<section display-inline="yes-display-inline" id="H3DD8197D56154500B5C44983324FACA5" section-type="undesignated-section"><enum></enum><text display-inline="yes-display-inline">That, effective on the date of the enactment of the Food, Conservation, and Energy Act of 2008, the Food, Conservation, and Energy Act of 2008 is amended by inserting after title II the following new title:</text>

<section id="H01F50C998E7D4FFA8B00BD00588F2D36"><enum>3001.</enum><header>Short title</header> 
<subsection id="H3904D083AFD441B3BE84F67950F499E7"><enum>(a)</enum><header>In General</header><text>Section 1 of the Agricultural Trade Development and Assistance Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/7/1691">7 U.S.C. 1691</external-xref> note; 104 Stat. 3633) is amended by striking <quote>Agricultural Trade Development and Assistance Act of 1954</quote> and inserting <quote>Food for Peace Act</quote>.</text> </subsection>
<subsection id="H9C889B6311BE40989C8DC2D64E5F7723"><enum>(b)</enum><header>Conforming Amendments</header> 
<paragraph id="H2D176FB38E5E4D9692BD34BE30F0D174"><enum>(1)</enum><header>In general</header><text>Each provision of law described in paragraph (2) is amended—</text> 
<subparagraph id="H76BB43D6DCE0403A9BFDE9E22DACAC86"><enum>(A)</enum><text>by striking <quote>Agricultural Trade Development and Assistance Act of 1954</quote> each place it appears and inserting <quote>Food for Peace Act</quote>; and</text> </subparagraph>
<subparagraph id="H5D8F7D0A2E6F45C29FE880A421E825B"><enum>(B)</enum><text>in each section heading, by striking <quote><header-in-text level="section" style="USC">AGRICULTURAL TRADE DEVELOPMENT AND ASSISTANCE ACT OF 1954</header-in-text></quote> each place it appears and inserting <quote><header-in-text level="section" style="USC">FOOD FOR PEACE ACT</header-in-text></quote>.</text> </subparagraph></paragraph>

<section id="H4A5B927E6E8F4AD5B8DF00A23304026C"><enum>3002.</enum><header>United States policy</header><text display-inline="no-display-inline">Section 2 of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1691">7 U.S.C. 1691</external-xref>) is amended—</text> 
<paragraph id="HA4923A4EA7FB4A708BCD72166EA3C00"><enum>(1)</enum><text>by striking paragraph (4); and</text> </paragraph>
<paragraph id="HB6996B5ED7C949488C0672FC006CDDD4"><enum>(2)</enum><text>by redesignating paragraphs (5) and (6) as paragraphs (4) and (5), respectively.</text> </paragraph></section>
<section id="H7CFF82596D95465FA79E004F211BE3CF"><enum>3003.</enum><header>Food aid to developing countries</header><text display-inline="no-display-inline">Section 3(b) of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1691a">7 U.S.C. 1691a(b)</external-xref>) is amended by striking <quote>(b)</quote> and all that follows through paragraph (1) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="HC4019E2C6C204EBF9DBAD2BB09E9386" style="OLC"> 
<subsection id="H47441CE190764289938D3F8259569DF0"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text> 
<paragraph id="HA04F4314946F4C86ADD9B2088E4FD2F5"><enum>(1)</enum><text>in negotiations at the Food Aid Convention, the World Trade Organization, the United Nations Food and Agriculture Organization, and other appropriate venues, the President shall—</text> 
<subparagraph id="H67959A8ADF9142BCB6D277A12D165F44"><enum>(A)</enum><text>seek commitments of higher levels of food aid by donors in order to meet the legitimate needs of developing countries;</text> </subparagraph>
<subparagraph id="H2E6F53EAD4984FECA78CB556933285A5"><enum>(B)</enum><text>ensure, to the maximum extent practicable, that humanitarian nongovernmental organizations, recipient country governments, charitable bodies, and international organizations shall continue—</text> 
<clause id="HC8622EABF0B64452974849F1BB90A34D"><enum>(i)</enum><text>to be eligible to receive resources based on assessments of need conducted by those organizations and entities; and</text> </clause>
<clause id="H9DA04DDC85DD429DA9D5CCA48C49529"><enum>(ii)</enum><text>to implement food aid programs in agreements with donor countries; and</text> </clause></subparagraph>
<subparagraph id="H4E9ADECD6B044807BE7942BEE2A0A6FF"><enum>(C)</enum><text>ensure, to the maximum extent practicable, that options for providing food aid for emergency and nonemergency needs shall not be subject to limitation, including in-kind commodities, provision of funds for agricultural commodity procurement, and monetization of commodities, on the condition that the provision of those commodities or funds—</text> 
<clause id="H592CBA96801A481FBC70B5940854E939"><enum>(i)</enum><text>is based on assessments of need and intended to benefit the food security of, or otherwise assist, recipients, and</text> </clause>
<clause id="H93D3B36039144D3F87F731BAAD439CC2"><enum>(ii)</enum><text>is provided in a manner that avoids disincentives to local agricultural production and marketing and with minimal potential for disruption of commercial markets; and</text> </clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>
<section id="H154FA4895A304396B6B2C7ABE200309B"><enum>3004.</enum><header>Trade and development assistance</header> 
<subsection id="H203B21EAF2B0429BB696A9D48D522C58"><enum>(a)</enum><text>Title I of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1701">7 U.S.C. 1701 et seq.</external-xref>) is amended in the title heading, by striking <quote><header-in-text level="title">TRADE AND DEVELOPMENT ASSISTANCE</header-in-text></quote> and inserting <quote><header-in-text level="title">ECONOMIC ASSISTANCE AND FOOD SECURITY</header-in-text></quote>.</text> </subsection>
<subsection id="H72D561F7066A4D1BA7E613DF294F8403"><enum>(b)</enum><text>Section 101 of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1701">7 U.S.C. 1701</external-xref>) is amended in the section heading, by striking <quote><header-in-text level="section" style="USC">TRADE AND DEVELOPMENT ASSISTANCE</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">ECONOMIC ASSISTANCE AND FOOD SECURITY</header-in-text></quote>.</text> </subsection></section>
<section id="HC4B7FA6C2129492C84FA685364BB18EF"><enum>3005.</enum><header>Agreements regarding eligible countries and private entities</header><text display-inline="no-display-inline">Section 102 of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1702">7 U.S.C. 1702</external-xref>) is amended—</text>

<subparagraph id="H795AA62DB3A8473DB1CFBFD7745FAA2D"><enum>(A)</enum><text>by striking paragraph (1); and</text> </subparagraph>

<section id="H47CE30E3E7524E8796A9E3D3BACF93E2"><enum>3006.</enum><header>Use of local currency payments</header><text display-inline="no-display-inline">Section 104(c) of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1704">7 U.S.C. 1704(c)</external-xref>) is amended—</text> 
<paragraph id="HCD24DB9103E948769F88F9B7D202B5C6"><enum>(1)</enum><text>in the matter preceding paragraph (1), by inserting <quote>, through agreements with recipient governments, private voluntary organizations, and cooperatives,</quote> after <quote>developing country</quote>;</text> </paragraph>
<paragraph id="H58FDE3F17F00458E9D266618C3843826"><enum>(2)</enum><text>by striking paragraph (1);</text> </paragraph>

<section id="H552FF1DB1EB740D1863154F749E8B7BE"><enum>3007.</enum><header>General authority</header><text display-inline="no-display-inline">Section 201 of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1721">7 U.S.C. 1721</external-xref>) is amended—</text> 
<paragraph id="H290E4C30BD384B69BB2962CAD31105AF"><enum>(1)</enum><text>by striking paragraph (1) and inserting the following:</text>

<section id="H96946286480A414BB5059EAD5EF2CF57"><enum>3008.</enum><header>Provision of agricultural commodities</header><text display-inline="no-display-inline">Section 202 of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1722">7 U.S.C. 1722</external-xref>) is amended—</text>

<subparagraph id="H79A0A93740124DDEA355EEB4A5EA85AB"><enum>(B)</enum><text>to adjust products and formulations (including the potential introduction of new fortificants and products) as necessary to cost-effectively meet nutrient needs of target populations; and</text> </subparagraph>
<subparagraph id="H6C5170B655934C39804DCCA22047FC00"><enum>(C)</enum><text>to test prototypes.</text> </subparagraph></paragraph>
<paragraph id="HC99150913AC64EDCBDDC39899CE9A72E"><enum>(2)</enum><header>Administration</header><text>The Administrator—</text> 
<subparagraph id="H8A44689FCE2C44928575D0C986763918"><enum>(A)</enum><text>shall carry out this subsection in consultation with and through independent entities with proven expertise in food aid commodity quality enhancements;</text> </subparagraph>
<subparagraph id="HA10197EC518C4491AEF0DC5C809DA36"><enum>(B)</enum><text>may enter into contracts to obtain the services of such entities; and</text> </subparagraph>
<subparagraph id="H57F8CD1099AB4056B9D6245B4CD40111"><enum>(C)</enum><text>shall consult with the Food Aid Consultative Group on how to carry out this subsection.</text> </subparagraph></paragraph>
<paragraph id="H832ED49BA1E143CC888C2F5C9BB486CE"><enum>(3)</enum><header>Funding limitation</header><text>Of the funds made available under section 207(f), for fiscal years 2009 through 2011, not more than $4,500,000 may be used to carry out this subsection.</text> </paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block> </paragraph></section>
<section id="H06D92D3279404D19A98C00932FB2002E"><enum>3009.</enum><header>Generation and use of currencies by private voluntary organizations and cooperatives</header><text display-inline="no-display-inline">Section 203(b) of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1723">7 U.S.C. 1723(b)</external-xref>) is amended by striking <quote>1 or more recipient countries</quote> and inserting <quote>in 1 or more recipient countries</quote>.</text> </section>

