		<official-title>To restore safety to Indian women.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Restoring Safety to Indian Women

			 Act</short-title></quote>.</text>

		</section><section id="id6BDCC45C6EBD4AE082E5509C76D48773"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>

			<paragraph id="IDd0a128b041b04656905618006460c31d"><enum>(1)</enum><text>national studies

			 indicate that Indian women experience domestic and sexual assaults at a far

			 greater rate than other groups of women in the national population;</text>

			</paragraph><paragraph id="IDe6ca4963a5f444498ad13112e5b26e36"><enum>(2)</enum><text>there is

			 relatively little data on the rate of domestic violence perpetrated upon Indian

			 women in Indian country or the costs associated with responding to acts of

			 domestic violence in Indian country;</text>

			</paragraph><paragraph id="ID2af6349d00a34206a080e735ec6c3a3f"><enum>(3)</enum><text>Indian tribes

			 have criminal jurisdiction to prosecute Indians who commit violations of tribal

			 law;</text>

			</paragraph><paragraph id="ID7caa2d2212b24fd6b7f0a81951369e6b"><enum>(4)</enum><text>the Federal

			 Government has jurisdiction to prosecute specific enumerated crimes that arise

			 in Indian country under section 1153 of title 18, United States Code (commonly

			 known as the Major Crimes Act);</text>

			</paragraph><paragraph id="idA7A4CCCF3D7745CBB496395A449C3EBD"><enum>(5)</enum><text>the Major Crimes

			 Act does not include provisions to provide Federal prosecutors the ability to

			 prosecute domestic violence assaults unless they rise to the level of serious

			 bodily injury or death;</text>

			</paragraph><paragraph id="ID9a814d55a40346b5a11b5da5daa27abf"><enum>(6)</enum><text>national studies

			 conducted by law enforcement organizations show that domestic violence

			 disturbance calls are the most dangerous situations and pose the highest risk

			 to responding law enforcement officers;</text>

			</paragraph><paragraph id="ID0440351a770341fd83fdc4127399577c"><enum>(7)</enum><text>the limited

			 arrest authority of the Bureau of Indian Affairs and Indian tribal law

			 enforcement agencies impacts the ability of law enforcement to properly respond

			 to acts of domestic violence; and</text>

			</paragraph><paragraph id="ID782724de50cc49b6bb30779c3bacb1d9"><enum>(8)</enum><text>Federal and

			 tribal prosecutors and law enforcement services are hampered in their efforts

			 to address domestic violence by the lack of available criminal history

			 information for tribal ordinance offenders.</text>

			</paragraph></section><section id="id0CA846A58A6D43C8BC33A661092D6E77"><enum>3.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are as

			 follows:</text>

			<paragraph id="id2A3771D240AF474F908DC72C67F40230"><enum>(1)</enum><text>To obtain data on

			 the rates of domestic violence perpetrated upon Indian women in Indian

			 country.</text>

			</paragraph><paragraph id="idCF2BC3B093E2438086DF9A869FE09AA3"><enum>(2)</enum><text>To close existing

			 gaps in Federal criminal laws to enable Federal, State, and tribal law

			 enforcement, prosecution agencies, and courts to address incidents of domestic

			 violence.</text>

			</paragraph><paragraph id="id3FF57C069E6C4F9E870DA527173FF88F"><enum>(3)</enum><text>To address the

			 public safety concerns experienced by tribal police officers that arise in

			 responding to incidents of domestic violence.</text>

			</paragraph><paragraph id="id88E972ACF69D400DAF4ACFBE515570E0"><enum>(4)</enum><text>To prevent the

			 serious injury or death of Indian women subject to domestic violence.</text>

			</paragraph></section><section id="IDf76b6d9dd6a24d0284f446ebaa5a08c8"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>

			<paragraph id="ID0c9e88f4ed6d4035af641a075584a013"><enum>(1)</enum><header>Attorney

			 general</header><text>The term <term>Attorney General</term> means the Attorney

			 General of the United States.</text>

			</paragraph><paragraph id="IDfa04f84072e242e9ae8461e451e6d8ce"><enum>(2)</enum><header>Secretary</header><text>The

			 term <term>Secretary</term> means the Secretary of the Department of the

			 Interior.</text>

			</paragraph><paragraph id="IDabc83982629a4370ae8769446bc69aca"><enum>(3)</enum><header>Indian

			 tribe</header><text>The term <term>Indian Tribe</term> has the same meaning as

			 in section 4 of the Indian Self-determination and Education Assistance Act (25

			 U.S.C. 450b).</text>

			</paragraph></section><section id="ID5a2c27eeb9c74eb286c43891fe96e9c2"><enum>5.</enum><header>Domestic

			 violence habitual offender</header><text display-inline="no-display-inline">Chapter 7 of title 18, United States Code,

			 is amended by adding at the end the following:</text>

			<quoted-block act-name="" display-inline="no-display-inline" id="idB806B7496510438B8077F18A88F8F0D7" style="USC">

