		<section id="id9AAB1E4412BC48CA8755C973DA19C65C" section-type="section-one"><enum>1.</enum><header>Prohibition on using
			 charities for personal or political gain</header>
			<subsection id="idCAB3A57BC9654A2F9B7DB21D3A8234ED"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Rule XXXVII of the
			 Standing Rules of the Senate is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="idA9D1FC011C934ACF8313B7EE3B30240E" style="OLC">
					<subsection id="id12932C46042F4C6C88AA597E135AAA34"><enum>13.</enum><text>(a) A Member of
				the Senate shall not use for personal or political gain any
				organization—</text>
						<paragraph id="id6852FDF431394220A03BB9172DEA158C"><enum>(1)</enum><text>which is
				described in section 501(c)(3) of the Internal Revenue Code of 1986 and exempt
				from tax under section 501(a) of such Code; and</text>
						</paragraph><paragraph id="idF104A0570966400F9871BE12F519978D"><enum>(2)</enum><text>the affairs over
				which such Member or the spouse of such Member is in a position to exercise
				substantial influence.</text>
						</paragraph></subsection><subsection id="idD57C908846594DD680B847ACF203005E"><enum>(b)</enum><text>For purposes of
				this paragraph, a Member of the Senate shall be considered to have used an
				organization described in subparagraph (a) for personal or political gain
				if—</text>
						<paragraph id="ID71e8ab80022347a987027b87631483e6"><enum>(1)</enum><text>a member of the
				family (within the meaning of section 4946(d) of the Internal Revenue Code of
				1986) of the Member is employed by the organization;</text>
						</paragraph><paragraph id="ID9b2d51f56f624f339040ee0cccbe85ac"><enum>(2)</enum><text>any of the
				Member’s staff is employed by the organization;</text>
						</paragraph><paragraph id="ID590cf037bd6b4de7a3dd9f36663f0b99"><enum>(3)</enum><text>an individual or
				firm that receives money from the Member’s campaign committee or a political
				committee established, maintained, or controlled by the Member serves in a paid
				capacity with or receives a payment from the organization;</text>
						</paragraph><paragraph id="IDe1d7b6acbd334deba25562bae8bd636f"><enum>(4)</enum><text>the organization
				pays for travel or lodging costs incurred by the Member for a trip on which the
				Member also engages in political fundraising activities; or</text>
						</paragraph><paragraph id="ID9f6b33aff5f34605b06a3cd6bd4bc486"><enum>(5)</enum><text>another
				organization that receives support from such organization pays for travel or
				lodging costs incurred by the Member.</text>
						</paragraph></subsection><subsection id="id6846FFF16AFE4D69BD3D539B2A734267"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idFCF366E8AA0F4045B5A758896A36AFFC"><enum>(1)</enum><text>A Member of the Senate
				and any employee on the staff of a Member to which paragraph 9(c) applies shall
				disclose to the Secretary of the Senate the identity of any person who makes an
				applicable contribution and the amount of any such contribution.</text>
						</paragraph><paragraph id="idDB2C20C4920B492A89D907D12E907DB8" indent="up1"><enum>(2)</enum><text>For purposes of this subparagraph, an
				applicable contribution is a contribution—</text>
							<subparagraph id="id8C1E344129584CCC8DCC0865CE53116D"><enum>(A)</enum><text>which is to an organization described
				in subparagraph (a);</text>
							</subparagraph><subparagraph id="id3C450A429FD54BD7A45D80519A026660"><enum>(B)</enum><text>which is over $200; and</text>
							</subparagraph><subparagraph id="id7542445037EF4858BB0652609551FF96"><enum>(C)</enum><text>of which such Member or employee, as
				the case may be, knows.</text>
							</subparagraph></paragraph><paragraph id="id1794D265619844DC862F5560F86AF9BE" indent="up1"><enum>(3)</enum><text>The disclosure under this
				subparagraph shall be made not later than 6 months after the date on which such
				Member or employee first knows of the applicable contribution.</text>
						</paragraph><paragraph id="id0AD9758083C34F4E965999FF1945AD4B" indent="up1"><enum>(4)</enum><text>The Secretary of the Senate shall
				make available to the public all disclosures filed pursuant to this
				subparagraph as soon as possible after they are received.</text>
						</paragraph></subsection><subsection id="id357AFFE06C6148F7A05BCD2B8E0412C0"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id0BEDF6EFE97A4C9AB5259AEC3109D582"><enum>(1)</enum><text>The Select Committee on
				Ethics may grant a waiver to any Member with respect to the application of this
				paragraph in the case of an organization which is described in subparagraph
				(a)(1) and the affairs over which the spouse of the Member, but not the Member,
				is in a position to exercise substantial influence.</text>
						</paragraph><paragraph id="id5D87FA6AA05F490EB417994944F31213" indent="up1"><enum>(2)</enum><text>In granting a waiver under this
				subparagraph, the Select Committee on Ethics shall consider all the facts and
				circumstances relating to the relationship between the Member and the
				organization, including—</text>
							<subparagraph id="id8BD71FB2BEF74BA5AC609493970E58EC"><enum>(A)</enum><text>the independence of the Member from
				the organization;</text>
							</subparagraph><subparagraph id="id8CF716F7705A4C1D972AC1C8D72EE529"><enum>(B)</enum><text>the degree to which the organization
				receives contributions from multiple sources not affiliated with the
				Member;</text>
							</subparagraph><subparagraph id="idAD5EF0A00E2E4906AA2EE45FDA7F0A3B"><enum>(C)</enum><text>the risk of abuse; and</text>
							</subparagraph><subparagraph id="id732A878D8DAB414E853EC03A60D8E77A"><enum>(D)</enum><text>whether the organization was formed
				prior to and separately from such spouse's involvement with the
				organization.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idD0737EA1E9F64250866DD1D4200EABB4"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by this section shall take effect on
			 January 1, 2007.</text>