<paragraph id="HC511EF4526A346AE81C59F121200A637"><enum>(1)</enum><header>Duties of Administrator</header><text>The Administrator, in consultation with the Secretary, shall establish systems and carry out activities—</text> 
<subparagraph id="H94EA5D8BB8D34397BBFFAAA7A8B5EEAF"><enum>(A)</enum><text>to determine the need for assistance provided under this title; and</text> </subparagraph>
<subparagraph id="H89B7DFE3524E4909959E44BADBFDD822"><enum>(B)</enum><text>to improve, monitor, and evaluate the effectiveness and efficiency of the assistance provided under this title to maximize the impact of the assistance.</text> </subparagraph></paragraph>
<paragraph id="H83E9C41B71AD4FAAB95C1CD65FE1EC70"><enum>(2)</enum><header>Requirements of systems and activities</header><text>The systems and activities described in paragraph (1) shall include—</text> 
<subparagraph id="H14FB4099BF2349DA947385EF5882DC9"><enum>(A)</enum><text>program monitors in countries that receive assistance under this title;</text> </subparagraph>
<subparagraph id="HB1B1A12315E94A3385CA7B0888DDBD00"><enum>(B)</enum><text>country and regional food aid impact evaluations;</text> </subparagraph>
<subparagraph id="H58EF6869827E407A82545F91E9C23770"><enum>(C)</enum><text>the identification and implementation of best practices for food aid programs;</text> </subparagraph>
<subparagraph id="H60312F9345514C3B8C3FF506FA14E435"><enum>(D)</enum><text>the evaluation of monetization programs;</text> </subparagraph>
<subparagraph id="HDB49C957149E428F9947C172A873F0BB"><enum>(E)</enum><text>early warning assessments and systems to help prevent famines; and</text> </subparagraph>
<subparagraph id="HE2FD786146E3453F9606C45EDD26E58"><enum>(F)</enum><text>upgraded information technology systems.</text> </subparagraph></paragraph>
<paragraph id="H44EBC8FBF1374C1C93F360DC56714FF3"><enum>(3)</enum><header>Implementation report</header><text>Not later than 180 days after the date of enactment of the Food, Conservation, and Energy Act of 2008, the Administrator shall submit to the appropriate committees of Congress a report on efforts undertaken by the Administrator to conduct oversight of nonemergency programs under this title.</text> </paragraph>
<paragraph id="H4B2CF054F5864910A600897F852BAC42"><enum>(4)</enum><header>Government Accountability Office report</header><text>Not later than 270 days after the date of submission of the report under paragraph (3), the Comptroller General of the United States shall submit to the appropriate committees of Congress a report that contains—</text> 
<subparagraph id="H5D478FB471C24F89970574E29B543C19"><enum>(A)</enum><text>a review of, and comments addressing, the report described in paragraph (3); and</text> </subparagraph>
<subparagraph id="H777FB0EEC54843F8914657002700A9BA"><enum>(B)</enum><text>recommendations relating to any additional actions that the Comptroller General of the United States determines to be necessary to improve the monitoring and evaluation of assistance provided under this title.</text> </subparagraph></paragraph>
<paragraph id="HFF54DF1E15BF4590B620E5A8C66F23FB"><enum>(5)</enum><header>Contract authority</header> 
<subparagraph id="HCE09FA4CB9204100B188CBCE00DF6F1C"><enum>(A)</enum><header>In general</header><text>Subject to subparagraphs (B) and (C), in carrying out administrative and management activities relating to each activity carried out by the Administrator under paragraph (1), the Administrator may enter into contracts with 1 or more individuals for personal service to be performed in recipient countries or neighboring countries.</text> </subparagraph>
<subparagraph id="HB03D31EEE52B45F4902E766966803CAD"><enum>(B)</enum><header>Prohibition</header><text>An individual who enters into a contract with the Administrator under subparagraph (A) shall not be considered to be an employee of the Federal Government for the purpose of any law (including regulations) administered by the Office of Personnel Management.</text> </subparagraph>
<subparagraph id="H7C685C679BE84B2FA1ED076E5B9E65C3"><enum>(C)</enum><header>Personal service</header><text>Subparagraph (A) does not limit the ability of the Administrator to enter into a contract with any individual for personal service under section 202(a).</text> </subparagraph></paragraph>
<paragraph id="H9DB40003F7CB4988B84298582D4528D2"><enum>(6)</enum><header>Funding</header> 
<subparagraph id="H854E771C64BC48F28562744816BF64F7"><enum>(A)</enum><header>In general</header><text>Subject to section 202(h)(3), in addition to other funds made available to the Administrator to carry out the monitoring of emergency food assistance, the Administrator may implement this subsection using up to $22,000,000 of the funds made available under this title for each of fiscal years 2009 through 2012, except for paragraph (2)(F), for which only $2,500,000 shall be made available during fiscal year 2009.</text> </subparagraph>
<subparagraph id="H74F5D979028A44C093CEF67FD936C68"><enum>(B)</enum><header>Limitations</header> 
<clause id="H09381B84066B4335B09140E94D4B7634"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), of the funds made available under subparagraph (A), for each of fiscal years 2009 through 2012, not more than $8,000,000 may be used by the Administrator to carry out paragraph (2)(E).</text> </clause>
<clause id="H87928C2840C44254B5F2D4534166B34F"><enum>(ii)</enum><header>Condition</header><text>No funds shall be made available under subparagraph (A), in accordance with clause (i), unless not less than $8,000,000 is made available under chapter 1 of part I of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151 et seq.</external-xref>) for such purposes for such fiscal year.</text> </clause></subparagraph></paragraph></subsection>

<paragraph id="H110EE49301694D54B709424220843382"><enum>(1)</enum><header>In general</header><text>In submitting project reports to the Administrator, a private voluntary organization or cooperative shall provide a copy of the report in such form as is necessary for the report to be displayed for public use on the website of the United States Agency for International Development.</text> </paragraph>
<paragraph id="H8E7FF9845E6E4BD4B1DCE49211637951"><enum>(2)</enum><header>Confidential information</header><text>An organization or cooperative described in paragraph (1) may omit any confidential information from the copy of the report submitted for public display under that paragraph.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section>

<subsection id="H9261403BBB114E3BB36B51620532C570"><enum>(a)</enum><header>Annual reports</header><text>Section 407 of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1736a">7 U.S.C. 1736a</external-xref>) is amended by striking subsection (f) and inserting the following:</text>

<subparagraph id="HF594C46954A8435F94DDB72FAC75FE"><enum>(A)</enum><header>Annual report</header><text>Not later than April 1 of each fiscal year, the Administrator and the Secretary shall jointly prepare and submit to the appropriate committees of Congress a report regarding each program and activity carried out under this Act during the prior fiscal year.</text> </subparagraph>
<subparagraph id="HA671DC3FF3154BB8B22CDB3C472E2F85"><enum>(B)</enum><header>Contents</header><text>An annual report described in subparagraph (A) shall include, with respect to the prior fiscal year—</text> 
<clause id="HA0708F6DDF9F4D38BEEB0515FDE351F6"><enum>(i)</enum><text>a list that contains a description of each country and organization that receives food and other assistance under this Act (including the quantity of food and assistance provided to each country and organization);</text> </clause>
<clause id="HD980B62172344DED85DC589D55F3DD2B"><enum>(ii)</enum><text>a general description of each project and activity implemented under this Act (including each activity funded through the use of local currencies);</text> </clause>
<clause id="H7FD8740E363E4C8FA2BA5924E4E83B05"><enum>(iii)</enum><text>a statement describing the quantity of agricultural commodities made available to each country pursuant to—</text> 
<subclause id="HB1D43D0C33BE4BD9963DE1B35808C007"><enum>(I)</enum><text>section 416(b) of the Agricultural Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/7/1431">7 U.S.C. 1431(b)</external-xref>); and</text> </subclause>
<subclause id="H1866B3D787604B4A9F933F0656548F95"><enum>(II)</enum><text>the Food for Progress Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/7/1736o">7 U.S.C. 1736o</external-xref>);</text> </subclause></clause>
<clause id="H1FD242DF953B4706B7FB2E55001FAE6C"><enum>(iv)</enum><text>an assessment of the progress made through programs under this Act towards reducing food insecurity in the populations receiving food assistance from the United States;</text> </clause>
<clause id="H756081202AEA457AB243ACBB41A86672"><enum>(v)</enum><text>a description of efforts undertaken by the Food Aid Consultative Group under section 205 to achieve an integrated and effective food assistance program;</text> </clause>

<subclause id="H3A3033D345D9431681201642C0C597F0"><enum>(I)</enum><text>each program oversight, monitoring, and evaluation system implemented under section 207(f); and</text> </subclause>
<subclause id="HBBB3A8C672E84610A61ECFC5205F096B"><enum>(II)</enum><text>the impact of each program oversight, monitoring, and evaluation system on the effectiveness and efficiency of assistance provided under this title; and</text> </subclause></clause>
<clause id="H3CC15EAF5EA44D7FB2331B80491662E7"><enum>(vii)</enum><text>an assessment of the progress made by the Administrator in addressing issues relating to quality with respect to the provision of food assistance.</text> </clause></subparagraph></paragraph>
<paragraph id="HDFC0194C20F14FE58038B0FABEBAA30"><enum>(2)</enum><header>Annual report regarding the provision of agricultural commodities to foreign countries</header> 
<subparagraph id="H4DC3DB2AF55C49AA8E25EC002600CD08"><enum>(A)</enum><header>Annual report</header><text>Not later than February 1 of each fiscal year, the Administrator shall prepare and submit to the appropriate committees of Congress a report regarding the administration of food assistance programs under title II to benefit foreign countries during the prior fiscal year.</text> </subparagraph>
<subparagraph id="H726FCC6E5DCA487F995159A538FBD9A9"><enum>(B)</enum><header>Contents</header><text>An annual report described in subparagraph (A) shall include, with respect to the prior fiscal year—</text> 
<clause id="HB2D814EB8E044FA2B3CDAC6E806615BE"><enum>(i)</enum><text>a list that contains a description of each program, country, and commodity approved for assistance under section 207; and</text> </clause>
<clause id="H1BF2C823B5314141A493EB38452D367E"><enum>(ii)</enum><text>a statement that contains a description of the total amount of funds approved for transportation and administrative costs under section 207.</text> </clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>

<section commented="no" id="HA4D36E2A49294B11B9EABF097CAD3A5"><enum>3021.</enum><header>Minimum level of nonemergency food assistance</header><text display-inline="no-display-inline">Section 412 of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1736f">7 U.S.C. 1736f</external-xref>) is amended by adding at the end the following:</text>

<paragraph commented="no" id="H2E8D48CDB748416EBB1D133F0770894E"><enum>(1)</enum><header>Funds and commodities</header><text>Of the amounts made available to carry out emergency and nonemergency food assistance programs under title II, not less than $375,000,000 for fiscal year 2009, $400,000,000 for fiscal year 2010, $425,000,000 for fiscal year 2011, and $450,000,000 for fiscal year 2012 shall be expended for nonemergency food assistance programs under title II.</text> </paragraph>
<paragraph commented="no" id="HB28166AF479240478E6D11E4CE00AC69"><enum>(2)</enum><header>Exception</header><text>The President may use less than the amount specified in paragraph (1) in a fiscal year for nonemergency food assistance programs under title II only if—</text> 
<subparagraph commented="no" id="H3A6D5673FF48412F9FFED9B486713704"><enum>(A)</enum><text>the President has made a determination that there is an urgent need for additional emergency food assistance;</text> </subparagraph>
<subparagraph commented="no" id="H3C6D1123F68E4235A4B501A7D39600FA"><enum>(B)</enum><text>the funds and commodities held in the Bill Emerson Humanitarian Trust have been exhausted; and</text> </subparagraph>
<subparagraph commented="no" id="H3BDA21BC70284D25A7DD43578041369B"><enum>(C)</enum><text display-inline="yes-display-inline">the President has submitted to Congress a supplemental appropriations request for a sum equal to the amount needed to reach the required spending level for nonemergency food assistance under paragraph (1) and the amount exhausted under paragraph (2)(B).</text> </subparagraph></paragraph>
<paragraph commented="no" id="H385B31C1C8CC4D07B53200823C935FD7"><enum>(3)</enum><header>Notification to Congress</header><text>If the President makes the determination described in paragraph (2)(A), the President shall submit to Congress written notification that the determination has been made.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>

<paragraph id="HDA6759F43FA04E93BA53723C8F2B59FE"><enum>(2)</enum><header>Contents</header><text>A report required under paragraph (1) should include a description of each effort taken by the Administrator and the Secretary—</text> 
<subparagraph id="H098D477E535A4F67AAC2B14FB53400C9"><enum>(A)</enum><text>to improve the coordination of food purchases made by—</text> 
<clause id="H16BB07CEDE264315A500CFEB630065D2"><enum>(i)</enum><text>the United States Agency for International Development; and</text> </clause>

<subparagraph id="HC0C43FBE689B450B82C4B7D7C96BA4A3"><enum>(B)</enum><text>to increase flexibility with respect to procurement schedules;</text> </subparagraph>

<section id="HD7EF9C8163F04EFFA026935166B9025D"><enum>3023.</enum><header>Micronutrient fortification programs</header><text display-inline="no-display-inline">Section 415 of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1736g-2">7 U.S.C. 1736g–2</external-xref>) is amended—</text>

<subparagraph id="H5AAC56A14D1D43BDB0BBBC4584AC3622"><enum>(C)</enum><text>develop an approach to risk evaluation that facilitates accurate country risk designations and timely adjustments to the designations (on an ongoing basis) in response to material changes in country risk conditions, with ongoing opportunity for input and evaluation from the private sector;</text> </subparagraph>
<subparagraph id="H78ECF570DDB1469FA7D9EFF36DC2A603"><enum>(D)</enum><text>adjust risk-based guarantees as necessary to ensure program effectiveness and United States competitiveness; and</text> </subparagraph>
<subparagraph id="H2E0F05A9FF584EAA925D01E1B3DF601E"><enum>(E)</enum><text>work with industry to ensure, to the maximum extent practicable, that risk-based fees associated with the guarantees cover, but do not exceed, the operating costs and losses over the long term.</text> </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection>
<subsection id="H544D53460ED94EBA91C3B06137335844"><enum>(b)</enum><header>Funding levels</header><text>Section 211 of the Agricultural Trade Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/5641">7 U.S.C. 5641</external-xref>) is amended by striking subsection (b) and inserting the following:</text>