				<section id="ID6550ecad82be43e082bc7256263e6d10"><enum>117.</enum><header>Domestic

				assault by a habitual offender</header>

					<subsection id="id8D01405DED9F407F8F6DB0368B24A97B"><enum>(a)</enum><text>Any person who

				commits a domestic assault within the special maritime and territorial

				jurisdiction of the United States or Indian country and who has a final

				conviction on at least two separate prior occasions in Federal, State, or

				Indian tribal court proceedings for offenses that would be, if subject to

				Federal jurisdiction—</text>

						<paragraph id="ID69dbd533e40d4568b188f91d791e0c27"><enum>(1)</enum><text>any assault,

				sexual abuse, or serious violent felony against a spouse or intimate partner;

				or</text>

						</paragraph><paragraph id="ID4fb9f434d8b74537af91fa487f65ef47"><enum>(2)</enum><text>an offense under

				chapter 110A,</text>

						</paragraph><continuation-text continuation-text-level="subsection">shall be

				fined under this title, imprisoned for a term of not more than 5 years, or

				both, except that if substantial bodily injury results from a violation under

				this section, the offender shall be imprisoned for a term of not more than 10

				years.</continuation-text></subsection><subsection id="IDe3d7a959dc2341d99f209dadc123b7b8"><enum>(b)</enum><text>For purposes of

				this section—</text>

						<paragraph id="ID3788eed8efc149898265fcd65695f33b"><enum>(1)</enum><text>the term

				<term>domestic assault</term> means an assault committed by a current or former

				spouse, parent, child, or guardian of the victim, by a person with whom the

				victim shares a child in common, by a person who is cohabitating with or has

				cohabitated with the victim as a spouse, parent, child, or guardian, or by a

				person similarly situated to a spouse, parent, child, or guardian of the

				victim;</text>

						</paragraph><paragraph id="IDce199b39f1f6495dbc52efe90cf124e5"><enum>(2)</enum><text>the term

				<term>final conviction</term> means the final judgment on a verdict of finding

				of guilty, a plea of guilty, or a plea of nolo contendere, but does not include

				a final judgment which has been expunged by pardon, reversed, set aside, or

				otherwise rendered void;</text>

						</paragraph><paragraph id="ID31954799497a40a38aa3e556ff74cde0"><enum>(3)</enum><text>the term

				<term>order of protection</term> has the meaning given to such term by section

				2265(b);</text>

						</paragraph><paragraph id="ID706de9b685284479a216bf14815bceb3"><enum>(4)</enum><text>the term

				<term>serious violent felony</term> has the meaning given to such term by

				section 3559(c)(2)(F);</text>

						</paragraph><paragraph id="ID786c6d34718e4e6c8a8c27400da77496"><enum>(5)</enum><text>the term

				<term>State</term> has the meaning given to such term by section

				3559(c)(2)G);</text>

						</paragraph><paragraph id="ID28c8a33d97d447aba1e5ac5b6c9b39f1"><enum>(6)</enum><text>the term

				<term>substantial bodily injury</term> has the meaning given to such term by

				section 113(b)(1); and</text>

						</paragraph><paragraph id="ID57059e1a86c843e0bf22e52f6c25038c"><enum>(7)</enum><text>the term

				<term>sexual abuse</term> has the meaning given to such term by section

				2242.</text>

						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section id="ID7e9bfcdf70394a17a53f5394408f791c"><enum>6.</enum><header>Enhanced arrest

			 authority</header><text display-inline="no-display-inline">Section 4 of the

			 Indian Law Enforcement Reform Act (25 U.S.C. 2803) is amended—</text>

			<paragraph id="idDBD47BC734974DE4A32D4816CDAB8AA6"><enum>(1)</enum><text>in paragraph

			 (2)(A), by striking <quote>, or</quote> and inserting <quote>; or</quote>;

			 and</text>

			</paragraph><paragraph id="id989CD822536848CE82BB9D827E7F0366"><enum>(2)</enum><text>in paragraph

			 (3)—</text>

				<subparagraph id="id37D080B871DD4C63972D3FAFAAA6B9AB"><enum>(A)</enum><text>in subparagraph

			 (A), by striking <quote>, or</quote> and inserting a semi-colon;</text>

				</subparagraph><subparagraph id="id2B7A48DFC78B4330A6877A41E082D906"><enum>(B)</enum><text>in subparagraph

			 (B), by adding <quote>or</quote> at the end; and</text>

				</subparagraph><subparagraph id="id501097A619D7455F84BEA57FEEE53ABE"><enum>(C)</enum><text>by adding at the

			 end the following:</text>

					<quoted-block display-inline="no-display-inline" id="idD3C8913B429B4FAC929D2273D93A0A85" style="OLC">

