		<official-title display="yes">To provide state and local governments with

		  financial assistance that will increase their ability and effectiveness in

		  monitoring convicted sex offenders by developing and implementing a program

		  using global positioning systems to monitor convicted sexual offenders or

		  sexual predators released from confinement.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Sexual Predator Effective Monitoring

			 Act of 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="id93D57A75F81D4471BFAC7B8E844E3A28" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="ID6160a6dce4134e558e35cb9867347903"><enum>(1)</enum><text display-inline="yes-display-inline">in recent years we have seen multiple cases

			 of convicted sexual offenders serving probation abducting and murdering young

			 children;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb4871067df4149f386b084d5494a3e2b"><enum>(2)</enum><text display-inline="yes-display-inline">several states have begun the development

			 and implementation of outfitting convicted sexual offenders with Global

			 Positioning Systems to track their movements while on probation;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID30fb2b49a9c241e695f569a525aa9613"><enum>(3)</enum><text display-inline="yes-display-inline">the employment of these devices will assist

			 law enforcement in tracking the movements and location of probationers in real

			 time to within 10 ft. of their location;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID16a0646bfef64631beeb5bb6cad59b18"><enum>(4)</enum><text display-inline="yes-display-inline">Global Positioning System tracking will

			 permit law enforcement to ensure that convicted sex offenders do not go to

			 areas restricted according to the terms of their probation;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID09755a384bfe402884fb95120c970451"><enum>(5)</enum><text display-inline="yes-display-inline">Global Positioning Systems will serve to

			 deter sexual predators from re-offending as they will know that their movements

			 are monitored and tracked by law enforcement; and</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa616704ae11848fbb029643d531c862e"><enum>(6)</enum><text display-inline="yes-display-inline">in the event that a convicted sexual

			 offender commits an additional sex offense while on probation and monitored

			 with a Global Positioning System, the Global Positioning System technology will

			 aid law enforcement in the investigation of these crimes by quickly determining

			 the location of sexual offenders within the area of the suspected crime.</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id057080850C364EB3B5C561AEB167AA74" section-type="subsequent-section"><enum>3.</enum><header>Sexual predator

			 monitoring program</header>

			<subsection commented="no" display-inline="no-display-inline" id="id71B1975B147C4821859AD01D985A9944"><enum>(a)</enum><header>Grants

			 authorized</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id1E500770B52243619B7A6335331058AE"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Attorney General

			 is authorized to award grants and contracts to State and local governments to

			 assist such States and local governments in—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id62428C408AA74C6C960E81FBD7FACC31"><enum>(A)</enum><text display-inline="yes-display-inline">carrying out programs to outfit sexual

			 offenders with electronic monitoring units; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4F1FB1B1D0484E648244DC4F88810BF7"><enum>(B)</enum><text display-inline="yes-display-inline">the employment of law enforcement officials

			 necessary to carry out such programs.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF9E2372BA182409C911DA992CC718E0B"><enum>(2)</enum><header>Duration</header><text display-inline="yes-display-inline">The Secretary shall award grants under this

			 Act for a period not to exceed 3 years.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idF3D8B3F2D0A5442B89A3A887AC205C60"><enum>(b)</enum><header>Application</header>

				<paragraph commented="no" display-inline="no-display-inline" id="idA88FF66845A947B3986F8AC09C89B954"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Each State or local

			 government desiring a grant under this Act shall submit an application to the

			 Attorney General at such time, in such manner, and accompanied by such

			 information as the Attorney General may reasonably require.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id39D2045392C649E19CC4112BD8C35A68"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">Each application submitted pursuant to

			 paragraph (1) shall—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id34D1079637474272AF8E516FFA183395"><enum>(A)</enum><text display-inline="yes-display-inline">describe the activities for which

			 assistance under this Act is sought; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA0E671DB858B40A39CB67606E757143A"><enum>(B)</enum><text display-inline="yes-display-inline">provide such additional assurances as the

			 Attorney General determines to be essential to ensure compliance with the

			 requirements of this Act.</text>

					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idC2FEDBE4DD654C49A5988F6EE138447C" section-type="subsequent-section"><enum>4.</enum><header>Proportional

			 share</header><text display-inline="no-display-inline">The Attorney General

			 shall ensure that each State with eligible programs receives a proportional

			 share of funding under this Act based on the total number of eligible States

			 and the population of sex offenders to be monitored with global positioning

			 systems in those States.</text>

		</section><section commented="no" display-inline="no-display-inline" id="idF8F2D7770B024CD397FD20C4AF94915E" section-type="subsequent-section"><enum>5.</enum><header>Definition</header><text display-inline="no-display-inline">In this Act, the term “sexual offender”

			 means an offender 18 years of age or older who commits a sexual offense against

			 a minor.</text>

		</section><section commented="no" display-inline="no-display-inline" id="idB3B73E1500294DFE92B3EC88050A0B4A" section-type="subsequent-section"><enum>6.</enum><header>Authorization of

			 appropriations</header>

			<subsection commented="no" display-inline="no-display-inline" id="id660A10B2C2FB4C23875FBE0BE136EB8B"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">There are authorized

			 to be appropriated $10,000,000 for fiscal year 2006 and $20,000,000 for fiscal

			 year 2007 to carry out this Act.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idB3FB1C8029E74288813A7825BAECDDC9"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than April 1, 2007, the Attorney

			 General shall report to Congress—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="idF5011447DC8F4452B8CB6A64BE42F229"><enum>(1)</enum><text display-inline="yes-display-inline">assessing the effectiveness and value of

			 this Act; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id747237BBCDED481B96EAFCE012B73CDA"><enum>(2)</enum><text display-inline="yes-display-inline">making recommendations for continuing

			 funding and the appropriate levels for such funding.</text>

				</paragraph></subsection></section></legis-body>
