		<official-title display="yes">To provide a 60 vote point of order against

		  out-of-scope material in conference reports and open the process of earmarks in

		  the Senate.</official-title>

	<resolution-body>

		<section id="id010326616AA64035912506939D7A8E16" section-type="section-one"><enum>1.</enum><header>Out of scope matters in

			 conference reports</header>

			<subsection id="id4F8D1F46D5E1470191B3C47FCB76FB85"><enum>(a)</enum><header>In

			 general</header><text>It shall not be in order in the Senate to consider a

			 conference report that includes any matter not committed to the conferees by

			 either House. A point of order shall be made and voted on separately for each

			 item in violation of this section.</text>

			</subsection><subsection id="idD40A93EC99CF410A906C98E9FEB94165"><enum>(b)</enum><header>Disposition</header><text>If

			 the point of order against a conference report under subsection (a) is

			 sustained, then—</text>

				<paragraph id="ID9AA4CF803DAA48378B61C9AD87187433"><enum>(1)</enum><text>the matter in

			 such conference report shall be deemed to have been struck;</text>

				</paragraph><paragraph id="IDA4543F073A8B486CA18C89F5F305B097"><enum>(2)</enum><text>when all other

			 points of order under this section have been disposed of—</text>

					<subparagraph id="ID246CD20A71B2457D8E4B8FEAB3717BAA"><enum>(A)</enum><text>the Senate shall

			 proceed to consider the question of whether the Senate should recede from its

			 amendment to the House bill, or its disagreement to the amendment of the House,

			 and concur with a further amendment, which further amendment shall consist of

			 only that portion of the conference report not deemed to have been

			 struck;</text>

					</subparagraph><subparagraph id="ID921A381006054B189B99A3BF7500CDC7"><enum>(B)</enum><text>the question

			 shall be debatable; and</text>

					</subparagraph><subparagraph id="ID25DD5E8255EF49B2BC8937EC28C6EF56"><enum>(C)</enum><text>no further

			 amendment shall be in order; and</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3270262C557C40808F4BC270CCE46813"><enum>(3)</enum><text>if the Senate

			 agrees to the amendment, then the bill and the Senate amendment thereto shall

			 be returned to the House for its concurrence in the amendment of the

			 Senate.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID401016AC802E43DDB454622F645A1869"><enum>(c)</enum><header>Supermajority

			 Waiver and Appeal</header><text>This section may be waived or suspended in the

			 Senate only by an affirmative vote of <fraction>3/5</fraction> of the Members,

			 duly chosen and sworn. An affirmative vote of <fraction>3/5</fraction> of the

			 Members of the Senate, duly chosen and sworn, shall be required in the Senate

			 to sustain an appeal of the ruling of the Chair on a point of order raised

			 under this section.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="idDE63B54266AA44FCB6DD858F87CD7F67"><enum>2.</enum><header>Earmarks</header>

			<subsection id="idE8CFE83D7C35474C85401B51B44A1112"><enum>(a)</enum><header>Honesty in

			 earmarks</header><text display-inline="yes-display-inline">Rule XVI of the

			 Standing Rules of the Senate is amended by adding at the end the

			 following:</text>

				<quoted-block display-inline="no-display-inline" id="idFCCEE1BFD551421A9A841FC427B005E1" style="OLC">

					<subsection id="id397E0D81A9D54D688092C4BD63DF6045"><enum>10.(a)<?LEXA-Enum 10.(a)?></enum><text>In this paragraph, the term

				<term>earmark</term> means a provision that specifies the identity of an entity

				to receive assistance and the amount of the assistance.</text>

					</subsection><subsection id="id60A1B7F2E7624090871028592DA80261"><enum>(b)<?LEXA-Enum (b)?></enum><text>It shall not be in order to consider any bill or

				amendment between the Houses or conference report on such a bill unless a list

				of—</text>

						<paragraph id="id9DC0E8F88A0B47E19FD16295112C6F1A"><enum>(1)</enum><text>all earmarks in

				such measure;</text>

						</paragraph><paragraph id="id829BEFDE1FB749078F06ACAAB39C170E"><enum>(2)</enum><text>an identification

				of the member who proposed the earmark; and</text>

						</paragraph><paragraph id="id3834AB5F23C54509AA3D9AE29C3619CD"><enum>(3)</enum><text>an explanation of

				the essential governmental purpose for the earmark;</text>

						</paragraph><continuation-text commented="no" continuation-text-level="subsection">are available to all Members and

				made available to the general public by means of the Internet for at least 24

				hours before its

				consideration.</continuation-text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="idD6C64C8486FE4F4CADBB5446BF095B0E"><enum>(b)</enum><header>Member

			 requests</header><text>Prior to the consideration of a bill in the Senate, any

			 Member who requests an earmark in the bill shall file a copy of the request

			 with the Secretary of the Senate and the request shall be printed in the

			 Congressional Record.</text>

			</subsection></section><section id="idBFEFCE7E87014B9D8F0C19A70A547A48"><enum>3.</enum><header>Availability of

			 conference reports on the internet</header><text display-inline="no-display-inline">Rule XXVIII of all the Standing Rules of the

			 Senate is amended by adding at the end the following:</text>

			<quoted-block display-inline="no-display-inline" id="idE4922D83D0DC428BB33D53795B4DDA44" style="OLC">

				<subsection id="id3788D6BBDC0F4419AD8495267652DA9C"><enum></enum><text>9. It shall

				not be in order to consider a conference report unless such report is available

				to all Members and made available to the general public by means of the

				Internet for at least 24 hours before its

				consideration.</text>
