		<official-title>To increase the role of the Secretary of Transportation

		  in administering section 901 of the Merchant Marine Act, 1936, and for other

		  purposes.</official-title>

		<section id="IDF0F02BF672C24E3DBD287440641C54E4" section-type="section-one"><enum>1.</enum><header>Transportation in american

			 vessels of government personnel and certain cargoes</header><text display-inline="no-display-inline">Paragraph (2) of

			 <external-xref legal-doc="act" parsable-cite="MMA/901(b)">section

			 901(b)</external-xref> of the <act-name parsable-cite="MMA">Merchant Marine

			 Act</act-name>, 1936 (<external-xref legal-doc="usc" parsable-cite="uscapp/46/1241(b)(2)">46 U.S.C. App.

			 1241(b)(2)</external-xref>), is amended to read as follows:</text>

			<quoted-block act-name="Merchant Marine Act" id="IDD8FB9320A0774CE5A148C99F4DC4314E">

				<paragraph id="ID0A7A038BD90D48639CE3A6B965D18515" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="IDBA215A33687245209D290024FB00AD1D"><enum>(A)</enum><text>Notwithstanding any

				other provision of law, the Secretary of Transportation shall have the sole

				responsibility for designating a program as subject to the requirements of this

				subsection. Each department or agency that has responsibility for a program

				that is designated by the Secretary pursuant to the preceding sentence shall

				administer such program in accordance with regulations promulgated by the

				Secretary.</text>

					</subparagraph><subparagraph id="IDDB48C07261CE47F2BD548B34C1FCB6BE" indent="up1"><enum>(B)</enum><text>The Secretary of Transportation

				shall—</text>

						<clause id="IDE738ABF3CEFA4936AA4B77FD7E2F0062"><enum>(i)</enum><text>conduct an annual review of the

				administration of a program designated pursuant to subparagraph (A) as subject

				to the requirements of this subsection; and</text>

						</clause><clause id="ID8F74AF799D94430CA1ED7F9E1B5CF0B4"><enum>(ii)</enum><text>submit an annual report to Congress

				containing the results of the review described in clause (i).</text>

						</clause><clause id="ID5A2A89176A3F43B398CA02B8812702D4" indent="up1"><enum>(C)</enum><text>The Secretary of Transportation shall

				prescribe regulations—</text>

						</clause><clause id="IDFE5B22D70F584DFC98A23C08736F99ED"><enum>(i)</enum><text>to carry out the provisions of this

				subsection; and</text>

						</clause><clause id="ID48A526DDFA3C4C31868F00BE08229E71"><enum>(ii)</enum><text>to provide penalties and sanctions

				for violation of this subsection.</text>

						</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section id="IDB56379F8EADD4E34A038D9CA83642C54"><enum>2.</enum><header>Conforming cargo

			 preference year to Federal fiscal year</header><text display-inline="no-display-inline">Section 901b of the

			 <act-name parsable-cite="MMA">Merchant Marine Act</act-name>, 1936

			 (<external-xref legal-doc="usc" parsable-cite="uscapp/46/1241f">46 U.S.C. App.

			 1241f</external-xref>) is amended—</text>

			<paragraph id="IDF7D03B72FDE54456B90058C50300AD7E"><enum>(1)</enum><text>in subsection

			 (a)—</text>

				<subparagraph id="ID2952FAF7EC944333B155098339F7EDD7"><enum>(A)</enum><text>by striking

			 paragraph (2); and</text>

				</subparagraph><subparagraph id="IDEFC3F0051A7847F292C73264AEB31DAB"><enum>(B)</enum><text>in paragraph

			 (1)—</text>

					<clause id="IDFFAA7C4DDE304946A4000056A476388B"><enum>(i)</enum><text>by

			 striking <quote>(a)(1)</quote> and inserting <quote>(a)</quote>; and</text>

					</clause><clause id="IDCAD48BBA2D31471DB8FDBD53FC0013D2"><enum>(ii)</enum><text>by

			 striking <quote>specified in subsection (b)</quote> and inserting

			 <quote>exported as described in subsection (b) in a fiscal year</quote>;

			 and</text>

					</clause></subparagraph></paragraph><paragraph id="ID6881B4D682D3439E99CEE85B00B7D1D2"><enum>(2)</enum><text>in subsection

			 (c)(2)—</text>

				<subparagraph id="IDE9F11336E49F47468BB82CC888335321"><enum>(A)</enum><text>by striking

			 <quote>calendar</quote> and inserting <quote>fiscal</quote>; and</text>

				</subparagraph><subparagraph id="ID329F9E99705849338D6468C200152983"><enum>(B)</enum><text>by striking

			 <quote>for 12 month periods commencing April 1, 1986</quote> and inserting

			 <quote>the 12-month period beginning on April 1 of each year before 2003, the

			 18-month period beginning on April 1, 2003, and each 12-month period beginning

			 on October 1 of 2004 and each year thereafter</quote>.</text>