<subparagraph id="H431E11A641F34C2C895ECCBA70B4C8AF"><enum>(B)</enum><text>the amount of credit guarantees that the Commodity Credit Corporation can make available using unobligated budget authority for prior fiscal years.</text> </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>

<clause id="HF48C3F9E586C4F9A894E19E217487C32"><enum>(ii)</enum><header>Event or series of events</header><text>An event or series of events referred to in clause (i) includes 1 or more of—</text> 
<subclause id="HCA3E3D9049874C27904047B469ABEB1F"><enum>(I)</enum><text>a sudden calamity, such as an earthquake, flood, locust infestation, or similar unforeseen disaster;</text> </subclause>
<subclause id="HC212AA1A60D948FF87B2B165565F4DA6"><enum>(II)</enum><text>a human-made emergency resulting in—</text> 
<item id="H51FEE7322FE743DBACF3D0028B236E6"><enum>(aa)</enum><text>a significant influx of refugees;</text> </item>
<item id="H63705A1FBC78420A00AAE3049F65A061"><enum>(bb)</enum><text>the internal displacement of populations; or</text> </item>
<item id="HEB31CA83674F4A12AAF51B4C04DA1202"><enum>(cc)</enum><text>the suffering of otherwise affected populations;</text> </item></subclause>
<subclause id="H8943240E39E8404800B382321200664E"><enum>(III)</enum><text>food scarcity conditions caused by slow-onset events, such as drought, crop failure, pest infestation, and disease, that result in an erosion of the ability of communities and vulnerable populations to meet food needs; and</text> </subclause>
<subclause id="HAB3DC3E2381E45099000F4F8022C9066"><enum>(IV)</enum><text>severe food access or availability conditions resulting from sudden economic shocks, market failure, or economic collapse, that result in an erosion of the ability of communities and vulnerable populations to meet food needs.</text> </subclause></clause></subparagraph>
<subparagraph id="HBEE2A66DA2F74922814F5EBCDB40119D"><enum>(B)</enum><header>Releases</header> 
<clause id="H7B346A638CCF4CD29BF8BFAD766C96E8"><enum>(i)</enum><header>In general</header><text>Any funds or commodities held in the trust may be released to provide food, and cover any associated costs, under title II of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1721">7 U.S.C. 1721 et seq.</external-xref>)—</text> 
<subclause id="H24221432B35E4A44B64FF39CAE2463E0"><enum>(I)</enum><text>to assist in averting an emergency, including during the period immediately preceding the emergency;</text> </subclause>
<subclause id="HB42CA0DA135C4C9B886B89004EBA11D1"><enum>(II)</enum><text>to respond to an emergency; or</text> </subclause>
<subclause id="H1F8BFB22019B4E0296FC5516D08F4992"><enum>(III)</enum><text>for recovery and rehabilitation after an emergency.</text> </subclause></clause>
<clause id="HFA4BE4C085D8468C8BF100A773E635A6"><enum>(ii)</enum><header>Procedure</header><text>A release under clause (i) shall be carried out in the same manner, and pursuant to the same authority as provided in title II of that Act.</text> </clause></subparagraph>
<subparagraph id="HA30342549DC0457E8926BC4B615FCC9E"><enum>(C)</enum><header>Insufficiency of other funds</header><text>The funds and commodities held in the trust shall be made immediately available on a determination by the Administrator that funds available for emergency needs under title II of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1721">7 U.S.C. 1721 et seq.</external-xref>) for a fiscal year are insufficient to meet emergency needs during the fiscal year.</text> </subparagraph>
<subparagraph id="H2B71AD9916F34493A96BBDBE25077FD0"><enum>(D)</enum><header>Waiver relating to minimum tonnage requirements</header><text>Nothing in this paragraph requires a waiver by the Administrator of the Agency for International Development under section 204(a)(3) of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1724">7 U.S.C. 1724(a)(3)</external-xref>) as a condition for a release of funds or commodities under subparagraph (B).</text> </subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph>

<subparagraph id="HC830BFD6F3C6454089CEBBCBF6A27301"><enum>(B)</enum><header>Investment</header><text>The Secretary may invest funds held in the trust in any short-term obligation of the United States or any other low-risk short-term instrument or security insured by the Federal Government in which a regulated insurance company may invest under the laws of the District of Columbia.</text> </subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph>

<section id="H1BB455A65EC44F04A5DDEC5925D7D3D7"><enum>3202.</enum><header>Global Crop Diversity Trust</header> 
<subsection id="HE6A8087FF11049618C025F0083FFF88E"><enum>(a)</enum><header>Contribution</header><text>The Administrator of the United States Agency for International Development shall contribute funds to endow the Global Crop Diversity Trust (referred to in this section as the <term>Trust</term>) to assist in the conservation of genetic diversity in food crops through the collection and storage of the germplasm of food crops in a manner that provides for—</text> 
<paragraph id="H048DA9486F4E46AB837EA5DAED99DF76"><enum>(1)</enum><text>the maintenance and storage of seed collections;</text> </paragraph>
<paragraph id="HED517F82BC534D948707E98764143559"><enum>(2)</enum><text>the documentation and cataloguing of the genetics and characteristics of conserved seeds to ensure efficient reference for researchers, plant breeders, and the public;</text> </paragraph>
<paragraph id="HDDD9D8AE2FFA4165BCC597B4849F1466"><enum>(3)</enum><text>building the capacity of seed collection in developing countries;</text> </paragraph>
<paragraph id="H3840C57B0A1D4BF9B492B6D8ACCE888"><enum>(4)</enum><text>making information regarding crop genetic data publicly available for researchers, plant breeders, and the public (including through the provision of an accessible Internet website);</text> </paragraph>
<paragraph id="HD16ABDDCA1D74E8E9E25AC4FFD02D82B"><enum>(5)</enum><text>the operation and maintenance of a back-up facility in which are stored duplicate samples of seeds, in the case of natural or man-made disasters; and</text> </paragraph>
<paragraph id="H40BC7F7BDE7C486E87D2D9AA224F47B5"><enum>(6)</enum><text>oversight designed to ensure international coordination of those actions and efficient, public accessibility to that diversity through a cost-effective system.</text> </paragraph></subsection>
<subsection id="H1445F2EB48D64DBBB1E15E757930F258"><enum>(b)</enum><header>United States contribution limit</header><text>The aggregate contributions of funds of the Federal Government provided to the Trust shall not exceed 25 percent of the total amount of funds contributed to the Trust from all sources.</text> </subsection>
<subsection id="H1CD1774BB3354E46BD588FC6E584A1A1"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $60,000,000 for the period of fiscal years 2008 through 2012.</text> </subsection></section>
<section id="H0E28922819EC4D1085B4A724E81FEE3"><enum>3203.</enum><header>Technical assistance for specialty crops</header><text display-inline="no-display-inline">Section 3205 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/5680">7 U.S.C. 5680</external-xref>) is amended by striking subsection (d) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H4383376755B54745A7181CFE57ED61AC" style="OLC"> 
<subsection id="HA60439E4BDCF49ACAA22C5583F25F312"><enum>(d)</enum><header>Annual report</header><text>Not later than 180 days after the date of enactment of the Food, Conservation, and Energy Act of 2008 and annually thereafter, the Secretary shall submit to the appropriate committees of Congress a report that contains, for the period covered by the report, a description of each factor that affects the export of specialty crops, including each factor relating to any—</text> 
<paragraph id="H27BD4C2A74814967ACCCD2688392365E"><enum>(1)</enum><text>significant sanitary or phytosanitary issue; or</text> </paragraph>
<paragraph id="H2310D0FA6B1A49B70088E0D4872FC125"><enum>(2)</enum><text>trade barrier.</text> </paragraph></subsection>
<subsection id="HBF7011577C0748C2B27D6178E2AFEF28"><enum>(e)</enum><header>Funding</header> 
<paragraph id="H7C36F035A3DA404BB3CDED1229C7FAF7"><enum>(1)</enum><header>Commodity Credit Corporation</header><text>The Secretary shall use the funds, facilities, and authorities of the Commodity Credit Corporation to carry out this section.</text> </paragraph>
<paragraph id="HE8FD6AB04BF1462DBB51F4199B570041"><enum>(2)</enum><header>Funding Amounts</header><text>Of the funds of the Commodity Credit Corporation, the Secretary shall use to carry out this section—</text> 
<subparagraph id="HE7BA3CA64C9347610038ECA8E36C89F2"><enum>(A)</enum><text>$4,000,000 for fiscal year 2008;</text> </subparagraph>

<paragraph id="H48574A715F964CB8B32092F05E34F7D3"><enum>(4)</enum><header>Term of guarantee</header><text>A facility payment guarantee under this subsection shall be for a term that is not more than the lesser of—</text> 
<subparagraph id="H98275CB76A004CE0BBE0FDC584CE3CCF"><enum>(A)</enum><text>the term of the depreciation schedule of the facility assisted; or</text> </subparagraph>

