enum><header>Contributions</header><text>For
				purposes of carrying out this section, the Secretary may solicit, accept,
				receive, hold, administer, and use gifts, devises, and
				bequests.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H5D94793EAC034EC88EA042EBBB12CEA"><enum>(f)</enum><header>Authorization of
			 appropriations for Marine Mammal Unusual Mortality Event
			 Fund</header><text>Section 409(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1421g">16 U.S.C. 1421g(3)</external-xref>) is amended by
			 striking <quote>fiscal year 1993</quote> and inserting <quote>each of fiscal
			 years 2007 through 2010</quote>.</text>