						<subparagraph id="id8BF83175E9244226B3284F2E8DF5B795"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="id160B750B0F044EBFBEAC167318109AD0"><enum>(i)</enum><text>the offense is a

				misdemeanor offense of domestic violence (as defined in section 117 of title

				18, United States Code); and</text>

							</clause><clause id="id73ED524FE82543AB84B1A770F21D341D" indent="up1"><enum>(ii)</enum><text>the employee has reasonable

				grounds to believe that the person to be arrested has committed, or is

				committing, the

				offense;</text>

							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</subparagraph></paragraph></section><section id="ID03f41fb2272c43ab80b197307cb7dc8b"><enum>7.</enum><header>Criminal records

			 database pilot project</header>

			<subsection id="id4590459A0D69441886F6885EBD5CCE8B"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Attorney General

			 shall make grants available pursuant to section 2001(b) of the Omnibus Crime

			 Control and Safe Streets Act of 1968 (42 U.S.C. 3796gg(b)) to Indian tribes for

			 the development of tribal criminal history databases to document final

			 convictions of tribal domestic violence court adjudications, orders of

			 protection, stay away orders, and such other domestic violence criminal

			 history.</text>

			</subsection><subsection id="id2C7E78A22A4E43A2BDFEBACD000EF010"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">A database developed under subsection (a)

			 shall include—</text>

				<paragraph id="ID85017220f4df44099e6b1e467666ce11"><enum>(1)</enum><text>final convictions

			 by a tribal court order;</text>

				</paragraph><paragraph id="idBE2C61E2D35B4CE6A69EE72F43E952C2"><enum>(2)</enum><text>orders of

			 protection that are currently in effect and meet the requirements of section

			 2265(b) of title 18, United States Code;</text>

				</paragraph><paragraph id="ID3cc7d908de3244c9aa846c4e5a1f7732"><enum>(3)</enum><text>a means to

			 provide tribal, Federal, and State law enforcement agencies with access to the

			 information in the database; and</text>

				</paragraph><paragraph id="ID05e730d1b289446489bf417345895fcd"><enum>(4)</enum><text>safeguards to

			 prevent the dissemination of the information contained therein for other than a

			 criminal justice or law enforcement purpose.</text>

				</paragraph></subsection></section><section id="ID1ad8bb2c51a44d7283a6badd008d2b1d"><enum>8.</enum><header>Study of

			 domestic violence in Indian country</header>

			<subsection id="idC7DCA690163A4D2893F0BBC30F94233E"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Attorney General,

			 in consultation with the Secretary, the Director of the Indian Health Service,

			 and Indian tribes, shall conduct a study on the incidents of domestic violence

			 in Indian country.</text>

			</subsection><subsection id="idB6CF60B6185747BFA99A455A82F4C44F"><enum>(b)</enum><header>Contents</header><text>The

			 study conducted under subsection (a) shall—</text>

				<paragraph id="id9690873CBCBF4983A28E8185D70681A8"><enum>(1)</enum><text>determine the

			 extent of domestic violence in Indian country and its causes; and</text>

				</paragraph><paragraph id="id2BFC3042D39E461BAC0032E0C391DCE7"><enum>(2)</enum><text>identify

			 obstacles to—</text>

					<subparagraph id="id13A71104A38F417A9EE20ECA84DF7C0D"><enum>(A)</enum><text>the prevention of

			 incidents of domestic violence;</text>

					</subparagraph><subparagraph id="id945EEAEBF0634375A7EF09DE134F07A4"><enum>(B)</enum><text>the appropriate

			 response to incidents of domestic violence;</text>

					</subparagraph><subparagraph id="idF94ADB06EEED4E77BF2F44D023096B59"><enum>(C)</enum><text>adequate

			 treatment for victims of domestic violence; and</text>

					</subparagraph><subparagraph id="idB61D341DE7324B75B292F0C2DEDB47A5"><enum>(D)</enum><text>criminal

			 prosecution of domestic violence offenders.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6C38EDFBC198460CAB6035591764A282"><enum>(c)</enum><header>Report

			 </header><text display-inline="yes-display-inline">Not later than 1 year after

			 the date of enactment of this Act, the Attorney General shall transmit to

			 Congress a report regarding the study conducted under this section. This report

			 shall include recommendations, including legislative recommendations, to

			 address domestic violence in Indian country.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id409882BF70204DE5BD372BA7BAA54AC0"><enum>(d)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated such

			 sums as are necessary to carry out this section.</text>

			</subsection></section><section id="id4BCFE51475F349A1A653CFA92F68AEEC"><enum>9.</enum><header>Conforming

			 amendments</header><text display-inline="no-display-inline">Section 2001(b) of

			 the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3796gg(b)) is

			 amended—</text>

			<paragraph id="id37A9E1869B1E484BB645A4E2A55E3B3C"><enum>(1)</enum><text>in paragraph

			 (10), by striking <quote>and</quote> after the semicolon;</text>

			</paragraph><paragraph id="idAC06C59697F94C2490668A58D9F122C8"><enum>(2)</enum><text>in paragraph

			 (11), by striking the period and inserting <quote>; and</quote>; and</text>

			</paragraph><paragraph id="id3E052FC8C32B476EA00F7716C43AE603"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

				<quoted-block display-inline="no-display-inline" id="id02164566C9504A5AAA3E52358DA4D907" style="OLC">

					<paragraph commented="no" display-inline="no-display-inline" id="id589C65A4A1F4431893E6EF18172ACCE8"><enum>(12)</enum><text>to develop

				tribal domestic violence criminal history databases for use by Indian tribal

				courts and tribal, State, and Federal law enforcement officers engaged in a law

				enforcement

				function</text>