<section commented="no" id="H71B64A8E5AF4494594F924CE3931387B"><enum>3205.</enum><header>Consultative Group to Eliminate the Use of Child Labor and Forced Labor in Imported Agricultural Products</header> 
<subsection commented="no" id="HF064E3ED5CA547A2AF044C17E3557EE8"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph commented="no" id="HE439DCADCC3041BE00B7930834DA09CC"><enum>(1)</enum><header>Child labor</header><text>The term <term>child labor</term> means the worst forms of child labor as defined in International Labor Convention 182, the Convention Concerning the Prohibition and Immediate Action for the Elimination of the Worst Forms of Child Labor, done at Geneva on June 17, 1999.</text> </paragraph>
<paragraph commented="no" id="HB3B183BF012449459EF3028EA3C7FD17"><enum>(2)</enum><header>Consultative Group</header><text>The term <term>Consultative Group</term> means the Consultative Group to Eliminate the Use of Child Labor and Forced Labor in Imported Agricultural Products established under subsection (b).</text> </paragraph>
<paragraph commented="no" id="HF33F2241EB0D40F184D73D2DBDC33995"><enum>(3)</enum><header>Forced labor</header><text>The term <term>forced labor</term> means all work or service—</text> 
<subparagraph commented="no" id="H6ED820AF2A854115B5B37B9D792694E6"><enum>(A)</enum><text>that is exacted from any individual under menace of any penalty for nonperformance of the work or service, and for which—</text> 
<clause commented="no" id="HD5B18A69FDE649A9A9655515EF17D46B"><enum>(i)</enum><text>the work or service is not offered voluntarily; or</text> </clause>
<clause commented="no" id="H87D7DB926AEE44A39C77B24058C3AA93"><enum>(ii)</enum><text>the work or service is performed as a result of coercion, debt bondage, or involuntary servitude (as those terms are defined in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>)); and</text> </clause></subparagraph>
<subparagraph commented="no" id="H7BA3E5136CBE4D108FA75D3F00ED04F7"><enum>(B)</enum><text>by 1 or more individuals who, at the time of performing the work or service, were being subjected to a severe form of trafficking in persons (as that term is defined in that section).</text> </subparagraph></paragraph></subsection>
<subsection commented="no" id="H6139220A898C4ABF9D443FC5A59386E1"><enum>(b)</enum><header>Establishment</header><text>There is established a group to be known as the <quote>Consultative Group to Eliminate the Use of Child Labor and Forced Labor in Imported Agricultural Products</quote> to develop recommendations relating to guidelines to reduce the likelihood that agricultural products or commodities imported into the United States are produced with the use of forced labor and child labor.</text> </subsection>
<subsection commented="no" id="HBDFAF17961774FF69240E535F31772B"><enum>(c)</enum><header>Duties</header> 
<paragraph commented="no" id="HD4CFB640128C44BD939DFE9CE5B4326C"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act and in accordance with section 105(d) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7103">22 U.S.C. 7103(d)</external-xref>), as applicable to the importation of agricultural products made with the use of child labor or forced labor, the Consultative Group shall develop, and submit to the Secretary, recommendations relating to a standard set of practices for independent, third-party monitoring and verification for the production, processing, and distribution of agricultural products or commodities to reduce the likelihood that agricultural products or commodities imported into the United States are produced with the use of forced labor or child labor.</text> </paragraph>
<paragraph commented="no" id="H76ECB9070D894A9E8F9F65452EAD1EE1"><enum>(2)</enum><header>Guidelines</header> 
<subparagraph commented="no" id="H5005E5EF243F48B7A345DDA962FA5F52"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date on which the Secretary receives recommendations under paragraph (1), the Secretary shall release guidelines for a voluntary initiative to enable entities to address issues raised by the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7101">22 U.S.C. 7101 et seq.</external-xref>).</text> </subparagraph>
<subparagraph commented="no" id="H7C1BD760566A4731B9A1D7F7883EEF56"><enum>(B)</enum><header>Requirements</header><text>Guidelines released under subparagraph (A) shall be published in the Federal Register and made available for public comment for a period of 90 days.</text> </subparagraph></paragraph></subsection>
<subsection commented="no" id="H8A46CFB1C4EE458196F4957356827D84"><enum>(d)</enum><header>Membership</header><text>The Consultative Group shall be composed of not more than 13 individuals, of whom—</text> 
<paragraph commented="no" id="HF4EE98DCEF1A49608C52AAB479001160"><enum>(1)</enum><text>2 members shall represent the Department of Agriculture, as determined by the Secretary;</text> </paragraph>
<paragraph commented="no" id="H45353FC9C62B4D5FA672B22D1400B8C7"><enum>(2)</enum><text>1 member shall be the Deputy Under Secretary for International Affairs of the Department of Labor;</text> </paragraph>
<paragraph commented="no" id="H632915A24A494D06944F06AB8D07BF1D"><enum>(3)</enum><text>1 member shall represent the Department of State, as determined by the Secretary of State;</text> </paragraph>
<paragraph commented="no" id="H4EEAD37CE42D43B5AE5D24DB6B91DB36"><enum>(4)</enum><text>3 members shall represent private agriculture-related enterprises, which may include retailers, food processors, importers, and producers, of whom at least 1 member shall be an importer, food processor, or retailer who utilizes independent, third-party supply chain monitoring for forced labor or child labor;</text> </paragraph>
<paragraph commented="no" id="H06113CD3335B4493A742DC039ED022B"><enum>(5)</enum><text>2 members shall represent institutions of higher education and research institutions, as determined appropriate by the Bureau of International Labor Affairs of the Department of Labor;</text> </paragraph>
<paragraph commented="no" id="H88C3803FA80749E597A09EB8DBA15465"><enum>(6)</enum><text>1 member shall represent an organization that provides independent, third-party certification services for labor standards for producers or importers of agricultural commodities or products; and</text> </paragraph>
<paragraph commented="no" id="HE13E04F1732247F5BF34F373C87FF245"><enum>(7)</enum><text>3 members shall represent organizations described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 that have expertise on the issues of international child labor and do not possess a conflict of interest associated with establishment of the guidelines issued under subsection (c)(2), as determined by the Bureau of International Labor Affairs of the Department of Labor, including representatives from consumer organizations and trade unions, if appropriate.</text> </paragraph></subsection>
<subsection commented="no" id="H7B96850DF3C7434A8E4E6B8D47156C03"><enum>(e)</enum><header>Chairperson</header><text>A representative of the Department of Agriculture appointed under subsection (d)(1), as determined by the Secretary, shall serve as the chairperson of the Consultative Group.</text> </subsection>
<subsection commented="no" id="H3056C3DA56B64FFEAE05F86CF76C4DA"><enum>(f)</enum><header>Requirements</header><text>Not less than 4 times per year, the Consultative Group shall meet at the call of the Chairperson, after reasonable notice to all members, to develop recommendations described in subsection (c)(1).</text> </subsection>
<subsection commented="no" id="H8E81A4DFBA784F35B756A9B5F291BBA1"><enum>(g)</enum><header>Nonapplicability of FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Consultative Group.</text> </subsection>
<subsection commented="no" id="H82BE0473C12347F48EE15B454DBB004E"><enum>(h)</enum><header>Annual reports</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter through December 31, 2012, the Secretary shall submit to the Committees on Agriculture and Foreign Affairs of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report describing the activities and recommendations of the Consultative Group.</text> </subsection>
<subsection commented="no" id="H6D68F09A5AC74D4F8EE3FBAA90ED61DB"><enum>(i)</enum><header>Termination of authority</header><text>The Consultative Group shall terminate on December 31, 2012.</text> </subsection></section>
<section id="HEC2FE5330B4E4A0E849768ECBD30DE29"><enum>3206.</enum><header>Local and regional food aid procurement projects</header> 
<subsection id="H421E2678524E478AABD45B4791CE7200"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H0B981D30A6704D98AFCA3D3F1209A336"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Agency for International Development.</text> </paragraph>
<paragraph id="HEE999B84A2D24BB5B7D866DBD273B83B"><enum>(2)</enum><header>Appropriate committee of Congress</header><text>The term <term>appropriate committee of Congress</term> means—</text> 
<subparagraph id="H5F41CBE077FE47468E495CAAD13F62BD"><enum>(A)</enum><text>the Committee on Agriculture, Nutrition, and Forestry of the Senate;</text> </subparagraph>
<subparagraph id="H234664F304AE4D48BA43D87D2C63735E"><enum>(B)</enum><text>the Committee on Agriculture of the House of Representatives; and</text> </subparagraph>
<subparagraph id="HE87A1B39F383445F8CAC228D97A2B8C6"><enum>(C)</enum><text>the Committee on Foreign Affairs of the House of Representatives.</text> </subparagraph></paragraph>
<paragraph id="H36B906495DE24BE4BE73E4EB2ABE46E"><enum>(3)</enum><header>Eligible commodity</header><text>The term <term>eligible commodity</term> means an agricultural commodity (or the product of an agricultural commodity) that—</text> 
<subparagraph id="H72C43A62B13A40F090F1CED480600852"><enum>(A)</enum><text>is produced in, and procured from, a developing country; and</text> </subparagraph>
<subparagraph id="H2F7194F990554C42918484FBAE2DB756"><enum>(B)</enum><text>at a minimum, meets each nutritional, quality, and labeling standard of the country that receives the agricultural commodity, as determined by the Secretary.</text> </subparagraph></paragraph>
<paragraph id="HFCC088CF1F8C4C13A5EBE6C13811EA27"><enum>(4)</enum><header>Eligible organization</header><text>The term <term>eligible organization</term> means an organization that is—</text> 
<subparagraph id="H96761A5E23654374B5650005AD493028"><enum>(A)</enum><text>described in section 202(d) of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1722">7 U.S.C. 1722(d)</external-xref>); and</text> </subparagraph>
<subparagraph id="H6E115ED297DE4C7CA613993B65CBD2A8"><enum>(B)</enum><text>with respect to nongovernmental organizations, subject to regulations promulgated or guidelines issued to carry out this section, including United States audit requirements that are applicable to nongovernmental organizations.</text> </subparagraph></paragraph></subsection>
<subsection id="H7B99E93F269D4EEFA8F9EC62832821B9"><enum>(b)</enum><header>Study; Field-based projects</header> 
<paragraph id="H7581378F895A4888BB00B58800F69775"><enum>(1)</enum><header>Study</header> 
<subparagraph id="H5E4141BDD2F34FA1A4C3239D593347B0"><enum>(A)</enum><header>In general</header><text>Not later than 30 days after the date of enactment of this Act, the Secretary shall initiate a study of prior local and regional procurements for food aid programs conducted by—</text> 
<clause id="H64A974C53EA54D4FB1E048BADE0FF7C"><enum>(i)</enum><text>other donor countries;</text> </clause>
<clause id="HEFA3F004DC4745F9AB69D121C5629E37"><enum>(ii)</enum><text>private voluntary organizations; and</text> </clause>
<clause id="H103CEED3C2DF419300ABB196B6DF1C68"><enum>(iii)</enum><text>the World Food Program of the United Nations.</text> </clause></subparagraph>
<subparagraph id="H3F05A249BB1F42079C99C7F3BDF173B2"><enum>(B)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall submit to the appropriate committees of Congress a report containing the results of the study conducted under subparagraph (A).</text> </subparagraph></paragraph>
<paragraph id="H167EA652A47A446EB28F8D3C79A8FE6"><enum>(2)</enum><header>Field-based projects</header> 
<subparagraph id="H3A654BE2EA6845F9ADA0C23BE446F73C"><enum>(A)</enum><header>In general</header><text>In accordance with subparagraph (B), the Secretary shall provide grants to, or enter into cooperative agreements with, eligible organizations to carry out field-based projects that consist of local or regional procurements of eligible commodities to respond to food crises and disasters in accordance with this section.</text> </subparagraph>
<subparagraph id="HA5BE8CFC835E4030AEA057D5AD71F455"><enum>(B)</enum><header>Consultation with Administrator</header><text>In carrying out the development and implementation of field-based projects under subparagraph (A), the Secretary shall consult with the Administrator.</text> </subparagraph></paragraph></subsection>
<subsection id="HA5A93A6DF28C4FF1A394C05BC77BD722"><enum>(c)</enum><header>Procurement</header> 
<paragraph id="H1E17AD8A167B4B0395BE7ECAE0D4ECE7"><enum>(1)</enum><header>In general</header><text>Any eligible commodity that is procured for a field-based project carried out under subsection (b)(2) shall be procured through any approach or methodology that the Secretary considers to be an effective approach or methodology to provide adequate information regarding the manner by which to expedite, to the maximum extent practicable, the provision of food aid to affected populations without significantly increasing commodity costs for low-income consumers who procure commodities sourced from the same markets at which the eligible commodity is procured.</text> </paragraph>
<paragraph id="HDDB486EEC9E24EA1B1B96D2D0071B4F9"><enum>(2)</enum><header>Requirements</header> 
<subparagraph id="HDFE1A5BD376745458ECE7DAEBE4B273F"><enum>(A)</enum><header>Impact on local farmers and countries</header><text>The Secretary shall ensure that the local or regional procurement of any eligible commodity under this section will not have a disruptive impact on farmers located in, or the economy of—</text> 
