		<official-title>To authorize the Secretary of the Interior to contract

		  with the city of Cheyenne, Wyoming, for the storage of the city’s water in the

		  Kendrick Project, Wyoming.</official-title>

		<section id="ID7C6FFDC4C7104D9B8CD975F1BF93EFB2" section-type="section-one"><enum>1.</enum><header>Water storage

			 contracts</header>

			<subsection id="IDBF251E32E9FF43D8808A7FBE655BD3D1"><enum>(a)</enum><header>Definitions</header><text>In

			 this Act:</text>

				<paragraph id="ID8E03E67DB3094505A809EB61AB33064C"><enum>(1)</enum><header>City</header><text>The

			 term <term>city</term> means—</text>

					<subparagraph id="ID200F0DE6103F42CC8118959DC9CB42D8"><enum>(A)</enum><text>the city of

			 Cheyenne, Wyoming;</text>

					</subparagraph><subparagraph id="ID9B09ECF86B37418C9A4A44CF0F73FCB2"><enum>(B)</enum><text>the Board of

			 Public Utilities of the city; and</text>

					</subparagraph><subparagraph id="ID47B507263D9143B0B117B6326B1F5EE5"><enum>(C)</enum><text>any agency,

			 public utility, or enterprise of the city.</text>

					</subparagraph></paragraph><paragraph id="ID84BFCE39D2D54FC0B8D4BFCA1AEA04AE"><enum>(2)</enum><header>Kendrick

			 Project</header><text>The term <term>Kendrick Project</term> means the Bureau

			 of Reclamation project on the North Platte River that was authorized by a

			 finding of feasibility approved by the President on August 30, 1935, and

			 constructed for irrigation and electric power generation, the major features of

			 which include—</text>

					<subparagraph id="ID675D14C1D4404E49A569B18DE2DBC48D"><enum>(A)</enum><text>Seminoe Dam,

			 Reservoir, and Powerplant; and</text>

					</subparagraph><subparagraph id="ID2DF74306D1604DAD997209F66F1A615B"><enum>(B)</enum><text>Alcova Dam and

			 Powerplant.</text>

					</subparagraph></paragraph><paragraph id="ID98851810BBB0469FAED961380FF35418"><enum>(3)</enum><header>Secretary</header><text>The

			 term <term>Secretary</term> means the Secretary of the Interior, acting through

			 the Commissioner of Reclamation.</text>

				</paragraph><paragraph id="ID6F551F724A0443D1B7C98CD1F419236D"><enum>(4)</enum><header>State</header><text>The

			 term <term>State</term> means the State of Wyoming.</text>

				</paragraph></subsection><subsection id="ID6A1DA7CD8F5C4C6FA312F811399F4B0A"><enum>(b)</enum><header>Contracts</header>

				<paragraph id="ID8DB6308769BD4238994F86E0C9F02B13"><enum>(1)</enum><header>In

			 general</header><text>The Secretary may enter into 1 or more contracts with the

			 city for annual storage of the city’s water for municipal and industrial use in

			 Seminoe Dam and Reservoir of the Kendrick Project.</text>

				</paragraph><paragraph id="IDCE24C5292FC247B9AF1BDE35C76DD8F5"><enum>(2)</enum><header>Conditions</header>

					<subparagraph id="IDED792FE3D722492A905C8B09CC204AE2"><enum>(A)</enum><header>Term;

			 renewal</header><text>A contract under paragraph (1) shall—</text>

						<clause id="IDEF243FEB7FEE4F0FB61A9FC0FE884B2B"><enum>(i)</enum><text>have a term of

			 not more than 40 years; and</text>

						</clause><clause id="ID7BE5CDC1D6B64400A4A5368E9A3691DC"><enum>(ii)</enum><text>may be renewed

			 on terms agreeable to the Secretary and the city, for successive terms of not

			 more than 40 years per term.</text>

						</clause></subparagraph><subparagraph id="ID4520C8AC8B454833B61D39A98AEC1110"><enum>(B)</enum><header>Revenues</header><text>Notwithstanding

			 the Act of May 9, 1938 (<external-xref legal-doc="statute-at-large" parsable-cite="stat/52/322">52 Stat. 322</external-xref>, chapter 187;

			 <external-xref legal-doc="usc" parsable-cite="usc/43/392a">43 U.S.C.

			 392a</external-xref>)—</text>

						<clause id="ID811786AE2AAF41CC9486A28AFCC2C881"><enum>(i)</enum><text>any

			 operation and maintenance charges received under a contract executed under

			 paragraph (1) shall be credited against applicable operation and maintenance

			 costs of the Kendrick Project; and</text>

						</clause><clause id="ID9B932BE013B548F29E1787FE82E06CCE"><enum>(ii)</enum><text>any other

			 revenues received under a contract executed under paragraph (1) shall be

			 credited to the Reclamation Fund as a credit to the construction costs of the

			 Kendrick Project.</text>

						</clause></subparagraph><subparagraph id="IDE4E5EAFE77B6400B9F232E7D14D66540"><enum>(C)</enum><header>Effect on

			 existing contractors</header><text>A contract under paragraph (1) shall not

			 adversely affect the Kendrick Project, any existing Kendrick Project

			 contractor, or any existing Reclamation contractor on the North Platte River

			 System.</text>

					</subparagraph></paragraph></subsection></section></legis-body>