<clause id="HA1B32A80185E47C8AE1B5D3C11A7916E"><enum>(i)</enum><text>the recipient country of the eligible commodity; or</text> </clause>
<clause id="H83F467A46946418A99F7B003B3F00C7"><enum>(ii)</enum><text>any country in the region in which the eligible commodity may be procured.</text> </clause></subparagraph>
<subparagraph id="H10B4D16E108B4882B3A7AA2000AC3200"><enum>(B)</enum><header>Transshipment</header><text>The Secretary shall, in accordance with such terms and conditions as the Secretary considers to be appropriate, require from each eligible organization commitments designed to prevent or restrict—</text> 
<clause id="HC9DB8D192C0C437290615B9DA7F2D265"><enum>(i)</enum><text>the resale or transshipment of any eligible commodity procured under this section to any country other than the recipient country; and</text> </clause>
<clause id="H4AA36637AE074F31AC76802067C5AFFB"><enum>(ii)</enum><text>the use of the eligible commodity for any purpose other than food aid.</text> </clause></subparagraph>
<subparagraph id="HAB44491BD4ED4F83BD7B2E00E6DB7C6"><enum>(C)</enum><header>World prices</header> 
<clause id="HF2D9BABE0C084C9690102CFC31394BDC"><enum>(i)</enum><header>In general</header><text>In carrying out this section, the Secretary shall take any precaution that the Secretary considers to be reasonable to ensure that the procurement of eligible commodities will not unduly disrupt—</text> 
<subclause id="HFBAD79BE15BB43DEA95CB8A6E333F12B"><enum>(I)</enum><text>world prices for agricultural commodities; or</text> </subclause>
<subclause id="H64ED0662949A4D3E8DBCD5568183EE34"><enum>(II)</enum><text>normal patterns of commercial trade with foreign countries.</text> </subclause></clause>
<clause id="H5F8EAF11925F4DD2A7DA9D591A63141"><enum>(ii)</enum><header>Procurement price</header><text>The procurement of any eligible commodity shall be made at a reasonable market price with respect to the economy of the country in which the eligible commodity is procured, as determined by the Secretary.</text> </clause></subparagraph></paragraph></subsection>
<subsection id="H4D9729C8EED34783BBF024033DCF8BA9"><enum>(d)</enum><header>Regulations; guidelines</header> 
<paragraph id="HA5C3AC52919C42239B009FBCFBCB18CD"><enum>(1)</enum><header>In general</header><text>In accordance with paragraph (2), not later than 180 days after the date of completion of the study under subsection (b)(1), the Secretary shall promulgate regulations or issue guidelines to carry out field-based projects under this section.</text> </paragraph>
<paragraph id="HD985BC5DCDE8485DB7D7DA4262D538C"><enum>(2)</enum><header>Requirements</header> 
<subparagraph id="HF3B413463EED4F1394852043E806DE70"><enum>(A)</enum><header>Use of study</header><text>In promulgating regulations or issuing guidelines under paragraph (1), the Secretary shall take into consideration the results of the study described in subsection (b)(1).</text> </subparagraph>
<subparagraph id="H61427F7E9AAC4A8897D51E91A8DB7FC2"><enum>(B)</enum><header>Public review and comment</header><text>In promulgating regulations or issuing guidelines under paragraph (1), the Secretary shall provide an opportunity for public review and comment.</text> </subparagraph></paragraph>
<paragraph id="H4F81A410A45B4B0FAEE660784FC4CAF"><enum>(3)</enum><header>Availability</header><text>The Secretary shall not approve the procurement of any eligible commodity under this section until the date on which the Secretary promulgates regulations or issues guidelines under paragraph (1).</text> </paragraph></subsection>
<subsection id="HD9CD572385DD4F1D93CEF2E2785D0340"><enum>(e)</enum><header>Field-based project grants or cooperative agreements</header> 
<paragraph id="HFDB9AC58FDA24E52BC3ED2A48EF20093"><enum>(1)</enum><header>In general</header><text>The Secretary shall award grants to, or enter into cooperative agreements with, eligible organizations to carry out field-based projects.</text> </paragraph>
<paragraph id="HDC7A55AA448E4E4491E879FD64CA9F88"><enum>(2)</enum><header>Requirements of eligible organizations</header> 
<subparagraph id="H3D2D8D814EC24F86B9F7FAC60638CF94"><enum>(A)</enum><header>Application</header> 
<clause id="H9BEBCC5D591747EB00A68D36AA10CEAF"><enum>(i)</enum><header>In general</header><text>To be eligible to receive a grant from, or enter into a cooperative agreement with, the Secretary under this subsection, an eligible organization shall submit to the Secretary an application by such date, in such manner, and containing such information as the Secretary may require.</text> </clause>
<clause id="HCAA98335C8EB42998B46A14FF6D9C501"><enum>(ii)</enum><header>Other applicable requirements</header><text>Any other applicable requirement relating to the submission of proposals for consideration shall apply to the submission of an application required under clause (i), as determined by the Secretary.</text> </clause></subparagraph>
<subparagraph id="HA62B4317935D425CA15D3DD341C2FE00"><enum>(B)</enum><header>Completion requirement</header><text>To be eligible to receive a grant from, or enter into a cooperative agreement with, the Secretary under this subsection, an eligible organization shall agree—</text> 
<clause id="H5BDD048B013A49BFBFE53FEAA7DFA166"><enum>(i)</enum><text>to collect by September 30, 2011, data containing the information required under subsection (f)(1)(B) relating to the field-based project funded through the grant; and</text> </clause>
<clause id="HB2B09799621D4814AC26521E70BA8B68"><enum>(ii)</enum><text>to provide to the Secretary the data collected under clause (i).</text> </clause></subparagraph></paragraph>
<paragraph id="H8B31A8B534C647F1BB715E5D5075B66E"><enum>(3)</enum><header>Requirements of Secretary</header> 
<subparagraph id="H98466742E5C74B5694004C37415CC959"><enum>(A)</enum><header>Project diversity</header> 
<clause id="H76F6742EE9BA46C6919E067804812EB1"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii) and subparagraph (B), in selecting proposals for field-based projects to fund under this section, the Secretary shall select a diversity of projects, including projects located in—</text> 
<subclause id="HFAFCE4D1135245C897F1576B2789AC9E"><enum>(I)</enum><text>food surplus regions;</text> </subclause>
<subclause id="H92A3D656C042413100293096B0E4906E"><enum>(II)</enum><text>food deficit regions (that are carried out using regional procurement methods); and</text> </subclause>
<subclause id="HBDF43028A9C44985AE84D7E7D5280941"><enum>(III)</enum><text>multiple geographical regions.</text> </subclause></clause>
<clause id="H55BFE57ED5CE4ADCABF283C28D328BDA"><enum>(ii)</enum><header>Priority</header><text>In selecting proposals for field-based projects under clause (i), the Secretary shall ensure that the majority of selected proposals are for field-based projects that—</text> 
<subclause id="H3B483F218D5A4651BFDC8703FEA6E6BD"><enum>(I)</enum><text>are located in Africa; and</text> </subclause>
<subclause id="H0EBD41713EFC456186EDF392745FE7EC"><enum>(II)</enum><text>procure eligible commodities that are produced in Africa.</text> </subclause></clause></subparagraph>
<subparagraph id="HC3ADB1FABAFA42AEA83CA18B2F008CFC"><enum>(B)</enum><header>Development assistance</header><text>A portion of the funds provided under this subsection shall be made available for field-based projects that provide development assistance for a period of not less than 1 year.</text> </subparagraph></paragraph>
<paragraph id="HC16062F9177743FAB1EE5FF80029B7C0"><enum>(4)</enum><header>Availability</header><text>The Secretary shall not award a grant to any eligible organization under paragraph (1) until the date on which the Secretary promulgates regulations or issues guidelines under subsection (d)(1).</text> </paragraph></subsection>
<subsection id="HD447A77AE3C442BC9798002B5C58FBBD"><enum>(f)</enum><header>Independent evaluations; report</header> 
<paragraph id="H784DF90DFABC452388899FA2F254FA48"><enum>(1)</enum><header>Independent evaluations</header> 
<subparagraph id="H5E709024D3A54E97BEE94B53DFE7F78D"><enum>(A)</enum><header>In general</header><text>Not later than November 1, 2011, the Secretary shall ensure that an independent third party conducts an independent evaluation of all field-based projects that—</text> 
<clause id="H7639FBB87E1240CBAED68B819CE1A74F"><enum>(i)</enum><text>addresses each factor described in subparagraph (B); and</text> </clause>
<clause id="HA4600E90530648D99B49D4F0C9C9A383"><enum>(ii)</enum><text>is conducted in accordance with this section.</text> </clause></subparagraph>
<subparagraph id="HFD5D80A3FFA1441392B7BB5CE1008BB8"><enum>(B)</enum><header>Required factors</header><text>The Secretary shall require the independent third party to develop—</text> 
<clause id="HFA88E4A3B9C0439BA324C815EA6E6C00"><enum>(i)</enum><text>with respect to each relevant market in which an eligible commodity was procured under this section, a description of—</text> 
<subclause id="H61B3BCD648D34F80B49BF0453FEAAF40"><enum>(I)</enum><text>the prevailing and historic supply, demand, and price movements of the market (including the extent of competition for procurement bids);</text> </subclause>
<subclause id="H6021EDE906694C12001742E36C605574"><enum>(II)</enum><text>the impact of the procurement of the eligible commodity on producer and consumer prices in the market;</text> </subclause>
<subclause id="H4F2C784824D745318EF8CB5B9D2900E6"><enum>(III)</enum><text>each government market interference or other activity of the donor country that might have significantly affected the supply or demand of the eligible commodity in the area at which the local or regional procurement occurred;</text> </subclause>
<subclause id="HD59CF9DCD5BE4A66A96DC800C60050BF"><enum>(IV)</enum><text>the quantities and types of eligible commodities procured in the market;</text> </subclause>
<subclause id="HE2DE3420C9ED48E596A326496B66D934"><enum>(V)</enum><text>the time frame for procurement of each eligible commodity; and</text> </subclause>
<subclause id="H2A97E8F7EF5F4FCC80669BDE8C942FB"><enum>(VI)</enum><text>the total cost of the procurement of each eligible commodity (including storage, handling, transportation, and administrative costs);</text> </subclause></clause>
<clause id="H388AF98194354060A1F1A917E8E2A683"><enum>(ii)</enum><text>an assessment regarding—</text> 
<subclause id="HC4FDFB34DE06448FAFB548EBE7A795F"><enum>(I)</enum><text>whether the requirements of this section have been met;</text> </subclause>
<subclause id="HE3B2FB4950F2470DB58B3634BED81772"><enum>(II)</enum><text>the impact of different methodologies and approaches on—</text> 
<item id="HDD74E2840F26441F949E9B4F330045F2"><enum>(aa)</enum><text>local and regional agricultural producers (including large and small agricultural producers);</text> </item>
<item id="H0E2A0658C9584B218E2ED00EE5229BA"><enum>(bb)</enum><text>markets;</text> </item>
<item id="HC412ECE387514263AF5629DAF9F4933F"><enum>(cc)</enum><text>low-income consumers; and</text> </item>
<item id="H9FF3E0D7EAAF4D0E839000FE019C01D4"><enum>(dd)</enum><text>program recipients; and</text> </item></subclause>
<subclause id="H156D39D4A4BB46A2864047E2A1636E02"><enum>(III)</enum><text>the length of the period beginning on the date on which the Secretary initiated the procurement process and ending on the date of delivery of eligible commodities;</text> </subclause></clause>
<clause id="H0945ACD580254899BC059E65A494DC47"><enum>(iii)</enum><text>a comparison of different methodologies used to carry out this section, with respect to—</text> 
<subclause id="HA8D926A7301541ED8C829900233D3185"><enum>(I)</enum><text>the benefits to local agriculture;</text> </subclause>
<subclause id="HD83D614480C04E8882E798AD181E9E2"><enum>(II)</enum><text>the impact on markets and consumers;</text> </subclause>
<subclause id="H695F8FFF20E04B82BB6005A91C9C1000"><enum>(III)</enum><text>the period of time required for procurement and delivery;</text> </subclause>
<subclause id="H67AEA3B40B5C4BF290279763FBB57EC7"><enum>(IV)</enum><text>quality and safety assurances; and</text> </subclause>
<subclause id="H3ABCED06B6F04A39888675F05D5610D4"><enum>(V)</enum><text>implementation costs; and</text> </subclause></clause>
<clause id="HBEBEA78797DE4F07B79DF439A62E4C5D"><enum>(iv)</enum><text>to the extent adequate information is available (including the results of the report required under subsection (b)(1)(B)), a comparison of the different methodologies used by other donor countries to make local and regional procurements.</text> </clause></subparagraph>
<subparagraph id="H5819C1E91AA842748B108D041C83B00"><enum>(C)</enum><header>Independent third party access to records and reports</header><text>The Secretary shall provide to the independent third party access to each record and report that the independent third party determines to be necessary to complete the independent evaluation.</text> </subparagraph>
<subparagraph id="HC73BD0268EE14E00A1DE8F9FCB0375E7"><enum>(D)</enum><header>Public access to records and reports</header><text>Not later than 180 days after the date described in paragraph (2), the Secretary shall provide public access to each record and report described in subparagraph (C).</text> </subparagraph></paragraph>
<paragraph id="HE57C7667D6894B999D81D82EBDD51C94"><enum>(2)</enum><header>Report</header><text>Not later than 4 years after the date of enactment of this Act, the Secretary shall submit to the appropriate committees of Congress a report that contains the analysis and findings of the independent evaluation conducted under paragraph (1)(A).</text> </paragraph></subsection>
<subsection id="HE75CCBC8F9A343A3B3825381337413CC"><enum>(g)</enum><header>Funding</header> 
<paragraph id="HAD3CB0A937F946009D8684A1DFECE06F"><enum>(1)</enum><header>Commodity Credit Corporation</header><text>The Secretary shall use the funds, facilities, and authorities of the Commodity Credit Corporation to carry out this section.</text> </paragraph>
<paragraph id="HAEACBA33EC9E4F1F9123007EAA49FAF5"><enum>(2)</enum><header>Funding Amounts</header><text>Of the funds of the Commodity Credit Corporation, the Secretary shall use to carry out this section—</text>

<paragraph commented="no" id="H09E426F37C904CF7AA2D1500FD4921B3"><enum>(4)</enum><header>Export charges</header><text>The term <term>export charges</term> means any tax, charge, or other fee collected by the country from which softwood lumber or a softwood lumber product, described in section 804(a), is exported pursuant to an international agreement entered into by that country and the United States.</text> </paragraph>

<subparagraph commented="no" id="H1283EF0D77C143A0B108CF12E87E81BE"><enum>(A)</enum><header>In general</header><text>The term <term>export price</term> means one of the following:</text> 
<clause commented="no" id="H2E87B5EE25DA464AA6AB108930DF3598"><enum>(i)</enum><text>In the case of softwood lumber or a softwood lumber product that has undergone only primary processing, the value that would be determined F.O.B. at the facility where the product underwent the last primary processing before export.</text> </clause>
<clause commented="no" id="HCC6BDDB2709A4565BD6FFA5DCDB1FF1D"><enum>(ii)</enum>
<subclause commented="no" display-inline="yes-display-inline" id="HCEC047174C914D3C88E58C45B4014121"><enum>(I)</enum><text>In the case of softwood lumber or a softwood lumber product described in subclause (II), the value that would be determined F.O.B. at the facility where the lumber or product underwent the last primary processing.</text> </subclause>
<subclause commented="no" id="H95BB8EC2A03844F99ED2E0C96BA751B" indent="up1"><enum>(II)</enum><text>Softwood lumber or a softwood lumber product described in this subclause is lumber or a product that underwent the last remanufacturing before export by a manufacturer who—</text> 
<item commented="no" id="H51E3C8C4C097499BB8D008212BA84605"><enum>(aa)</enum><text>does not hold tenure rights provided by the country of export;</text> </item>
<item commented="no" id="H32350B459BD0491100D9EE281FE9F7C6"><enum>(bb)</enum><text>did not acquire standing timber directly from the country of export; and</text> </item>
<item commented="no" id="HBC02F56035914883879DC83CA6721108"><enum>(cc)</enum><text>is not related to the person who holds tenure rights or acquired standing timber directly from the country of export.</text> </item></subclause></clause>
<clause commented="no" id="HEE8351645E5342B6B4B0072B77EF1B"><enum>(iii)</enum>
<subclause commented="no" display-inline="yes-display-inline" id="H8C883D9A3CE7448A9600055BC9A92C28"><enum>(I)</enum><text>In the case of softwood lumber or a softwood lumber product described in subclause (II), the value that would be determined F.O.B. at the facility where the product underwent the last processing before export.</text> </subclause>
<subclause commented="no" id="HDE5C03E5F21E46BCB1A1CEED5F4D4CB" indent="up1"><enum>(II)</enum><text>Softwood lumber or a softwood lumber product described in this subclause is lumber or a product that undergoes the last remanufacturing before export by a manufacturer who—</text> 
<item commented="no" id="HD3E22D1614244BD58448A9D411951E17"><enum>(aa)</enum><text>holds tenure rights provided by the country of export;</text> </item>
<item commented="no" id="H43602CE867554F799F7D00B5843D43EA"><enum>(bb)</enum><text>acquired standing timber directly from the country of export; or</text> </item>
<item commented="no" id="HEF22CB40604343A0A46549B03E274B79"><enum>(cc)</enum><text>is related to a person who holds tenure rights or acquired standing timber directly from the country of export.</text> </item></subclause></clause></subparagraph>
<subparagraph commented="no" id="HA0291AB7071C4F1C9300A4714801FFCD"><enum>(B)</enum><header>Related persons</header><text>For purposes of this paragraph, a person is related to another person if—</text> 
<clause commented="no" id="H337D49CBE6B14D95A8E25861A706C68"><enum>(i)</enum><text>the person bears a relationship to such other person described in <external-xref legal-doc="usc" parsable-cite="usc/26/152">section 152(a)</external-xref> of the Internal Revenue Code of 1986;</text> </clause>
<clause commented="no" id="H5BFB098321B442DEB2A5287BDF03DCAC"><enum>(ii)</enum><text>the person bears a relationship to such other person described in section 267(b) of such Code, except that <quote>5 percent</quote> shall be substituted for <quote>50 percent</quote> each place it appears;</text> </clause>
<clause commented="no" id="H454C247E02D84E899231278E1F0204C6"><enum>(iii)</enum><text>the person and such other person are part of a controlled group of corporations, as that term is defined in section 1563(a) of such Code, except that <quote>5 percent</quote> shall be substituted for <quote>80 percent</quote> each place it appears;</text> </clause>
<clause commented="no" id="H13F4433A9C50475AAC387056AAA2BE2"><enum>(iv)</enum><text>the person is an officer or director of such other person; or</text> </clause>
<clause commented="no" id="HACF55358A9DC442396D7CB420EC54E6"><enum>(v)</enum><text>the person is the employer of such other person.</text> </clause></subparagraph>
<subparagraph commented="no" id="HED569C3A6DA94B0C999963916E4C8E15"><enum>(C)</enum><header>Tenure rights</header><text>For purposes of this paragraph, the term <term>tenure rights</term> means rights to harvest timber from public land granted by the country of export.</text> </subparagraph>
<subparagraph commented="no" id="H5BB5F9CD4F03422E84C780F665B811E"><enum>(D)</enum><header>Export price where F.O.B. value cannot be determined</header> 
<clause commented="no" id="HF5647F5FE25549AFA457B8314E4F30A2"><enum>(i)</enum><header>In general</header><text>In the case of softwood lumber or a softwood lumber product described in clause (i), (ii), or (iii) <italic></italic>of subparagraph (A)<italic></italic> for which an F.O.B. value cannot be determined, the export price shall be the<italic></italic> market price for the identical lumber or product sold in an arm’s-length transaction in the country of export at approximately the same time as the exported lumber or product. The market price shall be determined in the following order of preference:</text> 
<subclause commented="no" id="H13FCCF2BC7C3481AA36FD6D405E2DDF9"><enum>(I)</enum><text>The market price for the lumber or a product sold at substantially the same level of trade as the exported lumber or product but in different quantities.</text> </subclause>
<subclause commented="no" id="H0D23A46E03934181B8B27DABD959CC9D"><enum>(II)</enum><text>The market price for the lumber or a product sold at a different level of trade than the exported lumber or product but in similar quantities.</text> </subclause>
<subclause commented="no" id="H24E81251C07244A996373C81C84C4484"><enum>(III)</enum><text>The market price for the lumber or a product sold at a different level of trade than the exported lumber or product and in different quantities.</text> </subclause></clause>
<clause commented="no" id="H676100A32EF74554A44B1200AF21D922"><enum>(ii)</enum><header>Level of trade</header><text>For purposes of clause (i), <term>level of trade</term> shall be determined in the same manner as provided under <external-xref legal-doc="regulation" parsable-cite="cfr/19/351.412">section 351.412(c)</external-xref> of title 19, Code of Federal Regulations (as in effect on January 1, 2008).</text> </clause></subparagraph></paragraph>
<paragraph commented="no" id="H7F57ECF39245478FAFC4F302E7CCD823"><enum>(6)</enum><header>F.O.B</header><text>The term <term>F.O.B.</term> means a value consisting of all charges payable by a purchaser, including those charges incurred in the placement of merchandise on board of a conveyance for shipment, but does not include the actual shipping charges or any applicable export charges.</text> </paragraph>
<paragraph commented="no" id="H37FB99A9582C402689D26D6EECD7181"><enum>(7)</enum><header>HTS</header><text>The term <term>HTS</term> means the Harmonized Tariff Schedule of the United States (<external-xref legal-doc="usc" parsable-cite="usc/19/1202">19 U.S.C. 1202</external-xref>) (as in effect on January 1, 2008).</text> </paragraph>
<paragraph commented="no" id="H1429CBF7321A4940B011E565005C5422"><enum>(8)</enum><header>Person</header><text>The term <term>person</term> includes any individual, partnership, corporation, association, organization, business trust, government entity, or other entity subject to the jurisdiction of the United States.</text> </paragraph>
<paragraph commented="no" id="H422F775823544DF69518B8C95527AC24"><enum>(9)</enum><header>United States</header><text>The term <term>United States</term> means the customs territory of the United States, as defined in General Note 2 of the HTS.</text> </paragraph></section>
<section commented="no" id="H26A182F68BB54DA399BDD9E06553ECC0"><enum>803.</enum><header>Establishment of softwood lumber importer declaration program</header> 
<subsection commented="no" id="H5140B47FA0374057B400FC71805BBFC0"><enum>(a)</enum><header>Establishment of program</header> 
<paragraph commented="no" id="HA88E0425AAE94E80A3BFFE6F96A07F82"><enum>(1)</enum><header>In general</header><text>The President shall establish and maintain an importer declaration program with respect to the importation of <italic></italic>softwood lumber and softwood lumber products described in section 804(a). The importer declaration program shall require importers of softwood lumber and softwood lumber products described in section 804(a) to provide the information required under subsection (b) and declare the information required by subsection (c), and require that such information accompany the entry summary documentation.</text> </paragraph>
<paragraph commented="no" id="H0D039ADFC42A4D04A72B17C15E650153"><enum>(2)</enum><header>Electronic record</header><text>The President shall establish an electronic record that<italic></italic> includes the importer information required under subsection (b) and the declarations required under subsection (c).</text> </paragraph></subsection>
<subsection commented="no" id="H646B240A445A4BBBAB5BE091F260D391"><enum>(b)</enum><header>Required information</header><text>The President shall require the following information to be submitted by any person seeking to import softwood lumber or softwood lumber products described in section 804(a):</text> 
<paragraph commented="no" id="H48200291A52E4CA0B13706B441BBF627"><enum>(1)</enum><text>The export price for each shipment of softwood lumber or softwood lumber products.</text> </paragraph>
<paragraph commented="no" id="HD4C79EABE5BF4FC28127E0BCE627F538"><enum>(2)</enum><text>The estimated export charge, if any, applicable to each shipment of softwood lumber or softwood lumber products as calculated by applying the percentage determined and published by the Under Secretary for International Trade of the Department of Commerce pursuant to section 805 to the export price provided in subsection (b)(1).</text> </paragraph></subsection>
<subsection commented="no" id="HBDB8B32E0B75401E8F15689EDF2F76CA"><enum>(c)</enum><header>Importer declarations</header><text>Pursuant to procedures prescribed by the President, any person seeking to import softwood lumber or softwood lumber products described in section 804(a) shall declare that—</text> 
<paragraph commented="no" id="H9CF9708925424C3EA7664D2F3053023F"><enum>(1)</enum><text>the person has made appropriate inquiry, including seeking appropriate documentation from the exporter and consulting the determinations published by the Under Secretary for International Trade of the Department of Commerce pursuant to section 805(b); and</text> </paragraph>
<paragraph commented="no" id="HE3F32E9ED4AA4C5A9F81D1C7013B8DD"><enum>(2)</enum><text>to the best of the person’s knowledge and belief—</text> 
<subparagraph commented="no" id="HAE6662495F554F9D961E68BA35A2C879"><enum>(A)</enum><text>the export price provided pursuant to subsection (b)(1) is determined in accordance with the definition provided in section 802(5);</text> </subparagraph>
<subparagraph commented="no" id="H0556433BC4F34AD89BB1E7F24E2CC347"><enum>(B)</enum><text>the export price provided pursuant to subsection (b)(1) is consistent with the export price provided on the export permit, if any, granted by the country of export; and</text> </subparagraph>
<subparagraph commented="no" id="H0BE12BEF47B14AC19C5FBBBF0B7DC6B"><enum>(C)</enum><text>the exporter has paid, or committed to pay, all export charges due—</text> 
<clause commented="no" id="H43A4AB97E01B4E999D03C8C73B423886"><enum>(i)</enum><text>in accordance with the volume, export price, and export charge rate or rates, if any, as calculated under an international agreement entered into by the country of export and the United States; and</text> </clause>
<clause commented="no" id="H46125444227E4A5899AC2382E3728768"><enum>(ii)</enum><text>consistent with the export charge determinations published by the Under Secretary for International Trade pursuant to section 805(b).</text> </clause></subparagraph></paragraph></subsection></section>
<section commented="no" id="H8D2B8208226446D89FB8DC32C200B7A1"><enum>804.</enum><header>Scope of softwood lumber importer declaration program</header> 
<subsection commented="no" id="HEEA83469BD614B5DA000DD727CC6A668"><enum>(a)</enum><header>Products included in program</header><text>The following products shall be subject to the importer declaration program established under section 803:</text> 
<paragraph commented="no" id="HBCE914B2D15F49F7BDF01C70E541726B"><enum>(1)</enum><header>In general</header><text>All softwood lumber and softwood lumber products classified under subheading 4407.10.00, 4409.10.10, 4409.10.20, or 4409.10.90 of the HTS, including the following softwood lumber, flooring, and siding:</text> 
<subparagraph commented="no" id="HCD4AB507B6AA4626BFBEA6B5C9BC6C4"><enum>(A)</enum><text>Coniferous wood, sawn or chipped lengthwise, sliced or peeled, whether or not planed, sanded, or finger-jointed, of a thickness exceeding 6 millimeters.</text> </subparagraph>
<subparagraph commented="no" id="H037EB151AF044AF0856812B29775F1B9"><enum>(B)</enum><text>Coniferous wood siding (including strips and friezes for parquet flooring, not assembled) continuously shaped (tongued, grooved, rabbeted, chamfered, v-jointed, beaded, molded, rounded, or the like) along any of its edges or faces, whether or not planed, sanded, or finger-jointed.</text> </subparagraph>
<subparagraph commented="no" id="H75D91A84371C4161AA95000059F5E30"><enum>(C)</enum><text>Other coniferous wood (including strips and friezes for parquet flooring, not assembled) continuously shaped (tongued, grooved, rabbeted, chamfered, v-jointed, beaded, molded, rounded, or the like) along any of its edges or faces (other than wood moldings and wood dowel rods) whether or not planed, sanded, or finger-jointed.</text> </subparagraph>
<subparagraph commented="no" id="H896302A9668B49028F5700A09F0064CF"><enum>(D)</enum><text>Coniferous wood flooring (including strips and friezes for parquet flooring, not assembled) continuously shaped (tongued, grooved, rabbeted, chamfered, v-jointed, beaded, molded, rounded, or the like) along any of its edges or faces, whether or not planed, sanded, or finger-jointed.</text> </subparagraph>
<subparagraph commented="no" id="HB300A52DAD9E43139439D524FC783334"><enum>(E)</enum><text>Coniferous drilled and notched lumber and angle cut lumber.</text> </subparagraph></paragraph>
<paragraph commented="no" id="H50B0C9817DEA47EA81F7B72C1DEF27BF"><enum>(2)</enum><header>Products continually shaped</header><text>Any product classified under subheading 4409.10.05 of the HTS that is continually shaped along its end or side edges.</text> </paragraph>
<paragraph commented="no" id="HEBAF5F99043341238EBCFCE9842FC4A8"><enum>(3)</enum><header>Other lumber products</header><text>Except as otherwise provided in subsection (b) or (c),<italic></italic> softwood lumber products that are<italic></italic> stringers, radius-cut box-spring frame components, fence pickets, truss components, pallet components, and door and window frame parts classified<italic></italic> under subheading 4418.90.46.95, 4421.90.70.40, or 4421.90.97.40 of the HTS.</text> </paragraph></subsection>
<subsection commented="no" id="HEAFC810AD0A94085AC17E2EB9C07A3D"><enum>(b)</enum><header>Products excluded from program</header><text>The following products shall be excluded from the importer declaration program established under<italic></italic> section 803:</text> 
<paragraph commented="no" id="HC19C6FC4803641A8891716B8EDF1CF"><enum>(1)</enum><text>Trusses and truss kits, properly classified under subheading 4418.90 of the HTS.</text> </paragraph>
<paragraph commented="no" id="HA21171634E1D4728B9F95EED116516DF"><enum>(2)</enum><text>I-joist beams.</text> </paragraph>
<paragraph commented="no" id="H359A7A207FB340768646DE2B005E4214"><enum>(3)</enum><text>Assembled box-spring frames.</text> </paragraph>
<paragraph commented="no" id="H5EFD0EDD479C4B3E9071B2EF98887A4"><enum>(4)</enum><text>Pallets and pallet kits, properly classified under subheading 4415.20 of HTS.</text> </paragraph>
<paragraph commented="no" id="H5DB0A3781C2C4E89A7B0DD49895C0E5"><enum>(5)</enum><text>Garage doors.</text> </paragraph>
<paragraph commented="no" id="H24C8E01471F54539AAB0D6E100A1B028"><enum>(6)</enum><text>Edge-glued wood, properly classified under subheading 4421.90.97.40 of the HTS.</text> </paragraph>
<paragraph commented="no" id="H0686A011C269498794690949127CD3E9"><enum>(7)</enum><text>Complete door frames.</text> </paragraph>
<paragraph commented="no" id="HF8CEF3F83B094A40BFC16E953D650032"><enum>(8)</enum><text>Complete window frames.</text> </paragraph>
<paragraph commented="no" id="H41F0E241652E43CB002920F317D5EA4"><enum>(9)</enum><text>Furniture.</text> </paragraph>
<paragraph commented="no" id="H841FF863412344FF936B87D26E94A703"><enum>(10)</enum><text>Articles brought into the United States temporarily and for which an exemption from duty is claimed under subchapter XIII of chapter 98 of the HTS.</text> </paragraph>
<paragraph commented="no" id="H63039630CB3344B5BD3F34A41D07B26E"><enum>(11)</enum><text>Household and personal effects.</text> </paragraph></subsection>
<subsection commented="no" id="H760978DB531E44ED960894AB48DF975F"><enum>(c)</enum><header>Exceptions for certain products</header><text>The following softwood lumber<italic></italic> products shall not be subject to the <italic></italic>importer declaration program established under <italic></italic>section 803:</text> 
<paragraph commented="no" id="H92567C0E483547CC9081992D8ED15605"><enum>(1)</enum><header>Stringers</header><text>Stringers (pallet components used for runners), if the stringers—</text> 
<subparagraph commented="no" id="HA1BFCBE41B0D465FA0788EFEBE12A1"><enum>(A)</enum><text>have at least 2 notches on the side, positioned at equal distance from the center, to properly accommodate forklift blades; and<italic></italic></text> </subparagraph>
<subparagraph commented="no" id="H9AFC04E95DFC40FBB68DE7C8B5001705"><enum>(B)</enum><text>are<italic></italic> properly classified under subheading 4421.90.97.40 of the HTS.</text> </subparagraph></paragraph>
<paragraph commented="no" id="HDD42B2840EB54C4CB3AE51008746009E"><enum>(2)</enum><header>Box-spring frame kits</header> 
<subparagraph commented="no" id="H4794BE8084C84005A74CF53E739D04A3"><enum>(A)</enum><header>In general</header><text>Box-spring frame kits, if—</text> 
<clause commented="no" id="HF46E19A9B2BA4CEBB5AC901873784C5D"><enum>(i)</enum><text>the kits contain—</text> 
<subclause commented="no" id="H836F9B0B7DCC42808CD5B4517A5AD75"><enum>(I)</enum><text>2 wooden side rails;</text> </subclause>
<subclause commented="no" id="H302D07DD79394457B1C415135581136"><enum>(II)</enum><text>2 wooden end (or top) rails; and</text> </subclause>
<subclause commented="no" id="H975C4DC0A3734C12B41D994DA0F0237F"><enum>(III)</enum><text>varying numbers of wooden slats; and</text> </subclause></clause>
<clause commented="no" id="H19D9DC4B2E0049A5A12422C9677191FC"><enum>(ii)</enum><text>the side rails and the end rails are radius-cut at both ends.</text> </clause></subparagraph>
<subparagraph commented="no" id="H919429FC36204142B0ABA76F98E3F5AA"><enum>(B)</enum><header>Packaging</header><text>Any kit described in subparagraph (A) shall be<italic></italic> individually packaged, and contain the exact number of wooden components needed to make the box-spring frame described on the entry documents, with no further processing required. None of the components contained in the package may <italic></italic>exceed 1 inch in actual thickness or 83 inches in length.</text> </subparagraph></paragraph>
<paragraph commented="no" id="H25D1FA016E8C4A3AB6580666605C00F5"><enum>(3)</enum><header>Radius-cut box-spring frame components</header><text>Radius-cut box-spring frame components, not exceeding 1 inch in actual thickness or 83 inches in length, ready for assembly without further processing, if radius cuts are present on both ends of the boards and are substantial cuts so as to completely round 1 corner.</text> </paragraph>
<paragraph commented="no" id="H3986D456274B431C84A8D0ED1E43B05"><enum>(4)</enum><header>Fence pickets</header><text>Fence pickets requiring no further processing and properly classified under subheading 4421.90.70 of the HTS, 1 inch or less in actual thickness, up to 8 inches wide, and 6 feet or less in length, and having finials or decorative cuttings that clearly identify them as fence pickets. In the case of dog-eared fence pickets, the corners of the boards shall be cut off so as to remove pieces of wood in the shape of isosceles right angle triangles with sides measuring <fraction>3/4</fraction> of an inch or more.</text> </paragraph>
<paragraph commented="no" id="HB883E991D6344200A1691D3381B8FDB1"><enum>(5)</enum><header>United States-origin lumber</header><text>Lumber originating in the United States that is exported to another country for minor processing and imported into the United States if—</text> 
<subparagraph commented="no" id="HD4DC7E62882C4869AE885D6D5CDEF0FE"><enum>(A)</enum><text>the processing occurring in another country is limited to kiln drying, planing to create smooth-to-size board, and sanding; and</text> </subparagraph>
<subparagraph commented="no" id="H6F7E830298F342B9BFBDE34508690055"><enum>(B)</enum><text>the importer establishes to the satisfaction of U.S. Customs and Border Protection upon entry that the lumber originated in the United States.</text> </subparagraph></paragraph>
<paragraph commented="no" id="H0CD850CFB25B4A20AAC3DEBEB3E8F4B"><enum>(6)</enum><header>Softwood lumber</header><text>Any softwood lumber or softwood lumber product that originated in the United States, if the importer, exporter, foreign processor, or original United States producer establishes to the satisfaction of U.S. Customs and Border Protection upon entry that the softwood lumber entered and documented as originating in the United States was first produced in the United States.</text> </paragraph>
<paragraph commented="no" id="H2417CF9204114D0696D4FA4BF7B2F9ED"><enum>(7)</enum><header>Home packages or kits</header> 
<subparagraph commented="no" id="H8E809C7EB2EC44448CA0C6A65400DC6F"><enum>(A)</enum><header>In general</header><text>Softwood lumber or softwood lumber products contained in a single family home package or kit, regardless of the classification under the HTS, if the importer declares that the following requirements have been met:</text> 
<clause commented="no" id="H5C58D7C4C1C4423297B00500F4D1B6A1"><enum>(i)</enum><text>The package or kit constitutes a full package of the number of wooden pieces specified in the plan, design, or blueprint necessary to produce a home of at least 700 square feet produced to a specified plan, design, or blueprint.</text> </clause>
<clause commented="no" id="HDD69FAE709E0494EAA5BCD8FFF318B"><enum>(ii)</enum><text>The package or kit contains—</text> 
<subclause commented="no" id="H8A9DE1F1E7904AD6B765F132D600B51C"><enum>(I)</enum><text>all necessary internal and external doors and windows, nails, screws, glue, subfloor, sheathing, beams, posts, and connectors; and</text> </subclause>
<subclause commented="no" id="H123C0249A9944E6890DBD4C76E467DC2"><enum>(II)</enum><text>if included in the purchase contract, the decking, trim, drywall, and roof shingles specified in the plan, design, or blueprint.</text> </subclause></clause>
<clause commented="no" id="H376CC1D55B7A4122ACF908E8135EF34"><enum>(iii)</enum><text>Prior to importation, the package or kit is sold to a United States retailer that sells complete home packages or kits pursuant to a valid purchase contract referencing the particular home design, plan, or blueprint, and the contract is signed by a customer not affiliated with the importer.</text> </clause>
<clause commented="no" id="HDCFD5B46E9E24BC291C351C5C44C25F"><enum>(iv)</enum><text>Softwood lumber products entered as part of the package or kit, whether in a single entry or multiple entries on multiple days, are to be used solely for the construction of the single family home specified by the home design, plan, or blueprint matching the U.S. Customs and Border Protection import entry.</text> </clause></subparagraph>
<subparagraph commented="no" id="H194AE53D08814525A16DCC0095ED7430"><enum>(B)</enum><header>Additional documentation required for home packages and kits</header><text>In the case of each entry of products described in clauses (i) through (iv) of subparagraph (A) the following documentation shall be retained by the importer and made available to U.S. Customs and Border Protection upon request:</text> 
<clause commented="no" id="H2A9BDA31494F4D5E84A2A6A665F9E5A5"><enum>(i)</enum><text>A copy of the appropriate home design, plan, or blueprint matching the customs entry in the United States.</text> </clause>
<clause commented="no" id="H3AAF3DC21BEF447DBD3C3DD84EA95779"><enum>(ii)</enum><text>A purchase contract from a retailer of home kits or packages signed by a customer not affiliated with the importer.</text> </clause>
<clause commented="no" id="H441724A2008D43B1A2057FE2A2CBCA9"><enum>(iii)</enum><text>A listing of all parts in the package or kit being entered into the United States that conforms to the home design, plan, or blueprint for which such parts are being imported.</text> </clause>
<clause commented="no" id="H5001B80CD1CE4BCAA000EA914BAE7C9C"><enum>(iv)</enum><text>If a single contract involves multiple entries, an identification of all the items required to be listed under clause (iii) that are included in each individual shipment.</text> </clause></subparagraph></paragraph></subsection>
<subsection commented="no" id="H6F06207E36764D41981719A606162BFA"><enum>(d)</enum><header>Products covered</header><text>For purposes of determining if a product is covered by the importer declaration program, the President shall be guided by the article descriptions provided in this section.</text> </subsection></section>
<section commented="no" id="H1B55C8863EA64830B277B04C50DB00F7"><enum>805.</enum><header>Export charge determination and publication</header> 
<subsection commented="no" id="H745B18D0467945E2A6705980E488F200"><enum>(a)</enum><header>Determination</header><text>The Under Secretary for International Trade of the Department of Commerce shall determine, on a monthly basis, any export charges (expressed as a percentage of export price) to be collected by a country of export from exporters of softwood lumber or softwood lumber products described in section 804(a) in order to ensure compliance with any international agreement entered into by that country and the United States.</text> </subsection>
<subsection commented="no" id="H49048DCE0D414BFB827F5284833B617C"><enum>(b)</enum><header>Publication</header><text>The Under Secretary for International Trade shall immediately publish<italic></italic> any determination made under subsection (a) on the website of the International Trade Administration of the Department of Commerce, and in any other manner the Under Secretary considers appropriate.</text> </subsection></section>
<section commented="no" id="H48DCBA06C79F47DB8DA6F7A81013F5A4"><enum>806.</enum><header>Reconciliation</header><text display-inline="no-display-inline">The Secretary of the Treasury shall conduct reconciliations to ensure the proper implementation and operation of international agreements entered into between a country of export of softwood lumber or softwood lumber products described in section 804(a) and the United States. The Secretary of Treasury shall reconcile the following:</text> 
<paragraph commented="no" id="HE72517B07FC84DE58DD6F93A604EB67"><enum>(1)</enum><text>The export price declared by a United States importer pursuant to section 803(b)(1) with the export price reported to the United States by the country of export, if any.</text> </paragraph>
<paragraph commented="no" id="HA7B6BDDE8DE74E27A4704478536F8940"><enum>(2)</enum><text>The export price declared by a United States importer pursuant to section 803(b)(1) with the revised export price reported to the United States by the country of export, if any.</text> </paragraph></section>
<section commented="no" id="H4BB122B4F54B4AE0939B29DF452CE7BC"><enum>807.</enum><header>Verification</header> 
<subsection commented="no" id="HB9148BE7D9AB4326AF09994C00B5A065"><enum>(a)</enum><header>In general</header><text>The Secretary of Treasury shall periodically verify the declarations made by a United States importer pursuant to section 803(c), including by determining whether—</text> 
<paragraph commented="no" id="HA461F320CD4A479C004F062B38FA15DF"><enum>(1)</enum><text>the export price declared by a United States importer pursuant to section 803(b)(1) is the same as the export price provided on the export permit, if any, issued by the country of export; and</text> </paragraph>
<paragraph commented="no" id="H3DE45EE515FC4D35A411328CEB003C29"><enum>(2)</enum><text>the estimated export charge declared by a United States importer pursuant to section 803(b)(2) is consistent with the determination published by the Under Secretary for International Trade pursuant to section 805(b).</text> </paragraph></subsection>
<subsection commented="no" id="HCB35A4832CA74730B608F4ACFA02D39F"><enum>(b)</enum><header>Examination of books and records</header> 
<paragraph commented="no" id="H7CFF5A5BD0A345D4A2C2C876B7BCBC28"><enum>(1)</enum><header>In general</header><text>Any record relating to the importer declaration program required under section 803 shall be treated as a record required to be maintained and produced under title V of this Act.</text> </paragraph>
<paragraph commented="no" id="H6E36ABF31B354C16995E1D209D97DAF"><enum>(2)</enum><header>Examination of records</header><text>The Secretary of the Treasury is authorized to take such action, and examine such records, under section 509 of this Act, as the Secretary determines necessary to verify the declarations made pursuant to section 803(c) are true and accurate.</text> </paragraph></subsection></section>
<section commented="no" id="H5F3D91A3EFFC4CEF83D596207EE79B"><enum>808.</enum><header>Penalties</header> 
<subsection commented="no" id="H11956934AEDE45CD00BA81E917E0FCFC"><enum>(a)</enum><header>In general</header><text>It shall be unlawful for any person to import into the United States softwood lumber or softwood lumber products in knowing violation of this title.</text> </subsection>
<subsection commented="no" id="H81865B577F6C4E3800362D56D91DA3D5"><enum>(b)</enum><header>Civil penalties</header><text>Any person who commits an unlawful act as set forth in subsection (a) shall be liable for a civil penalty not to exceed $10,000 for each knowing violation.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="HA4E5F4D52F2F4244AC3BFC44C68A0D0"><enum>(c)</enum><header display-inline="yes-display-inline">Other penalties</header><text display-inline="yes-display-inline">In addition to the penalties provided for in subsection (b), any violation of this title that violates any other customs law of the United States shall be subject to any applicable civil and criminal penalty, including seizure and forfeiture, that may be imposed under such custom law or title 18, United States Code, with respect to the importation of softwood lumber and softwood lumber products described in section 804(a).</text> </subsection>
<subsection commented="no" id="HFA3AC254948743E081DCA2711E85BD3E"><enum>(d)</enum><header>Factors To consider in assessing penalties</header><text>In determining the amount of civil penalties to be assessed <italic></italic>under this section,<italic></italic> consideration shall be given to any history of prior violations of this title by the person, the ability of the person to pay the penalty, the seriousness of the violation, and such other matters as fairness may require.</text> </subsection>
<subsection commented="no" id="H69327380E4E6426AAAD5C8CA66C3728E"><enum>(e)</enum><header>Notice</header><text>No penalty may be assessed under this section <italic></italic>against a person for violating a provision of this title unless the person is given notice and opportunity to make statements, both oral and written, with respect to such violation.</text> </subsection>
<subsection commented="no" id="HBA94E7305F664EF6AB5668B9DA4DADB1"><enum>(f)</enum><header>Exception</header><text>Notwithstanding any other provision of this title, and without limitation, an importer shall not be found to have violated subsection 803(c) if—</text> 
<paragraph commented="no" id="H4536C07E4034424BBEF0D8E2A5BD9E95"><enum>(1)</enum><text>the importer made an appropriate inquiry in accordance with section 803(c)(1) with respect to the declaration;</text> </paragraph>
<paragraph commented="no" id="HB0CBB77E0A864074B44B4400422752DC"><enum>(2)</enum><text>the importer produces records maintained pursuant to section 807(b) that substantiate the declaration; and</text> </paragraph>
<paragraph commented="no" id="H1BD78A6EA76A4826AF00B073B80041A4"><enum>(3)</enum><text>there is not substantial evidence indicating that the importer knew that the fact to which the importer made the declaration was false.</text> </paragraph></subsection></section>
<section commented="no" id="H161CE170D59F42C100CAD800828E93C1"><enum>809.</enum><header>Reports</header> 
<subsection commented="no" id="H235DBD4528B44D9FB2B6D368C7663D6"><enum>(a)</enum><header>Semiannual reports</header><text>Not later than 180 days after the effective date of this title, and every 180 days thereafter, the President shall submit<italic></italic> to the appropriate congressional committees a report—</text> 
<paragraph commented="no" id="H7BF34547386A4666A4AEC7FBD38BD7C2"><enum>(1)</enum><text>describing the reconciliations conducted under section 806, and the verifications conducted under section 807;</text> </paragraph>
<paragraph commented="no" id="HE4F94669186E418092FB53CC5ECEBFFC"><enum>(2)</enum><text>identifying the manner in which the United States importers subject to reconciliations conducted under section 806 and verifications conducted under section 807 were chosen;</text> </paragraph>
<paragraph commented="no" id="HE70E3F217E844AD6B06BC106D3D1F3A8"><enum>(3)</enum><text>identifying any penalties imposed under section 808;</text> </paragraph>
<paragraph commented="no" id="H86B713F06A714CCAAF99A2B9695DC9B3"><enum>(4)</enum><text>identifying any patterns of noncompliance with this title; and</text> </paragraph>
<paragraph commented="no" id="HCBD33530A38D4E699D152924B9EA955"><enum>(5)</enum><text>identifying any problems or obstacles encountered in the implementation and enforcement of this title.</text> </paragraph></subsection>
<subsection commented="no" id="H7BEB3124A2C14EBBA666D634392D1B97"><enum>(b)</enum><header>Subsidies reports</header><text>Not later than 180 days after the date of the enactment of this title, and every 180 days thereafter, the Secretary of Commerce shall provide to the appropriate congressional committees a report on any subsidies on softwood lumber or softwood lumber products, including stumpage subsidies, provided by countries of export.</text> </subsection>
<subsection commented="no" id="H2272DECACA41458AA5210000CCE4A075"><enum>(c)</enum><header>GAO reports</header><text>The Comptroller General of the United States shall submit the following reports to the appropriate congressional committees:</text> 
<paragraph commented="no" id="HF5653FCBD97E48D88213F02E64D4C702"><enum>(1)</enum><text>Not later than 18 months after the date of the enactment of this title, a report on the effectiveness of the reconciliations conducted under section 806, and verifications conducted under section 807.</text> </paragraph>
<paragraph commented="no" id="HC840DF2CEC984FD991A33BB51C29923F"><enum>(2)</enum><text>Not later than 12 months after the date of the enactment of this title, a report on whether countries that export softwood lumber or softwood lumber products to the United States are complying with any international agreements entered into by those countries and the United States.</text> </paragraph></subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection commented="no" id="HE64C0A181C674AA8B84DE7D541BE281C"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date that is 60 days after the date of the enactment of this Act.</text> </subsection></section></subtitle></title><after-quoted-block>.</after-quoted-block></quoted-block> </section>
